My hon. Friend is right, and in conversations I have found that a surprising number of right hon. and hon. Members from across the House were similarly unaware that police forces bear those liabilities. We should be under no illusions that most members of the public are much better informed.

Let me return to the principle of switching to a new-for-old system. From the perspective of public finances, much of the additional cost of such a change can be expected to be offset through savings on spending on the loss adjusters needed to calculate second-hand values. It is much simpler and more efficient to assess the cost of a new replacement product, which is why so much of the insurance industry has moved to such a process.

Was the hon. Gentleman referring to the case in Croydon North of Mr and Mrs Hassan? They had recently bought a dry cleaning business with old dry cleaning machines. It was burned to the ground, but because they were offered only like-for-like funding they could not re-establish their business or get their livelihood going again. They went into serious arrears and were threatened with the loss of their home because they could not pay the mortgage. Surely that is unacceptable and needs to change.

The hon. Gentleman puts his constituents’ case far better than I could, and he is absolutely right. New for old makes sense—it will save time and make the process simpler, fairer and less labour-intensive for local police bodies.

That is precisely what I have been calling on the ABI and other insurance bodies to do leading up to today’s debate.

I turn to the Bill’s provisions on a riot claims bureau. It sets out that the Secretary of State may assume responsibility for managing riot compensation claims. That is appropriate if rioting spreads across more than one police force area, as it did in 2011. It may also be appropriate at the request of a local policing body, particularly in one of the smaller police force areas, should the volume of compensation claims prove challenging to manage and be beyond its capacity. It is not about taking away local policing bodies’ financial autonomy. It is merely about providing capacity, consistency and additional oversight where necessary.

I am grateful to the hon. Gentleman for being so generous with his time. He mentions compensation being paid to victims. Is he aware that when local communities came together to raise and distribute funds to support businesses, families and individuals who had been financially affected by the riots, those funds were then deducted from the more official compensation payments? Does he agree that that was completely wrong and went against the intentions of people who generously donated to help their fellow citizens recover from the terrible circumstances in which they found themselves?

I would certainly hope that money raised to support local communities would be used for that purpose. Of course, we would want to avoid double compensation, with damages being repaid twice so that people were not just put back in an equivalent position to before the riots but received additional payments on top of that. I do not think that that would be appropriate. I do think that after a riot money should be retained more at a community level and invested in rebuilding community cohesion.

The structure of a riot claims bureau would include, in its running and financial decision making, a role for a police and crime commissioner or equivalent, or their designated representative, as well as insurers and loss adjusters. The Bill would allow local policing bodies to place the day-to-day management of claims into the hands of experts in the loss-adjusting profession. That is clearly a better alternative to expecting police forces to retain such responsibility in-house. Companies already have the capacity available to manage major insurance-related incidents, as has been seen in their response to major weather-related events. Moving responsibility for the management of the process to those who understand it best would allow police and crime commissioners to utilise fully industry experts, while retaining full control of the financial decisions for which they are democratically accountable.

The Bill provides, for the first time, cover for some motor vehicles. Understandably, motor insurance and damage to motor vehicles was not considered in the 1886 Act. It is time, nearly 130 years later, to address that. Most insurance companies cover riot damage in comprehensive motor vehicle policies, the type held by the overwhelming majority of the country’s motorists. The Bill would not seek to replace that coverage. The intention is to provide compensation for motorists not covered by comprehensive insurance. Where the vehicle is held in accordance with the law, it would be covered under the Bill: it would cover third-party claims that meet basic minimum legal requirements for insurance, or vehicles that are exempt from requirements for insurance.

Sorry, I am not into zombie movies. It was Mr Melville’s example. They found cars burning and other such things one does not expect to see in Ealing. Bang & Olufsen closed early, as a precautionary measure, but even so, the glass was shattered and the footage attracted many millions of views on YouTube. Ravi found his store in flames. The London fire brigade was in attendance for 24 hours. It was not just the shop; there were flats above as well.

The Bill attempts to redress some of the imbalances in the current legislation and revamp the compensation provisions, as the hon. Member for Dudley South (Mike Wood) described. The existing legislation is on the aged side, if that is not too much of an understatement. Very few statutes—very few anything—dating from 1886 continue completely unaltered today. It was a time when Queen Victoria was on the throne, and I think both Lord Salisbury and Gladstone had turns at being Prime Minister that year. A house dating from 1886 would at the very least have needed a bit of updating: a lick of paint, central heating and other mod cons. Riots in the UK are, thankfully, relatively rare, but the legal framework needs to be brought into the 21st century, as the hon. Member for Dudley South said.

A lot of people called the riots of four years ago the social media, high-tech riots. Some commentators even likened them to the contemporaneous Arab spring, which I think is going a bit far—the riots in Tunisia and those countries had a different cause. To pursue the parallel, if we were updating an 1886 house in line with what the legislation needs, we would need several coats of paint, not just a lick of paint, and total rewiring and heating, with a new boiler and radiators. The cumulative effect is that it becomes too much of a job to stick with the existing structure, so we do need new legislation. It makes perfect sense, and I congratulate the hon. Gentleman on bringing the Bill to the House today, because we need to bring that Victorian legislation kicking and screaming into the present day.

Ealing council’s riot scrutiny panel report from 2012 stated that over 1,000 999 calls were made on 8 August 2011, many of which went unanswered. The report states that there was damage to 100 shops and businesses and that “one supermarket burnt down”—Ealing Green Local, which I referred to. It took 18 months to reopen. It now has half its original footprint and has been rebranded as a SPAR. When the riots happened, I was cowering indoors watching Twitter, but I remember going the next day and seeing an Edwardian turret from the roof structure of that building being lifted away by crane. It was quite surreal.

Ravi outlined what happened in the aftermath and told me what he would like to see in future riot compensation legislation. He said that the insurers had paid out, but that the process was painfully slow. He reckoned that his claim was accelerated somewhat because he knew someone on the inside. That should not be so: we should be a nation above corruption in those things. He pointed out—the hon. Member for Bury North (Mr Nuttall) also made this point—that consequential loss should be covered as well. Ravi said that, at present, compensation covers only fixtures and fittings, whereas he would like loss of earnings to be included.

Ravi’s other point was that the role of the council was relatively limited. Ealing’s report said:

“Feedback on the Council was very positive—the payment of £1,200 was delivered promptly, and the named officer had been in frequent contact with advice and support.”

That is what the council said.

If Ealing is the queen of the suburbs, Croydon is surely the king. There was another role for councils, in the receipt of riot recovery funds. Croydon council—run by the Conservatives at the time—received more than £20 million from the Greater London Authority, spent half of it in an area that was not affected by the riots and left the rest in a bank until the GLA tried to claim it back. Does my hon. Friend agree that there should be a bigger role for communities and victims in overseeing how such funding is spent, so that the worst affected areas can recover faster?

My hon. Friend makes an excellent point. He anticipates what I was going to say about the Ealing example, but he is correct that these decisions should be taken at a local level.

Ravi said that the council was very good initially, but that

“after 18 months their door was closed.”

He also praised police actions after the event, but recognised that their role too was limited. His was a flat with a shop beneath, and both were subject to an arson attack, as in probably the most extreme case, which was in my hon. Friend’s constituency—or was it in Croydon Central?—with the famous picture of the girl jumping out of the burning building.

I am talking about loss of earnings. The store owner, his wife and two kids had to live off their savings for 18 months. It is an extreme case: 18 months is not the norm, and riots are not the norm. We do not usually expect these occurrences. Let us hope they never happen again.

Helen from Bang & Olufsen remarked that the shop front had not been smashed. The video was shared so many times because people were saying that the rioters had been defeated, along the lines of “Hooray: victory against the rioters”. In the end, she faced a bill of £10,000 for the glass splinters. High-end products were involved, as expensive televisions behind the glass were also damaged. Helen’s point was that a cheque had to be written from the firm’s business account, which caused a problem for cash flow afterwards. She said that she had sunk all her savings into the business, which had been open only for six years, and when it started there was a massive recession. The hit to cash flow to pay the glazier was huge. She suggested that a temporary loan would have been helpful in that instance. It was a frightening time for her: she had a little kid and a second one was on the way.

It was not just Reeves Corner that was affected. Nine businesses and 40 flats were destroyed in London road, west Croydon. Some of the businesses had to continue to pay mortgages or rents on properties that had been destroyed, which is enough to put businesses or individuals who are not wealthy in severe financial difficulty. Does my hon. Friend agree that riot compensation should apply to those who have suffered serious losses of that kind?

That is an excellent point. There were the headline cases that got all the attention and went viral, but I believe that the proprietors of many small Asian shops in the London road have been waiting a long time to be compensated. I am not sure whether they have received any compensation yet. We may focus on the headline cases, but these are all tragic stories.

“Proportion”—people will hear how the Home Secretary is trying to spin it. Let us deal in people, shall we, rather than proportions. Between 12,000 and 13,000 officers lost, police community support officers lost, and all at a time when crime is beginning to go up. She wants to take away 22,000 more. I say in all sincerity to the Home Secretary that with crime on the rise this is no time to cut the police.

May I bring to the attention of my right hon. Friend another example of Tory promises? Croydon was hit very hard by the riots in 2011 and the Prime Minister came down days afterwards and promised to keep the area safe. Since then, the Government have allowed every single police station in Croydon North to close down and as of today we still have fewer police on the streets than in 2010, when these people came into government. Is that not yet more Tory broken promises?

Everybody will remember very well the terrible fire and the consequences of the riots on the streets of Croydon. People would expect promises like that to be kept, would they not? But with this Prime Minister and this Government, they are rapidly learning that such things are said in the moment to look good but are not followed through. Sadly, that is the hallmark of this Government.

The Government are sending the police on a dangerous journey without a route map. Where is the White Paper that sets out the case for these drastic changes to the police and the vision for the police service of the future? Where is the expert analysis of the changing nature of crime and society and therefore of the resource needs of the police? In the absence of all that, the only justification put forward by the Government, as we have heard today, is that despite reductions crime has continued to fall. I have dealt with that, Madam Deputy Speaker. I believe that in the last decade the reduction we saw was linked to the investment in neighbourhood policing and we are now beginning to see signs that crime is on the rise again.

The truth is that this whole process is not being driven by our future needs as a society, or by the changing nature of crime; it is a crude, Treasury-driven process that owes more to an ideological drive to shrink the state than to the good governance of the police and our public services. What we will soon be left with is the police service of the Treasury’s dreams but the public’s worst nightmares.

My hon. Friend is absolutely right. There are very good examples of where that is taking place. I referred to Hampshire. Northamptonshire is also doing this, and there are other examples of where there are real opportunities for savings to be made and for a better service to be given to the public as a result.

Secondly, the motion suggests that there is evidence that crime is rising, including increases, in the most recent police recorded crime statistics, in very serious crimes such as knife crime and sexual assault.

I am going to make progress.

The right hon. Member for Leigh and others are right when they say that those crimes are serious, and it is absolutely right that the police are recording more incidents of each, but it is wrong to suggest that an increase in police recording necessarily means more crime in communities. As the independent Office for National Statistics said last month:

“as well as improvements in recording, this is also thought to reflect a greater willingness of victims to come forward to report such crimes.”

Victims of crime—often very vulnerable people who have endured horrendous suffering and torment—are coming forward to tell their stories to the police and to put the perpetrators of their abuse behind bars. Members across this House should welcome that and not seek to manipulate or use it for their own ends. As I said earlier, according to the independent crime survey, crime is down by more than a quarter since 2010.

Thirdly, the right hon. Gentleman says that crime is changing and traditional crimes such as burglary and car theft are being replaced by modern criminality like cybercrime. Crime is indeed changing, but the level of some digital crimes in no way compares with the dramatic falls in conventional volume crimes over the past five to 10 years. Crime survey data also show that the proportion of plastic card users who were victims of fraud is currently around 25% lower than its peak in 2009-10.

This Government have not failed to recognise the changing nature of crime; we have faced up to it. In 2012, we set up the National Crime Agency to lead the fight against serious and organised criminality. In 2014, we brought Action Fraud into the City of London police to better co-ordinate the response to fraud and financial crime. Our national cyber-security programme has invested nearly £900 million in protecting British people, businesses and state assets against cyber-attack. For the first time ever, the Office for National Statistics now publishes an estimate of the number of cybercrimes and frauds experienced by members of the public, making us the first major western country to capture the changing nature of crime.

I want to make progress because I am conscious of those who wish to speak.

However, it is the crux of the motion that I find most troubling—that is, the concern among Opposition Front Benchers that the police may endure spending reductions in the forthcoming comprehensive spending review. As I have said, in the previous Parliament we successfully halved the deficit. In a few weeks’ time, my right hon. Friend the Chancellor of the Exchequer will set out how we will finish that job in the comprehensive spending review. In doing so, he will show that this Government recognise the value of balancing the books, spending within our means, and lowering taxes for hard-working people, because the deficit is still too high, and it is right that police forces share in that effort, as they have done in the past five years. To echo the shadow Home Secretary’s speech to the Labour party conference, savings are still there to be made. The limit of those savings is not the arbitrary 10% that he sets out in his motion. Let us remember that usable financial reserves for police forces in England and Wales stand at just over £2.1 billion right now—built up, in part, to help soften the impact of future spending cuts. These reserves increased by nearly £100 million last year—up in 26 forces across England and Wales. Capital reserves are approximately £240 million in 2014-15—roughly the same as the previous year.

Nor can we forget the extraordinary savings and operational benefits that can be made, as several hon. Friends have said, from better collaboration between forces and effective joint working with other local services. Only last week, Cleveland, Durham and North Yorkshire constabularies announced a £5 million saving by bringing together their dogs units, while still maintaining a 24-hour service across the three forces. There are efficiencies afforded by better technology. Cambridgeshire police have saved an estimated 240,000 officer hours a year and over £7 million by rolling out tablet and mobile devices to officers to allow them to work better on the road and away from the police station.

Given that this Government have actually banned and outlawed 500 legal highs, I do not think it is accurate to say that we have taken no action. We obviously want to move to a general ban on legal highs—lethal highs, as I call them—and that is on the shelf, ready for the new Government.

There is a glaring difference between the Government’s complacency and the City of London police commissioner’s view that online crime is growing exponentially. Does the Minister agree with the Office for National Statistics that if all bank and credit card fraud were included, the statistics would show that overall crime was up by 50%?

I am having a lot of disagreements with the Labour party today. The ONS is working to incorporate measures of cybercrime in the main crime survey. It looked at this issue specifically and said, when it published the latest crime figures, that it had found that although there may have been some movement by criminals into fraud and cybercrime, it certainly had not been enough to offset the substantial falls in traditional crimes, such as burglary and vehicle theft, over the past 20 years. Action Fraud’s reporting is up. That is a specialist reporting agency. We are acting on fraud.

My right hon. Friend makes a good point. Europol is doing very important work to tackle cybercrime—that high-level malware-type crime that can have a major impact on businesses and infrastructure. Through the Serious Crime Bill we are introducing additional offences to tackle the serious misuse of the internet to impact on national infrastructure.

Can the Minister confirm that there are now delays of more than 12 months in processing and investigating some cases of online child abuse that have been reported to the National Crime Agency?

I do not recognise that statistic. The NCA is working very hard, and we have seen from the success of Operation Notarise just what it can achieve. I work closely with it, and I know it takes this issue extremely seriously and it will make sure all crimes are investigated appropriately.

I congratulate the hon. Member for Christchurch (Mr Chope) on securing the debate. However, his Bill is a reminder of the gap between what the Prime Minister’s Eurosceptic Back Benchers demand and what he says.

Only this week, at his joint press conference with Chancellor Merkel of Germany, the Prime Minister confirmed his support for the principle of free movement within the EU. To be fair to Conservative Back Benchers, it must be hard to keep up with the Government’s position. First, it was that the Prime Minister was going to “sort this out”, as he said in his conference speech. Then, there was the great retreat from that position in his pre-Christmas immigration speech. Now, when standing alongside Chancellor Merkel, he talks of his new-found love for freedom of movement.

The gap between the Prime Minister and his Eurosceptic Back Benchers illustrates his plight. No renegotiation in Europe could ever satisfy some of them, other than one leading to Britain’s exit from the EU. Europe does need to change, but the tragedy for Britain is that, since being elected, the Prime Minister has spent more time negotiating with his rebellious Back Benchers than with other EU leaders. His attempts at megaphone diplomacy, such as his ill-fated opposition to the appointment of the new Commission President have left him isolated and, dare I say, humiliated.

Dragging Britain closer to the EU exit door would be damaging enough if that was the Prime Minister’s thought-out strategy. Worse than that, however, he is marginalising Britain in Europe without even thinking it through. A British exit from Europe by default is an even bigger failure of leadership than exit by design.

I have some sympathy with the hon. Gentleman and other speakers on the Government Benches over their disappointment with the Government’s record on immigration. I do not think it is fair to blame that entirely on the Liberal Democrats either, who are a minority in the coalition. The Government have abandoned the Prime Minister’s “no ifs, no buts” immigration target. The chief inspector of borders finds that the Government make no attempt to check potential immigrants’ criminal records. In October last year, the Public Administration Committee found that 50,000 failed asylum seekers have been lost. We do not know where they are. What is needed is not exit from the European Union, but renegotiation, delays before new arrivals can claim benefits, more and properly trained border staff, proper entry and exit checks, and a requirement for applicants to provide criminal records.

What is remarkable about the debate over Europe in the Conservative party is that it thinks speculation about the UK leaving is Europe is costless. It is not. It places a huge question mark over British jobs, rights at work, investment and our place in the world. It is a growing national tragedy that the Prime Minister is too weak to stand up to the Eurosceptics in his party, or to engage our European Union colleagues properly.

The hon. Gentleman is making a very serious point. We are all agreed that we want to stop criminals entering the country. Is he saying that the Labour believes there should be some sort of device by which we can require EU nationals entering this country to prove that they are not guilty of a criminal offence, or some way in which we can prevent criminals from other EU countries coming to this country? Is he saying that?

The Labour party is very keen to negotiate from a position of solidarity with our European Union colleagues. That is what the Labour party would do if elected in a few weeks’ time.

In the meantime, I remain very disappointed that the Prime Minister has failed to engage our European colleagues and the leaders of our fellow EU states in proper negotiations. By failing to do so, he will never secure the improvements that I think Members on all sides of the House would like to see on this issue and in our relationship with the EU.

According to a recent survey of border staff, 98% of them have warned that they do not have enough resources to protect the border effectively. Why is that?

As the hon. Gentleman will know, it is this Government who dealt with the failing UK Border Agency and introduced Border Force and UK Visas and Immigration. My meetings with Border Force officials and guards on the front line are always positive. It is clear to me that those dedicated professionals are doing all that they can to protect our borders, because they understand just how important it is for them to do so. I shall deal shortly with the issue of criminal movement within the European Union and across our borders.

The Immigration (European Economic Area) Regulations 2006 provide for the admission of EEA nationals and their family members and the removal of those who are not entitled to reside, in accordance with European Union law.

While I agree with the thrust of my hon. Friend’s thinking, I believe that parts of the Bill would be unlawful. Its aim is to ensure that the United Kingdom has absolute control over the right to prevent non-UK citizens from entering the UK, and to determine the circumstances in which they may be required to leave. It asserts the absolute sovereignty of the UK in controlling its own borders, notwithstanding our existing international treaty obligations and the domestic legislation that gives effect to them.

The Bill would repeal section 7 of the Immigration Act 1988, which provides the basis on which those exercising European Union rights are not required to obtain leave to enter or remain in the UK under the Immigration Act 1971 and subsequent legislation. Essentially, it seeks to curtail the free movement of EU citizens to the UK under existing treaty rights. The provisions curtailing rights of entry are not compatible with EU free movement rights, and we cannot pass national legislation that does not comply with EU law.

I am happy to do as my hon. Friend suggests and congratulate Thames Valley police on all they have done in reducing crime by 30% in their area, but I also congratulate all police forces that are rising to the challenge of driving efficiency and cutting crime. Effective policing plays a key part in reducing crime, as does tackling the underlying drivers of crime, which this coalition is also doing.

The Minister does not have much to say about card crime, which is up by a quarter, or online banking fraud, which is up by 71%. More and more people shop online, particularly over Christmas and the new year, but Her Majesty’s inspectorate of constabulary found that just 2% of police had any training in cybercrime. When will the Government stop being so complacent about crime that is still rising?

I welcome the hon. Gentleman to his place. Up to now, cybercrime has been a lesser interest. The hon. Gentleman is absolutely right to say that the trend among all people now is to buy online, but I would say that what is illegal offline is also illegal online. Policing cyberspace is just as important as policing the streets, and that is what our police force is doing.

The Government risk sounding very complacent about areas of crime that are still getting worse. Can the Minister explain the Government’s lack of action on violent assaults, which are up by 20% in London over the last year, and online banking fraud, which has soared by 70% nationally?

The national crime agency for banking fraud has been set up and people are, of course, coming forward to report crime when they previously did not.

It is vital to ensure that police officers and local forces understand how to tackle cybercrime and where to report it, and I am very pleased that the College of Policing is providing training for all officers so that they know what to do. As I have said, Action Fraud and other online databases are available, and I know that the police are making sure that they gather the information and share the intelligence.

Is the Minister aware that Her Majesty’s inspector of constabulary has reported that only three police forces in England and Wales have an effective cyber-attack strategy, and that although reported cybercrime is up by about a quarter, the number of prosecutions is down? Why has she allowed that to happen?

The Government take cybercrime extremely seriously. That is why it is a tier 1 national security risk. We have invested £860 million in the national cyber-security strategy, and have so far committed £70 million to the national cyber-security policy to build law enforcement capabilities. It is vital for training to be provided, and the Government are committed to ensuring that it is. The report to which the hon. Gentleman referred represents a view of, as it were, a “snapshot” taken some time ago. We have been working very closely with, in particular, the National Crime Agency to ensure that the issue is addressed and training is given.

The hon. Lady will know that we are looking at the whole issue of out-of-court disposals. We want to reach a position where the use, as she says, of community resolutions is restricted to crimes where this is appropriate, but not for those where such a resolution would damage the public’s confidence in the criminal justice system. I hope she acknowledges that the amount of violent crime in this country is at such a low level now.

Before a prosecution is made, the police first have to record a crime. In Lincolnshire, more than a quarter of all reported rapes are dismissed as “no crime”, compared with a national average of 9%, and there are similarly high rates in other police areas. A police whistleblower claims that officers in some forces pressurise vulnerable victims to drop their allegations to make the crime statistics look better. What action has the Minister taken to explain and reduce the extreme variation in the number of rapes categorised as “no crime” by different police forces?

I agree with the hon. Gentleman’s underlying concern, but I hope he will be reassured that the “no crime” rate for rape has fallen year on year, from 12.6% in 2010 to 9.6% in 2013. At the same time, the Crown Prosecution Service is now achieving its highest ever rape conviction rate, with 63% of prosecutions resulting in successful outcomes and the average custodial length going up 21 months over the past 10 years. Everyone shares the concerns, but the hon. Gentleman should be reassured that the position is actually improving.

I agree with what my hon. Friend has said. Freedom of movement is not and cannot be a freedom to claim benefits. The Government have introduced a series of domestic measures to restrict access to benefits and we are committed to working with our partners to reform the rules on access to benefits, which were designed for a different era and are no longer fit for purpose.

Does the Home Secretary agree with the Institute of Directors that the Immigration Minister’s first major speech in his new job was

“feeble, pathetic and divisive and more about political positioning than what is good for the country”?

Did she see it in advance?

I did not know that I had been promoted but I will obviously answer the hon. Gentleman’s question. There is nothing feeble and weak about an immigration policy that continues to attract the brightest and the best to this country while resolutely focusing on reducing net migration to sustainable levels. That is why our policies are having an effect, reducing net migration from outside the EU by 82,000. What was feeble was the last Government’s failures that let immigration get out of control. It is their mess that this Government continue to sort out and with our reforms cutting non-EU migration to its lowest levels since 1998, we are having an effect.
