Commons ChamberI have listened to the right hon. and learned Gentleman over many weeks and many years, and this guy is doomed to be a permanent spectator. We have a plan to fix the NHS and fix social care; the Opposition have no plan. We have a plan to fix our borders with our deal with Rwanda; they have no plan. We have a plan to take our economy forward; they have no plan.
The right hon. and learned Gentleman talks about the elections in a few days’ time. Let me remind him that everywhere we look at a Labour administration, it is a bankrupt shambles. Labour-run Hammersmith Council spent £27,000 on EU flags three years after the referendum. Labour-run Nottingham Council—bankrupt because of its investment in some communist energy plan, of the kind that he now favours; he should apologise for it. Labour-run Croydon—bankrupt because of its dodgy property deals. And never forget Labour-run Britain in 2010—bankrupt because of what the Labour Government did, and they said that they had “no money” left.
If the right hon. and learned Gentleman looks at council tax—he boasts that he lives in Islington or Camden, or somewhere like that—he should contrast neighbouring Westminster, which has the lowest council tax in the country and better services, too. That is the difference between Labour and Conservative across the country. Vote Conservative on 5 May.
My hon. Friend is entirely right: those are the issues on which people will be voting. As I said, they will be voting for better value, better services and lower council tax, and I hope they will be voting Conservative.

Commons ChamberThe issues that companies such as Mr Norman’s have found are the very issues we want to resolve as part of the wider package. It is important to note, as we look at the Command Paper, that we want to deal with a wide range of issues. That is my point about dealing with the fundamental problems, rather than going piecemeal through the symptoms. That is why there is a range of options in there, some of which will make a veterinary agreement redundant, because it will not be required in that kind of process, potentially. That is part of the discussion we want to have with the EU to get a resolution to all these issues; it is more than just the food and chilled meats issue.
I welcome the proposal in paragraph 48 of the Command Paper for a light-touch customs regime for goods that are staying in Northern Ireland and not moving on to the Republic, but will the Secretary of State confirm how small businesses could comply with the requirement to provide
“complete transparency of their supply chains”
to the various authorities? I can see how a large supermarket chain could do that, but how could a small trader do that?
My hon. Friend highlights an important point. We are talking to small businesses and, indeed, the wholesale groups that they often work with to make sure that there is a way for them to be able to work through this, and we will continue to work with them as we go forward. There is technology now, similar to the technology that large companies use, that smaller businesses can use—the trader support service is hugely helpful in this—but my hon. Friend highlights one of the core problems: making sure that goods that are moving to Northern Ireland purely to be consumed in Northern Ireland do not have the same kind of rigmarole and checks. I think that I have mentioned before in the House a large supermarket chain that has no stores in Ireland yet has to go through the same checks. That cannot be right and needs to be resolved.

Commons ChamberI am very happy to do that. In fact, we organised a meeting just recently for Executive Ministers and Ministers and officials from Government, including the Ministry of Housing, Communities and Local Government, to talk through the schemes—not just the shared prosperity fund but the community renewal fund and others—because there are substantial extra funds available this year for Northern Ireland as we move towards the shared prosperity fund. As I set out earlier, part of the £400 million of new deal money will be focused on work around social fabric and potentially integrated education, and I am really keen to engage to make sure that that money is put into areas where it has the most beneficial impact and is positive for people on the ground in Northern Ireland.
Does the Secretary of State agree that the democratic institutions in Northern Ireland have a key role to play in ending this violence? Will he therefore urge all the parties not to take the step of suspending the institutions, as we have seen in recent years, and to keep talking to find a solution to take Northern Ireland forward?
The short answer is yes, but I want to stress that the main political parties that form the Executive in Northern Ireland are all in the place that my hon. Friend outlined—working together. That is why it was really good to see them come together last week with a joint statement on this. There are five different political parties in a power-sharing arrangement in a devolved authority. Obviously, they will disagree on things from time to time. What they absolutely agree on is their right to disagree and to do so in a democratic and peaceful way, which they have worked together on very well since the re-formation after the New Decade, New Approach agreement last year, and I hope they will continue to do that. From my engagement with them all at the moment, I am confident that they will, and it is the right thing to do—it is certainly what the people of Northern Ireland want to see.

I assume that the hon. Gentleman therefore supports the moves we took last week in showing leadership to deliver for the people of Northern Ireland. We have been consistent in what we wanted to deliver, and we have delivered unfettered access for Northern Ireland businesses to the rest of the UK market. We were always clear that we recognised the single epidemiological unit of the island of Ireland, which meant that those sanitary and phytosanitary checks would be built upon and put in place, as they have been. As the Command Paper outlined, we want to see a clear, flexible ability for businesses to trade, so that consumers in Northern Ireland will not see their everyday lives disrupted. In fact, the early paragraphs of the protocol highlight that that is the intention of the protocol. That is what we have to focus on, and that is what the decisions last week were about.
Does the Secretary of State agree that the unique status of Northern Ireland means that it will not be possible for the EU to enforce its single market rules in the same way there as it can elsewhere in the EU? Does he also agree that the only way to achieve a sustainable solution is for the agencies in Ireland to work together with their UK equivalents to build trust and to work out how we can enforce the rules and tackle the key risks while leaving the border in a workable position that businesses can manage?
My hon. Friend makes an important and fair point. The Irish Government and their agencies work closely with the UK Government and our agencies and with the Northern Ireland Executive on a wide range of issues to the benefit of people in the Republic of Ireland and Northern Ireland, and it is important that we continue to do that. He also highlights why it is important that we continue to be very clear about the needs of the people of Northern Ireland—why the protocol was put in place—recognising the unique circumstances and the complexity of the situation in Northern Ireland, and ensuring that the relationship with the Republic of Ireland can work in a smooth and effective way. As I have said before, I absolutely recognise that the EU’s core, prime focus is on the protection of the single market. We are focused not just on protecting the businesses and people of the United Kingdom but on the core determination and commitment to deliver on the Good Friday-Belfast agreement in all of its strands.

I have worked closely with Minister Poots, and I recognise that he comes at this with a very different attitude to the protocol—it is not something that he necessarily wanted in the first place—but he and his Department are working pragmatically to deliver on this. We will continue to work with the Department of Agriculture, Environment and Rural Affairs to ensure that the requirements are met and that, where necessary, infrastructure is upgraded. The UK Government have offered to cover the cost of some of that, because we recognise that this relates to an international agreement for which we are responsible. With regard to customs systems, it is for the Treasury to respond on the detail, but I reiterate what I said in my statement: IT systems are on track.
Can the Minister confirm that the Irish tax authorities and Her Majesty’s Revenue and Customs are working together to put in place common-sense arrangements that can help to address the unique issues arising from Northern Ireland’s status in both the UK and the EU customs areas? Some sensible interpretations and information sharing could avoid some of the more extreme proposals being put forward by one side or another in this debate.
My hon. Friend makes an interesting proposal. In the absence of an agreement and a deal between the UK and the EU, clearly we would need to explore everything that could be done at a bilateral level. I am not aware of those discussions as of now, but I am happy to discuss that with Treasury colleagues and write back to him if that is the case.

The Northern Ireland civil service was clear that a decision to extend the welfare mitigation package was needed this autumn or else it would have to start taking alternative measures to advise Northern Ireland recipients of them on what action they should take. Has the Secretary of State got a plan to extend the welfare mitigations in the near future?
My right hon. Friend the Secretary of State for Work and Pensions was in Northern Ireland last week. I continue to work with her and she is actively involved in looking at the issue of welfare not only in Great Britain but across Northern Ireland.

The hon. Lady is rightly giving vent to people’s frustrations. She and many people on both sides of the House, including me, feel exactly the same way, as do many of the victims’ groups. I make the point that I made in my opening remarks: when the results of the consultation came out, they were different in some detailed, but very important respects from the initial Hart recommendations. It was important to make sure that we had a solid basis of reconciliation between those proposals and the original Hart report proposals, and to make sure that there genuinely was cross-party agreement. That process is difficult and took some time, but I think that we are there now. It seems, therefore, that we have something with which we can go forward. It would be slower if we did not have cross-party consensus, so it has been sensible to take the time to get there. I agree—I think everybody here is in violent agreement—that now we are there, there are very few obstacles to moving forward at pace, and I think everybody wants to do so.
I wish my hon. Friend and the Secretary of State all the best for the discussions that will happen later today or tomorrow. If we stick to the timetable that gets the Bill through by the end of the year, will he confirm when he thinks payments can start being made to the victims?
I am afraid I cannot give my hon. Friend a precise date. The Bill will have to make its way through Parliament—through this Chamber and the one at the other end of the corridor—and there will be clarity at that point about when the payments scheme should be able to start making payments. I suspect that the appetite for a leisurely process will be very thin. I expect that people will want to crack on with this and it is right that we should want to. We would therefore want to start making preparations as soon as the civil servants constitutionally can—as soon as the direction that Parliament will go is clear—and at that point, we can start doing the preparations at an early stage, as I am sure everybody will want them to.

Commons ChamberI want to make sure that we not only restore the institutions, but do so in a sustainable way, because the people of Northern Ireland deserve to see government. Not only is it 18 months since I took this job, but tomorrow, it will be two and a half years since the Executive collapsed. We can never again be allowed to go for that period of time without government in Northern Ireland. I know the commitment that the right hon. Gentleman’s party has made to this, and the commitment of other parties, but let us be clear: the issues that caused the Executive to collapse and which have meant that we have not had an Executive for two and a half years remain, and we need to find a way to bridge that gap. I am bringing this Bill in with the utmost reluctance, but I am doing it to ensure that we have continuity of good governance arrangements in Northern Ireland. However, this is not and can never be a replacement for effective, devolved power-sharing, where locally elected politicians make decisions on behalf of the people who elected them. I know that the right hon. Gentleman agrees with that point—we have discussed it on a number of occasions—as does everyone in this House.
That is why it is clear that ultimately, agreement cannot be imposed by the UK Government, the Irish Government or anyone else. It requires the consent of Northern Ireland’s elected representatives. Twenty-one years after the Belfast/Good Friday agreement was reached, the need for all the institutions that it established to be fully functioning is there for all to see today in Northern Ireland.
We need to see the same spirit from Northern Ireland’s political leaders today that drove those who made that historic agreement 21 years ago, but while the parties continue to work towards securing an accommodation, the people of Northern Ireland should not have their services put at risk. Responsible government is about making provision for all scenarios, just in case those contingency plans are needed. I hope therefore that the House will support the Bill and will join me in urging all parties to come together.
How does the Secretary of State assess her duty to propose a date for an election? In the absence of these measures, would she have had to call an election in the very near future, or would she have had the power to name a date at some point in the future, rather than perhaps six or seven weeks after the existing powers had lapsed?
The role and duty of the Secretary of State to call an election is as set out in the St Andrews agreement and legislated for in this House. It is very clear that the Secretary of State has a duty to call an election, and there are timeframes set out for that. The Bill removes that duty, but it does not remove the discretion to call an election, if it is felt that it is the right thing to do.
I hope the Bill does not receive Royal Assent. That is a slightly odd thing for a Secretary of State to say, but I hope that the Executive will be restored before Royal Assent so that we have government in Northern Ireland and there is no need for the Bill. The Bill will ensure that all contingencies are covered. It does not preclude the Secretary of State from calling an election should they wish to, but it does mean we have the flexibility and discretion to give the talks the best chance of success. Ultimately, that is what the people of Northern Ireland want, and that is why we want an accommodation reached as soon as possible that restores the Executive immediately. On that basis, I commend the Bill to the House.

Commons ChamberI welcome the hon. Lady back to speaking on matters regarding Northern Ireland. It is very nice to see her. I know that this is a temporary move, just for today, but it is nice to have her back. She is absolutely right to say that ordinary people have been giving us this message for a very long time; I have heard it time and again. When we brought forward the Northern Ireland (Executive Formation and Exercise of Functions) Bill last October, we were clear that it was designed to give the parties space to enable them to come to the accommodation that is needed to get power sharing restored. I am as frustrated as anybody that we have not been able to get to this point before now, and it is a shame that it has taken something so tragic to focus minds, but I repeat what I said to the hon. Member for Rochdale: it has always been the intention that talks would resume after the local elections, and I see a real willingness from the political parties to do that.
The hon. Lady asked questions about the process and structure of the talks, and about civic society. I agree that there is clearly a role for the members of civic society who have done so much to hold things together in the absence of Ministers, but as I said to the Chair of the Select Committee, today is not the day to go into the formal structure of the talks. I will be happy to do that at the appropriate point, but the important thing today is to focus on getting the parties back round the table and getting agreement on the structure and framework of the talks.
The hon. Lady asked about the Government’s commitment to the Belfast agreement. I want to put it clearly on record that this Government are steadfast in their commitment to the agreement and its successors, and to all the institutions established by those agreements. She also asked about the hard border issue. We have made it clear, in the joint report in 2017 and in the withdrawal agreement, that we will not allow there to be a hard border between Northern Ireland and Ireland. The border in Northern Ireland is not just about the completion of customs dockets and the movement of goods; it is about how people feel and the emotional connection that people have with communities on the other side of the border that contain their families, their friends, their schoolmates and their colleagues. Those communities live side by side and do not see a border between Northern Ireland and Ireland. We need to ensure that that continues.
I wish the Secretary of State the best of luck with these talks. May I ask her what she meant when she said that we have a “narrow window in which genuine progress can be made”? Is she setting a deadline for an outcome from the talks, and if so, what will be the consequences if the talks fail? Might there be another election in Northern Ireland, or a move towards direct rule from here?
I can well understand why my hon. Friend is keen to ensure that contingency plans are in place, but I think that today is the day to look towards getting the talks started and the potential for them succeeding. I mentioned a narrow window because it is clear that, as for everything in Northern Ireland, there are events in the calendar that make it harder for the parties to come together. One such event is the local elections on Thursday; it is harder for parties to talk to each other and work together when they are out on the doorstep campaigning against each other. Once we have got through the local elections, we will have an opportunity for the parties to come together, and I want to use that opportunity.
