Given the busyness of the last few days, the Prime Minister may have missed the new leader of the Liberal Democrats saying that she would ignore a leave vote in a second referendum. Does the Prime Minister agree with me that campaigning for a referendum whose result you intend to ignore is pretty pointless?
I thank my hon. Friend, and it smacks of tyranny. It smacks of tyranny. These people pretend to be democrats, yet their plan is to quash the will of the people time and time and time again.

I know that all Members across the House—it will have been obvious in response to his question—will want to join me in sending deepest sympathies to my hon. Friend’s constituent. As my hon. Friend will know, the courts can already, and do, consider harm caused to a mother or unborn child in sentencing for an offence. I know my hon. Friend has discussed changing the law on this particular issue with the Ministry of Justice, which is concerned that there could be far-reaching unintended consequences of doing so, but I have asked it to keep the law under review. I know that my hon. Friend, along with others in this House, will continue to work on this issue. I am sure everybody recognises the compassion that my hon. Friend is showing in raising this issue. What we want to ensure is that what he is proposing is not something that could lead to other, unintended consequences, of the sort that he would not wish to see.

Commons ChamberI thank the hon. Gentleman for his intervention—I still consider him a friend, even though I am on the Opposition Benches—but I gently point out that it is good he is not a surgeon if he cannot recognise who the patient is.
Many Members have made the point that now is not the time for this amendment and that we should table it later, but it has been a bit like “Waiting for Godot”. “Now” will never be the right time, and we are just 15 days from falling off the cliff. I was there in the summer with 700,000 people who marched through the streets. Their call was: “We demand a people’s vote”. When did they want it? They wanted it now. They were not saying, “We want it when it is convenient for the Labour Front Bench”.
I am sorry—I say this with great sincerity to Labour colleagues—but there was a clear promise to move to support a people’s vote, and it is simply no good to keep backtracking on that. Today is the time for us to vote for this amendment. It may fail—I accept that—but there is nothing to stop us bringing it back and voting for it again.
I am afraid I am not able to give way. I urge all colleagues who know that they support a people’s vote to vote for this amendment today, and again when they get the opportunity. If people never demonstrate that they supported a people’s vote that will be their greatest regret, and I am afraid the chances are that those on the Labour Front Bench will never move to wholeheartedly and unequivocally support a people’s vote, unless there is significant pressure to do so. Those of us, from many parties, who have come together to press for a people’s vote will support the amendment today. We urge hon. Members to join us, and to support it again next week.
If I am honest, all this just reminds me of the Muppets. It is that moment when Gonzo, I think it was, sings “The Windmills of Your Mind.” As he sings and runs faster and faster, with his legs wheeling like the Isle of Man’s coat of arms, he becomes wilder and wilder and goes out of control. We are
“like a circle in a spiral, like a wheel within a wheel,
never ending or beginning on an ever spinning reel”.
It is just going on and on and on, and every two weeks we come around on the merry-go-round and we make the same speeches all over again, and we still ride our own hobby horses. Frankly, it is not doing us or the nation any good medically or emotionally.
My amendment is a simple one, and it tries to put a stop to all this gyratory nonsense, as the right hon. Member for Clwyd West (Mr Jones) rightly mentioned. My amendment is the embodiment of a very old principle of this House. When James I became King in 1603—do not worry, I am not going to do every year—he summoned Parliament, and that Parliament became so fed up with MPs constantly bringing back issues on which it had already decided that the House expressly decided on 4 April 1604:
“That a question being once made, and carried in the affirmative or negative, cannot be questioned again, but must stand as a judgement of the House.”
That has been our rule.
No, I will not give way. I am terribly sorry, but there is not much time and I am sure we have already decided the matter anyway, so it stands as a judgment of the House.
This ruling has been repeated many, many times. On 30 June 1864, Sir John Pakington wanted to give more money to nursery schools—hoorah! On 17 May 1870, Mr Torrens wanted to relieve poverty by enabling the poor to emigrate to the colonies. On 9 May 1882, Henry Labouchère wanted to allow MPs to declare, rather than swear, an oath so as to take their seats. On 27 January 1891, Mr Leng wanted to limit railway workers’ very long hours. On 21 May 1912—this one would probably have the support of every Member—George Lansbury wanted to allow women to vote.
On every single occasion, the Speaker—Speaker Brand, Speaker Peel, Speaker Denison and Speaker Lowther—said, “No, you can’t, because we’ve already decided that in this Session of Parliament”. That is why I believe the Government should not have the right to bring back exactly the same, or substantially the same, measure again and again as they are doing. It is not as if the Government do not have enough power. They decide every element of the timetable in the House. They decide what we can table and when. They decide when we sit. They can prorogue Parliament if they want. They have plenty of powers. The only limit is that they cannot bring back the same issue time and again in the same Session because it has already been decided.
What do the Government not understand about losing a vote by more than 200 and losing it a second time by 149? For me, the biggest irony of all is that the Government repeatedly say, “The people can’t have a second vote”, but the House of Commons? “Oh, we’ll keep them voting until they come up with the right answer”. We should stand by tradition—Conservatives should be a bit more conservative about the traditions of the House—and stop this ludicrous, gyratory motion.
As ever, it is a pleasure to follow the hon. Member for Rhondda (Chris Bryant), who rightly pointed out the importance of tradition. I backed remain in the referendum, but there is a tradition in our country of democracy and of respecting public votes, which is why I respect the two thirds in my constituency who voted to leave the EU and why I believe we should get on with it and not extend article 50. To do otherwise would badly undermine public trust in our democracy.
The hon. Member for Rhondda (Chris Bryant) made the point very eloquently that we should not consider the same matter again and again. Does my hon. Friend think that the same should apply to the repeated putting of questions about second votes—

Commons ChamberThe Government’s position is very clear. We believe it is better for this country to leave with a deal. That is the position that the House of Commons has taken, but the House of Commons has also said that it does not agree the deal that was negotiated. It wants to see changes to the backstop and that is what we are working for.
The Prime Minister has taken many questions encouraging her to end uncertainty by taking no deal off the table, but many others encouraging her to create more uncertainty by extending article 50 and calling for a second referendum. The Liberal Democrats managed to advocate both in the same question. Does she share my confusion over the uncertainty among those who oppose Brexit over whether uncertainty is acceptable or not?
My hon. Friend has very neatly pointed out the contradiction in many of the contributions that have been made in the House today.

Commons ChamberAh, the hon. Gentleman has been crafting that one for quite a time, I can see. He asked what my right hon. Friend is doing. The answer is that she is responding to the points made to her again and again by Members of this House, because in the statements and the exchanges that followed, and in the debates that we have had so far, hon. Members have expressed criticisms, usually focused—not exclusively, but for the most part—on one issue: the so-called backstop on the Irish border. Again and again, right hon. and hon. Members in all parts of the House have asked her to go back to EU member states and the Commission to seek changes, and in particular, to provide assurances that the backstop would only be temporary. That is exactly what my right hon. Friend has done.
It was very clear from the first three days of debate—colleagues have not been backwards in making themselves available to the media as well to say how much they disagree with the deal—that the House was not going to pass it, so surely the Prime Minister has done exactly the right thing in going back to Europe to get a better deal to put to the House in due course.
My hon. Friend puts it well. As I have said, the Prime Minister is responding to the wish expressed by many Members of the House.
I left work last night embarrassed to call myself a Member of Parliament. The Government are not without blame—the deal is far from perfect and our Brexit journey could have been managed better—but yesterday evening, footage was being shown all around the world of the Mace being taken, apparently because MPs, although legions of them have been on TV to say that they could not vote for the deal and the Prime Minister needed to do better, were outraged that she wanted to go off and do exactly as we had instructed.
It turns out that, for too many of us in this place, the politics matters more than the reality. Very few of those who intended to vote against the deal really wanted the Prime Minister to go off and do any better; they wanted no deal, or no Brexit, or a second referendum, or a general election, or a new Prime Minister. The divisiveness of no deal or no Brexit seems to matter not one bit. The mockery that a second referendum would make of our democracy seems to matter not one bit. The reality that a change of Prime Minister would still mean that someone had to captain the same ship through the same storm seems to matter not one bit, and the fact that the Labour party says it wants a general election, but still has no idea what its Brexit policy is, let alone how it would negotiate it, seems to matter not one bit either.
So here we are, angry that we did not get a vote on whether we should have a vote, having a debate about not having a debate. There is no majority for anything and, as far as I can tell, there is little desire to find a majority either. At the most important parliamentary moment in decades, we are digging our trenches deeper and refusing to find compromise. In the past few weeks the Prime Minister has travelled around the country, trying to sell her plan. She has spent hours in this place doing the same. Now she is travelling around Europe, trying to articulate Parliament’s requirement that we get something different.
Despondent, last night I read an early draft of my maiden speech, written just three and a half years ago. It was filled with hope: hope for what our Government could do, and hope for what this Parliament can do. We have all agreed that this is not how it should be. Deep down, we all know that we can do better, but only if we climb out of our trenches and reconsider all options, especially the Prime Minister’s deal. The Christmas present that the nation seems to want above any other is for us in this place to rediscover the art of the pragmatic compromise. That is not weakness; it is leadership.

“it is the clear intent of both Parties to develop in good faith agreements giving effect to this relationship”.
The hon. Gentleman refers to sovereignty. The contents of the political declaration are a recognition that there is a balance between the question of checks at the border and the degree to which rules are accepted and operated on both sides of that border. What we set out in the White Paper we published in July was a recognition of that and a proposal that frictionless trade came with a commitment to a common rulebook, but with a parliamentary lock, so that it would be a decision of the UK—of the UK Parliament—to choose to diverge from those rules.
I am sure that the hon. Gentleman is aware that divergence from those rules such that products were manufactured not in line with the standards and regulations operating in the European Union would have an impact on access to the market of the European Union, just as it would under any other agreement we made with other parts of the world. We will be sovereign—this deal delivers that sovereignty—but if it is in place, it will be for this House to decide where it wishes to go in relationship to the rulebook that enables access to a market versus divergence and a sovereign decision.
As the Prime Minister has said, beyond this place people are just desperate that we get Brexit over and done with. I have met many people in my constituency who greatly admire the resolve she has shown in pursuing this deal in recent weeks. Does she agree that they will look very dimly if we grind ourselves to a standstill here by pursuing ideological perfection, rather than accepting the very good and pragmatic?
My hon. Friend makes an important point. It is for us in this House to look pragmatically at what will deliver for the British people. That is what I have done in this deal, and it is what I believe the deal delivers for the British people. He is right that we should remember the many people up and down the country who want us to get on with this and build that brighter future.

Commons ChamberI want to briefly express my admiration for the Prince of Wales and all his work on climate change, the environment and our oceans. In particular, I want to thank him and his wife, Her Royal Highness the Duchess of Cornwall, for their great patronage of our nation’s armed forces and the ships, regiments and squadrons of which they are colonels.
I have seen at first hand just how close a relationship they have with those regiments and the personal interest they take in not only the lives of the men and women serving in those units, but their families, those who have served in the units previously, those who are bereaved as a result of soldiers, sailors and airmen serving in those units being killed in action and those who have been injured in the course of their duties. On behalf of my constituents and all those soldiers, sailors and airmen who hold both His Royal Highness and Her Royal Highness the Duchess of Cornwall in such high regard, I wish him a happy birthday.

Commons ChamberIt is very good of the hon. Gentleman to raise that issue. I pay tribute to other Members across the House who have put clear emphasis on this issue and ensured that, in Baby Loss Awareness Week and outside it, we recognise the tragedies that sadly take place and the circumstances that are faced by too many families in this country. I am very happy to pay tribute to the hon. Gentleman’s constituents and the amazing work that they have done in raising the funds that he has referred to. We do not want anybody to have to face and deal with this, but out of such a terrible tragedy has come the good of that fundraising, which can help others. I hope that his constituents are proud of what they have done.
In Somerset, we have been working for years to pay down the huge debts left by the Lib Dems when they last ran county hall, which means that funding for many essential services is now being withdrawn. Will the Prime Minister meet me and Somerset colleagues to discuss this challenge and will she look favourably on our bid to fully retain business rates from April 2019?
I understand that the issue of business rates and the bids to which my hon. Friend has referred, from Somerset and others, are currently being assessed. A decision will be announced alongside the local government finance settlement later this year. I can tell my hon. Friend that I have already received representations from a Somerset Member of Parliament on the issue, but I am sure that Ministers in the Ministry of Housing, Communities and Local Government will be willing to meet him and others to discuss it further. I am sure that they will be happy to sit down and discuss the details.

Commons ChamberFirst, that comment was not actually made at the NATO summit. Secondly, the hon. Lady might have seen that we have not sued the European Union; what we are doing is going into negotiations.
The Prime Minister has spoken about the impressive advances in cyber-capability being made across the alliance. How is thinking developing over how the principles of collective security enshrined in article 5 would be applied in the event of a cyber-attack, because I know that work on that has been ongoing within NATO for some time?
My hon. Friend is absolutely right to raise this issue. It is fair to say that we have been pressing for reform of NATO for some time, as has the United States, recognising these issues. NATO does recognise the issue and it is still working on that question. It is important that we have made our offensive cyber-capabilities available to the alliance. One or two other countries are now doing that as well, and I look forward to seeing others do the same.

It seems that the convention that was established in 2003 and that is in the Cabinet manual is being tossed aside as simply inconvenient. It is necessary and urgent that the House has the opportunity to discuss its rights and responsibilities in respect of decisions on UK military intervention.
I will make just a little more progress.
As the exception makes clear, there are also situations when coming to Parliament in advance would undermine the security of our operations or constrain our armed forces’ ability to act quickly and decisively. In these situations, it is right for the Prime Minister to take the decision and then to be held accountable to Parliament for it. I give way to my right hon. Friend the Member for Chingford and Woodford Green (Mr Duncan Smith).
My hon. Friend makes an important point in quoting from that report. We have to be able to retain the flexibility we need to make the decisions necessary for our national security and our national interest and to act in the way that we have.
I am grateful to the Prime Minister for giving way. She knows that the decisions she often has to take are in response to very dynamic security and military situations. Legislating in this place for the mission brings with it an inflexibility that would be very unhelpful when targets change, missions change and rules of engagement sometimes need to be adjusted. She cannot allow her freedom of decision making to be limited in such a way.
My hon. Friend is absolutely right; it is important to have that freedom and flexibility. May I say how striking that comment is coming from him, as I believe he has served in both Iraq and Afghanistan?
I must apologise to the House. I know that many Members want to speak and I want to make progress if I can.
I remind the House that the right hon. and learned Member for Rushcliffe (Mr Clarke), the Father of the House, said yesterday that
“once President Trump had announced to the world what he was proposing, a widespread debate was taking place everywhere—including among many Members of Parliament in the media. However, there was no debate in Parliament.”—[Official Report, 16 April 2018; Vol. 639, c. 47.]
We should listen to the wisdom of the Father of the House.
As the President tweeted reckless comments, simply heightening tensions, the Scottish National party immediately called for the Prime Minister to recall Parliament for last Saturday. We have been clear: any proposed change to the role of UK forces in Syria must be subject to a vote in Parliament. Cabinet was recalled. Why wasn’t Parliament?
There is no good answer to that question, because the Prime Minister knows she should have done so. As I have said, precedent has been set. In 2013, the Prime Minister, David Cameron, recalled Parliament for a debate and vote following a suspected chemical attack on Syrian civilians in the suburbs of Damascus. After the 2013 vote, Professor Malcolm Chalmers of the Royal United Services Institute commented:
“It is now hard to see how any UK Government could undertake significant military action without the support of Parliament, or indeed of the wider public.”
We know what a lack of rigorous analysis and thought can lead to. We must—absolutely must—have learned the lessons from the Iraq war, and we must fully endorse the conclusions of the Chilcot report. A full debate in Parliament would have allowed for many questions about the UK’s military action and role to be asked. For example, what is the Government’s long-term strategy for Syria?
Chilcot has been cited a number of times by Opposition Members. The Iraq war was voted on in this place, but on the basis of incomplete information. What intelligence would the right hon. Gentleman propose to compromise to Members of the House so that they could make a better decision and what analysis has he made of the impact of sharing that intelligence on the operational security of those who would prosecute the mission thereafter?
None. How do we— [Interruption.] Well, look. I am trying to be— [Interruption.] I see the hon. Member for Chelmsford (Vicky Ford) waving her arms. I have already made the point, as the hon. Member for Wells (James Heappey) would know if he had been listening to what I have been saying, that I do not expect the Government to have to share intelligence information with Members of Parliament. Let me also be clear, for the absence of doubt: I accept the case that has been put that the Syrian regime is responsible for the chemical weapons attack. I am happy with the explanation that has been given, and, in my case, I have been made aware of some of the intelligence information.
Let us not say that Parliament cannot take action on the basis of being told what it can be told. But it does not need to be told what is sensitive intelligence information. That is the way Parliament has worked, and we are asking that parliamentary democracy continues to take place.
Taking military action is not easy; we accept that. Finding a way through the morass in Syria and offering hope to the people is more difficult, but that is an issue that, as part of any plan for military action, has to be discussed.
