As well as having to cope with the cost of remortgaging, thousands of people who thought they had bought a safe and secure home are still living with unsafe cladding and other fire-safety defects. What is the Secretary of State’s current assessment of the total number of properties in England that have yet to be made safe?

My commitment to making sure that we follow through on the issue of remediating unsafe buildings is total. There are 24 buildings over 18 metres that have yet to be remediated in the way that the right hon. Gentleman sets out. My priority—I will meet developers shortly—is to ensure that they sign the contract, which they committed to do in the summer, thanks to the hard work of my right hon. Friend the Member for Surrey Heath (Michael Gove), and to make sure that they fulfil their responsibilities. We are also taking action against those freeholders who have declined to remediate the buildings that they are committed to look after. We have served a pre-action notice on the owners of Vista tower in Stevenage with precisely the intention of making sure that they honour their obligations.

I beg to move,

That the Committee has considered the draft Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022.

It is a pleasure to serve under your chairmanship, Mr Stringer. This statutory instrument was laid before the House on Wednesday 11 May 2022 under section 150(9) of the Energy Act 2013 and section 250(6)(f) of the Housing Act 2004. I hope hon. Members will agree that, only days after the fifth anniversary of the tragedy of Grenfell Tower, it is both appropriate and fitting that we are meeting today to discuss strengthening safety standards in the social housing sector. In the aftermath of the disaster, the Government committed to putting in place much greater protections for residents against the risk of fire and carbon monoxide in their homes.

Hon. Members might recall that we published a social housing Green Paper seeking the public’s view on the proposals to create parity between the private rented sector and the social rented sector on safety standards. It will come as no surprise to hon. Members that the overwhelming majority of respondents were in favour. We have subsequently built on those proposals with our social housing White Paper to drive up standards across the board in the social housing sector and make sure that all tenants live somewhere that is decent, safe and secure. To deliver on that vision, we are amending the regulations to bring requirements for social homes in line with private rented homes. I am delighted to be the Minister taking this legislation through, given the fact that I proposed something similar in my ten-minute rule Bill as a Back-Bench MP in 2018.

Currently, the Smoke and Carbon Monoxide Alarm (England) Regulations 2015 make it mandatory for private landlords to install smoke alarms on every floor of a home that they let. Carbon monoxide alarms must be installed in every room with a solid fuel-burning appliance such as a log-burning stove or a coal fire. At present there are no such requirements for social landlords, and that is despite the Home Office suggesting that someone is around eight times more likely to die in a fire if they do not have a working smoke alarm in their home. Hon. Members might also be shocked to hear, as I was, that there are on average 20 deaths from accidental carbon monoxide poisoning each year in England and Wales. So let us be clear: smoke alarms and carbon monoxide alarms save lives.

Through this statutory instrument we will amend the Smoke and Carbon Monoxide Alarm (England) Regulations 2015 so that they replicate those for the private rented sector. The changes will mean that for the first time all social rented homes in England will be required by law to have smoke alarms installed. Specifically, social landlords will need to make sure that at least one smoke alarm is installed on the floor of a home where there is a room used for living accommodation. All landlords, regardless of tenure, will need to install a carbon monoxide alarm in rooms that are used for living accommodation but which have a gas boiler or similar appliance, or a solid fuel-burning appliance. That does not include gas cookers, which are responsible for fewer incidents of carbon monoxide poisoning than gas boilers.

These strengthened regulations will also require all landlords to repair or replace a faulty alarm as soon as they practically can.

Does that obligation on the landlord extend to replacing the battery? If someone has a smoke alarm that is beeping because the battery has run out, does that obligation fall on the tenant or the landlord?

I suggest that it would be the responsibility of the tenant, only in as much as they would want that done quickly. However, if they were unable to afford to do that, I suspect that the social landlord would take that up. I guess it is a question of proportionality and speed. Tenants would want it done quickly, and it is unlikely to be something that a social landlord would prioritise, given the other calls on their time.

The changes will not just make it easier for tenants to detect a fire in their home. They will also protect them from the risk of carbon monoxide fumes, which are undetectable and can cause serious illness or death. We will update guidance on the placement of smoke and carbon monoxide alarms, and on the types of alarms that need to be installed, so that landlords have absolute clarity on what they need to do to meet the standards.

On the timescale for the changes, I am sure that hon. Members will agree that a lengthy delay between regulations being made and taking effect could put lives at risk. We have therefore decided that 1 October 2022 is an appropriate date for the regulations to come into force. Landlords have known about the changes for a while now, but that gives them a little more time to get everything in place before the regulations come into force.

To conclude, the regulations will save lives and give thousands of households reassurance that they are receiving the best possible protection from the risks of fire and carbon monoxide in their home. We are determined to ensure that the reforms set out in the social housing White Paper, including these changes, will drive up standards so that people across the country have a safe and decent home to live in. I hope that colleagues will join me in supporting the draft regulations. I commend them to the Committee.

I beg to move,

That this House has considered social housing and building safety.

The events of the night of 14 June 2017 were unimaginably horrific. The fate of those living in Grenfell Tower is something that none of us can ever forget. I am sure I speak for Members across the House of Commons when I say that the 72 innocent people who lost their lives—18 of them children—will forever be in our memory. Today we are approaching the fifth anniversary of that tragic night and we all, particularly those of us in government, have a chance as a House to reflect on the tragedy and the important questions that it posed. We have to be clear: what happened that night should never have occurred. Each of us has a right to be safe in our home. The situation in which the residents of Grenfell Tower were placed was unforgivable. The fact that those in the tower were not safe exposed failures that had been overlooked for too long—failures in building control and safety that it is vital we address.

As we reflect on this tragedy, we should bear in mind that there had been warnings before that night. Residents of the tower and others had warned about how the voices of those in social housing were not heeded. In reflecting on what happened, we should reflect not only on the failures in regulation and building safety but on the way in which social housing tenants had not had their rights respected or their voices heard as they should have been. We all have to do better to ensure that issues of life and death are never overlooked again, and that everyone in this country can live their life in safety and dignity, in a home that is warm, decent and safe.

I am glad that we are joined in the Public Gallery by some of those directly affected, including bereaved families, friends and survivors who, for almost five years now, have been living with the ongoing consequences of this tragedy in north Kensington. Since I was given this responsibility as Secretary of State last September, I have been genuinely humbled to hear the personal stories of those affected by the tragedy. I thank them for the vigour, energy, sincerity and determination of their campaign. It cannot have been easy—by God it cannot have been easy—to live with the memories of what happened five years ago, but the people joining us here today, and their friends, relatives and neighbours, have campaigned with dignity and resolution over the last five years to ensure that appropriate lessons are learned.

I can think of few better representatives of community spirit, few better activists for a better world, than those from Grenfell United and the other organisations representing the next of kin, bereaved relatives and survivors. It is important the Government recognise that those voices and that activism should result in action. Again, I apologise to the bereaved, the relatives and the survivors for the fact that, over the last five years, the Government have sometimes been too slow to act and have sometimes behaved insensitively. It is important that we now translate the actions they are demanding into real and lasting change. As I hope I have done, and as I will always seek to do, that involves acknowledging what we got wrong as a Government and what went wrong more widely in our building safety system.

It is clear from the wonderful documentary work on the experience of those in Grenfell Tower that their representatives had warned before the refurbishment about some of the dangers, some of the high-handedness and some of the lack of consideration for which the tenant management organisation and others charged with tenants’ welfare were responsible. Lessons need to be learned about that.

It is also the case that, in the immediate aftermath of the fire, many of the institutions upon which people in North Kensington should have been able to rely failed them. We have to be honest about that, too. There is nothing I can say from the Dispatch Box today that can make up for those failures. All we can do is seek to learn from those mistakes and make sure we work with the community to ensure that nothing like this tragedy ever happens again.

My Department has a dedicated team of civil servants who are working to make sure those lessons are learned and the community’s voices are heard, and I thank all the officials who have worked with the community over the past five years, and who in many cases have become close friends of those affected, for their work. I also thank other professionals in the public sector who have worked with the community and families. I particularly want to thank those in the NHS. The health and wellbeing of many survivors of the tragedy has been impaired in a terrible way, and the commitment of NHS professionals to working with those who have been affected is admirable and worthy of our support and, certainly on my part, gratitude.

I also wish to thank two colleagues, Nick Hurd, a former Member of this House, and Baroness Sanderson, who have been advising the Prime Minister on how we can support the Grenfell families. Both of them were, of course, appointed by the former Prime Minister, my right hon. Friend the Member for Maidenhead (Mrs May), and I would like to thank her as well for the continuing close personal interest she takes in the issues that the Grenfell tragedy has brought to the forefront of all our minds.

I also want to thank the independent Grenfell Tower Memorial Commission, and I stress that it is independent; it includes elected community representatives, and it has been working hard to ensure that we can have a permanent and appropriate memorial to honour those who lost their lives in the tragedy. I recommend to all Members of the House the commission’s recent report. It makes for powerful reading and gives us all an opportunity to reflect on what the right way is to ensure that there is a fitting memorial for those who have lost their lives. The scene of that fire is both, of course, a crime scene and a sacred place, because for all those who perished that night we want to make sure that their memory is never forgotten. That is why my Department wants to work with the commission to ensure that its report is brought to fruition.

I also want to thank those who have been working with the public inquiry, under Sir Martin Moore-Bick. I know that when the inquiry was set up many representatives of the community were concerned that its work might not meet the needs of the hour, but I think that Sir Martin and his team, particularly the counsels to the inquiry—the lawyers who have been working diligently to get at the truth—have done us all a service. They have laid bare a series of mistakes that were made by those of us in government and by others, and they have exposed what I believe is wrongdoing on the part of a number of organisations. I do not want to pre-empt the conclusions of the inquiry and the steps that will necessarily need to be taken to ensure that justice is done. Sir Martin’s inquiry’s first report made a series of recommendations and it made uncomfortable reading for some, but it also ensured that the decision by my right hon. Friend the Member for Maidenhead to set up the inquiry has been vindicated. We now need to ensure that we take seriously all the forthcoming recommendations when the inquiry concludes.

Of course, we in government have not waited for the inquiry to conclude in order to take action. Not all of the steps that should have been taken have been taken, but in recent months we have been seeking to ensure that in respect of the direction of travel set out by the inquiry, and by others who have looked closely at the problems that underlay our regime of building safety, appropriate steps have been taken.

It should not have taken a tragedy such as the Grenfell Tower fire for us to realise that there were problems in our building safety regime and in our regulatory regime. But now that we have had an opportunity to reflect, study and look at the multiple and manifold failings, we know that a significant amount of work, which we are undertaking, requires to be completed as quickly as possible. We know that shortcuts were taken when it came to safety. We know that unforgiveable decisions were made, in the interests of financial engineering, that put lives at risk. We also know that in my Department individuals sought to speak up and to raise concerns but those voices were not heeded. That must rest on my conscience and those of Government colleagues. Many of those involved in construction, from those in the construction products industry to those directly involved in the refurbishment and remediation of buildings, just behaved in a way that was beyond reckless. That is why it is so important that the collective fight for justice that the Grenfell community have asked for results in those responsible being brought to book. In the meantime, we have been seeking to ensure that we put in place a regulatory regime that repairs some of the damage of the past and that money is made available to repair buildings in which people still find themselves in unsafe conditions.

The Secretary of State is being eloquent and honest in his apology for what happened—the collective failure. However, on the point that he has just addressed, he will be aware that there are cases where professional fire safety advisers have told leaseholders that the cladding on their building is not safe and does not comply with the new rules, but when those leaseholders have made applications to the building safety fund they have been turned down. Some of them are now having to contemplate spending £70,000 to £80,000 and waiting another eight months to put the panels in combination on a rig and then set fire to them. If those tests, the BS 8414 tests, go ahead and they show that the cladding does burn and causes a risk, will he undertake that the building safety fund will look again at the applications for funding, so that those buildings get the money, enabling work to begin, and people can feel safe in their homes?

The right hon. Gentleman makes a very good point. He has been, if I may say so, a consistently clear and authoritative voice on behalf of those who have found themselves in an incredibly difficult situation. The leaseholders he has described should not be in that position. There have been problems with the building safety fund—there absolutely have. Let me promise him that I will look at the specific case that he raises and, indeed, the wider issues and see what we can do to make sure that the building safety fund, which has not been discharging funds at the rate, at the pace and in the way that it should, does better.

I think my hon. Friend, the Chair of the Select Committee, is making the Secretary of State’s day. We can add that to the very long list of problems. I think his question was more for the Secretary of State than for me, and I am sure he will ensure that it is addressed in the winding-up speeches, but I add my voice to his in saying that one of the reasons we were very concerned about the scheme is that it reaches only a very small number at a very high price.

We have a housing crisis in Britain and, as the Secretary of State knows, it manifests in a multitude of ways—in people who have been mis-sold leasehold properties, people who face soaring rents and are crippled by housing costs and the cost of living, and people in totally unsuitable exempt accommodation. Those loopholes have still not been closed while people continue to milk the system and claim housing benefit while allowing communities to fall into rack and ruin.

As the Secretary of State acknowledged, five full years after the Grenfell tragedy thousands of people remain stranded in homes covered in similar cladding, facing ruinous costs because of a scandal that was not of their making. The right hon. Gentleman is right that developers, not leaseholders, should pay. He has pushed that further than any of his predecessors and he has my full support in doing so. As long as he continues down that road, we will support him in the fight. However, I understand that so far 45 homebuilders have paid £2 billion to fix fire-related safety defects, which is roughly half of what he told the House would be needed. Where will the other £2 billion come from? What assurances and guarantees does he have that the developers who have agreed to pay cannot backtrack on any of the agreements?

The Government’s plans are missing several elements that need to be addressed and added to existing measures in the Building Safety Act 2022. The Secretary of State will be aware of those. There is still far too little support for the significant number of leaseholders who face huge bills to fix non-cladding defects.

My hon. Friend is making a powerful speech. On the point she just addressed, there are leaseholders living in buildings who have looked to what the Secretary of State says about wanting to make those responsible pay but who still do not know who was involved. Often there is a network of companies; some may have disappeared or taken new names but still have the same directors and so on. Would it not be helpful if the Government were to write to the leaseholders in all those buildings setting out what information they currently have about the willingness of those involved in the construction of the building to cough up for the unsafe flats they constructed?

My right hon. Friend makes an extremely good suggestion, which I hope the Government will take up. It is not just the huge costs that are causing such damage to people; it is the uncertainty and anxiety that they have to live with every single day. Anything the Government can do to alleviate that anxiety—to send a signal to the leaseholders who are now trapped in their homes that they are not on their own—would be extremely welcome.

Will the Secretary of State look specifically at those who are seeking to sell or remortgage their properties? For such people, this wait is agonising and unbearable; their lives are on hold and they simply cannot move on. I have to say to him that it is quite wrong of the Government to rule out retrospective help for those who have already paid. Many people felt pressured or bullied into paying these enormous bills, yet no help is coming for them. That is not justice. Nor is there help for the countless leaseholders who are mired in mortgage chaos. Government funding so far is available for buildings over 11 metres, but shorter buildings may contain more vulnerable residents, be coated in more cladding and have more serious fire safety issues. What more does the Secretary of State plan to do to ensure that priority funding is allocated according to risk?

At the current pace, it will take until 2026 to remove cladding on all social housing blocks, and until 2024 for private blocks. When does the Secretary of State expect remediation of all dangerous buildings to have been completed? Can he give us some reassurance on that?

It would be wrong of me to stand here and say that the problems facing leaseholders began and end with Grenfell. A group of local residents who have been caught up in this scandal came to see me and told me a familiar story. They have been hit with huge charges, but when they challenged the charges with their management company, they did not even get a response. They have written again and again and have been completely and utterly ignored. It is totally unacceptable, and it is not new.

The hon. Member for Worthing West (Sir Peter Bottomley) is not in his place right now, but he has fought this battle for years, as I well remember. Many years ago, in 2001, I worked for the then Member of Parliament for Walthamstow as the Commonhold and Leasehold Reform Bill—later the 2002 Act—was going through this place. These debates were happening here in this place at that time, a full decade before I was elected to Parliament. They were happening when I was working for Centrepoint, the fantastic organisation to which Members have paid tribute today. Parliament was debating how too many people were being ignored and overlooked, and these arcane and archaic, feudal models of tenure were still being defended by some, even though they had clearly and completely outlived their usefulness.

Almost every country in the world apart from Britain has either reformed or abolished this archaic, feudal model. I believe there is now cross-party consensus on the need to do something about it. I was pleased to hear the Secretary of State acknowledge that we are right to say that we must have legislation to deal with this, but I say gently to him: where is it? He says legislation will be forthcoming in this parliamentary Session, but it was not in the Queen’s Speech. There are five Bills from the Department for Levelling Up, Housing and Communities in the Queen’s Speech; surely time can be found to ensure that we deal with this problem once and for all.

We need new legislation to end the sale of new private leasehold houses, effective immediately after Royal Assent is given; new legislation to replace private leasehold flats with commonhold; and new powers for residents over the management of their own homes, with rights for flat owners to form residents’ associations and simplification of the right to manage. Why do the Government not hand leaseholders the right to extend the lease to 990 years with zero ground rent at any time or to cap ground rents when extending a lease to 0.1% of the freehold value up to a maximum of £250 a year? The Levelling Up, Housing and Communities Committee, which my hon. Friend the Member for Sheffield South East (Mr Betts) chairs, has done incredible work on that. The proposals are there and ready to go.

Where are the Law Commission’s proposals to reform the process of enfranchisement valuation for leaseholders, including on marriage value and prescribing rates for the calculations of the premium? Surely, in the midst of a cost of living crisis, it is a no-brainer to crack down on unfair fees and contract terms by publishing a reference list of reasonable charges, by requiring transparency on service charges, and by giving leaseholders the right to challenge rip-off fees and conditions or poor performance from service companies.

I started by saying that a group of people were rendered invisible to decision makers only a few miles away, which is completely unacceptable in modern Britain. How can we accept that these rip-off companies, on behalf of owners who we often do not know and do not have the right to find out about, are allowed to tell people whether they can change the doorbell on their own home or make minor changes that would make a big difference to their lives? How on earth is it right that we are siding with those rip-off management companies and opaque owners over people who live in their own homes, have a stake in this country and their communities, and deserve the right to something better?

If the Secretary of State can secure time for the second part of the leasehold reform Bill that was promised, we could end these arcane rules and give power and a voice back to people in their own homes and communities. Was levelling up not intended to answer that clamour for more control and agency, and give people who have a stake in the outcome a greater ability to make decisions about their own lives? That is the legacy that we should seek to build in honour of those who lost their lives in Grenfell: everybody everywhere in the UK, regardless of the type of tenure that they happen to end up with, has the right to a decent, secure, safe home—full stop. We will make sure that that is delivered.

The Grenfell community has steadfastly campaigned not just for justice but for change, and it is humbling to welcome some of the relatives to the Gallery. I share the Secretary of State’s view that that has come too slowly and that their long fight for justice has for too long been paved with broken promises. Those lives mattered, and if we believe and mean what we say when we honour them, we must build a better system in the wake of that appalling tragedy. His Department has five Bills in the Queen’s Speech, which is five chances for us to get it right. We will move heaven and earth to help him do that, but let us not waste them.

I begin by joining others in expressing my condolences to the families who are here—and others who are not—whose loved ones died in the Grenfell fire. Their pain is never, ever going to go away. The very least we can do, and the essential first step, is to apologise for the failures. We heard that from the Secretary of State and my hon. Friend the Member for Wigan (Lisa Nandy), who spoke for the Opposition.

Looking back, it is incredible that combinations of materials were allowed on the outside of buildings as cladding and were declared safe when no one had ever set fire to them to see what would happen. It is extraordinary that that transpired, and it is incredible that so many buildings were not constructed in accordance with the building regulations in force at the time. As the Secretary of State will know, as cladding has been inspected, people have peeled stuff off, peered inside and said, “Uh-oh—where are the fire breaks?” It is also shameful that the people responsible for this generation of jerry-built blocks thought that they could get away with it. That is what we are confronting.

There is no doubt at all—I join hon. Members on both sides of the House in saying this—that the Secretary of State has applied great determination and energy to the task that confronted him when he came into the post. However, he will be acutely conscious that thousands of leaseholders still do not know what will happen to their block. With each passing day, they remain trapped: trapped in their life, trapped in their building, which they are told is a fire risk, and paying additional costs. They do not know when it will all be brought to an end.

I have raised with the Secretary of State the particular case of the Gateway building in the centre of Leeds. Three types of cladding were submitted to the building safety fund. The fund said that it would pay for the render, but that the two types of zinc cladding—zinc is applied to battens with various other materials—were not eligible for funding, even though the specialist fire safety adviser to the managing agents and the freeholder has said that in their professional opinion such cladding does not comply. The leaseholders are currently debating whether to spend £70,000 or £80,000 and another eight months on it. There is a great waiting list—after a generation or two of failure to set fire to materials to see whether they were safe, there is now a long queue for the small number of institutions that can make up a particular combination made up at height and set fire to it to see what happens.

I raise the case because one of the considerations that my constituents and the managing agents are weighing up is that if the material is not found to burn in a way that breaches the regulations, a fire safety adviser will be able to issue an EWS1 certificate in respect of the building. But what if the material does burn in a dangerous way? Is it all worth doing unless they are sure that if they provide incontrovertible evidence, the building safety fund will say, “Okay, we will now cough up for a replacement”? That is a very important question. It may relate to a relatively small number of blocks, but they deserve reassurance that if they provide the evidence, they will get a change in the building safety fund’s decision.

The problem is immensely complex, as the Secretary of State and his officials, who have been working so hard, know better than anybody. Also complex is the liability waterfall that he has created to deal with it, but leaseholders are still not sure how the waterfall will work. To extend the analogy, I suppose they hope and pray that the water will never fall on them because others higher up the chain will have taken on the work and the liability.

I have great sympathy for the managing agents, some of which are quite small. They have dealt with lift contracts and ground maintenance. They never thought that the task of being a managing agent would mean being asked to manage a multimillion-pound contract to, in effect, pick off the outside of a building and rebuild it to be safe. They are sitting with leaseholders and trying to work out where the funding will come from, out of multiple sources. It is a very difficult process.

The hon. Member for Bromley and Chislehurst (Sir Robert Neill) raised a point about buy-to-let landlords. Apart from the unfairness of saying to people who have bought flats in good faith that somehow they are not entitled to the same protection as leaseholders, there is a practical problem. I can think of blocks in my constituency in which a goodly proportion of the flats are owned by buy-to-let landlords. If they cannot come up with the money to contribute to fixing the problem, that will affect all the leaseholders living in flats that they have bought in the same block, because the work will never get done. There is a pragmatic reason for ensuring that that does not come to pass.

This debate has not touched on the alternative approach of having a building works agency, rather like what has happened in Australia, where a central body has taken on this complex task but then gone after the people who should pay. With hindsight, that would have been a better approach. Of course, costs are rising all the time.

Before I come on to social housing, I want to make one other point to the Secretary of State. I do not know whether he has taken this up—I apologise if he has—but I wrote to one of his predecessors to propose convening a standing roundtable, if that is not a contradiction in terms, made up of representatives of leaseholders, managing agents, fire services, fire surveyors, insurance companies and mortgage lenders. The Minister and his team and officials may be having conversations with each of those bodies individually, but such a roundtable would be a place where individual problems that may be happening elsewhere could be worked through in aid of a speedier outcome.

The real test, as with the debt of obligation that we owe to the Grenfell families who are here today, will be how soon the day will arrive when all my constituents and every other hon. Member’s constituents can finally breathe a sigh of relief, knowing that the problem has been sorted, and can get on with the rest of their lives.

I have a brief point to make about the social housing crisis. I listened with great interest to what my hon. Friend the Member for Mitcham and Morden (Siobhain McDonagh) said. In the 1980s, Leeds City Council had about 94,000 council properties; today, it has 54,000. The big fall in the numbers of new council houses being built across the country, along with the sale of council houses, means that the stock available to let to people in need is falling at a rate of about 600 a year. Many other councils around the country will see the same picture. What is more, turnover is falling because people are thinking, “I think I’ll hang on to the council property I’ve got at the moment,” and demand is ever rising. In Leeds, 26,500 people are on the housing register, 6,500 of whom are in band A.

The maths is really terribly simple. There is growing demand, with people living in overcrowded accommodation —increasing numbers of people are coming to me and telling me, as their Member of Parliament, about the difficulties that they are experiencing in overcrowded, unsuitable accommodation with medical and other needs. They are chasing a diminishing number of properties. In one case, when new council houses were advertised—Leeds is doing its best to build them and has a choice-based lettings system—more than 1,000 people applied for one new council property. Anyone who is not absolutely at the top of the priority banding does not have a hope in hell of getting a property.

I listened with interest to the recent announcement about the right to buy. In all honesty, I have to say to the Secretary of State that we have heard about one-for-one replacement time and again, but it has never happened. That is why Leeds City Council’s housing stock has gone from more than 90,000 to just over 50,000. We have ended up in the absurd position that in an effort to increase the number of council houses for rent, councils including Leeds are buying back council houses that they originally built but which were sold. So they are paying twice over for one property, and that does not make sense.

I do not know whether the Government would ever consider this, but one approach would be to say, “I support the right to buy, but if the person who has bought the house then wants to sell it on to someone else, shouldn’t the council have the right of first refusal to take the property back?” We know what has happened: as has already been pointed out, many of those houses, as they have been sold down the chain, have ended up in the hands of private landlords charging—as we heard a moment ago from my hon. Friend the Member for Brentford and Isleworth (Ruth Cadbury)—rents that are way in excess of those that applied when they were council houses. It is an absurd system, at a time when we know that there is such basic housing need.

It is not as if new homes had not been built; loads of new homes have been built in the centre of Leeds. However, they are mainly one or two-bedroom flats—some of them in the blocks that are currently affected by the cladding crisis—whereas, in Leeds as in many other places, as families grow the need is for three and four-bedroom housing. There has been a terrible mismatch. It is not as if there were no space in which to build, and it is not as if there had been no resources with which to build. The problem is that the wrong types of properties are being built, and the people in the greatest need are unable to get their hands on the properties that would enable them and their families to look forward to a better future.

The time has come for this acute housing crisis, which is causing great suffering to people, to be addressed by the Government.

I am delighted to make that commitment. My hon. Friend mentioned the complexity of the EWS1 form and, as a civil engineer and a member of the Chartered Institute of Building, I am a keen enthusiast for such technical detail. I look forward to that discussion.

It was good to hear the valuable observation from the hon. Member for Richmond Park (Sarah Olney) that Members in all parts of the House are committed to tackling these problems together. She is right that we often do not have consensus, so it is welcome that we have it here. I will continue to consult on and consider remediation costs, and I will make sure we have discussions with social housing providers to come to an appropriate conclusion on how those costs can be covered.

The hon. Lady referred to the work of Kwajo Tweneboa and ITV. To a degree it is sad that we need people outside the House to highlight these points to us, but I am grateful to them for doing so. A number of housing providers are ahead of our legislation and are already upping their game. Many housing providers provide excellent service and high-level accommodation in safe and secure properties for their tenants, but just one case such as we have seen highlighted by Kwajo Tweneboa or ITV is one too many. We need to address that so nobody feels it is appropriate to provide poor-quality accommodation.

The hon. Member for Brentford and Isleworth (Ruth Cadbury) mentioned PEEPs. The Government have now committed to undertake a new consultation. This will include a proposal called “emergency evacuation information sharing,” which would require persons responsible for high-risk buildings to assess the needs of their most vulnerable residents and to consider what might reasonably be done to mitigate any fire safety risks.

The right hon. Member for Leeds Central (Hilary Benn) mentioned problems experienced by residents in the Gateway building, which I understand has made a successful application to the building safety fund.

Rather than attempting to discuss that across the Chamber, it would be good to meet the right hon. Gentleman to discuss the specifics of his case in more detail.

The Secretary of State is keen to see more social housing supply generally. I fully appreciate that the hon. Member for Greenwich and Woolwich (Matthew Pennycook) says the direction of travel has not been positive, and we need collectively to turn that around.

I will finish on a positive note. The hon. Gentleman welcomes the Social Housing (Regulation) Bill, but he says he will push us further and faster. It will be good to work with Members from all parties to discuss how we can enhance that Bill and where there are opportunities for us to go further. We need to take this opportunity to make sure we get it right and to make long-lasting changes.

As a Parliament and as a nation, we must never forget what happened on 14 June 2017. To that end, I echo the comments made by my right hon. Friend the Secretary of State in thanking the Grenfell Tower Memorial Commission for its tireless work on determining a fitting and lasting memorial at the Grenfell Tower site. But we must also continue to honour and respect the memory of those who were lost by ensuring that this country has one of the most rigorous and robust building safety regimes in the world.

Working with colleagues from across this House and with campaigners throughout the country, we have already come a long way together. Our Building Safety Act 2022 created a tough new regulator and an even tougher regulatory regime to match, with an “accountable person” held responsible for a building’s safety and the residents who live in it. The Fire Safety Act 2021 has strengthened assessments and improved safety standards across the board. And our charter for social housing residents, developed in close consultation with the Grenfell community, has empowered social housing tenants everywhere, ensuring that they are listened to and treated with the dignity and respect they deserve.

We know that we still have a long way to go, but, as my right hon. Friend stated in his opening remarks, we are now doubling down on our efforts to finish the job we started, by forcing the industry to take collective responsibility for the safety defects it created, and through a new Social Housing (Regulation) Bill, which places tenants’ concerns at the heart of everything that landlords do. We will be judged not by our words, but by our actions to fix this broken system for good and to make sure that everyone in our society lives somewhere that is safe and secure, and that they are truly proud to call home. Let that be Grenfell’s enduring legacy.

My door is always open, so if the hon. Gentleman wants to raise specific cases with me I would be more than happy to take them up and make sure that we get relevant answers for him.

Freeholders and landlords should not be commissioning costly remediation in buildings below 11 metres except in exceptional circumstances, which is where there is no more proportionate option available. They certainly should not be pointing to old EWS assessments to justify those costs. Given the small number of buildings involved, a blanket legislative intervention bringing hundreds of thousands more buildings into scope to deal with an issue affecting just a handful of buildings would be entirely disproportionate. The Government amendments therefore reinstate the definition of “relevant building” as one that is at least 11 metres, or five storeys in height, and contains at least two dwellings.

I am extremely grateful to the Minister for giving way. In respect of the point that he has just made, have the Government made an estimate of the number of residential buildings below 11 metres where there may be a case for extensive remediation works? I am just trying to follow the logic of the Government’s position. They say that there is not really a problem with buildings below 11 metres, which is why they do want to include them, but if there is not a problem, surely the Government would not be having to do much in respect of those buildings, because there are very few of them—so the Minister says.

The issue is the proportionate measures that can be made in those buildings to ensure that they are safe. We want to make sure that we get this right, and we will be continuing to look at all of these. If the building safety regulator assesses that further work needs to be done, or that the Government need to look at what needs to be done, we will absolutely make sure that we do that, and I make that commitment to the House.

What an awful long way we have come with this Bill. On the previous Bill, the Fire Safety Bill, we were told categorically that that was not the right vehicle for the sorts of remedial help people needed in all our constituencies and that this was the Bill. To be fair to the Minister and his civil servants, there has been huge movement—huge movement—compared with where we were when there was considerable unrest on the Conservative side of the House as well as around the House. One of the reasons this Bill has been changed so much is that there was general unrest across the Floor of the House as to what the Bill was actually saying and doing. Can I pay tribute to my colleagues on this side of the House? With a majority of this size, the Government could have ignored us, but they could not because there was too much unrest on this side of the House and the campaigning went on. I want to pay tribute to my colleagues on that point.

Is the Bill perfect? No, it is not going to be perfect. But do we need this Bill on the statute book in this Session? Yes, we do. That is why I will personally be supporting all the measures, and not voting for any of the amendments to send it back to the other place. I think a lot of the work can be done through secondary legislation. The Minister has indicated that. More work could be done, particularly in my opinion—I have said this on Report and Third Reading, and the Father of the House, my hon. Friend the Member for Worthing West (Sir Peter Bottomley), has touched on it, as have all of my colleagues here—with the insurance companies. The Father of the House cited how all the professional bodies that were responsible for building these properties—all of them—were insured, yet the insurance companies have got off scot-free.

I know that those in the Department will say—I have said this before, but let me just repeat it—that it would be very difficult to get the insurance companies to retrospectively pay for this work. That is what they said about mesothelioma, where companies had gone bust and people were dying and suffering from that horrible asbestos disease, but the Government actually brought the legislation forward so that we took a levy from the insurance companies to cover those missing employers, and we could do it with the missing companies. We could do it if we wanted to really do it, and I hope—I am going to go on and on to everyone in this House—that this can be done. Look at the way the Department for Work and Pensions did that Bill. I know a lot about it because I took it through the House, so I am slightly biased. It can be done.

I want to pause for a second, and I declare an interest as a former firefighter. I have nothing but admiration for our firefighters and emergency services who went into Grenfell, when others were quite understandably coming in the other direction. They saw things they never dreamed they would see in their careers. We do not want to see that again, but fires do recur, and our emergency services do a fantastic job. I hope that they are getting the psychiatric support for what some of those sights will have created in their lives. That will affect their lives going forward, and I have asked this question before of several Ministers.

However, the key to this Bill today is that we get it on the statute book. We can do more work through secondary legislation. I think it is absolutely imperative for our constituents that we get it on the book today, so that the other House listens to us and we get this on the statute book before the Queen’s Speech.

Like many Members have already done, I begin by acknowledging the progress that the Government have made. I think the House would like to thank the Secretary of State and the Minister for Housing for effecting the transformation from the laissez-fair approach that the Government took previously to a really hands-on approach now—I also pay tribute to the civil servants for the work they have obviously done advising Ministers—and for asking themselves, “What are all the levers we can pull and the legislation we can enact to force people to live up to their responsibility?” I also thank Members on both sides of the House—it has been a team effort—but echo the point made by the right hon. Member for Hemel Hempstead (Sir Mike Penning) that, given the Government majority, dissent on the Conservative Back Benches has been really important in getting us to this point. I pay particular tribute to the hon. Members for Stevenage (Stephen McPartland) and for Southampton, Itchen (Royston Smith).

The reason above all others that we have got to this point, however, is the leaseholders’ refusal to give up. They looked at the situation they found themselves in through no fault of their own and basically said, “We’re not having it, because it’s not fair.” The House now acknowledges that and recognises it, so we should, above all, applaud their determination and persistence and that of all the cladding groups, including the Leeds Cladding Scandal group in my constituency, where, like many speakers today, I have constituents who are affected. It shows what can be done if people do not give up, which is a really important life lesson.

Having said that, our constituents have lived with years of uncertainty and it is not quite over yet—a point to which I shall return. Reference was made to a video of one of the fires. We all saw what happened at Grenfell, but there was also the fire at The Cube student accommodation in Bolton, and we saw how quickly it went up. I think the official report said, in effect, “The building did not perform according to expectations”. If that is not understatement, I do not know what is. The truth is that we are dealing with a load of buildings that were badly built and unsafe, and people got away with it for far too long. Let us try to put ourselves in the position of those who live in those buildings. Never mind the fear of a bill arriving which they have no hope of paying; there are the waking watch costs, the insurance, the uncertainty, the inability to get on with their life or to sell, and going to bed every night thinking, “Well, if there were a fire, would I get out if the building went up in 11 minutes?” It is a scandalous position that people have been put in through no fault of their own.

I have a few brief points to make. The first is that I stick to the principle that I and many other Members have advocated from the start, which is that leaseholders, because they are not responsible, should not have to pay anything. My hon. Friend the Member for Greenwich and Woolwich (Matthew Pennycook), who spoke so clearly a little earlier, was absolutely right when he said that they should not have to pay. A cap is better than an uncapped bill, but why should they have to pay anything at all?

Secondly, we have discussed the position of buildings under 11 metres this afternoon, and I think the local case for including them is extremely strong. Replying to interventions, the Minister for Housing said that he is prepared to look at them on a case-by-case basis, but it seems to me that he could do that even if the Government chose to include them in the scheme.

Thirdly, I seek clarification on a point my hon. Friend raised about what happens if leaseholders have already paid up to the £10,000 cap but there are further costs. What if there is a continuing need for a waking watch? If the bill is not paid, the fire service may say to leaseholders, “You’re going to have to leave the building. We’re shutting it down because you don’t have a waking watch still in place.” What happens in those circumstances? It would be scandalous if leaseholders who have already paid the £10,000, or £15,000 in London, were to suffer that for want of someone to pay the bill.

Fourth is a point that has not been raised in the debate so far, but some constituents have contacted me about it. The Government have decided to limit the number of leaseholders who are not resident—buy-to-let landlords—who can benefit from the scheme. Morally, I do not see how anyone can argue that they are more responsible for the failings of others than residential leaseholders. Also, if a building has a lot of buy-to-let properties and the buy-to-let landlord leaseholders cannot come up with their share of the money to fix the building, that has an impact on the residential leaseholders living in the building, and the net result could be that the building does not get fixed and they continue to bear costs that they cannot bear. I say “cannot bear” because ultimately that is the reason the Government have had to move. It was a fantasy to think that leaseholders would come up with sums of money they simply do not have—ridiculous. It was never ever going to happen.

The right hon. Gentleman mentioned the Leasehold Knowledge Partnership, which I should have included in the list of those to be thanked. I think that representatives of the partnership and the National Leaseholders Campaign have had time to get from the rally to the Gallery, so I repeat the thanks to them. I include with them Lord Greenhalgh, who has engaged with all the voluntary groups. I can think of no better aim for a campaigning charity than saving residential leaseholders from a situation from which they could not otherwise escape.

I am delighted to echo the Father of the House. The partnership has been brilliant in its analysis of what has and has not been done, what the problems are and what the solution ought to be, and it has also been persistent.

I know the Minister will appreciate my final point, because he has worked very hard on this. Our constituents have waited long enough, with their lives on hold, and the sooner we can made all these bits work, the better. We have to enable them to wake up in the morning and think, “D’you know what? I don’t have to worry about the nightmare I’ve been living in for the last five years and I can get on with the rest of my life.” We owe it to them to bring the day they dream of around as soon as possible.

It is a pleasure to follow the right hon. Member for Leeds Central (Hilary Benn). I refer the House to my entry in the Register of Members’ Financial Interests, in particular as chairman of the all-party group for fire safety and rescue. As I mentioned in an intervention, I have been involved in prelegislative scrutiny of the Bill from its beginning and in the various reports the Select Committee produced in the wake of the Grenfell fire. The eye-watering aspects of building safety across this country really only came to light with that terrible tragedy at Grenfell, nearly five years ago. We have all learned a lot.

I congratulate my right hon. Friend the Minister for Housing, who is new to the job and to the Bill, on the rapid progress that has been made since he was appointed. I also congratulate my right hon. Friend the Secretary of State, who has dramatically changed the whole approach taken in this Bill. The Opposition spokesman, the hon. Member for Greenwich and Woolwich (Matthew Pennycook), is no longer in his place, but I think he recognises the dramatic changes that have taken place during the passage of the Bill through the other place.

When preparing for today’s debate, I thought of one or two ironies. The first was that the Second Reading debate was so shortened that we all got three minutes to speak, but today, although we have a reasonable amount of time to debate the issues, the business managers are encouraging us not to go on too long. That seems suitably ironic.

There are several issues to address. I thank the Minister for making it clear that this will not be the end of the process. Secondary legislation will come along on the back of the Bill, and that will be the detail that really matters to the people we represent—the leaseholders, who are the one party in all of this who are completely innocent and should not be penalised in any way, shape or form. It is a contradiction that we are asking leaseholders to make a contribution to fire safety costs and cladding remediation for which they have no responsibility.

I welcome the cap, but I do not see why that cap has been set at a particular figure. Many of the people we are talking about are not wealthy. They may have bought their leases a long time ago, and they are often living on fixed incomes and have no disposable income to put towards the costs, because they are paying the other bills for their properties. They are not able to stump up huge amounts of cash. As has been said, many of those people have been presented with eye-watering bills, such as £250,000 or more, to fix fire safety issues that are definitely not their fault, are clearly the responsibility of the developer in the first place and should have been put right since.

Also in preparation for this debate, I had a look at the Select Committee’s first report on prelegislative scrutiny of the Bill—the Chairman of the Committee may recall it. If the Government had accepted our proposed changes, we probably would not be here today discussing Lords amendments. Almost all the proposals in our report are now in the revised Bill. That is a significant change and demonstrates that when we are dealing with issues of such a technical nature, prelegislative scrutiny is the right way forward. I commend its use to Ministers in the future.

I have a couple of points to make about where we are now, to put them on the record so that we can get through this phase in the secondary legislation. I would like clarity from the Minister on the position of housing associations when pursuing developers who have developed social housing that is clearly not fit for purpose.

My right hon. Friend is correct; that is why I sought in my statement to emphasise that levelling up can only succeed if British business and private enterprise succeed. That means the right regulatory framework, outside the European Union, as we spelled out on Monday. There are steps we have taken and can take to ensure that we have smarter and leaner regulation.

More broadly, I think that if we look at the success of great industrial towns in the past, we see that figures such as Joe Chamberlain were driven by the spirit of private enterprise, but by civic pride as well. Chamberlain provided an example of great local leadership, and also of ambition to improve education. The mission that he led in Birmingham to ensure that universal education was extended even to the poorest was the perfect complement to the drive that he showed in generating wealth through the market.

One of the great inequalities in my constituency is the gap between those who are able to feed their families and those who are not. In every year since the Government took office the use of food banks has increased, and last year 2.5 million food parcels were given out to people who had gone up to a complete stranger and said, “Can you help me to feed my family?” What are the Government going to do to bring an end to this scandal?

The right hon. Gentleman makes a very important point. We have taken, and continue to take, a series of steps through the supporting families programme. We are also outlining in the White Paper some of the proposals that we are taking forward as part of Henry Dimbleby’s national food strategy, which explicitly addressed some of the particular challenges to which the right hon. Gentleman has rightly drawn attention, to ensure that people have the resources and the capacity to put healthy food on the table for their children. I look forward to perhaps visiting Leeds with Henry Dimbleby to talk to the right hon. Gentleman about exactly how we can achieve the change that we need.

I am grateful to my hon. Friend. Of course, the time made available for debate in the other place is for the other place to determine, but I am sure that the business managers in both Houses have heard his points. I certainly want to ensure that there is adequate time to debate properly what are somewhat technical and detailed matters so that, working across party and with members of the Select Committee on Levelling Up, Housing and Communities, we can properly get the Bill right.

Further to the answer given to my right hon. Friend the Member for East Ham (Stephen Timms), will the Minister explain why the statutory protection that the Government are considering will apparently not extend to leaseholders not living in their flats? I know of at least one constituent of mine who was forced to leave his flat and rent it out as that was the only way he could raise the money to pay for the waking watches and insurance bills. Given that he is just as much a victim as those still living in their flats, why should protection against unreasonable costs not be extended to people such as him?

I am grateful to the right hon. Gentleman. He will know, as the House does, that building safety and the challenges that leaseholders face are very complicated. The House will also know that we have committed to help those in shared ownership, for example, by making it easier for them to rent out their properties if that is a means of ensuring that they can pay their mortgages. I assure him that we will look closely and work collegiately and collectively across parties, and with other interested parties, to ensure that such issues are effectively and appropriately debated and addressed.

My hon. Friend is absolutely right. I hope that, as Members consider the Bill and amendments, they have the chance to reflect and to remember why it is going through.

One does not pre-empt the Grenfell Tower inquiry’s conclusions in stating that the horror of that dreadful June night was the product not only of pernicious industry practice, but of state failure—the failure of successive Governments in presiding over a deficient regulatory regime, and the failure to act on repeated warnings about the potential lethal consequences of that fact. The Hackitt review detailed a deeply flawed system of regulation and argued for a radical overhaul of it. To the extent that the Bill delivers on the recommendations of Dame Judith’s report, we remain supportive of it and want to see a version of it on the statute book as soon as possible, given that four and a half years have elapsed since the Grenfell tragedy; however, the House knows we have serious concerns about what is missing from the Bill, and particularly its failure as drafted to provide robust legal protection for leaseholders facing ruinous costs—a point already made by several hon. Members on both sides of the House—for remediating historic cladding and non-cladding defects. In the absence of such protection, the Opposition are clear that the Bill will fail to meet what Dame Judith described as

“The ultimate test of this new framework”,

namely,

“the rebuilding of public confidence in the system.”

As we have heard, part 5 deals with remediation and redress, as well as assorted provisions relating to safety and standards. In Committee, my hon. Friends raised concerns about the limitations of clause 126, which seeks to ensure that landlords take “reasonable steps” to pursue other potential means of recovering the costs before passing them on to leaseholders. We of course believe it is right that landlords be forced to exhaust all means of funding remediation works other than passing on costs to leaseholders, whether that be seeking redress from the original developer in cases where the two are not the same, exploring a claim against a warranty, or applying for grant funding; however, we remain of the view that this provision gives leaseholders extremely limited protection in practice and we want that to be supplemented with additional provisions for maximum legal protection against the costs of remediating all historical defects—an objective that I know is widely shared across the House, as evidenced by the numerous amendments on the amendment paper today relating in one way or another to leaseholder protection. I will speak on that issue in more detail later in my remarks.

Clause 128 relates to limitation periods and makes changes to the operation of the Defective Premises Act. We supported the proposed expansion of the Act but remain of the view that there are considerable practical obstacles to leaseholders’ successfully securing redress via that mechanism—a point made by the right hon. Member for Hemel Hempstead (Sir Mike Penning) and my hon. Friend the Member for Blackley and Broughton (Graham Stringer)—not least given the prevalent use of special purpose vehicles precisely to avoid liabilities of this kind. We believe that the Government are in general overplaying the significance of litigation as a solution of the building safety crisis.

While of course we all welcome the extension, in practical terms, our constituents who have, staring at them from the table, bills for sums of money that they cannot afford, will not be in a position to start a legal action that may take several years, at enormous cost and risk and with no guarantee that it will reach a satisfactory conclusion, as my hon. Friend is so ably pointing out. It is not an answer to the problems that so many of our constituents are facing now.

My right hon. Friend, as so often, is absolutely right that it is an uphill struggle for leaseholders to get together to begin legal action of this kind. He also raises the highly pertinent point that there is nothing in the Bill that prevents freeholders today from passing on costs to those blameless victims of the crisis.

The Father of the House is absolutely right. When we put to the insurers this idea that they should compensate those people whose lives and loved ones had been affected by the asbestos, did they like it? No, they hated it. They fought tooth and nail not to do it, but we did it, and we did the right thing. When we come to part 5, Mr Deputy Speaker, I hope to catch your eye again.

May I just touch on a point that many colleagues have raised today? If people, in fear of threatening letters from lawyers and bailiffs, paid the remedial costs on their lease in good faith, how can it be right for us in this House to say that they did the wrong thing, while the people who held off paying those costs did the right thing? That sticks in my throat. It cannot be right that we penalise people who feel that they did the right thing. I said this to the Secretary of State during his statement. I am not saying that he dismissed it; he probably just thinks it is very difficult. Yes, it is very difficult, but that is what this place is for—when things become difficult, we resolve the problem. We have an opportunity with the insurers.

As we have heard from Members across the House, these bills are dropping on people’s doorsteps now, and it is happening in my constituency. They are innocent people who have done nothing wrong other than wanting to get on the housing ladder. Today we have an opportunity to address this. I agree with my hon. Friend the Member for Stevenage (Stephen McPartland) that we do not need to move these amendments now. We will wait to see what happens when the Bill goes to the Lords, but by golly we will move them if it comes back.

The one thing that has united the House today has been support for the principle embodied in new clause 13. There is a huge burden of expectation now on the shoulders of the Minister and the Secretary of State because of the commitment that was given in the recent statement, and we are all anxious to see how the Government intend to fulfil it.

The right hon. Member for Hemel Hempstead (Sir Mike Penning), whom it is a great pleasure to follow, asked earlier what happens if the funds are not forthcoming from those who are still in existence who were responsible. The answer is that there is a mechanism already in place, which is the levy that the Government previously announced. I have no objection to adding insurers to those who are levied, because it is a collective failure on the part of the industry. That is the point. Even if we put on one side debates about cladding, for every one of the buildings that have been discovered to have missing fire breaks, I can guarantee that the plans specified that the fire breaks should be installed, but they were not. As a result, we have a generation of shoddy, unsafe buildings and it is our constituents who are feeling the pain.

Secondly, once we have sorted out who is paying, we really have to find a way of getting the work done. I must say to the Minister that having observed, as we all have, the back-and-forth between managing agents, freeholders, developers and the building safety fund, we can see that that is not a very efficient way to solve the problem. That is why the buildings works agency approach that my hon. Friend the Member for Greenwich and Woolwich (Matthew Pennycook) spoke about earlier is such a good idea. It is a good idea for two reasons. First, we would have a body whose job was to find, fix, fund and then recoup through the levy that we have discussed, which would be quicker. Secondly, it would avoid the stand-offs that are taking place. I have seen one case where the expert advisers to the building owners have said that the zinc cladding on wooden battens is not safe, but the building safety fund has said that it is.

Another reason that the Government should adopt our proposal for a buildings works agency is that it would be the perfect vehicle to review the safety assessment of all of the buildings, which the Secretary of State spoke about last week, and in the end be the referee—the judge and the jury—that says what is safe, what works and what work needs to be done.

My right hon. Friend makes a very good point. We want those we can identify as the responsible owner or freeholder of properties to contribute to and meet the needs of fire safety costs, but we are already looking at the wider development community and at construction products manufacturers to help to ensure that we have sufficient resources to provide relief to leaseholders everywhere.

I join the tributes to Jack Dromey. Our shock is all the greater because we thought that he would always be with us; the whole of his life was dedicated to being there for others, as a representative of workers who was very proud to serve his constituents.

I welcome the statement that the Secretary of State has made today. It represents progress—loans were never going to work; they were unfair. However, my constituents will have listened very carefully to the exchanges between the Secretary of State, my hon. Friend the Member for Sheffield South East (Mr Betts), the Chair of the Select Committee and the hon. Member for Harrow East (Bob Blackman) on the question of liability for non-cladding costs. I have many constituents, as do other Members, whose bill is on the mantelpiece, staring at them. Given that the Secretary of State has offered statutory protection, what are they meant to do with those bills? Can they confidently say, “I do not have to worry about that now, because the Government are going to sort this out”? When he talks about statutory protection, he mentioned protection against forfeiture and eviction. May I add a third risk to that list, which is bankruptcy? That is what many people are facing if they are ever forced to pay these bills that they are not responsible for and cannot afford.

The right hon. Gentleman is absolutely right: such people are not responsible for these problems and in many cases they cannot afford the bills. I would not want to give advice precipitately to any individual at the moment about their particular circumstances without knowing every aspect of their particular circumstances, but it is vital that we move as quickly as possible. What I will want to test with him and others is the efficacy of the legislative solution that we propose to bring forward, because I am confident that it will help enormously, but I want to be in a position where he and others have an opportunity to stress test it, so that we get the best possible protection.

Culture is absolutely vital to levelling up. One thing I was discussing with my right hon. Friend the Secretary of State for Digital, Culture, Media and Sport earlier today was the importance of making sure that more of the Arts Council funding that is currently spent in London and the south-east is spent in the midlands and in the north. Our acting and performing talent is spread equally across this country, but funding and institutions are not. We must do more, and my hon. Friend is absolutely right.

The Secretary of State said earlier that his revised plans to solve the cladding crisis would be published shortly. Will that be before the forthcoming recess? All long-suffering leaseholders in my area want for Christmas is finally to hear that they will not have to pay sums they do not have to fix a problem they are not responsible for.

Many first-time buyers thought that they had bought the home of their dreams, only to discover that it was rendered worthless because they are caught up in the cladding scandal. Earlier this month, one of my constituents received a service charge bill for £103,000 to fix cladding for which they are not responsible, and requesting sums of money that they do not possess. It is reported that the Secretary of State, who I welcome to his post, has been told by the Prime Minister to “sort out” the problem. It is evident to all our constituents affected that the measures that the Government have announced thus far, which I support, are insufficient to bring this nightmare to an end. When will we see a comprehensive plan to help those leaseholders?

The right hon. Gentleman is quite right: there are many people caught up in a terrible situation. That is why we have already spent more than £5 billion of public money on remediating the highest-rise buildings, and we will be bringing forward further proposals to deal with some of the other issues that he identifies. Fundamentally, this issue needs to be brought back into proportion. If we look at what Ken Knight and Judith Hackitt have said, there are far too many lenders and insurers that have been risk averse and have been ascribing zero values to property where no EWS1 form and no remediation, or very little remediation, is necessary. We are working with that sector to make sure that we fix it, and we will.

Of course, we take the risk of electrical fires very seriously, and the Government have taken a number of steps, particularly in the private rental sector, to ensure higher standards than there are today.

I am extremely grateful to the Secretary of State for giving way. He made the point a moment ago that the risk of a fatal fire is very low. Can he therefore explain why thousands and thousands of leaseholders are paying for expensive waking watches, having been told by their local fire services that, unless there is a waking watch, the building will be closed down and all of them will have to leave? There is a clear contradiction between those two positions.

I think the right hon Gentleman makes an important point, and that is one element of the market failure we are seeing today. Waking watches are being used excessively. They can be rip-offs and, in many cases, they can be replaced by modern fire alarms. That is why I created the waking watch relief fund last year, which is assisting with the issue, but has not closed it down entirely. The National Fire Chiefs Council has now produced further guidance, which essentially says that waking watches should be used only in the most exceptional of circumstances, and where they are used, they should be used only for short periods. My right hon. Friend the Home Secretary is taking forward that work with fire and rescue services, and I would like to see most waking watches, barring the most exceptional of circumstances, brought to a close as quickly as possible.

The Bill will deliver improvements across the entire built environment. It will strengthen oversight and protections for residents in high-rise buildings. It will give those residents a greater say and will toughen sanctions against those who threaten safety. Its focus on risk will help owners to manage their buildings better, while giving the home building industry the clear, proportionate framework it needs to deliver more high-quality homes.

Last Saturday, I attended a demonstration at Leeds Dock in which my constituents—leaseholders affected by the scandal—talked about the anxiety, the stress and the potentially crippling financial costs they face if they are asked to pay to fix their homes. They really feel that nothing has changed. Now, had they been able to see Ted Baillieu from Victoria state speak last week, as referred to by the Father of the House, the hon. Member for Worthing West (Sir Peter Bottomley), they would have been blown away by his direct, no-nonsense approach. Those three words—“find, fix, fund”, and then go after the people who are responsible —should be the guiding light of the Government’s approach. My question to Ministers is: when will we see in the UK the kind of comprehensive approach that we are seeing in Victoria in Australia?

I appreciate—we all do—the money that the Government are putting in, but there are so many other faults in buildings apart from unsafe cladding that replacing the cladding will not make them safe. To take one example, the Richmond House fire was just under two years ago. It was below 18 metres, yet we are told that it was the absence of proper cavity barriers and fire breaks that allowed the fire to spread. I say to Members: watch the video. It is absolutely terrifying.

Luckily no one was killed, yet it is precisely fire defects of that sort, which we know are being discovered on countless buildings, that are not covered by the Government’s funding offer, because the Government are funding the removal of dangerous cladding. Ministers know—we have told them time and again—that lease- holders do not have the money to pay to fix those defects. If the defects are not fixed, those buildings will remain classed as unsafe. Presumably if they are a serious risk, they will continue to have waking watch and insurance bills, which will drain the accounts of innocent leaseholders.

My second point is: where is the plan to manage the most dangerous buildings first? At the moment, the order in which they are fixed depends on the speed with which managing agents and freeholders either pay for it themselves or apply to the building safety fund. We do not actually know the full extent of the problem; there is no comprehensive list. Offering 15 years instead of six is fine, but useless, because not a single leaseholder I have spoken to will be able to put the money up and take the risk of suing someone when they might lose after seven years and face another bill. They have enough to worry about at the moment.

I look forward to working with others on a cross-party basis to support amendments to the Bill, so that finally my leaseholders can look at the Bill when it is finished and say, “Right. We have a plan to deal with this”. Then all our constituents can get on with their lives, because that is what they want and what they deserve.
