I beg to move amendment (d), at end of paragraph 2, leave out ‘at today’s sitting’ and insert

‘in two days (in addition to the First Day already taken)’

It is normally a great privilege to follow the hon. Member for Wallasey (Ms Eagle), but this evening the opposite is the case. I am afraid that what has happened today is part of the deal that has been done to reach all-party agreement. The deal was: “Okay, if we agree to this, we won’t object to the fact that these very important amendments and new clauses won’t be discussed.” It is clear that there will now be a maximum of only 40 minutes in which to discuss some really serious issues. I fail to understand how the Leader of the House or the shadow Leader can say that there will be other methods and time to discuss them.

I have moved a manuscript amendment to the programme motion—the first time I have done so—because of the unusual circumstances. In the short time since it was prepared and we knew what was happening today, 15 right hon. and hon. Members from both sides of the House have signed it, including two former Home Secretaries and the Chair of the Home Affairs Committee.

When we were in opposition, we always used to criticise the then Government for curtailing debate on legislation, but I must say that this is the most outrageous example I have ever seen. These are really serious issues affecting extradition and vulnerable people, and to say that, effectively, they will not be discussed because of a clever way of guillotining their consideration is, to my mind, completely unacceptable.

Over 20 amendments have been selected, never mind all those that were tabled but not selected, and very many Back-Bench Members have signed them. It cannot be right to have tabled a programme motion last Thursday at 5.15 pm, after a huge row at business questions, saying that there would supposedly be plenty of time to discuss the Bill—although people had queries about that—without any knowledge that a Standing Order No. 24 application was going to be tabled and granted. I absolutely believe the Leader of the House when he says that when the Government tabled the new programme motion very late on Thursday they did not know—indeed, they could not have known—that there would be a Standing Order No. 24 application and that three hours of today’s debate would be lost.

If the Leader of the House thought that that amount of time should be available, we are going to be three hours short of it today. It would be possible, even now—I know that it is not going to happen because I have been here and seen this too often—for him to get up and say that this is a perfectly reasonable amendment to the programme motion and accept it. All the Leveson clauses would still be debated exactly as was proposed in the original programme motion; all that would happen is that the important amendments that we have lost would be debated on another day. If the Leader of the House is saying that so much legislation is rushing through this House that we have no time to find on any other days, that is hard to believe since the House of Lords has been given an extra week’s recess because we are not progressing enough business.

In May 2009, when we were in opposition, the Prime Minister-to-be made a speech called “Fixing Broken Politics”—I would recommend it to every right hon. and hon. Member—in which he made it clear that the one thing he was not going to do when he was in power was restrict debate; he was going to have open, transparent debate and allow enough time to scrutinise really important issues.

Did the hon. Gentleman really believe what the then Leader of the Opposition, now Prime Minister, said? Did not those of us on the Government Benches during those years say that the programme motions that were being tabled and passed would almost certainly happen in the same way if the Conservatives won the election? I am sure that the hon. Gentleman is not so naive.

I am very naive, because that is exactly what I believed. At that time, the hon. Gentleman would have gone through the same experience of the expenses scandal, when there was a real movement in the country for this place to change so that proper scrutiny would take place in this mother of Parliaments.

Previously, any scrutiny occurred down the corridor; we never got the chance to reach important clauses and amendments in Bills. We complained about that week in, week out. Yet here we are tonight having lost any debate whatsoever on really important clauses. Even when the situation was at its worst, under the Blair regime, I cannot remember anything being so dramatically curtailed. Why on earth could not the Leader of the House simply have said that we were going to have another day because of the Standing Order No. 24 debate? We could have extended tonight’s timetable by another three hours—that would have been sufficient—but given that that has not happened, the only way that we could, at the very last minute, come up with an acceptable, in-order amendment, was to say, “Deal with Leveson today and finish that at the time the Government suggested”, which will now be 10.44 pm, “and then move on to these important issues another day.” It is condescending to say that a few Members will be upset. It is not about a few Members being upset; these are really important issues that we should be debating as a House.

The Leader of the House said that there would be other opportunities to discuss those issues. Would it not be useful, arising from the strong representations and speeches that have been made from both sides of the House on the right of Parliament to debate such issues, if the Leader of the House indicated when we will be able to discuss such issues if he is not willing to agree to the amendment?

I am grateful to the hon. Gentleman for making that point, with which I agree fully.

The Executive are overriding completely the will of this place. The matters that we are not able to discuss are not minor ones; they are vital matters that concern people out there. They are not matters for the twittering classes of Westminster alone; they are vital matters that affect ordinary citizens up and down the UK. For example, we are dealing with automatic deportation and ensuring convention rights. We cannot be expected to run through such vital issues in a matter of minutes. I find the whole thing utterly unacceptable.

I was in Parliament in 1992 when the then Conservative Government thought better of such practices and provided time for debates to take place. Very rarely were debates truncated in this way. It is utterly unacceptable and I am sure that people outside this place will see that. We took a step forward this afternoon, but we are taking a major step back this evening.

On a point of order, Mr Deputy Speaker. Would it not be appropriate for the Leader of the House to show respect for the views that have been expressed in the past 15 minutes and at least come to the Dispatch Box and make some comments? He is just sitting there grinning and showing indifference. What sort of respect does that show for the views of the House of Commons?

As my hon. Friend knows, it is the Government’s intention to have a debate on that issue. He will also know, however, that on 15 January he and his colleagues went to the Backbench Business Committee to ask for time for a debate, but it has not been scheduled. We must remember that as a general proposition this House resolved that the Backbench Business Committee should take responsibility for a wide range of debates, including general debates. If we start to re-import an expectation that the Government will provide time for such debates, it will by extension be impossible to allocate the same amount of time to the Backbench Business Committee. We will have a debate on the Francis report and discuss between ourselves how that is to be accomplished at the appropriate moment. I continue to make the general point of principle that the Backbench Business Committee exists in part to enable the House to debate current important issues, as it did with Hillsborough, for example.

May we have a debate in Government time on the fact that we are supposedly “all in it together”, so that we can contrast the return of the curse of fuel poverty that is affecting many of our constituents with the handover of some £10 million to the outgoing chief executive of British Gas, the £1.3 billion to shareholders, and the fact that so much is being done to make life more difficult for the people we represent?

The hon. Gentleman will know that the House supported in legislation the establishment of the green deal, which will make an enormous difference to many people. Many companies in the energy sector are providing discounts on energy bills to something approaching 2 million households, and over the winter the Government are supporting many people with winter fuel payments. In addition, the hon. Gentleman will be aware that the Energy Bill has just been considered in Committee, and when it returns to the House it will provide an opportunity to debate many of the issues surrounding fuel and energy prices, and energy poverty.

My hon. Friend makes a good point. It seems to me that next week’s business, including as it does a general debate on Europe, affords an excellent opportunity for the Foreign Secretary to set out the Government’s position—and in so doing, he may well refer to the Conservative party’s policies for beyond the next election. That should provide a real opportunity for the Conservatives to maximise the Conservative vote at any by-election.

Should we not have a statement today from the Home Secretary on the 16,000 immigration cases that have been found by the chief inspector of borders and immigration—in addition to the number of cases found last year—with boxes being found in all kinds of places, unknown to the UK Border Agency? When is the Home Secretary going to get a grip on the situation after nearly three years in office and stop blaming her predecessor?

As the hon. Gentleman should know, this is an historical problem. It would not arise now because the reconsideration of those rejected applications could not happen under the current policy. My hon. Friend the Minister for Immigration has made it clear that this is being dealt with and that such a situation would not be allowed to arise again. As I have made clear in business questions before, the chief inspector of borders and immigration is equally clear that performance is being turned around. The Minister has said that he is not satisfied with the performance of the UK Borders Agency and the chief executive is not satisfied with it: they are taking every measure to ensure that it is improved in the future.

I am grateful to my hon. Friend, who knows how our right hon. Friend the Secretary of State for Northern Ireland has come to the House and, quite rightly, made statements. Of course, I have no doubt that in the new year, if need be, she will do so again. We all condemn the lawlessness and thuggery we have seen. It is not in defence of the flag; it is a disgrace to the flag, frankly, and to Britain that this is happening. We want to see it stop. In particular, the threat to our elected representatives and the threat to and attacks on the police are attacks on democracy. I know that my right hon. Friend the Secretary of State is working with the Executive to ensure that local solutions, led in Northern Ireland, are leading the approach. We all support that, as we respect the devolution settlement, but I know that as a House we are very concerned and that the Government will take seriously their responsibility to report to us.

I would like to thank the Chair of the Finance and Services Committee, the hon. Member for Caithness, Sutherland and Easter Ross (John Thurso), for his useful introduction to the debate. I do not particularly want to go into the amendments; I will decide accordingly when the time comes and vote one way or the other.

Mention is made in appendix A of the Committee’s report that by 2015

“The House of Commons will be valued as the central institution in our democracy”.

That is stating the obvious. Whether it is valued or not, or savings are to be made or otherwise, I have always thought that this place is the basis of our country’s democracy; I am unaware of any alternative institution that ensures the democratic process and the rule of law. The appendix also refers to Parliament having

“the accommodation it needs to operate in a modern democracy.”

That subject is my main reason for wanting to speak in this debate.

First, let me say that I entirely accept that savings need to be made. It would be a rather odd situation if we were urging savings everywhere else and ourselves took the view that that would not be appropriate in the Palace of Westminster. That is not necessarily to say, by any means, that I agree with everything that is being suggested.

Aspects of the way in which this place is run and managed sometimes rather surprise me. For instance, I came into my office in late autumn, when there is no necessity for any central heating, and was surprised to find that it was on at full blast and would have been for some days. Obviously, I took appropriate action. I am not suggesting for one moment that central heating should be reduced for those who work day in and day out in this place—Members’ staff, officers, and employees of all kinds—but perhaps some savings could be made in a way that would reduce public expenditure. I certainly would not have liked to pay the heating bill for my office out of my own pocket, nor would I want to claim for my constituency accommodation money that was not justified.

There should be no ambiguity about what I am going to say about cleaning, so let me point out that I am a lifelong trade unionist and a member of the GMB, and I am pleased about that, but, as my hon. Friends will know, I would say it regardless. Conservative Members might take a different view, but be that as it may. On page 18 of the report, there is a recommendation to reduce the number of cleaning staff directly employed by the House and not to renew existing employment contracts. I am concerned about that. Four or five years ago, there was a row about the terms and conditions of service of cleaners not employed by the House of Commons being far inferior to those of cleaners who were directly employed. There was a demonstration, and a lot of pressure applied both inside and outside the House, and the necessary changes were made. The cleaning contract for the House of Commons is with KGB; I am not making that up. Presumably it is not the organisation that became so notorious over 70 years!

When the Leader of the House winds up, I would like him to say whether the same conditions of service for cleaners directly employed by House of Commons apply to those who are on contract with KGB. Is there sickness pay? Is there any pension arrangement? Are their conditions in any way worse than those of directly employed cleaners? I believe that there is no difference in terms of hourly payment, but I am concerned about their conditions of employment.

I now come to my main point. The sum to be saved by 2014-15 is about £20 million, in round terms. However, figures that I have obtained from the Library, and which are in the report, show that spending on the maintenance of the Palace averaged some £30 million in each of the past three years. That, of course, was for both Houses. The contribution made by the House of Commons was, I think, somewhat more than half; in round figures, it was about £54 million, which is a very considerable sum. We know that the maintenance is absolutely essential—it is not done for the sake of it—because this building would not be able to operate on a daily basis if it were not undertaken. That is not in dispute; I am in no way challenging it, and no one else is likely to do so.

Another report, “Restoration and Renewal of the Palace of Westminster”, makes alarming reading and shows why the House of Commons must at some stage, I hope in the near future, make a decision on this building. It says that water penetration is widespread throughout the building, including the House of Commons and the House of Lords, that asbestos is equally widespread, that the building’s mechanical and electrical services are very defective, and that in some areas there is a high fire risk. Another area where essential maintenance is needed is the roof of the Palace, which causes the water penetration and so on. We are not debating that report today, but passing reference is made to it in the report before us.

There is no doubt that we all agree on the savings, but are we going to grasp the real issue that this 19th-century building is not fit in any way for the 21st century? We must recognise that we can keep on spending the money on maintenance year in and year out, but, inevitably, the upshot will still be that a complete overhaul, with all the absolutely essential work that is necessary, will need to be undertaken. Moreover, it will undoubtedly have to be done with Members and everyone else having been evacuated from the Palace; it cannot be done while people are working here, even in the summer recesses—as we all know, if an emergency arises the House is recalled at a moment’s notice. I hope that it will be possible for a decision to be reached in time for the necessary work to begin in the next Parliament. Having known over the years how reluctant the House of Commons is to reach a decision, I very much doubt that that will occur, but I certainly hope that it will be done by 2020.

I am sure that the Leader of the House has read the report to which I referred and will recognise that I am not exaggerating about the overall work that needs to be done. Although I can sometimes be accused of exaggeration by Conservative Members, I do not believe that I am exaggerating now. Yes, it will cost a lot of money, but, as I have illustrated, we are spending money year after year on essential maintenance work. I agree that there must be savings; for the reasons I have stated, I will not oppose the recommendations in the report. However, the House should, as quickly as possible, reach a decision on the bigger, absolutely essential job of making sure that this Palace is fit for purpose.

I am grateful for the opportunity to contribute to the debate. I do so on behalf of the Government to make clear our support for the work the House is doing to ensure it meets the necessary savings in the broader context. The hon. Member for Sheffield South East (Mr Betts) and the shadow Leader of the House made that clear, too, recognising the need for financial savings right across the public services. As Leader of the House and on behalf of the Government, I also want to reflect on how the House can best achieve those savings.

I would like to say a few words of thanks to the Backbench Business Committee, not least for scheduling this debate, and I congratulate the hon. Member for Caithness, Sutherland and Easter Ross (John Thurso) on securing it and on the manner in which he introduced it and, as others have said, guided so well the discussion and work to this point. The way in which the Backbench Business Committee has opened up debates in this House has been positive, enabling us, as in this debate, to have a similar impact on House administration. It is not only for us, but for members of the House service and the public more generally, to see how this House is managed and administered in order to deliver something that is not only effective but value for money.

We welcome the level of savings entered into by the House of Commons Commission. Clearly, 17% reductions by 2014-15 relative to 2010-11 are broadly in line with savings across the 2010 spending review, which identified that, other than for protected areas of expenditure, departmental budgets would on average decrease by 19% over four years.

It is important to recognise that this is not the beginning of the process; it is the next stage of it. The House of Commons Administration has already made considerable progress in achieving savings, as Members have said, through voluntary exits, discontinuing printing of documents and improving contract management. We can now see examples of how, as the Commission agreed at the outset, savings should be achieved through detailed analysis of services, and delivered to arrive at something better, not just cheaper. From the Finance and Services Committee report we can see the emergence of more such opportunities, not least if we look at the ICT strategy in the table on page 15. There is clear evidence of how that might make a considerable difference, not just on print to web, but as the Committee’s Chairman said, in relation to such things as cloud computing. That can make a big difference not only in how we access our responsibilities more effectively but by enabling us to rethink the way in which the physical estate is managed in order that we may deliver our responsibilities.

Innovation has to come, too, in respect of visitors to this building, their access and facilities. The Administration Committee set out how to achieve that in its first report of this Session. It was a very good basis on which to proceed. It is not the subject of the report before us, but the income generation associated with it is an integral part of the process of achieving the medium-term financial plan.

I listened carefully to my hon. Friend the Member for Harlow (Robert Halfon). Many Members have illustrated that the risks and concerns that he raised would not be valid on the basis of the way in which the Administration Committee is proceeding. I say gently to my hon. Friend that he underestimates the importance to all of us, and to our constituents, of opportunities for access. We can provide access individually as Members, as the hon. Member for Poplar and Limehouse (Jim Fitzpatrick) has so famously done, but I meet so many constituents who have visited this place without my knowing they had done so. It matters to them that they can access their Houses of Parliament, because so much of their history is here. That is true not just for the people of this country, but for those of many other countries around the world.

I particularly echo the point rightly made by the shadow Leader of the House that as we develop visitor access and facilities, it allows us to boost the opportunities for educational access. Progress has been made, but we all know we want to do more. If we could one day be confident that we could arrive at a position whereby at one point in their educational experience, every young person in this country had had access to their Houses of Parliament on at least one occasion, it would be a dramatic thing to have achieved. We are, however, an order of magnitude away from where we need to be to make that happen.

The hon. Member for Walsall North (Mr Winnick) raised major issues about the repair and renewal of the House. Part of what we are doing in the medium-term financial plan and in achieving savings will help us better to understand what the shape of repair and renewal for the future will look like. Today and for the foreseeable future, however, we are not yet in a position to make decisions about any of those options, other than to have made clear—for this House and the other place—that we do not want the building of a new Houses of Parliament somewhere else, separate from this place. Much more work needs to be done on the question of how we can sustain this House in the long term before we can look at the options ahead of us.

Let me make it perfectly clear that I am certainly not in favour of another House of Commons. I want this place to be renewed, so it can be a working place for a long time to come. For that work to be done, however, it seems to me that some evacuation will have to occur.

I understand the hon. Gentleman’s point. There are options ahead of us, one of which would entail such a “decant”, as it has been called; the other of which would not. We have a great deal of work to do before we know which of them is the best option for this House to meet its responsibilities and for value-for-money purposes.

It has already been demonstrated that House staff are able to deliver excellent service in challenging times, and that their participation in the savings programme has been instrumental. It is axiomatic in any walk of life that if we want to deliver the best possible service, the people who are best equipped to do it are the people working in that service at the front line: they understand it; they can bring forward some of the best ideas for making it happen. The medium-term financial plan is about showing how the business improvement plans— my right hon. Friend the Member for Saffron Walden (Sir Alan Haselhurst) further illustrated them—can achieve that. We should engage the staff fully, listen to them, and work with them. This is not about Members, intimate though we are with how the House works, deciding everything. It is about our working with the staff in challenging times, and recognising that we can achieve not just financial savings but a re-engineering—to use that unfortunate term—of the way in which we do our business.

I agree with the hon. Member for Ellesmere Port and Neston (Andrew Miller) that staff in the Committee services and others will need to take a positive and constructive approach to new technologies and new ways of working. I think that many of them are already doing that, and that they will all make a great contribution in the future.

Let me finally say, on behalf of all of us on the House of Commons Commission, that this debate has been immensely helpful in enabling us to understand what response we should make to the Finance and Services Committee, and that we will take full account of all the points that have been raised. I find myself thinking of that famous remark by Sir Winston Churchill:

“We shape our buildings and afterwards our buildings shape us.”—[Official Report, 28 October 1943; Vol. 393, c. 403.]

It is tempting to think that very little should change in a building of this character, but change is inevitable, and I think that in this instance it will be positive.

I am delighted to reassure the hon. Lady that at this stage, with the Commission not yet having received the report, all options can be placed on the table. However, the option that is ultimately chosen will follow best practice, best value and the best advice that we receive.

It would be totally unacceptable for the House not to sit for three months, so I hope we will continue with September sittings. Does the hon. Gentleman accept that if the patching-up work is going to be very costly and possibly carry on for years, it would be far better to reach a brave decision and do the job properly from the start?

The hon. Gentleman makes a very good point. As I said, from my experience in another life, I have found that it is usually better to take two or more years and get the job done than to be inconvenienced and unable to work properly for 10 years. I stress, however, that we are at a very early stage; it is for the professional advice to be given first, and then for the Commission to make a decision in the light of that advice.

As I said at the outset, any change will have consequences. My hon. Friend has correctly identified one of those consequences, namely the clash with Committee sittings on Tuesday mornings.

Let me now, for the benefit of all Members, say something about the mechanics of the voting that will take place later. I have had a discussion with the Patronage Secretary, the Chief Whip, and because there is to be a genuine free vote for Government Members and also, I trust, for Opposition Members, and because there are differences of opinion in the Government Whips Office, he has agreed that the Government Whips will act as Tellers on motions 1 to 7. The right hon. Member for Lewisham, Deptford (Dame Joan Ruddock) will therefore not need Tellers for the vote on her motion to change Tuesday sittings, although if she wishes to push her later amendment, she will need Tellers for that. The Government have taken a view on September sittings, and if any Member chooses to divide the House on my motion on the subject, Tellers will also be needed then. I hope that that is helpful to all Members.

I congratulate the Committee on an excellent report which is thorough and very readable, and which makes some sensible recommendations.

Does the right hon. Gentleman accept that if, at the appropriate time, a majority voted against September sittings, it would be disastrous for the reputation of the House? It is quite wrong, and always has been, for the House not to sit for 10 continuous weeks, and I hope that when the motions recommended in motion 8 are put to the House, it will vote overwhelmingly in favour of continuing the September sittings.

I hear what the hon. Gentleman has to say, but I must tell him that the evidence that the Committee received from Members was rather mixed. There was little, if any, enthusiasm for September sittings. Many Members felt that little of substance was achieved during those two-week periods, and that any presentational benefit was outweighed by the financial costs of setting up the House so that Members could be brought back for just eight or nine sitting days before the conference recess. Many also regretted the loss of opportunities for constituency work in September, particularly visits to schools.

However, the view in other quarters—including, I believe, the Government—rather reflected that of the hon. Gentleman, namely that any move to return to the long summer recess would be very difficult in presentational terms, and would also create a long period during which the House would be unable effectively to fulfil its task of scrutinising the Government and holding Ministers to account. Indeed, that may well be the view of the official Opposition.

We all work long hours in this place, and however we jig them that will remain the position. However, we should hesitate a little before complaining about the hours that we work. They are long, and most of us have weekend duties and will continue to do so, but other people do as well. We are not going to get a great deal of public sympathy if we go round our constituency complaining that our hours are long and all the rest of it. The obvious reaction will be: “If it’s so terrible, why do you stand for re-election?” We have to be a little careful about complaining. If there are lazy Members in the House, which I very much doubt—I do not know how they would get away with it—there must be very few indeed. All of us, wherever we sit in the Chamber, work long hours to carry out our duties here and in the constituency.

I am in favour of the present arrangements for Monday to Friday. As for Thursdays, I am not particularly concerned. I was and still am a member of the Home Affairs Committee, and when the House met at 11.30 on Tuesdays there was a clash. We had to decide where we should be. We had to decide whether to carry on in the Committee because we had further business, or come to the Chamber to participate in oral questions. There are bound to be strong feelings about the time we should finish, particularly on a Tuesday, but for the life of me I cannot see any advantage for the great majority of Members whose constituencies are hundreds of miles away in stopping at 7 o’clock.

The main reason I am on my feet is September sittings, which I am very pleased about. I do not often praise the Government, but I certainly praise them and my hon. Friend the Member for Penistone and Stocksbridge (Angela Smith) for supporting our sitting in September. I long campaigned for that in the 1980s and 1990s, as my right hon. Friend the Member for Blackburn (Mr Straw) may remember, because I simply could not understand why on earth we should break up for 10 weeks. As far as Governments are concerned, it is a tremendous advantage, because there are no oral questions, no statements and no points of order—it is almost a paradise for them.

Members talk about their constituency duties, such as visiting schools, holding surgeries and all the rest of it, and yes, they are very important, but we should bear it in mind that, apart from anything else, our job first and foremost is to be here holding the Executive to account. That is the first priority. If we break up for a continuous 10-week period, we are not doing our job. There might come a time when it is possible to rejig the conferences in such a way that we do not have to break up again after them, but in the mean time, as the Procedure Committee reported, there is apparently no opportunity for the parties to change the conference season. The September sittings are very important. I know that we are not conditioned by the media, but we can imagine what the press reaction would be: “MPs take 10-week holiday.” We call it a recess, but has anyone heard that word outside the Westminster village? The word that is bound to be used is “holiday”.

I have listened carefully to the hon. Gentleman and know that he has a lot of experience in this place, but does he not accept that it is also very important for Members to have some semblance of a family life, and not just younger Members with child care responsibilities but older Members who now face caring for elderly parents?

Of course. We all have responsibilities in our political and private lives. We are all accountable to someone or other, and that is very important, but with the greatest respect, I do not think that the hon. Lady’s point has a great deal of relevance to September sittings. The last time there was a vote on September sittings we lost it. I hope that this time we will win it, and win it with a decisive majority.

My right hon. Friend will have an opportunity to raise that matter next Thursday. I remind him that in December we published the water White Paper, which sets out a more resilient approach to the water shortages he refers to. Next Wednesday we will debate a Bill that will enable investment in water infrastructure, particularly in London, in order to improve the quality of water and the reliability of supply.

With regard to the Health and Social Care Bill and future debates, is the Leader of the House aware that watching the Prime Minister trying to defend the Bill yesterday reminded some of us who were present at the time of Mrs Thatcher, as she then was, trying to defend the poll tax?

The role of the Table Office is to assist the Speaker in upholding the rules of the House. I hope that that is widely understood.

The right hon. Gentleman will understand that I cannot debate this matter further now, and that it would not be right to do so, but he has made his point very clear. I have heard it, representatives of the office in question have heard it, and I hope that that will suffice for now. I will keep the matter under close review, and I am sure that the spirit of what the right hon. Gentleman has said will be respected.

You have made a point that I was not going to make, Mr Speaker, except perhaps in passing.

I have the highest respect for my right hon. Friend the Member for Manchester, Gorton (Sir Gerald Kaufman). His point of order illustrated that, having been in the House for nearly 42 years, he is still always willing to act on behalf of his constituents, which is highly commendable. I do not think that a single Member in the House would disagree with that.

However, given that my right hon. Friend was highly critical of the Table Office, I wish to put on record that during my years in this place, I have always found those at the Table Office co-operative and courteous. I have never found them rude at any stage. Had I done so, I should have reported the matter to the Clerk of the House or to the Speaker, as the case might be. I look on the Clerks of the House, as on the other Officers, as dedicated servants of the House of Commons who serve the House of Commons, and I think that that should be put on record.

I understand my hon. Friend’s constituent’s concern about what happened. As my hon. Friend will understand, it would not be appropriate for me to comment on a particular case. I imagine that, as with all decisions of a court, this man will have an opportunity to appeal against what happened. As I understand it, the confiscation orders are simply designed to put anyone who has profited from an illegal catch back into the position in which he or she would otherwise have been; they are not intended to be a punishment. I hope my hon. Friend will understand the constraints on Ministers when it comes to commenting on individual cases.

Would it not be more appropriate for Ministers to give serious consideration to the amendments that were carried yesterday in the House of Lords? Perhaps we could have a statement before the normal parliamentary procedure becomes involved. Does the Leader of the House not agree that to take action against cancer, bone and stroke patients is totally unacceptable? Indeed, it is sick. I heard the Minister of State, Department for Work and Pensions, the right hon. Member for Epsom and Ewell (Chris Grayling) on the radio today trying to justify what has occurred, but I hope that the Cabinet will give further consideration to the matter. What has been agreed to by the House of Lords should be agreed to by the Government.

As I said to the hon. Member for Wallasey (Ms Eagle), the Government will give serious consideration to the votes that took place in the other place yesterday. We have asked Professor Harrington to work with Macmillan to ensure that the work-related assessments are appropriate, although it should be borne in mind that the worst cancer cases would be in support groups and would therefore not be affected. Government amendments tabled to the Bill yesterday would have protected those whose condition subsequently deteriorated. Of course we will consider the matter seriously, but as I have said, if we do not make savings by means of that part of the Bill, we may have to seek compensatory savings elsewhere.
