Commons ChamberWe absolutely accept that of course young people with learning difficulties need additional assistance and additional understanding of conditions and so on, which is why we have very much focused on providing that in jobcentres to make sure that they get the support they deserve.
The DWP does not set a target for processing PIP claims. The Department takes all reasonable steps to obtain evidence of claimants’ individual needs, including independent assessment. We make decisions as quickly as possible based on the available information in order to reach the right outcome. I am sure that my right hon. Friend will be pleased to know, as I was, that the median time from start to end is currently 13 weeks.
Notwithstanding further appeal by the Department, will the Minister restore benefits after a successful first-tier decision for the applicant?
My right hon. Friend raises a very important question, but the Department takes the view that, because we are appealing the decision and it is based on an error of law, that really would not be appropriate. I just want to reassure him and all hon. Members that there are always exceptions, and this could arise where a suspension would cause financial hardship. For most benefits, this is considered before suspension is imposed, but, in all cases, the suspension letter sent to claimants invites them to contact the Department immediately if they are in financial hardship so that we can help them.

Commons ChamberOn a point of order, Madam Deputy Speaker. I am asking for your guidance about what we can do, because the Minister, perhaps inadvertently, is seeking to mislead the House. It is absolutely crystal clear in the Scotland Act 2016 that the Scottish Parliament is not in a position to introduce benefits by reason of old age. That is quite clear, and the Minister should be truthful with the people of this country. He should stop blaming the Scottish National party and the Scottish Government for a responsibility that solely lies here with Westminster.
Further to that point of order, Madam Deputy Speaker.
I will first answer the original point of order. First of all, of course the Minister is being truthful. Secondly, the right hon. Member for Ross, Skye and Lochaber (Ian Blackford) knows that this subject is a matter for debate.
Further to that point of order, Madam Deputy Speaker. I was just going to observe the contradiction that it is impossible to, as the right hon. Member for Ross, Skye and Lochaber (Ian Blackford) said, “inadvertently seek” to mislead the House. One either misleads the House seeking to do so or not.
I thank the right hon. Gentleman for that helpful advice. I suggest that we move on, because time is very limited and we do not want to delay the debate further with continuous points of order.

Commons ChamberOn the last point, people can get explicit consent—they just need to get the consent. On the delays and moving to fortnightly payments, I am aware that the Scottish Government have taken a different approach, but they are doing so by ensuring that the second payment, at the end of the second assessment period, is half what it would be in England and Wales, deferring it and then paying it a fortnight later. If the Scottish Government are happy with that and want to defend it to the Scottish people, they are welcome to do so, but it seems a strange way to deliver the benefit. On the public finances, we fought the 2015 general election with a commitment to find savings in the welfare budget, and we will deliver those savings.
I congratulate the Secretary of State. Does he anticipate any increase in the number of very short-term claims and did he consider spending the money on the taper rather than on reducing the number of waiting days?

Commons ChamberOur record on the timeliness of universal credit payments has improved markedly and, as the hon. Lady knows, advances are also available. I should also say that in the run-up to Christmas, when many temporary work opportunities are available, universal credit works much better for people, because they are able to access those opportunities, particularly on the verge of the festive season.
Very well: we have heard the right hon. Gentleman on Question 14, although he did not seek agreement to that proposition. He simply blurted it out, but we will accept that on this occasion.

Commons ChamberThe proposal is not cost-neutral; I must make that clear. It is very impractical and it is impossible to do in the time concerned. I have made it very clear that the transitional arrangements that were made when the Pensions Bill went through Parliament are all that will be provided.
What was the minimum notice received by those facing the maximum increase in age?
These changes took place under two Acts of Parliament: the Pensions Act 1995, which brought in the main change, and the Pensions Act after that. I want to make it clear that after the 1995 Act, 18 months was the maximum increase.

We all know from our own constituency surgeries that there are individual cases that might need to be taken up, sometimes simply because people disagree with a decision, or if there are delays. I am absolutely aware of that. [Interruption.] I point out to the hon. Member for Oldham East and Saddleworth (Debbie Abrahams), who is characteristically chuntering from a sedentary position, that the appeal rate against PIP is extremely low, so actually the facts again do not suggest those kind of problems. But we are absolutely keen to improve this. That is why in the coming weeks we will be setting up service user panels precisely so that we get the real world, on-the-ground experience available to the Department that the hon. Lady wishes us to have.
It is odd to be asked to pilot something that merely restores the status quo ante—or have I misunderstood the committee’s recommendation?
I appreciate my right hon. Friend’s concern. The committee makes a number of recommendations, and, as ever with the SSAC, I will take all of those recommendations very seriously and respond to them fully.

The Department has, of course, met all its requirements under the public sector equality duty. Equality assessment information has been received and shared with the Social Security Advisory Committee, which chose not to consult on this.
Young people in their first jobs cannot afford their own accommodation, so they share with other young people or they stay at home. Why should it be different for people who are out of work?
My right hon. Friend makes exactly the point that underpins this policy. We want young people in work and young people out of work to be making the same choices about where they are going to live.

The hon. Lady will know that what is considered for debate are matters for the usual channels. It ill behoves any Secretary of State to try to interfere in the actions of the usual channels.
The hon. Lady’s first question is based on the misapprehension that people with mental health conditions are doing worse under PIP as it is currently run. That is simply factually not the case. I am proud of the fact that overall the Government are spending £11.4 billion on people with mental health conditions—more than any previous Government have paid out. Overall, we are spending £50 billion a year on disability benefits. In every year of this Parliament we will be spending more than was spent in 2010. That is how we are meeting our commitments to disabled people, which I take very seriously and the whole Government take very seriously.
Are there lessons for the framers of the regulations to avoid them effectively being rewritten by the tribunals?
There are always lessons for anyone who writes regulations. By necessity, benefit regulations are complex, particularly because they need to be very sensitive. We are dealing with vulnerable people. In this case, we are dealing with disabled people who have extra living costs or difficulties with mobility. Inevitably, the framers of regulations try to make them as exact as possible. It is one of the roles of the courts to point out where that has gone wrong. In this case, the courts have said that they were not clear. What the Government are doing is clarifying them. That is to everyone’s benefit.

Commons ChamberThe hon. Lady makes a good suggestion. We are looking at that, and if we can share data better—not just across our own systems but with local government—we could improve things, because we could cut down on a huge administrative burden for claimants.
Have Ministers identified the critical difference that makes a recipient of universal credit so much more likely to get into work than someone on jobseeker’s allowance?
There are multiple features of universal credit that make that so much more likely. The critical thing is to remove the barriers that create differences between being out of work and being in work. Having the rent paid directly to the individual is one thing; there is also the additional support that people get from the work coach in the jobcentre; then there is the fact that people know how much they will retain for every extra hour worked and extra pound earned.

However the problem presents in my surgeries, scratch the surface and, nine times out of 10, the swiftest cause of poverty is family breakdown, which will be a much harder nut to crack.
Absolutely. That is precisely why this Government, and previously the coalition Government, have decided that having a simple income-based measure and target is not the right way. We need to look at the root causes of child poverty, and having a range of indicators and targets—one of which is on family breakdown—is the best way to make sure that we have as few children as possible living in poverty and that more and more children are able to emerge from it.
