Commons ChamberYes. First of all, and I am sure I speak for everyone in the House, I express my sympathies to the right hon. Gentleman’s constituent and his family. The right hon. Gentleman is entirely right to raise the case directly with Sir Robert Francis. I urge Members across the House to look up the details of the Infected Blood Compensation Authority on the gov.uk website and point their constituents in that direction—the authority is already setting out newsletters—and to do as the right hon. Gentleman has done and write directly to the authority. On the basis of being infected through transmission from his mother, his constituent clearly fits the category of an infected person under the scheme. He is precisely the kind of person the scheme is designed to help. The right hon. Gentleman is right to raise the case on the Floor of the House today in this debate.
I am very grateful to the Minister for giving way. This has been a long, long journey for the people who have been affected by this scandal—and that is exactly what it has been. Can he clarify an issue that has been raised about inheritance tax? Given that many payments will be paid to the very elderly, many second generation recipients are worried about inheritance tax. Will they be exempt from inheritance tax? Is that possible?
Yes, the awards are exempt from inheritance tax and capital gains tax. That is precisely how the scheme has been designed. I hope that gives reassurance to the hon. Gentleman.
Let me move on to the points raised by the Secondary Legislation Scrutiny Committee, as it is important that I address them. As the Committee noted, the infected blood scandal stretches back over many decades, and access to records, in particular medical evidence, will be very challenging—I acknowledge that. That is at the very heart, as I am sure hon. and right hon. Members will understand, of the challenge of trying to address an injustice that has been allowed to continue for so many decades. Where that is the case, the authority will need to make objective decisions relying on the evidence that is available in order to determine, on the balance of probabilities, that treatment with infected blood occurred. The authority will—I expect it to do this—provide assistance to those who believe that their medical records have been lost or destroyed, and evidencing eligibility will be easier, faster and more compassionate than, for example, one would experience through any court proceedings.
The Committee highlighted the complexity of the regulations. That is why, alongside the publication of the regulations and the explanatory memorandum, the Government published a detailed policy paper in August on how the compensation scheme will operate, setting out what individuals can expect to receive, including case study examples. Additionally, the Infected Blood Compensation Authority will ensure that appropriate advice and support is available to assist people with managing their compensation awards, accessing financial services and accessing benefits advice where relevant, as I set out in response to an earlier intervention by my hon. Friend the Member for Hartlepool (Mr Brash).
Thirdly, the Committee raised questions on how claimants will receive payments. As set out in recommendation 10 of the infected blood inquiry’s second interim report, the regulations include a mechanism for electing for periodic compensation payments or a lump sum. That is responding to the wishes of those who have told us that they wanted that option to be available to them. We have also provided an alternative for those currently receiving support scheme payments through the infected blood support schemes. The so-called IBSS route was developed following the recommendations of Sir Robert Francis KC, following his engagement with representatives of the infected blood community.
The clearest finding from that engagement was around the continuation of the existing support scheme payments. The Government have listened, and we have agreed and accepted that support scheme payments will continue for life for those who elect the IBSS route. The route will be available for those who applied to be registered on a support scheme on or before 31 March 2025, and delivered as part of the compensation package. The tariff-based scheme is designed to be fast, fair, consistent and secure. We hope that people will be satisfied that they have been provided with full and fair compensation, as the scheme sets out. However, should that not be the case, the regulations make provision for review of decisions made by the authority and for appeals to the first-tier tribunal.

Commons ChamberThank you, Mr Speaker-Elect. I am very glad to be back and very glad to see the results of the election. Many people in Northern Ireland are delighted with it. We look forward to holding the new Government to account for the promises that they have made to the people of the north of Ireland.
I want to take this opportunity to welcome all the new Members—even the ones I profoundly disagree with. The one piece of advice I would give every new Member is to remember that the Speaker does not just chair the meetings; he is the boss. He is in charge of everything around this place and it would do well for you not to fall out with him. In fact, even a bit of sucking up is sometimes good. I want to take this opportunity, as I say that, Mr Speaker-Elect, to congratulate and thank you for all the fantastic work you did over the last Parliament. You were a champion, as you said yourself, for Back Benchers and for the smaller parties. Even when some of us pushed very close to the line, when we felt that certain things had to be put on the record of this House—he knows what I am talking about—you were there to protect us from some of the legal authorities who would like to get at us. Thank you very much for that.
Mr Speaker-Elect, I wish you all the best in corralling this new House. It is very diverse in terms of representation and in terms of opinion. I look forward to the end of tribal politics—I think that will be a sight to behold. Congratulations.

Commons ChamberMy hon. Friend makes an important point. A key principle of our country is that there are the same rules for everyone. On this topic, the Labour leader should show some leadership: stop reading the legal advice; simply publish it and get a grip of the situation. It says a lot about his priorities that, with his famed legal expertise, he is more than happy to help defend Hizb ut-Tahrir but refuses to help his deputy.
The recently published Kenova report makes it clear that the IRA was riddled with British agents from top to bottom. Those agents were involved in the abduction, torture and murder of British and Irish citizens. The British Government—successive British Governments—knew all about it and did nothing. The report also calls for an apology from the Government to those victims. Will the Prime Minister take this opportunity to make that apology?
As the hon. Gentleman will know, the report is an interim one. As the Secretary of State has laid out, we cannot comment on the findings until we get the final report, but we would never condone wrongdoing where there is evidence of that. I will also say, because it is not said enough, that the overwhelming majority of the police, armed forces and intelligence services served with great distinction. They defended democracy in the face of some horrendous violence, and without their service and their sacrifice, there would have been no peace process. They helped ensure that the future of Northern Ireland will never be decided by violence but by the consent of its people.

Commons ChamberMy hon. Friend is a long-standing campaigner for better dental access in his constituency. I congratulate him on the new dental centre that is opening, which I know he worked hard to deliver. I agree that it is right and fair that we seek better value for the significant investment that the taxpayer makes in the education and training of the dental workforce. That is why, as our workforce plan outlined, we are exploring whether a tie-in would ensure that dentists spend a better proportion of their time in the NHS. We will launch a consultation on that policy later this year.
In the week of the anniversary of Bloody Sunday, people in Derry are watching unarmed Palestinians being gunned down by Israeli soldiers. Over 25,000 people have now been slaughtered in Gaza. The Prime Minister has said—he has said it again today—that he wants to see a sustained ceasefire. My question is a very simple one: the next time there is a vote at the UN for a ceasefire, will his representative vote for it?
Of course we will engage with all UN resolutions on their merits. I have been clear that no one wants to see this conflict go on for a moment longer than is necessary. We want to see an immediate pause so that we can get aid in and hostages out, because the situation is desperate for many people there, but a sustainable, permanent ceasefire needs to fulfil a set of conditions, which include Hamas releasing all the hostages, Hamas no longer being in charge of Gaza with the threat of rocket attacks into Israel, and an agreement in place for the Palestinian Authority to return to Gaza to provide governance and services. The Foreign Secretary is in the region. Those are the principles on which we are working, and I believe that those are shared by all our major allies.

Commons ChamberWe have heard much about the many roles that Tony played during his time in politics, in the House, in the Labour party, as a police and crime commissioner, and as the interim Mayor of Greater Manchester. He was also a champion of the underdog, someone we could all learn from and someone I absolutely looked up to. He was a great friend of mine from his time as the shadow Secretary of State for Northern Ireland. I was a newbie in this place in 2019, and he helped me to navigate the corridors and the strange rules that govern this place.
The chair of the parliamentary Labour party, the hon. Member for Leyton and Wanstead (John Cryer), talked about Tony’s tolerance and restraint. I can tell you, Mr Speaker, that when he was the shadow Secretary of State, during a very difficult period in our politics, we put those qualities to the test many times, and in the numerous meetings that I attended with Tony and representatives of other political parties in Northern Ireland, there was not much tolerance and restraint on display, but he was there to calm us all down.
I think it important for me also to say that Tony’s interest in Ireland did not start when he became shadow Secretary of State; it was a decades-long pursuit of truth, justice and peace for the people of our island. His friends in Ireland will never forget him, as he never forgot us. I was delighted to host him in Derry a few months ago for a few pints in a local hostelry, where we had great craic and told great stories, and to see him again in the Strangers Bar for a pint just before Christmas—sometimes we actually met without having pints.
One thing stood out to me on the many occasions on which I saw him after he got sick. We all knew that he was not well, but he wore it so lightly. As others have said, he did not talk about himself or his own illness; he talked about us and asked us questions about how things were going. I think of some of the contributions that he was making in this place at the end of his career. He was talking about arms exports to Israel, he was talking about Rwanda, and he was talking about and advocating on behalf of private tenants who were not being treated properly. He was an advocate for the voiceless until the very end.
I want to extend our sympathy and love to Tony’s family and friends, and to all who loved him. On behalf of the people I represent on our island, I say, “Ar dheis Dé go raibh a anam”. May he rest in peace.

Commons ChamberMy hon. Friend is absolutely right to raise the concerns of his constituents. The Environment Agency’s criminal investigation is ongoing so, as I hope he understands, I cannot comment further on it. However, with regard to his concerns about the measurement inaccuracies, I have been assured—and have checked—that the Environment Agency is working swiftly to understand the scale of the problem. The Environment Secretary is monitoring the situation, and I have asked her to keep my hon. Friend updated regularly.
A few short months ago, the world came to Belfast to celebrate the Good Friday agreement. At the heart of that agreement was the realisation that we could not use violence as a tool for revenge or to achieve our political aims. As 1,400 Israelis and almost 6,000 Palestinians lay dying or dead, when will the Prime Minister say enough is enough? When will he call for a ceasefire? When will he tell Israel to stop meting out collective punishment to the people of Gaza, and when will he and other world leaders insist on a political solution that involves a Palestinian state for the Palestinian people?
As I said, an important principle is that Israel does have the right to defend itself under international law, to ensure that attacks like this one—which was brutal and horrific for its citizens—cannot happen again. We continue to support that position, but, as I said, from the start we have also wanted to ensure that humanitarian aid can go in and hostages and foreign nationals can come out. We recognise that that means there has to be a safer environment, which of course necessitates specific pauses, as distinct from a ceasefire. We discussed exactly this with our international partners yesterday at the United Nations and will continue to do so. As I made clear on Monday, we have doubled down on our efforts to find a better future for the Palestinian people. That has been a feature of all our diplomacy in the region, and we will continue to give all our efforts to making that happen.

Commons ChamberAs I said, we must support Israel’s right to defend itself—to go after Hamas—and recognise that it faces a vicious enemy who are embedding themselves behind civilians, but it will do so in accordance with international law. As a friend, we will continue to call on Israel to take every precaution to avoid harming civilians.
I join the Prime Minister in strongly condemning the despicable, horrendous acts by Hamas last week. It was and is an ongoing war crime. Of course, though, one war crime does not excuse another, so will the Prime Minister please speak to Prime Minister Netanyahu and ask him to stop dropping bombs on innocent children in Gaza? Some of us know all too well that unspeakable violence should not be met with unspeakable violence. We know in Ireland that the only option is to relentlessly pursue peace through dialogue.
I refer the hon. Gentleman to the Israeli President’s words, where he has been clear that the Israelis are working operationally according to the rules of international law. They will exercise their lawful right to defend themselves, and as a friend we will continue to call on them to take every precaution to avoid harming civilians.

Commons ChamberI thank my right hon. Friend for his warm words, which mean a lot coming from a Brexiteer with such long-standing credentials. As someone who has done the job, he knows how difficult these things are, so it means a lot to me and the Government to have his support, for which I thank him.
The brake will work on the basis of the petition of concern mechanism. That mechanism is part of the Good Friday agreement institutional framework, which is why we believe it is the right cross-community safeguard to use. It will be applied to the goods rules in annex 2 of the protocol that were the main cause of concern. It is there for those rules that cause significant and lasting damage and change to the everyday lives of ordinary people in Northern Ireland. Once the emergency brake is pulled, it will give the UK Government a veto. It is a very powerful cross-community safeguard that ensures sovereignty for the people of Northern Ireland, and it is part of why this agreement is the right one for the people of Northern Ireland.
I associate myself with the remarks about Betty Boothroyd, and I join colleagues, particularly my colleagues from Northern Ireland, in sending our love and support to the Caldwell family and every single PSNI officer in uniform today standing up for our peace and democracy.
Although we have some concerns, particularly on the Stormont brake—we will study the detail of this as we go—we are happy that things seem to have moved today. There has been an awful lot of talk, particularly today and in recent months, about the concerns of the DUP and the Unionist community. It is important to remember that the majority of people in Northern Ireland opposed Brexit and want to see the benefits of dual market access properly utilised. Does the Prime Minister agree it is important that his Government now support that dual market access and promote it to international investors?
I thank the hon. Gentleman for his engagement with the Secretary of State and myself in recent weeks. He is right: there is a balance to be struck, and the Good Friday agreement is about respecting that balance—it is about the aspirations and identities of all communities in Northern Ireland. That is what we have sought to achieve with the Windsor framework. As I outlined, something we have heard loud and clear from businesses in Northern Ireland is that they value their access to the single market and they value, as all of us do, not having a hard border between Northern Ireland and the Republic. That is something we have had to bear in mind as we considered these negotiations, but I believe we have struck the right balance and the framework means that this agreement can command the support and consent of communities right across the spectrum in Northern Ireland. I look forward to working with him and his party to deliver it.

Commons ChamberI pay tribute to my hon. Friend for his efforts to progress this project. We are fully committed to securing investment to grow our electric vehicle supply chain. Although he will know I cannot comment on individual commercial negotiations, we announced £350 million of funding for the automotive transformation fund in the net zero strategy to support the development of that supply chain, and I wish him every success in his bid.
Yesterday, BBC Northern Ireland announced cuts to programming and jobs at BBC Radio Foyle, which in my view will leave the station totally unsustainable. The BBC charter places an obligation on the BBC to allow audiences to engage fully on local issues. This decision is a very clear breach of that obligation, leaving licence fee payers outside the Greater Belfast area without proper local programming. Will the Prime Minister act to defend this very important local public broadcasting service?
I believe very strongly in local public broadcasting, and indeed the Government have taken steps to support local media. I will be happy to look at the specific issue the hon. Gentleman raises, and to bring it up with the BBC when I next see them.

I thank my right hon. Friend the Member for Kingston upon Hull North (Dame Diana Johnson) for securing this debate, and for the time that she has spent in her parliamentary life on this issue; it would be well spent on this issue alone, I feel. I also pay tribute to all the campaign groups out there—Tainted Blood, the Contaminated Blood Campaign, Haemophilia Wales, which has been mentioned, and others—which have not just kept the campaign on the parliamentary agenda, but have given help, support and advice to people going through this. That point was made to me again last week by my constituents. Those organisations have been a lifeline, and I thank them on behalf of my constituents.
I urge the Minister in as strong terms as I can to extend interim payments to bereaved parents and families. We are all relieved that some people have interim payments, but all who have suffered must get them, because they are still living with this every day. I, too, want the Department to get on with setting up the systems up now, so that final compensation, once the inquiry is complete, can be paid as fast as possible, with no further delays.
On the issue of the enhanced payment for patients with hepatitis C, stage 1, that scheme is backdated to 2019 in Northern Ireland, but in the rest of the UK it is backdated to 2017. The British Government today have begun acting in the devolved space around budgets, because we do not have a Government, of course, in Northern Ireland. Does the hon. Member agree with me that the British Government should urgently backdate the payments in Northern Ireland to 2017, which is what everybody else has?
I thank the hon. Member very much for that intervention, and hope that the Minister will address it in his closing remarks.
Like other hon. Members, I want to speak about my constituents. I will base my remarks on the Smiths from Newport, who lost their wonderful son Colin in 1990 after he received infected blood products from a prison in Arkansas. Colin was one of 380 children who were infected with HIV. Colin’s mum and dad were among the youngest parents who lost children to this scandal, and they are in an ever diminishing group of bereaved parents who are still alive; many waited for compensation and justice that never came. Over my years as an MP, it has been one of the greatest privileges to get to know the Smith family. Every time I meet them—I met them last week—I am taken aback by their fortitude, dignity and bravery in the face of the disgraceful injustice that they have lived with over all these years. I watched their evidence to the inquiry again last week, and I just do not know how they did it. It is shameful that, other than payments through the Skipton fund, they have never been properly compensated for the loss of their son. It is not about the money; it is about the acknowledgement of a life. Colin may not have been a breadwinner, but he could have been. Like other bereaved parents, they were excluded from the interim payments scheme. Although they themselves were not directly infected by toxic blood products, there is no metric under which the Smiths and others like them could not be considered victims of this scandal.
I do not have time to go through the multitude of indignities suffered by these families, which other hon. Members have alluded to. People painted graffiti saying “AIDS dead” on the side of the Smiths’ house, and they had to move home. Mr Smith lost his job and was not able to get proper employment because he was the father of a child with HIV. The family also suffered financial strain, accruing debt as a result of visiting Colin in hospital, arranging transport and so on. There has been no formal acknowledgement of the indignities that Colin suffered, and he never lived to receive a formal apology or compensation.
The campaign will always fall short because no money can compensate the families, but compensation is still crucial if we are to acknowledge the depth of the failure of the British state. These families were let down in the worst possible way. The Smiths are now in their 70s. Although it is not about the money for them, I want them to live in comfort and to be able to support their surviving children in the years that they have left. That is not too much to ask. We cannot wait more years for this. It is vital that the Government prepare for further recommendations, so that there are no additional waits. The drawn-out process of contacting the solicitors of core participants to gather information for the compensation framework should be undertaken as soon as possible.
My ask for the Minister on behalf of the Smith family is simple. Do not make us call more debates. Please do not make us bring these families to London again and again. Please do not make us tell these deeply painful stories about our constituents again and again. No more warm words from Front Benchers. Please do as my right hon. Friend the Member for Kingston upon Hull North said: pledge, prepare and pay. There is no time, and families have waited far too long already.
I hear what the hon. Lady is saying, but I want to assure her that we take the matter extremely seriously. That is why the inquiry has been set up, why we have engaged fully with it, why we responded immediately to the call for interim payment, why we paid those payments on time and why we will continue to do what is necessary to see that justice is done.
I will now turn to the point raised by the hon. Member for Foyle (Colum Eastwood) on backdating payments for Northern Ireland. I am afraid I will have to write to him on the issue, because I will need to consult colleagues in the Department of Health and Social Care and the Northern Ireland Department of Health. I will write to him as swiftly as I can.
I am grateful for that commitment. Can the Minister bear in mind that we do not have a single Minister in Northern Ireland over any devolved area right now, and that people in Northern Ireland are getting a bad deal as a result of this scheme? The Government today published a budget in the devolved space for Northern Ireland, so what I am asking for is very doable for this Government. Please, please take it seriously.
I understand what the hon. Member is saying, and I will write to him as swiftly as I can.
A couple of Members raised the matter of destroyed medical records, and the inquiry is considering that closely. We expect the inquiry to make findings on this important issue, and we will respond to them as soon as we can after the inquiry reports.
To those individuals and others who are out of scope of the interim payments we have already made, I emphasise that the interim payments that the Government have announced are the start of the process, not the end. There is much work still to be done. Sir Robert’s compensation framework study has been warmly welcomed by the inquiry, and without prejudicing the findings of the independent inquiry, we fully expect Sir Robert’s wider recommendations to inform the inquiry’s final report when it is published next year. Until that time, the Government will continue to work in consideration of the broader recommendations of the compensation framework study so that we are ready to respond promptly when the inquiry concludes its work, as was our intention when we commissioned the study.
There is a point I wish to make that bears much repeating. No sum of money can ever compensate for the turmoil that infected people and their loved ones have faced, but I hope that the interim payments and the further work being undertaken by the Government demonstrate that we will do everything in our power to support them.
