It is a pleasure to see you in the Chair, Mr Paisley. I thank my hon. Friend the Member for Gower (Tonia Antoniazzi) for securing the debate and for her opening remarks.
I am really pleased to have the opportunity to speak in the debate on behalf of the 140 residents of Dulwich and West Norwood who signed the petition to ban raw sewage discharges, and the thousands of others in my constituency for whom this is an important issue. As a member of the Environmental Audit Committee, I pay tribute to our Chair, the right hon. Member for Ludlow (Philip Dunne), for his commitment and work on this issue over many months.
I recently had the opportunity to visit the River Windrush in Oxfordshire, where a group of local residents have come together as Windrush Against Sewage Pollution in order to take action on the impact on the ecology of the river of Thames Water’s frequent discharges into it. I pay tribute to them for their work, which has been instrumental in the struggle to hold water companies to account for the damage that they cause to health and the environment by discharging raw sewage into our rivers. Windrush Against Sewage Pollution has engaged in citizen science over several years by monitoring the water quality and ecological diversity of the River Windrush. Through such data gathering, the group is able to understand the impact of raw sewage discharge and has discovered that raw sewage discharges are underreported, going undetected by the Environment Agency in as many as 96.5% of cases. All the evidence points to the inadequacy of the Environment Agency’s action on sewage discharge.
On the same visit, we went to a Thames Water treatment works that discharges into the River Windrush. That revealed further issues with the water treatment and monitoring regime that I want to highlight. Specifically, in addition to the problem of frequent undetected and unsanctioned discharges of raw sewage, water companies are not required to measure or treat many substances that are harmful to the environment. Among them are microplastics, which are present both in river discharge and in sewage sludge, which is spread on the land for fertiliser, thereby potentially entering the food chain; antibiotics, at a time when there is a huge race against growing antibiotic resistance; and hormones, which have an impact on the reproduction of fish and other aquatic life.
We have a monitoring, treatment and enforcement framework for wastewater treatment and discharge that is simply not fit for purpose for the serious environmental challenges we face. At the same time, water companies are also failing to invest adequately in their clean water infrastructure. Across my constituency, where ageing water pipes are put under additional strain by hilly topography, there are serious water leaks and bursts every single week. I have been pressing Thames Water for years to invest in the pipe replacement that we need to secure a reliable water supply for local residents and stop the terrible waste of drinking-quality water that occurs whenever there is a leak.
I am pleased that in response to that pressure, the level of investment in my constituency has increased, but we are still far from a plan to replace all the pipes that need replacing. Thames Water still has a serious problem with the quality of its workmanship. Almost without fail, as soon as replacement works finish in my constituency, a new leak occurs because the workmanship is so poor. There have been two such instances in the last three weeks—it happens all the time.
We face a climate emergency and ecological crisis. Nature recovery is a vital part of our response to climate change, and river water quality is critical. Privatised water companies are not fit for the task. They already face competing priorities—the need for investment in both clean water and water treatment infrastructure—and are trying to face in those two different directions at the same time. They also have to face in a third direction: to deliver the returns for which they are under constant pressure from shareholders. That is not a responsible way to run such critical infrastructure, and it simply is not working.
We need the water industry returned to common ownership so that it can focus on delivering functioning clean water infrastructure and be part of the solution to the challenge of nature recovery. Our rivers and communities cannot wait any longer.
It is, as ever, an absolute pleasure to see you in the Chair, Mr Paisley. I thank all hon. Members who have taken part in this heated debate, and those people who signed the petition. Although I really respect the strength of feeling—the passion—in the petition, I want to say at the outset that I believe it was probably started when the social media campaign was whipped up. I am sorry, but a lot of misinformation was indeed spread, so we need to get over that and ensure that it never happens again.
I do understand the passion about this issue, which I think we all share. Quite frankly, I am personally also horrified by a lot of what we have seen. That is why I am so proud that, as an Environment Minister, I have made water quality a priority; indeed, so have this Government. As was so eloquently said by a number of Government Members, particularly my right hon. Friend the Member for Basingstoke (Mrs Miller), we now have a chain of actions that will deal with this. Many of them, of course, are triggered through the world-leading Environment Act. I was sorry, whatever the shadow Minister, the hon. Member for Plymouth, Sutton and Devonport (Luke Pollard), says—I do, as he knows, have great respect for him—that our Labour colleagues did not, in the end, vote to make that law to get water companies to reduce harm from storm sewage overflows. The tables were turned, and for that I am sorry. I think we need to get over that, too, and we all need to move on—
So I am not going to take an intervention on that.
I will also say that the issue is devolved. I thank the hon. Member for Gower (Tonia Antoniazzi) for introducing the debate. As she knows, it is for individual Governments to have their own powers, although Wales joins a great many of the powers in the Act.
I thank the hon. Lady for that; we are at pains to work with the devolved Administrations, because water does not have boundaries. I increasingly want to do exactly that, so I hand out an offer to do more. On misinformation, although I am not defending the quality of our rivers, it is comparable to that of rivers in densely populated areas of Europe.
The storm overflows system is an old Victorian plumbing system, which in many cases is not fit for purpose given our growing population, climate change and the frequent heavy extreme weather incidents that we are getting. Many hon. Members have made reference to the fact that the whole system needs improving.
I have been clear that storm sewage overflows, which are supposed to be for emergency use, are used far too frequently, which is absolutely unacceptable. I have said that frequently. We are the first Government to take decisive action on storm overflows through the Environment Act. I established the storm overflows taskforce to look into the issue and to inform us. I thank my hon. Friend the Member for Keighley (Robbie Moore), who did great work on the Bill Committee, for recognising that.
The petition calls for the elimination of storm overflows, which is a commendable ambition.
The Minister said at the start of her remarks that she thought the petition had probably been started in response to the social media campaign. To clarify, it was started more than six months ago and indeed, the Government published their response to it on 5 May.
I thank the hon. Lady for clarifying. As I said, I share the passion of the people who signed the petition, so I am not arguing about that.
The petition calls for the complete elimination of storm overflows. We need to look at how possible that is and what the function of overflows is in emergency situations. We need to look at the whole issue in the round. The recently published storm overflows evidence project report shed some light on that and the costs that we are looking at. The hon. Member for Plymouth, Sutton and Devonport keeps asking about that, but he can read all about it in an independent survey published on gov.uk. It highlights that the cost of complete elimination would be between £350 billion and £600 billion.
When we are looking at all those things, we also need to consider all the other things that we have to deal with in terms of water, such as phosphates, nitrates and soil in the water. Several right hon. Friends rightly referred to that and how complicated the picture is. We are dealing with it, as we need to.
Work is under way on that timeframe to reduce and potentially eliminate overflows. The hon. Member for Harrow West (Gareth Thomas) made some interesting points about consumer involvement and bringing the public along so that they understand what we are doing. Water companies consult consumers but, of course, that does not change their obligation to meet their requirements and regulations in law.
That is where the Government’s direction to Ofwat, the regulator, is important. We have just produced our draft strategic policy, in which we flagged the issue of storm overflows and reducing the harm for the first time. We also put the environment at the top of the agenda. I am sure we all share the view that that is the right thing to do.
The issue of enforcement has been raised several times. Action is taken and must be taken, but I understand the frustration about how long it can take. The Southern Water enforcement took years, but the fine was £90 million, which sent a clear message. Thames Water has also had some significant fines, but it is now spending £4.4 billion on the Thames Tideway Tunnel. That will be a game changer, rightly treating sewage that goes into the Thames. We have seen progress, although that is not to say that we do not need to go a great deal further.
We have seen some action. The shadow Minister keeps asking, “What is happening now?” There is some action. Yes, we need more, but through the taskforce we instigated a call for action that is happening right now. Importantly, water companies are spending £144 million in additional investment on storm overflows in the period 2020 to 2025, on top of the £3 billion they are already spending on the environment.

The climate emergency is the single biggest issue we face both nationally and globally. In order to prevent the most catastrophic consequences of global warming by limiting the increase to 1.5°, the climate must be a prism through which every political and economic decision is taken, yet it is clear that this Government are very far from where we need them to be in both leadership and action.
COP26 is a critical opportunity to secure a global agreement on the scale of climate action needed to limit global warming to 1.5°, but the UK Government risk squandering the precious opportunity we have as the host nation. There is scant evidence of a concerted diplomatic effort by the UK Government over the past two years to secure the attendance and commitment at COP26 of the most polluting nations, many of which are set to be absent from Glasgow. There is no evidence of a concerted effort to give confidence to the countries of the global south that the UK is committed to a just transition. Cutting UK aid in the run-up to hosting the COP is a disastrous approach to negotiation on carbon reduction measures.
The Government’s approach to the UK’s own net zero challenge is also falling far short. Publishing a net zero strategy at the last minute because hosting COP26 without one would be an international embarrassment is not the act of a Government sufficiently committed to climate action. Continuing to permit the exploration of new oilfields in the North sea and a new coalmine in Cumbria is not the act of a Government sufficiently committed to climate action. Failing to commit anything close to the scale of the investment required to deliver the speed of transition we need is not the act of a Government sufficiently committed to climate action.
In contrast, our local councils are delivering at pace. I am proud of both Lambeth and Southwark Councils, which were among the first in the country to declare a climate emergency and are both making climate action a top priority. But they need both additional resources and powers to make the scale of change that the climate emergency demands, including in relation to the planning system, where tackling the climate emergency must become a core aim.
When I was first elected in 2015, I brought together organisations and individuals in my constituency who care about climate change and we formed an organisation called the Dulwich and West Norwood Climate Coalition. Next week, we will deliver our letter to the Prime Minister ahead of COP26, signed by hundreds of local residents and community organisations. We ask him to secure the agreement we all need to tackle the climate emergency and secure the just transition that we need. My constituents across Dulwich and West Norwood understand the scale and the gravity of the climate emergency. Many are already doing everything they can to reduce carbon emissions. They are desperately looking to the Government to show leadership on the international stage, and secure the scale and ambition of agreement necessary to secure the future of our planet for our children and grandchildren.

Commons ChamberMy hon. Friend makes a very important point. Our peat habitats are vital for our biodiversity, can be a vitally important carbon store and can also help with both drought and flood risk mitigation. We will be dramatically increasing the funds available for peatland restoration. I or one of my ministerial colleagues would of course be delighted to visit his constituency in the High Peak and see some of the work being done there.
We are dramatically increasing the rate of peatland restoration to get to 35,000 hectares by the end of this Parliament. It will be a big feature of the landscape recovery component of our future agriculture policy. We have great ambitions to see the natural hydrology of our deep peat habitats restored.

Commons ChamberMy hon. Friend raises an important point: it is not just those employers with large numbers of staff that could face challenges; it could be those with a very small number of staff, or those with no staff, who operate alone. We are working with the National Farmers Union and others to work out ways to address this issue. It will require friendly and supportive neighbourly behaviour in some cases.
The hon. Lady raises an important point. The Government have given specific guidance to those considered most at risk, including the over-70s. There will be additional support for those with clinical issues that make them especially at risk.

Commons ChamberSince before the EU referendum in 2016, my constituents have been raising concerns that Brexit would mean a watering down of the most important protections we have derived as a consequence of our membership of the EU. Again and again those fears were dismissed. We were told there was nothing to fear, accused of scare- mongering, and told to be quiet. Yet at the first test before them, the Government have failed. They have failed to reassure my constituents at all—failed to make a commitment to keep pace with EU standards and to avoid slipping back. The Government could easily have put a commitment to non-regression into this Bill. There is no reason not to do so. This is not about whether, in any hypothetical scenario, the Government cannot go further and faster than the EU; it is about being certain that we will not slip backwards. This is a fundamental breach of trust and of the commitments that were made both during the referendum campaign and at every stage subsequently by those who argued to leave.
Air pollution is one of the issues of greatest concern to my constituents. We have in Dulwich and West Norwood areas of extremely poor air quality. My constituents have watched with dismay as the Tories have been taken to court three times over illegal levels of air pollution and, instead of reacting with the concern and urgency that such a legal defeat would demand, have chosen to spend public funds unsuccessfully appealing against the court decisions—funds that could have been spent on developing the comprehensive air quality strategy that this country so badly needs. That strategy is still missing from this Bill. Air pollution is a public health emergency. Toxic air affects every organ of the body and contributes to as many as 40,000 premature deaths a year. In this context, it is inexcusable that the Government will not commit in this Bill to meet legally binding WHO targets for particulate matter by 2030.
On plastic pollution, again this Bill contains a woeful lack of ambition and detail.
My hon. Friend speaks eloquently about the very serious challenge that this country faces on air quality. Does she agree that this is a matter not just for London boroughs but for almost every urban area and some rural communities, and that it is one of the most significant threats to public health that is emerging in the 21st century?
I thank my hon. Friend for his intervention. It is a fundamental flaw of the approach that this Government have taken over the past five years that they have again and again pushed responsibility for air quality down to local authorities, forgetting that the circumstances are different in many areas of the country and that it is not within the gift of local authorities to address many sources of air pollution.
The role of plastic pollution in the ecological crisis is profound and devastating. So much single-use plastic is completely unnecessary. The Government could take action to begin the elimination of it now, yet this Bill introduces no bans. I want to draw attention particularly to the role of single-use sachets common across the catering and cosmetics industries. Globally, 855 billion sachets are thrown away every year—enough to wrap the entire surface of the globe in plastic. Replacement materials are available for most sachet packaging that render the use of plastics in sachets completely unnecessary. So I ask the Government to amend the Bill to include provisions under the banner, “Sack the Sachet”, to eliminate this harmful and unnecessary form of plastic pollution.
Finally, I want to address the related issues of biodiversity gain and nature recovery. In relation to biodiversity gain, there are key weaknesses and omissions in this Bill. Biodiversity gains should be protected in perpetuity. National infrastructure should not be exempt from it, and the provisions should cover the private as well as the public sector. I ask the Minister to look again at the proposals for biodiversity gain to ensure that they are comprehensive and genuinely deliver the net improvement that we need to see.
As parliamentary species champion for the common pipistrelle bat, I have similar concerns about the proposals in the Bill for nature recovery strategies. Nature recovery strategies have the capacity to play an important role in restoring habitats and enabling species recovery, but they will do that only if they are deliverable as well as descriptive. That means the Government resourcing local councils to prepare and implement nature recovery strategies. Will the Minister confirm that new burdens funding will be allocated to local authorities, to enable nature recovery strategies to be meaningful for the long term?
The Bill provides an opportunity to demonstrate that the Government are serious about the climate emergency and ecological crisis. As currently drafted, it does not do so, and there are critical weaknesses that, if left unaddressed, will prove to be fundamental flaws. I ask the Government to commit today to ensuring that the Bill cannot result in our regressing from EU standards; to strengthening many of the provisions; and to giving teeth to enforcement. The emergency we face demands nothing less.

Commons ChamberIt has been galling this afternoon to listen to Government Members welcome the environmental commitments in the Gracious Speech as a step change in our commitment to the environment. In reality, those commitments are partial and incomplete, and they sit in the context of a decade of failure and a climate emergency. We already have legally binding carbon reduction targets, and the Government are failing to meet them—indeed, we are currently predicted to miss the fourth and fifth carbon budgets.
The Government are still investing billions of pounds in fossil fuel extraction overseas, when an emergency demands that fossil fuels are kept in the ground. They have announced a paltry package of measures in response to intense public pressure and anxiety about their failure to act. The Gracious Speech ignores the Government’s utter complacency, and nowhere is that more evident than in relation to the built environment. Some 14% of UK carbon emissions come from residential buildings, yet over the past 10 years, the Government have scrapped the zero-carbon homes programme, which means that every new home currently being built is a lost opportunity to deliver carbon reductions.
The removal of subsidies for domestic solar power has all but halted the installation of solar panels by private individual homeowners. The introduction and then closure, just two years later, of the disastrous green deal for retrofitting, means that next to no progress has been made on reducing carbon emissions from existing homes. There is no programme to reduce our reliance on gas to heat our homes, and one in 10 UK households is still living in fuel poverty. Deregulation of the planning system has reduced the quality of many new homes, as well as the quantum of new urban green space being built alongside new homes.
Finally, the Government talk in the Gracious Speech about a world-leading approach, but the UK is already world-leading because of our role in the EU. Within the EU, we have helped to weight the balance of power towards greater ambition on climate change, and we will have helped to push EU states that are reluctant to do more. If we leave the EU, that ability to lead will be lost and the UK will be stuck between a European Union where we have no seat at the table and the America of Donald Trump, one of the greatest climate vandals of our time. Dressing up some minimalist commitments after 10 years of failure and negligence, in a policy context in which whatever we do will be diminished by Brexit, is simply not an adequate response to an emergency.

Commons ChamberThe Government are currently in discussions about a tariff policy in the event of no deal. The options that are open to us are to have tariff rate suspensions, which we are likely to do on goods that we do not produce, and to have autonomous tariff rate quotas or lower applied tariffs. That issue is being considered by the Government and a statutory instrument will be laid before Parliament in due course.
My right hon. Friend the Secretary of State launched the clean air strategy last month alongside the Secretary of State for Health and Social Care. That has been welcomed by the World Health Organisation as an example for the rest of the world to follow. As I referred to earlier, we continue to deliver our £3.5 billion plan to reduce roadside nitrogen dioxide concentrations.
In my constituency, parents, schools and our local councils are working hard together to introduce school streets: timed road closures and a drop-off and pick-up time close to schools to reduce pollution, encourage cycling and walking and increase awareness of the urgent need for action on air pollution and climate change. Will the Secretary of State commit to a fully funded nationwide programme of school streets?

Commons ChamberIn my constituency, we have had a Thames Water leak or burst every single week of the winter. The pipe network is crumbling and causes constant problems, but it is not a surprise. The unforgivable thing about this week’s water supply problems has been the total lack of a robust emergency plan for a situation that anyone could have predicted would occur sooner or later.
Thames Water customers, faced with no water supply, have been unable to contact the company by phone or via the website, and have not had access to up-to-date detailed information, while the distribution of emergency supplies has been delayed, patchy and chaotic. There has been no plan for getting water to customers not already registered as vulnerable, but who are nevertheless unable to carry bottles of water long distances.
Thames Water made pre-tax profits of £638 million last year. There is simply no excuse for not having robust emergency plans in place. The failings this week have been appalling, and they have exposed an organisation that is not fit for purpose. Will the Minister now commit to ensuring automatic compensation for all Thames Water customers who have been without water this week, and to reforming our water industry to ensure its resilience for future emergencies?
I fully understand why the hon. Lady is so angry on behalf of her constituents. It is right that Thames Water is very much under the spotlight, and I am angry with it, too. This is a recurring pattern, but we should recognise that there has been a change of ownership and a change of leadership. I am absolutely determined that Thames Water customers should receive a far better service than they are now receiving.
It is not in my power to compel the water companies to give compensation. However, I can tell the hon. Lady that Thames Water is proactively going around to her constituents door to door in the 5,000 properties affected. It has been working through the problems with the airlocks. [Interruption.] I am just flagging up to the hon. Lady the information that I have received. I know that there was a particular problem with one of its service reservoirs, which it has now fixed, but that has caused further problems along the way.
I will of course make sure that we keep pressing Thames Water because, frankly, it has not delivered what it should be doing. I expect a full review from Ofwat that will particularly focus on its performance.

Commons ChamberMy hon. Friend makes a very important point. Although we need to reduce demand for plastic and increase recycling, plastic does have a role to play in the preservation of fresh produce and in helping us to tackle food waste, which is in itself an environmental and economic mistake.
The hon. Lady is angry on behalf of her constituents, and I share her concern. That is why the chairman of Ofwat, Jonson Cox, has been doing such a good job in holding Thames and other water companies to account. Change is coming, but of course I want it to come faster.

Commons ChamberThe Mayor of London is making huge strides in cleaning up London’s bus fleet, in stark contrast to his predecessor, and he deserves to be recognised for taking this issue seriously while the Government are failing. However, urgent action is needed to tackle HGVs, private cars and other diesel vehicles. Will the Minister now set up a comprehensive plan at a national level, including scrappage schemes, fiscal incentives and urgent investment in research and development to help the Mayor and others to remove the highest polluting vehicles from our roads?
Transport for London had an £11 billion settlement from which it can decide to prioritise certain actions. I do commend the Mayor, who is bringing forward measures more quickly, particularly on buses. We need targeted interventions rather than, perhaps not a sledgehammer, but comprehensive schemes which may not be the best use of taxpayers’ money in tackling this critical issue.
