Public Bill Committees
Blake Stephenson
I thank the Minister for her comprehensive answer. I am sure the right hon. and hon. Members who put their names to the new clauses will be grateful and will find that useful. I beg to ask leave to withdraw the motion.
Clause, by leave, withdrawn.
New Clause 41
Disapplication of the Human Rights Act 1998 in relation to UK immigration and asylum legislation
“(1) In respect of any provision of any UK legislation relating to immigration, asylum or deportation—
(a) the Human Rights Act 1998 is of no effect and must be disregarded in the interpretation and application of such legislation;
(b) any such provision must be read and given effect to as if there were no mention of or reference to the Human Rights Act 1998.
(2) Where the European Court of Human Rights indicates an interim measure relating to the exercise of any function under any provision of any UK legislation relating to immigration, asylum or deportation—
(a) a Minister of the Crown will decide whether the United Kingdom will comply with the interim measure;
(b) no immigration officer, court or tribunal may give any regard to the interim measure unless a Minister of the Crown decides that the United Kingdom will comply with the interim measure.”—(Matt Vickers.)
This new clause would disapply the Human Rights Act and interim measures of the European Court of Human Rights in relation to UK legislation about immigration, asylum or deportation.
Brought up, and read the First time.
