Commons ChamberI would commit the Labour Government to the fiscal framework agreement that has already been put in place. It was negotiated and agreed in August 2023, and lays out the fiscal framework for the years ahead. When Labour Members move from the Opposition to the Government Benches come the general election, I am not sure if the hon. Member for Inverclyde (Ronnie Cowan) will be still be in his place. We have had 14 years of Conservative failure in this place and 17 years of SNP failure in Scotland too. That is the context in which these orders come forward. There is an enormous black hole in Scotland’s public finances, while one in six Scots are on NHS waiting lists. Real earnings in Scotland today are lower than they were in 2007. The only response to this crisis from either Government has been to increase taxes.
I wonder whether the hon. Member agrees with his shadow Health Secretary who said at the weekend that, right across the UK, every part of the NHS is in crisis. All roads lead back to Westminster, because, even though this is a devolved matter, decisions taken in Westminster have an impact on the NHS across the whole country.

Commons ChamberWill the Secretary of State clarify what he was saying earlier and whether he thinks it is legitimate for Scottish Government Ministers to be able to travel overseas to promote the work of the Scottish Government?
I have always been very clear that Scottish Government Ministers can go overseas to promote areas that are devolved, but the reserved areas, such as the constitution and foreign affairs, are a matter for the UK Government and those Ministers should not be using our embassies and consulates to promote their plans for separation, or their different views on the middle east or anything else.

Commons ChamberIt was not so long ago that Scottish Labour was calling for even higher taxes on the people of Scotland. When Scottish Labour leader Anas Sarwar stood for the leadership, he said:
“I actually think our tax policies will be even more progressive and radical than even John McDonnell’s or Jeremy Corbyn’s tax policies or manifesto”.
Mr Sarwar has now U-turned, of course, but maybe the hon. Gentleman can explain how much Scottish Labour secretly wants to put up taxes in Scotland.
The UK Government are focused on opening new international export markets for Scottish businesses. We have trade agreements with 71 non-EU countries and the EU, and those agreements will support growth, jobs and higher wages. The hon. Gentleman will have noted the recently revised numbers, which show that we have recovered better from the pandemic than France, Italy or Germany. Since 2010, the United Kingdom has achieved the third highest rate of growth in the G7—faster than Italy, France, Japan and Germany.
We had a really good trading relationship with the European Union—it was called membership—and 78% of people in Glasgow North, and 62% of people across Scotland, voted to retain it. If Brexit is really delivering the successes that the Secretary of State says it is, why does he think the polls show that those figures would be even higher if the people of Scotland had the choice again?
The recent trading numbers show that we are now doing more trade with the EU in goods and services than we did when we were members.

Commons ChamberI thank the Minister for giving way and for his very generous opening remarks. It is also worth putting on the record that Winnie’s late husband Stewart was a councillor in the Summerston area of Glasgow, which I currently represent in this place. Winnie, her husband and her children have between them represented Scotland and the people of Scotland at every conceivable level, which really is a tremendous legacy. I echo the condolences paid to all those who survive her and her family.
I am grateful for that point. I think it is fair to say that the family are a bit of a dynasty in Scottish politics.
All those dates of her terms in office and the various Parliaments tell only a fraction of the Winnie Ewing story. We have been reminded very clearly this evening how she approached politics with intelligence, warmth and wit.
I want to pick up on a couple of points made in the debate. The hon. Member for Central Ayrshire (Dr Whitford) made a very important point that Winnie’s family are grieving and we should not forget that. A number of Members spoke of Winnie’s humour and wit, and we heard about her passion for Europe. Personal family memories were shared by the hon. Member for Caithness, Sutherland and Easter Ross (Jamie Stone), as well as memories of the friendship that Winnie offered and, clearly, very fond memories of the Jolly Judge pub in Edinburgh at the top of the Royal Mile, which is one of my favourite pubs as well.
The hon. Member for Arfon (Hywel Williams) pay tribute from a Welsh perspective and the hon. Member for Perth and North Perthshire (Pete Wishart) spoke of memories of Winnie during his maiden speech as well as her various contributions to the SNP campaigning machine.
Winnie Ewing brought a winning combination of charisma and commitment to everything she did throughout her long and distinguished career. Members have reflected on her by-election victory in Hamilton and what that meant to her party and the constitutional ambitions of the Scottish National party to break up the United Kingdom. As I said, our political views on such matters were and remain very different, but I think we can all agree on the huge significance, back in 1967, of the arrival at Westminster of a young and dynamic Scotswoman. Her driving up in a Scottish-built Hillman Imp to the sound of bagpipes set the tone. She was here to make an impact, and there is no doubt that is what she did.
There is no doubt that Winnie Ewing was a trailblazer and a strong role model whose high profile made it easier for other women on all sides to follow in her footsteps. Parliament is a much better place today for the example she set more than half a century ago.
Winnie Ewing was an inspiration to many, and her voice was truly unique. Since her passing was announced last week, we have heard numerous tributes in news reports and obituaries, in speeches at Holyrood and now here today. We have heard many warm and fitting words from across Parliament to remember Winnie and to celebrate her life. I hope Fergus and Annabelle Ewing and her whole family will take comfort from that.

Commons ChamberI did not catch everything the hon. Gentleman said—my tinnitus gets the better of me sometimes. As to all the legal reasons, we have covered that a hundred times today. As to whether there will be a chance for another debate and another vote, my understanding of section 35 is that the Opposition have 40 days to pray against it, and that would then lead to a debate in this Parliament.
The Secretary of State for vetoing Scotland will be disappointed when he eventually gets to the House of Lords, because, even for all its faults, the House of Lords does not have the kind of veto power that he is exercising today. Even if the United States President vetoes a Bill, it is subject to checks and balances from Congress. Further to what my hon. Friend the Member for Glenrothes (Peter Grant) just said, if a motion is tabled praying against the section 35 order, will the Government guarantee that time will be made available for a debate and a vote on the Floor of the House?

Commons ChamberTo pick up on the hon. Lady’s middle point, which was the only relevant point she made, the reason why leaflets in general elections say no to a second independence referendum is simply because the Scottish National party is obsessed with an independence referendum and nothing else.
In 2014, people in Scotland were told that if they voted yes the value of pensions would collapse, supermarkets would be empty of food and energy prices would rocket, and that if they voted no, freedom of movement would be guaranteed, the UK would have as close to federalism as possible and the right hon. Member for Uxbridge and South Ruislip (Boris Johnson) would never become Prime Minister. Did the people of Scotland get what they voted for in 2014?

Commons ChamberI strongly agree with my hon. Friend that the Borderlands growth deal is a great demonstration of what can be achieved when we work together. I recently visited Innerleithen in the constituency of my right hon. Friend the Member for Dumfriesshire, Clydesdale and Tweeddale (David Mundell) and saw some of the great work that is happening there. What is really important about these growth deals is that they develop strong local partnerships that can form the basis for longer-term economic plans. My hon. Friend was a fantastic champion of the Borderlands growth deal, and I know that he will be at the forefront of developing these future plans.
The Westminster Parliament can and does legislate for all of the UK, and we have always sought to do so with the consent of the relevant devolved Parliament when we legislate in areas of devolved competence. The Scottish Parliament has passed legislative consent motions for seven Bills in this Session where the legislative consent motion process has been engaged. However, as the hon. Gentleman knows, the SNP Scottish Government made it quite clear that they would not grant LCMs for Brexit-related Bills. We understand their position even if we do not agree with it, but following Brexit, it is this Government’s duty to legislate sensibly for the whole of the United Kingdom, which has involved legislating without consent on a small number of occasions and may well mean doing so again in the future.
That small number of occasions includes the Elections Bill, the Professional Qualifications Bill, the United Kingdom Internal Market Act 2020 and the withdrawal agreement itself. All were rejected by Scotland’s Parliament but are taking effect anyway because this Tory Government never really believed in devolution in the first place. So is this actually the end of the Sewel convention, and is ignoring the Scottish Parliament the new normal?

Commons ChamberI have regular discussions with my ministerial colleagues and Scottish Government Ministers on economic and fiscal matters. The Treasury has made an unprecedented up-front guarantee to the devolved Administrations, guaranteeing that Scotland will receive at least £6.5 billion in additional funding this year on top of its Budget 2020 funding.
First, I repeat the point made by my right hon. Friend the Secretary of State that we have heard this “cry wolf” story before from the Scottish Government. The fact of the matter is that, as well as the guaranteed minimum funding for this year, the Chancellor has asked the Office for Budget Responsibility to provide forecasts next month. Together with the spending review, which will happen this autumn, that will give the Scottish Government plenty of certainty in setting their budgets.
This is just the disrespect agenda in action. The Tories never really wanted devolution anyway, and now they do not really give a stuff about whether or not it works properly. If they do not think that people in Scotland should not be in control of their finances, why will they not give the Scottish Finance Minister the information she needs to be able to set the budget properly? If they will not give her the information she needs, why not just give her the power to set our budget properly, without any recourse to Westminster at all?
I shall make a number of points in response to that. First, the Scottish Finance Minister is very welcome to contact me and explain why she has underspent the budget every year since the SNP has been in control of the Scottish Government. I have already explained in reply to the hon. Member for Gordon (Richard Thomson) that there will be plenty of information. The evidence is in the fact that this year we have guaranteed a minimum spend in addition to the usual budget of £6.5 billion. Only the separatists could call that a small amount of money.

Commons ChamberThe hon. Gentleman raises an extremely important point. I think we have all received in our parliamentary inboxes cases of people who are trapped abroad. Only yesterday, I heard about five or six cases of people in New Zealand and Australia, and I raised them with the Foreign Secretary. The Foreign Secretary has made a statement on the issue. We are hoping to bring people back and keep some airline hubs open—the Prime Minister of Singapore has kindly agreed to keep Singapore open for that purpose—and the Foreign Office is coming up with a plan. I encourage all British nationals to register with the high commission or the embassy in the country concerned and get their name on a list, ready for when we are able to organise flights.
On behalf of all of us in the Scottish National party, I endorse the comments made by the Under-Secretary of State in extending thanks to everyone who is helping us to get through this crisis. Many of the people in the NHS and the care sector, delivery drivers and people stacking supermarket shelves are European nationals, and it turns out that these are not low-skilled, poorly paid people; they are essential people who are helping us to get through the crisis. I hope the Secretary of State will reflect on that.
There are many in Scotland who came to our country seeking asylum and refuge, and many of them have medical expertise and other skills that could help their adopted communities get through the coronavirus crisis. Will the Secretary of State discuss with the First Minister and the Home Secretary how and when the right to work can be granted to asylum seekers who want to make a difference to our society, not just during this crisis but permanently?
I think it is fair to say that that is a UK-wide issue. Normally, asylum seekers cannot work while their case is being considered; however, they can volunteer. NHS England announced a volunteering scheme yesterday, and I hope the Scottish Government will do the same.
I hope that anyone who volunteers under those schemes, whether or not they are seeking asylum, feels supported. Many asylum seekers are left destitute, without recourse to public funds. To be asking them to give their time and labour without recognition would not be appropriate.
On another matter, when the Secretary of State speaks with the First Minister, will they discuss the challenge faced by many of our distilleries, particularly craft distilleries, that are keen to switch production from products that we all enjoy consuming to products that could help the health sector—hand sanitiser and cleansing products? Many of them face duty payments in advance, which means that they literally cannot give this stuff away. Will he speak urgently to the Treasury and the Scottish Government about how we can help our distilleries rise to the challenge?
Yes, and we have done so. We want Her Majesty’s Revenue and Customs to speed up the registration process for those companies, because the tax treatment of alcohol used in hand sanitiser is no different from the tax treatment of alcohol used in the production of food, chemicals or many other things: as it is denatured, it is duty-free once the company is registered.

Commons ChamberI am very interested that the hon. Member says that. He was chastising people before for not having read the Scottish Government’s paper. In their paper, they talk about the Canadian experience. I mention Canada and Australia because those are the two models that the Scottish Government talk about, ignoring the fact that both Canada and Australia are geographically vast countries and their geographical experiences are not particularly relevant to the United Kingdom’s. On page 81 of their paper, the Scottish Government specifically say about the Canadian experience:
“Migrants reported that the most significant factor affecting retention in the province of nomination”—
in other words, migrants staying in the province where they originally went—
“was economic: onward movement was most likely to occur where they considered that better or more job opportunities were available outside of their original province. This points to the importance of linking provincial migration with labour market opportunities.”
The hon. Member has argued that London is a much more attractive place for migrants. Following the logic of the arguments made in his own paper would result in the conclusion that the Scottish Government would allow lots of people to go to Scotland, and that those people would then look across the United Kingdom at more attractive job opportunities, which he has just pointed out are in London; they would then not stay in Scotland, thus effectively nullifying the policy.
Perhaps the right hon. Gentleman can explain something to me—and I hope the Minister will pay attention—because we will all experience these kinds of cases in our surgeries. I have a young constituent who is from Australia. Her name is Jessica, she works for the Beatson cancer clinic in Glasgow and she wants to stay there. Her colleagues also want her to stay. She is making a hugely valuable contribution to the workplace, the economy and the culture. But she cannot stay because of the arbitrary salary thresholds imposed by this Government, who are actively excluding people from our economy who want to stay here. That is why we need these powers in the Scottish Parliament.
That is a very good question because it provides me with the opportunity to say one or two words about the Government’s proposals for their Australian-style points-based system, which allows for some of the flexibilities—the Minister alluded to them—that would deal with some of the concerns that Jessica might have.
Under those plans, which are to be published later this week, there would be skilled migrants who get points for a job offer at the appropriate skill level, which would clearly be appropriate for Jessica; a job offer with an approved sponsor company; and a salary of at least £25,600. The plans make it clear, on the score awarded for salary, that people on £23,000 will still be able to earn points, and those who earn less than £25,600 will score double points for working in a sector where there is a skills shortage. That is a more flexible approach than that taken at the moment. There would also be more points available for younger applicants and for those planning to work outside London, thus dealing with the point made by the hon. Member for Cumbernauld, Kilsyth and Kirkintilloch East about the attractiveness of the labour market in London. Given that this system has not yet come into force and has not yet been set out in detail, it would be sensible for us to at least give it an opportunity to see whether it deals with some of these complexities, and the experience of Jessica, before throwing it away.
