Commons ChamberLast year, nearly 5,000 spiking incidents were reported to the police in England and Wales, but the real number is likely to be far higher. Spiking is endemic in the night-time economy. Women and girls should be able to go about their business and enjoy nights out without fear. While the Government pay lip service, cases across the country are rising, yet we have no actual reporting system for this heinous crime. When will the Minister do the right thing by victims and make spiking a separate criminal offence?
The Government are looking carefully and speaking to stakeholders about spiking. There are adequate criminal offences for this sort of behaviour, and we have had some quite high-profile convictions. However, the hon. Lady is right to highlight the issue. The Government will review it. Specific funding has been given, and there is better testing. Evidence is important, but we need to get women and girls, and men and boys, to come forward when they have been spiked. Spiking also affects older people; I read a case the other day of someone in their 40s who was spiked. It is essential that we work in this area.

Commons ChamberMy hon. Friend the Member for Hornsey and Wood Green (Catherine West) asked about deep poverty among minority children. I shall repeat the point again: black, Asian and minority ethnic households are twice as likely to be in deep poverty, struggling to afford everyday basics such as food and energy. That is 46% of ethnic minority children living below the breadline. Is the Minister proud of her Government’s record, and will she answer the question that was put by my hon. Friend?
I refer the hon. Lady to my previous answer. We do know that work is the best route out of poverty and the best way to tackle those deep-rooted disadvantages. I recently joined a No.10 roundtable on a mentoring and support pipeline to help understand what is holding people back. No one should be left behind because of their postcode or their background. Mentoring circles at the DWP can make a real difference, particularly to young people who are looking to progress from that deep disadvantage.

Commons ChamberOf course, the health disparities White Paper is important, but work has already started on disparities. As I set out, the NHS has already launched the Core20PLUS5, where the 20% most deprived communities are being targeted with interventions in the five most clinically significant areas. Those are maternity, mental health, respiratory disease, cancer and hypertension. Work has already started, and I know that that is of particular interest in areas such as Stoke.
A new World Health Organisation study, published in The Lancet, found that poorer women in Britain have some of the highest cancer death rates in Europe. Income levels should not be the marker of someone’s chances of getting and dying from cancer. Does the Minister recognise that that is not acceptable, and will she commit to a cross-Government strategy that tackles health inequalities?
I refer the shadow Minister to the work that the Government are already doing. Cancer in particular is one of the five core areas in which we are investing significant resources to diagnose people earlier. She may be interested in the lung cancer detection vans, which go to those communities with the highest incidence rates and poorer outcomes for lung cancer. Some 70% of people with stage 1 or 2 cancer are being detected, significantly improving their life expectancy.

I think this is becoming a continuation of Prime Minister’s questions, so we will leave it at that.
On a point of order, Madam Deputy Speaker, in Prime Minister’s questions the Prime Minister said that the Leader of the Opposition was a supporter of people traffickers. I think that should be taken out of the record.
I thank the hon. Lady for her point of order. Frankly, the level of noise during PMQs meant that it was not possible for the Chair to hear everything, but I understand that the Prime Minister did say, as she says, that the Opposition were on the side of people traffickers. That seems to me—and, I have to say, to the Speaker—to fall well short of the good temper and moderation that should characterise our debates. I say to the Prime Minister and to all Members here that we need to refer to each other in this place in more respectful terms, and I am sure that that spirit will be adopted in the statement to come.

Commons ChamberThat is one reflection among many who sit on the other side of the debate, including those who have looked into this matter in great detail.
Why are the Government still pushing ahead with this reform? If we accept the Secretary of State’s reasoning, it comes down to cost and
“a disproportionate use of valuable judicial resource”.
In reality, however, the cost of Cart reviews is no more than £400,000 a year. That is a drop in the ocean compared with the Ministry of Justice’s overall budget. It is less than the Department for Digital, Culture, Media and Sport spent on its art collection last year. Put another way, the Government Legal Department’s total administrative costs for the last year were £226.7 million, more than 500 times the upper estimate for yearly Cart judicial review costs.
As with clause 1, there could be another, murkier reason that the Government are so keen to abolish Cart judicial reviews. In its press release, the Ministry of Justice said that
“it is expected that the legal text that removes the Cart judgment will serve as a framework that can be replicated in other legislation.”
With those words, the Government let their mask slip. If that is indeed their intention—I look forward to the Lord Chancellor confirming that it is not—that would allow them to insulate whole sections of Government decision making from challenge by members of the public. I am sure that Members on both sides of the House would agree that that would be a truly chilling development. Governments have to be challenged. Governments suffer defeats in the courts. Why would we start to oust Government decisions in other areas, beyond this small but important area of immigration law?
Beyond judicial review, there are several provisions dealing with a shift towards greater use of online procedures and technology. While Labour supports measures that would make the justice system more efficient, we must ensure that no one is left behind and that adequate safeguards are in place to prevent serious injustices. As the Bill currently stands, there is only a vague duty for the Lord Chancellor to provide digital support
“for those who require it”.
Labour feels that a specific commitment to assist digitally excluded individuals would offer better protection. While the creation of an online procedure rule committee is a positive step, the Bill currently puts too much power in the hands of the Lord Chancellor. As it stands, the Lord Chancellor could amend, repeal or revoke any law he feels necessary to create the online procedure rules, and he would only have to consult the Lord Chief Justice and the Senior President of Tribunals before making amendments to them.
The last area I want to address is the coroners court. As with provisions on criminal procedure, any efforts to reduce “unnecessary procedures” or allow for greater online participation must be accompanied with robust protections for those who could be excluded. More fundamentally, there is nothing in the Bill to address the inequality in the inquest system that sees bereaved families denied the legal aid that my hon. Friend the Member for Lewisham, Deptford (Vicky Foxcroft) mentioned earlier, while the state has the benefit of the finest Government lawyers that taxpayers’ money can buy.
Does my right hon. Friend agree that hospital authorities can hire Queen’s Counsel and spend millions of pounds on defending themselves, yet lone individuals cannot even get legal aid following the death of their immediate family? How disgusting is that?

I want to congratulate the great Conservative-controlled council of Bolton on everything that it is doing and continuing to do throughout this pandemic to look after the people of Bolton. I know what incredible work the local officials do, and I thank them very much for it. Since we believe so strongly in local government, as a creature of local government myself, I am proud that we have invested £4.6 billion in supporting local government just so far in this pandemic.

Commons ChamberLet us make no bones about the suggestion that I am not able to be completely critical when I think that things are wrong, both in my party and in the governing party. It is just a shame that quite a lot of the people sitting in front of me know that what has happened over the last two days is wrong, but are too cowardly to say in the House, in public, what they are all saying in the Tea Room. They know what has happened here. It is as if we were kicking out my right hon. and learned Friend the Member for Camberwell and Peckham (Ms Harman). That is what it feels like. I say to those people: the way your party has behaved is an abomination. You have all crowed and given sympathy to me about the problems that we have in the Labour party, but you have just sat by silently while your colleagues have been marched out.
I agree with my hon. Friend about the way in which the Conservative party has treated loyal Members of Parliament. Whatever else night be said, I think it is unheard of in parliamentary history for the whip to be suspended from an MP who has voted against his party. That is a bully-boy tactic.
I entirely agree.
I am going to speak for Brenda in Bristol, although there are plenty of Brendas in Birmingham. I do not think that we should have a general election, and I will not vote for one. I also think that we should not have a conference recess and we should not prorogue Parliament. We are currently involved in a national crisis. This is not a game. This is not some toy that we can play with.

Commons ChamberI thank my right hon. Friend for pointing out that fact about Government borrowing and for highlighting the work we have done for the economy, delivering that balanced approach. I would like to thank my right hon. Friend the Chancellor for the work he has done in delivering that. What does that mean? It means borrowing at its lowest level for 17 years; it means the lowest unemployment since the 1970s, wages growing at their fastest for a decade and debt falling. That is what my Government have delivered: more jobs, healthier finances and an economy fit for the future.
Obviously, I always look at Select Committee reports with care. I commissioned the Augar review of post-18 education funding, and that review has been very clear that more money needs to go into further education and into sixth forms. I want to see that happening. Indeed, I think that, just as my Government have given a priority to the national health service in looking at funding for the future, the next Government should give priority to education so that we can see that money going into further education and sixth forms and ensure that for every young person there is an avenue through education and training that suits them and their talents and gives them the best opportunities for their future.

Commons ChamberFirst, I commend my hon. Friend for the work she is doing in her constituency through the jobs fairs. I absolutely agree with her: it is very important that young people are able to see that there are different routes for them for their futures and different routes into the workplace. Apprenticeships are an important route for some young people. All the apprentices that I meet say that the best thing they have done is take up an apprenticeship, and that was right for them. We want every young person to be able to take the route that is right for them, be it higher education, further education or apprenticeships.
This is an important issue that has been raised by a number of Members from across the House. Our priority is always the safety of patients. Ministers are aware of the new study that has come out. We have a commitment to review any new evidence in this area, and we do that, but we do it by consulting independent scientific experts. Baroness Cumberledge is leading the independent medicines and medical devices safety review. That is expected to examine what happened in the case of Primodos and will determine what further action is needed. I assure the hon. Lady that we will listen very carefully to any recommendations that come out of the review, and of course that study will be looked at very carefully to see what has come out of it.

Commons ChamberI am very pleased to speak in this debate, and I hope that I would be making this contribution regardless of which party was in power. At a reception in your apartments, Mr Speaker, you were asked who were the best ever orators in Parliament. You said that there had been many, but two that you often quoted were the right hon. and learned Member for Rushcliffe (Mr Clarke)—who, sadly, is not in his place today—and the now deceased right hon. Robin Cook. My right hon. Friend the Member for Islington North (Jeremy Corbyn) referred to Robin Cook’s speech this afternoon, and I think it goes to the heart of why we are here today. The role of Parliament is important because there is an element of having to persuade not only one another but the country of our views, our principles and our ideas.
That is an important principle that came out of the very lengthy Chilcot inquiry. I was on the shadow Front Bench during that time, and I had to pinch myself to stop from crying at times because of the pain that was in that report. Today, we have to reflect on what we have learned from the report, not just about the importance of Parliament and our role in scrutinising the Executive, but about two other key elements. One of those involves the need for a plan. My hon. Friend the Member for Wirral South (Alison McGovern) made a fantastic speech yesterday in which she mentioned the cross-party group on Syria and its steadfast commitment to the Syrian people. She spoke about the importance of having a plan, and one of the sticking points over the past week has been the lack of a sense of what we should do next. There has been a sense of “this feels fine for this weekend, but what happens next?”
The second element is the need for high-quality intelligence and evidence. This goes back to what was crudely referred to as the “dodgy dossier”, which has haunted us in our political debates from many years. We still need to ask those questions. Many of us will make no apology for asking questions. That is our job as Back-Bench Members, whatever role we might have.
Does my hon. Friend agree that when someone asks a probing question on these kinds of issues, it is neither fair nor right to accuse that person of being an apologist or a traitor?
I often feel that the language used can prevent us from getting to the goal that we want to achieve. That is certainly the case in relation to questions about peace and war.
It has been mentioned that Lord William Hague committed himself and others to enshrining this kind of an idea in law, in exact legal language, but I understand that he has now changed his mind. Due to other commitments, I did not have time to listen to his contribution this morning, but I will go back and listen to it because I am interested to know why he felt this matter to be pressing when he was in this place and why, now that he is no longer in this place, it is no longer so pressing. We carry a certain mantle on our shoulders as parliamentarians in this House, but I do not think that that sense of responsibility applies in the other place to the same degree. There is not that same sense of the ballot box and the sense of our being pushed here. We have to live up to that responsibility.
In conclusion, there was plenty of time last week to recall Parliament, and I wish that we had had yesterday’s debate—perhaps not with every single security detail—at that point. Many of us could have taken losing a vote—or, indeed, winning a vote. Whatever might have happened with that vote, at least we would have done what we always do, which is to debate, to contend, to get cross, to get sad, or to get happy. We would have done what we do in this place and gone through the Lobby to produce a result for the people we represent.
