Commons ChamberThe Secretary of State has made that clear, but I have some nervousness when talking to my right hon. Friend because of the extent and difficulty of the walk he and I have had together; I know how powerfully he feels about these issues. I am very clear that the EU can only legislate in relation to the goods law that remains in place and we have had the very clear assurance on VAT, but if he has any further doubts or concerns about this, I would appreciate the opportunity to sit down with him, go through it in great detail and answer all his questions, even if he is not 100% satisfied. As I have said—I think now for the fifth or sixth time—I know that leaving in place some EU law in Northern Ireland is a hard compromise for Unionists and Eurosceptics. It is a hard compromise for me, as I know it is a hard compromise for him. Nevertheless, eight years on, we have delivered what I would regard as alternative arrangements in Northern Ireland—something we were once told was magical thinking and worthy of unicorns.
Does the Minister of State join me in welcoming the fact that we currently have the first applicability motion being brought before the Assembly? It is a change to the previous arrangements and enables the Assembly to vote on whether a change to an EU law can apply in Northern Ireland. Furthermore, under the auspices of the Assembly’s newly established Democratic Scrutiny Committee, the Assembly will be able to block the application of new EU law and refer it to the UK Government for further consideration, and that ultimately the UK Government can veto that law being applied in Northern Ireland. While imperfect, these arrangements represent very substantial progress from where we were, which was an automatic pipeline of EU law, with no opportunity for scrutiny, and no opportunity to block or veto such a law. We are certainly in a better place than we were before these new arrangements.
I am most grateful to the right hon. Member. Of course I welcome these arrangements. I was very pleased to give instruction to my officials that the Assembly should be notified. Beyond that, on the particular measure, I do not wish to go any further at all, because I am absolutely determined that this should be a matter for the Assembly, with the UK Government stepping back and leaving it to the democratic consent of MLAs.
Elements were relevant at the time, as the Secretary of State has just mentioned to me, but, alas, I was not the relevant Minister at the time. I did the European Union (Withdrawal Agreement) Act 2020, not the European Union (Withdrawal) Act 2018. However, if I am advised otherwise by officials after this debate, I shall certainly write to the shadow Secretary of State and place a copy of the letter in the Library of the House. I am not expecting to be advised that there would be significant consequences, but I shall certainly take advice.
I particularly appreciated the shadow Secretary of State’s exegesis of the Acts of Union. I am not a great historian, and I appreciated his running through those things. We are of course all absolutely united in our desire for a better future for Northern Ireland.
The hon. Member for Gordon (Richard Thomson) welcomed the compromise and the pragmatism of everyone involved. I do not think I will tease him, as he has teased me, on that particular point. He made a very thoughtful speech about people’s ability to indicate their consent or otherwise to membership of a particular state, and he raises some important matters that I will not have time to go into.
I particularly appreciated, of course, the leader of the DUP’s speech. I think this is a very good day for Unionism. Speaking as an English MP, even though I have been choosing to go to Northern Island since 2013, it is very easy as an English MP to neglect the Union. What we have seen through this process is that the whole Government and the whole House have come far more deeply to appreciate the need to nurture the Union. I think today is a good day for the Union, and I think the right hon. Gentleman and his right hon. and hon. Friends have done a service to the whole Union by highlighting these issues and forcing us all to confront the need to nurture the Union, even if, as I think it is fair to say, it is not one of the most prominent issues in English constituencies. I certainly pay tribute to him and his DUP colleagues for what they have achieved.
As the right hon. Gentleman made a point about the red lane, and the need to improve further and move more goods out of it, which I am absolutely all for doing, I think it is worth reminding everyone of who voted for the Northern Ireland Protocol Bill. I believe everyone in the DUP voted for the Bill.
There are nods of assent. The Northern Ireland Protocol Bill established the principle that there should be a red lane, and we do need to remember that the red lane is therefore legitimate. It is something that we should all have expected. On the issues that have been invented, I think we have enough practical problems in this life without inventing additional ones.
I want to turn to the remarks of the hon. Member for North Down (Stephen Farry), because he said that Brexit is the original sin. I am going to accept the temptation that he put before me to respond on this point. Occasionally, we get the opportunity to comment on matters of historical sin, and I hope the House will forgive me if I say that to me the original sin was proceeding with the Maastricht treaty and all it meant without getting consent. It was compounded by the mortal sin of proceeding with the Lisbon treaty positively against the expressed wishes of a number of populations. That is what brought me into politics—positively establishing the European constitution by another name against the expressed wishes of populations in referenda.
I take the hon. Gentleman’s point about Brexit being the original sin. Although I am tempted to say that I am an unapologetic Unionist, a waggish official reminded me earlier, “But, Minister, you’ve made a number of apologies”—apologies notably in relation to Ireland, but I do not mind sharing with the House and the public that, during the early days of my appointment to this role, I said to a number of stakeholder groups in Northern Ireland, particularly in the area of Derry/Londonderry, “Yes, I am sorry that you have been put to as much trouble as you have through this withdrawal process.” I have great sympathy with what he says, but if we can step back a little, out of this whole process, there is a lesson for those who wish to make great constitutional changes, and that is to take the public with them at all times, but I am certainly not perfect in that regard. I for one, however, wish to put all that behind us and to move forward.
The hon. Gentleman mentioned the all-Ireland economy and talked about the need for east-west and north-south to operate in harmony, and I am of one mind with him. I am absolutely all for free trade and removing all barriers to free trade wherever that can be done consistently with democratic consent.
Casement Park came up a couple of times, and we need to see a proper business case with a full statement of the costs involved. Clearly, there has been inflation in the costs, and we need to see what the full bill would be.
Revenue raising was part of the financial settlement tabled in December. The Government’s primary objective is to support stability and fiscal sustainability through a restored Executive who have the tools to deliver better outcomes for the people of Northern Ireland in an affordable way. That is why a condition of this package—specifically, the quantum of debt to be written off—will be agreed on a proportionate basis to locally raised revenue generated from the implementation of the Executive’s fiscal sustainability plan.
The right hon. Member for East Antrim (Sammy Wilson) made a very interesting speech. I do not doubt that we have arrived where we are by a circuitous route, but here we are, and I think this is a happy day for Unionism overall. As the right hon. Gentleman the leader of the DUP said, we have a great opportunity to go forward now and make Northern Ireland work for all the people and to persuade them, in the context of those changing demographics, that they would be well placed to continue to choose to remain within the United Kingdom.
The hon. Member for North Antrim (Ian Paisley) set me a number of questions, and I do not wish to further return to the rabbit hole he mentioned on border polls. I think I will just refer to my opening remarks, which were crafted to avoid any kind of ambiguity. He asked: when will we see action? We have seen action: we have legislated twice already, we are here for this Humble Address and we will continue to take action.
On the veterinary medicines working group, I will undertake to write to the hon. Gentleman before the week is out on the progress in establishing it, and I will place that letter in the Library so that others can see it, because I know it is a subject of the first importance, particularly to him. I shall write to him to set out our progress towards establishing that working group. I gave officials very clear instructions that we were to proceed with great haste, as swiftly as possible, to the establishment of that group and the horticulture working group. The horticulture working group is already established, and we will have further communication to do on that point.
Intertrade is dependent on the East-West Council, and we will need to work through those issues, including across Government. The hon. Gentleman will appreciate that for east-west work to be effective we must properly engage, particularly with our colleagues in the Department for Levelling Up, Housing and Communities, and with the other devolved Administrations. Let us get this thing right. That means it will take just a little time, and I hope he can bear with me. As I said in my opening remarks, I am determined to proceed as swiftly as possible and to keep the House informed, including on the point about the Department of Agriculture, Environment and Rural Affairs. The hon. Gentleman has already undertaken to give me the examples he mentioned, and I look forward to processing those. His history is better than mine. He referred to the Home Rule debate in 1879, and let us hope that we continue to do better than they did. They took 78 years to resolve some of those matters. We have already made swifter progress, and I am proud of it.

Perhaps the most powerful illustration of the change that we have secured is to consider what will happen now on the ferry route between Dublin and Holyhead as a result of these new arrangements. A Northern Ireland haulier using that service will board the ferry, travel to Holyhead, leave the ferry and travel straight out of the port and on to their destination, with no customs procedures and with full unfettered access. In contrast, a southern Irish haulier arriving at Holyhead will be subjected to full UK customs procedures at the port before they can proceed. Does he join me in welcoming Northern Ireland’s restoration fully within the UK internal market?
Yes. The right hon. Gentleman is absolutely right in what he has just set out, and I do join him in that. It is a proud day for me, as it is for him, and I join other Members in congratulating him on his courage in bringing all of us this far.
As a result of these regulations, we now have guarantees for Northern Ireland goods moving to the rest of the UK, via Dublin. This unfettered access is future-proofed, regardless of how rules evolve in either Northern Ireland or Great Britain. These regulations will more squarely focus the benefits of unfettered access on Northern Ireland traders. The regulations tackle avoidance of the rules and ensure that, for agri-food goods to benefit from unfettered access in avoiding sanitary and phytosanitary processes, they must be dispatched from registered Northern Ireland food and feed operators. We will also expressly affirm through these regulations that export procedures will not be applied to goods moving from Northern Ireland to other parts of the UK’s internal market.
With great respect to my right hon. Friend, with whom I have gone a very long way in this cause, he might like to revisit the text. The point is that the 80% of goods going on that route are staying in Northern Ireland; they are UK goods. The other 20% are goods that are going on to the European Union. That is the point: 80% is UK internal market trade, and 20% is trade going on to the European Union.
I would not accept that. I am not in a position to set out the statistics, and I do not doubt that the statistics need some work applied to them. It pains me to say this, as I have always regarded the right hon. Gentleman as a great friend—he and I have walked a long way together on this and I have always regarded him as an ideological bedfellow, both on the Union and on Brexit—but as his group leader, the right hon. Member for Lagan Valley (Sir Jeffrey M. Donaldson), said earlier, we voted for, and fervently supported, the protocol Bill. We said that we were willing to have a red lane in order to safeguard the legitimate interests of our friends and partners—and family members, as the Irish ambassador Martin Fraser said. This was always a family dispute, and we were always going to get through it.
Our friends in Ireland, and indeed in the EU, have legitimate interests, which we should have the humility to respect. Even if we had acted unilaterally as a single united Parliament, ridden roughshod over any international negotiation and just done what suited ourselves with the protocol Bill, we would have implemented the red lane. I am afraid that I will part company now with anyone who says otherwise. We would rightly have implemented the red lane, even acting unilaterally, out of respect for the legitimate interests of our friends and trading partners.
Will the Minister join me in welcoming the announcement on Tuesday of agreement on a joint legal text that will significantly change the status of goods coming from the rest of the world into Great Britain and travelling on to Northern Ireland? The effect of that change, which is part of the arrangements and the published Command Paper, will be that some 4 million goods movements between Great Britain and Northern Ireland will now be moving out of the red lane and into the UK internal market system. That is this party delivering, and securing real change that ensures that more goods flow freely between Great Britain and Northern Ireland, save for those going into the EU or that are at risk of doing so because they are part of a manufacturing process for goods being sold to the EU.
I strongly welcome that intervention. I thought that the right hon. Gentleman was going to mention the draft joint agreement on tariff rate quotas. For a while I was concerned that TRQs needed to be applied to Northern Ireland so that Northern Ireland could share fully in the benefits of free trade agreements with the rest of the world.
I hope to return to this later, but in case I do not have the opportunity to do so, I want to say what an extraordinary situation Northern Ireland is now in. Northern Ireland is not in the single market. I draw everyone’s attention to page 4 of the Command Paper, which sets out checkmarks comparing Northern Ireland with Ireland, as a member of the EU, and with Norway, which is a member of the single market through the European economic area but is not in the customs union or the European Union. Northern Ireland really has the minimum of EU law compatible with unfettered—or privileged, perhaps—goods access to the EU market, and consistent with having an open, infra- structure-free border.
I wonder at people who thought that we could leave the European Union and establish a hard border, or do absolutely nothing about the border. We were always going to leave the European Union and have special arrangements in relation to Northern Ireland. This is a moment of great feeling for me, because before the referendum vote, I and other colleagues set up a committee of Eurosceptics to consider how we might deal with these issues. I confess that we did not have the SPS and customs expertise to proceed. That then became the great story of this battle.
If the United Kingdom had united in accepting the result of the referendum, if this Parliament had united in going forward with resolve to further our own interests as an independent nation state outside the EU, but crucially with the humility to respect the legitimate interests of our friends and partners, and if from the beginning we had had united resolve and clarity of vision, I do not doubt that in a spirit of friendship and good will—the kind that exists today between Ireland and us, and between the European Union and us, thanks to the work of the Secretary of State, the Prime Minister and others—we would have been, as we are now, in a totally transformed position to make our way forward as friends, respectful of their interests and resolved on ours.
That is not what happened. The House does not need me to rehearse it. It has taken eight years of drama for us to arrive at this moment, when we have reduced EU law to this extent and put in place a red lane to protect the legitimate interests of Ireland and the EU. That is something that we should all be very proud of, after everything that we have faced and all the risks that could have put us in a far worse position.
It has long been said that this is the Conservative and Unionist party and we have long been understood to be a Unionist party. This agreement is entirely consistent with both our Unionism and our full respect for all dimensions of the Belfast/Good Friday Agreement. We will continue to govern in a spirit of good will and impartiality.
I readily concede that there can be changes to retained EU law and that divergence can happen, but we have set out the safeguards at some length. I also encourage the right hon. Gentleman—as my right hon. Friend the Member for Skipton and Ripon (Julian Smith), who made an excellent speech, said, and as indeed the right hon. Member for Leeds Central (Hilary Benn) said—to look at the section of the Command Paper in relation to the Acts of Union. I myself learned a great deal about it.
Very briefly, I draw the Minister’s attention to paragraph 146 of the Command Paper, which makes it very clear that where primary legislation carries implications for the internal market, the Government will set out the measures they propose to take to protect Northern Ireland’s place in the internal market.
I am grateful to the right hon. Gentleman for that intervention. Yes, that is the position.
In closing, there are sensitivities on all sides, as we have heard over the course of the debate, but real life in the age of intervention is complex, and we will press on as best we can. With that, I believe this Government have kept to the timetable as we agreed. I very much hope we will be able to look forward now to a restored Executive—one we will be very pleased to support in serving the best interests of all the people of Northern Ireland.

Commons ChamberThat brings me on to a point I wanted to make. My right hon. Friend the Secretary of State and I sat here throughout the debate listening to a number of Members imploring us to take one action or another, which would amount to going down the road toward direct rule. We have no plans to go toward direct rule. We have been asked what we will do if this situation continues. In the event that we need to take further steps, we will announce them, if the need arises and when the time is right, but we have no plans to go to direct rule, and no amount of pressing us on one issue or another will cause us to take up direct rule.
Regarding the Windsor framework, yes, there are some technical matters that we might deal with in order to fulfil the policy intent clearly agreed by both sides. Where there are technical issues we need to move forward on, please, let us take them up as technical issues and deal with them in the Joint Committee. Let us not again raise such matters up to levels that require the attention of the great statesmen and women of Europe. It is better to deal with these things in a low-key way.
With great respect to the Minister, the matters that we want to be addressed are not matters for the European Union; they are matters for His Majesty’s Government. They relate to the internal market of the United Kingdom and its workings. Either the UK Government are in charge of that, or they are not. When I see the UK Government introducing new statutory instruments to impose customs arrangements on parcels being sent from one part of the UK to another, I begin to wonder if the UK Government actually get our concern about the workings of the internal market.
We certainly do. The right hon. Gentleman and I have walked a long way together over the last seven years. As he well knows, I regret that we have had to part ways somewhat at this point, but we are clearly aware of his concerns, which he articulates with great clarity and force. I hope he will not mind if, at this late hour, I say that I will leave this to my boss, the Secretary of State, and the other parties to work through.
Finally, I think, I turn to the issue of the Northern Ireland Audit Office, which the hon. Member for Hackney South and Shoreditch (Dame Meg Hillier) set out in some detail. Of course we appreciate the important role played by the NIAO and other independent bodies that hold the devolved Government to account, and ensure that public finances are spent properly and efforts are made to improve public services. However, when the Secretary of State considered budget allocations, he needed to take account of the challenging budget context and reductions faced by other Northern Ireland Departments. In such challenging circumstances, we believe it is only right that we ask the non-ministerial Departments and independent bodies to find savings in the same spirit as the rest of the Northern Ireland Departments.

Commons ChamberI am delighted to confirm to my hon. Friend that residents of Northern Ireland will be able to enjoy the sausages produced by the great businesses in his constituency. The framework ends the ban on chilled meats, such as sausages and seasoned lamb joints, meaning that supermarket shelves in Northern Ireland will be able to stock the products that customers want and have bought for years.
But the reality for my constituents, and businesses such as McCartney’s delicatessen in Moira, is that although they can bring in sausages from Yorkshire or any other part of the UK that are made to British standards, the sausages they make in Northern Ireland, part of the UK, have to be made to EU standards, because EU law applies to all manufactured goods in Northern Ireland. So why is it right to bring sausages from Great Britain to Northern Ireland and sell them in Northern Ireland, but it is not right to sell British sausages made in Northern Ireland in Northern Ireland?
I understand the force and passion with which the right hon. Gentleman makes this point, but he knows that what we have done is reduce the extent of EU law in Northern Ireland to the absolute minimum consistent with keeping open an infrastructure-free border with the Republic of Ireland. I appreciate that this is a compromise that for many people will go too far, but I believe it is the right decision in these circumstances.
I ask Members, please, to take notice of the questions.
Thank you, Mr Speaker. The reality is that Northern Ireland’s place within the UK internal market has not been fully restored by the Windsor framework, because EU law applies to all manufactured goods in Northern Ireland, despite the fact that of £77 billion-worth of goods manufactured in Northern Ireland £65 billion are sold in the UK. All of those goods must comply with EU law, regardless of where they are sold. Can we not get back to the proposals in the Northern Ireland Protocol Bill, which mean that UK law applies unless a business wants to trade with the EU, in which case it must follow EU law?
On the proposal for dual regulation, that was not what constituent businesses in Northern Ireland wanted. At some point, even unrelenting figures such as myself do need to compromise and give the voters what they want. I recognise that compromise is extremely difficult. We are in a position where we have an opportunity to move forward together. The right hon. Gentleman knows, as I do, that the manufacturing of most of the kinds of goods to which he is referring is done to international standards. So given all the circumstances, this is a reasonable compromise for Northern Ireland.

Commons ChamberWith the leave of the House, I am glad to respond to the debate.
First and foremost, I join other hon. Members in offering condolences to Alex Easton, whose parents Alec and Ann tragically died in a fire in Bangor earlier today. I know the whole House will want to put on record our shared sorrow at this news, and to thank the emergency services who attended. At the same time, I am delighted to congratulate Doug Beattie on the birth of his granddaughter Skyler. I am sure we will be able to find a couple of copies of Hansard to send on to the families.
I am grateful to the Opposition for their comments; When opening the debate the hon. Member for Hove (Peter Kyle) said that we were right to prioritise restoring power, and I am grateful to him for that. He asked for an update on the negotiation, which I will give in a moment. We are all agreed that Stormont should be restored—I think that has been a universal theme. The Secretary of State and I have met a wide range of stakeholders and, though of course we are in an undesirable position, we are confident that we have listened to a range of views as we have participated in reaching these decisions with Northern Ireland’s civil service.
Turning to the protocol, as hon. Members know, it has always been our preference to resolve the issues through talks. The Foreign Secretary and Vice-President Maroš Šefčovič speak regularly and Government officials have technical talks. The Foreign Secretary and Vice-President Šefčovič spoke on Monday 16 January and have agreed that rapid scoping work should continue, which we are very pleased about.
We welcome the agreement reached recently on the EU’s access to UK IT systems that provide live information about what goods are moving across from Great Britain to Northern Ireland. That agreement has provided a new basis for further constructive discussions with the EU to come to a negotiated solution on the protocol. We are of course proceeding with legislation, but I would like to take a moment to elaborate on the situation we face.
It is sometimes impressed upon me by some of the harder-line Unionist commentators that we should simply tear up the protocol. I am not sure what political world they think we operate in—I am not talking about Members of this House, but some individuals outside it. The world is rather more complicated than that. Ministers do not have unfettered power to tear up treaties, nor should they. That is why we proceed with the Northern Ireland Protocol Bill.
On the point about border posts, the reality is that we are in the happy position where legitimate interests on both sides are now being recognised: the legitimate interests of the EU and Ireland to have their market protected—that is what the border posts are for, even in the circumstances that the Protocol Bill has to become an Act and be used—and the legitimate interests of Unionism and Unionists. I put on record my heartfelt thanks to the present Taoiseach, Mr Varadkar; I know I will not be thanked by some Unionists for that, but he has had the statesmanship to move his position and recognise the legitimate interests of Unionism. I am grateful to see Opposition Members nodding; it is very good news.
Given the position we are in, where we are very willing to recognise the legitimate concerns of the EU and Ireland and they are increasingly willing to recognise the legitimate concerns of Unionism, this is a moment when we ought not to goad one another. I have fought hard enough in this place over Brexit, but we are tantalisingly close to recognising that we are friends and partners and that we can look after one another’s interests and go forward in the spirit of goodwill.
I encourage everyone, rather than rehearsing the arguments and grievances of the past, to look to a future that is tantalisingly close to being very positive, with a deal that we can all accept. With that in mind, I want to say gently to those of us who fought for Brexit, those of us who are Unionists, that when a deal comes—I do believe it is when, but there is a lot to be done—if that deal is acceptable to the Eurosceptic cause and to Unionism, we are all going to have to sell it to people. It will be no good to just denounce border infrastructure, which is there for the red lane, to protect the interests of the EU. Denouncing what has been done, when we have the green lane and arrangements for unfettered access within the UK, will not be enough. I mean that most sincerely, because if one thing has come home hard, even now—I think I have always known it, given when I joined the Royal Air Force—it is that even after 25 years of the Belfast/Good Friday agreement giving us some welcome peace, the politics of Northern Ireland, as hon. Members from Northern Ireland know better than me, is not to be taken for granted.
The politics of Northern Ireland is a grave thing; too many graves. That has been realised across the European Union. People realise that it is a post-conflict society with, as we have heard, an enforced coalition between the two poles of debate on the pre-eminent constitutional question that caused the conflict, so things are not to be taken lightly. That is why I am happy to put on record my admiration for the current Taoiseach and his predecessor, Mr Martin, with whom I get on well. I look forward to meeting Mr Varadkar. On the protocol, we are tantalisingly close to a success of which we can all be proud and then move on. Let none of us do anything to spoil the prospects of that success.
I turn to the overall points made about spending. Notwithstanding what was said about the Barnett formula and so on, which we support, it must be said that per head public spending in Northern Ireland is the highest of any region of the UK at 21% per head more than the UK average. The Northern Ireland block grant is at record levels, averaging some £15 billion a year over the next three years. On top of that, if we look at the new deal for Northern Ireland at £400 million, city deals at £617 million, the New Decade, New Approach financial package at £2 billion and the forthcoming Peace Plus at £730 million, that adds up to about £3.5 billion of extra funding. That is reflective of Northern Ireland’s special status. But it cannot really be said that Northern Ireland is in any sense neglected.
I will make three points about the process by which we came to the Budget. First, it has been drawn up as a result of intensive engagement between our officials and the Northern Ireland civil service. We are grateful to officials on all sides. The Government have also taken on board many representations that we received in correspondence and in person.
Secondly, I stress again that we believe this overall Budget is a fair and appropriate settlement that reflects the key pressures facing Northern Ireland. I mentioned per-head spending, and I will not repeat myself. Thirdly, it has been said on many occasions that the Bill does not preclude a functioning Executive from making changes to the Budget allocations, should one return. Of course, we are beyond the point at which it is possible to restore the Executive without an election so we would have to legislate. We all fervently hope that the Executive could be restored without an election, and the Secretary of State is considering all his options.
I turn to the important point about the PSNI made by the leader of the DUP, the right hon. Member for Lagan Valley (Sir Jeffrey M. Donaldson). As the right hon. Member will know, its main budget is allocated by the Northern Ireland Department of Justice. The Budget gives the Department of Justice a 3.1% uplift on its 2021-22 budget. In addition to the block grant, the UK Government provide the PSNI with the additional security funding that it needs to tackle the substantial threat that we face from Northern Ireland-related terrorism. The UK Government contribution for 2022-23 will be £32 million
I do not dispute the Minister’s figures—my point was not about those figures and I was not challenging them—I was simply pointing out that, in relation to New Decade, New Approach, there was an agreement to recruit additional police officers to bring us up to the level that was agreed way back when the Police Service of Northern Ireland was formed. It was clear that the Treasury would provide the additional funding required to ensure that those extra officers were recruited. My point is simply this: that has not happened.
I am extremely grateful to the right hon. Member for clarifying that point. I will write to him on that. The PSNI is close to my heart, and I am extremely grateful to all the people who work for the PSNI for everything that they do to keep us all safe.
The Opposition spokesman the hon. Member for Hove, the right hon. Member for East Antrim (Sammy Wilson) and the hon. Member for Foyle (Colum Eastwood) all talked about education funding. According to information published by the Treasury, identifiable public spending on education stood at £1,759 per head in Northern Ireland for the 2020-21 financial year. That compared to £1,428 per head for the UK as a whole over the same period. That was 23% higher than the UK average. That reflects our commitment to Northern Ireland and to education.
The Department of Education projected significant levels of overspend, but this Budget has actually delivered an increase in education spending of just under £300 million. We recognise that pressures above that level of increase will require difficult decisions to be taken, but we believe that those decisions are deliverable within the legal framework that we have set out in the Northern Ireland (Executive Formation etc) Act 2022 and the accompanying guidance.
I was grateful to the hon. Member for North Down (Stephen Farry) for his point about efficiency savings that could be made in education. My goodness, yes there are some. Again, that integrated education could even be a question in the 21st century is extraordinary to me. There are certainly savings to be made. That level of additional funding represents around a 12% increase on the previous year, excluding the additional funding allocated for covid. That really is as much as could be afforded in the light of the £660-million black hole that we were facing. Overall, that demonstrates just how unsustainable Northern Ireland finances have become and the need for reform.
The hon. Member for Gower (Tonia Antoniazzi) mentioned women’s healthcare, particularly the misery of endometriosis. Once again, this is a shocking situation to be in. The hon. Member for Belfast South (Claire Hanna) talked about the lack of collective shame. In this day and age, we should be ashamed of the state of public services in Northern Ireland. For far too long we have been just grateful for peace and have not done enough to highlight across the whole of the UK what needs to be done to serve the people of Northern Ireland because, my goodness, they deserve good services.
This Budget provides £7.28 billion in funding for the Department of Health. That is an increase of £228 million on 2021-22 spending, which included significant covid-19 funding. It is an increase of £786 million compared with last year’s funding, excluding the one-off covid uplift. As with education, there will be difficult decisions to take on health. Decisions on the reform of healthcare will be difficult. The Bengoa report, as we have discussed, should be carried forward. Too many years—six—have gone by without progress. We need to see Executive return as soon as possible.
I will make one more point before I conclude. I responded to the hon. Member for Foyle in an earlier debate on the addiction rehabilitation centre. I can tell him that the Government stand ready to respond to a proposal submitted by the Executive. I know it is frustrating; I am frustrated because I want to give him the answer he wants. We are waiting on that Northern Ireland Department of Health business case.

Commons ChamberMy right hon. Friend the Secretary of State and I have taken that up with our counterparts in BEIS. We do so frequently and intensively. My right hon. Friend has just said to me that he met the energy Minister on Thursday. We will continue to press colleagues in BEIS. They are fully aware of the situation and the imperatives, and I think a full answer on the justification for the £100 would meet with Mr Speaker’s disapproval at this moment.
The Minister rightly said that the Union is both a political and an economic union. In the High Court and the Court of Appeal, in respect of the Northern Ireland protocol and its application, the Government’s lawyers argued that the protocol superseded article 6 of the Act of Union itself—the Union with Ireland Act 1800—which is the basis for the economic union. Will the Government and the Minister assure us that, in any negotiations with the European Union, they will strive to restore our full rights under article 6 of the Act of Union and our place in the UK internal market?
I am grateful to the right hon. Gentleman for the opportunity to commit that, yes, the Government are determined to restore the constitutional position of Northern Ireland fully within the United Kingdom. That is our intention. I cannot get into the niceties of the legal arguments that were made, but, if I may so, as I understand it, I think they are broadly technical.
Can I also refer to the comments made by the shadow Secretary of State, the hon. Member for Hove (Peter Kyle), and raise the energy support scheme and the £400 that is to be allocated to the electricity accounts of domestic households and non-domestic users—businesses and so on—in Northern Ireland? I have spoken with the Secretary of State for BEIS to urge that the payment is brought forward in good time. Will the Minister assure me that he will continue his efforts with us to ensure that the £400 payment is made to the people of Northern Ireland as soon as possible?
We certainly will continue those efforts together. I am grateful for the right hon. Gentleman meeting the Business Secretary. I hope he will not mind my saying, though—I understand the reasons he is not in the Executive and that is why we wish to press forward on the protocol—that matters would be somewhat easier if a functioning Executive were in place.

I want to speak to new clause 5, in my name. As we have heard, there have been calls from across the UK to look out for the members of our society who are elderly and vulnerable. I wish to add my voice and to say that the victims of modern slavery must be addressed urgently. I spoke to the Minister’s colleague earlier today, and I have received assurances from the Minister. I welcome the fact that the Department is working closely with the Salvation Army, which is the contractor dealing with these issues. I have faith that it will do the right thing and look after these people, but it is important to issue guidance on this issue when possible.
I recognise that the Department is pressed and that officials are working hard on this issue, but I really hope the Government will be able to address my concerns, particularly to ensure that the victims of modern slavery continue to receive special payments; that where their key worker is off ill due to the virus, someone else will liaise with them and keep in contact; that there are arrangements to address the need to protect them when they are in shared or cramped accommodation, as is often the case; and that the Government will look into these matters and ensure that these vulnerable people, who are already victims, are not further victimised or isolated as a result of a lack of capacity to deal with these issues and concerns at the moment. I am looking for that assurance, and I hope the Government will be able to issue guidance along the lines I have suggested in new clause 5.
I stand first with my hon. Friend the Member for Isle of Wight (Bob Seely). We cannot neglect his constituents on the Island. I fear that this issue has gone on for far too long, and I want to say sorry to him that we did not weigh in behind him sooner. This issue has just got to be dealt with, and I know that my right hon. Friend the Minister knows that.
Secondly, I would like to pay tribute to hon. Member for Bradford West (Naz Shah). She has done an absolutely fantastic job in the last 24 hours. It has been a real privilege to work with her to secure what I think is a fantastic result. At a time like this, matters of the hereafter are close to everybody’s thoughts. They sometimes say that there are no atheists in a foxhole. I certainly would not want to stand by and see my constituents cremated against their wishes, and nor, indeed, would I want to see people buried against their wishes. I really want to congratulate her; she has done a fantastic job, and she has done it in a wonderful cross-party spirit, which has done a lot to reinvigorate my faith in this place and in what we can achieve together when we put our constituents first. Well done to her.
I will pay particular attention to amendments 1 and 6 and Government new clause 19, which relate to the expiry of these powers. When I got into politics, it was with the purpose of enlarging liberty under parliamentary democracy and the rule of law. When I look at this Pandora’s box of enlargement, discretion and extensions of power, I can only say what a dreadful, dreadful thing it is to have had to sit here in silence and nod it through because it is the right thing to do.
My goodness, between this and the Prime Minister’s announcement tonight, what have we ushered in? I am not a good enough historian to put into context the scale of the infringement of our liberties that has been implemented today through the Prime Minister’s announcement and this enormously complicated Bill, which we are enacting with only two hours to think about amendments.
I could speak for the time I have available several times over just on the provisions relating to the retention of DNA, which we addressed in the Protection of Freedoms Act 2012. [Interruption.] I see from the expression on the face of the Paymaster General, my right hon. Friend the Member for Portsmouth North (Penny Mordaunt), that she understands the anguish—she probably knows it better than any of us—that we are all going through in passing this Bill.
Let me be the first to say that tonight, through this Bill, we are implementing at least a dystopian society. Some will call it totalitarian, which is not quite fair, but it is at least dystopian. The Bill implements a command society under the imperative of saving hundreds of thousands of lives and millions of jobs, and it is worth doing.
By God, I hope the Prime Minister has a clear conscience tonight and sleeps with a good heart, because he deserves to do so. Libertarian though I may be, this is the right thing to do but, my goodness, we ought not to allow this situation to endure one moment longer than is absolutely necessary to save lives and preserve jobs.
Although I welcome new clause 19 to give us a six-month review, I urge upon my hon. and right hon. Friends and the Prime Minister the sunsetting of this Act, as it will no doubt become, at one year, because there is time to bring forward further primary legislation. If, come the late autumn, it is clear that this epidemic, this pandemic, continues—God help us if that is true, because I fear for the economy and the currency—there certainly will be time to bring forward further primary legislation and to properly scrutinise provisions to carry forward this enormous range of powers.
Every time I dip into the Bill, I find some objectionable power. There is not enough time to scrutinise the Bill, but I can glance at it—I am doing it now—and see objectionable powers. There would be time to have several days of scrutiny on a proper piece of legislation easily in time for March or April 2021.
I implore my right hon. Friend, for goodness’ sake, let us not allow this dystopia to endure one moment longer than is strictly necessary.
