Commons ChamberThe commission’s view is that, as currently drafted, the proposals for a strategy and policy statement are not consistent with its role as an independent regulator. The provisions would enable actual or perceived involvement by the current Government or future UK Governments in the commission’s operational functions and decision making, including its oversight and enforcement of the political finance regime. The scope of the proposed power is significantly broader than similar mechanisms in place for other regulators. If these provisions are not removed, this would allow Ministers from one party to shape how electoral law is applied to them and their political competitors.
It is clear that this power grab will mean risks to democracy. Even under existing rules, we have had party overspending seen as business as usual; that money funding the Tories in Scotland; Tory treasurers who donated £3 million made Lords; dodgy Russian donors; and cash for curtains. That shows the risk. Surely we need more power for the Electoral Commission, rather than a power grab by Tory Ministers.
The commission has made a series of recommendations to improve voter confidence in the regulation of election finance. The proposed new powers for the commission include the power to require information outside of an investigation and to allow data sharing with other regulators. These recommendations were recently echoed by the report of the Committee on Standards in Public Life. The commission will take any opportunities to discuss these proposals further when it meets the Government from time to time.

Commons ChamberOh, so it is all our fault. Well, it is the Conservatives’ fault what is happening in Northern Ireland and for driving the Scots away, because the truth is that the SNP is more similar to the Tories than it lets on.
Today, there are two debates led by the SNP, one on constitutional affairs—independence—and one on Brexit. In fact, they are the same debate, as my right hon. Friend the Member for Leeds Central (Hilary Benn) said, because exactly the same baseless arguments that the Tories made about Brexit, the SNP now makes about Scottish independence. The Tories showed the UK the failings of their own Government and said, “Look, everything will be fine if we are free of the EU.” The SNP is also showing the failings of its own Government and the UK Government and saying, “Look, everything will be fine if we leave the UK.”
In the case of Brexit, every prediction was that we would take a hit to our economy, but that did not matter because we would be free. In the case of Scottish independence, every prediction is that the Scottish economy would take a big hit, but that does not matter, according to the SNP, because it would be free. Both campaigns were and are about narrow nationalism, appealing not to sense, reason or objectivity based on facts, but to emotion stirred by distrust of others. None of the Brexit argument stood up; it was pure ideology. None of the Scottish nationalists’ arguments stands up to scrutiny either; theirs is a pure emotional ideology. I am just waiting for them to roll out “Take back control” as their campaign slogan and the circle will be complete.
I am a wee bit disappointed in the hon. Gentleman’s contribution, because he knows we are better than that. We want a forward-thinking, outward-looking country that is not tied to this backward-looking global Britain. What is wrong with wanting a country where the electorate elect the parliamentarians of their choosing so that they have control?
I am quite happy for the electorate to elect a party and a Government of their choosing. That is what democracy is.
I implore the people of Scotland not to get conned again by impossible promises; not to be hoodwinked by the mirage of the oasis of independence; not to fall for the same tricks that persuaded people to vote for Brexit, because the same bogus arguments are being deployed now for independence, just in a different context; and not to be seduced by the power of the dark side that is divisive nationalism, because ordinary people in Chester have the same problems as ordinary people in Aberdeen and Inverness and Motherwell, as my hon. Friend the Member for Rochdale (Tony Lloyd) said. If the UK is weaker by leaving the EU—and we are—then Scotland will be weaker by leaving the UK.
It could well be that the people of Scotland have had enough of being ruled by the Conservatives. Guess what? So have I. The answer is to get them out, not to stick our heads in the sand and wish them away through the mirage of independence. So I say to the people of Scotland: it may not feel at the moment like a partnership, a brotherhood and sisterhood, a commonwealth—it certainly does not from where I am standing, seeing the destruction that the Tories are wreaking—but England needs Scotland too. Scotland will be weaker out of the UK, and the UK will be weaker without Scotland.
I reckon that a chunk of the SNP’s support is not necessarily for independence, but is an anti-Tory vote—and who can blame people for that? Now, with the outstanding Anas Sarwar leading Scottish Labour, I predict that much of that chunk of support will start to come back to Labour, because now, with real leadership, there will be real scrutiny in Scotland of the effects of independence and the failings of the SNP. The Tories cannot provide that and do not want to provide it; as I have said, they are now the party of petty English nationalism, and the truth is that they do not care if we lose Scotland. But I do care; I am proud to be British—and even more so because Scotland is such a big part of being British. We have a magnificent common shared history. Get the Tories out, ditch this impossible, divisive, corrosive obsession with nationalism, and our shared common future will be brighter.

Commons ChamberThe Electoral Commission works proactively to regulate digital campaigning under the rules currently set out in law. It publishes data on digital spending by campaigners to provide transparency for voters, monitors online campaigning activity and supports campaigners with targeted advice. In 2018, it published a comprehensive package of recommendations that would increase transparency for voters, and it continues to recommend changes that would help voters have confidence about online campaigning.
I thank the hon. Member for that answer. The reality is that we know that Vote Leave did all sorts of myth-spreading using digital campaigning. The same people then moved and masterminded the Tory 2019 general election campaign, so it is no wonder that the UK Government have not done anything yet to change the rules. Does the commission agree that there has to be not only better regulation, but fines that go beyond business-as-usual amounts, so that they are a real deterrent to myth-spreading online?
The commission has recommended that its current maximum fine of £20,000 per offence should be reviewed to ensure that it is proportionate to the income and expenditure of parties and campaigners. As a Member from Scotland, the hon. Gentleman may have noticed that the Scottish Parliament recently increased the commission’s maximum fine for Scottish referendums to £500,000. The commission continues to recommend that its sanctioning powers should be updated by other Governments and for other polls, to provide a more proportionate regime.

It is a great pleasure to see you in the Chair, Mrs Moon. I congratulate my hon. Friend the Member for Warrington North (Helen Jones), the Chair of the Petitions Committee, on introducing the debate. Her speech was comprehensive and extremely well delivered.
I rise to support the BBC and the licence fee, which are often seen as interchangeable by their opponents. The licence fee is often used as a proxy to attack the BBC. The BBC is under attack, whether by the SNP, which is still smarting from the result of the Scottish independence referendum and looking for someone to blame; by activists on the far left, including their deplorable condemnation of Laura Kuenssberg, putting out fake news that she would speak at an event at the Tory party conference; or by those on the right of the political spectrum who say that the BBC is full of lefties—if only it was.
The BBC has to be defended. The hon. Member for Dartford (Gareth Johnson), who is not in his place, talked about the licence fee being the least worst option. In a similar, semi-humorous way, I might suggest that if the BBC is being attacked politically from all sides, perhaps it is getting something right.
I have to say to my good friend, the hon. Member for Kilmarnock and Loudoun (Alan Brown), that he is missing out. He cannot watch everything, because the volume of output from the BBC, across all its channels and radio stations, is so great. There must be something on that he could enjoy and take something from. He is a good friend of mine, but he is cutting off his nose to spite his face. By not watching the BBC, he is missing out. He puts me in mind of the families who cut themselves off from the electricity grid in the 1970s and ’80s, because they did not want electricity generated by nuclear power. They would sit around a candle. I say to him, “Come back. Give the BBC a chance,” because there is some really good stuff on there.
When I last checked, I still had my nose, so I have not cut my nose off to spite my face. It is good of the hon. Gentleman to do the BBC’s bidding and implore me to come back, but I made a conscious choice and truthfully, I do not miss watching live TV. It is interesting that he says there is so much choice, but I do not miss that.
The hon. Gentleman has an excellent and an excellent nose and an excellent face. I am a big fan of Radio 6 Music. I know that politicians are supposed to listen to the “Today” programme, but I do not; I listen to Shaun Keaveny on the breakfast show on Radio 6. The BBC’s flagship programme at the moment is “Blue Planet”. I want to address the point made by my hon. Friend the Chair of the Petitions Committee about the ability to invest in programmes such as “Blue Planet”. There was a remarkable scene a couple of episodes back that involved filming a huge shoal of millions of groupers that were about to spawn, with sharks circling to eat the groupers as they gathered. The film crew went down, but the groupers had not spawned; they went down the next day, and the groupers had spawned and left. So what did the BBC film crew do? They waited a year, and then they came back to a similar area the next year. That level of commitment, investment and astonishing quality would not be possible without the security and certainty that the licence fee gives.

Public Bill CommitteesMy hon. Friend is a parliamentary Mr Loophole, not in the sense that he exploits loopholes, but in that he spots them for the rest of us. It may sound like a far-fetched scenario, but the purpose of the Committee is to go through the Bill in detail and to establish scenarios that might happen. Perhaps the Minister will take up my hon. Friend’s suggestion. I am worried because I do not want our police, whose important job might involve using laser equipment, to be undermined.
I think we are all agreed. I support clause 22, notwithstanding the hon. Gentleman’s comments about a possible loophole regarding the police.
I will quickly talk to amendments 25, 26 and 27, which are very sensible. Amendment 25 confirms that the offence is the intent or actual action of pointing a laser at a vehicle. That is important because we do not want the argument to get hung up on proving whether someone has dazzled somebody or caused a distraction. The offence should be the attempt to point a laser at somebody, and that should be made much clearer in the Bill. For that reason, I support the amendment.
Clause 22(2) states that a person has a defence if they show that they pointed a laser completely accidentally and without intent. The clause also includes a defence for somebody acting in a reasonable manner.
The amendments confirm the offence of pointing a laser at traffic control and, as we have heard, planes. Planes get moved about, not just on take-off but when they are taxiing around the runway. That is also sensible and I would like to hear the Minister’s response.
In Scotland, there have been 150 incidents in 18 months, with 24 at Glasgow airport in February alone. That shows how serious and prevalent the issue is, which is why I welcome the Government’s action in clause 22, but I think it would be strengthened by the amendments.
