Commons ChamberI congratulate my hon. Friend the Member for West Bromwich West (Shaun Bailey) on his articulate speech. He did not use notes, which I will try to replicate.
I also congratulate my hon. Friend the Member for Barrow and Furness (Simon Fell) on introducing the Bill. Before I came here on the train, I looked at the Bills on the Order Paper, and it occurred to me that this Bill might seem simple, but who knew that releasing prisoners on a Friday has the unintended consequence—my hon. Friend the Member for Southend West (Anna Firth) mentioned unintended consequences—of a greater chance of reoffending? That surprised me.
I fully support the Bill, and I hope the Government do, too. The comments of my hon. Friend the Member for West Bromwich West resonated with me on a personal level. I am not an offender, but I grew up in quite a deprived area of Batley and Dewsbury. I had a friend from an early age who, as a late teenager, committed quite a serious crime that, unfortunately, led to his imprisonment. We went our separate ways. He spent quite a number of years in prison. My hon. Friend the Member for West Bromwich West spoke about giving people a second chance, and prison gave this friend a second chance. He turned his life around, but it astonishes me that, had he been released on a Friday, it might not have happened. That is an important point about this Bill.
This friend is now a member of the same gym as me, The Muscle Pit in Dewsbury—“Muscle Pit” is obviously a contradiction in terms as far as I am concerned. My hon. Friends the Members for Milton Keynes North (Ben Everitt) and for West Bromwich West are both gym members.
Ultimately, we need to give offenders every chance we can. It is a problem if releasing them on a certain day of the week does not help. That problem has been well addressed today, for which I pay tribute to my hon. Friend the Member for Barrow and Furness.
There are statistics on reoffending, and my hon. Friend the Member for West Bromwich West alluded to the fact that not everyone will stop reoffending if we release them on a Monday instead of a Friday, but we should do everything we can to help the statistics. There are resources available to support people released from prison in reducing their risk of reoffending.
My hon. Friend the Member for Barrow and Furness has been working with Switchback, an award-winning resettlement charity in London, and it has highlighted the Ministry of Justice data showing that more than 50,000 people are released from prison each year, and of those 40% are reconvicted. That is 20,000 people, which is far too many. Just one in 10 gains work, which is 5,000. What happens to the other 25,000? Reoffending costs society and the taxpayer an estimated £18 billion a year. Switchback found that, in London, two in three were released homeless. One in four had no ID, bank account or phone, so they were out of the system.
Is my hon. Friend aware that, in supporting the Bill, Lord Bird has commented that the link between prison and homelessness is critical and that the Bill is a step towards breaking that link?
I was not aware of those specific comments, but obviously we do not want people sleeping on the streets or rough sleeping. I pay tribute to Kirklees Council and its rough sleeping team. If the Bill alleviated the problem, that would be a benefit, so it should be brought forward. I thank my hon. Friend for that.
Nacro, which has campaigned on this matter since 2018, has also called for an end to Friday releases. It suggests that more than a third of prison leavers are released on a Friday, which piles pressure on to offender managers, responsible officers, local housing authorities, accommodation providers, Jobcentre Plus officers and other community services. I suggest that the impact is wider than just the public sector and those offering such services.
I would like to name-check a number of charities that also want to help offenders. The Blast Foundation equips offenders, ex-offenders and their families to prepare for reintegration into lawful society through mentoring and training. Choices is a counselling service for those facing unplanned pregnancy and child separation. Moving on from what was said by my hon. Friend, HTB shelter and night shelters provide a safe place for rough sleepers in London. Mind provides advice and support to empower anyone experiencing mental health problems. One in Four supports people who have experienced child sexual abuse and trauma, and Prison Fellowship works through its volunteer members to support prisoners in a number of ways. Prisoners and offenders need access to those services as they come back into society. If they cannot have that on a weekend, of course they are more likely to be stood at the prison gates and tempted by the drug dealers and people who want them not to rehabilitate themselves—obviously, from a financial point of view, that would not help them.
A final organisation that I have much admiration for when it comes to prisoners and rehabilitation is Timpson, which does dry cleaning. It does my dry cleaning, although my suit probably needs to go back there next week—you will be pleased to know that I will bring in another suit next week, Mr Deputy Speaker. Timpson does great work with offenders—it has been known to meet offenders at the gates. It may not do that on a Friday—obviously it works on a six-days-a-week basis—but it is there to help stop reoffending.
It is a pleasure to follow my hon. Friend the Member for Loughborough (Jane Hunt) and to speak on this hugely important legislation. I congratulate my hon. Friend the Member for Barrow and Furness (Simon Fell) on bringing the Bill forward. There is so much in there, particularly with regard to its impact on reducing reoffending, but I will talk specifically about the impact on reducing homelessness, which is close to my heart.
Leaving prison is a hugely significant transition for offenders. Once they are out, it takes them a long time to adapt, so starting on the right foot is important. It is therefore vital to get people into stable accommodation. In 2022, two in three of those released from prison were released homeless. Those who are released and are immediately homeless are more likely to reoffend, so that cycle continues.
I welcome the Government’s new accommodation service, which is being rolled out across England and Wales and will support thousands of prison leavers at that crucial time of their life and give them the foundation to work on to rebuild themselves. It is critical that we end the cycle of leaving prison and becoming homeless. On that note, I support the Bill.

Commons ChamberI am interested in exploring my hon. Friend’s point about the scope of the testing. As Members across the House will know, legislating to proscribe drugs is something of a retrospective game because almost every week more drugs appear on the market and in head shops. We seem to be chasing our tail when it comes to these things, and they can be harmful or they can be innocent. Where would he place the limit on the scope of testing?
That has been addressed recently through legislation to ensure that the appropriate Department can incorporate different types of psychoactive substances so that there does not need to be primary legislation on each and every occasion a new substance is named. It is very easy to tinker with one or two of the chemical elements, thereby taking them out of the scope of what is illegal and what is legal. Thankfully, that has been addressed, so it would apply to this proposed legislation as well, making sure that we were not always chasing our tails. I thank my hon. Friend for making that very important point.

Commons ChamberI should start by congratulating the hon. Gentleman on the instrumental role that he played in bringing forward the legislation to which I have just referred. On the question of Sentencing Council guidelines, I understand that the Sentencing Council, which is independent of Government, is in the process of looking at the sentencing guidelines. I hope that it will reflect the very strong feelings on both sides of this House about the seriousness of assaulting an emergency worker and that it will bear that in mind when it publishes those revised guidelines. I am afraid I do not have to hand the number of those being sentenced to more than six months; of course many will be. Where the assault is more serious, it will be prosecuted as grievous bodily harm or GBH with intent, which carry much higher maximum sentences. I am happy to write to the hon. Gentleman with those figures if that will assist him.
We have innovative and ambitious cross-Government action plans to tackle reoffending as part of our uncompromising mission to cut crime. For example, we are introducing GPS tags for serious acquisitive offenders to track their movements for up to 12 months post release and increasing the length of curfews. In January, we announced a £70 million investment, which included enhancing the Department’s approved premises and providing temporary basic accommodation for prison leavers to keep them off the streets and reduce reoffending.
I thank the Minister for that answer. It is jobs that I am interested in. We know that having a job can reduce a person’s chance of reoffending by up to 50%, so what steps is his Department taking to support young offenders to get on the job ladder? I will give a local example here. We have an excellent “Ban the Box” campaign, which Milton Keynes College supports, to end that cycle of reoffending and offer a chance to young people to turn their lives around.
My hon. Friend has identified, with his usual wisdom, one of the three pillars of success post incarceration: a house, a friend and a job. He is quite right and I congratulate Milton Keynes College on its participation in the “Ban the Box” campaign. The Ministry of Justice has also been pleased to support business in the community at the event marking the remarkable milestone, it tells me, of 1 million roles covered by “Ban the Box” in March this year. We adopted “Ban the Box” in the civil service in 2016 and about 350,000 of those 1 million jobs are now in the civil service. More widely, as part of our approach to revising offender management, we are working very closely with colleagues at the Department for Work and Pensions to make sure that those who leave the secure estate have a fair shake in the job market, which, as he rightly said, will go a long way to cutting reoffending.

Commons ChamberI associate myself with the heartfelt and genuine comments from Members of all parties about the tragic circumstances around Sarah Everard’s death. My thoughts are with her family, her friends and her community. It is a terrible time. Opposition Members have sought to equate the policing of Saturday’s vigil with measures in the Bill that are intended to protect the public from disruptive protests, but those measures make up only a small part of the Bill. It is a knee-jerk reaction. It is populist. I think the Labour party will regret taking the decision to oppose the Bill and will find itself on the wrong side of history.
Let us have a look at what the Labour party proposes to vote against tonight. Labour Members will be voting against protecting women and children from sexual abuse; against tougher punishment for perpetrators of serious sexual and violent crimes; against tougher community sentences, which would ensure that offenders give back to society; and against measures giving police the tools that they need to deal with the harms caused by unauthorised encampments—something that is very important to the people of Milton Keynes.
Labour Members will be voting against the introduction of a serious violence duty on specified authorities that will require them to work together to prevent and reduce serious violence; against extending whole-life orders for the premeditated murder of a child; against ending the automatic early release of dangerous criminals; and against life sentences for killer drivers.
The Bill will ensure that those who commit the most heinous of crimes will spend the rest of their lives behind bars. It will ensure that the police will have the powers and support that they need to make our communities safer. As we vote on the Bill tonight, we need to look ourselves in the mirror. We need to be able to look our constituents in the eye. I know that I will be able to look my constituents in the eye; will Labour Members be able to do the same?

Commons ChamberWe have committed more than £4 billion to deliver 18,000 additional prison places across the prison estate by the mid-2020s to support the Prime Minister’s commitment to crack down on crime. Those 18,000 prison places include the 10,000 places being made available through the construction of four new prisons, the expansion of a number of other prisons, refurbishment of the existing prison estate, and the completion of our ongoing prison builds at HMP Five Wells and Glen Parva.
Can my hon. and learned Friend confirm what types of offender will be prioritised for these new prison places and that the most dangerous criminals will be kept off our streets?
We anticipate that the additional places will deliver a mix of places based on population type and category, which will enable us to ensure that prisoners are kept in the right security category according to their risk assessment. In September, the Lord Chancellor published “A Smarter Approach to Sentencing”, which sets out our plans for a system that protects the public. These reforms will ensure that serious sexual and violent offenders and those who are dangerous are kept in prison for longer.

Will my right and learned hon. Friend join me in paying tribute to grassroots organisations such as MK Act in my constituency, which has worked tirelessly to assist victims of domestic abuse throughout the lockdown? I would like to make the House aware of the Open University open justice team, who have collaborated with the charity Support Through Court to launch free online resources to support those dealing with domestic abuse.
I am delighted to hear of the excellent work done by those organisations in Milton Keynes. We fully recognise the role that charities across the country play in providing vital services, which is why we announced £28 million of funding across Government to support domestic abuse charities providing services in safe accommodation and in the community. I am aware of the collaborative work done between the Open University and Support Through Court. That work was funded, in part, by a Ministry of Justice grant.

Commons ChamberStreatham is a place that is very close to my heart. I lived there for many years and had the privilege of being the chairman of Streatham Conservatives and working closely with community groups and the police. I pay tribute to the professionalism of the police and the community groups. We know that the people of Streatham will be coming together at this dark hour to support each other. The incident on Streatham high road was especially tragic because it came so soon after a similar incident at London bridge.
That brings us to why we are here. We have been put here by our electors with an understanding, which is both explicit and implicit, that we will keep them safe. We have a duty to keep our constituents safe—I have a duty to keep the people of Milton Keynes North safe—and we have the power to act on this matter. It is our duty as public servants and human beings to act. Let us be quite clear: those who have been proven to have committed or to have conspired to commit acts of terrorism are enemies of the Crown. As my hon. Friend the Member for Rutland and Melton (Alicia Kearns) put it, they are traitors, and people expect the full application of the law, of justice and of sentences.
