As with most Bills, there are aspects of this one that are to be commended, and others that we can argue about. The Bill contains several measures for which the justification is utterly unclear. In introducing the changes to community orders and to the law of self-defence, the Government seem to be ignoring the importance of judicial discretion, and the changes to immigration law seem very harsh. In my contribution today, I will set out the reasons for my opposition to some provisions in the Bill. I would also like to say, however, that the proposals on single family courts, on drug-driving and on judicial appointments are all excellent. The devil will be in the detail, of course, but so far so good in those areas.

Clause 28 provides for the relaxation of the ban on televising court proceedings by granting the Secretary of State the power to revoke the current rules by order, with the agreement of the Lord Chief Justice. Under the current law, section 41 of the Criminal Justice Act 1925 bans the taking of photographs, portraits and recordings of judges, jurors and witnesses in all civil and criminal proceedings. By removing that ban, I hope that clause 28 will broaden public engagement with the administration of justice, as well as increasing understanding of the judicial process.

Caution must be exercised, however, to ensure that proper parliamentary scrutiny is given to the detail of these plans. It is unclear to me why clause 39 should provide for any secondary legislation setting out the specific circumstances in which the Government intended to allow filming to be subject to the negative resolution procedure, hence greatly limiting the scope for debate on the topic in this place. Many groups, including Liberty, have expressed concern about the possible repercussions that could emanate from allowing for the filming of civil and criminal proceedings in their entirety. That could well lead to additional anxiety for witnesses—and in certain circumstances to some witnesses being less inclined to appear in court—as well as to the alteration of testimony.

The impetus behind the provision is, of course, welcome, but for the reasons that I have set out, the details of the Government’s plans in this area should be set out in primary legislation. If, however, the televising were limited to the judgment, as is the case in Scottish courts, that would add useful transparency and provide assistance to law commentators, to students and to practitioners.

By contrast, the proposed changes to the law on self-defence in clause 30 seem to have no justification. I do not like falling out with the right hon. Member for Berwick-upon-Tweed (Sir Alan Beith)—the esteemed Chair of the Justice Committee, of which I am a member—but I take a different view from him on this. He will know that, under the common law, defendants are able to use reasonable force against an intruder. That defence was put on to the statute book by section 76 of the Criminal Justice and Immigration Act 2008.

The law states that a defendant may use against an intruder an amount of force that he or she believes to be reasonable and proportionate at the time, even if a court subsequently considers that that belief was misplaced. The law as it stands evidently provides sufficient defence for homeowners. Indeed, data from the Crown Prosecution Service show that, between 1990 and 2005, the service prosecuted only 11 cases in which a defendant had been charged under the current law. However, if clause 30 is allowed to go through unamended, it will allow for a defendant to use an amount of force that he or she acknowledges to be disproportionate at the time, provided that the force used is not “grossly disproportionate”.

I have prosecuted and defended many cases involving self-defence, as have other Members, and the existing law has been regarded as perfectly adequate hitherto. If ever I saw a change to the law that would open the door to vigilantism, this is it. In my surgery on Friday last, a farmer came to see me. He was a responsible, middle-aged man, and he told me that three individuals had tried to break into one of his barns to steal a quad bike. There is too much of that kind of thing going on in rural Wales at the moment—but I digress.

The farmer said, “I have a shotgun. What would have happened if I’d aimed and shot above their heads?” I had to put him right on that and he said, “But isn’t there a change in the law?” That is where we are: people think that we are upping the ante. If the purport of the clause is to raise the bar for the police and the CPS in the first place—Justice Ministers have told me that that is the case—I suppose that there is some logic to it, but it could well be dangerous, as my example shows. Ministers do not think that it will change anything in the court and hope that it will lead to the bar being raised in the first place, but as I have said, there is a grave danger that people will take the law into their own hands and believe that it is open season on individuals who roam on their property. The Law Society says that it will end up with greater litigation and that the present law is workable and acceptable.

Clause 31 would put into effect the provisions of schedule 15, which provide for a number of changes to courts’ means of dealing non-custodially with offenders. Part 2 of the schedule would allow courts to defer sentencing so that the offender and victim can partake in restorative justice. This is most welcome. All we need to do, as the right hon. Member for Wythenshawe and Sale East (Paul Goggins) has said, is look at the Northern Ireland model and make sure that the resources are there. It is an excellent step forward and I am pleased with it.

Recent polling conducted by Make Justice Work suggests that 70% of victims believe that they should have the opportunity to communicate with the offender so as to show them the impact of their actions. I think that that is probably right. However, the findings of a poll conducted by the British Crime Survey showed that 69% of victims who were offered a meeting with their perpetrator said no to the opportunity. The onus is now on us as individual politicians and the Ministry of Justice to increase public confidence in any proposed scheme.

The changes introduced in part 7 of schedule 15 are likewise welcomed. If passed, part 7 would ensure that all contracts made between the Secretary of State and probation trusts would require the trusts to make specific provision for female offenders, thus taking into account the particular needs of this demographic group. I pay due regard and tribute to Baroness Corston for the work she has done. The provisions in part 7 were included as a result of a successful non-Government amendment on Third Reading in the other place. I hope that the Government will accept these vital measures in this place.

Other changes proposed by schedule 15 are less welcome. Part 1 would amend section 177 of the Criminal Justice Act 2003 to guarantee that courts imposing community orders must include a mandatory punitive element. This could mean electronic tagging, exclusion orders and so on. I am at a loss to see why the Government are going further down the road of electronic tagging. Actually, I find it baffling, because the Government’s own impact assessment, published in March 2012, acknowledged that the measures could lead to an increase in reoffending as a result of rehabilitative requirements being sacrificed to make way for punitive requirements.

Part 4 of schedule 15 relates to electronic monitoring, on which the Government’s own impact assessment, dated 4 January 2012, suggests that

“the UK evidence points towards a more neutral impact on re-offending”.

It does not work. The current spending on electronic monitoring is £120 million and, as a result of this Bill, it will rise to £360 million for something that does not work—and this from a Government who seek “more for less”. Conversely, the impact assessment observes:

“Research on supervision suggests that the supervisory relationship between the offender and the case manager plays an important role in securing compliance and promoting desistance.”

Why, therefore, are the Government now seeking to privatise that so that trained professionals will not deal face to face with offenders, which is the proper way of doing it? The Government have also proposed major changes to the probation service and I am concerned about the effects they will have.

Clause 20 would revoke a restriction listed in the Senior Courts Act 1981, thus providing for the transfer of immigration judicial review applications from the High Court to the upper tribunal.

The right hon. Gentleman will know that the Scottish Parliament passed a legislative consent motion allowing this House to legislate on its behalf, but clauses 20 and 21 were introduced at a later stage without any consultation with Scottish Ministers. This has caused great upset in the legal fraternity in Scotland, particularly those who are acting and operating in our judicial system and with particular regard to referrals to the Court of Session. Does he agree that the Government should have consulted Scottish Ministers before including clauses 20 and 21 in the Bill?

Absolutely. We always thought that the devolved Administrations were part of the respect agenda and that the Government would consult them. I find it astonishing that that has not happened with regard to such an important matter.

On clause 20, the Immigration Law Practitioners’ Association and Liberty argue that no case has been made for the change, which will impact on almost all immigration and asylum applications. Crucially, the upper tribunal stands charged with not having demonstrated its ability to deal with the UK Border Agency’s conduct in the same way as the High Court has done. ILPA cites examples of UKBA failing to respond quickly to the upper tribunal’s orders and its failure to adequately plead its case as problems that plague many cases.

As a result, the Joint Committee on Human Rights has recommended that the Government insert further provisions into the Bill to make sure that immigration and nationality cases in which human rights such as life, liberty and freedom from torture are at stake continue to be decided by the High Court. I hope that the Government will reconsider that point.

Clause 34 would remove the right of appeal against the refusal of a visa to visit a family member, except on grounds of human rights or race discrimination. I will not retread the ground very well and adequately covered by the right hon. Member for Blackburn (Mr Straw) and others. I fully agree with them and hope that the Government will reconsider the provision, because it could be harsh in the extreme. I also agree with the Law Society and the JCHR, which argue that the measure cannot be passed in the light of the poor quality of so many decisions made by UKBA, as evidenced by the high number of successful appeals against refusals.

There it is—as always, there are some very good things, but there are some pretty poor things as well, and one hopes that many of them will be improved and some deleted in Committee.

It is a pleasure, as always, to follow the right hon. Member for Dwyfor Meirionnydd (Mr Llwyd), although, as will become apparent, I disagree with some of the points he raised. I also declare an interest as a non-practising solicitor.

I wish to direct most of my comments to clause 30, which deals with self-defence by householders in their own homes and by business people whose businesses are part of the accommodation in which they also live—principally, shopkeepers.

As far as I am concerned, this is unfinished business. As the Home Secretary said in her speech, I and a couple of other Government colleagues have in the past tried to change the law to make sure that what is proposed by clause 30 is enacted. I promoted a private Member’s Bill in December 2006, as others had done before me. It had cross-party support, including from the present Attorney-General and my hon. and learned Friend the Member for Harborough (Sir Edward Garnier), the former Solicitor-General, as well as from distinguished Members on the Labour Benches, particularly the right hon. Member for Birkenhead (Mr Field) and—dare I say it?—a very distinguished person in yourself, Mr Deputy Speaker. I therefore congratulate the Home Secretary on introducing this measure.

At present, the test for a householder is to use reasonable force in self-defence, which, I contend, is difficult to define and not easy to enforce. A higher test is required that allows the use of force as long as it is not grossly disproportionate. That will benefit not only the general public but the police and the Crown Prosecution Service, because it will provide them with much clearer guidelines within which to operate.

The example given by the right hon. Member for Dwyfor Meirionnydd would not exempt a person from being prosecuted. We are talking about individuals acting in the heat of the moment. The test is reasonableness—not with the benefit of hindsight, but as it appears at the time.

To lie in wait with a shotgun is not to act in the heat of the moment; it is premeditated. That is not what clause 30 allows.

The only people whom clause 30 will not benefit are the criminals who break the law in the first place.

In considering the clause, it is important to reflect on some statistics. The crime survey for England and Wales for 2010-11 estimates that there were 745,000 burglaries during that period. In approximately 205,000 of those instances, the victims were at home, were aware that the offence was being committed and saw the offender. In approximately 75,000 cases, force or violence was used against the victim.

Those who support the present test often say that it is for a court—a judge and jury—to decide on the facts. However, it can take up to a year, or possibly longer, for a case to reach the courts. During that time, the individual has to put up with the stress and anxiety, especially those who are subsequently found innocent. It cannot be right that people who are going to be found innocent, along with their families, have to endure that anguish. It is therefore important that the law is clarified for people who act honestly and instinctively in self-defence.

The public should know that the law is on their side. Sometimes, it is right and proper that we speak up for the victims of crime and the general public who are on the receiving end of the violence, the figures for which I have just given. Let there be no doubt that we are talking about victims of crime—law-abiding householders, shopkeepers and military personnel living in barracks, because the clause covers the military as well.

It is not surprising that leading and prominent members of the police force support raising the test. The former Metropolitan Police Commissioner, Lord Blair, said on his first day in office, when asked about this issue:

“I thought reasonableness was quite a difficult concept at 4 o’clock in the morning in your kitchen, whereas something as stark as gross disproportionality did seem to me to be clearer.”

He was right. At 4 o’clock in the morning, a householder who is confronted by an intruder is frightened—indeed, he is likely to be petrified. His response will be instant and he will have no regard to reasonableness or otherwise.

Lord Blair’s predecessor, Lord Stevens of Kirkwhelpington, did not mince his words either, saying that

“householders should be presumed to have acted legally, even if a burglar dies, unless there is contrary evidence”.

The present commissioner, Sir Bernard Hogan-Howe, told the BBC that he agreed that homeowners need better protection than is available at present:

“I think, probably, there’s an argument at the moment for making sure that that bar gets higher, and that the homeowner has better protection, and the burglar is put more on notice that they’re at risk if they choose to burgle someone’s home while they’re in it”.

It is important to note that the higher bar is reflected in the guidance for police when arresting people. The test for individuals who claim to have been acting in self-defence was updated only two months ago:

“The changes are driven by the coalition commitment to protect householders and others from unnecessary arrest when they use force in the belief that they are acting in self-defence. The amended Code…sets out that, in order to establish grounds to suspect a person of committing an offence, officers should consider facts and information which tend to indicate the person’s innocence as well as their guilt.”

The Crown Prosecution Service guidance also uses a higher level:

“You are not expected to make fine judgements over the level of force you use in the heat of the moment. So long as you only do what you honestly and instinctively believe is necessary in the heat of the moment, that would be the strongest evidence of you acting lawfully and in self defence.”

It goes on to say:

“If you have acted in reasonable self-defence, as described above, and the intruder dies you will still have acted lawfully.”

Given that the guidance for the people who implement the law—the police and the Crown Prosecution Service—refers to a higher test than that laid down in the present law, it makes sense for us to clarify the law and make it easier to implement, rather than for the implementers to rely on guidance.

There is considerable public demand for this measure. When I introduced my private Member’s Bill in 2006, one of my local newspapers, the Cambridge Evening News, conducted a survey that found that more than 90% of the people who responded were in favour of raising the bar of the test. An ICM poll conducted by The Sunday Telegraph in December 2009 found that 79% of those who took part favoured changing the test from reasonable force to grossly disproportionate force.

A change in the law is not only necessary; it will send out a powerful message. It will tell law-abiding citizens that the law is on their side and not on the side of criminals. It will also show that an Englishman’s home is still his castle.

My hon. Friend has been a member of the Treasury Committee for many years, and he is keen on cutting public spending where it is wasteful. He is right that police and crime commissioners will play a key role in encouraging chief constables who need to do better on this to do so. Indeed, the PCC in his county of Suffolk made practical commitments on reducing bureaucracy, including the idea that the time spent supervising criminals or offenders in detention centres, hospitals and behind desks could be carried out by other staff, not by trained police officers. It is that kind of practical approach that will cut bureaucracy and release police officers to serve on the front line, where we want them.

As a member of the Select Committee on Justice, I recall that some years ago, Jan Berry, the ex-chair of the Police Federation, was appointed to conduct a review of police bureaucracy and identify how it could be cut. She well understood the need for a balance between keeping the spirit of the Police and Criminal Evidence Act 1984 and doing away with needless paperwork. How many of her recommendations have, in fact, been adopted by the Government? If the Minister cannot answer today, will he send me a note—[Interruption.] I do not mean to be offensive, but perhaps he can write and tell me?

I cannot off the top of my head give the right hon. Gentleman the number, but I am pleased to assure him that I have worked closely with Jan Berry, who comes from Kent and still lives there, and has continued to take an interest in police affairs after standing down from the Police Federation. The right hon. Gentleman is right that many of her ideas are extremely good, and I shall write to him with the details.

My hon. Friend is right. One point of bringing extra resource in to support the North Wales police on this issue is to look at the historic allegations and to investigate whether everything was done that needed to be done in respect of following up criminal prosecutions as well as ensuring that all the evidence was taken.

I commend the Home Secretary for her statement today and the urgent action she has taken. I am very pleased that CEOP will be involved and that every extra resource will be there, if necessary. Some of these allegations, however, are not fresh; they were made during the proceedings of the Waterhouse inquiry. I believe that the right hon. Lady is right that a two-strand approach is vital and that the police should get on with it immediately. As to the inquiry itself, if the individual looking into it says, as others have said here today, that we need a further, overarching public inquiry, will the Home Secretary agree to it?

As I set out in my statement, we intend to discuss with various parts of Parliament, including Select Committees such as the European Scrutiny Committee, by what process the House should vote on this issue. We will come back to the House in due course with proposals on how it can express its view on this significant issue of justice and home affairs powers—namely, the package of measures that we might wish to opt into when the time comes.

Many of the crimes considered most serious by any normal standard are international in type, including the trafficking of drugs and of people, including children, and banking and corporate fraud. Bearing that in mind, does the Home Secretary truly believe that it is in the interests of justice to opt out of scores of cross-border EU justice measures not knowing if and when future opt-ins will succeed?

As I have made clear, it is not open to us to opt out of individual measures. The last Government negotiated a block opt-out, with a right to opt into certain measures following negotiation with the Commission and member states. We intend to follow that process.

The right hon. Gentleman talks about cross-border crime, which is significant. The drugs that are being peddled on the streets and lead to petty crime are being brought across the border by organised crime gangs. That is why we are setting up the National Crime Agency, which will include a border policing command and will have an enhanced ability to deal with serious and organised crime.

I think the way that my hon. Friend puts that is exactly right. I have experience of that in my constituency and by dealing with those people who abuse the regime and the hospitality of the settled community we will make the settled community more welcoming of those who are genuine Travellers. In that way, both parts of the community can live in harmony.

Over the past couple of years there has been a huge increase in theft from rural premises, rural businesses, farms and domestic properties, particularly of metal, fuel and implements. The Minister cannot get away with simply saying that the police commissioners will sort it out. What initiatives has his Department been following for the past couple of years?

I repeat what I said about police and crime commissioner elections meaning that the police will be more responsive to the important issues raised, because they will be able to raise them with chief constables on behalf of rural communities. We have been considering some of those important issues at a national level, for example through the plant and agricultural national intelligence unit that has been set up, to ensure that we deal more effectively with some of the crimes that are common across the country in rural areas on both a local and national level.

I thank my hon. Friend for raising that issue. The persistency of an offence is a factor that should be taken into account when looking at the seriousness of it. Perhaps I can attempt to give the hon. Member for Walthamstow some indication on these matters. My hon. Friend raises the issue of someone persistently undertaking the offence of stalking, and we hope to reach a situation in which early examples, or early behaviour, of stalking can be identified, captured and therefore dealt with through the lower level offence before it moves on to stalking behaviour—the more serious offence that is set out in proposed section 4A.

We do take stalking very seriously, however, and we are determined to do all we can to stamp it out. We have created the two new offences, explicitly putting stalking on the statute book for the first time; we are giving the police the powers of entry that they need to disrupt stalkers at an early stage; and we have responded to the concerns of victims and of victims’ organisations by making it clear that behaviour which ruins lives will be properly punished. I think that those changes will make a real difference to the lives of victims, and I commend the Lords amendments and the Government’s amendments to those amendments to the House.

It is a pleasure to follow the Home Secretary and the hon. Member for Walthamstow (Stella Creasy) in what is a very interesting debate.

Some 10 months ago I set up an all-party committee covering both Houses, including Members from all parties and none, by which I mean it included Cross Benchers from the other place as well. The hon. Member for South Swindon (Mr Buckland) played a very active part in the committee’s deliberations and is to be commended on the hard work that he put in.

We looked at the whole issue of a stand-alone offence of stalking, something that I have long believed to be a necessary tool in the criminal justice armoury. We were helped immensely by Laura Richards of Protection Against Stalking and by Harry Fletcher of the National Association of Probation Officers, to whom we as a committee are very grateful. The researcher Delyth Jewell also did a sterling piece of work in clerking the committee.

We took evidence from July last year, and we are indebted to those who came and gave of their time to provide evidence to us. I think in particular of the victims and the victims’ families. It took a great deal of bravery to relate some of their accounts. Many were harrowing, almost beyond belief and ended, as the Home Secretary said of her constituent, in death. They were awful situations, so we are indebted to those individuals, because they came before the committee and their evidence has convinced us all that this is an urgent matter that needs to be put right.

We took evidence from lawyers, who said that there was a lacuna in the current law. I was a Member in 1997 when the Protection from Harassment Act became law, and we thought it a fairly decent piece of legislation. Indeed, by and large it has been and has dealt with a great range of offences, but on the particular offence of stalking in large parts it has not fit the bill. The lawyers told us that they, too, thought we needed to consider a separate offence of stalking.

I agree with the Home Secretary that some police officers are very good at pursuing stalking through the provisions in the 1997 Act, but I am afraid—I say this as the brother and the son of police officers; I do not have any great beef with the police generally—that the vast majority cannot handle the problem, hence the fact that 72% to 75% of those surveyed reported that they were very dissatisfied with the police action taken. That is partly to do with complications in the provisions and partly to do with the new form of the offence, which often involves e-transmissions of some kind, and so on. It is also due to a lack of specific training, which is extremely urgent in this context.

We took evidence from psychologists who advised us that in many instances it is possible to address such offending behaviour. It is vital, in the case of individuals who would be subject to new section 4A and sent away for a period of incarceration, but also in the case of those subject to new section 2A, who would not be, that criminal psychologists get involved fairly soon in order to divert them from their behaviour, because, by its very nature and essence, stalking is an obsessive, often repeat, offence that goes on and on. We heard examples of individuals in prison who were planning the next stalking venture from their prison cell.

I am advised by Laura Richards, in particular, that about 20 to 25 practitioners in the UK are able to diagnose and, in large part, deal with stalking behaviour and divert offenders away from it. That is important, because otherwise all we will do is take them off the streets for a while and then they will be back. Whether they have committed a 2A or a 4A offence, it is vital that we make available the necessary specialist clinical services to deal with them. I am no psychologist and I am not medically qualified, but I know that they often have behavioural, as opposed to psychological, problems. People are trained to help them address that, and their expertise must be used to ensure that we have a proper, tough regime to deal with these awful offenders.

The right hon. Gentleman touches on an important point. The danger is that, whatever the penalties may be, these people come out of prison and carry on committing the same offence, because they are obsessive to the point that whatever action is taken against them, they will keep on doing it and ruining people’s lives.

The hon. Gentleman is absolutely right. By its nature, that is the kind of offence that it is, and that is how it ruins people’s lives. I have spoken to many victims who say that it is almost like having a black cloud behind them day and night, and they have to turn around every now and then to make sure that the person is not there. It is an awful situation to be in. I believe that the Bill deals with the problem in large part, if not completely; there are one or two things that I would like to discuss. I am in sympathy with some, but not all of the points raised by the hon. Member for Walthamstow.

We suggested in our report that the offence should be one that is capable of being tried either way, but to be fair to the Home Secretary, she has clearly expanded on how the Government are now looking at this. Although I would argue that stalking is never a minor offence, there are more serious initial offences. It will be partly to do with whether the person has been before the courts before for a similar offence involving a different victim or the same one. My fears are allayed, to a certain extent, by what the Home Secretary said, although we did recommend, as I said, that the offence should be triable either way, as the 4A offence would be.

Following lobbying by NAPO and Protection Against Stalking, Lord Henley announced in the other place an amendment to the wording of the amendment to include psychological harm. I welcome that amendment to the amendment—it is almost like an extension to the extension—because that is crucial. When I had the privilege of meeting the Prime Minister to discuss this, two young women were there who had given us evidence, both of whom would not necessarily fall into the physical harm category but into the psychological damage category. One young woman has received therapy for the past 10 years because of stalking. I am pleased that that element is now included. In effect, it completes the circle.

It was put to me earlier today by senior police officers that one reason why the police have got more effective at tackling domestic violence is that more women police officers have come into the force. Did the right hon. Gentleman’s inquiry find a link between stalking being treated effectively and the involvement of female police officers?

The right hon. Gentleman makes a good point. We took evidence from several police officers, among whom were several knowledgeable females, who had been training their respective forces. Given that we now have a large number of good senior and junior police officers who are women, it will hopefully be more straightforward to put this legislation into effect than the 1997 Act.

I had come here to argue that the inquiry wanted a single indictable, either-way gateway. However, I am persuaded by what the Home Secretary said. I do not disagree with her analysis of new sections 2A and 4A of the 1997 Act. Hopefully, there will be such discretion for the police. When a repeat offender under new section 2A comes up again, he will clearly be a customer for new section 4A. It is extremely important that that is understood. Searches without warrant will happen under new section 4A, but not under new section 2A. I still believe that that power would have been helpful under new section 2A as well, because the police tell us that the earlier we move in on such people, the better the outcome is likely to be.

Whatever legislation we enact, it is crucial that the police, prosecutors—particularly those within the Crown Prosecution Service—judges and magistrates are trained and instructed properly, through various courses, on the necessary approach to this awful offence.

I know that other Members wish to speak, so I will curtail my remarks, but I first wish to put various questions on the record. I do not realistically expect the Home Secretary, or indeed any Minister, to respond to them all this evening, but I hope she will agree to respond in writing in due course.

My first question is whether there will be a consultation with NAPO, Protection Against Stalking and other stakeholders on the interpretation by police and prosecutors of the list of stalking behaviour contained in new section 2A. I agree that “inter alia” is otiose in the circumstances. There will be a review of the behaviour covered, so the point is dealt with without our having to discuss amendment (a).

Will there be an ongoing discussion about the need for improved victim advocacy, which is vital? I can say without breaching any confidences that the Prime Minister also took the view that that was vital. Will there be a full consultation with PAS, NAPO and other stakeholders on the implementation of the new sections of the 1997 Act? The Home Secretary said that there would be an annual review, which seems to me to provide a vehicle for including those stakeholders.

Will the impact of the new sections on police practice and prosecutions be monitored once they become law later this year? Will there be a full consultation with PAS, NAPO and other stakeholders on the interpretation of the definitions of “fear of violence” and of psychological harm involving serious alarm and distress, and will those definitions be set out in guidelines or training?

Will it be possible to monitor the impact of evidence being seized because of the need for the police to obtain a warrant for a perpetrator’s arrest prior to their property being searched under new section 2A? I was going to ask whether there would be consultation on the guidelines for prosecutors, to ensure that persistent stalkers are charged under new sections 2A and 4A, but that has been dealt with, so I need not bother the Home Secretary with it.

I ask the Government to facilitate the treatment of offenders in such a way that as many as practicable can be diverted away from their offending behaviour. Appropriate courses need to be put in place for police, Crown prosecutors, judges, magistrates and probation officers, to ensure that they are thoroughly trained up. I mention Crown prosecutors because the Crown Prosecution Service has now put together a package to deal with the new legislation. Unfortunately, it will deal only with e-crime, not with crimes in general. I believe that that mistake needs to be put right.

The right hon. Gentleman has asked a number of detailed questions, and I will be happy to get back to him in writing. We have had very good consultation and a very good relationship with NAPO and Protection Against Stalking in developing the Bill, and I expect to continue to have good consultations and discussions with them as we take the matter forward.

On the issue of perpetrators, the aim of reducing reoffending lies behind the rehabilitation work that the Ministry of Justice is doing, and I will certainly bring the right hon. Gentleman’s comments to the attention of the Secretary of State for Justice.

I am grateful to the right hon. Lady for that assurance, which I take to be an invitation to write to her. I had another seven or eight questions, but I shall not labour the House with them this evening.

Before I sit down and allow others to take the matter further, may I once more express my sincere gratitude to all the parliamentarians who took part in the research work? I think this may be the only time when a cross-party group that is not a Committee of the House has succeeded in bringing forward a change in the law. I do not know how often that will happen, but it is certainly a precedent that I favour—I would say that, wouldn’t I?

I wish again to say how grateful we are to Laura Richards of PAS and Harry Fletcher of NAPO, and to all the victims who assisted us by giving evidence. I am also very grateful to the Home Secretary, because I know she has been on the side of the angels on this issue for some time. I am sure she shares my pleasure in the fact that something positive is now being done.

The Bill’s provisions on stalking show that the Government have carried out a listening exercise, and we will now have firm laws. They will prevent lives from being ruined and, crucially, from being lost. They represent an important change in the law, and I have been privileged to play a part in achieving it. The inquiry has been the most enriching and worthwhile experience of my political life, and I am delighted to see the result.

I will not repeat the constructive comments of the right hon. Member for Dwyfor Meirionnydd (Mr Llwyd) and others on the provisions that all parties have accepted. I am delighted to have been part of the process, but hope that does not give me, as a relatively new Member, a false sense of what can be achieved so quickly by consensus. The Government have moved with speed and with willingness to listen, and I commend their fleetness of foot. I am grateful to them for acting and amending their own amendments. That shows their willingness to listen to the debate and to engage with NAPO and Protection Against Stalking, to which I pay tribute.

The journey does not end here. Once the Bill is passed, it is essential that we get training for police officers and guidance for prosecutors absolutely right and monitor the progress of the new laws. Stalking is emotional terrorism; it is a crime of control, a crime of manipulation and, yes, a crime of violence. It was quite clear from the evidence heard by the all-party inquiry heard these changes to the law were necessary. I started as somebody who was not convinced that the law should be changed, but I ended as somebody who was entirely persuaded. I commend the Government’s amendments to the House.

I am clear that there will be enough police on the streets to do the job that we and the public want them to do, and that police officers want to do. I say to any other Opposition Member who wants to make a similar point that I listened to the previous statement and it is now absolutely clear that the Labour party has abandoned any pretence of having a credible policy to deal with the deficit.

The Prime Minister said this morning that, all of sudden, the Met could turn out 16,000 people in a day, rather than the previous 6,000 or whatever the figure was. That does not take into account all the other policemen and women from all the other forces. How many Met police were in fact turned out, and how many came from other forces?

A significant number did indeed come from other forces. I do not want to give the right hon. Gentleman figures that are incorrect, so I will get the precise figures for him. It is right that the 16,000 figure that the Prime Minister spoke about included mutual aid from other forces. I pay tribute to all the forces around the United Kingdom that have been willing to provide support and trained police support units.

Is the Minister aware of a campaign with which I am involved to introduce changes to the Protection From Harassment Act 1997 in respect of cyber-stalking? Many young women and girls are terrified by what is happening to them day after day and the law needs changing. Will the Minister meet a small group to discuss where the law is failing and where we need to put it right?

I have to say to the right hon. Lady that her intervention and that of the hon. Member for Rhondda betray the difficulty that the Labour party has had, both in government and in opposition, with this issue of front-line services. Chief constables such as Chief Constable Steve Finnigan have said that they are determined to protect the front-line service that is provided to members of the public. There is a difference between the service that can be provided and the number of police who are there, and the trouble with Labour is that it has always focused on numbers. What we have seen recently is that there are great variations in, for example, invisibility and availability of the police who are out there on the streets being seen by members of the public. Percentages can vary from 9% of police being available and visible to the public to 17%, as in Merseyside. If that highest figure was followed by every force, then just under 8,000 more officers would be visible and available to members of the public. This is about the efficient use of resources. Police and crime commissioners, as I have said, will bring accountability to local policing.

If the hon. Gentleman will forgive me, I am conscious of time and wish to make a little more progress.

The Opposition’s scepticism about the merits of directly elected police and crime commissioners will be tested when it comes to deciding whether to field candidates for the elections next year. Indeed, according to media reports, the former Home Secretary, Jacqui Smith, intends to run as a candidate. Before moving on, I would like to make it clear that responsibility for policing and policing governance in Wales is reserved to this House. This House has determined that the provisions for police and crime commissioners should be implemented in Wales and in England. There cannot be two tiers of governance for a police service whose officers and assets so regularly cross the regional boundary between England and Wales in tackling crime.

The right hon. Gentleman may wish to intervene after I have completed my point about the vote that took place in the National Assembly for Wales. I think that it is regrettable that the Assembly did not agree to the legislative consent motion that would have allowed police and crime panels to reflect the unique nature of local government in Wales, as we wanted. That would have included giving the Welsh Assembly Government a seat on the police and crime panels in Wales.

The reason why Assembly Members did not endorse it is quite simply because they do not believe in the idea of a directly elected police commissioner. They did not want the panels and so voted against the proposal. Unfortunately, this place decided to ride roughshod over their wishes and the wishes of democratically elected people in Wales, thus showing little of the respect agenda and acting in a hugely undemocratic way.

That is not correct. It is precisely because we respect the Assembly’s decision that we are removing police and crime panels from local government structures in Wales. The Assembly had the opportunity to put in place a legislative consent motion that would have enabled that to take place. Such a motion was tabled by the Welsh Assembly Government, but they then chose not to support it, even though they had put it forward. As a result, the view of the Welsh Assembly was that police and crime panels should not form part of the local government structure in Wales. Instead, the PCPs will be freestanding bodies.

I want to make it clear that in taking a power to appoint those freestanding bodies I will not be telling, instructing or forcing any authority to do anything. I will invite local authorities to nominate a member to the PCP for each force area, and if an authority fails to nominate a member, I will invite members directly while having regard to the political balance within the force area. I think that the amendments will ensure that the appropriate checks and balances on police and crime commissioners can apply in all force areas in England and in Wales.

Those of us who argued against the 2003 Act did so on the basis that 24-hour drinking would not introduce a café society to the UK where youngsters sipped wine into the early hours discussing Baudelaire, and the only thing that the Act has done is to move yobbishness, drunkenness and violence from late nights to early mornings.

The hon. Gentleman makes a very important point, and it will be interesting to hear whether the former licensing Minister, the hon. Member for Bradford South (Mr Sutcliffe), who is now on the shadow Front Bench, will be able to explain why that café culture, which was supposed to be created as a result of the previous Government’s reforms, has perhaps not arisen. In reality, we have seen an increase of about 65% in the number of hospital admissions linked to alcohol over the five years to 2008-09, and that is why we think that reforms are required.
