I say to my noble friend that we discussed this briefly yesterday. We are engaged with the legitimate Government of Yemen, both bilaterally and through the United Nations. Those contacts will continue, and we very much have in mind the points that she has made.

My Lords, I too support these targeted strikes thus far, in the context of the strategy that the Government and the United States are engaged in, which, as has been explained to Parliament, is to degrade the capability of the Houthis to interfere with traffic in the way in which they did and to keep the seaways open, and, by that, to stop them targeting ships and to deter them. Six days ago, the President of the United States, asked whether the strikes were working, responded, “When you say working, are they stopping the Houthis?” He answered his own question and said, “No”. He then formulated another question to himself, saying: “Are they going to continue? Yes”. Parliament is entitled to be consulted on the strategy and to know what the endgame is and how that will be measured. At the very least, there should be a debate to deal with these issues.

My Lords, I think I have answered that question. I cannot claim personal responsibility for comments made by a head of state in any other country, however distinguished. I have set out our action with regard to the Houthis. It is in defence of free navigation and in self-defence in relation to Article 51 of the United Nations. That remains the position. I am not going to comment further on future potential operational activities.

The Daily Telegraph—a very important newspaper. He set out in precise and clear detail the extent to which the Government had gone to show and make sure that our action was proportionate and deliberate. We will continue to operate in that way, also protecting operational security.

My Lords, further to the initial point made by the noble Baroness, Lady Falkner, there is a trap of aggression leading to further escalation. I draw your Lordships’ attention to the views of a former US ambassador to Yemen, and now an American academic, published on Friday, in which he stated that the Houthi attacks on Red Sea shipping were, in his assessment, designed to “provoke US retaliation”. Given that the domestic popularity of the Houthis was ebbing until the outbreak of hostilities in Israel/Gaza, and that they derive almost all their support from fostering a sense of anti-western grievance, what assessment has the Foreign Office made of this hypothesis that the Houthis have foreseen and deliberately provoked military reprisals?

No one should dispute, and certainly I do not, that our air strikes, which in the words of the Prime Minister were

“intended as a limited, single action”,

were proportionate and justified. But we must be mindful that we may have degraded Houthi offensive capabilities at the price of increasing their domestic political support. Can the Minister inform us what analysis has been undertaken in respect of the likely long-term political consequences of our actions, particularly within Yemen itself?

My Lords, I do not think that “aggression” is really an appropriate word to use in this respect. The United Kingdom, the United States and other nations involved have not undertaken any form of aggression. I think that if the noble Lord, with his great experience as a very distinguished Minister, had been faced with a situation where a British warship had been attacked by 20 drones and nine missiles, he might have asked himself whether some response would be appropriate. I think I said in this Statement, and repeated in earlier responses, that very careful and calibrated warnings have been given here. But with this aggression—if one wants to use that word; frankly, it is tantamount to a piratical attempt to interrupt the right of people all over the world to trade and move, and use the freedom of the seas—there is, as I said in the Statement, a cost to inaction. The Government’s judgment, and I believe the judgment of the House broadly, would be that not to have responded to that kind of attack, not only on one of our own warships, would have a cost. Were we to lose such a warship, having been targeted by 29 weapons, that would have been regarded as a disaster. We should remember that the Houthis have launched more than 25 attacks already on ships in the region, including those sailing under the British flag. This is not aggression; this is an act of self-defence and defence of international law.

My Lords, as I expect all Back-Bench noble Lords have done, I have thought long and hard about how best to use my three minutes. I have chosen to devote a large part of them to repeating the words of Julie Hesmondhalgh, the actress who played Suzanne Sercombe—the partner and now wife of Alan Bates—in “Mr Bates vs The Post Office”. On “The World at One” on Monday, 13 minutes into her interview she was asked why she thought this drama had been so spectacularly influential. She responded insightfully. I will read her words in part:

“It is really important to remember that this was a systemic failure … it’s about lies and corruptions on a systemic level. I think part of why this series has been so popular is that we’re at peak lies and corruption and that people have had enough and that this has … been the … final straw. The expression of that and the representation of that on screen has made people say, ‘That’s enough now’”.


In these words, Julie Hesmondhalgh is speaking for the nation. We, the political classes, need to pay attention to that state of mind—particularly so in this election year as it will naturally affect how people will vote. This therefore demands a collective and corrective response.

The extent of the lies and corruption to which Julie Hesmondhalgh referred is captured in a briefing from Spotlight on Corruption and Transparency International that we all—with the exception of the Leader—received on Tuesday. It accurately and compellingly sets out the recent extent of scandal and impropriety in Westminster and Whitehall, including:

“the sale of privileged access to the Prime Minister … government awarding £1.6 billion in PPE contracts based on political connections … ministers making ‘unlawful’ decisions to favour party donors … the award of life peerages to those who have made generous political donations … An MP caught lobbying ministers in return for cash … secretive lobbying by a former Prime Minister seeking commitments … that would put tens billions of pounds of taxpayers’ funds at risk … These follow decades of scandal over expenses, cash for questions and cash for honours”.

Helpfully, the briefing also contains clear recommendations about what needs to be done to respond to the public’s strong appetite for significant reforms to uphold public integrity. Many of them are recommendations from the Committee on Standards in Public Life.

As it is impossible for me to do justice to this excellent briefing in the time available, I shall ensure that the Leader gets a copy. To the extent that he does not cover the recommendations in his winding-up speech, I ask that he treats them as my questions to him and writes.

My Lords, I thank the noble Baroness, Lady Verma, for securing this debate and congratulate her on her powerful and persuasive opening speech. She speaks truth to power very well.

It is a particular honour to follow my noble friend Lord Soley, who has sadly delivered his valedictory speech after over 43 years in Parliament—26 years in the other place and 17 years in this House. I say sadly because the whole House will miss his warmth, wisdom and judgment, so I invite the whole House to join me in thanking him for his service.

A probation officer, he was first elected for Hammersmith in 1979. He quickly became a significant figure in the parliamentary party, particularly on Northern Irish affairs, and consequently someone I came to admire well before I even met him. In 1997, the year I was first elected, beyond being re-elected, he was elected by his fellow Labour colleagues as chair of the Parliamentary Labour Party—an indication of the esteem in which he was held. Since then, it has been a real pleasure and an education to get to know him during our times together in both the other place and, subsequently, your Lordships’ House, which he joined in 2005 and I joined five years later.

I thank him for an informed and entertaining but characteristically modest speech. He has much to be proud of. I know he must be looking forward to his retirement, but he still has much to offer. He is still a crusader for more and better housing and education, civil liberties—although we now call them human rights—prison reform, Northern Ireland solutions, a responsible press and almost any other deserving cause. He is also an author, photographer and supporter of charity. Born in England, as he told us, he has chosen in his later life to live in Scotland, the wise man. There is a phrase in the Scottish cultural lexicon that perfectly fits Clive Soley and his experience of life: “a lad o’ pairts”, meaning

“a youth, particularly one from a humble background, who is considered talented or promising”.

Scotland prides itself on giving the lad o’ pairts opportunities for advancement. I am sure that he will seize them in his retirement.

In the time I have remaining, I turn to the subject of the debate. A UK-India FTA is currently under negotiation. We should remember that, in 2013, negotiations for the EU-India FTA collapsed due to concerns about the impact on India’s generic supply of and access to affordable medicines. The current negotiations appear to be in danger of foundering on the same rock. A recent leak from them revealed that the UK’s strategic position is to strengthen the position of multinational pharmaceutical corporations—many of which are based in the UK—at the expense of India’s public health safeguards, thus enabling companies to prolong their monopolies on medical products and charge higher prices for longer periods.

Presently, the UK, along with other countries around the world and providers such as Médecins Sans Frontières, relies heavily on access to affordable, quality-assured generic medicines, a large proportion of which are supplied by companies in India. Some 25% of the quality, affordable, generic medicines available on the NHS and a large proportion of medical products used by many low and middle-income countries are from Indian generics, including no less than 90% of generic medicines for HIV.

It seems rather counterintuitive that someone from these Benches needs to remind a Conservative Government of the basic principle of free trade: that having multiple independent generic suppliers for each medical product is important because the competition among them, and with the originator company, can bring prices down, enabling us better to serve public health needs and save more lives. However, this can happen only if generic companies are able to produce and supply more affordable medical products once the IP protection, including patents, on these products has expired or been removed.

The consequences of undermining India’s generic industry on supply and prices could be devastating for many countries with already stretched health budgets. This is of particular concern to LMICs, but it could also impact all countries that procure medicines from India, including the UK’s NHS. While the proposals in the leaked IP chapter of the UK-India FTA do not amount to a final negotiated chapter, they none the less point to the UK’s negotiating strategy—

I thank the right reverend Prelate for his comments, and I pay tribute to the Church and other faith organisations for all the help and support that they provide in a whole array—both in the UK to refugees coming over here but also within the region. We will continue to work very closely with faith groups, but also civil society more broadly, to provide the support that communities around the world need. We are a world leader in development, having spent more than £11 billion on ODA in 2021. In 2021, we were the third-largest ODA donor in the G7 and the fourth-largest overall donor by volume, and we remain very proud of our work in this area.

My Lords, I think that the noble Lord, Lord Browne, knows what I am going to say. I think that it is only right that, when a noble Lord arrives five and a half minutes after the start, he should not really speak. But I do accept that there are not many people here. I think it would be good if the noble Lord allowed people who were here at the beginning of the debate to speak, and if there is time afterwards then he might be allowed to speak.

My Lords, I apologise too for being late for the beginning of the Statement. I had expected it to be later in the evening and my office is in Millbank House. Anyway, I can assure the noble Baroness—to whom I apologise profusely—that I have read the Statement, because I have a very specific question and wanted to see whether there was any reference to it in the Statement, but there is not. As part of the US increasing its military presence across Europe, two more squadrons of F-35 stealth jets will be stationed at RAF Lakenheath, which is leased to the US air force. Can the noble Baroness reassure me that these will not be the dual-capable variant of the stealth aircraft, and that we will not, some time in the future, face the challenge of the United States wanting to base nuclear weapons in the UK once again?

The noble and gallant Lord is well aware that we are not in a place that we would wish to be in, which is exactly why Future Soldier has defined the path over the next few years. The Army is designed to fight; it will remain that way, and we will ensure that it is equipped to do so.

My Lords, the noble Earl will be aware that our Armed Forces are essential to our national resilience as well as to national defence. Prior to the pandemic, requests to bring them in to assist civic authorities were already rising steadily, and they more than doubled during the pandemic: about 34,000 service personnel were deployed to support the pandemic response and, this year, the pre-pandemic increased tempo has been sustained. There is no mention of this trend in the integrated review, but surely, taking account of this increased demand and the increased national defence demand, this justifies a review of the size of the Army, if we are to become the most resilient nation in the world, which is the Government’s ambition.

My Lords, I emphasise that the programme that we have called Future Soldier is the most significant transformation of the British Army in more than 20 years. As I say, it will create an Army that is more integrated with itself and with the other branches of the Armed Forces, and one that is more agile. This means an Army that can turn its hand not simply to combat in the field, which we hope that it will not have to engage in, but also to the tasks at home that the noble Lord so rightly drew attention to.

We are working closely with partners to ensure that we can quickly provide emergency humanitarian assistance. We have also announced 1,000 more British troops will be put in readiness in the UK to support the humanitarian response in the region, should it be needed. I cannot go into huge specific details, but we are working with international partners because we recognise that there may be a need in the area.

My Lords, we can impose sanctions on the three people who have been identified in the Statement, but we cannot guarantee that we can freeze and seize their assets, because we will not know where they are. They will be hidden behind all sorts of complexities of shell companies and transactions. My right honourable friend Keir Starmer in the other place asked the right questions. He said:

“We need to draw a line under Companies House providing easy cover for shell companies. We need to ensure that our anti-money-laundering laws are enforced … and we have to ensure that money is not pouring into UK politics from abroad.”


When will we be able to say that we have that assurance?

My Lords, in paragraph 14 of this update, we learn why this is a minimalist report at the request of the Metropolitan Police so as not to prejudice their investigations. In paragraph 13, we learn that Sue Gray has been instructed and has undertaken to store and safekeep all the information gathered

“until such time as it may be required further”,

and to keep it “in confidence”. In answer to a question in the other place, the Prime Minister, in avoiding giving an undertaking to publish an unredacted version of the full report, clearly referred to—although I do not have the Hansard, so I may not get the words exactly right—legal considerations about one account that had been given to Sue Gray. There were legal considerations about it that prevented him giving that undertaking was the inference to be drawn from his answer. Who has been talking to the Prime Minister about accounts that witnesses have given and how does he know that?

As I have said, I cannot comment on the ongoing Met investigation, but what I can say is that the Prime Minister has said—or the Government have now said—that at the end of the process, following the Met investigation, the Prime Minister will ask Sue Gray to update her work in the light of what is found and we will publish that update.

I think the answer has to be no. We had to move particularly quickly in very difficult circumstances. Of course, there is always a risk of fraud—all fraud is unacceptable, but there was a risk because we had to move quickly. As I say, there is a lot of work and, particularly from HMRC’s point of view, in the months and years ahead there is big scope to recover.

My Lords, fraud in government is rampant and is estimated at just under £30 billion—so writes the noble Lord in the Financial Times today. Why, in those circumstances, did the Government agree to drop the long-awaited economic crime Bill from next year’s legislatory list for Parliament to consider?

I do not have an answer to that; I will have to get an answer to the noble Lord. I say again that the schemes brought forward during those very difficult times were designed in response to a pronounced market failure, particularly with the UK’s smallest businesses struggling to access the finance that they needed to survive at the start of the pandemic. Voices from across the spectrum, including from the party opposite, were shouting at us to be sure that we acted quickly. We were already doing so, but we continued to do so.

My Lords, the Prime Minister, Dominic Raab, other Ministers and the Chief of the Defence Staff are all very fond of the phrase, “Even the Taliban were surprised at the speed of the Afghan collapse.” They do not use this because we are interested; they use it because it is supposed to support an inference that we therefore should not be surprised that they were caught out by it, and to assert that everyone was surprised by the speed of the collapse. This is not true.

We now know that multiple US intelligence reports in spring and summer warned of the fragility of the Afghan army and the Afghan Government. If that were not sufficient—and it should have been—here in the United Kingdom the visiting professor of war studies at King’s College, a man called Tim Willasey-Wilsey, who spent 27 years in the Foreign Office on these issues, was freely writing blogs on the Cipher Brief, an open-source DC-based website, explaining all the factors in the inept deployment of the Afghan army and the behaviour of the Afghan Government that supported this fragility. The question for the Government is this: why did that information, which was in the public domain and being discussed, not ring alarm bells in the intelligence community and in the UK MoD? If that cannot be answered, why should anyone trust that the Government are being honest about the situation in Afghanistan?

I have to say to the noble Lord that we were working on preparations. The preparations for Operation Pitting, for instance, involved intensive work by many government departments over recent months. It was the huge effort, bravery and commitment of our Armed Forces personnel, diplomats and civil servants in Kabul that enabled us to evacuate more people than any other country, other than the United States. The specific evacuation plan for Afghanistan was revised in January 2021 and kept under review until it was enacted. So we were making preparations as the situation unfolded.

Yes, I can assure my noble friend that that is exactly what we will be doing. We will also want to be pragmatic and through organisations and some form of dialogue see whether we can talk to the Taliban and encourage them to do the things that we are talking about, such as providing safe passage. We have a number of levers at our disposal and will use all of them to try to make sure that we can achieve safe passage for those who want to leave Afghanistan and to make sure that many of the gains in civil society and within the country for women and girls and for minorities are not lost in the coming months.

My Lords, I thank the noble Baroness for engaging with the question that I asked earlier, but she did so without dealing with the germane point of the evidence: did the Government have the ability in any form to come to the conclusions reached by other people who were not in the intelligence community? Why did the fact that they were doing that not ring alarm bells with Ministers who had responsibility, with their officials and with the intelligence community?

The noble Baroness tells us anyway that the Government were planning. Dominic Raab told the Foreign Affairs Select Committee that, back in July, the Government were planning for the possibility of an evacuation of British citizens and those who were quite rightly entitled to think that we had a moral obligation to secure their lives. Will the Government share this planning? Did it include the explicit possibility that, unlike with any other evacuation I know of, those conducting it would remove the military before they had removed the civilians? If so, did we discuss this with the United States of America and with our NATO partners and say, “We have to face the possibility that history will look back on us as having removed the source of these people’s security before we could take them out of the place of danger”? Did we do that?

I am afraid that all I can do is once again reiterate the point that the specific evacuation plan for Afghanistan was revised in January 2021 and kept under review until it was enacted. Plans within it included options to support and evacuate our diplomatic team, British nationals and their families, the continuation of the evacuation of those eligible under the ARAP scheme and the withdrawing of remaining military personnel.
