The interest is declining—that is the point. Had we not taken those difficult decisions, we would be spending more money on paying interest to banks than on providing services to the people of this country, so my hon. Friend is right.

The decisions that we took were difficult and, clearly, people have felt pain. But people across the board have felt pain. It is interesting to hear the criticisms from the Labour party. What would have happened if that party had remained in power? Where would we be now? Under this Government 1.85 million new jobs have been created. That is 1.85 million people with the security of a pay packet every week and the dignity that employment brings.

Those new jobs would not have been created, had the hon. Gentleman’s party been in power.

In my constituency, Clwyd West, the improvement is tangible. The last Labour Market Statistics showed that over 12 months, the number of people claiming jobseeker’s allowance or not in work and claiming universal credit fell by 519 over 12 months—an annual decline of 34.5%. Those figures are mirrored right across Wales and right across the UK. In January, the International Labour Organisation measure of unemployment was 1.86 million people, down 486,000 on the previous year.

No, I will not give way for the moment.

These are strong, substantial changes, which we should all welcome, even the hon. Member for Pontypridd (Owen Smith), while acknowledging the task ahead. [Interruption.] He will have plenty of time to speak.

I would like to focus my attention today primarily on north Wales, which is the part of Wales in which I have lived nearly all my life and which I know best. I was brought up in the village of Rhosllanerchrugog near Wrexham, a very unusual, strange, unique and wonderful village. At the time of my boyhood, most of the working men were employed in coal mines and in the steelworks. Since then, there have been huge changes. We all know that the coal industry has virtually gone and the steelworks in north Wales are much smaller than they used to be. But now, north Wales is the home of dynamic new industries.

The wings of every Airbus aircraft that flies anywhere in the world are made in Broughton, in north-east Wales. Close to Broughton is the Deeside industrial estate, part of which is now an enterprise zone. There, high-tech industries serve customers across the globe. Deeside is one of the most dynamic, forward-looking, thrusting industrial areas of the United Kingdom and we should all take huge pride in it. On the other side of the region of north Wales is the island of Anglesey, where we see the Wylfa nuclear power station, which will soon, I hope, be replaced by a new power station, Wylfa Newydd. That will be a gigantic project employing many thousands of people for many years during the construction phase, and many people for decades after the station is up and running. It will provide the opportunity for the creation of centres of excellence in skills, education and training and I am tremendously pleased that the island of Anglesey has welcomed the developers so warmly.

Wylfa is only one element of what I believe is a bright future for north Wales as an energy hub. Out to sea, we have the Gwynt y Mor, Rhyl Flats and North Hoyle offshore wind farms, one of the largest groupings of offshore wind farms anywhere in the world. Let me be frank: as many hon. Members know, I have never been a huge fan of wind power. I believe that it is unreliable, supplying only intermittent and unpredictable energy, and it is far too heavily subsidised. Furthermore, onshore wind, and to a certain extent offshore wind, blight—as my hon. Friend the Member for Montgomeryshire put it—the spectacular landscapes, both onshore and offshore, of north Wales.

Nuclear power, by contrast, provides predictable and reliable base-load generation, which is precisely what is needed. However, nuclear must be seen as part of an energy mix. Wind is currently part of that mix, but I was extremely pleased when the Prime Minister indicated only a few weeks ago that subsidies for onshore wind farms will be phased out under the next Conservative Government.

A new technology, and one that has been developed in Wales, is that of tidal lagoons. I remember taking evidence on tidal lagoons several years ago when I was a member of the Welsh Affairs Committee. I was immediately struck by what a tremendous opportunity they represented for Wales, given its huge tidal ranges. The technology has been slow in coming, but it appears that it will soon be here. The company Tidal Lagoon Power has not only made an application for development consent for a new lagoon in Swansea, but has ambitions to create a chain of lagoons stretching from Lancashire in the north, right around the coast of Wales, to Somerset in the south. Only a few weeks ago I chaired a meeting in Colwyn Bay to discuss proposals for a huge tidal lagoon there. It would have a potential generating capacity of 4 GW, which is equivalent to a very large nuclear power station.

Lagoons have the advantage of being green—they produce no carbon emissions—but they also have what wind power lacks: they are entirely reliable. Nothing on the planet is more reliable than the ebb and flow of the tide. As a result, each tidal lagoon would have the capacity to generate for 22 of every 24 hours. This is a new technology, and a British technology. Moreover, it could be centred in Wales. I believe that Wales could become a leader in what could rapidly become an important export industry.

Obviously there are environmental issues to consider, not least with regard to transmission infrastructure, which is having a catastrophic effect across Wales. My hon. Friend the Member for Montgomeryshire mentioned the impact that transmission lines would have in Montgomeryshire. Equally, in my constituency of Clwyd West there is now a strong campaign aimed at requiring the transmission lines serving the new Clocaenog wind farm to be buried underground. Saving the planet should not mean at the same time trashing our landscapes and seascapes. I therefore strongly support the proposition that developers of wind farms, which are heavily subsidised, should be required to pay the cost of laying transmission cables underground.

I would like to touch on transport in north Wales. The railways are increasingly important in north Wales, and they are being used increasingly heavily, as is the case across the country. Journey times have improved tremendously. When I was first elected to his House some 10 years ago, the journey back to London from Colwyn Bay on a Sunday took some four and a half hours. As a result of efforts by both the previous Labour Government and this Conservative Government, that has been reduced dramatically—the same journey now takes almost exactly three hours. The fast train, which I hope to take tonight, takes approximately two and three quarter hours.

That is all commendable, and it is a tribute to the work done by Network Rail, but we must look to the future. We know that HS2 will be built and that it will go to Manchester. It is important that north Wales should benefit from it, which is why I believe that the new hub proposed for Crewe should be built and that there should be a fast connection right through to Holyhead. We must bear it in mind that north Wales is very much part of the north-western economic region; economically, the region has always looked to the great cities of the north-west, Liverpool and Manchester. I was therefore delighted when last year the Chancellor announced funding for the reopening of the Halton curve, which will put Liverpool and the expanding Liverpool John Lennon airport within easy travelling distance of north Wales.

In north-east Wales we should seek to maximise the economic benefit we can derive from the new enterprise zone at Deeside by encouraging synergy with the new enterprise zone at Wirral Waters in Birkenhead. There is a railway line linking Liverpool and north Wales, but the difficulty is that passengers have to change at Bidston from an electric train to a diesel one to take them through to Wrexham. I believe that a very good improvement, and one that could be achieved at relatively low cost, would be to electrify that line, certainly between Bidston and Shotton, where a new interchange is proposed. That would mean that the two great enterprise zones at Deeside and Wirral Waters would be within easy commuting distance of each other.

Tourism has always been the mainstay of the north Wales economy, but I believe that more could be done for it. One simple measure that is acquiring support from hon. Members from all parties is to give serious consideration to reducing the rate of value added tax on tourism businesses. That has been tried out in competitor countries, not least Ireland, and has been found to be entirely successful. It has been calculated that the immediate loss of revenue would be made up within four years. The big problem is that, in areas such as north Wales, most tourism businesses are run by small family undertakings that, in order to remain competitive one way or the other, try desperately to avoid being registered for VAT, the consequence of which is that they are deterred from expanding and improving their businesses because they cannot have the benefit of input VAT to set against the cost. Therefore, one measure which should appeal to my right hon. Friend the Chancellor, and to which I hope he will give serious consideration in the impending Budget, is to reduce the rate of VAT for tourism businesses to 5%.

Finally, I want to touch on a matter that is worrying to everybody with a constituency in north Wales, namely health care. I know that the issue is a hot potato in this House and that Government Members are frequently criticised for criticising the Welsh Government’s delivery of health care. The fact is, however, that areas such as north Wales are almost entirely reliant on the north-west of England and the midlands for very specialist medical care. It has been a concern for many years that north Wales patients have to wait considerably longer than their English counterparts for elective surgery in English hospitals, simply because of the way in which the Welsh Assembly Government fund health care.

The situation is getting worse. Yesterday in Prime Minister’s Question Time the hon. Member for Arfon (Hywel Williams) mentioned his constituent, Mr Irfon Williams, who has been obliged to move out of Wales to Ellesmere Port in order to access drugs that he would have got routinely had he been resident in England. He is not by any means a unique example. I have a number of constituents who, because they live in Wales, simply cannot access the medicines they need. They have to go through the most byzantine consenting procedures if they are to have specialist treatment. Frankly, the matter is causing huge distress in north Wales. The situation was compounded recently by the decision of the Betsi Cadwaladr university health board to downgrade maternity care in Glan Clwyd hospital, because it is finding it difficult to attract staff of the necessary calibre and quality.

I believe that that shows that there are structural difficulties with the health care system in Wales under the Welsh Government. It is suggested that the Welsh Government have been subject to cuts, but the fact is that the Barnett formula protects the health budget in Wales. The simple fact is that the Welsh Government, of their own volition, decided to cut the health budget, and the consequence is that patients in my and other north Wales constituencies are suffering.

I am rapidly coming to the view that the Welsh Government are finding it almost impossible to run a decent health system in Wales. Before I sit down, I plead with them to look very carefully at the misery being inflicted on a lot of people in north Wales and to turn to the Department of Health in Westminster for advice. They should not be too proud to do so. Until they do so, I believe that health care in Wales will only continue to decline.

We have made it clear that the Scottish powers would kick in only after the next general election and they will, of course, have to be the subject of a manifesto commitment. However, Wales is not Scotland. We believe that the arrangements that we are putting in place are right for Wales. I would have hoped that the hon. Gentleman would support them.

On devolution, in the last hour there has been an extremely important ruling by the Supreme Court. It found in favour of the Labour Welsh Government in their attempt to preserve an Agricultural Wages Board for Wales and to protect low-paid farm workers in Wales. Will the Secretary of State take this opportunity to apologise for wasting court time and money on seeking unlawfully to get rid of an Agricultural Wages Board for Wales, and will he commend the Welsh Government on their actions?

The hon. Gentleman is entirely right that the Supreme Court delivered a judgment this morning. We are still considering the consequences of that. Where a procedure exists and there is an issue of doubt, it is entirely right that we should go to the Supreme Court to have the position clarified, and the position has been clarified.

The Secretary of State is trying to present this as a score draw. To be clear, he has lost 2-0. This is the second time he has referred Welsh legislation to the Supreme Court and the second time he has lost. This time he was trying to stop the Welsh Government trying to protect agricultural wages in Wales. I ask him again: will he apologise for wasting time? Will he agree with me that his interference and this ruling show that we definitely need Labour’s proposal of a reserved powers model for the Assembly in Wales?

Can the hon. Gentleman clarify whether the Labour party in the Assembly will be pushing for an early referendum on tax-varying powers?

It was well worth waiting for the Secretary of State to intervene, but I think that the answer is no. Had he been paying attention, he would know that the First Minister has been very clear—[Interruption.] He says “Ah!”, but I think that there is no surprise in hearing that the First Minister has said that income tax-varying powers for Wales are not a priority, for all the reasons I have enumerated many times in this Chamber. If the Secretary of State was to debate some of these issues with me, rather than standing behind the Exchequer Secretary when it comes to all these detailed parts of his brief, perhaps we would have a clearer idea of his understanding of these issues.

I think that everyone in the House is now even more confused as a consequence of what the hon. Gentleman has said. He said that he sees the value of borrowing powers associated with income tax, but given that Labour will never hold a referendum on income tax powers, how does he hope to access those borrowing powers?

I suspect that that reveals why the Secretary of State cannot speak to his own Bill and instead relies on the Exchequer Secretary. The Secretary of State will know, of course, that irrespective of whether there is a referendum in future, the volume of income tax powers to be extended to Wales has a direct link to the amount of borrowing, because the Government have chosen to introduce a different rationale for affording Wales borrowing powers from that which they used for Scotland. The Scotland Act 1998 draws a connection between the amount of capital expenditure—the budget for capital—and the amount of borrowing. In this Bill, for some reason, the Government have chosen to pursue a different rationale, whereby the ratio of borrowing is to be equal to the ratio of income tax devolution. It is very important that the Government consider amendment 10, because it would increase the volume of income tax that could potentially be exercised by the Welsh Government, and should therefore, under the logic employed by the Government, increase the amount of borrowing above the £500 million that is currently envisaged.

The hon. Gentleman does not seem to understand that if there is never a referendum on income tax powers, the Welsh Government will not be able to access an income stream of either 10p or 15p. Does he not understand that point?

Absolutely, so perhaps the Secretary of State could come back to the Dispatch Box to explain why that connection was never made in Scotland, and why, in Scotland, the powers relating to the amount of borrowing were a function of the capital expenditure budget. Can he explain why that difference occurred? Obviously, he cannot, so once again, we know that the Government have simply made it up as they went along.

My last point deals with our fair funding amendments. We remain convinced that the Government do not intend to provide fair funding for Wales, and that any extension of devolution of taxation to Wales ought to be subject to a clear understanding, and agreement by the Welsh Government that the fair funding issue has been dealt with. The Exchequer Secretary acknowledged earlier that the issue of convergence has been accepted by the Government in the floor that has been put beneath the Barnett formula. The Holtham commission said that there was a shortfall of about £300 million—perhaps it is now as little as £150 million—in Wales, but we are convinced that the Welsh Government ought to be the arbiter of whether that fair funding test has been met. That is why we would encourage the Government to adopt our proposal of a back-stop power for the Welsh Government to determine whether fair funding is afforded to Wales.

Yes, and I am grateful to my hon. Friend for reminding me about that important point. I can tell the House that I have engaged with the Department of Health, and that NHS England is continuing its efforts to work constructively with the Welsh Government to find a solution to the problems faced by English patients, such as my hon. Friend’s constituents, who access NHS services in Wales. Work on resolving the issues raised by the cross-border protocol is continuing, and it is hoped that this work will conclude by the end of this year.

Can the Secretary of State also inform the House on the relative performance of the NHS on either side of that border? What is the difference between, for example, the Wye Valley NHS Trust and the Aneurin Bevan health board on cancer waiting times? My understanding is that in Wales the targets are rather more stringent, and are being met.

I could rehearse the remarks that were made on the last occasion we discussed this issue, but the point that my hon. Friend the Member for Forest of Dean (Mr Harper) was making was that his constituents access the health service in Wales. They wish to access the English health service, but at the moment they have difficulty doing so. I would have thought that the hon. Gentleman would want to facilitate my hon. Friend’s constituents’ access to the English health service, rather than continuing to snipe.

The energy sector is very important for Wales and the Government are investing heavily in energy, including giving support for the new nuclear power station at Wylfa Newydd. The market between this country and Europe is extremely important—a two-way flow—and our energy interventions will ensure that our energy sector is supported.

We know that this Government are out of touch, but listening to the Secretary of State this morning I fear that he is completely out of touch with the views of Welsh business about the European Union. Has he spoken to Ford, GE, Hitachi, Citibank, BMW or Airbus, which are all companies that have expressed their concerns? If he has not, does he know how many jobs in Wales are reliant on our membership of the European Union?

I speak regularly to Welsh businesses—I dare say more frequently than the hon. Gentleman does. What is absolutely clear is that although Welsh businesses value their engagement with Europe, they feel that there is too much regulation and too much meddlesome interference from the European Union. We need to strike a proper balance. That is why we intend to renegotiate our position with Europe and at the end of that process hold a referendum.

I doubt that the Secretary of State is actively talking to those businesses, because when I talk to them, what I hear are their grave concerns about the uncertainty that he is creating. He did not answer the question. In truth, one in seven jobs in Wales is now reliant on EU trade. Does he not accept that the attitude of his Government and the attitude of a Secretary of State who has referred to Europe as “a basket case” is jeopardising those jobs, and does he not realise that it is only Labour that will secure them? That is why a Labour vote next week is a vote for jobs in Wales.

What I recognise fully is that the Labour party is reluctant—in fact, it is refusing—to give the British people a vote on this important issue. So far as business is concerned, the hon. Gentleman ought to understand that 72% of companies interviewed in north America for the Ernst and Young attractiveness survey thought that reduced integration in the EU would make the UK more attractive as a foreign direct investment location. He does not understand that; we do, which is why we can and we will give the people of Wales and Britain a vote on their future in Europe.

Actually, it is for every elected representative to express concern when a service as important as health is affected. When the devolved Administration are not delivering an adequate standard of health care, it is entirely appropriate for every elected representative to draw attention to that.

I agree entirely with my right hon. Friend the Prime Minister that in England there is a cancer drugs fund, and in Wales there is not. I can tell the hon. Gentleman—[Interruption.] The hon. Gentleman should listen to this. Constituents of mine have died because they have not had access to cancer drugs, because they live in Wales. If the hon. Gentleman considers that an acceptable state of affairs, shame on him.

There is a significant lack of resources in Wales compared with England. For example, Wales has no cancer drugs fund. As the hon. Gentleman will know, a recent study conducted by Bristol university showed that Welsh patients were seven times less likely to have access to cancer drugs than those in England. There is a litany of failure in relation to Welsh health services. Almost everybody who lives in Wales can give examples of such failures. Only today, the Western Mail reported that complaints to health boards in Wales had increased by more than 40% between 2009-10 and 2012-13.

However, the Labour party is simply not listening. The First Minister and his Cabinet are presiding over what looks increasingly like a shambles. Health care in Wales is moving backwards. That is, quite simply, unacceptable—

Crucially, it is also both alarming and worrying for people in Wales who need to use those services.

The Welsh Labour Government in Cardiff are not only failing thousands of patients in Wales, but failing hard-working professionals who are every bit as competent and dedicated as those in any other part of the country. It is in that context that we are debating the amendments tabled by my hon. Friends the Member for Monmouth and for Aberconwy.

I am grateful to my hon. Friend for that intervention.

Amendments 12, 13 and 14 seek to shine a light on the organisation and funding of cross-border health services—services provided in England to patients living in Wales and vice versa. I shall not dwell on the intended legislative effects of these amendments, but rather on the intentions behind them. I know this is an issue of real importance to many Members who have spoken this evening, and I would like to reassure the Committee that I share the concerns about the operation of the current system.

My hon. Friend the Member for Forest of Dean has also spoken to his amendments 17 and 18, which would require both the Secretary of State and the Welsh Ministers to include in their annual reports on the implementation of the Bill’s financial provisions details on the costs and effectiveness of cross-border services. His proposed new clause 3, which reflects concerns he has expressed over many months to me and my right hon. Friend the Secretary of State for Health, would require the Welsh Ministers to consider the impact of their decisions on the provision of health services to people who live in England but who are registered with Welsh GPs.

Current funding arrangements are set out in the protocol for cross-border health care. I entirely agree that there is concern about the practicality and deliverability of these arrangements as they operate on the ground. Everyone should receive the best possible health care regardless of where they live or where their GP is registered. As we have heard, health services in Wales are falling short in many respects of the standards we expect. That is a matter for the Assembly, and in particular the Welsh Government, urgently to address.

The Welsh Government’s policy of referring patients registered with Welsh GPs for treatment in Wales only created more difficulties for English patients, such as the constituents of my hon. Friend, who are registered with Welsh GPs. I am pleased, however, that following discussions between the Wales Office and the Welsh Government some local health boards in Wales have reviewed this policy and have exempted English residents. I know this falls short of patient choice, but it is at least a step in the right direction.

Improving the cross-border protocol is the responsibility of both the Welsh and the United Kingdom Governments and I can assure the House that this Government are determined to tackle the protocol shortcomings and ensure better cross-border health services. It is only right that we ensure that the health care of people living close to the border does not suffer merely because of where they happen to live. It is in this mechanism that the greatest potential for real change lies, and that is why we are reviewing it to ensure it really does meet the needs of people on both sides of the border. Is it in order for the Secretary of State—who we have not heard from for, I think, fully 245 minutes—to dwell for almost the entirety of his speech today on continuing the war on Wales and the Welsh NHS, none of which is addressed in this Bill, which is meant to be about the financial circumstances post-the Silk commission as they relate to Wales, not the NHS in Wales?

The point I was making is very simple and I do not need to embellish it, because I can rely on the evidence provided by the Government’s own impact assessment, which states extremely clearly that the proposal’s objective is to benefit the

“smaller parties in Wales who may have a smaller pool of high quality candidates to represent them in elections.”

Labour Members certainly would not for one moment contest the argument that the smaller parties in Wales—among which I would, unfortunately, count the Conservative party—may have a smaller pool of high-quality candidates to represent them in elections, but I do not believe that that is an adequate reason for seeking to amend legislation with regard to this country’s constitution and elections.

The shadow Secretary of State will know that under the original Government of Wales Act 1998, there was no ban on dual candidacy. At what point did the damascene conversion of the Labour party against the concept of dual candidacy take place?

I am very grateful to the Secretary of State for asking that question, because I think the date was 2 or 3 May 2003. The precise geographical location of that conversion was on a road not to Damascus, but to Ruthin. It was of course during the Clwyd West election—the election to the Assembly in his constituency in north Wales—when we witnessed the extraordinary state of affairs in which Labour quite clearly won the election and the Conservatives, the Liberal Democrats and Plaid Cymru lost it, but the Conservative, Liberal Democrat and Plaid Cymru representatives were all returned to the National Assembly for Wales in what any right-thinking individual would think was a complete denial of democracy and natural justice.

I anticipated that the hon. Gentleman might mention the so-called Clwyd West question. Was it not always entirely foreseeable from the moment that devolution was instituted under this system that in some seats a number of representatives would be elected by first past the post, on the list, or both? It was always foreseeable and, frankly, the fact that it was not foreseen seems a large oversight by the Labour party.

That may well have been foreseeable. Labour has acknowledged that it was a mistake to draft the legislation in such a fashion that it became possible for would-be Members of the Assembly to nest like cuckoos in individual constituencies for a period, anticipating their entry to the Assembly via the back door. However, we did not imagine that the measure would be used so shamelessly as it was by parties in the Secretary of State’s Clwyd West constituency.

As all hon. Members do, I talk regularly to colleagues in other parts of Britain, but we are now addressing legislation that relates to Wales. The evidence relating to Wales that is before our eyes—from recent history in the Secretary of State’s own seat—suggests that there is a problem there and that the measure has been abused. As best we understand it, public opinion also supports my contention that the system should be retained and that the proposed ban should not be lifted.

Because that was quite clearly the system in place at the time. However, as I have acknowledged—my right hon. Friend the Member for Neath (Mr Hain) of course acknowledged it when he amended the law in 2006—we admitted that it was a mistake to allow people to abuse the system in such a fashion.

I hesitate to steal the thunder of my right hon. Friend, who referred to this matter so eloquently on Second Reading, but if we want evidence of the potential abuse of the system whereby an Assembly Member nests in a constituency that they subsequently want to seek election to through first past the post, we need look no further than the leader of Plaid Cymru, Leanne Wood. She published a memo to her members in an e-mail which provided what can only be described as a route map for such abuse. I did not intend to quote extensively from it, but as I have been provoked, perhaps I ought to remind the Committee of the details. She instructed her party:

“We need to be thinking much more creatively as to how we better use staff budgets for furthering the aims of the party.”

She went on:

“Regional AMs are in a unique position. They are paid to work full-time in politics and have considerable budgets at their disposal.”

She said:

“Consideration should be given to the location of their office—where would it be best for the region? Are there any target seats…within the region?”

She went on:

“They need not be constrained by constituency casework and events, and can be more choosy about their engagements, only attending events which further the party’s cause. This can be achieved by following one simple golden rule: On receipt of every invitation, ask ‘How can my attendance at this event further the aims of Plaid Cymru?’ If the answer is ‘very little’ or ‘not at all’, then a pro forma letter of decline should be in order.”

I do not think that we need any further evidence of the potential abuse to which I am referring.

Is the hon. Gentleman’s criticism not of Leanne Wood, who I agree behaved wholly disgracefully? Is he not overlooking the many regional Members who were elected and behaved entirely properly? His criticism is not of the system, but of an individual who behaved reprehensibly.

The Secretary of State might be right that some regional Members behaved perfectly appropriately. I agree with him that Leanne Wood did not behave appropriately in instructing her colleagues to respond in that way. The point that I am making is that the system as it was constituted, and as he proposes to reconstitute it, was open to such abuses. That is why we suggest that the current system, which we put in place when in office, should be retained.

The hon. Gentleman is being extremely generous in giving way again. Surely these issues could be resolved by a change in the standing orders of the Assembly, rather than by changing the legislation. Does not the Assembly have the power to regulate itself? The hon. Gentleman looks puzzled. I would have thought that he would recognise that the Assembly is in a position to regulate the conduct of its Members through its standing orders.

I am merely quoting from the Government’s own impact assessment, which clearly states that this is for the benefit of the smaller parties in Wales, among which we count the Conservative party.

Public attitudes to this issue are relatively clear and there have been several reports. Most importantly, the Bevan Foundation—which is non-aligned although splendidly named after my great hero—conducted an analysis and a large survey to consider all these issues. It found that

“dual candidacy was unfair compared with those who felt candidates should be free to stand in both.”

As a reference to the detail included in that survey, I quote a respondent from Llanelli who asked:

“How can it be right that you vote one way and then the person who loses can still find a way to get elected?”

Someone from Swansea East said:

“I think it is unfair … It’s like people can sneak in the back door.”

and another said:

“It does seem unfair in a way, surely if they weren’t popular enough they shouldn’t be able to get in.”

Another respondent said:

“I don’t think some should have the added advantage of standing in both—it seems unfair really.”

and someone else from Llanelli said:

“You don’t have two bites of the cherry.”

Will the hon. Gentleman clarify whether the survey he refers to is the one that was commissioned by his hon. Friend the Member for Caerphilly (Wayne David), and although he refers to a large number of respondents, is it the case that there were precisely 47?

It was indeed commissioned by my dear and hon. Friend the Member for Caerphilly (Wayne David), but the Bevan Foundation, as the Secretary of State will know, is a non-aligned charitable foundation. It would surely contest quite vigorously the implication—which I am sure he does not mean to make—that it is in any way aligned to the Labour party.

Of course, it is not just evidence from the Bevan Foundation that is important. International evidence suggests that this form of gerrymandering is not supported by the public. In New Zealand, for example, public opinion research conducted by the independent review committee, which is part of its Parliament and appointed to examine the electoral system, found that one key criticism was that it was possible for MPs to be defeated in an electoral contest but returned to the House through their position on the list—clear evidence that it is not just in Wales that people are concerned about that.

In fact, it is not just in New Zealand that there are concerns. In New Brunswick in Canada, an independent commission endorsed the ban on dual candidacy stating:

“The Commission heard that in some jurisdictions where candidates are able to run simultaneously on both ballots, voters are displeased with the case where a candidate is not successful in a single member constituency, but is elected anyway by virtue of being placed on the top of a party’s list.”

Evidence from two notable democracies—Canada and New Zealand—shows that it is not just those in the Labour party and in Wales who are worried about that process.

Of course, it is not just Labour Members who have been concerned about this issue: it used to be a concern of Members on both sides of the House. For example, Lord Crickhowell, a former Conservative Secretary of State for Wales, has said that the arrangements were “really pretty indefensible”. I would have thought that was a clear statement, but the current Secretary of State clearly does not agree.

Perhaps Liberal Democrat Members agree with the Chief Secretary to the Treasury who said when we last debated this in 2006:

“I should also point out that the Secretary of State for Wales has said that if the Commission had considered what he called the systematic abuses carried out by list members in Wales”—

which I have described here today—

“he would have reached the same conclusion that we have”—

“we” in that case being of course the Liberal Democrats—

“namely that a ban on dual candidacy is the only effective solution.”

We therefore have many examples from across the world, from Wales and from across the House of people’s concerns about the way in which the system has been abused.

I, of course, share the general delight at serving under your chairmanship, Mr Chope.

This has been an interesting and very forthright debate. Clause 2—it seems unnecessary to say—will overturn the ban on dual candidacy introduced by the Government of Wales Act 2006. Under its provisions, candidates at an Assembly election cannot stand both in a constituency and on a regional list. Before 2006, candidates could of course stand in both.

Amendment 15, which was moved by my hon. Friend the Member for Forest of Dean (Mr Harper), would require the Secretary of State to commission an independent review of the possible effects of dual candidacy on the effectiveness of the National Assembly for Wales and to lay the findings before both Houses within nine months of Royal Assent. I fully understand his intention in tabling the amendment and to a certain extent I empathise with him. I welcome the opportunity to debate further the merits of removing the current unfair ban. My hon. Friend has highlighted the need for independent evidence on the effects of dual candidacy, which is of course important, but the fact is that ample evidence from independent bodies shows that dual candidacy is part and parcel of similar systems across the world.

The previous Labour Government justified imposing the ban on dual candidacy on the grounds that they said there was “considerable dissatisfaction” with the system, although they provided little evidence to support that position. Frankly, having listened to the debate, I have to say that I have heard little more evidence this afternoon. We have of course had the Bevan Foundation—

It is fair to say that there was a majority of one, but frankly most of the respondents were Labour Assembly Members. As I will mention later, the letters written by those Assembly Members bore a suspicious similarity to one another. It might almost have been that a template was provided for them.

The ban was introduced despite opposition from other parties in the House, academics and even the Electoral Commission. I know that several Labour Members served on the Welsh Affairs Committee before the passage of the 2006 Act, and I am sure that they recall the evidence of Dr Richard Wyn Jones, Dr Roger Scully and Glyn Mathias, the Electoral Commissioner for Wales, who all highlighted the potentially partisan nature of the changes. Professor Alan Trench of the constitution unit at University college London, who is currently a special adviser to the Select Committee, said in November 2011 that it was

“a pretty blatantly partisan manipulation of the electoral system”.

In its evidence to the Welsh Affairs Committee in 2005—I do not think the hon. Member for Wrexham (Ian Lucas) was a member of that Committee—the Electoral Commission stated that it did not believe that the case had been made and that it would

“caution against any change that is perceived to be partisan and could add to a prevailing distrust of politicians”.

The Electoral Commission saw no evidence in favour of the ban during the passage of the Government of Wales Act 2006. During the pre-legislative scrutiny of the draft Bill, it reaffirmed that position. Even the Arbuthnott commission, which the last Labour Government set up to consider the electoral arrangements in Scotland, made it clear that

“dual candidacy is a common feature of mixed member proportional systems across the world”.

I do not think that we have had that difficulty in the past.

The Opposition have pointed to the fact that a majority of respondents to the Government’s Green Paper consultation were in favour of retaining the ban as further evidence in support of it. However, if one takes away the many Labour Assembly Members, who responded in a strikingly similar way, that would no longer be the case. The simple fact is that the ban was introduced to benefit one party, the Labour party, in one part of the United Kingdom, Wales, and in not Scotland or London.

In his evidence to the Welsh Affairs Committee during its pre-legislative scrutiny of the draft Bill, Professor Scully said that the claims that are made about dual candidacy, which have been repeated again and again by Labour Members,

“remain wholly unsupported by solid evidence”.

I repeat that the simple fact is that the ban was introduced as a partisan act that affects smaller parties disproportionately and ensures that good quality candidates are lost to the Assembly.

We are skiing somewhat off piste, because that is not within the competence of this Bill, but there is clear correspondence between the Assembly Government and the Department for Transport on how the upgrade would be funded, and it is absolutely clear that the Welsh Government were paying for the upgrade of the valleys lines.

What I will say is that we made it absolutely clear that this Government were paying, directly and indirectly, for the upgrade of the main line as far as Swansea and for the valleys lines. I think that if the hon. Gentleman has a word with his friend the First Minister, he will find that there was an exchange of correspondence between the two Administrations which made the funding arrangements very clear, as did an e-mail from the Office of Rail Regulation.

We have made it very clear that we need to rebalance the finances of this country before we will consider that. Let me remind the hon. Gentleman, however, that in October 2012 there was a specific agreement between the Welsh Government and the Treasury that on the occasion of each spending review there would be an assessment of the issue of convergence, and that is indeed what happened on the last occasion.

The Secretary of State said a moment ago that he would be voting yes and campaigning for a yes vote in a referendum on tax-varying powers. May I take him back to the time when he was a Member of the Welsh Assembly? In his maiden speech, he said:

“We have no tax-raising powers—long may that state of affairs continue.”

Indeed: a Damascene conversion. The hon. Member for Pontypridd (Owen Smith) is a particular enthusiast—he now believes that 15p should be devolved to the Assembly, whereas as recently as 5 February he clearly stated that he did not believe in any tax devolution at all. He will clearly have some interesting explaining to do later in the debate.

The hon. Gentleman changes his mind with astonishing regularity. For example, on 5 February, in a Welsh Grand Committee debate, he said:

“I do not believe for a moment that having additional responsibility for tax-varying powers would confer any extra degree of accountability on the Welsh people.”—[Official Report, Welsh Grand Committee, 5 February 2014; c. 18.]

However, during last weekend’s speech to the Welsh Labour party conference, he spoke glowingly of the prospect of devolving 15p in the pound and said that that would

“increase both the accountability of the Assembly and its borrowing capacity too.”

He is clearly a bit at odds with himself, and we look forward to hearing what he has to say later on.

It should be entirely clear to the hon. Gentleman, because the Under-Secretary of State for Wales, my hon. Friend the Member for Preseli Pembrokeshire (Stephen Crabb) took the trouble to write to the Chairman of the Grand Committee, the hon. Member for Gower (Martin Caton), on 10 February, setting out these matters in great detail. I know that a copy of that letter was sent to the hon. Gentleman, and he will know, having read it, that the provisions are as follows:

“In the first year of operation (and any transitional years) the block grant adjustment will equal the amount of tax revenue generated by the Welsh rate of income tax set at 10p. It is important to note the following:

This is the amount of income tax forfeited by the UK Government as a result of reducing the main rates of income tax by 10p in Wales. If the Welsh Government sets a rate of 10p then there will be no impact on their budget compared to current arrangements. By setting a rate of, for example, 11p or 9p the Welsh Government can increase or decrease its budget (respectively) compared to current arrangements, as the block grant adjustment will still be based on the 10p forfeited by the UK Government. That means that the higher or lower revenue resulting from a rate of 11p or 9p (rather than 10p) would not be netted off the block grant.”

Well, the hon. Member for Pontypridd had not read this letter, so I am reading it out to him. It goes on:

“In subsequent years the initial deduction is indexed against movements in the UK NSND”—

that is, not savings, not dividends—

“income tax base. That means that if the UK NSND income tax base contracts by 2%, the block grant adjustment will decrease by 2%; if the tax base grows by 2%, the adjustment will increase by 2%.”

That should have been absolutely clear to the hon. Gentleman, but he clearly did not read the letter, so I am glad to have had this opportunity to acquaint him with its contents. It clearly contains the reassurance that he seeks.

No, I will not give way.

Subject to the outcome of a referendum, the legislation provides for the introduction of a Welsh rate of income tax. The main UK rates of income tax would be reduced by 10p for Welsh taxpayers, and the Assembly would be able to set a new Welsh rate—a whole number or half a whole number—which would be added to the reduced UK rates. The rest of the income tax structure would remain a matter for this Parliament.

The Silk commission estimated that reducing the Welsh rate of income tax by 1p would cost the Welsh Government around £185 million, without taking account of any gains resulting from people moving to Wales to take advantage of lower tax rates. That is not an insignificant amount of money, but lower rates of income tax would boost the spending power of working people in Wales and bolster growth in the Welsh economy. Stronger economic growth in Wales could deliver a real boost in tax revenues, providing the Welsh Government with more resources to invest in devolved services and infrastructure across Wales.

Some Opposition Members, most notably the hon. Member for Pontypridd, have suggested that the devolution of an element of income tax is some sort of unspecified coalition trap, set to ensnare the Welsh Government.

In the first place, let me say that I object quite strongly to the hon. Gentleman’s suggestion that I would ever be involved in gerrymandering, particularly given that it was his party that introduced this atrocity in the first place in the 2006 Act. May I refer him to what Professor Roger Scully said in his written evidence to the Welsh Affairs Committee:

“If parties that are defeated at constituency level can still win representation through the list, then it is difficult to see why that should not also apply to individuals”?

Individuals represent parties; where they happen to be standing makes no difference at all.

I am just getting over the fact that the Secretary of State referred to what we thought was a fairly simple safeguarding of democracy as an “atrocity”. I am pleased that I let him intervene, because he chose to read out a piece of evidence given to the consultation on the measure. I note, however, that the Secretary of State failed to inform the House that the overwhelming majority of respondents to the consultation were opposed to the measure. Clearly, this is a nakedly partisan reversal by the current Government. Let me be clear with the House: if we get the opportunity to win back power in this place, we will reverse the measure.

I would not want the hon. Gentleman to have wasted his eye rolling. Just for clarification, is it his case that the Labour party wants devolved income tax competence to be able to increase the rate of tax for the 4,000 or so who pay the additional rate of tax in Wales, but not to cut the standard rate of tax for the 1 million-plus who pay the standard rate?

I have already made that very clear in this House. I take your admonition that I should be coming to the end of my speech in the spirit in which it was intended, Madam Deputy Speaker, although I believe that I have spoken for slightly less time than the Secretary of State. [Interruption.] If it is significantly longer that is perhaps because I have addressed more of the substance of the Bill than the Secretary of State, who glossed over most of the gerrymandering and the other reasons for it.

Let us be very clear that our proposals to allow the Welsh people, if they so choose at a referendum, to give powers to the Welsh Government to set a progressive rate of income tax would guard against a Tory Government with malign instincts reducing the justice of our taxation system in Wales and increasing the outrageous targeting of Wales that has been described and exposed in other areas in recent days. We will not allow such exposure on the economy to be passed on to Wales. We will not allow Wales to be worse off as a result of the measures, and we will scrutinise the Bill extremely carefully.

My hon. Friend illustrates an important point, which is that patients on both sides of the border are frequently reliant on care provided on the other side of the border. He makes a sensible point, because it is clear that Knighton hospital will be put under pressure if the current arrangements in the health care system in Wales continue to prevail.

The Tory war on Wales has reached a new low in this House today: four questions from compliant Tory Back Benchers, all suggesting that a higher proportion of Welsh patients are being treated in England when the reverse is the case. Would the Secretary of State like to correct the record and tell those Members the truth, which is that the proportion of Welsh patients being treated in England has fallen and the reverse proportion has risen?

What I will say is that, in terms of cancer care, Welsh patients are increasingly dependent on English services and, to be frank, are seeking them out, so I am surprised that the hon. Gentleman raises that point.

I am particularly surprised that the right hon. Gentleman should choose cancer as a topic of debate, because the truth is that, in cancer care, Wales is outperforming England. In fact, in the trusts of the hon. Member for Hereford and South Herefordshire (Jesse Norman), the numbers show that 81% of patients are meeting the 62-week target, which is worse than three quarters of all the trusts in Wales. We spend more on cancer in Wales and we have faster improving outcomes. This is a smear by a Secretary of State and a Tory party that used to speak for Wales.

That is actually a smear from a Labour party which is in total dereliction of its duty to Welsh patients. Frankly, the Welsh Government cannot afford to be complacent when they have not met the urgent suspected cancer waiting time since 2008. Furthermore, there is no cancer drugs fund in Wales. Instead of reacting so badly to criticism, the hon. Gentleman might wish to criticise his own friends in the Welsh Government.

On Monday, we heard in this House the Secretary of State commit his party to cutting a penny off income tax for taxpayers in Wales, including millionaires. I am sure he did not pluck that figure out of thin air; I am sure he consulted the Treasury. Will he therefore tell us what the precise cost to the Welsh budget will be of his proposed tax cut?

The point I made was that a cut of one penny in the pound would do a tremendous amount to stimulate the Welsh economy. Let me repeat what I said to the hon. Gentleman on Monday. We in the Conservative party are ambitious for the people of Wales. We want to see the Welsh economy growing; he wants a Welsh economy reliant on handouts. That is the difference between our parties.

No, the difference is that I want some answers. I assume from the Secretary of State’s answer that he did not consult the Chancellor and does not know how much the proposal will cost the Welsh budget, so let me help him out. The static effect is £200 million, or the equivalent of 5,000 teachers in Wales, so will he tell us which services he would propose cutting to pay for that tax pledge?

The hon. Gentleman clearly does not get it. The issue of whether income tax should be devolved will be in the hands of the Welsh people. It will be up to the Welsh Assembly Government to make the decision to trigger that referendum. For our part, we want them to trigger that referendum, to call it, to elect for a lower rate of tax and to give Wales the competitive edge that so far it lacks under the Labour Welsh Assembly Government.

I thank the Secretary of State for advance sight of his statement on this historic occasion. It is almost a year since the Silk Commission produced its report and 16 years since the last time a Conservative Secretary of State for Wales made a statement in this House—better late than never. Labour Members certainly welcome the acceptance of the Silk recommendations, especially coming from a Secretary of State who once described devolution as constitutional damage.

I would like to thank Paul Silk and his team for their work in producing the report. That report and the Government’s response to it are of enormous significance to the people of Wales—a part of the UK that has been harder hit by this Tory Government than anywhere else. Welsh wages have fallen faster and further than anywhere else in the UK, the Welsh budget has been cut by £1.7 billion by the current Tory Government, and we have seen energy and other bills rise higher and faster than elsewhere. That is the reality of the context of today’s announcement.

Because of those cuts, the Welsh Government have sought borrowing powers and agreed with the Silk recommendations that Wales should be able to exercise those powers, as Scotland and Northern Ireland do at present. We welcome the confirmation that Wales will in future have the capacity to borrow in order to invest in infrastructure, but will the Secretary of State clarify some of the many details that are left outstanding after today’s announcement?

First, will he clarify exactly when he expects that package of borrowing to be in place for the initial tranche of investment in the M4 and other roads? More importantly, will he tell us about the process by which that level of borrowing will be agreed? The Government previously indicated that the devolution of the minor taxes such as stamp duty and landfill tax, which are being devolved today, would be sufficient to trigger significant borrowing powers for the Welsh Government. Today’s statement, however, seems to suggest that that borrowing would now be contingent on income tax-varying powers being taken up in Wales. Will the Secretary of State confirm whether that is the case and say how much borrowing will be released once the minor taxes are devolved? Will he further confirm whether a mechanism, a set of methods and a formula similar to that used in Scotland under the Scotland Act 2012, which affords about £230 million of borrowing to Scotland, would be the method employed in Wales?

We welcome the devolution of the minor taxes—stamp duty and landfill tax—as this gives the Welsh Government the capacity to make some changes to the Welsh economy and to invest in order to grow and create jobs. Prior to the introduction of these new Welsh taxes, we would need to be very clear about whether the Welsh people would be better or worse off. That is our primary concern, so will the Secretary of State explain exactly how the process and methods will be agreed and set for offsetting the block grant by the amount devolved to Wales under the minor taxes?

The most significant aspect of today’s announcement relates to income tax and the proposal that the Government will legislate for a referendum in which the Welsh people may be asked if they want a proportion of income tax to be devolved to Wales. Our position on income tax is that we support the proposal as laid out by Silk on the basis of a “triple lock”, whereby we will judge whether the people of Wales will be worse off, we will see through the referendum whether the people of Wales want to take that responsibility and we will see whether fair funding is agreed for Wales. That remains our position today.

It is a significant that, in making today’s announcement, the Government have rejected Silk’s proposal to devolve the income tax bands independently of one another. Can the Secretary of State confirm why he has rejected that recommendation? The Government’s written statement suggests the reason is that the UK Government have discovered an interest in the progressivity of the UK tax system and are concerned that devolving those bands independently of one another might reduce that progressivity. That is ironic from a Government who have cut taxes for the wealthiest people in Wales. Will the right hon. Gentleman further confirm that the leader of the Welsh Conservatives in Cardiff Bay has said that he would use the tax powers only for the wealthiest by cutting only the 40% band, thus continuing the anti-progressive policies being pursued in Westminster?

I noted from the media today that the Secretary of State, in contrast, would cut all the bands by 1%. He will know that that would result in a £200 million shortfall in the Welsh Assembly’s budget. Will he tell us exactly how he would fill that shortfall, or, alternatively, tell us which services he suggests that the Welsh Government should cut to make the tax cut affordable?

May I ask the Secretary of State about fair funding? Last year the Government said that there was evidence of convergence in funding between Wales and England. Today’s statement commits them to

“review relative levels of funding for Wales and England in advance of each spending review and, if convergence is forecast to resume, to discuss options to address the issue in a fair and affordable manner.”

Will the Secretary of State tell us exactly what the result of those reviews will be? If there is evidence of convergence, will action be taken? Will we see what Paul Silk wanted, namely a review of the Barnett formula?

Without a hint of irony, the statement provides for the Government to give Wales a facility to save any “surplus revenues” that it might have lying around. Given that the Welsh budget has been cut by £1.7 billion over the last three years, can the Secretary of State tell us when that surplus is expected to materialise? Or have we just been given another set of false promises by a Government who do not believe in the Welsh people, and will not deliver for them? Is today another day on which we should beware Tories bearing gifts?

I am grateful to the shadow Secretary of State for what I think was a welcome for my announcement. However, we heard the predictable preamble about Wales having been hit harder by the Government than any other part of the United Kingdom. In fact, the grant to the Welsh Government has been reduced proportionately less than that of any other Whitehall spending Department. Given that we are living in times of extreme difficulty—caused to no small extent by the last Labour Government—I should have thought that the hon. Gentleman would welcome the support that this Government have given the Welsh Government and the Welsh Assembly.

The hon. Gentleman asked a number of specific questions, the first few of which related to when the borrowing powers would be made available. I am pleased to be able to tell him that, as was announced in my written ministerial statement, the Welsh Government have already been given assurances that they can negotiate with the Treasury for borrowing powers in respect of the M4 and the north Wales expressway to take effect immediately. We will fund that by allowing the Welsh Government’s current borrowing powers to be used without any adverse impact on the departmental expenditure limit.

The hon. Gentleman welcomed the devolution of taxes. The two larger taxes that are being devolved are landfill tax and stamp duty land tax. That will of itself provide a funding stream against which the Welsh Assembly Government can borrow, but we want income tax to be devolved as well. The hon. Gentleman is right: I do support the devolution of income tax. I urge the Welsh Assembly Government to trigger the referendum as soon as they can, because the Conservative party will be campaigning vociferously for a yes vote in that referendum, and, furthermore, for a cut in income tax.

The hon. Gentleman made a point that revealed the poverty of the Labour party’s ambition. We believe that devolution should be used to give a competitive edge to Wales, and that the powers that are devolved should be used to make Wales a more prosperous place. Very far from wanting the tax cuts to apply to the wealthiest people in Wales, we would like them to apply across the board, to everybody in Wales, so that the brightest and best want to come to Wales to set up business, to make their livings and to look forward to a brighter future. That is what differentiates the Labour party from the Conservative party. Interestingly, the Welsh Finance Minister, Jane Hutt, hailed today’s announcement as

“a good deal for Wales, and a big step forward for devolution.”

However, the Eeyore-like shadow Secretary of State prefers to look for a cloud in every silver lining. He is out of step with everybody except himself.

I believe that Wales has had more than a fair share of capital expenditure announced. Let me reiterate: the electrification of the south Wales and valley lines, the north Wales prison and the commitment to support new nuclear through guarantees.

The reality is that since 2010 the Welsh budget has been cut in real terms by £1.7 billion, or 11%, yet on Welsh television last week the Secretary of State for Wales said that Wales had “got off lightly”. I know that the right hon. Gentleman is not exactly famed across the House for his humour, but was that meant to be a joke?

Compared with the average cut across Whitehall, which was 8%, and the cut to the Wales Office budget, which was 10%, I would say that the real-terms cut of 1.9% for Wales, because of the protection of the health budget and the education budget, is a good deal.

The answer is clear: Wales is meant to be grateful for this Government’s largesse, but the reality is that on the right hon. Gentleman’s watch, the budget is down £1.7 billion, real wages are down £1,700, 3,000 more people are out of work, 35,000 people are using food banks, 33% of children in Wales are in child poverty and 400,000 people have lost their tax credits. If that is “getting off lightly”, heaven help the most vulnerable in Wales if he and his Government decide to get serious.

My hon. Friend is entirely right that St Athan offers an enormously important resource in south Wales. The Aerospace Technology Institute will lead collaborative research and development projects across the UK, which will involve universities and industry. I suggest that that is a tremendous opportunity for St Athan.

Airbus is a quintessentially European company. It employs 6,000 people in Wales and 10,000 in the UK, and 100,000 further jobs support it. Does the Secretary of State believe that those jobs will be more or less secure if Wales is not part of Europe?

The hon. Gentleman is wrong because Airbus employs 6,600 people in Wales, but he is right that it is an extremely important employer. Nevertheless, the people of this country deserve to have their voice on Europe. The Prime Minister will carry out important negotiations in the next few years. At the end of that period, the issue of Europe will be put to the British people. It is right that it should be. I am astonished that the hon. Gentleman and the Labour party want to deny the people of Wales and the UK their voice on that important issue.

Leaving the pedantry aside, we had no answer from the Secretary of State on whether he believes that those 6,600 jobs in Wales will be more or less secure if Wales is not part of the EU. For the record, could he clarify his position on whether the jobs will be more secure if Wales is in or out of the EU? What is our Secretary of State’s opinion?

I am entirely happy to clarify the point. Membership of the EU will be subject to negotiation. To repeat, at the end of that negotiation, we will see whether the conditions are right for this country to remain in the EU. The interests of companies such as Airbus will, of course, be taken fully into account.

Higher education is a major export earner for Wales and, of course, for the United Kingdom as a whole. During his recent visit to India my right hon. Friend the Prime Minister made it clear that there is no arbitrary limit on the number of students who can study in the UK, provided they have the necessary qualifications and can speak the language. They are more than welcome to come to the UK.

Last week the Joseph Rowntree Foundation warned that Wales faces a decade of destitution as a result of policies pursued by this Government, and the Welsh Government said that £600 million is being taken out of the pockets of ordinary Welsh people. Is the Secretary of State telling the Prime Minister and his Cabinet colleagues what people are saying about his Government in Wales, or is he just there to cheerlead for policies that are hammering his country?[Official Report, 28 February 2013, Vol. 559, c. 7-8MC.]

If this Government were to pursue the policies advocated by the Labour party and try to fix a debt crisis simply by borrowing more, the plight of the individuals whom the hon. Gentleman mentions would be infinitely worse. So far we are providing 109,000 additional jobs for the people of Wales, and we are reducing their tax bills and doing our best to ensure that they get sustainable private sector jobs. The hon. Gentleman has no answer to that.

What I can say is that working households across Wales fully understand the need to tackle welfare and benefits. If the hon. Gentleman is not prepared to do that and stand up for working households, this party is.

There was no answer there from the Secretary of State, as usual. Let me tell him the answer. There is no excuse for his not knowing, because his own income assessment makes it clear that 400,000 households—a third of all households in Wales—will lose out as a result of these changes. Let us contrast that with the 4,000 households—that is 4,000 versus 400,000—that will get a tax break as a result of the millionaires’ tax cut. That ratio of 100:1 tells us everything we need to know about this Government. The 99% pay while the 1% profit. Let me be clear: Labour will continue to speak for the 99%; the Secretary of State can speak for the 1%.

As a consequence of the measures taken by this Government, 1.1 million taxpayers in Wales are paying less tax, while 109,000 taxpayers in Wales are now paying no tax at all. That is what we are doing for hard-working people, and I am appalled that the hon. Gentleman sees fit not to support them.

I think it unlikely that the Assembly could raise unlimited amounts of tax, because it would need unlimited levels of income, which everyone would agree it does not have. Paul Silk’s work is important, and it deserves careful consideration, and that is what is happening at the moment.

May I first add my words of sympathy and best wishes to those who have been affected by the floods in Wales, and my thanks to the emergency services and volunteers, and to the Secretary of State for going there tomorrow?

As the Secretary of State will know, the Silk commission’s report is a very important document that has produced recommendations relating to air passenger duty and income tax—issues that affect not just Wales, but the whole of the UK. Does he therefore agree that the whole House ought to be able to debate those issues, and can he explain why he seems to want to limit that debate to the Welsh Grand Committee?

I believe that we should have an early debate in the Welsh Grand Committee on this important issue. The hon. Gentleman will know that my office is in touch with his office and the offices of the leaders of other parties with a view to agreeing that. It should be done as quickly as possible. On the question of a further debate, that is clearly a matter for the Treasury, the Wales Office and the Welsh Assembly Government to progress the work that is being done to discuss the issue, and at that stage we should consider a further debate, which could potentially be on the Floor of the House. Certainly, any legislation would require primary legislation, which would have to be a matter for the House to deal with in the usual way.

I think the Secretary of State said he is in favour of a debate on the Floor of the House, which is welcome, as his predecessor committed to holding such a debate when we last discussed the Silk commission. In anticipation of that debate and outside the Silk commission, so to speak, the right hon. Gentleman will know that borrowing powers are extremely important to the Welsh Government. Can he confirm that the Silk commission’s recommendation that £200 million-worth of non-income tax powers would constitute, in his view, an independent income stream that would facilitate borrowing for the Welsh Government?

I echo the tribute the right hon. Gentleman pays to my predecessor, who was an excellent Secretary of State. As for the references to the Supreme Court, as he knows these matters are set out in the Government of Wales Act, for which he was responsible. The reference of the first Welsh Bill—that is, the Local Government Byelaws (Wales) Bill—to the Supreme Court should not be regarded as disrespectful or hostile in any sense. It is simply an administrative procedure to clear up the issue of competence and that is it.

I add my words of support to those of the Secretary of State for Dyfed-Powys police and the community of Machynlleth as they live through the awful events of recent weeks. I also warmly congratulate the Secretary of State and his deputy and welcome them to their new role. The Opposition are thrilled that the Prime Minister finally found a Welsh MP to take on the post.

In fairness, the Secretary of State’s predecessor, with whom I did not always agree, has found a new spirit of candour in recent weeks since she left the job and has admitted, for example, that his Government have lost all reputation for competence. On this question of respect, will he continue in this spirit of openness and clear up the question of his attitude to devolution? Will he tell us straightforwardly—does he think that devolution has been good for Wales?

I do not think I can carry on accepting all these welcomes; it is far too much for me—[Interruption.] I am sure they will soon come to an end. I feel strongly that devolution is developing, and that as the Assembly and the Assembly Government mature as institutions they could be very good for Wales indeed. That is why I and my office are determined to work closely with them to assist in doing our best for Wales with them.

Mr Speaker, you will forgive me if I think that the Secretary of State’s view that the Assembly “could” be good for Wales is hardly a ringing endorsement of the devolution settlement that was so decisively supported by the Welsh people. Are not his view that the devolution settlement has “damaged our constitution” and his deputy’s view that it is “constitutional vandalism” what they really think and where they really have disrespect for devolution? Is not the truth that the right hon. Gentleman cannot speak for modern Wales—devolved Wales—but we on this side of the House can and will?

When I used the word “could”, my intention was to point out that under the Labour Assembly Government, coupled with 10 years-plus of Labour Government here in London, Wales has been the poorest part of the United Kingdom. I believe that a lot more could be done to make Wales a happier place to live, and for that purpose it is necessary for us in the Wales Office to work closely with the Welsh Assembly Government. I am willing to do that; I hope that the hon. Gentleman will support me.

As we have heard this morning, it is not only public sector jobs that are at risk in Wales. Does the Under-Secretary agree that the Peacocks jobs in jeopardy in my constituency and throughout the country are at risk largely because of the Government’s economic decisions to choke off consumer demand and raise VAT?

Of course, I share the hon. Gentleman’s concern about the plight of Peacocks. However, so far as I can see from the reports that I have had to date, it is nothing to do with the Government’s economic policy, but everything to do with Peacocks’ banking arrangements. The Wales Office is intensely concerned about the matter and will continue to express concern.

As my hon. Friend points out, the issue of economic development is firmly in the hands of the Welsh Assembly Government, as indeed is training. That is entirely a matter for them, but I am bound to say that, given the current economic backdrop, I was surprised that the economic development budget was cut last week.

One of the flagship Government policies that was meant to help the private sector to grow in Wales was the national insurance holiday. That was meant to improve the prospects of 45,000 companies in Wales, but it has actually supported just 300—less than 0.7% of them. Will the Minister tell the Chancellor that it is not working in Wales and that he really needs to pull his finger out and help the 16,000 people who have found themselves on the dole as a result of this Government?

Will the Minister ask the Secretary of State whether she would be happy to resign over the failure to deliver the electrification of the railway to Swansea and the valleys, as she is happy to resign over matters in her constituency?

Given that the hon. Gentleman is so geographically challenged, it is perhaps no surprise that, during the 13 years of the last Labour Government, not one centimetre of electrified line was created in Wales.

It is, I am afraid. I think that most of us in this Chamber—with the honourable, or possibly dishonourable, exception of the hon. Member for Carmarthen East and Dinefwr (Jonathan Edwards)— are Unionists, and we do not want the Union of this country damaged. Therefore, the West Lothian question must be addressed, and the Government are committed to doing so during this Parliament.

As the hon. Member for Pontypridd said when agreeing with something that I said earlier, perhaps we are doing things the wrong way round—perhaps the exercise should have taken place before devolution was instituted in this country—but the issue must be addressed. I can think of nothing that would do more to endanger the Union than to perpetuate a sense of grievance on the part of certain Members of this Parliament and certain large sections of this community about a perceived lack of fairness in how they are treated.

I shall not, as I have little time. I am sure that the hon. Gentleman will understand. Over-representation is a problem, and introducing fairness is a good way to start to address it.

To conclude, this debate has been an interesting exercise—but essentially a historical one, as I said earlier. The Select Committee has published its report, but since then, the caravan has moved on. As I said earlier, the AV referendum was held with little difficulty, as far as we can establish, and we must now look to the future. The Boundary Commission’s exercise is continuing, and it will result in provisional proposals in September this year and a final report to the Secretary of State by October 2013.

The new parliamentary constituencies will be in place by the time of the next general election, and appropriate arrangements will be made for the next Assembly election in 2016. All proposals will be taken into consideration— the hon. Member for Carmarthen East and Dinefwr made an interesting suggestion, as did the hon. Member for Pontypridd—before Assembly constituencies are determined.

I reiterate that the fundamental issue addressed by the Parliamentary Voting System and Constituencies Act 2011 is fairness.

I think that that would be premature at this stage, but I am pleased about the decision to refresh the existing cross-border health services protocol for a further year, until 31 March 2012.

The Minister will be aware that one of the other destabilising effects of the Health and Social Care Bill is the abolition of the National Patient Safety Agency, whose job was to monitor patient safety in England and Wales. In England its job will be taken over by the national commissioning board, but what provision has been made for transferring its responsibilities in Wales to ensure patient safety? If the job is given to the National Assembly, will extra funds be made available for the purpose?

As the hon. Gentleman will know, the existing cross-border protocol is supported by an annual transfer of funds—currently £5.9 million—to the Assembly Government, and an additional payment of some £12 million was made in the last two financial years. These matters will have to be discussed with Welsh Ministers once the new Assembly Government has been established.

There is no doubt that we are going through difficult economic times, as the hon. Gentleman knows. Unfortunately, third sector organisations are affected by that. I believe that the £200 million that will be available through the big society bank will be of immense benefit to third sector organisations in Wales.

The Welsh people are a shrewd lot, and they have quickly seen through the big society scam. Since £1.8 billion was cut from the Welsh Assembly budget, leaving councils with a shortfall of many millions of pounds, charities such as People First, which works with people with learning disabilities in the Rhondda Cynon Taff area, have been on the verge of closure. That is throwing more people on to the record unemployment numbers in Wales. As Dawn Price of People First put it to me:

“How can we take part in a Big Society when our funding is being so cruelly cut?”

I realise that some Opposition Members have huge difficulty with the proposition that people should be allowed to organise their own lives in the way that best suits them, rather than such matters being delivered top-down by big Government. However, there are signs that it is slowly dawning on the Leader of the Opposition at least that the big society may be rather a good idea. When he launched Labour’s policy review recently, in which I think the right hon. Member for Neath (Mr Hain) played a part, he said:

“We have got to take that term ‘big society’ back off David Cameron”.

Yes, that is disappointing. China presents enormous opportunities for inward investment to Wales and to the UK as a whole, and these are matters on which my right hon. Friend the Secretary of State is liaising closely with the Department for Business, Innovation and Skills.

As we have already heard and as the Secretary of State will know, hundreds of public sector jobs in Wales have already been lost on her watch. Is she aware that there will be further job losses at the Driver and Vehicle Licensing Agency when it closes its offices in Bangor and Cardiff? Will she tell us what she is doing to keep those precious jobs in Wales?

The Minister and the Secretary of State say that individual police forces will be responsible for the cuts that they have to make. However, they will know that North Wales police—overall crime in the area reduced by 40% under the Labour Government—now faces cuts of perhaps 230 officers from 1,600, and 160 police community support officers. If crime increases from the current record lows in north Wales, will the Minister and Secretary of State blame the chief constable?

Before I answer that question, may I congratulate the hon. Gentleman on being awarded the accolade of “one to watch” in the ITV Wales political awards? I can assure him that I am indeed watching him.

The hon. Gentleman’s point has been well rehearsed, but I would rather rely on the chief constable of North Wales, who has given an assurance that the force will continue to protect the public and provide a service in which the public can be confident.
