It is a complex situation, but one to which we think we can find an answer. A category of “trusted traders” is certainly something that any competent Government would be looking into, but I do not want to go into the details of the proposals, for reasons that I have already given.
Let us try again. Can the Minister simply confirm that any new physical checks or infrastructure, whether at the border or away from it, would be illegal under the Good Friday agreement and the withdrawal Act passed by the House last year?
I think I have already answered that question in part. I have agreed to write in response to the part that I have not answered, and I will copy the right hon. Gentleman into my response.

That is the first time I have heard that I am popular. I think the hon. Gentleman may very well be misinformed, but I thank him for that. When it comes to rumours, I am slightly conflicted. I am not sure what gives me more pleasure: appearing at the Dispatch Box to answer Opposition questions, or speaking to lobbyists at the Conservative party conference.
People watching will notice that the Minister has been at the Dispatch Box for nearly 40 minutes and has repeatedly failed to answer a simple question, which I will put to him again. In the absence of this House supporting a deal or no deal, how will the Government comply with the Benn Act and leave the European Union on 31 October?
For 40 minutes, I have tried to give a consistent answer. I think that hon. Members do not like that answer.

Commons ChamberYes, it is extraordinary, but it sits with the other evidence that there are not any proposals being put forward and that there are not any negotiations actually taking place. Therefore, we are not closer to a deal now than we were when this Prime Minister took office; in truth, we are further away. That appears from leaks to be the Prime Minister’s chief of staff’s policy position, because he talks of negotiations, apparently, for domestic consumption, yet the talks are a sham.
Will my right hon. and learned Friend reassure me that we will not fall into the trap being set by the Prime Minister, and that we will not support a general election before not only this Bill is enacted, but its provisions, including an extension, have been implemented?
I can confirm that we will not be voting with the Government tonight and that we will keep our focus on the task in hand, which is to ensure that we do not leave the EU without a deal, and that requires the passing and implementation of this Bill.

Commons ChamberI am keen to get this motion passed today. I was very disappointed that some hon. Members, particularly those in the official Opposition, did not feel able to support it last week but, in the spirit of cross-party working, I am trying to be respectful of the reasons why they did not feel able to support it. Coming from the city of Edinburgh, which voted 75% to remain, and the country of Scotland, which voted 62% to remain, and representing a constituency which voted 72% to remain, I understand that it is easy for me to cross this bridge, but it is more difficult for Members in English and Welsh constituencies with different mandates.
Equally, unlike the British Government, who have failed to recognise the fact that Scotland and Northern Ireland voted remain, I am trying to recognise that other parts of these islands voted leave and that, for some people to support this motion, the door cannot be closed on the Brexit process by a revocation to prevent no deal. That is why, with the assistance of lawyers—including Jo Maugham QC who was my fellow petitioner when we took the case to the Court of Justice in Luxembourg to establish that article 50 can be unilaterally revoked—we have crafted the motion in this way. In that connection, I declare my interest in relation to the support of the Good Law Project.
Does the hon. and learned Lady agree that nobody in this House except those who positively want a crash-out, no-deal Brexit should have any problems voting for her motion?
I do agree. I appeal to Members across this House. I know that 10 Conservative Members, including two junior Ministers, voted for this last week. I appeal to anyone who cares about the people who live on these islands and the economy of these islands to prevent a no deal from happening. It is no secret that I came to this House to secure an independent Scotland. That is still my primary aim, but it is not in the interests of Scotland for the Scottish economy to go down the tube with a no-deal Brexit. It is not in the interests of the English, Welsh and Northern Irish economies to go that way, and it is not in Scotland’s interests for the English, Welsh and Northern Irish economies to go that way. Make no mistake about it: if we crash out with no deal, it will be the jobs of ordinary, decent working people that go first. They are the sort of people who vote for the SNP. They are the sort of people who vote for the Labour party and we must protect them.
While the headlines that greeted last week’s indicative votes, saying that they were a shambles and chaos, were patently ridiculous, given that it was the first time that we were given the opportunity to discuss these options after two and a half years of the Government failing to get a consensus, it would be helpful if we made progress today. As other Members have said, that will involve all of us not just sticking to our first preference but voting for our second preference and, indeed, any preference that we can live with. That is certainly something that I shall be doing. I will support Labour’s unanimously agreed conference policy in favour of a public vote, and I am minded to support the motion in the name of the Father of the House. However, I and other hon. Members have concern about that and about the length of the extension, because I do not want the Prime Minister to pocket it, add it to her political declaration and take us out of the European Union on 22 May. I do not think that would be acceptable.
I have similar concerns about the motion in the name of the hon. Member for Grantham and Stamford (Nick Boles). It is better—it takes away all the stuff about the free movement of labour—but it still has only a temporary customs union and could still be bagged by the Prime Minister and added to the political declaration, and we would be out within a few weeks.
I hope that the right hon. Gentleman will recognise that the only way in which the Government can carry this forward, if there is a cross-party consensus, is by bringing in something like the withdrawal agreement and implementation Bill, which would give his party the opportunity to seek to amend it, no doubt with much support around the House, to prevent the eventualities that he is talking about.
I very much hope the right hon. Gentleman is right, and I take his point on that. I also want absolutely to agree with my right hon. Friend the Member for Derby South (Margaret Beckett). If we get progress today and a majority on one or more of these options, my view is that basing the future of our country on a majority that has been agreed in Parliament among Members of Parliament, for whom it might have been not their first preference but their second or third, will lack not only long-term legitimacy but sustainability. It will be impossible for us as a House or for any Government to take this forward without it being ratified in a confirmatory vote by the British public. That is why, whatever happens tonight, I think we are going to have to accept the principle that the Brexit that is now on offer is so different from the Brexit that was offered in 2016 that it would be undemocratic and illegitimate not to give the people a final say on it.
I want to say one last thing about the motion in the name of the hon. and learned Member for Edinburgh South West (Joanna Cherry). I will support that motion and, as I said earlier, I cannot see any reason for anybody—unless they actively want a no-deal Brexit—not to support it tonight. I hope that Labour Front Benchers might support it tonight and that they will support it on Wednesday, if it comes to that, because we have to have an insurance policy against a no-deal, crash-out Brexit. More than 6 million members of our community are demanding it, and I urge all hon. Members, on both sides of the House—it is only a recommendation for Opposition Members—to vote for the motion and to do so with enthusiasm.

Commons ChamberThat is exactly so, and I am very grateful to the right hon. and learned Gentleman for spelling that out so clearly and for lending his support to this motion.
Fellow Members can support this motion even if they are supporting other motions tonight. It should be acceptable to supporters of the current draft withdrawal agreement—for some reason that is not on the Order Paper today, but we might see it later in the week. If an hon. Member wished to support the Prime Minister’s deal, they could also support my motion because it is a failsafe. If an hon. Member wished to support Norway-plus, they could also support my motion because it is a failsafe. And, very importantly, those of us who wish to support a people’s vote can also support this because it is a failsafe. Also, it does not even preclude a general election, because the way the motion is worded makes it kick in on the penultimate day before exit day, which is of course a moving target at the moment; so it leaves the door open to a general election, which I know some of us would quite like to see, particularly the SNP in Scotland as we are riding so high in the opinion polls. But today is about cross-party working and democracy, because the decision that we are taking is of generational importance for the United Kingdom and it ought to be the representatives of the people of the United Kingdom in this House who decide between revocation and no deal, not the Prime Minister of a minority Government.
The hon. and learned Lady mentioned the spirit of cross-party working. She also asked about the Labour whipping arrangements, and I can assure her, as one of those who has signed her motion, that the Labour whip is not to oppose her motion. There is simply a recommendation to abstain, but I am sure that a number of my colleagues will be supporting it.
I am grateful to the right hon. Gentleman for clarifying that and for his support, but I am puzzled why Labour Members would be instructed to abstain on this motion, as it is the only means for them to fulfil their manifesto promise. However, I will leave that to Labour Members, who I am sure will have been receiving the same amount of lobbying as I have—
I am sorry if I was not clear. It is not an instruction; it is a recommendation. That is entirely different when it comes to whipping.
I am grateful to the right hon. Gentleman for clarifying that, and I feel more and more encouraged that many more Labour MPs will support the motion. I will not take up any more time; I simply want to thank all Members who have signed and supported my motion.

Commons ChamberI shall come to that later, but I will make this point. The period should of course be as short as possible, but it must be long enough to determine the purpose. In other words, the purpose has to determine the length. One of the mistakes we have made in the past two years, on which we have struggled and challenged the Prime Minister, is that if we let the clock, rather than the purpose, dictate we end up exactly where we have ended up now.
Does my right hon. and learned Friend agree that it is absolutely ridiculous to suggest the idea of participating in democratic elections this May as the main reason for this House, or this nation, not to do what is in our national interest? It is complete nonsense.
Last week we touched on the difficulty of the EU elections and discussed the legal position and what the political position may be, and we need to bear that in mind. Of greater importance is that, given that we are discussing the future of the United Kingdom and its relationship with the EU, we take time to find the purpose of the extension and a majority that the House can get behind, so that we know why we are seeking the extension. That will begin to answer the question of how long an extension should be for.
I did not think it was possible to feel more outrage at or contempt for the behaviour of this Government and this Prime Minister. The right hon. and learned Member for Beaconsfield (Mr Grieve) said earlier that he had never felt so ashamed to be a Conservative MP; let me reassure him that this is not about party politics. I feel ashamed that we have a Prime Minister who is prepared to behave in this reckless and arrogant way, with total disregard and contempt for Parliament and the views of the majority of people in this country.
At this moment of maximum peril for the United Kingdom, we have a Prime Minister and a Government who resort to trickery, and who say one thing to Parliament and the public one day and do another thing the next. Most Members of this House are prepared to live up to our responsibilities and find a way out of this crisis. If the Government do not allow us to do that, Parliament will have to do it for ourselves.
My message for those Ministers in the Government whom we are told could not under any circumstances contemplate a crash-out no-deal Brexit, some of whom might be prepared to tolerate a less damaging, softer Brexit, or even a public vote, is that the next few days are their chance finally to stand up and be counted and to do what is in the national interest. They have been played. They have been had by this Prime Minister. They have put their trust in her and she has betrayed them. The next few days will be the moment of truth for them: will they finally do what they need to do in the national interest to prevent this kamikaze Prime Minister from driving this country to destruction, for which she and they will never be forgiven?

As my hon. Friend will remember, there were two options. If the deal is adopted by the House, the Government will apply for a short extension of the article 50 period. If it is not—if the deal is voted down or for whatever reason is frustrated—we would have to seek a longer extension. It is not currently the Government’s intention to seek to join EFTA or any other of those organisations. We made it very clear that this was a binary choice: we would have the deal, in which case we would ask for a short extension, or we would have to ask, regrettably perhaps, for a longer one.
The Minister seems to be the only person in this House who thinks the deal can be agreed before this week’s European Council meeting. It is not going to be; let us get real about this. Does he understand something we have been trying to impress on the Prime Minister for some time: the one and possibly the only way she can save her deal now would be to bring it back here and make it conditional on putting it to the British people?
I was very struck during last week’s events about this so-called people’s vote, because my understanding was that the Labour party had suddenly changed its policy in favour of it, but then of course when the amendment came from the hon. Member for Totnes (Dr Wollaston), the Labour party refused to back it, so I and others are in a lot of confusion about the nature of the so-called people’s vote. I am not going to prejudge things; I still think there is a chance that the deal can come back and go through the House, but perhaps I am an eternal optimist.

Will the Minister acknowledge that tabling an amendment with Government support tomorrow to make support conditional on a not-yet-negotiated agreement would fulfil neither the letter nor the spirit of the Prime Minister’s promise?

Commons ChamberI am grateful for that intervention. One of the central problems in all this is that the political declaration is 26 pages long, it is vague in the extreme and simply talks about a “spectrum” of outcomes. The main theme of the political declaration is that the extent of any checks at borders will depend on the degree of alignment; therefore, there is a spectrum of outcomes. I think that we all understood that within hours of the referendum. That is why there is all this pressure on the backstop—because the political declaration is so ill-defined.
Following my right hon. and learned Friend’s replies to the hon. Members for Bracknell (Dr Lee) and for Totnes (Dr Wollaston), does he agree that the Government have clearly rejected Labour’s offer of a less damaging Brexit, and that to wait until the end of March to activate our unanimously agreed conference policy in favour of a public vote would be far, far too late?

Commons ChamberI share my hon. Friend’s concern and will elaborate on that point in just a minute. To build on that comment, as I have been saying for some time, I do not think for one moment that this House is going to accept the binary choice that the Prime Minister will attempt to put before us. A choice between bad and even worse is not a meaningful choice. Nor is leaving the EU on 29 March next year without a deal viable. It has never been viable, and as every day goes past it becomes less and less viable.
I am sure that my right hon. and learned Friend is going to do this in his speech, but one thing that would greatly reassure not only the public but businesses and some of our public services, which are now being forced to spend unnecessarily billions of pounds that would be best spent on other things, would be if he could talk through how Parliament will ensure that no deal cannot happen.
I really think it is the duty of the Government and the Prime Minister to stand at the Dispatch Box and rule out no deal. That is the first thing, and that is the easiest way, because I think the vast majority of Members of the House would agree with it. If the Government will not do that, I am absolutely sure that this House will take the first opportunity to express its view. Whether by way of amendments to the motion in January, through other amendments, or by whatever means, the voice of this House and the majority who will not countenance no deal must be heard and will be heard. I have said it before, but I say it again: I think that deep down this Government and this Prime Minister know jolly well that no deal is not viable. That calls into question the expenditure that has been announced as additional expenditure, not the only expenditure.
