Commons ChamberThis morning, I learned that a café in my constituency had been broken into for the third time this year. This is not an isolated incident: burglary in Nottinghamshire is up this year, as it was up last year. How much more evidence do we need to get more police on the streets?

Commons ChamberI shall move on to new clause 1. The right hon. Member for Delyn (David Hanson) continues to raise the issue of the safety of retail staff, and I thank him for that. Indeed, I recently discussed that issue with him, and also with the head of the British Retail Consortium. Although the Government fully understand the concern of retailers and their staff about being threatened or attacked if they refuse to sell a corrosive product or bladed article to a member of the public, we do not believe that a new criminal offence as set out in new clauses 1 and 14 would provide additional protection or result in more people being prosecuted. The law already provides the police and Crown Prosecution Service with sufficient powers to prosecute this type of offending and provide protection to retail staff. A number of criminal offences are available to cover a wide range of unacceptable behaviour, including that described in the tabled amendments, ranging from abusive and threatening language to actual violent offences against the person. So, we submit that there is no gap.
A group of women shopworkers came to see me because of regular threatening behaviour by a gang of youths. These women were afraid and fearful, especially when they had to work alone. We have an opportunity today to strengthen the law; it clearly needs strengthening. We should do so.
I am extremely concerned to hear that, but I wonder why the local police are not using the powers already available to them, because if a gang is behaving like that, there are offences that would enable the police to deal with that threatening behaviour, and any violent acts.
The Sentencing Council has set out, in its definitive guideline on assault offences, that it is an “aggravating factor” for an offence to be committed against those who are either working in the public sector or providing a service to the public, and an offence against either group could result in a more severe sentence within the statutory maximum for the offence—and that includes retail and shop staff.
However, there is more to this than the shape of the legislation, as I am sure the right hon. Gentleman would agree. That is why, in October 2017, the National Police Chiefs Council—with the support of Home Office funding—launched the national business crime centre, a repository for good practice, standards and guidance for all business nationally. It also acts as a national alert and data feed service, to enable businesses to have more information regarding crime in their local area.

Commons ChamberMy hon. Friend puts it much better than I did. Last year, the precept was able to raise £270 million. That is a drop in the ocean given that this Government have taken £2.7 billion out of policing over the past eight years. The force in the area of the hon. Member for Clacton (Giles Watling) may have been able to increase numbers from their existing point, but I am sure that they will not have been driven up to the levels that we saw in 2010, and will certainly not account for the level of demand or the cuts that we have experienced.
There are other demands on rural forces—if not unique to them, then certainly more pronounced. From cyber-crime to hate crime, from domestic violence to historical child sexual exploitation, the Government keep stating that crime is falling, but the experience of the police on the ground could not be more different. Nowhere is that more obvious than in non-crime demand that falls on the police. Non-crime demand makes up about 83% of calls to command and control centres, and in rural forces that is likely to be higher. Over the past eight years, because of the sparsity of social, mental health and more general health services, rural police forces have taken on an increased role as an auxiliary social and emergency service. I know of one rural county in northern England which, at the weekend, has one social worker on duty for the entirety of its social services, including for children with learning difficulties and those living with dementia. From 5 o’clock on a Friday, the police are the only service available to fill the gap.
Does my hon. Friend agree that there has been a massive increase in the number of calls to 101 that now go unanswered? That just proves how stretched our police forces are.
There has been the same level of demand from 101 and 999 as, just a few years ago, the police would have experienced only on new year’s eve. As I say, that is coming not only from traditional crime but from the demand on other public services.
This is not only wrong for the police, who are not trained or equipped to deal with the responsibilities of other public services, but, most importantly, wrong for the people struggling with their health needs, who are met with a criminal justice response rather than a health one because the proper provision simply is not available.
The result of all this is that criminals have recognised that our rural communities do not have the protection they need, and they are exploiting that. One reason why we are now hearing calls for all rural police officers to be armed is that the response time is unacceptably high for police and armed officers in significant swathes of the country, but arming all officers fundamentally undermines the principle of policing in this country: to police in communities and by consent.
While all forces experience seasonal variations, the minimum relative to maximum variation, especially for daily crime and antisocial behaviour, is far greater in rural forces with national parks and coastal areas attracting tourism. The seasonality of demand must be recognised, to ensure not only geographic equity but that minimum levels of service can be maintained throughout the year.
Clearly the police funding formula needs to take into account the real picture of demand and pressure facing every police force. We know that the current funding formula is broken. It uses age-old data and does not reflect the needs, demands and pressures on forces, nor the modern demands of policing.

I am terribly sorry that the hon. Gentleman is not going to stay for the entirety of the debate. He regularly contributes to debates on this topic, but rarely stays around for the responses. If he wants to raise the issue of misandry, he is perfectly able to do so. To date, he has not. He has every opportunity, as everybody in the House does, to pursue that. It does not form part of my suggestions today, which are focused on misogyny. There is a power imbalance in society that disproportionately affects women negatively, so I think misogyny should be an exclusive strand of hate crime.
By setting the definition in statute, the Government would put down a marker to say that culturally endemic negative attitudes towards women are not acceptable. The recording of the crime would give a clearer picture of the scale of the issue, assist the police in taking action and intervening, and give women greater confidence that their concerns would be taken seriously. In evidence to the APPG on domestic violence, Women’s Aid said:
“Hate crime law was designed to combat crimes that deny equal respect and dignity to people who are seen as other…That violence is a consequence of sex inequality…That inequality undermines the ability of targeted people to feel safe and secure in society.”
The increasing rates of violence, sexual violence, harassment and disproportionate online abuse towards women show that women are routinely seen as “other”. If we are genuinely to tackle the violence, we must address the root cause—inequality. That certainly seems to be what Baroness Williams of Trafford was hinting at when she said:
“The Government recognise that it is critical to look beyond criminal justice measures and also to focus on what we can do to prevent abuse and violence in the first place.”—[Official Report, House of Lords, 22 November 2017; Vol. 787, c. 481.]
That is the challenge that five police forces around the country—most notably Nottinghamshire police—have set out to address. Their experience of piloting misogyny as a recordable hate crime has led to an increase in reporting.
I have been reading the press reports about this debate with some interest. In Nottinghamshire in 2014, Paddy Tipping presided over the first force to introduce such a crime. As a Nottinghamshire MP, I want to reassure hon. Members that in Nottinghamshire the world has not caved in—far from it. When misogyny and hate crime were included in the force victim satisfaction survey, 94% of victims said they felt reassured and confident in the police. In short, this has been a success.
It is welcome to hear that it has been a success. The police more widely do not seem to object to the extension of the definition of hate crime. The police are looking to the Government to support them in that action and to ensure that appropriate sentencing facilities are available to support any action they might take.
Contrary to media hype, there was not a surge of reports complaining of wolf-whistling, but arrests have been made for public order offences and actual bodily harm incidents that were classed as misogynist. That certainly reflects the experience of my hon. Friend the Member for Ashfield (Gloria De Piero), who claims that the initiative has been a success. There are specially trained officers in place in a city that has two universities, and the change has made positive difference to women, who feel better able to report unwanted attention and receive appropriate support where necessary.
Ultimately, I hope that if we set our laws appropriately, there will be a reduced need for police intervention, because behaviour and culture will evolve to fit the new standard. Dame Lara Cox, who chaired the Fawcett Society sex discrimination law review, said:
“Laws are instruments in changing attitudes, setting the bar for expectations of treatment and behaviour”.
She made the point that our laws are not stagnant and that they must reflect the reality of today’s society.
The reality, as borne out by campaigns such as #EverydaySexism, #goodnightout, #girlsagainst and, more recently, #MeToo, as well as, internationally, #StopStreetHarassment, is that today’s society is awash with misogynistic acts such as groping, sexual comments, upskirting, revenge porn, sexual remarks, leering and stalking. As the nature of harassment changes, so must the laws that govern it, and too many incidents do not meet the criteria for assault, discrimination or public order offences.
The fact that I have had the temerity to call for this debate—this exploration of ideas—has provoked a backlash of vile fury. I have been told that I am in some way a man-hater, that I have no sense of humour and that I should most certainly learn to take a compliment. Because I am not a snowflake, as has been suggested, that has not dissuaded me from continuing to discuss these ideas, but it highlights why women and girls are so often put off from directly challenging behaviour at the time the incidents occur. They are put off from even reporting them, given that the potential response is so aggressive.

Commons ChamberI will give the right hon. Gentleman a bit more time to recover from presenting his excellent ten-minute rule Bill, so I will proceed with my argument.
When shaping the settlement, I spoke personally to every PCC and chief constable in England and Wales. The Home Office collaborated closely with the police’s own demand and resilience review. I am incredibly grateful to frontline officers across the country who gave me their time and very candid opinions during my visits. I also thank Members from all parties who engaged with me on behalf of their local forces.
We heard three messages from that engagement. First, it is very clear that demand on the police has risen, and it has done so in areas of greater complexity and resource intensity. That does not mean that the British public are experiencing more crime. Indeed, the independent crime survey for England and Wales, which our independent statisticians confirm as being the most authoritative data on long-term crime trends, shows that the public’s experience of crime has continued to fall. It is down by almost 40% since 2010. However, police-recorded crime, which is a different thing, has risen significantly since 2015. Again, the independent statisticians are clear that the drivers of that growth include improved police recording of crime, and the fact that more victims of high-harm hidden crimes, such as domestic abuse, modern slavery and child sexual exploitation, are coming forward—
When police cuts are made, it is our poorest communities that suffer most. Lone parents and the unemployed are twice as likely to be burgled as the average person, and the deprived and unemployed are twice as likely to be the victims of violent crime. Do not the police cuts show what side of the argument Conservative Members are on and who they stick up for? It is not the poor, who need the police more.
I beg the hon. Lady’s pardon, but even if I have to shift my geography, I do not think that my argument will change. I hope that she welcomes the fact that Nottinghamshire police will receive £4.5 million more cash in 2017-18 and the statement from her PCC, Paddy Tipping, that he will use that money to recruit more police officers.
My hon. Friend is absolutely right. Despite what the Government like to say, every single Member of this House will have seen frontline cuts to police forces. Two weeks ago, the Leader of the House insisted in this Chamber that
“frontline policing throughout the country as a whole has not changed—it has, in fact, slightly increased since 2010.”—[Official Report, 25 January 2018; Vol. 635, c. 421.]
This has been a familiar refrain throughout the Government’s time in office: “Yes, we are making cuts, but they are having no real impact.”
More than 36,000 101 calls went unanswered or were abandoned in Nottinghamshire last year, which is a 201% increase year on year. Those people needed genuine help, but they did not get it.
My hon. Friend is absolutely right. The number of abandoned calls has increased as the number of calls to 101 and 999 has increased. We now have 21,000 fewer police officers on our streets than there were when Labour left office in 2010, 17,000 fewer police staff, who perform vital functions in investigations, and 6,000 fewer PCSOs. Neighbourhood policing—the absolute bedrock of our model of policing—has been decimated, which is an appalling legacy of this Government. Neighbourhood policing is not just a “nice to have”; it is vital to our policing system and underpins the police’s ability to police by consent. It is almost wholly responsible for building and maintaining relationships with communities, and if we reduce our police to nothing more than a blue light that arrives only when the absolute worst has happened, we risk rolling back all the progress that has been made in police accountability and trust over the last generation.

The hon. Gentleman is right about that. Our constituencies are cheek by jowl. Sadly, in some situations in my surgeries I have been quite disturbed by what young children are hearing or having to explain to adults. Parents who do not speak English are in a painfully difficult position if they cannot get the help that they need and find someone to interpret for them. That is the situation that we want to address today.
At this moment in our history, encouraging greater community cohesion could hardly be more important. The recent European referendum caused quite a lot of community tension and has left many people feeling more separated from those around them. Following the vote, reports of hate crime and racist abuse dramatically increased. For many, the prevailing narrative of the last year has been one of division and discord, regrettably. Now the Government must ensure that the UK becomes a more inclusive, tolerant and united country in which to live.
May I raise a point on behalf of training providers in my constituency, such as Sutton academy? It asked me to raise the importance of making resources available to provide good training. As the right hon. Lady says, good training provides community cohesion, among many other things.
Training is part of it. The hon. Member for Coventry South (Mr Cunningham) has just referred to the additional £10 million that the Government are providing to teach English. If refugees are to be trained, the first step is to train them in a language that they understand. Basic English learning has to be the start point; the training that they need to get a job is stage two. Resources are needed for both.
As the Second Church Estates Commissioner, I cannot miss the opportunity to point out that the Archbishop of Canterbury has said that we must be
“builders of bridges and not barriers”.
That is all of us; that is why we are here today.
English for speakers of other languages—known as ESOL—classes are essential to enable contact and integration, which is critical for building stronger communities. It is therefore essential both for the wellbeing of the refugees and for the population of our country as a whole. We must remember that ESOL funding has improved for some specific groups. In September last year, the Home Secretary pledged £10 million over the next five years in additional ESOL funding, available to refugees who arrive under the vulnerable persons resettlement scheme. Additionally, in July this year, the Home Secretary announced that the Syrian VPRS was to be expanded to include all nationalities affected by the Syrian conflict, because we know it has had an impact on the wider region.

Commons ChamberIt is a pleasure to follow the right hon. Member for Kingston and Surbiton (Sir Edward Davey).
When the national health service was launched in July 1948, it was launched on the basis of three core principles: that it should meet the needs of everyone, that it should be free at the point of delivery, and that it should be based on clinical need and not the ability to pay. Those principles continue to serve us very well; they are supported across the House, and they have been reinforced by the NHS constitution.
The extraordinary success of the NHS and public health provision lies in its delivery of increased life expectancy. Many people who now survive into adulthood would not have done so when I qualified as a doctor, some years ago. However, that extraordinary success hands us the key responsibility and challenge of ensuring that we can continue to provide and to meet the needs of everyone in the coming decades. The right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper) spoke of the importance of joint working across the House. Given that we now have a different parliamentary arithmetic, I agree with her, and I would extend that to the way we talk about funding of health and social care.
Last week I was told by Pauline that her mum, 79-year-old Sheila, who has dementia and heart failure, suffers from seizures and is unable to eat, go to the toilet or dress on her own, has been denied a funded place in a care home. Does the hon. Lady agree that that is a scandal that needs to be resolved?
The hon. Lady has made a very important point. We will all see similar cases in our surgeries. However, we will not resolve the problem by having constant arguments about how we are going to do so. What we must do is agree, across the House, on how we are to provide long-term sustainable funding. I commend the House of Lords Select Committee on the Long-term Sustainability of the NHS for its work on the provision of long-term sustainable funding for health and social care. I welcome the commitment from Ministers in the Gracious Speech to seek sustainable social care solutions, but I call on the Government to extend that to health, because if we continue to view the two systems in isolation, we will fail exactly the patients, and others, to whom the hon. Lady has just referred.
The parliamentary arithmetic is such that there is an additional responsibility on all of us to ask what we can achieve by the end of this Parliament and what we can achieve when the NHS reaches its 70th birthday next year. I would say that by working together we could achieve something really remarkable, and I call on all Members from all parties to work to make that happen.
I also very much welcome the proposals in the draft patient safety Bill, but I put it to the Secretary of State that we need to get to grips with the impact of the workforce challenge across health and social care on patient safety. I agree with others that it is time for us to think again about the impact of the public sector pay cap. There is no doubt in my mind that seven years of the cap are now having a significant impact on morale in the health service and across our wider public sector. Again, I think that the change in the parliamentary arithmetic following the message that we have had from the electorate is very clear. People value our public services and they want to see this matter addressed.
One way in which we can address the issues of recruitment, retention and morale is to deliver a fair pay settlement, and I hope that we can make further progress on that. Again, however, we will achieve the funding that is required for that through realistic cross-party working. During the election campaign, and in the manifesto, we tried to address the issues of intergenerational fairness in funding these services, and it might be that, as we look realistically at how we are going to fund our public services, we need to take ideas from all parties in order to achieve our aims, so that we can do something about public sector pay and improve the retention rates in our health and social care workforce.
Another area of the Queen’s Speech that I want to touch on is mental health, and I should declare a personal interest, in that I am married to an NHS consultant psychiatrist who is also the registrar of the Royal College of Psychiatrists. I very much welcome the fact that we are the party that legislated for parity of esteem, but we now need to translate that into practice. It needs to be translated into ensuring that the welcome extra funding for mental health actually reaches the frontline and delivers.
I am pleased to see the proposals in the Gracious Speech for a Green Paper on children and young people’s mental health, and I hope that the Secretary of State will look at the joint work of the Select Committees on Health and Education in that area and take note of our proposals and suggestions. I also hope that he will look again at the work done by the Health Committee on suicide prevention. Suicide remains the single biggest cause of death in men under the age of 50 and in young people of both sexes. This is a core challenge, and one of the issues that we identified is now in the Government’s proposals—namely, how we involve the families of those with serious mental health challenges in their care and treatment. That does not involve riding roughshod over the important principles of confidentiality. Often, it can involve simple things such as ensuring that mental health professionals are aware of the consensus statement on how to achieve consent.
I welcome the progress that we have made on reducing the use of cells as a place of safety for those with serious mental health problems. Their use is wholly inappropriate and I hope that we can make further progress on that. There is much more that we can do to improve mental health care, but we have some excellent proposals in the five-year forward view. This is all about implementation, and I urge the Secretary of State to do everything he can to ensure that the money reaches the frontline, that there is transparency about that and that we make further progress on improving the mental health of young people and adults alike.
As I was saying, we have gone much further than the European directives have told us to do. My understanding is that the new tobacco control plan will have vaping in it. NHS England has told us that vaping is 95% safer than using cigarettes, and it is not a way to get into cigarettes. Some 2.8 million smokers have voluntarily gone on to vaping, which is 95% safer, and we need to ensure that the action plan for tobacco recognises that fact. More will need to be done to support vaping, perhaps in public places as well.
I declare an interest, as a vaper. Vaping is healthier and safer, but is this not also an issue of social justice? It is far cheaper to vape than to buy cigarettes and, as we know, it is poorer people who are most likely to smoke.
Yes, indeed it is. Some people say that they do not like vaping because the products are produced by tobacco companies, but that is wholly wrong. I have had a running battle with the tobacco companies for decades in this place, and it is wholly wrong to use attitudes to vaping in that way.

Commons ChamberI most certainly do; this is a matter for local police and crime commissioners, but there has been a reduction in the number of complaints against the police when body-worn cameras have been used, because people know that they cannot try it on when there is evidence. These cameras also provide fantastic evidence in court when a police officer is assaulted. There has been a big improvement in the personal protective equipment available for the police, although there has been an issue with procurement, which I am glad the Home Office is looking at. When I see people from the Police Federation, one issue they raise is that officers want to be armed more routinely with Tasers, so that they can protect themselves. There is sometimes a misunderstanding about Tasers, as they are not non-lethal weapons, but less-lethal weapons. Unfortunately, people have died after being tasered, but Tasers are to be used only where the officer faces a lethal threat.
Another piece of police protective equipment that has been in the press recently is the spit guard. It is clear to me that if an officer faces being spat at in the face, they should be able, where appropriate, to use a spit guard. Liberty describes spit guards as “primitive, cruel and degrading”, but what I think is primitive and degrading is a police officer being spat at in the face. Perhaps the hon. Member for Halifax would like to send a copy of the Hansard report of her speech to the Mayor of London, who seems to have the same problem that Liberty has with spit guards.
The quality of training is another issue that police officers raise with me. Our police officers want to do a first-class job, and to do that they need first-class training so that they can do their job safely and well. I see an increased role here for the College of Policing, which currently validates training. That role would include registering officers who work in specialist areas, and providing syllabuses, validation and re-validation. I hope that that will be done under the banner of a royal college of policing, so that our professional police officers have the professional badge that many others working in professions have.
Police officers also raise the issue of police numbers. Does the hon. Gentleman think the last Labour Government were wrong to increase police officer numbers by 14,000?
I think this Government were right to preside over a regime that has seen crime drop to an all-time low, which is why I come on to the subject of budget. All of the things that I have just mentioned and which the hon. Member for Halifax mentioned do require money—there is no getting away from that. This Government have difficult decisions to make about the policing funding formula, which they are currently considering. It is important to remember that, in the last Budget, police funding was protected. The police said that they were grateful for that, and I am pleased that Conservative London Members were able to meet the Chancellor and put their case at this time of unprecedented threat from terrorism. Yes, I accept that the police need money, but as well as money they also need us in this House to give them the tools they need to do their job.
As a Member of Parliament, I stood on a platform of giving the police the tools they need to do their job. We did that in this House with the Psychoactive Substances Act 2016. We have all heard stories from police officers in our constituencies about having to deal with somebody who has taken a novel psychoactive substance, has gone berserk, been impossible to restrain and assaulted them. We provided the police with the tools to do their job there, and we are trying to do so again with the Investigatory Powers Bill. We want to give them the tools to tackle the current technology that criminals are using.
I hope that when the hon. Member for West Ham (Lyn Brown) winds up, she will reflect on how the hon. Member for Hackney North and Stoke Newington (Ms Abbott) came across to police officers when she made a litany of complaints about that Bill at the Dispatch Box yesterday. How will police officers have felt about that when this Government are trying, through that Bill, to give them the tools they need to do their job—the powers that they have asked this Government to provide for them? For my part, I will continue to support our brave police officers, and I know that the hon. Member for Halifax will as well. I will continue to ask the House to give the police the tools they need, and I will support the Government’s amendment tonight, to do our bit to keep our brave police officers safe, so that when those officers face danger, they know that our laws and our politicians are behind them to keep them safe.

Friend is right that, rather than introducing yet more legislation, the Government have been ensuring that we modernise the workplace and that in doing so we modernise the culture around flexible working in particular. It is a shame that the Labour party in government was unable to put in place flexible working. We have set great store by flexible working for all, and ensuring that everybody, regardless of their care responsibilities, has that option available to them.
Under Labour the gender pay gap fell. This morning’s official figures show that it is now on the increase. What are the Government going to do about it?
The hon. Lady will know that under this Government more women are in work than ever before, that the figures show that salaries are rising, and that we are tackling the long-term issue of the gender pay gap by changing the culture in business. Her party failed to do that by not ensuring that flexible working was available for all. We are making sure that a workplace that was designed by men for men is now designed to accommodate women too.

Commons ChamberI absolutely join my hon. Friend in congratulating mumpreneurs and applauding their work. I know that she is a small business woman and knows a great deal about the sector. The figures speak for themselves: in the last quarter we saw a further 27,000 women taking up entrepreneurial roles in our economy, making 1.2 million in total. That is real progress indeed.
There is no board in this country more high-profile than the Cabinet, so what message is being sent to business when only four out of 23 of its members are women?
I take this opportunity to welcome the hon. Lady to her first questions on the Front Bench. I am sure that she will make a good contribution to all our Question Times. She is right that the Government have a huge role to play in setting an example. In my Department we have a significant majority of women in leadership roles. We want to ensure that in future we have even more women not only in Parliament and as Ministers, but in the Cabinet—something on which the Prime Minister has made his thoughts very clear.
