I will come to these points later in my comments, but let me say that consultation is not a vote. Ultimately, the decision about the content of the curriculum is for schools, and as I have said, we are today issuing materials, with the final version of the guidance, to schools to help them in the process of engaging with parents. But I listened to the comments about campaigning and standing up to the campaigns against RSE, and we will consider what hon. Members have said in this debate.

Will the Minister be taking any guidance from Nazir Afzal, the former Crown prosecutor in the north-west, who I understand has been brought in to mediate over the protests outside the schools? He is a practising Muslim. He is a very sensible man; he is the chair of the governors at Hopwood Hall College in my constituency. I wonder whether the Minister will be taking any of his advice.

I will take the hon. Lady’s advice, under advisement. Our senior officials are working on the ground, daily, for both schools involved in this dispute in Birmingham and with Birmingham City Council in trying to find a solution to this problem. We are working hard to try to assuage concerns, but ultimately we will be on the side of the headteacher in making these decisions, because we believe the content of the curriculum is a matter for schools.

Central to this debate are deeply held views on what is right to teach children about LGBT people and relationships at different ages—not because of bigotry or intolerance, not to push an agenda, but because they believe they know best for the children involved. This reveals the truth about equality and respect: sometimes it is hard. And when opinions differ, we should talk; dialogue is what moves us forward. That is why we are strengthening the requirements on schools to consult parents. From September 2020, all primary schools will be required to teach relationships education and all secondary schools will be required to teach relationships and sex education—RSE. We have set out in the regulations for these subjects that schools will be required to consult parents on their relationships education or RSE policies. That requirement means that the dialogue we consider so important in reducing misunderstanding and getting this teaching right will be happening in every school.

It is important to note that relationships education is not about sex, as was pointed out by the hon. Member for Rhondda. It is about learning the importance of kindness and respect for others, and providing children with the foundations to understand difference and be able to build constructive relationships with those who may appear different from them. We are encouraging as many schools as possible to start teaching the new subjects from September 2019. Whether or not schools do so, we recommend they start planning their consultation with parents now, to ensure this is done in good time and effectively. As I have said, we are publishing supporting materials to help schools to get this right.

Schools are not required to consult parents on any teaching they choose to give about the Equality Act. However, when such teaching involves young children, and when schools know that their pupils’ parents have strongly held beliefs related to the content, it is absolutely right that schools engage with parents, listen to their views and reflect. To answer the question from the hon. Member for Birmingham, Hall Green, I think it would be appropriate for a school to work with parents to determine how Equality Act teaching is delivered in the school, if that works for them. That does not mean that headteachers should spend excessive time consulting parents or that consultation should go on in perpetuity. Schools are well practised at consulting and engaging their parent bodies on aspects of their activities, and if they have good practices in place, they can and should be used to consult parents on this topic. If schools feel that their current engagement processes are not effective, the introduction of the new subjects is a good opportunity to learn from good practice in other schools and to improve.

Consultation does not mean that parents can veto curriculum content; it means sharing a proposed approach, seeking views and using those views to inform a final decision. It is not a vote. Consultation does not mean abandoning teaching about respect for difference. I do not believe that is what parents would want and it is not what schools should feel they must do. Consultation certainly does not mean that schools should be on the receiving end of intimidating behaviour, protests or bullying. The Department has been clear that protests outside primary schools are unacceptable and should stop.

The RSE legislation is clear that it is parents whom schools must consult. We do of course encourage schools to recognise and reflect on their important foundational role in local communities. If schools consider it useful to engage members of their wider community on any of their activities, including the teaching of relationships and sex education, we would support that activity. Consultation does mean the consideration of whether the strongly held views of a school’s parent body should lead it to adapt when and how it approaches certain topics with pupils. It is only right for parents to be able to share their views on how and when their child will be taught topics that are sensitive to them. Schools should consider those views and balance them with their views on the needs of pupils and the wider school community. Ultimately, it is for schools to decide their curriculum, having taken these views on board.

The hon. Lady would have been fair if she had also acknowledged that we launched a review of school exclusions, led by Edward Timpson. The Children and Families Act 2014 secures the presumption in law that children and young people with SEND should receive mainstream education—of course, 98.7% of them are educated in the mainstream. We have put £4 million into innovation funding to improve alternative provision as well.

There are clearly funding pressures on the system, which is why we have announced £250 million in additional funding to take the funding to £6.3 billion. We are in the middle of a spending review and I will be putting my best foot forward to make sure that we get the funding in place.

It is a pleasure to serve under your chairmanship, Sir Roger, and I thank the hon. Member for Gloucester (Richard Graham) for securing this important debate. I have in my constituency Hopwood Hall College, a further education college that is in the top 10% in England for level 3 progress and has the highest achievement rate for vocational level 2 in Greater Manchester. That college is rooted in our local community, and is crucial to driving social mobility and providing the skills needed to boost our local and regional economy. My partner taught art and design at Hopwood Hall before he retired. I mention that because, later in my short speech, I will refer to his experience of teaching young people.

Many young people in my constituency also choose to study at sixth-form college. In my neighbouring constituency of Rochdale, we have Rochdale Sixth Form College, which in January this year was named the highest-ranked sixth form college in the UK for value-added performance for the fifth year running. However, although my local FE institutions enjoy success, both have expressed to me their concerns about funding issues and their long-term sustainability. The Institute for Fiscal Studies has highlighted the shocking cuts to 16 to 18-year-old and adult education over the past decade. It has stated:

“Funding per student aged 16–18 has seen the biggest squeeze of all stages of education for young people in recent years.”

Those funding cuts are affecting the sustainability and quality of FE provision, with colleges having to deal with an average cut of 30% while costs have increased dramatically.

Research from the House of Commons Library shows that when the educational maintenance allowance for 16 to 19-year-olds was scrapped by the coalition Government and replaced with a bursary scheme, expenditure through that scheme was only about a third of the expenditure on EMAs. When that happened, my partner was still teaching, and I remember him telling me that students were forced to drop out of his course simply because they could no longer afford the bus fare to get to college. The scrapping of the EMA scheme was a cruel blow to the most disadvantaged students and their efforts to access an education, and a Labour Government would reinstate that scheme, which has been proven to support retention of students in education.

Clearly, something has to change; this situation is just not sustainable. The solution, as many Members have already said, is to raise the national funding rate for 16 to 18-year-olds. It makes sense to do so, as there is little point in investing in pre-16 and higher education if the pivotal stage in the middle is overlooked.

Maintained Nursery Schools

It is a pleasure to follow my hon. Friend the Member for Birmingham, Erdington (Jack Dromey). Like him, I have met the headteacher of the maintained nursery school in my constituency, and she also praised the Minister for his openness and willingness to listen. I hope that the Minister takes heed of those remarks. I also thank my hon. Friend the Member for Manchester Central (Lucy Powell) for securing the debate, and for her expertise and hard work on this subject.

In my constituency of Heywood and Middleton, there is just one maintained nursery school left: Sunny Brow Nursery School in Middleton. I just want to say that my praise of the great work done by Sunny Brow Nursery should in no way be taken as a criticism of the other nursery providers in my constituency. I know how important childcare provision is and how valuable the service is to parents, employers and families. I would like to see all nursery provision being valued and an end brought to the minimum wage culture. We trust all nursery nurses with the care of our children. It is an important and responsible job, and should be remunerated as such.

Last week, I met Janet Cook, the headteacher of Sunny Brow Nursery, as well as the governors and parents, to discuss the dire funding situation facing the nursery. We also talked about the huge educational contribution and fantastic start in life that Sunny Brow has given to the children who attend it. The parents talked about how their previously shy and withdrawn children had blossomed in the atmosphere of Sunny Brow. One parent was guardian to a child who, sadly, suffered from foetal alcohol syndrome. She talked about how much the expert teaching at Sunny Brow had helped this child to prepare for primary school, in stark contrast to his two siblings with the same syndrome who had not had the benefit of attending a maintained nursery school and both struggled when they entered mainstream schooling, with many breaks and problems in their subsequent school careers that could and should have been addressed in the early years—the most important years in anyone’s education.

Sunny Brow employs graduate class teachers to provide the excellent care and education from which these children benefit and on which they thrive. Yet the future of the nursery is uncertain due to the lack of clarity over what will happen when the Government top-up fund comes to an end in April 2020. The headteacher told me that unless another source of funding becomes available, Sunny Brow, which has provided early years education in Middleton since the second world war, will no longer be able to operate and will be forced to close. We cannot allow this to happen. We know how important early years education is. This is supported by the Government’s own studies, which show that those from poorer backgrounds are likely to benefit more from education and care from the age of two.

The 30 hours’ childcare costs have helped to put extra pressure on maintained nursery schools’ budgets, as they do not get all the funding back for the 30 hours. This is an additional pressure for Sunny Brow, coupled with the uncertainty of its future post April 2020.

Sunny Brow serves a catchment area of pupils that includes many with specialist needs and disadvantaged backgrounds. With my constituency only 395th out of 533 parliamentary constituencies in the recently published “Social Mobility Index”, it is vital that we are able to maintain the high-quality early years provision provided at Sunny Brow Nursery. We should be celebrating the achievements of nurseries such as Sunny Brow, and their contribution to social mobility and closing the attainment gap, rather than letting them simply wither on the vine due to a lack of funding. Any Government who are serious about improving social mobility—I do believe that the Minister is serious about doing that—should be promoting the expansion of maintained nursery schools, especially into deprived areas like mine, not joining in a race to the bottom. I wish the Minister the best of luck in putting pressure on the Treasury to release funding for this vital service. He can rely on support from Labour Members in so doing.

I am grateful to my hon. Friend. I suspect that we may be going on a regional tour of colleges over the next 25 minutes or so. The picture that my hon. Friend paints is familiar across the country; indeed, it is all too recognisable across the nation. I represent Cambridge, a place that is rightly associated with excellent education and where higher education often dominates the agenda and discourse. Somehow that makes the contrast all the more stark between the focus on higher education policy—and, frankly, the resources—and that which goes to further education. Many of us remember the huge national outrage when tuition fees for university students were introduced and later trebled, but when fees were introduced in further education, where was the outrage? Where were the marches? In my patch, it was just me and a handful of local trade unionists out there talking about it—thanks, Peter Monaghan and others from Cambridge. Some people noticed, but the vast majority did not. Was the matter considered newsworthy? Hardly at all.

I would like to add to the points that my hon. Friend is making. Where was the outrage when the education maintenance allowance was taken away? That seriously affected students in further education, many of whom were unable to afford the bus fare even to get to college and receive an education.

My hon. Friend is absolutely right. That issue is almost worthy of a whole debate in itself, but the problem is not just the removal of the education maintenance allowance, of course. Where was the outrage in the country about the near collapse in the number of mature and part-time students? People can read about that in the pages of the specialist press; I think that we all know why it does not reach any further.

We have an ongoing call for evidence. [Interruption.] I think it is extremely important to hear the views of young people themselves, because they are very aware of what sort of relationship and sex education is needed. There is no doubt that the Department will make sure these guidelines are out as soon as possible, because there is clearly an urgent need. It is absolutely right that we hear the views of young people on how they feel this should be delivered.

There are limits to the influence and voting proportion that local authorities can have in multi-academy trusts. This is about a new independence for academies. I have been discussing with my hon. Friend the particular multi-academy trust about which he is concerned, and I am happy to continue to have those discussions with him and with my noble Friend Lord Nash.

The higher education sector has taken this issue very seriously indeed. The Department has had a positive and comprehensive response from all 238 HEFCE-funded providers and designated alternative providers. When issues have been identified, providers have been quick to respond to protect student safety. Officials will continue to work closely with those in the Department for Communities and Local Government who are reviewing private student accommodation.

It is a pleasure to be able to speak in this debate and to follow my hon. Friend the Member for Nottingham North (Alex Norris) and all the wonderful, passionate and eloquent maiden speeches that it has been my privilege to listen to this afternoon.

The Queen’s Speech says that we will invest in schools, ensure that every child has the opportunity to attend a good school and see that all schools are fully funded. The National Association of Head Teachers says that the general election result showed that the public did not endorse many of the Conservatives’ more controversial policy ideas, including expanding selection and ending universal infant free school meals. It is right that those policies have been dropped from the Government’s legislative programme.

The Conservative manifesto contained a commitment to ensure that no school would lose per pupil funding under the formula, and it is vital that that promise is now followed through. However, the House of Commons Library says that the Government’s new funding formula would have “winners and losers”, with 54% of schools seeing a cash increase and 46% seeing a cut.

Figures from the National Audit Office show that, in the Borough of Rochdale of which my constituency of Heywood and Middleton forms a part, our schools are facing cuts of £15 million. On average, our local schools are facing cuts of £550 per pupil, which is equivalent to the loss of 468 teachers across the borough, leading to larger class sizes and increasing stress and disillusionment among those teachers remaining in post.

I have been contacted by many headteachers and teachers in my constituency, who have expressed their real and serious concerns about the impact of the new funding formula on our children’s education. They have told me that they have had to make budget savings year on year, and that now the cupboard is bare. The imposition of any more cuts will give them no option but to reduce the number of teachers. Locally, none of the schools in my constituency is a winner; they will all lose out under the new funding formula. Nationally, the picture appears to be much the same, with even Tory MPs complaining that these cuts are “entirely unacceptable”.

We must not forget our international obligations. We have signed up to sustainable development goal No. 4, which commits to ensuring that by 2030 all girls and boys complete free, equitable and quality primary and secondary education.

Last week, the wonderful children at St Vincent’s Roman Catholic primary school in Norden in my constituency invited me to a morning assembly on the theme of “send my friend to school” where they sang and performed brilliantly on behalf of their international neighbours. They reminded me that, at our current rate of progress, sustainable development goal No. 4 will not be achieved until 2084. None the less, it made me very proud to see those children looking outwards, not inwards. Seeing this care and compassion among our young people gave me hope for the future, and I hope that this Government will take note.

Let me briefly touch on the recent election. The Prime Minister recklessly gambled with her majority and lost it. Far from providing strength and stability, we now have a fragile minority Government propped up by Democratic Unionist party votes. I was one of the few MPs who voted against the election—because of voter fatigue. My constituents have had a major election every year since 2014, and at the time the election was announced we were in the midst of the Greater Manchester mayoral elections. I tried to save the Prime Minister from herself but to no avail.

It is essential that we support learners while they study if we are to grow the number of skilled workers that the economy needs. The Government will introduce maintenance loans for learners studying higher-level technical qualifications at level 4 at national colleges and the new institutes of technology from the 2019-20 academic year. Maintenance loans will be available for the first time for both full-time and part-time higher education distance learners in the same year, subject to satisfactory controls being in place.

I thank the hon. Gentleman for his question. I am very supportive of distance learners and the incredible work of the Open University. We want to offer these maintenance loans, but we want to get this right; we have a duty to ensure that we are providing the right value for money for the public and that the right controls are in place.

The Chancellor, in his Budget statement, declared a commitment to lifelong learning, yet maintenance loans have been capped as being for those of less than 60 years of age. Given this Government’s apparent determination to raise the retirement age and their appalling treatment of the WASPI—Women Against State Pension Inequality Campaign—women, does the Minister agree with me, and probably with Dame Vera Lynn, that life most definitely does not end at 60?

It is this Government who have introduced advanced learner loans; we are going to have maintenance loans for students going to institutes of technology or national colleges, and for future distance learners; and we have just announced an extra £500 million to support further education. This Government are actually backing skills and giving people the funding they need.

It is a pleasure to serve under your chairmanship, Mr Hanson. I wanted to speak in the debate for three reasons. The first is that I personally have never quite fathomed the fashion for cripplingly high heels. I have only ever owned one pair of really high heels. Bought for a wedding, they were worn once and then consigned to the charity shop. I have always been a fan of the comfy shoe—nothing gladdens my heart more than a sensible shoe in a broad fitting.

The second reason is that I was a workplace trade union rep for Unite the union before I was elected to this place, and I have spent many happy and not so happy hours discussing dress codes with various HR advisers and managers. That is a truly thankless task, and I would advise against it if it can possibly be avoided.

I was one of the people with whom the hon. Lady would have been having such a discussion, although I suspect that it might not have been a thankless task if the discussion had been between us. Did she ever discuss, as part of any of those negotiations, a requirement to wear high heels?

I am happy to say that I did not, because I worked for the NHS and our dress code was very much along health and safety lines and about protecting people at work, rather than forcing them into garments that are unsuitable for the workplace.

The third reason why I wanted to speak in this debate is that I am a feminist and I find the idea of women being forced to wear certain items—any items, but particularly those that are uncomfortable and inhibit our ability to walk properly, stand for long periods of time or even run away—quite abhorrent. I find the idea that an employer might make the wearing of such items a prerequisite for a job even more abhorrent still.

I can remember when the NHS trust that I used to work for produced a 30-page document outlining what staff could and could not wear—from the contents page containing headings such as “acrylic nails”, “make-up”, “hair”, “jewellery”, “tattoos” and “piercings”, to the extremely prescriptive details on each subject that followed. I was interested to hear the flesh-coloured tights dilemma that my hon. Friend the Member for Warrington North (Helen Jones) highlighted—I remember the long conversations we had about what exactly was meant by the requirement to wear flesh-coloured tights. Given the diversity of our workforce, what colour of flesh did management have in mind? After much discussion, management finally agreed to drop that requirement.

Piercings and tattoos were another source of much agitation. I worked in a laboratory and recall our laboratory manager, having interviewed for a lab assistant, appointing a young man who turned up for his first day with his face resplendent with various piercings that he had not worn to the interview. I remember the anguished cry of our laboratory manager—“We’ve taken on Metal Mickey!” He appeared to feel that he had been duped in some way. Yet that young man proved to be conscientious and good at his job, and given that his role involved minimal contact with the public, his visible piercings were not really too much of a problem.

Of course, a lot of dress code issues in the NHS are necessary because of health and safety at work and the need to wear personal protective equipment. I certainly do not think there was any emphasis at all on making women conform to some odd standard of stereotypical attractiveness, as the petition concentrates on. However, I mention those details to emphasise that dress codes do not have to be 30-page documents stipulating down to the tiniest detail what can and cannot be worn. I recall the deathless phrase in our code, “Underwear must not be visible”, and wondering whether that also applied to my boss’s string vest, which was always clearly visible through his white shirt, and exactly where people buy such things from.

A good dress code only has to be a few lines long, and my own council, Rochdale Borough Council, has an exemplary policy that is brief but covers all eventualities and health and safety requirements. It simply states:

“First impressions count and there is a general expectation that employees dress appropriate to the nature of their duties and responsibilities. The Council values and welcomes the ethnic diversity of its workforce and therefore expects all employees to recognise and respect this in terms of dress. Where there is a clear business, service or health and safety reason appropriate dress codes may be introduced following consultation to suit the service needs and meet public expectations. Uniforms must be worn where required and provided. Personal Protective Equipment must be worn where it is appropriate to do so or if directed by the manager or Health and Safety Advisor.”

I was interested to hear the hon. Lady read that. There was a part where she said that uniforms must be worn where provided. However, the issue is whether the uniforms required are appropriate; ultimately, the key arbiter of that must be a court, which will establish whether an employer has gone too far. Does she therefore agree that, to reiterate what I said earlier, the key is to ensure that people can access the courts to establish where the boundaries lie and to achieve justice and case law that will apply to future circumstances?

Yes, I agree that every worker should have access to the courts. Unfortunately, the tribunal fees that have been introduced have restricted such access. I think I am right in saying that no employee of Rochdale Borough Council has had to seek that access; I appreciate the hon. Gentleman’s point, but the uniforms provided by Rochdale Borough Council tend to be practical and appropriate for the job.

A brief dress code such as that is really all that is needed. Any attempt to be prescriptive and go into further detail about particular items of clothing is a waste of everyone’s time and, given the vagaries of fashion, likely to be quickly superseded by some new fad or trend.

I personally think that high heels hobble and restrict women and hamper our ability to move freely, and even to run away if necessary. However, I recognise that some women choose to wear heels of their own volition, and I will not criticise them for that—we should all be free to wear whatever we like. What I cannot tolerate is employers trying to force women into an ideal of what constitutes professionalism or power dressing by insisting that particular items, such as cripplingly high heels, must be worn.

I am reminded of Ginger Rogers’ famous response when she was asked about dancing with Fred Astaire and said, “It’s easy, I just do everything that Fred does,” and then added, “just backwards and in high heels.” That is all these strict dress code stipulations are—an attempt to hobble and restrict women, meaning that we have to perform as well as men, if not better, while being held back by quaint, stereotypical notions of what constitutes femininity and a professional appearance. So I say to women everywhere, “Let’s have no more going backwards in high heels; let’s go forwards, and in sensible shoes.”
