We are talking about legislation here, not the treaty, and the withdrawal agreement has already been established. In the future economic partnership, there is a negotiation to be conducted—it is specified there—on our level of alignment when it comes to workers’ rights, but this is in advance of that. This provides an opportunity at the point of withdrawal to give Parliament the ability to make sure that it takes an informed view of whether it wants to continue to be aligned. That is a valuable opportunity. The hon. Gentleman says that we should do it now with the treaty. That is part of the next phase of the negotiations. It is taking all the Government’s efforts to conclude the withdrawal agreement, without being able to conclude the future partnership in the next few weeks. But this is an important opportunity to establish, in primary legislation, a requirement properly to consider all new regulations that would come from the European Union and to assess the compatibility of legislation that we make in this House with that of the rest of the European Union. That, it seems to me, is a valuable opportunity.

Let me start by echoing the warm words of the Secretary of State about Kumar Bhattacharyya. The Jaguar plant in my constituency is open, employing more than 2,000 workers, in no small way due to his herculean efforts over many years to turn around Jaguar Land Rover.

In my previous being, on behalf of the Transport and General Workers’ Union, I took the case of the Eastbourne dustmen all the way to the European Court of Justice because a Conservative Government refused to apply the acquired rights directive to 6 million public servants. We won and TUPE was extended to those 6 million public servants. In future, however, there will not be the same enforcement mechanism. The trade union movement has spoken with one voice today. Frances O’Grady said that this will not protect rights and that there is nothing to stop future Governments from tearing up the legislation. She added that no one should be “taken in” and that our rights are “still under threat.” Does the Secretary of State understand that residual concern and that, crucially, unless the Government go significantly further with regard to legally enforceable rights, not just depending on the whims of future Governments, she is right: these guarantees are worthless?

These rights will be enforceable by the UK courts. I meet Frances O’Grady very regularly. As I said to the shadow Secretary of State, I recognise that the TUC has a different preference, which is to continue to embed European rights directly and to have them enforced by the Court of Justice of the European Union. That is a different approach. In my view, it is not compatible with Brexit. Therefore, we are looking for a way in which this House, this Parliament and the UK courts can provide the guarantees that I think everyone in this House wants to give.

It will. This is one of the big advantages of the agreement. The industry and individual firms have been very clear that this is one of the reasons why they have endorsed it.

Today is a human tragedy for 3,500 workers in that great Swindon factory, yet there are those, such as Patrick Minford, who would say that the car industry should follow the coal mines down the path to industrial oblivion; and there are those in this House, such as the hon. Member for North East Somerset (Mr Rees-Mogg), who when confronted by the automotive industry’s concerns about, for example, frictionless trade and the impact of Brexit, say, “Fake news.” Does the Secretary of State agree with me that our 850,000-strong automotive industry is a world-class success story, and that nothing should be done that puts it at risk by those who would be oblivious to the consequences of their actions and take this country crashing out of the European Union on 29 March without a deal?

I am very proud of our automotive industry. It has all the attributes the hon. Gentleman ascribes to it. I am proud of the workforce. I am proud of the workforce in Swindon in particular. This is no reflection on their calibre, their commitment and their ingenuity. Far from the automotive industry being an industry that we can or should do without, it is one of the prime opportunities we have. If we have some of the best brains on the planet looking at connected and autonomous vehicles, and inventing the next generation of batteries, why on earth should we not make the products of that ingenuity in this country? I am determined that we should do so.

I am grateful for the hon. Gentleman’s advice. I think it is matter of public record that I have constantly and consistently advocated the need for us to be able to secure the trading relationship that we need to make sure that the jobs in his constituency and all around the country continue. It is important that I should do that.

The automotive industry, employing 850,000 workers, is the jewel in the crown of manufacturing excellence. We have had 4,500 jobs going at Jaguar Land Rover and we now have the news about Nissan. The Society of Motor Manufacturers and Traders is warning that the industry is now “on red alert” as a consequence of Brexit uncertainty. Does the Secretary of State agree, on the one hand, that we should rule out any question of a no-deal Brexit, and crucially, on the other hand, that this House needs to come together at the next stages to negotiate a deal that will provide much greater and longer-term security, at the heart of which must be the customs union?

The success last week of the amendment that the hon. Gentleman tabled with my right hon. Friend the Member for Meriden (Dame Caroline Spelman) demonstrated that the majority of Members of this House are determined not to see a no-deal Brexit. Indeed, to avoid that, we need to come together in just the way that he says to reach a deal, making compromises with each other that can provide the certainty that investors need to continue the period of great success that we have enjoyed in this magnificent industry.

I hope the hon. Gentleman has read the Chequers agreement and the White Paper. I will be very happy to forward him a copy. It explains how the views and interests of the motor industry are central to how the sector works throughout all countries in the European Union, including us. We will continue in a friction-free way that is very much to the advantage of the automotive industry.

The success of Jaguar Land Rover and the Jaguar plant in my constituency has transformed the lives of thousands in an area of high unemployment. Now JLR is facing the twin challenge of the transition from diesel on the one hand and the threat of Brexit on the other. Does the Minister agree that wide-eyed Brexiteers appear to believe that we can crash out of the European Union with no consequences for jobs, that they are wrong and they are letting down British workers, British industry and Britain?

I thank my hon. Friend for his intervention; I will indeed talk about that. He is right that the problem is not confined to small sections of our economy, but spread throughout. From tourism to retail, hospitality and our public services, the economy is dependent on these jobs. It goes far beyond genuine short-term work, such as meeting seasonal demand over the Christmas rush in retail, or the busy summer period at a caravan park. The balance of power is woefully skewed in favour of employers who use short-term contracts to minimise their responsibilities and maximise their profits at the expense of job security for their employees.

Areas such as my own in Barnsley are disproportionately affected. Former industrial towns and coalfield areas are disadvantaged communities that have been left behind by the economy and are taken advantage of. Where average wages lag far behind national levels, unemployment is higher and social mobility is appallingly low. Unscrupulous companies can offer insecure, low-paid work where the alternative is often nothing. In Barnsley, the switch to gig employment and short-term work in areas such as distribution in warehouses and our public sector means that too many people in my constituency simply cannot be certain that their job will last longer than the next rota. No matter how hard they work, their precarious employment leaves them with no chance to save up or plan for the future.

My hon. Friend is making a very powerful case. Does she agree that a characteristic of the gig economy is that on the one hand companies make enormous profits, while on the other workforces live in permanent insecurity, with all that means for their living standards and their family life? Will she join me in congratulating the GMB for the landmark challenges it has mounted—in particular, to the grotesque abuses characterised by Uber?

I totally agree, and I join my hon. Friend in congratulating GMB. He is right: many employees are forced into debt and are unable to pay their bills or buy food, and others are forced to work through physical or mental illness out of fear of losing what employment they have.

I first pay tribute to the excellent presentation made by my hon. Friend the Member for Warwick and Leamington (Matt Western). I will speak about the human consequences of what will happen if the Government get this wrong.

Erdington is rich in talent, but is one of the poorest constituencies in the country. However, we are blessed with having the Jaguar plant in our midst. The industry has now become the jewel in the crown of British manufacturing. It has been transformed, but it is characterised by its troubled history and by tragedies. I remember working night and day back in 2005 with Tony Woodley to try to prevent the collapse of Rover, and I remember that awful Friday when the factory finally collapsed and 5,000 workers were made redundant. However, in 2009 we saw the establishment of the Automotive Council—the first great industrial strategy—and the scrappage scheme to save the industry from collapse. The basis was laid for a future to be built on.

In 2010, Tata Motors took over Jaguar Land Rover from Ford. It brought in two gifted German industrial managers, one of whom—chief executive Dr Ralf Speth—is still there to this day. We worked night and day with them to turn around a factory that was doomed to close and where there was a funereal atmosphere on the part of the workers. I will never forget that wonderful day in October 2010 when we stood outside the main gate and said that the factory that had built the Spitfire during the war and two generations of Jaguars after the war was safe for the next generation.

That transformed the lives of thousands of local workers. I will never forget Warren, who is a big bear of a man. I first met him at a jobs fair that we organised. Four years later, he was moving into a house in Edwards Road, just down from my constituency office. He called me over and told me about how he was buying this little Edwardian terraced house. He said how he had been in and out of work for 10 years before getting that apprenticeship, and was now in a job that he described as secure, well-paid work that he loved. He then turned to his partner and said, “I’m moving into the house of my dreams with the woman of my dreams.” He said that could never have happened had it not been for the success of Jaguar Land Rover.

Lives were transformed and progress was built on. I actually pay tribute to some of the things that the Government did by way of continuity of policy, such as with the Automotive Council; the focus on the industrial sector and the engine plant; the skills initiative; and investment in research and development. All of that was welcome. As a consequence, we saw the number of staff at the factory double from 1,400 when it faced closure in 2010 to 3,000, while GKN—the parts plant just up the road—increased its staff from 500 to 800. Thousands of local people were given the opportunities that Warren had.

However, we now face deep and growing difficulties. Some 1,000 workers are being laid off at the Solihull plant, while 240 workers have been transferred from the Jaguar plant to Solihull. Why? Because of the combination of utter confusion over diesel on the one hand—forgive me if I say this, but the Secretary of State for Environment, Food and Rural Affairs has grossly mishandled this situation and has sent the wrong message, having a serious impact on consumer confidence—and Brexit on the other.

I have only a short time remaining, so I will conclude. I wholeheartedly agree with the points made earlier. Hope emerges from despair. I once again see workers on production lines despairing and fearing for the future. Our fortunes are inextricably linked with those of the European Union—crucially, through the single market and the customs union. If we get it wrong over Brexit, this country will pay a very heavy price, and the people who will pay that price above all will be the workers in the automotive industry.

Those are important questions. If there is a phase 1 investigation, that will take 40 days. As I have said, both parties are urging the CMA to consider a fast-track approach. If it does that, phase 2 could be completed in six months. I can reassure my hon. Friend that the CMA will take very seriously the other issues he raises.

I know from my union experience that supermarkets are powerful both as employers and along their supply chains. They must not be allowed to abuse that power. Does the Minister understand the dismay of employees about this announcement that came out of the blue, and will he act to ensure that the guarantees given by the two supermarkets, about which he has waxed lyrical today, are not just day-one guarantees, but can be counted on by workers in the years to come?

I thank the hon. Gentleman for his concern and recognise his passion as a previous trade union representative. He asks about the validity and veracity of the assurances given so far by Sainsbury’s and Asda. It is early days—we are not even at day one into this process—so we will see how that develops. On his aspiration that we protect the farmers and small suppliers, I gently point out that it was this Government who introduced the Groceries Code Adjudicator and brought in those tough measures and protections to help our farmers and the supply chain.

That is the right approach. The UK’s reputation for being a dependable place to invest and do business is based on clear rules and principles, and we have benefited from that. We make significant investments in the UK economy, we make significant investments in overseas companies, and we hold big assets. That is important to us, and we should be a trading nation, which means that we should be open to investment as we invest in other countries. That is the heart of our approach. However, it is important to keep the regime under review, and where there are long-term interests, such as in research and development, it is right that we have introduced an ability during a takeover bid to extract indications of how a bidder would approach things. That is what we have done in this case.

It is a bleak day for British industry and British workers when a 259-year-old icon of British engineering excellence falls prey to a hostile takeover thanks to hedge funds moving in to make a quick killing. We will hold Ministers and managers to account for the promises that they have now made. Crucially, does the Secretary of State agree that the time has come for a fundamental review of our corporate takeover regime, because the idea that the British national interest can be sold down by the river by hedge funds moving in to buy 20% of a company is fundamentally wrong?

The hon. Gentleman talks about employees’ interests, and he has fulminated about the bid for a company that has an important plant in his constituency, but he has not made a single request or proposed a single safeguard to protect those interests. I do not know whether he has met the new management of GKN—I do not think he has—but my hon. Friends the Members for Filton and Bradley Stoke (Jack Lopresti) and for Redditch (Rachel Maclean) have made the effort and have discussed the important commitments that are being made, and the undertakings that I have secured will contribute to employment stability. The difference between my hon. Friends and the hon. Gentleman is that they have rolled up their sleeves and got involved, whereas he has contented himself with making slogans from the Back Benches.

The shadow Secretary of State and the Secretary of State have now had their little bit of fun, in which, with my characteristic generosity, I have been willing at this early stage to indulge them. I do not think we need to pursue the matter any further for now. Doubtless, they will preserve these little titbits for their children, or possibly for subsequent generations.

On a point of order, Mr Speaker. Indulging in the use of uncharacteristic language, the Secretary of State for Business, Energy and Industrial Strategy suggested that no proposals had been put to him by me and others. Would he like to confirm that I and others met him and made representations to him in detail asking that the bid be called in under section 58 of the Enterprise Act 2002, with a particular focus on defence and strategic grounds? Would he therefore like to take the opportunity to correct the record?

Erdington is rich in talent, but is one of the poorest constituencies in the country. It is, however, blessed by the industrial belt that stretches along the M6, at the heart of which is the giant Jaguar plant. Back in 2010, I was involved with the new management brought in by Tata to turn around the plant from closure. It has gone from strength to strength since and has doubled in size. Just up the Chester Road from the Jaguar plant is GKN—Guest, Keen and Nettlefolds—a 259-year-old company which, on the back of the success of Jaguar, has gone from 500 to 800 employees. It is at the heart of a motor manufacturing cluster in the midlands—a world-class success story that is in part built on foundations that we laid in government with the establishment of the Automotive Council.

However welcome some of the things said today about industrial strategy are, developments in relation to both Jaguar Land Rover and GKN potentially make a mockery of that talk. The Secretary of State is a good man with whom I have worked over the years, such as on the Heseltine initiative in 2012 and on securing investment for the new low-emission engine plant in Wolverhampton in 2012-13, but the simple reality is that Jaguar Land Rover is facing mounting problems with the combination of uncertainty over Brexit on the one hand and the grotesque mishandling of the transition from diesel on the other.

We have gone down from 3,000 workers in the Jag to 2,200, with no production for six weeks, and now 1,000 are being laid off at Solihull, with 360 workers being transferred from the Jag over to Solihull. Little wonder that when the workers were briefed on Monday, they were described to me as being “numb.” So, too, were the GKN workers when I was with them in the Driveline plant on that bleak day of 29 March with the takeover by Melrose. It was a rerun of what happened over Cadbury. I led the battle against the Kraft takeover of Cadbury, when a debt-laden American multinational took over a successful and profitable British icon because 31% of the shares were bought by hedge funds.

Exactly the same thing happened over GKN. We had hoped, after Cadbury, that progress would be made on a new corporate takeover regime. We had discussions with the Government at the time about freezing the share register at the time of a bid, for example, and about a proposal for shareholders needing to have held shares for six months before they could vote. We discussed a whole range of potential mechanisms, including a public interest test, but little progress was made and GKN was ultimately left open to a predator, Melrose, as vultures such as Elliott—described as the world’s most ruthless hedge fund—circled. They were utterly cynical in their approach. They were there for a matter of weeks in a company with a 259-year-old history, and their aim was simply to make a quick buck on the back of that corporate takeover. Theirs was a fleeting interest, and it was fundamentally wrong.

I welcome some of the contents of the industrial strategy, but I hope that the Government will listen to the wise words of the shadow Secretary of State about going yet further, crucially on Jaguar Land Rover and on the lessons of GKN. On Jaguar Land Rover, the transition to electric has been called a just transition, and all parties should be involved in the next stage: the road to zero. Crucially, that will need support from the Government—for research and development, for example—but that has been nowhere near good enough so far. Investment in infrastructure will also be needed. In parallel to that, I have to say that there must be no more playing to the gallery, exciting fears in the meantime, by the Secretary of State for Environment, Food and Rural Affairs. His statements on the transition from diesel have been at the heart of the collapse in diesel car sales by 37%, despite the fact that the new diesel technology is infinitely better for the environment than the old.

On GKN, I still hope that the Government will use their power under section 58 of the Enterprise Act 2002. If they do not, the guarantees given thus far will simply not go far enough. The most immediate task for the Government is to ensure that they play their part in extracting cast-iron guarantees for the future. They must then look towards introducing a Cadbury-GKN law. There must be no more leaving it to the market, red in tooth and claw—what the Daily Mail called “an abuse of capitalism”. Crucially, at the centre of our industrial strategy, to achieve a long-termism of approach, we need a new corporate takeover regime that is in the best interests of British industry, British investors and British workers. That is what our country needs, and it is what we look to the Government to deliver.
