Commons ChamberI agree with one thing the hon. Gentleman says: EU citizens in Scotland, and indeed in the whole United Kingdom, make a significant contribution to civic life and the economy of our country. As the Prime Minister has repeatedly made clear, we want those people to stay. She has sent out a very clear message, and it is clearly set out in the White Paper. We do not believe that the Article 50 Bill is the place to set it out.
Order. This is on the importance of the rights of EU nationals. I am sure that that is what the hon. Gentleman meant.
I know that businesses across Scotland value the contribution that EU citizens make to their businesses, and I am clear with them that even when the UK leaves the EU, it will be important for EU citizens still to come to Scotland and play an important part in our economy.

Commons ChamberMay I first welcome the fact that the hon. Gentleman’s colleague, the hon. Member for North Ayrshire and Arran (Patricia Gibson), has secured an Adjournment debate tomorrow that will focus specifically on the Ayrshire regional growth deal? I have met the councils and I want that deal to receive support from the UK Government in the way that is most appropriate to make it happen.
At this Scotland Office questions, I am pleased to inform the House that I have just been notified that Andy Murray has won his second round match in Melbourne.

I am sure that the Independent Fiscal Commission will have noted that my colleagues in the Conservative group in Holyrood voted against the SNP’s motion because we have absolutely no idea where the SNP stands in relation to the UK’s future relationship with the EU.

Commons ChamberMr Speaker, may I begin by commending you not only on your attendance at the Davis cup semi-final in Glasgow, but on your obvious enthusiasm and exuberance, which the hon. Member for Glasgow Central (Alison Thewliss) and I were witness to? I am sure you will agree that, although the result was not as we would have wished, the event once again confirmed Glasgow’s place as a great international sporting venue.
The UK leaving the EU should be seen as an opportunity for Scotland. Today’s GDP figures are an encouraging sign of growth. However, Scotland is still lagging behind the UK as a whole and that underlines the need for Scotland’s two Governments to work together to take such opportunities.
The Secretary of State and his daughter did a fantastic job as well, as did the constituency Member of Parliament.

I would be very happy to meet the hon. Lady to discuss those issues further. I am also very interested in pursuing the proposed Ayrshire regional growth deal, which, in promoting tourism in that part of Scotland, will have golf at its heart.
This is the first opportunity in Parliament to put on the record our total revulsion at and condemnation of the terrorist atrocities in Brussels, as well as our solidarity with everybody affected. We join the Secretary of State for Scotland in that.
The promotion of the Ryder cup in Scotland was a huge achievement for the Scottish Government and the then First Minister, my right hon. Friend the Member for Gordon (Alex Salmond). Today is the last sitting day of the Scottish Parliament. Given that he is standing down from Holyrood, may I pay tribute to my right hon. Friend for his remarkable tenure as an MSP and as First Minister, and pay tribute to all other MSPs from all parties who are retiring? Does the Secretary of State agree that there is much that can be built on following the success of the Ryder cup? How does he plan to contribute to that?
I am sure that that was a courteous tribute, but I hope the right hon. Gentleman will not object if I say that the first part of his question was way off the fairway.
Securing the Ryder cup to be held in Scotland was a significant event. I agree that the former First Minister of Scotland has made a remarkable contribution to Scottish politics, although the right hon. Member for Moray (Angus Robertson) and I will probably differ on the detail of that. What the former First Minister and many MSPs who are standing down—I also pay tribute to them—have done, and what we all need to do, is promote Scotland together, because that is when we get the best results for Scotland.

Commons ChamberI welcome the hon. Lady’s question, because of course she and I were both Scottish Conservative candidates for the Scottish Parliament in the dim and distant past—[Interruption.] I am sure that the detail of this agreement and the issues that she raises will stand up to scrutiny.
Order. It is a moderately unedifying spectacle when such large numbers of Members are quite so vociferous. The saving grace is that all of them do have a very notable smile on their face, so at least there is good humour in the Chamber.

Commons ChamberIt is open to any Member who believes that he or she has made a mistake to correct the record voluntarily. It is not the responsibility of the Chair to arbitrate between competing claims about a sequence of events, and nor is it my responsibility to interpret what the Minister might have meant in responding to the hon. Gentleman at the time. The hon. Gentleman has made his point with force and alacrity—we would expect no less of him. If the Secretary of State wishes to respond, he is perfectly at liberty to do so, but he is under no obligation.
Further to that point of order, Mr Speaker. I have noted what the hon. Gentleman has said and will have the matter investigated.
The Secretary of State has kindly said that he will have the matter investigated. I ought to emphasise, for the avoidance of doubt, that he was not the Minister who answered in the debate. I hope that the hon. Member for Ross, Skye and Lochaber (Ian Blackford) is satisfied with his prodigious efforts for the day and that we might now move on to other fare. I know that he will be absolutely delighted that we can now move on to the ten-minute rule motion, to be put forward by his hon. Friend the Member for Inverness, Nairn, Badenoch and Strathspey (Drew Hendry). I am sure that he is sitting expectantly with that in mind.

Commons ChamberThe Prime Minister claims that he will get a good deal for Britain in the European Union. Would the Secretary of State like to see the United Kingdom play the same role and have the same powers in the EU that he claims Scotland currently has in the UK?
That was quite tangentially related to the west coast main line, but I hope that the dexterity of the Secretary of State will admit of an answer.
Mr Speaker, the west coast main line is one of the most important routes within the United Kingdom to Europe via London. I have set out my position in relation to the EU referendum. If the SNP genuinely wants Scotland to remain in the EU, it is important that, rather than concentrate on process issues, it gets out and campaigns for it.
Order. Members need to learn the merits of the blue pencil. If they used the blue pencil and questions were shorter, they would benefit.
The Scottish Parliament will indeed take on those very significant tax powers, which it will be able to use as it sees fit. I hope it will use them to make Scotland a more attractive place for business and commerce and to grow the Scottish economy and the Scottish population.

Commons ChamberI have no grievance, manufactured or otherwise. I am confident that the Scottish Government want to achieve an agreement. The UK Government want to achieve an agreement based on fairness to Scotland and fairness to the rest of the United Kingdom. I give the hon. Gentleman an absolute commitment that the fiscal framework, as agreed, will be subject to full parliamentary scrutiny here in Westminster and in the Scottish Parliament.
I regularly discuss a range of matters with the Scottish Government. Although higher education is a devolved matter, the available figures show that application rates for those aged 18 in 2014 and 19 in 2015 were 37% in Scotland compared with 44% in England. [Interruption.]
Order. I also wish to hear the voice of Christchurch on the matter of Scottish universities.
How can it be in the United Kingdom national interest that school leavers from Scotland are being denied access to their own universities because of the arbitrary cap on numbers imposed by the Scottish Government, when school leavers with lower qualifications from the rest of the UK are able to gain such access?
We always listen with interest and take forward in a positive way anything that is forthcoming from the Scottish Affairs Committee, and I look forward to reading the hon. Gentleman’s report.

Commons ChamberBefore I answer the question, may I begin by commending you, Mr Speaker, not just for your attendance at the Davis cup semi-final in Glasgow, but for the enthusiasm with which you got behind Team GB for that momentous win? I am sure you will join me not only in wishing our Team GB the best in the final in Ghent, but in confirming that Glasgow, as it has once again demonstrated with the world gymnastics championships, is a great sporting city.
The UK Government have given local communities the final say on new onshore wind developments in England. Planning for onshore wind is a matter fully devolved to the Scottish Parliament and sadly the Scottish Government have kept that power to themselves. I would urge them to look closely at this Government’s policy of an affordable energy mix that also protects our natural landscapes.
I thank the Secretary of State. I shall be there in person, all being well, to support the team.
True devolution means that power should rest as closely as possible to the people in Scotland, in Wales and in Northern Ireland. Does the Secretary of State deplore the centralising policies of the current Scottish and Welsh Governments, who seem to think they know better than the people and the communities of Scotland and Wales?
In addition to this question, question after question on the Order Paper from the Nats queries the powers of the Scottish Parliament, yet the truth is this: they have missed the A&E waiting time in Scotland for six years; more than 6,000 children leave primary school unable to read properly; children from poor families get a particularly bad deal under devolution; and Scotland faces a housing crisis. When I visited Edinburgh a week or so ago, I was stunned at the level of rough sleeping in that city—it is much higher than in comparable cities. Should the Nats not be sorting out the things for which they are responsible instead of demanding all those other powers? They are not just the most centralising but the most useless—
Order. I have been generous. We must now hear from the Secretary of State.
The Scotland Bill will make the Scottish Parliament the most powerful devolved Parliament in the world. What we require now is to hear from the SNP and the Scottish Government how they will use these Parliaments. They prefer arguments about process. They do not want to tell us what they will do and they do not follow that through with action.
The hon. Gentleman could learn a lot from the leader of the Western Isles Council, who is keen to have confirmation that the Scottish Government will devolve responsibility for the Crown Estate to the Western Isles—a measure that he, as MP for the Western Isles, does not appear to support. [Interruption.]
Order. The hon. Member for Na h-Eileanan an Iar (Mr MacNeil) is the Chair of the Energy and Climate Change Committee, and I urge him to behave in the statesman-like manner expected of such a high office holder. We might learn about onshore wind from Michelle Thomson.

Commons ChamberThat will not do, Secretary of State. You have been asked a very straight and clear question: will you now rule out bringing significant and substantial changes to the Scotland Bill in the unelected House of Lords? The House of Lords has never been held in such contempt by the Scottish people, who see it as nothing but a repository for the cronies of, and donors, to the UK parties. Will you rule out making significant changes through the House of Lords and do it in front of the elected Members of the House of Commons?
Order. I say very gently to the hon. Gentleman that I will rule out nothing, but I will leave it to the Secretary of State to do so. The debate runs through the Chair, and the hon. Gentleman, who is an experienced denizen of this House, should know that.
The hon. Gentleman does not listen. It was made clear repeatedly during the Committee stage of the Bill that amendments would come forward on Report and be debated in this House. The hon. Gentleman has been rumbled. He does not want to participate in a proper debate about the issues of concern to the people of Scotland; he is interested in press releases and stunts.

Commons ChamberLet me continue. We are going to debate the Bill in full. We are going to scrutinise, over four days, every line and every clause. I am satisfied that the editor and readers of the Daily Record will be confident that the Bill meets the Smith commission recommendations in full when we complete that process. [Interruption.] No, we have dealt with that issue. [Interruption.]
Order. We cannot have argument by gesticulation. The right hon. Member for Gordon (Alex Salmond) is a seasoned observer—he does not have the excuse that he is a newcomer to the House—and he has a sort of cheeky chappie countenance, but I am afraid that it will not wash at this stage. He will have to try his luck later.
I fear there is a lot of cheek still to come.
Over 18 years, the devolution of power and decision making from this Parliament to the Assemblies of Wales and Northern Ireland and to the Parliament in Scotland has changed the constitutional make-up of the United Kingdom fundamentally. I was proud to be elected as a Member of the new Scottish Parliament at its inception in 1999—indeed, I was the first MSP to ask a question in that Parliament on the opening day, so I draw from my experience of the Scottish devolution settlement as I take this Bill forward.
Even though some had doubts at the time, few would now deny that devolution has been a success story for Scotland. It has ensured that decisions affecting our homes and our families, from schools to hospitals to our police service, have been taken closer to the people they affect. As today’s Bill makes clear, the Scottish Parliament is a permanent part of the UK’s constitutional arrangements. The Bill recognises that, and rightly so.
I congratulate the right hon. Gentleman on his new position and on beating off the opposition that he no doubt had in getting it. Does he not have cause to reflect that, whereas the previous Government in which he served as a Minister had the support of about a quarter of the elected Members of this House from Scotland, he is now this Government’s sole representative in Scotland? Does not that place on him a moral obligation to discuss with the elected representatives of the people of Scotland how to take forward this Bill? Is he not concerned that the all-party group in the Scottish Parliament that considered his draft proposals says that they do not equate to the proposals made by the Smith commission?
I was intending to cover a number of the points that the hon. Gentleman raises. I have met the Scottish Parliament committee that was set up in relation to the Bill, and I am going to appear before it to give evidence directly on 25 June. I am in ongoing and constant dialogue with the Scottish Government in relation to this Bill. This very morning, I had a very cordial meeting with John Swinney, the Deputy First Minister, who is responsible for constitutional matters. During the four days when the Bill will be debated on a line-by-line basis, I will be very pleased to hear the suggestions and proposals that come forward from the hon. Gentleman’s group and, indeed, from any Members of this House.
Order. All these things take some acclimatisation, but debate must always go through the Chair. The concept of “you” does not arise, because “you” means me—and I have no views on these matters.
The hon. Gentleman will see that there have been significant changes to the draft Bill—[Interruption.] There have been. If he goes through the Bill in detail, he will see that there are significant changes. [Interruption.] Well, I do not regard the power to give the Scottish Parliament the right to top up all welfare benefits in Scotland as some minuscule change; I regard it as a very, very significant clause in the Bill. It is one of a number of changes that have been made. We have made it very clear that throughout the Committee stage of the Bill we will look at proposals for changes to it. The Scottish Government published some proposed changes to the Bill yesterday—it was nice to see them—and no doubt we will have a greater chance to debate them in detail.
I gather it has been denied. I must say, I would not have lasted long in the House had I been required to sign any such paper. I am innocent of such matters. It is the first I have heard of it and I doubt it will last.

The Smith agreement does not stop at powers over tax and welfare. The Scottish Parliament will receive a transfer of legislative competence in a range of significant policy areas. I cannot list each power in detail now—as I have said, the House will have ample opportunity to scrutinise them in Committee—but I will provide some examples. The Bill will enable the devolution of the management of the Crown Estate’s economic assets in Scotland to the Scottish Parliament and of the management and operation of reserved tribunals to designated Scottish tribunals. The Scottish Parliament will also have additional responsibility over roads, speed limits, road signs and the policing of railways in Scotland, as well as powers over onshore oil and gas extraction—
