Labour has a five-point plan to reinvigorate our high streets, in stark contrast to the Government’s worn-out platitudes and failure to act. Precisely when is the Minister going to produce a plan—or will the Government just keep walking by on the other side of the high street?

The tiger that was previously in the library has now been removed, and the immediate danger has been averted. I think the Minister will be familiar with the Merchant Ivory film in which that exchange occurs. [Interruption.] It is fairly obvious, if one applies one’s mind to it.
My hon. Friend the Member for Nottingham East (Mr Leslie) asked a very simple and sensible question. The Minister’s long and rambling answer had a simple summary—clearly, it was no. The Secretary of State repeatedly told us that it was a simple matter to roll over deals on trade with approximately 70 countries, which constitutes 13% of our exports and 12% of our imports—it would be a cut-and-paste job. The Government would be ready on day one after Brexit, he told us. That was never true, was it? Those deals are entirely separate and independent from any deal that we may have with the EU.
If we leave with no deal, can the Minister confirm that these arrangements with third-party countries will fall away, as we have consistently warned? Will he confirm that, without new agreements in place, we could, in the absence of a deal with the EU, have no basis of trade with these countries after 29 March, and would fall back on World Trade Organisation rules? That is an argument for taking no deal off the table if ever there was one.
Will the Minister confirm that many of the terms of those agreements will need to be amended, and could be changed substantively as countries seek to improve on the terms that they have with the EU? Will he also confirm that agreements with countries that have economic partnership agreements are often regarded as being not fit for purpose and are alleged to have been signed under economic duress? The Minister will do well to listen to some of this, as this is the reality of what is going on in his Department. For example, North African countries want to sell their oranges and olive oil to us in far greater quantities than is allowed by the EPAs with the EU, which protect southern European producers.
In the Trade Bill debate in the Lords yesterday, the Minister conceded that the Department had no idea how many countries were ready to roll over their free trade agreements, how many would not, how many would have to adjust their constitutional arrangements, and how long that might take. Will the Minister for Trade Policy confirm that his colleague was right to say so?
The Secretary of State is busy socialising in Davos. Is that not a reminder of the incompetence and overconfidence that he has shown over the past two and a half years?

My suit is from an independent retailer in my constituency, not from M&S.
The Press Association reported last month that 21,000 retail jobs were at risk in the first three months of the year, with administrations at Maplin and Toys R Us, and store closures at New Look, House of Fraser and Carpetright. We now learn that M&S is to close 14 branches this year, and 100 stores by 2022. As we express our fond memories of M&S, may we remember that 872 members of staff will lose their jobs? We need some sobriety in the proceedings here.
High street retailers struggle to compete against out-of-town and online shopping, given their lower cost base, and that is not helped by the long-term squeeze on incomes under this Government. The Government have their much-trumpeted industrial strategy, but where is the retail sector deal? How do they propose to help the affected communities and high streets? The Government must go much further on business rates because the changes simply have not cut through to make the difference needed by high street retailers. What conversations have the Minister and her colleagues had this year with trade unions that represent retail workers?
Unless the Government are prepared to step in to secure a level playing field between our high streets, and online and out-of-town retailers, more shops will close, more high streets will lose key big-name brands, more communities will lose out, and more workers will lose their jobs. The Marks & Spencer closures show that leaving market forces to their own devices is simply not working, and the Government must ensure that there is a fair market in retail for the good of businesses, workers, communities and our high streets.

Commons ChamberPatients at Hightown GP surgery were promised that their surgery would stay open, but, out of the blue, they were written to and told that the surgery would close on 8 June. The Government are belatedly taking action on the shortage of GPs, but will the Minister intervene to make sure that Hightown surgery is kept open and that a promise is kept to patients?

Commons ChamberI do not think the hon. Gentleman represents a north-west constituency.
This Government have done nothing to deliver local rail infrastructure in the north-west, which is vital for jobs and the economy. When are they going to invest in decent local rail services, including those used by my constituents from Southport to Manchester? If the Government will not do it, they should stand aside and let us get on with the job.

Commons ChamberI am most grateful to the hon. Gentleman for his point of order and his courtesy in giving me advance notice of it. It is not for me either to give or to deny the hon. Gentleman permission to hand over the report to the Chair of the Select Committee; the hon. Gentleman must, and I am sure will, take responsibility for his own actions. For my part, I must say to the House, as well as to the hon. Gentleman, that I do not wish to receive a copy. That is for two very good reasons. First, I have a very full reading list, in so far as the hon. Gentleman has the remotest interest in my personal habits. Secondly, and more importantly, I do not wish to receive a copy of the report because however important its contents and however they may be a source of perturbation to many people, they are not a matter for the Chair. Should the Treasury Committee wish to procure this document, I am sure that it could take steps to do so. The hon. Gentleman would also be well advised to take legal advice if he plans wider disclosure of the document he has received.
I can confirm that the hon. Gentleman’s comments in this House are covered by privilege. That is, it has to be said, perhaps just as well, since he has already uttered them. Deliberately misleading a Select Committee of the House would constitute a contempt. The proper course of action for a Member wishing to complain of a breach of privilege is to write to me. There have been a number of examples of this, so I can authoritatively tell the hon. Gentleman that that is the proper course open to him. I hope that that is helpful to the hon. Gentleman and that he will go about his business at least moderately satisfied.
Further to that point of order, Mr Speaker. I have also seen the full report, which refers to an “intentional and co-ordinated strategy by management” and makes clear the responsibility of the RBS board for the mistreatment of small businesses. I have raised this matter through a series of parliamentary questions with Ministers, and I raised it in the debate secured by my hon. Friend the Member for Norwich South (Clive Lewis), but so far the Government have declined to give an opinion on the summary of the report. The full report goes significantly further, and as my hon. Friend said, there is a suggestion that Parliament might well have been misled about what the full report says. RBS is owned by the Government, and the Government should surely be expressing a view about what is in the report, so can you advise me, Mr Speaker, how to go about getting the Government to express an opinion on what is in the summary and what is in the full report and to explain the discrepancies between the two?
The hon. Gentleman invests me with powers that I do not possess: it is not for me to cajole or exhort, or still less to require a ministerial response on this matter, because I simply do not have the locus to do so. What I can say to the hon. Gentleman is that if he desires a ministerial response, there are a number of routes open to him. He can continue his attempt at questioning—he can beetle along to the Table Office if he wishes to table further questions—and there are other mechanisms in the Chamber that he can try if the matter is potentially urgent. I do not know whether it is and I make no guarantee, but he knows what route is open to him if he thinks it could be. More particularly, on the strength of what I have heard, off the top of my head, I say to the hon. Gentleman that if the Select Committee has an interest in this matter, it is perfectly open to it to request a response from a Minister either through correspondence, or by inviting the relevant Minister to appear before the Committee. So the resources of civilisation—and even, indeed, of the House of Commons—have not yet been exhausted on this matter, and I think that should bring a smile to the face of the hon. Gentleman.

Commons ChamberI am grateful to the hon. Gentleman for giving way, but I fear that he may be being a little bit churlish. He has the opportunity now to set out the Labour party’s position in relation to the Bill. He is, of course entitled to go on speculating about what might or could not or should have been debated at this time—as long as you allow him to do so, Mr Speaker—but he has the opportunity to debate this subject now. What does he have to say about it?
Order. I am grateful to the hon. Gentleman for his inquiry. I could not know what the hon. Member for Sefton Central (Bill Esterson) would say until he had said it, but now that he has said it, I can tell him that he should not have said it.
It would be advisable now for the hon. Gentleman to return to the subject of the European Union (Approvals) Bill. I very gently remind the hon. Gentleman, who is quite a seasoned parliamentarian, that it consists of two clauses, of which—and I say this not least for the benefit of those who are attending to our proceedings elsewhere—the second is “Extent, commencement and short title”. The only substantive clause is clause 1. The question of the pay cap is a matter of enormous interest, but it is wholly irrelevant to the question of clause 1 and consideration of the Republic of Albania, the Republic of Serbia, the European Union Agency for Fundamental Rights, and the relationship between the European Union and the Government of Canada in respect of competition law.
Thank you very much, Mr Speaker. You may even have stolen parts of my speech.
Anyway, we have the European Union (Approvals) Bill, with its four draft decisions and two clauses, the second of which—as you pointed out, Mr Speaker—consists of the name of the Bill. Members will be pleased to learn that Labour will not oppose the Bill at this stage. We on the Labour Benches are committed to ensuring that the UK fulfils its responsibilities as a member state of the EU, not least in the very important matter of the progress made by the former member states of Yugoslavia. We will do so until the time of withdrawal from the EU; we will continue to scrutinise EU matters that come before Parliament.
This Bill is the enactment of provisions under the European Union Act 2011 and addresses draft decisions of the Council of the European Union. The first of those relates to the participation of the republics of Albania and Serbia as observers in the European Union Agency for Fundamental Rights, and the second to the signing and conclusion of an agreement between the EU and the Government of Canada regarding the application of their competition laws, which includes the exchange of information between the EU and the Canadian Competition Bureau.
The European Union Agency for Fundamental Rights replaced the European Monitoring Centre on Racism and Xenophobia in 2007. As set out on the Europa website:
“It advises EU institutions and national Governments on fundamental rights, particularly in the areas of: discrimination; access to justice; racism and xenophobia; data protection; victims’ rights; children’s rights.”
The agency’s areas of work have been determined through a five-year framework. The main priority areas include the fight against racism, xenophobia and related intolerance.
EU candidate countries can participate in the European Union Agency for Fundamental Rights as observers. This Bill approves two draft decisions on the participation of the Republic of Albania and the Republic of Serbia as observers in the work of the agency. The decision will not in itself confer observer status on Albania and Serbia, but it will establish that the Stabilisation and Association Councils for Albania and Serbia can determine the conditions of the two countries becoming observers.
As the House of Commons Library explains, under the draft Council decisions, Albania and Serbia would both appoint an observer and alternate observer in the work of the agency’s management board, on an equal footing with the member and alternate members appointed by EU member states, but without a right to vote. They would also participate in initiatives undertaken by the agency and make a financial contribution to it.
In an explanatory memorandum to the European Scrutiny Committee on 22 March 2016, the hon. Member for Esher and Walton (Dominic Raab), who was then and is now a Ministry of Justice Minister, said that the Government support Serbia and Albania becoming observers in the European Union Agency for Fundamental Rights, agreeing that it would assist their accession to the EU which the UK also supports subject to “firm but fair conditionality”.
Albania and Serbia will both make a contribution to the EU budget in order to participate, ranging from €160,000 to €183,000 a year. The draft decisions have been cleared by the European Scrutiny Committee and the Lords European Union Select Committee. The Minister said that this is an opportunity for us to support the progress being made on human rights in the two countries in question, and I completely agree on that.
