To ask His Majesty's Government when in early 2024 they intend to consult on the impacts of the July 2023 High Court ruling in Uber Britannia Ltd v Sefton MBC on the VAT treatment of Private Hire Vehicles, as undertaken in paragraph 5.81 of the Autumn Statement 2023.

To ask the Secretary of State for Business and Trade, whether she has made an assessment of the adequacy of support provided to drivers by (a) Uber and (b) other private hire operators.

The Government is unable to comment on individual circumstances or the working practices of individual companies. However, we are clear that everyone deserves to be treated fairly at work and rewarded for their contribution to the economy, both in terms of fair pay and fair working conditions.

An individual’s entitlement to employment rights such as the minimum wage are determined by their employment status (employee, limb (b) worker or self-employed). In 2022, the Government published new employment status guidance, making it easier for businesses to comply with existing regulations and for individuals to understand which employment protections apply to them.

To ask the Chancellor of the Exchequer, with reference to the judgment in the case of Uber Britannia Limited v Sefton Borough Council [2023] EWHC 1975 (KB), what assessment his Department has made of the potential impact of that judgment on the application of VAT on taxi fares.

The Uber Britannia Limited v Sefton Borough Council [2023] EWHC 1975 judgment does not apply to taxis, it only applies to Private Hire Vehicle Operator (PHVO) services.

The VAT rules remain unchanged for PHVO fares. Fares have always been subject to VAT when provided by a VAT registered business who is providing those services as principal. The Government is carefully considering the impact this will have on the sector and passengers.

To ask the Secretary of State for Business and Trade, what steps she is taking to help raise public awareness of the safe purchasing of lithium battery products.

My Department is working with the Home Office, London Fire Brigade and the National Fire Chiefs Council, to raise awareness on this issue. Through the Office for Product Safety and Standards (OPSS), we have been promoting Home Office guidance on safe battery charging practices in the home and we share safety messages via social media. OPSS also recently published a safety notice giving specific advice to consumers. I recently also wrote to major food delivery apps including Uber Eats and Deliveroo, urging them to share important government safety advice on e-bikes and lithium-ion batteries.

Existing legislation requires manufactures to provide relevant safety information with their products. OPSS is also seeking assurances from Online Marketplaces on how they ensure consumers have access to instructions on safe use.
