First, I did not hit Muralitharan for six. Secondly, I think he was being quite gentle with me. I certainly could not read which way the ball was going to go and I was fairly lucky to hit it at all. He made a good point that a huge amount of progress has been made in terms of peace, stability and economic prosperity. His organisation is bringing together Tamils, Sinhalese and others to help forge the country together. He is doing amazing work and we should back that work. He also thought I was right to attend and to raise these issues. What he wants, as a proud Sri Lankan, is to ensure that a fair picture is painted of his country, and he is right to say that.

The Prime Minister clearly succeeded in raising concerns about human rights in Sri Lanka. At the Commonwealth summit, did he or his officials get the chance to raise, with the Government of Bangladesh, our Government’s wish for them to address concerns about the International Crimes Tribunal in Bangladesh, the upholding of fair trial standards and the use of the death penalty for those convicted?

What I want to see are more jobs in this country, and that means making sure we keep our flexible work force. What the hon. Gentleman did not tell us, of course, is that he chairs the Unite group of Labour MPs. Perhaps he ought to declare that when he stands up. While he is at it, perhaps he could have a word with Mr McCluskey and say that we need a proper inquiry into what happened in Unite and a proper inquiry into what happened in Grangemouth, because we all know that the leader of the Labour party is too weak to do it himself.

Q11. The economy has grown 1.5% in the past six months, during which time in the Chippenham constituency the number of jobseekers has fallen by a fifth. Raising living standards requires greater productivity from a work force who are highly skilled, but in Chippenham hopes were dashed five years ago when the national college building programme ran out of money. Will the Prime Minister join me in backing Wiltshire college’s bid to the Skills Funding Agency to rebuild our Chippenham campus to make it fit for local students to gain the skills that employers demand?

I very much agree with what my hon. Friend says. We all remember the huge disappointment when Labour’s planned investment in so many of our colleges collapsed. I saw exactly the same thing at Abingdon and Witney college, and it is this Government who are now putting the money in to see that expansion and improvement and to put quality colleges in place. I am sure that that can happen in Wiltshire as well as in Witney.

The Cabinet Office is not devoting any money from local authorities. Every week the hon. Lady pops up to talk about cuts in her constituency, but she never asks any tough questions of her local authority about the priorities it sets. The Cabinet Office has taken over responsibility for youth policy, and part of what we will be doing is working with local authorities across the country that want to think creatively about how they continue to deliver really value-added youth services.

It was a privilege to meet participants in the National Citizen Service in Wiltshire last month. They told me that they got the opportunity to work with people on social action projects whom they would not otherwise have met. Does the Minister agree that the value of the initiative depends on its ability to continue to draw participants from all backgrounds?

My hon. Friend makes a hugely important point. The social mix is fundamental to the value of NCS, because it is about giving young people opportunities to meet and spend time together that they would not otherwise have, and they value that enormously. We pay by results when it comes to providers delivering that, and we monitor it obsessively.

First, the hon. Gentleman has to be clear about what is and what is not a tax. Before our changes, there was a subsidy for people who had additional rooms they were not using, and we believe that it is fair to have the same rules in private sector rented accommodation and in council accommodation. The question is now for Labour. You have ranted and raved about the spare room subsidy. Are you going to reverse it? Just nod. Are you going to reverse it? Yes or no? Absolutely nothing to say, and weak with it.

It is no trivial decision for people to up sticks and leave their home and country, fleeing for their own safety. How many people must have left Syria before it is impossible for its regime to declare any kind of moral entitlement to govern that country?

I do not believe that the regime has any legitimacy. The way it has treated its own people—bombing and maiming its own citizens, and now the use of chemical weapons—means that I see it as a completely illegitimate regime. What we now have to do is bring every pressure to bear for a transition so we can end up with Syria in totally different hands. That is what is required.

The hon. Gentleman makes a good point that will be noticed outside the House.

I appeal to Government Members to look closely at the amendment and ask themselves what is wrong with the safeguard it proposes. Surely the UN weapons inspectors must be able to conclude their mission and have the necessary opportunity to report to the Security Council on the evidence and their findings on whether chemical weapons were used in Syria. Surely we must have definitive evidence that the Syrian regime or opposition was responsible for the use of these weapons—with the greatest respect, that means not just two pages of A4 paper. Surely the UN Security Council must consider and vote on this matter in the light of the reports of the weapons inspectors and the evidence submitted. Surely there must be a clear legal basis in international law for taking collective military action to protect the Syrian people on humanitarian grounds. And surely the aims, objectives and consequences of any intervention must be made clear and must not run the risk of escalating the conflict, causing further deaths and worsening the humanitarian situation. The safeguards in the amendment are absolutely clear and will bring the issue back for a parliamentary vote before any UK military intervention is possible. Should these safeguards not be satisfied, the Scottish National party and Plaid Cymru will vote against intervention, just as we voted consistently against the Iraq war.

I urge the UK Government to invest more time and effort in supporting an end to the conflict and stepping up humanitarian support for the hundreds of thousands of victims in Syria and refugees who have fled to neighbouring countries. Earlier today, I met Jehangir Malik of Islamic Relief, an organisation that deserves as much assistance as possible to help people in and around Syria. He warned about the potential negative impact of military intervention and why that could significantly worsen the humanitarian situation. May I urge the Government to do yet more to support Islamic Relief and the other organisations involved in the Disasters Emergency Committee? With so many people watching our deliberations, I also urge the public to continue their great generosity in supporting humanitarian efforts.

I also urge the Government to renew their efforts to find a diplomatic resolution to the conflict. Do we think that Tomahawk cruise missiles fired into Syria will make that easier or more difficult? It is clearly understood that this civil war is intractable and that there is little willingness to compromise. Earlier today, I heard an appeal by Sakhr al-Makhadhi, the London-based Syria expert and commentator. He said that the people of Syria, from all backgrounds, are crying out for help to resolve the civil war. Please can the UK Government focus their attention on working with the United States and the Russian Federation, and all others who have influence in the region, including Iran, to bring the different Syrian sides to the negotiating table?

In conclusion, the UK Government must not have a blank cheque for military intervention in Syria. We have already heard that it is being briefed that tonight’s vote on their motion is an agreement, in principle, for military action. We should not give them a blank cheque for military intervention in Syria, either in principle or in practice.

I have only 30 seconds left.

We cannot ignore the lessons of the calamitous Iraq war. We need safeguards, in order to ensure that all is done to provide evidence about chemical weapons and to support the United Nations and international law. We need a coherent and comprehensive strategy that fully takes into account the consequences of intervention. What is currently a calamity for the people of Syria could worsen and become a conflagration across the middle east. That is why this House should unite around the cross-party safeguards amendment, vote against the Government motion, and make diplomatic and humanitarian efforts the key focus of the international community.

What the hon. Gentleman will see if he looks at it closely is that the European starting position is that there will be an exception for audiovisual services, which has been in place for all free trade agreements we have made as a European Union with countries around the world. Uniquely, there is an opportunity, if we want it, to add it back in. Personally, I think that the British film and television industry is immensely strong and I do not think that our tax credit system is in any way an unfair subsidy. We should be proud of collaborations between Britain and Hollywood. This subject was much discussed, including which member of the G8 liked what French film.

I congratulate the Prime Minister on securing agreement on land in the declaration he cited earlier this afternoon. Will he support measures to increase the transparency of land deals done around the world by companies based in the United Kingdom, thereby getting our own house in order?

I am grateful to my hon. Friend for his question. Clearly, the register of beneficial ownership will help with this issue, because companies will have to declare who owns them. That will be one way that tax authorities in developing countries, for example, will be able to ensure that bribes are not paid and so on. That is part of the point of the register.

I have some good news for the hon. Gentleman: because of the lead we have taken at the G8 and the new changes in the European Union, the Crown dependencies and overseas territories have all agreed to share proper tax information with the UK. That is quite an important breakthrough in ensuring that we have a fairer tax system.

No doubt the Prime Minister intends the exploitation of European shale gas reserves to replace our dependency on imports of liquefied natural gas from unpredictable parts of the world. How does he propose to stop it crowding out investment in domestic sources of energy, notably renewables, which result in far fewer carbon emissions?

I am not a protectionist; I do not believe that the aim of policy should be to cut off the access that Britain has to liquefied natural gas, whether it is coming from Qatar or anywhere else. What we want is a competitive energy market where consumers can benefit from competition and low prices, but we also want security of supply. That is why it makes sense to look at shale gas, as well as imported gas, gas from the North sea, and the renewable technologies. We should be open to all these technologies, rather than simply trying to pick winners.

The hon. Gentleman makes an important point, and he gives me the opportunity to praise President Banda for what she is doing to lift people out of poverty in Malawi, and to thank her for visiting Britain and Scotland this week. The hon. Gentleman makes an important point about slavery, because there is still modern-day slavery and we still need to take action to combat it at European level, at national level and at local level with the police. This Government will continue to take that action.

Q11. Whatever further changes the Chancellor announces today, the payslips of ordinary working people will show a tax cut next month as a result of the personal allowance rise that the Liberal Democrats called for. It represents the largest single income tax change in this Parliament. What does this say about the priorities of my right hon. Friend the Prime Minister’s coalition Government?

This is an important priority that we have taken action on in Budget after Budget, even in difficult times, saying to people, “We are on your side. We want to cut your tax bills.” In just two weeks’ time there will be a tax cut of over £200 for 24 million people in our country—each and every taxpayer. At the same time, we are lifting over 2 million people out of tax—they will not pay any income tax at all. This is real progress and it is on the side of the people who work hard and want to get on.

Days after the coalition Government came to office, we introduced strict controls on ICT spend that saved the taxpayer £316 million last year alone, a figure verified by the National Audit Office. We have opened up procurement to small and medium-sized enterprises, we are moving towards open standards and interoperability, and we are reopening some of the incredibly expensive and burdensome ICT contracts that we inherited from the previous Government, with a view to making significant further savings. There is much more that can be done, and much more that we will do.

I thank the Minister for that answer and welcome those actions. I also thank him for visiting Ark Continuity in my constituency, a company whose data centres make cloud computing possible. There are myriad data centres in local and national Government and in the wider public sector, and there are huge savings to be made. Will the Minister target this area in searching for ways to save the taxpayer money?

I enjoyed my visit with my hon. Friend to Ark Continuity. It was very illuminating. There is a huge amount we can do. Data centre capacity across Government is massively underused. A huge amount of overcapacity was left in place by the outgoing Government, who had no interest in these subjects at all. We are getting to grips with it, however. We need to do more, and we will do so; there is much more money we can save.

I congratulate my hon. Friend the Member for Congleton (Fiona Bruce) on her speech. I want to speak briefly as the Member of Parliament for the Preston Down Trust. It is not in Lancashire, but in Paignton in Devon.

It is right that organisations must demonstrate public benefit, but the key is the clarity with which the Charity Commission interprets public benefit. There are three organisations near Preston Down road, which is where the name of the Preston Down Trust probably came from. One is an evangelical Christian charity, Anode, which gives furniture to people who require it. Another is Preston Baptist church, which offers a place for services and has a cafeteria where people are charged for cakes and tea. In the middle is the Brethren’s gospel hall, where they were giving away food and Bibles a couple of weeks ago. They seemed to be doing exactly the same as the other two organisations, which have charitable status.

Three things are wrong. First, a long-standing religious organisation is being treated differently from similar religious organisations. Secondly, the Charity Commission lacks clarity in its advice. Thirdly, the length of time that the commissioners have taken to reach a conclusion must be considered. I want to ask the Minister two questions and hope to finish within three minutes. First, will he address the definition of public benefit, and do so soon? Secondly, will he ensure that the Charity Commission understands that definition and turns its attention elsewhere?

My hon. Friend is ably representing his constituents in this worthwhile debate, as other right hon. and hon. Members have done. Will he add to his questions to the Charity Commission the puzzlement that I am sure we all have? In the legal curiosity with which it embraced clarification of the law, was it arbitrary or discriminatory to choose to do so in this case and to place the burden of making that case on the Brethren?

My hon. Friend is absolutely right: 15 years non-renewable hardly leads to accountability.

A key absence from the Bill is that there will be no referendum. The Government have opted to impose their proposals on the public, rather than trust the people with a vote on House of Lords reform. We think that is an error, and it runs contrary to the growing tradition that major constitutional change should be put to the people in a referendum.

It is not only Labour that calls for a referendum. The Joint Committee also unanimously called for a referendum:

“The Committee recommends that, in view of the significance of the constitutional change brought forward for an elected House of Lords, the Government should submit the decision to a referendum.”

This Bill is much weaker as a result of the Government refusing to include a referendum.

We heard a number of defences of that position from the Deputy Prime Minister. He said a referendum was not needed because proposals to reform the House of Lords were in all three main parties’ manifestos. The manifestos said very different things, however. While Labour and the Lib Dems called for a wholly elected second Chamber—albeit Labour wanted a referendum as well—the Conservatives sought only to find consensus. It is not simply semantics to argue that the Conservatives never actually gave a commitment to reform the House of Lords; they gave a process commitment to seek dialogue to find common ground.

I need to make some progress; I have been speaking for quite a while.

What is the best way to build consensus and to get a second Chamber that has legitimacy and public confidence? One way would be through holding a referendum. That would give consensus, public confidence and greater legitimacy.

Even if all three manifesto commitments had been identical, we would still push for a referendum. First, we would do so because it is in our manifesto. Secondly, as has been highlighted by a number of eminent commentators and colleagues from both sides of the Chamber, we would do so because someone who was opposed to reform of the House of Lords had no way of expressing that opinion at the last election. A referendum would allow a full and frank airing of views and allow voters the option to support, or oppose, the position.

I want to make some progress.

The fact is that, under these proposals, by 2015, let alone 2025, the way in which the Members of the other Chamber are elected and appointed will be totally different from how it is now. That is a radical change; it is not simply tinkering. If it were just tinkering, I am sure that the Deputy Prime Minister would not be quite so keen to champion the proposals as he is now.

Moreover, Parliament has got into the habit—some would call it a convention, and a good one at that—of holding referendums on major constitutional change. When in government, Labour did so in Wales, Scotland and Northern Ireland on devolution proposals, and in London on the creation of the mayoralty and the assembly. We also did so on giving further powers to the Welsh Assembly. We gave the people of the north-east of England a referendum to vote on regional government —a proposal they rejected. Even this Government have held a referendum on changing the voting system. People will not unreasonably think that the Deputy Prime Minister fears that his latest set of proposals will suffer the same fate as his electoral reform ideas. Referendums were also held in towns and cities up and down the country on proposals for elected mayors less than eight weeks ago. So if a referendum is good enough for Wales, Scotland, Northern Ireland, London, the north-east, Bristol, Leeds, Sheffield, Manchester, Birmingham, Wakefield, and for the alternative vote system, it is certainly good enough for Lords reform—an issue of national significance.

Time prevents me from dealing with the other areas where this Bill needs improvement, which include the length of the terms; whether those terms should be renewable; the cost of the second Chamber; the transitional arrangements; and the system of elections. There are more such issues, but time is running away.

We have made it clear that we will be voting to give the Bill a Second Reading; we support the principle of reform of the House of Lords. As the Government have decided to introduce this Bill, our job is to respond. We will oppose where we think things are not right and we will support them when we think they are the right thing to do. As I have said, on this occasion we will be supporting the progress of this Bill, but the Committee stage will offer the opportunity for the House to shape the Bill into something much better.

It is absolutely crucial—[Interruption.] I will answer the question that Ministers on the Treasury Bench have been chuntering about. It is crucial that the Bill is given sufficient time to be debated in detail. I know that the Chief Whip has now left, but attempts to shorten or stifle debate by the Government would be unhelpful. A fixed period of time for the Committee stage will not allow proper discussion of all 60 clauses and 11 schedules, and consideration of new clauses. Filibustering could render a full and frank debate impossible, which would be an utter travesty for a Bill of this importance. Let us consider the following:

“when there are really important matters before the House…a big Bill when Members want to say what they need on behalf of their constituents, they are unable to do so because of some ridiculous programme motion that does not take into account the gravity or importance of the measure.”—[Official Report, 2 February 2009; Vol. 487, c. 638.]

They are not my words; they are the words of the Deputy Leader of the House of Commons.

I have already told the House what the Deputy Leader of the House thought a few months before he had the burdens of high office. Only two months before he became part of the Government and part of the Executive, he said that programme motions are

Let me refer to the manifesto on which the hon. Gentleman stood and won in 2010. In a section on the House of Commons entitled

“Strengthen the House of Commons to increase accountability”,

it stated that Parliament would be given

“control over its own agenda so that all bills leaving the Commons have been fully debated.”

It is a great pleasure to follow the right hon. Member for Kingston upon Hull West and Hessle (Alan Johnson). Although I disagree with a lot of what he says, I have respect for the way in which he says it. I certainly agree with his last point about a referendum.

There is wide agreement in this House and in the other place that we want reform of the second Chamber. Sadly, the Bill before us is standing in the way of measured, necessary reform. If only we had a small Bill that proposed to do what we all know needs to be done, we could get on with it. But we cannot, because the Bill is fundamentally flawed. It undermines democracy in three specific ways: first, it damages accountability; secondly, it has not been subject to proper consultation; and thirdly, it ignores the will of the people.

First, a person who is elected for a 15-year, non-renewable term of office is accountable to nobody.

I do not know what proposals I would support for the House of Lords, because we have not had proper consultation or proper consideration of what ought to be done. I believe that we ought to have a constitutional convention to consider the reform of Parliament as a whole. Once we have done that properly, I will be happy to give the hon. Gentleman my answer.

Worse still on the matter of accountability, a body of people who, having been elected, claim to have a democratic mandate, will behave as though they had one. There will be no stopping them. They will flex their democratic muscles and challenge this House of Commons. No matter what any Bill or any convention says, they will challenge the primacy of this House.

Today’s debate has been passionate and knowledgeable, and it will stand as a fine example of the House at its best. We have heard numerous excellent contributions from right hon. and hon. Members, and we have heard a range of differing views from all parts of the House—some were in favour of the Bill and some against, but most speakers acknowledged that in the name of parliamentary democracy the proposals in it needed to feel the heat of Members’ thorough scrutiny.

Labour Members can be proud of an unmatched record on reform, as my right hon. Friend the Member for Tooting (Sadiq Khan) made clear at the beginning of the debate. We have introduced many of the changes in the relationship between this House and the House of Lords, and we are proud to be the party of reform. The House of Lords Act 1999 finally removed the hereditary principle from membership of the second Chamber. Interestingly, the decision elicited this response from the then Leader of the Opposition, the current Foreign Secretary,

“let me make it clear…that we believe it is wrong to embark on fundamental change to the Parliament of this country without any idea where that will lead.”—[Official Report, 2 December 1998; Vol. 321, c. 876.]

It would be interesting to know whether the Foreign Secretary feels the same about the Deputy Prime Minister’s desire to curb parliamentary scrutiny of the Bill. My feeling is that he just might.

The result of the 1999 Act was that, overnight, the size of the other place was reduced from more than 1,300 to just 669. In 2006 we created the post of elected Lord Speaker, separated the judiciary from the Lords by establishing the Supreme Court and created people’s peers—all steps that strengthened our democracy.

It is also important to remember that in 2003 and 2007 Labour initiated votes on whether there should be a fully or partly elected second Chamber. Although the 2003 votes were inconclusive, the 2007 votes favoured a 100% elected second Chamber. The Opposition recognise that vote and believe that the job of Lords reform will not be complete until we have a 100% elected second Chamber. We committed to that in our last manifesto, and we stand by that commitment.

The Deputy Prime Minister agreed with that policy just over a year ago, as my right hon. Friend the Member for Tooting said earlier. I wonder what made him abandon yet another apparently strong belief. Page 88 of the Liberal Democrats’ 2010 manifesto stated that they would:

“Replace the House of Lords with a fully-elected second chamber with considerably fewer members than the current House.”

Despite all that, the Deputy Prime Minister has made proposals for only an 80% elected House—then again, we all know how much the Deputy Prime Minister’s manifesto promises are worth. Leaving that to one side, it should be clear to all Members that the Bill deserves the fullest possible scrutiny, precisely because of issues such as I have mentioned. The Joint Committee was split, and it is clear that a rigorous debate is required before the issue is settled in statute. The House’s task, therefore, is to ensure that the Bill is fit for the long term, fit to endure in our democracy and fit to last a great deal longer than the legacy of its main architect.

Many hon. Members have referred to the primacy of the Commons, including, to mention just a few, my right hon. Friend the Member for Derby South (Margaret Beckett), the hon. Member for Epping Forest (Mrs Laing) and my hon. Friend the Member for Blackley and Broughton (Graham Stringer). It is now 101 years since the Parliament Act 1911, a measure that the House laid before Parliament to curb the powers of the other place. We should consider how emboldened an elected second Chamber might be if it disagrees with the Commons. As my right hon. Friend the Member for Tooting said, clause 2 reasserts the powers of the Parliament Acts, but it is silent on the future power and roles of a reformed Chamber, and relies on the evolution of conventions for the maintenance of Commons primacy. An elected second Chamber could evolve to challenge the conventions. Rigorous debate informed by constitutional expertise is required on Commons primacy. As the Foreign Secretary has said in the past, it is important to know and to try to establish where such measures lead.

The Opposition believe that such a major constitutional change should be put before the British people in a referendum—another hot topic in the debate. The idea was supported by numerous Members, including my hon. Friends the Members for Rutherglen and Hamilton West (Tom Greatrex) and for Dudley North (Ian Austin), and my right hon. Friends the Members for Knowsley (Mr Howarth) and for Kingston upon Hull West and Hessle (Alan Johnson). The last of those made it clear to the House, in his usual straightforward and blunt style, that he is a strong supporter of the reforms, but he also made it very clear that he supports a referendum. If cities can have referendums to decide whether they want a mayor, surely it is right to trust the British people on such a major change to our democracy.

One must be careful that referendums do not undermine the representative nature of our democracy, but there is a strong case for the mechanism when major constitutional change is proposed.

The hon. Lady is keen to tell us that the Labour party supports Lords reform and wants a referendum. Will it therefore campaign for a yes vote to deliver House of Lords reform in such a referendum?

That depends entirely on what the Bill looks like when it is presented to the British people. Hon. Members who have sat through the past seven hours of the debate will realise that the vast majority of Members of the House want the Bill debated thoroughly and amended to make it fit to put before the British people. The Joint Committee agreed unanimously on that point. It remains a mystery to Opposition Members that the party that was so keen to hold a referendum on the alternative vote system is so shy of supporting a referendum to determine the essence of our democracy and our parliamentary institutions. What on earth are they afraid of?
