We do think that Israel must do more on deconfliction, but the hon. Gentleman is right that the use of Israeli lawyers in targeting and in the planning of military activity—not dissimilar from what we do in the United Kingdom—is very important. I am grateful to him for the balance that he has expressed, as he always does.

This country used not only to respect but to champion international law. The Minister’s dismissal of ICC procedures today confirms how far the Government have fallen from their adherence to the rule of law. Why are the Government undermining the Court and its British chief prosecutor as he attempts to call those to account for war crimes, including extermination, murder, hostage taking, starvation, targeting civilians and persecution as a crime against humanity?

I am surprised at the hon. Gentleman putting it that way. He is an extremely distinguished lawyer, and I hope he will recognise that the point I am making is that the House is rushing to conclusions that are not merited at this stage in the process.

Spain, Norway and Ireland are ready jointly to recognise Palestine as a state within weeks. Four other European countries look likely to follow suit, and France recently voted to admit Palestine as a full member of the UN. Is it not time that the UK Government joined their European partners in recognising Palestine?

As I have set out previously to the House, we have previously assessed that Israel is committed and capable of complying with international humanitarian law, and that is kept under review. Were there to be any change in the position and view of the British Government in that respect, we would inform the House.

On that matter, the Government do sometimes publish legal position statements. According to the Cabinet Office, on 11 December 2023 the Government published a statement of the legal position in relation to the Safety of Rwanda (Asylum and Immigration) Bill, and it published a similar legal position statement when introducing the Northern Ireland Protocol Bill in July 2022. Will the Minister publish such a statement setting out any breaches of international law by any parties in the Israel-Gaza war?

The hon. Gentleman, who is an enormously distinguished lawyer, is well aware that we do not disclose our internal legal advice, and that has consistently been the position of Governments of both the major parties. We have no plans to change that position.

The hon. Lady uses florid language to describe these matters, but I hope that she will agree that the right thing is to do everything we possibly can to get the hostages out, support the people whom she so eloquently describes, and get support into Gaza, and that is what the Government are seeking to do.

Every month in Hammersmith, we hold “Ukrainian open house” to bring together all those supporting Ukrainian families who have fled that war. Every month, I am asked why there are not similar visa schemes to allow Palestinians to join their relatives in the UK, or to be hosted by families who wish to give them refuge here. What is the Government’s answer to that?

The Government’s answer is that the two positions are not analogous; they are very, very different. The hon. Member will know that we are doing everything we can to help individual cases in both instances, and we will continue to do so.

The weakness in the Minister’s statement is that it makes his Government a commentator rather than an actor in the situation in Gaza. If this House and our international partners speak with one voice in calling for an immediate ceasefire, it would carry more weight with the Government of Israel. If he accepts that the absence of a ceasefire has resulted in the deaths of tens of thousands, and the horrific suffering of 2 million Palestinian civilians, does he not have a duty to call for a ceasefire now? Would that make the Government’s case stronger?

As I have set out, a ceasefire that collapses back into fighting within weeks is not in anyone’s interest. The hon. Gentleman suggests that the Government are a spectator, but nothing could be further from the truth. If he looks at what the Foreign Secretary has been doing, at the way Britain’s humanitarian representative in the Gulf has been acting, and at all the discussions that have been going on in the region and at the UN, he will see that Britain is at the forefront of trying to achieve a humanitarian pause, leading to a sustainable ceasefire, and that is what we will continue to do.

I have 10 and 11-year-old constituents—British citizens—who are stuck in the Israeli fire zone in southern Lebanon. The Foreign Office is urging them to return to the UK, but as their mother is not a British citizen, the Home Office is preventing that. Will the Minister help me to persuade the Home Office to relent on this issue?

I am happy to look at the case that the hon. Gentleman raises immediately after Question Time, if that is convenient to him. The Foreign Secretary is in the region today, not far away from the country that the hon. Gentleman mentions, and I am sure that we will be able to advance the talks that are going on.

My right hon. Friend makes an extremely good point. We and our allies and friends, and virtually everyone in the region, believe that the only answer is a two-state solution, with Palestinians living behind safe borders and Israelis living behind safe borders as well. That is the policy of the Government, this House and the Opposition. We are pursuing it vigorously, as Lord Cameron showed in his many meetings last week.

The Minister said that the Government did not support the reference to the ICJ, but that they support the outcome that justifies that reference. Given those mixed messages, what confidence can we have that he is communicating to his Israeli counterpart that the legally binding orders of the Court must be complied with?

The South Africans are entitled under the rules to refer the matter to the International Court of Justice in the way that they have and, as I have repeatedly said, there will be different views across the House on whether it is helpful to do so at this stage. In respect of what my right hon. and learned Friend says about South Africa, South Africa is a pluralist democracy and there are many different voices that come out of it. Britain has a close, deep and abiding historical relationship with South Africa and we give our advice to the South African Government whenever we have the opportunity to do so.

The Minister says Israeli military action should be targeted on Hamas leaders and operatives. He knows better than anyone that it is not. It disproportionately kills civilians, including children, journalists and health care and aid workers. What steps are the Government taking to restrain Israel from breaking international law, and will he concede that ending trade with illegal settlements is, as a matter of fact and law, unrelated to boycott, divestment and sanctions?

In respect of the discussions to which the hon. Gentleman refers, I can assure him that the British Government hold those discussions all the time. He will know that the Prime Minister has spoken to Prime Minister Netanyahu at least four times and met him in Israel towards the end of October. He has met President Herzog, the ruler of Qatar, King Abdullah, President al-Sisi, António Guterres, President Mahmoud Abbas and Mohammed bin Salman from Saudi Arabia. Those arguments and discussions are going on, and above all we make the point that people must abide by international humanitarian law.

The agenda of the Netanyahu Government is to save him from jail, wreak revenge on all Gazans for the crimes of Hamas, and recreate the Nakba in the occupied territories. The UK Government’s refusal to call for a ceasefire gives cover to this. How many tens of thousands of Palestinian civilians must be killed, and how many millions made refugees, starved or terrorised, before this Government call for it to stop, and to stop now?

I do not agree with the hon. Gentleman that that is the Government’s position; we are not providing cover for anything. We are insistent that international humanitarian law should be accepted and respected, and we will do everything we can to get to the position of a sustainable ceasefire, but, as he will accept, we are not there yet. In the meanwhile, it is important to press for opportunities to get humanitarian aid and support into Gaza, to help people who are in a terrible position.

Britain has increased planned assistance to Palestinian civilians to £60 million, and has delivered over 74 tonnes of aid. The recent pauses in fighting were a welcome opportunity to get hostages out and aid in. We know that more is needed: more fuel, increased humanitarian access and assistance into Gaza, and compliance with international humanitarian law.

Did the Minister see the analysis recently published in the respected Israeli newspaper Haaretz that the proportion of civilian deaths in Gaza is significantly higher than the average civilian death toll in all conflicts around the world during the 20th century? Does that not give the lie to any claim that Israel is avoiding civilian deaths, and as the death toll in Gaza approaches 20,000, is it not now time for the whole international community—including the UK—to support a ceasefire that protects civilian lives?

The hon. Gentleman will know the importance that the Government and Opposition Front Benchers attach to saving civilian lives, and will know that Britain has made it absolutely clear to the authorities in Israel that we expect them to abide by international humanitarian law and understand and accept the rules of war. He will equally know that the unprecedented figures he refers to follow on the back of an unprecedented attack by terrorists on 7 October, a pogrom in which more Jewish people were murdered than at any time since 1945 in the holocaust.

Unfortunately, it was not possible to achieve that compromise when it came to negotiating the UN resolution, but the hon. Member may rest assured that in all these matters Britain is a force for good at the UN in trying to achieve the end aim that everyone in this House agrees is required.

Could the Minister clarify whether the UK Government failed to support the UN Security Council resolution because it did not mention Hamas or because they oppose a ceasefire in any event, or both? If the Government have doubts about Israel’s adherence to international humanitarian law, should they not call for a ceasefire observed by all sides until they are persuaded that Palestinian civilians are not subject to collective punishment?

It is the plausibility of a ceasefire that informed our decisions on that matter, but on the hon. Member’s specific question, we were unable to support the resolution because it did not make an absolute condemnation of what Hamas did on 7 October.

The hon. Gentleman is, of course, right: it is a priority. There is some suggestion that while I have been on my feet in the Chamber, Qatar has announced that the truce will be extended by two days. Obviously we all hope that that is true, and that as a result more hostages will be able to leave.

The Minister is known for his humanitarian instincts. Does he agree that it is unthinkable now to resume the indiscriminate destruction of Gaza and the lives of Palestinian civilians? Is he urging on the Israeli Government the need to find a means of removing the threat from Hamas that does not cost the lives of thousands of women, children and other non-combatants?

The hon. Gentleman speaks with wisdom about the position of civilians. All of us hope that the loss of life among innocent civilians can be minimised, but I would point out to him that the Israeli Government have an absolute right to go after the murderous terrorists of Hamas who perpetrated the dreadful events of 7 October.

UNICEF is one of the most highly respected United Nations organisations and agencies. Britain has consistently been one of the most generous and strong supporters of UNICEF, precisely because of the effectiveness of that organisation. The hon. Lady may rest assured that we will work closely with UNICEF throughout this period, and that we profoundly respect the abilities and reach that UNICEF brings to its work.

Yesterday a mother and five children—all UK citizens in my constituency—finally made it out of Gaza, having experienced sights that no child should witness, literally walking past hundreds of dismembered and decaying bodies to reach safety. If war crimes are committed, they should be investigated. Will the Minister answer the question that he has deftly avoided so far: is there a role for the International Criminal Court in investigating the conduct of all parties to this terrible war?

I do not think it fair to say that I was avoiding the question. I was making the point, which I know the hon. Gentleman will understand, that Britain was one of the first countries to support the ICC—it was not supported by Russia, China or America, as I recall—so Britain’s support and enthusiasm for the work of the ICC should not be in doubt.

I thank my hon. Friend very much for her comments and her support for the statements of condolence across the House today. These discussions take place all the time. I can tell her that the UK is committed to working with all parties to reduce tensions and maintain calm across Israel and the OPT. These discussions do not go forward in leaps and bounds; they are continuous and take place all the time.

It was disappointing that there was no announcement in the Minister’s statement on recognition, on settlement trade and on supporting international law processes in the International Criminal Court or the International Court of Justice. We all agree with the condolences that he has expressed, and we have a debate this afternoon. Will he deal with one point, which is the transfer of a major part of the occupied territories to civilian administration? As a matter of law, that is de facto annexation. What has he addressed specifically with the Israeli Government on that point?

I raised the issue of religious tolerance when I visited the west bank and Israel at the end of last year. The hon. Gentleman’s comments will have been heard by the Foreign Office, which I have no doubt will pursue them.

We need to focus on the real issue of aid, not on red herrings about its misuse by the Palestinians. The fact is that Israel has blockaded Gaza and the checkpoints in the west bank are stifling any attempt by the British Government to bring aid to the Palestinians. What is the Secretary of State doing to make the Israelis co-operate in respect of the aid that Britain and the EU gives to the Palestinians?

Britain has an extremely well-targeted aid and development programme in the Occupied Palestinian Territories. It focuses on building the capacity of the Palestinian Authority to provide good government and support for the two-state solution. It focuses, too, on wealth creation and economic growth, which are important. The third strand principally supports the United Nations Relief and Works Agency, and ensures that we fulfil our humanitarian responsibilities. The programme is very well placed, and we make certain that it achieves all three of those things effectively.
