Commons ChamberI do not accept that at all. It is inevitable with a change of this magnitude that it will be essential for state interventions to trigger private investment. That will go in the first instance where it can trigger additional growth in the market. We use the LEVI fund and other mechanisms to ensure equity across the country.

That the Committee has considered the draft Drivers’ Hours, Tachographs, International Road Haulage and Licensing of Operators (Amendment) Regulations 2022.
It is a delight to see you in the Chair, Ms McVey.
The draft regulations will be made under the powers conferred by section 31 of the European Union (Future Relationship) Act 2020. They are to implement fully some of the international road transport provisions in the trade and cooperation agreement between the European Union and United Kingdom, which was entered into on 30 December 2020 and is known as the TCA. The regulations are mainly about drivers’ hours and tachograph rules for most commercial drivers of lorries and coaches, but also involve international haulage access to the UK.
Section 29 of the European Union (Future Relationship) Act 2020 provides a general implementation clause under which domestic law, including EU regulations retained as UK law, is, where necessary, interpreted in order to implement the TCA. On top of that, the changes being proposed by the statutory instrument will formalise the relevant TCA provisions into UK domestic law to provide legal clarity. That will also enable UK enforcement officers to enforce against EU commercial drivers in the scope of lorries and coaches operating in the UK.
The regulations amend in the first place the retained EU regulation (EC) 561/2006, which sets out driving time rules for commercial drivers. Secondly, they amend the retained EU regulation (EU) 165/2014, which sets out rules on the installation and use of the tachograph device, a recording device used for the enforcement of the driving time rules. Thirdly, the regulations amend the retain EU regulation (EC) 1072/2009, which sets out rules on cabotage movements. They also amend the domestic Goods Vehicles (Licensing of Operators) (Temporary Use in Great Britain) Regulations 1996, which set out the rules for non-GB operators’ access to GB roads.
I notice that the explanatory memorandum states that the SI
“also removes some access rights for EU operators to reflect the market access in the TCA”
Can my right hon. Friend say what sort of rights are being removed from EU operators?

Commons ChamberThe hon. Lady will be aware that we have backdated business grants to address some of these concerns. It is also worth mentioning that the third phase alone of the self-employed scheme is expected to cost more than £7 billion. As the Chancellor said, it is part of a wider package of support that we are trying to give to businesses and individuals affected by the crisis.

Commons ChamberThe hon. Gentleman is absolutely right that there are benefits associated with extending the zero rate of VAT in this area, as in others. The task for Government is to work out what is the right thing to do, all things considered. All I can say is that we have responded to the Cairncross review in part of this area, and we continue to keep all taxes under review, especially in the lee of a budget.
While agreeing with the point made for the SNP by the hon. Member for Linlithgow and East Falkirk (Martyn Day), does the Minister not find it somewhat ironic that the only way we can reduce the rate of VAT to zero is through Brexit, yet the SNP wishes to remain in the EU, and we would therefore not be able to reduce VAT if that were the case?
That is a very telling point, and I draw the House’s attention to the parallel issue of sanitary products for women, on which I am pleased to say we will be able to act after we have left the EU.

General CommitteesLet me say two things. First, as the hon. Gentleman will be aware, this is a very complex area and the draft regulations cover a wide range of subjects, including—I have listed some of them—airport security areas, planning, aircraft search, passenger baggage screening and many others. Secondly, we are not in a position to—indeed, we have made an undertaking to Parliament that we will not—change the substantive provisions, even where improvements are possible for policy reasons that are widely accepted across Parliament. That is because this is a lift-and-shift exercise. It should remain open to Parliament to scrutinise, through the normal mechanisms, any further legislation that changes Government policy.
Surely the whole point of Brexit is that Parliament will be free to make changes to and improve legislation in due course, once we are out of the European Union. Until we are out of the European Union, we are rather bound by Brussels diktat.
That is one way of putting it. I would say this: the European Union (Withdrawal) Act 2018 and this process with SIs establish a baseline against which a future autonomous British Government can make decisions.

That the Committee has considered the draft Operation of Air Services (Amendment etc.) (EU Exit) Regulations 2018.
May I say what a pleasure it is to serve under your chairmanship, Sir Christopher? Following the UK’s decision to leave the European Union after the referendum in 2016, the Government have been working to develop a positive future relationship with the EU, including a comprehensive and ambitious air transport agreement. The Department for Transport has undertaken a significant amount of work with respect to the withdrawal negotiations and to prepare for the range of potential outcomes. The best outcome, as we all recognise, is for the UK to leave with a deal. A draft withdrawal agreement that delivers on the referendum, brings back control and protects jobs is now being considered by the House.
May I tell the Minister how relieved I am to hear what he said? If I believed others, I would think that, once we left the European Union, planes could not fly into the UK, and planes from the UK could not fly to Europe. Do I take it that all that was a load of hogwash?
I cannot comment on the wisdom or otherwise of comments made at the time, but on 7 March this year the President of the European Council, Donald Tusk, said,
“I am determined to avoid that particularly absurd consequence of Brexit that is the disruption of flights between the UK and the EU.”

That the Committee has considered the draft Electricity and Gas (Energy Company Obligation) (Amendment) Order 2017.
It is a pleasure to serve under your chairmanship, Mr Hanson, especially since you are not Geraint Davies, whose name I see on the form. In addition to thanking you, I thank all colleagues who have come at this early hour to assist us with this piece of legislation.
If other Members wish to proclaim themselves keen as well, I welcome that.
In the Prime Minister’s first speech of her term in office, she acknowledged the hardships faced by poorer households in Britain—those hard-working families who, in her words
“can just about manage but worry about the costs of living”.
As part of the response to that dilemma, the Government are committed to helping households in fuel poverty or on lower incomes and those living in homes that are expensive to heat. The order is designed to move us further towards that goal.
Regarding the cost of living and the cost of heating people’s homes, I have one question, having briefly looked through the explanatory notes. I wonder whether these tighter regulations, while perhaps helping to save the planet, might increase the cost of installation or operation. Has the Department made any analysis of the effect that the order will have on installation?
I am very grateful to my hon. Friend for that intervention, and I congratulate him on making it when my remarks have barely started, such is his eagerness. The Department of course scrutinises the cost of legislation, and the order is designed to allow a transition period precisely to set the suppliers up for the next supplier obligation, which will be introduced in 2018. That should allow time for any costs associated with the changes to be absorbed within the system.
The order will also make an important contribution to the Government’s clean growth plan and to reducing carbon emissions. We are making amendments to the existing Electricity and Gas (Energy Company Obligation) Order 2014, which covers the period from 1 April 2015 to 31 March 2017. The amendments extend the current scheme from 1 April 2017 to 30 September 2018 to enable reforms to be introduced while also allowing the industry time before further improvements are made through a new longer term scheme that will run from 2018 to 2022. Planning ahead to 2022—beyond the life of this Parliament—reflects announcements on funding made in the 2015 spending review. The longer term confirmation of funding is designed to give greater certainty to energy suppliers, installers, local authorities and other energy stakeholders.
The Government are facing up to the enormous energy challenges our country faces over the coming years. With the overhaul of the electricity market and continued investment in renewable technologies, we are making good progress towards ensuring that the UK’s energy is secure, low carbon and affordable. Improving the energy efficiency of the UK’s homes is central to that challenge and to reducing fuel poverty. The energy company obligation scheme helps occupants to keep warm, reduce their energy bills and protect their health and wellbeing by requiring energy suppliers to reduce carbon emissions and energy costs through installing energy efficiency measures in households across Great Britain. The supply chains involved in that endeavour also provide economic benefits across the country.
Since the introduction of the ECO in 2013, the scheme has proved to be a remarkably reliable and cost-effective means of upgrading our housing stock. Altogether, more than 2 million energy efficiency measures had been installed in more than 1.6 million homes by the end of December 2016, with around 1.2 million of those measures going to 900,000 low income and vulnerable households and households in deprived areas. That is a significant investment in addressing energy efficiency and fuel poverty. Thanks to the amendment order we are introducing today, we forecast more than half a million more insulation measures and around 45,000 more heating measures will be delivered through the ECO by 2018.

Commons ChamberI am unsure whether I entirely caught the hon. Gentleman’s remarks, but the Government have been clear in their support not just for the UK continental shelf and the companies on it, but for Aberdeen through the £250 million city deal.
I am sure that my hon. Friend will understand that I will not comment on that specific economic issue. However, I admire his awareness of the oil spot price. The Government have managed to engineer a significant fall in oil and gas supply costs on the continental shelf—[Interruption.]

Commons ChamberThe Minister is quite right to say that he will analyse this in the round, because while I think many of us will recognise the economic advantages, particularly over a long period such as 100 to 150 years, the environmental impact will be considerable. Can he perhaps amplify what sort of things he will be looking at, including how tidal lagoons affect fish life, marine life and bird life?
It is of course true that, as well as the economic case and value for money issues that that raises, there will be wider consideration of environmental impacts, but in relation not just to individual schemes as they can be understood now, but to the way in which they might concatenate across a programme of tidal lagoons.

Commons ChamberI am very pressed for time. I hope that the right hon. Gentleman will not mind if I allow him to intervene later, perhaps at the end of my speech. We are under tremendous time pressure.
Secondly, Ms Mills was and, indeed, is herself subject to an inquiry by the Australian Parliament. Thirdly, the Speaker’s panel of selection was purely advisory, and was smaller than, and assembled on a different basis from, that used in 2011. Fourthly, the terms of the process of recruitment changed from the original terms set out by the House of Commons Commission on 30 April 2014. Fifthly, while acknowledging the Clerk’s executive functions, the advertisement for the post in The Sunday Times led with, and specifically emphasised, “constitutional matters” and the Clerk’s role as
“chief adviser to the Speaker, the Leader of the House and other members of the Front Bench on matters of procedure and privilege”.
Sixthly, outside headhunters, Saxton Bampfylde, were used for the first time. Seventhly, despite all that, the final candidate—Ms Mills—was, in effect, recruited for a job that did not then exist as such, that of chief executive of this House. Finally, the letter nominating Ms Mills was signed by the Speaker on the advice of the panel, was sent to 10 Downing street during the recess, and, but for the intervention of Parliament, might have been forwarded to Buckingham Palace during the recess.
I am delighted that my hon. Friend has put this motion before the House today. Is he aware that I understand from an answer to me that the panel was completely unaware that Carol Mills was undergoing investigation—two investigations, actually—by the Australian Senate before it made its decision? Moreover, Saxton Bampfylde wished to inform the panel that that was the case, and the panel was advised not to take evidence from it.
