I would be very happy to come back to the hon. Lady and other Members with an update on that question. It is an evolving situation, but I echo her comments. It is particularly concerning when universities—the training grounds for the next generation—appear to have been hijacked in some places by antisemites: when Jewish students are being intimidated and harassed and Jewish societies have their meetings picketed, with people standing outside shouting abuse and worse. That is completely unacceptable, and we should all support the Department for Education’s work in this area and call on university vice-chancellors to show absolutely zero tolerance for that kind of behaviour—to stamp on it hard wherever they find it.

I thank my right hon. Friend for his statement, and join him in paying tribute to the work of the Community Security Trust. Today, however, the most senior Liberal Democrat councillor in Harrogate and Knaresborough has been exposed for tweeting horrendous antisemitic comments for the past five weeks. She had hundreds of followers, including many senior local Liberal Democrats; she tweeted over 500 times on the subject, and those tweets were read over 10,000 times, so it beggars belief that no Liberal Democrat knew what she was saying. They must have known, but in the five weeks she has been tweeting, they did nothing until it was exposed in the media today.

In our politics, we have seen antisemitism in meetings; we have seen it online; we have seen it in Rochdale; and now we have seen it in Harrogate. Does my right hon. Friend agree that political leaders—indeed, everyone in every political party—must act immediately if they encounter antisemitism in their midst, not wait to see whether anyone notices?

Yes. My hon. Friend is quite right: it is incumbent on political leaders, from whom many other members of the community take their lead, to act immediately, not just when antisemitism gets exposed in the media or when pressure builds, and not because it is convenient but because it is right. Whether it is the example in Harrogate that my hon. Friend gave or, indeed, the recent example in Rochdale, acting immediately from principle is what counts, not just reacting to public pressure a few days later.

Oh, 1986. I was actually five years old then. I was a big fan of it back then.

But why do we need a specific law about this group of people? Why can they not be covered by the laws on the nuisances, insults and harassment that we can all define easily? That is the bit that I find alarming. If people are shooting up in the street or are openly engaged in dangerous practices such as pimping people, we are talking about a different thing, but there are laws covering those things already. If only I were the Minister, I could tell the Committee which ones. I am not him, but I am fairly certain they exist.

My brother, who slept on the streets, said to me, “It isn’t the drugs that will kill me; it’s the stigma. The stigma is the thing that is going to kill me.” He has been clean for seven years, and he said that when he stands at the school gate to pick up his children, he feels like everyone knows he was a homeless drug addict. The idea that you are less—that you are a vagrant, a tramp—never leaves you. That is why I do not want to see people like my brother, who, as I said earlier, was a nuisance to me on many occasions—I just do not want to write that stigma into the law.

I rise to make a couple of points. The Minister made a very important point: we have to get the balance absolutely right here. We have a case in Harrogate at the moment concerning a pavilion in Crescent Gardens that was used by rough sleepers in a series of tents in September. They were there for two weeks, and it has been fenced off ever since.

I have absolutely no doubt that when the hon. Member for Birmingham, Yardley says that she and the British public are not distressed by homelessness, she is absolutely correct. People want to see homeless people supported into accommodation and the underlying causes tackled. At the same time, there was a significant number of complaints from local residents about antisocial behaviour coming from that group of tents. Getting the right balance between protecting communities and offering support to homeless people is very difficult. In our case, we have a very impressive homeless charity, Harrogate Homeless Project, which is next door to my office in the middle of my constituency.

I just want to make sure that the Minister is clear that the balance is critical. I have been much reassured by his words, but it is an important balance, and we are dealing with some of the most vulnerable people in our community.

It has been a good debate, and I am glad to have the opportunity to contribute to it. As we finish this section of the Bill, I have more hope than when we started it, in the sense that I now genuinely believe that we are seeking to do the same thing. The Minister has explicitly said on the record that the Government do not wish to criminalise rough sleeping in general, which is very welcome. I will just say—and this is where the disagreement lies—that that is not reflected in the Bill. The Minister talked about the Bill having a precise, specific and limited definition of nuisance rough sleeping, so that it criminalises only nuisance rough sleeping and not rough sleeping in general. I would argue very strongly that that is not what clause 61 does. It is much broader than that, as I will do my best to demonstrate.

The clause is crucial. It contains the definition, and it makes or breaks whether the Minister’s case holds. The test is in subsection (2). The first limb, in paragraph (a), is that the person must be

“sleeping rough or…intending to sleep rough in a place”.

My hon. Friend the Member for Birmingham, Yardley talked about stigmatising and subjective language, and there is an issue on the point of someone’s “intending to sleep rough”. What is the judgment that an individual is being expected to make? Is it about someone’s appearance? Is it about what someone is carrying? If I am asked by a relevant person, who might be a reasonably junior member of the local authority, where I am sleeping that night and I cannot answer, am I intending to sleep rough? That test would be applied subjectively by a person who may not have very much training. If I looked dishevelled, would that be enough for me to be intending to sleep rough?

The reality is that we will see edge cases, but how will we test them? As I have said, the people we are talking about often have the least recourse to legal support. I would argue that there is nothing precise even about the point of someone’s “intending to sleep rough”. As the Minister said, subsection (2)(b) goes on to describe a person’s

“doing something that is a nuisance”.

Again, that is very much the crux of the debate.

That is an interesting case. I have absolutely no doubt that that is not the Government’s intention, but could this clause be applied to such a case? I would make a strong argument that a member of council staff could say that those people have left rubbish or are capable of it. They do not have to have done it, but by generating rubbish that perhaps blows away, they could cause deposits of waste. Could this clause be used to prevent that activity? Yes, it could. That brings us back to asking whether it is precise, specific and limited, and the answer is no: it fails all three of those tests.

That takes me to the important points made by the hon. Member for Harrogate and Knaresborough. It is about finding a balance, because the public are sympathetic and want to see the issue tackled positively.

Let me be completely clear about this. We will be amending the Offences against the Person Act 1861 so that the language of an existing statutory provision will capture the modern offence of spiking in all its forms, because we recognise that the language in that Act, although it nominally covers the offence of spiking, will not be clear to a member of the public.

I thank the Minister for her statement. Very serious and worrying cases have been raised with me locally, but I know that this is a widespread, national problem, so I strongly welcome these measures, and I pay tribute to the Minister and all who have campaigned on the issue. May I return to the answer she gave on the ability to report anonymously? Does she agree that that is critical both to gaining a better understanding of what is going on and the scale of the problem, and to making it easier for people to come forward and report?

I do indeed think that the ability to report anonymously is a critical part of this. I hope the use of that tool on a national basis will mean that people become accustomed to being able to report these incidents, and that as a result they are reported more widely. I hope that today’s statement will generate publicity, and that we will collectively make this an offence that people will feel much more ready to come forward and report.

Q Sue, you mentioned trading standards. Are you saying that you do not think they do have the powers? As a constituency MP, I have reported to the police the sale of these knives. They have then got trading standards involved, and trading standards went and seized vanloads of this stuff.

Councillor Sue Woolley: Sorry, I am not saying trading standards staff do not have the power. I think, again, it is a capacity issue. We could do with 10 times the number, and that would go a long way towards stopping these knives getting on to the streets in the first place.

Q May I pick up on a point that you made earlier, Councillor Woolley? It was about rough sleeping. You mentioned that this is often about dealing with people with very complex issues; often, having access to addiction services is critical, and progress is made by different agencies working together. I agree very strongly about how making progress and helping those on our streets is most important. Do the provisions in this Bill help or hinder that work?

Councillor Sue Woolley: It helps, but more could be done. On the duties, it would be good if we could have language that said, “We expect, as members of the public, that you will work together.” It would be good if the language, rather than telling various agencies, “You have to do this and you have to do that,” was, “Our expectation is that as organisations, in the first instance, you will work as a team, as a community safety partnership.” If you work as a partnership, everybody has an equal responsibility, and that is the bit that I would really like to see emphasised.

David Lloyd: To underline the concern that I had earlier, there is a real danger, if it is seen that the police have the power to do something about homelessness or rough sleeping, that it might be left for only the police to pick that up. In Hertfordshire, we really believe in, and the whole of our policing is based on, prevention first. In many ways, it would be best if we did not have to use the police at all and everything was done further up the line. I think that if we end up at a point where councils can say, “Well, this is not entirely our responsibility; the police have a responsibility for it,” there is a danger, in the same way as with mental health.

We had the issue with mental health authorities not picking up the issue of people who were mentally unwell. It ended up with the police doing far too much and mental health nurses not enough. I fear that, especially in a time of tight budgets, we may well find that this is pushed more towards the police, so we just need to recognise that. It might be that by working even better through community safety partnerships we get over it. But it is better to go in with our eyes open to it.

That is a good question; I should have touched on that earlier. It is a non-detained site, so the service users—asylum seekers—will be able to leave the site and return at will. There will be some management of that on the door to get the name of who is leaving and who is coming back, although there is always a concern that people will get out by other means as it is a very big site, but the point is that they are non-detained. There is an informal curfew at 10 pm, so there is no requirement for them to come back. Safeguarding calls will be made to them after 10 o’clock if they are not back, but there is no limitation on the number of times that they can leave the site. In fact, they can go and stay overnight elsewhere. They are free to come and go, which is clearly a big concern for the village.

I am sure that this is not the Home Office’s intention, but it appears to me that the village is collateral damage of a wider policy. It cannot be right to put the whole burden of a single national policy, however important it is, on one small community wherever it is in the UK—whether it is in my constituency or not. This is not about my popularity locally or my majority. I know many people in the village and was at school with many of them. It is simply unfair, it is simply wrong and Ministers must think again.

My hon. Friend is making a valuable speech about the implications for that community. Has he had any indication from the Home Office about extra funding that may be available for local services such as extra policing or health? It is a small community facing a very large potential increase in the population. What happens to that funding?

My hon. Friend is absolutely right, and that position is not yet clear. It has been made more apparent recently that there will be that kind of funding, but we have no plan in place. The police, fire and crime commissioner, Zoë Metcalfe, has been very helpful and engaged in the whole process, as have Hambleton District Council, Mark Robson, the leader of the council, and Mal Taylor, the local councillor. Apparently, there will be a double-manned police car in that village 24/7, which is good to hear, and there will also potentially be CCTV in the village, which does not currently exist. Those potential mitigations would help, but it is not clear that those plans will be in place on 31 May when service users move in. I have also not seen a clear plan anywhere.

On the funding of the centre, I understand that money will be made available from Home Office funds, but again that is not clear, which is why we are saying that the plans should be paused until we understand what is needed and how it will be deployed properly.

I have been called all kinds of things on Twitter since I objected to this facility, such as racist, which is complete nonsense. Thirsk and Malton has been welcoming of asylum seekers from all different parts of the world. We have some Syrian families in Malton and we have Ukrainian families all across the constituency, so it is complete nonsense. Nor is it a question of nimbyism. As I said, I would object to such a facility and support other hon. Members—I am delighted to see so much support in the Chamber—wherever it was going to be if that was the wrong location, as this is. We can tell it is the wrong location because Home Office guidance on dispersal is clear that there should be one asylum seeker per 200 head of population. This is on a completely different scale. The only comparable facility that we operate in the UK is at Napier in Folkestone, where there are now 320 service users against a population of 47,000. In this case, there will be 1,500 against a population of 600. Clearly, that is a trebling of the population.

I am always grateful for the constructive way in which the hon. Gentleman approaches these matters. Calls are charged at the local rate. I set out for the House the steps being taken to boost capacity in Her Majesty’s Passport Office but also in relation to the contractors that we work with to deliver these services. It is also the case that, after 10 weeks of proof of travel, within two weeks, the upgrade is free, should that be required. Again, I go back to the fact that 98.6% of passports are renewed within the 10-week timeframe and more than 90% are processed in just six weeks. However, it is right, in terms of the remainder, that we make the interventions we are making to improve matters. We want to see the best service possible delivered and that is precisely what those interventions seek to do.

It is clear that all of us are being contacted by distressed constituents seeking their passports. It can be highly stressful for them to be chasing documents as they approach departure day—and business travel can be at even shorter notice than a planned holiday. I am encouraged to hear that significant recruitment is taking place at the Passport Office and that 1 million passport applications were completed in March alone—that is a good number—but will the Minister look at the progress being made with that recruitment? We clearly have a capacity issue, which we need to get through, and that will only be got through when we have boosted the capacity of those doing the applications.

I thank my hon. Friend for his question. Of course, I and ministerial colleagues recognise the distress caused when individuals cannot receive their passports in the timeframe that they seek. That is why we are taking steps to improve matters. On recruitment, I hear his point about trying to expedite this as much as possible. It is fair to say that we want to see progress made on that as quickly as possible, and I will certainly ensure that Home Office colleagues are sighted on his views. My hon. Friend the Minister for safe and legal migration has that at the forefront of his mind. We want to see that recruitment happen as quickly as possible.

I commend the Minister on this initiative. We have had the most exceptional monarch in Her Majesty, and I believe that Brits, including in Harrogate and Knaresborough, will want to celebrate and mark her incredible service to our country. Raising a pint to Her Majesty in a pub is a fitting way to celebrate her remarkable life and toast her exceptional qualities. The extension of the licensing hours proposed today will be very popular. I support the draft order.

If I may say so, I think the right hon. Lady will be very well aware of the engagement that has taken place in Government on our safe and legal route for Ukrainian nationals coming over to the United Kingdom, and those discussions have taken place across the devolved Administrations. I should also say for the record that the number of people who have come to our country through safe and legal routes stands at over 180,000 right now. Global Britain is doing more than its fair share in the world, and we are leading the world when it comes to safe and legal routes. Finally, I conclude by saying that, when it comes to safe and legal routes, it is those from the right hon. Lady’s party and every party on the Opposition Benches who have voted against the Nationality and Borders Bill, which actually puts safe and legal routes into statute.

My right hon. Friend has highlighted the opening of a reception centre at the former RAF base at Linton-on-Ouse, located between Harrogate and York. Can she give us a bit more information about that—for example, when might it open, what is its capacity and how many local jobs will be created?

I can confirm that the centre will be opening in the next six weeks. Work has been undertaken for several months on the development of the site, including capacity at the site and all the various measures required for the housing and accommodation for asylum seekers.

I refer to my comments earlier, but let me make it abundantly clear for the hon. Lady that in terms of the EU response, we are working in co-operation and collaboration with the EU. There is no doubt about that whatever. The EU has a different approach, but even at this stage it has not agreed the number of people who will go country by country. We are working with them at a very difficult time not only on the humanitarian approach, but on ensuring that we support each country that has been heavily affected not just in terms of border issues, but in receiving Ukrainian refugees. That is a collective response not just from the British Government, but in conjunction with the EU.

I welcome the simplification of the scheme that my right hon. Friend has announced today, and I recognise how hard the job for the Home Office team is. As we make every effort to help those fleeing this crisis, can she provide a bit more information to the House about the surge capacity that she has put in for Home Office staff to process visa applications in countries where the majority of the Ukrainian refugees are fleeing?

Yes, I can. I have already spoken about the increased capacity at visa application centres. I can also tell the House that work is taking place with the MOD in country and in region. For example, we know that one of the main surges is taking place in Poland. That is because Poland is on the frontline and bringing in people from Ukraine in huge numbers. We are supporting the Polish Government in many ways. With that, we will be working with the MOD teams already in Poland not only to surge staffing, but to look at what more we can do to provide wider humanitarian support for Ukrainian refugees in country.

Thank you, Mr Deputy Speaker, for working so hard to get all colleagues in.

The issue of our borders has always attracted attention and the strongest feelings both here in the House and across the country. Judging by my inbox, there are some actions that my constituents want to see taken very promptly. The first is to ensure that safe routes to come here are the primary routes to come here, and that means making them more attractive and it means making the unsafe routes less attractive. What does that mean in policy terms? Well, we can see from the Bill that it means improving support for refugees to help them build their lives in the UK with an enhanced integration package when they come here. It means tackling the process so that it works much better. The speed of processing claims is absolutely woeful. All of us, I am sure, have dealt with difficult cases in our constituency casework of people who have been in the system in limbo for years. It is inhumane, not fair at all, and it needs to be speeded up.

We also have to tackle the illegal route by making the unsafe route less attractive, and that means tackling the evil of people traffickers. This is organised crime, and these are peddlers of misery. My hon. Friend the Member for Ruislip, Northwood and Pinner (David Simmonds) spoke powerfully about how people had died during this process. Improving judges’ sentencing options to include life sentences is a welcome step forward. There are huge links between people trafficking and modern slavery. The hon. Member for East Lothian (Kenny MacAskill) spoke about the links with the sex trade, but it is not just that. There are all sorts of other parts of our economy where modern slavery is an evil. Other measures in the Bill will prove attractive as well, such as the speedier removal of foreign criminals.

Overall we have a system that is broken. That has been fairly clear from comments across the House throughout the two days. It is less clear what the Opposition parties would do about it. They have been keen to use blood-curdling language to criticise those who may take different views, but I am absolutely sure that the Government are right to look for a better system, to promote the legal over the illegal, to focus on need, to tackle organised crime and to support people better when they get here. I want to see a continued focus on the resettlement scheme, tackling the most vulnerable parts of the world’s conflicts and bringing people here from those regions. I am sure all of us want to see support for those fleeing persecution, and I will—
