To be absolutely clear, child maintenance does not impact on the amount of benefits the receiving parent will get, whether it is paid or not paid. It did under the old system of the Child Support Agency, but it does not under the new system.

That is very good to hear, although it is certainly very different from how the regulations for universal credit were set out at the time. If those regulations are changing, that is good.

However, it remains the case that women who are due to receive child maintenance are not getting the support from the CMS that they need, and it is all too easy for men in general to evade their responsibilities by hiding their money and income, and it then takes years for people to be able to claim that, and for children to receive the support they need, as has been highlighted here today.

The Minister’s team have listened to many cases from my constituency surgeries. We have yet to see decisive action taken against those defendants; I hope that it will be, but we really should not have to meet senior civil servants in the Department in order to get any action taken.

I have gone from being the Secretary of State to potentially not having a job in the next couple of days in the space of one question, but I will look at that letter carefully. I actually agree with the hon. Lady’s point that we want the right decision the first time. We want claimants to be able to access the crucial medical evidence that can assist with assessments. Assessments are right more often than not, and only a small percentage of claims ultimately need to be appealed, but we need to learn lessons wherever there are mistakes, and I will take that case seriously.

I also welcome the ruling, but it is important not just that we get rulings, but that people on PIP get the support that they deserve. I was concerned by the release of figures a couple of weeks ago showing that the Department’s own equality impact assessment expected 14% of the 1.6 million people on PIP who were reviewed after previous court rulings to get an additional award, but just 0.8% of people reviewed have actually received an increase in their entitlement. Will the Minister commit to an urgent audit of what is going on in those reviews to ensure that people affected by this case do not see their awards quashed yet again?

The hon. Lady refers to the mental health estimates, which were done before the final guidance was implemented. We have consulted with Mind and other key stakeholders on the revised guidance, and we will continue to ensure that those who are entitled to additional support get it as quickly as possible. We are on track to complete that work by next year, as initially set out.

I understand the hon. Lady’s passion on this subject. She is right that we should be doing everything we can to protect vulnerable claimants, but I remind her that there have been 4.4 million universal credit claims, that as it stands today there have been 42,000 referrals, each of them very important, and that to put it in context, since January, every month we have had more than 110,000 requests for advance payments.

We will continue to tighten up the procedures, using real-time information, data matching and the digital platforms, so that we are as robust as we can be, but we must not lose sight of ensuring that vulnerable claimants have access to funding as quickly as possible. Nobody in this House would want people not to be able to access vital financial support.

I have been raising this matter with the Minister for some time, and I welcome the fact that he says that claimants who have made a claim in error, or not made one to their knowledge, will not have to repay the advance. Will he also confirm that those claimants will be allowed to return to their legacy benefits, since they have not made a valid claim for universal credit that they are aware of, and that he will deal with these cases much more quickly than the eight weeks that my very vulnerable constituent has been waiting since I first raised this with him?

I pay tribute to the hon. Lady, who raised this case with the Minister for Employment, who is responsible for this area. It helped to focus our minds on what more could be done. Every individual will be treated individually, and we will look at the unique circumstances. Where it is clear that they have been a victim of fraud through no fault of their own, no, we would not expect them to pay it back, and yes, we would consider putting them back on to the legacy benefits if they were better off under those.

The hon. Gentleman highlights the importance of ensuring that claimants do not go without any money, which is why we welcomed the improvements to make advance payments more accessible. Let us remember that, under the complicated six legacy benefits, more than £2.4 billion of benefits were left unclaimed every year, worth an average of £280 per month; that meant that 700,000 of some of the most vulnerable people were missing out on their entitlement.

A constituent of mine who is a single mother with three children was persuaded to apply for a loan to replace her cooker. The loan company took her details and made an application for universal credit on her behalf, unbeknown to her, and claimed a large advance payment that they told her was the loan. When she reported this to the police and to the DWP and asked them to look into her case, they insisted that it was a valid claim for universal credit. She has had her advance payment, and she is left—pregnant, with three young children—with no access to any money until the end of the month. Please will the Minister or the Secretary of State look into this and make sure that vulnerable people cannot be treated in this way?

I know that my hon. Friend works extremely hard in this area; I have made several visits to his constituency, where I have seen him championing local organisations that make a difference to disabled people in his community. Universal credit targets support at those who most need it, which is why, on average, more than a million disabled households will be £100 a month better off.

The severe disability premium does what it says on the tin: it goes to those with the most severe disabilities. Why, then, is the Minister claiming that people who most need support are gaining, when more than 10,000 people entitled to the severe disability premium are now waiting for back payments—like my constituent who is owed nearly £1,000 by the DWP? People are building up rent arrears and are in danger of eviction. Why are the Government not treating them properly by bringing forward this legislation and paying them what they are due?

We are all keen to bring forward those regulations, but I remind the hon. Lady that where under the legacy benefit an ESA claimant would expect £167.05, the equivalent under universal credit will be more than twice that: £336.20 a month.

Universal credit is available in every jobcentre in Wales. Our welfare reforms are incentivising work and supporting working families. In the past 12 months alone, the employment rate in Wales has increased by 3.4 percentage points, the largest increase in any area of the UK.

There are two elements to that. First, it depends on individual circumstances and the impact of factors such as different arrangements in whether people are working, their caring responsibilities, and their health conditions. Secondly, it is about the principle of fairness, in that those of working age should not be accessing pension-related benefits. We should not be taking people of working age out of the workplace. Pensioner poverty continues to stand at one of the lowest rates since comparable records began, and we intend to keep it that way.

Turning to universal credit, in the 2018 autumn Budget statement the Chancellor announced additional assistance for those on universal credit. As such, the universal credit work allowance will increase by £1,000 after they have been increased by prices, helping 2.4 million working families. This measure raises the amount someone can earn before their universal credit payment is reduced and directs additional support to some of the most vulnerable low-paid working families.

Finally, let me turn to disability benefits. This year the Government will continue to make sure that carers and people who face additional costs as a result of their disability will get the additional support they need.

With this uprating order, I am bringing forward plans to increase support for some of the most vulnerable people in society to the tune of £3.5 billion, with £3 billion alone to help those with disabilities and long-term health conditions, and pensioners—key people who the Government, as we share the proceeds of growth, will continue to target support towards. That is why the incomes of the lowest-paid have risen by over £400 in real terms since 2010 while the wealthiest fifth of society have seen their income fall by £800. We recognise the right places to target support through additional measures, including the introduction of the national living wage, worth £2,000 a year, and the increase to the income tax threshold of £1,200.

But we know from announcements in the last two Budgets that spending on working-age benefits will be £2 billion higher than it would have been under the legacy benefits. That is why we now see 300,000 fewer children in absolute poverty, as we continue to target support at the most vulnerable in society.

I am going to make some progress.

In addition, the carer and disability premiums paid with pension credit and working-age benefits, the employment and support allowance support component and the limited capability for work and work-related activity elements of universal credit will increase by 2.4%. Those increases will ensure that our welfare system continues to provide the most support for the people who need it.

In conclusion, in this order the Government propose to spend an extra £3.7 billion in 2019-20 on increasing benefit and pension rates. With this spending, we are upholding our commitment to the country’s pensioners by maintaining the triple lock, helping the poorest pensioners who count on pension credit, ensuring that working people can earn more before their universal credit payment is reduced and providing essential support to disabled people and carers. I commend this order to the House.

What we know is that every region of the UK is seeing more people working. Youth unemployment increased by 45% under the last Labour Government, but it has almost halved under this Conservative Government, and that will continue.

I assume that in claiming that I am attacking policies aimed at job creation, the Minister is referring to the huge cuts in mainstream corporation tax, which I analysed at the Union of Shop, Distributive and Allied Workers when working on some of the major supermarkets. They actually took their corporation tax reduction and refused to even put that amount into wage growth, let alone into jobs. This is not a job creation scheme; it has made profits for shareholders, not for workers.

I thank the hon. Gentleman for his intervention. I am coming on to those. UC dealt with the fact that, for some, there was in effect a 90% tax rate. The well-documented 16, 24 and 30-hour cliff edges were significant barriers for people. It was so confusing and complex that £2.4 billion-worth, we believe, of claims went untaken each year across 700,000 claimants, who were some of the most vulnerable people. My role in the DWP is to represent vulnerable people going through the benefits system and it was often those people who were missing out on money because they were simply unaware that they were entitled to the support that we rightly wanted them to have.

Let me make a bit of progress and I will give way if I have time. The hon. Member for South Shields has raised some important questions and I want to try to cover as many as I can in the limited time. If I can, I will come back to the hon. Lady.

There have already been much needed improvements, partly through the additional £4.5 billion cash boost that has been secured in recent Budgets. There are the changes to advance payments, particularly to make that a part of the discussion in the initial conversation. We have changed repayments from six months to 12 months to 16 months and the rate at which they are done. That is something that we will continue to review. There is the additional, non-repayable two weeks’ housing benefit, worth up to £237, and the recent announcement of an additional two weeks of ESA, JSA or income support, worth up to £200. We have scrapped the seven days’ waiting. There are the alternative payments—direct to landlords—on housing, and more frequent payments where we feel that will help. There is the additional £1,000 work allowance, worth £630, which alone came to £1.7 billion. There is the 12-month exemption from the minimum income floor for the self-employed, and there is the increase in the severe disability premium from £158 to £326.

However, there are areas where we still need to do further work. The hon. Member for South Shields talked about digital by default. I think we do need to look at that. We have alternatives in place, but we also need to be more proactive in recognising those who would need that support. We have to identify vulnerable claimants and a major step was to put in place a formal arrangement—I championed this—with Citizens Advice. It will remain independent of us, it is widely respected and it is best placed to give support, particularly to vulnerable claimants, not just on the digital side, if that is needed, but general support as people navigate the benefits to which they should be entitled.

Building on that, we have to make sure that stakeholders are absolutely key and at the heart of everything we do in training our frontline staff and providing support for claimants. For example, a month before Christmas, I was working very closely with Women’s Aid, Refuge and ManKind, meeting three or four times, so that they could do a root and branch review of the training we do to help to identify potential victims of domestic abuse, update our training manuals and guidance, feed in the feedback they receive from their supporters, and look at the best ways to identify potential victims, refer them to the maximum number of local and national support organisations, and work on the level of support we can offer. That is a principle I would like to see formalised, so that it does not just happen because it is a topical issue; it is a given going forward and we look to do that in many areas.

A lot was said about measures of poverty and what the reality is out there. What we do know is that there are 1 million fewer people in absolute poverty—a record low—including 300,000 children. On the different measures of relative and absolute poverty before and after housing, all are no higher than in 2010 and three are now lower. The average income of the poorest fifth in society under our Government has increased by £400 in real terms.

It is a pleasure to serve under your chairmanship, Mr Betts. I thank the hon. Member for High Peak (Ruth George) for opening the debate. She displays a huge amount of knowledge, passion and care in this area, and she has raised many points that the Government and I would agree with.

Carer’s allowance actually falls within the remit of my hon. Friend the Minister for Disabled People, Health and Work. There is an outstanding relationship with Carers UK, both at ministerial level and with officials. There are regular meetings with Carers UK, and many of the points raised in this debate have been raised previously and are being looked at and reviewed, so the debate is very timely.

As an individual, I share much of the passion that we have heard today. Not a lot gets me emotional, but I remember, in my early days as a constituency MP, meeting young carers, who are often forgotten in debates about carers. I am talking about children who have often lost the things that we all took for granted when growing up, as they have taken on caring responsibilities. It was a particularly moving meeting, and one that I have never forgotten, so I was happy to step in for this debate.

The Government recognise and appreciate the vital contribution made by informal carers, who provide invaluable support for relatives, partners, friends and neighbours who may be ill, frail or disabled. We also recognise the important role that many carers’ organisations play across the country in supporting carers, including those in the hon. Lady’s constituency, such as the Blythe House and Buxton carers’ support groups, which I am sure that she, as a diligent constituency MP, will have had much involvement with.

The Government are already supporting carers in a number of ways, including through the benefit system. About 850,000 people currently receive carer’s allowance. Since 2010, the rate of carer’s allowance has increased from £53.90 to £64.60 a week, with a further increase to £66.15 planned for April 2019, meaning an additional £635 a year for carers since 2010. By 2023-24, the Government forecast a spend of around £3.4 billion a year on carer’s allowance, which is a real-terms increase of more than one fifth since 2016-17.

Carer’s allowance offers a measure of recognition of the vital contribution that carers make to our society, although we fully appreciate that many make substantial sacrifices to care for their loved ones. That is why in June 2018, the Government published “Carers action plan 2018 to 2020: supporting carers today”, which sets out a two-year programme of targeted work to support unpaid carers. The plan puts a focus on practical actions to support carers and gives visibility to the work already under way or planned within Government.

However, I recognise that there are concerns about carer’s allowance, particularly around earnings and the possibility that a number of claimants may have been overpaid. Again, I pay tribute again to the hon. Lady, who raised some of those issues, which have been raised in the media, through the work of the Work and Pensions Committee and through her own recent, diligent parliamentary questions. It is in everyone’s interest that we deal with fraud and error effectively, preferably by stopping it happening in the first place.

We have been discussing updating our measurement of carer’s allowance fraud and error with the National Audit Office over the last year or so. We now plan to start the measurement during 2019, with the intention of publishing revised estimates during 2020. This is vital, because the last time we did this was in 1996-97. A huge amount has changed since then—not only the technology, but the way people work and their circumstances, as the hon. Lady mentioned. We suspect that the estimate of 5.5% fraud and error, which was set in 1996-97, does not reflect the reality today. The new measure, which will come in next year, can accurately set out where we should be, and where we should then target and prioritise our resources to prevent, identify and counter fraud and error even more effectively and efficiently.[Official Report, 6 December 2018, Vol. 650, c. 12MC.]

However, we are not complacent about fraud and error and already have a number of measures in place to deal with it. We are also reinforcing to carers their responsibility to inform us of changes to their earnings and other circumstances. Our priority has been to try to clear new carer’s allowance claims as quickly as possible, including during a period when the number of carer’s allowance claims has increased significantly. In part, that increase is due to the great work of stakeholders to raise the profile of carer’s allowance. We have also done our part by introducing the new online claim system, which is easier to use and—perhaps surprisingly for a Government online system—has a 90% satisfaction rate, so there are certainly some lessons for us to learn there.

Our performance here has been consistently improving, partly as a result of recruiting new staff—an additional 150 in the last 12 months alone. Many of them are based in the Preston, Blackpool and Swansea offices. I know that the Minister for Disabled People, Health and Work visited the Preston office in the summer, in her role as the Minister responsible for carer’s allowance. She was very impressed with the enthusiasm and hard work of the staff.

The Minister says that performance is improving. In what way is it improving? Does he mean that they are now going back over these historical overpayments and requesting them back from carers? Most carers and most people in this House would not see putting right the wrongs of previous years by finally investing in compliance to be a performance improvement, at least not for the carers that it affects.

I am coming on to what those staff will be doing and the improvements that we are bringing forward. As well as focusing on new claims, we are working hard to reduce backlogs elsewhere in the system, remind carers of their responsibilities and make better use of available technology.

The Department for Work and Pensions takes every care to explain a claimant’s responsibilities when they apply for carer’s allowance. This includes the need to report changes on time. Our annual notifications help remind claimants how important that is. We also provide information on the website gov.uk, while customers who need additional advice can contact the Carer’s Allowance Unit for further information, and we encourage stakeholder groups to help to share that information.

I absolutely understand the points the hon. Lady made about whether the guidance is perfect. When the Work and Pensions Committee raised questions with the Minister, we recognised that there were improvements to be made in this area. We have already made significant changes to the website. I also accept the points made about the letter, which the hon. Lady went through. I will encourage the Minister for Disabled People, Health and Work to meet with her personally to discuss the specific points about the quality of that guidance and information. We absolutely have to get that right, and it was a fair point to raise.

The consequences of not keeping the DWP up to date, including the need to repay overpayments, are clearly stated during the initial claim process and in our annual uprating letters. Therefore, every claimant has an obligation to tell us when their circumstances change. As with all benefits, the DWP has a responsibility to recover an overpayment where a claimant has failed to disclose a change that would affect their entitlement. Where there is an overpayment, the DWP will always look to recover the debt through a sustainable repayment plan. Where a claimant is having difficulty repaying a benefit overpayment, they can request a reconsideration of the amount that is being taken. It is also important to note that once a claimant has told us of a change of circumstances, they would not be responsible for overpayments from that date. However, we must recognise that we need to work with claimants to help them avoid overpayment and to ensure that we pay the correct amount.

In recent years, the DWP has introduced new technology to make it easier to identify and prevent overpayments, with cases checked against earnings information held by Her Majesty’s Revenue and Customs. The new verify earnings and pensions—VEP—system, allows us better to check earnings declared by carers to the DWP against tax records, and it allows staff to quickly take any action to clear up any discrepancies. Where we do have arrears from previous exercises, our priority is to ensure that the benefit is being paid at the correct rate in order to provide regular financial support. Once we have done this, we can determine any overpayment that might have accrued. Even when there has been a delay in dealing with a change in circumstances, as a carer’s allowance claimant can earn £120 net of allowable expenses a week, many of these claimants will have been paid correctly anyway. We will be increasing the carer’s allowance earnings limit again from £120 to £123 a week from April 2019. The Office for Budget Responsibility forecasts that average earnings will increase by around 5.1% between 2017 and 2019, whereas we will have increased the carer’s allowance earnings limit by 6%.

The Government acknowledge the vital role played by carers and the valuable work that carers’ organisations carry out on behalf of carers. We recognise that the UK’s 6 million carers play an indispensable role in looking after friends or family members who need support, which is why it is so important that carers should continue to have access to a dedicated benefit that recognises their particular contribution to society. Our staff work hard to support carers and pay people the right entitlement. I know that the Minister for Disabled People, Health and Work is very passionate about this, and it is a real priority for her. Equally, there are improvements in place that mean that we are tackling arrears and have a much smoother process for taking account of any earnings changes going forward. I thank the hon. Lady for giving me the chance to talk about carer’s allowance.

It is a pleasure to serve under your chairmanship, Mr Davies. I pay tribute to the hon. Member for Midlothian (Danielle Rowley), who has been a long-standing campaigner in this area through parliamentary questions; meeting the Minister for Employment, who has overall responsibility for universal credit; and visits to her local Jobcentre Plus, where she has also met supporting organisations. I know it is an area in which she has a long-standing track record of campaigning.

I share that passion. For many years I have supported my local women’s refuge. I have also worked with Women’s Aid, hosting parliamentary events prior to my ministerial appointment. I was very briefly on the Work and Pensions Committee, so I was present when they were considering the report, although I did not contribute to it because I was not there during the hearings. I pay tribute to my former colleagues on the Committee who were really engaged with this incredibly important topic.

The Minister heard the powerful evidence taken by the Select Committee, of which I am a member. I am interested in how, having heard that evidence on the impact on women and, in particular, on children, he can justify the Government response to the recommendation that if a payment cannot be split it should go to the main carer by default.

I was not present when that evidence was given, just when the Committee was considering it, but I will cover many of those points as I proceed.

With respect to domestic abuse, we are covering physical, sexual, psychological, emotional and financial abuse, and controlling and coercive behaviour. We are particularly looking at economic abuse. We all agree that the solution to domestic violence is complex and should ultimately be delivered through the judicial system, but the Department has an incredibly important role, not just through UC but through the wider work of the Government. The Government are fully committed to taking the issue very seriously, and I expect that to have full cross-party support. The Department will continue to feed into progress towards the domestic violence and abuse Bill. I represent the Department on the inter-ministerial group on violence against women and girls, and we regularly work with key stakeholders such as Women’s Aid, Refuge and the ManKind Initiative—I shall give more details on that work as I proceed.

I was particularly touched by the case that the hon. Member for Midlothian raised. Today I met representatives of Women’s Aid and Refuge to talk specifically about the journey in the jobcentre process. It is now mandatory for all work coaches to have training to recognise and identify victims of domestic abuse and those at risk, and to offer support, which can include signposting to national partnership organisations such as Refuge and Women’s Aid, but also to local organisations—every town is different. That approach relies on people being willing to be referred, but they are offered that menu of signposting options.

In her case study, the hon. Lady mentioned financial barriers to people leaving their household. The hon. Member for Sheffield, Heeley (Louise Haigh) said in an intervention that it would be totally unacceptable for the Government to put up a barrier. That is a really key point, so we ensure that people who wish to leave their household can be put immediately on the universal credit single payment in their own right. If they are already on a legacy housing benefit, they will get two weeks of additional housing benefit money up front, to give them immediate cash. While they are there, they will also have 100% access to the advance payment on day one, as well as the signposting.

We do not encourage people to stay in such a household, so we put a big emphasis on partnership working and on talking to those with expertise in the area. However, those who do wish to stay, for whatever reason, can request split payments. The hon. Member for Midlothian cited a figure of 15 households, but the figure is actually 20. At the moment, the majority of people going through UC are single claimants, so it is not an exact science, but we will continue to look at the statistics. I take the point that the data is limited; it tells us whether people are now successfully receiving split payments, but I would like more—that is a given. As a Minister, I will push for more data because we will need it to target support. UC design is not a simple process.

Does the hon. Gentleman not agree that in the impact assessment from May 2012 for the introduction of personal independence payments under the coalition Government, the objectives were to ensure that expenditure was sustainable and to save £2.24 billion a year by reducing claimants by 500,000 a year?

And the reality is that we are spending £3 billion more on supporting the most vulnerable people. That is partly because we have an extremely proactive Minister who, rightly, meets regularly with charities, stakeholders, individual users and MPs from across the House. I did the same when I was a Minister, and the system continues to be improved.

Finally, under DLA the higher rate was given for visual impairment at 36%, but it is now 79%. The system is not perfect and we need to continue moving it, but we can all access the stats from the Library. They are independent of the Government. They are the reality. That does not excuse mistakes or times when the system lets people down, but it is a fallacy to think that the old DLA system was better. It was not better, which is why the charities and stakeholders support the principle of PIP.
