Lords ChamberThe NHS Medical Director has made it clear that the NHS has carefully planned to make sure that we can deal with additional demand using, as the noble Lord has rightly said, the mobilisation of the Nightingale hospitals and through partnerships with the independent sector. They will ensure that this is rolled out as and when it is needed. I am sure that they will be cognisant of the situation in Blackburn and will be monitoring it very carefully.
My Lords, will the noble Baroness kindly clarify further her response to the noble Lord, Lord Newby? Do the Government plan to relax international travel restrictions to allow for air travel over the Christmas and new year period on the proviso that compliance is upheld in the country of destination? More generally, do the Government anticipate accepting negative test results within any 72-hour criteria being allowed towards the proposed five-day criteria when that test has been taken at an overseas clinic?
On travel over Christmas under the new tier system, people will be permitted to travel abroad, but those in tier 3 areas are being advised to avoid leaving the area for any reason other than work, education or caring responsibilities. The noble Lord may be aware that from 15 December, passengers arriving in England from countries not featured on the travel corridor list will have the option to take a private test after five days of self-isolation with a negative result, releasing them from the need for self-isolation.

Lords ChamberI think we are all aware that, as I said, we will review the restrictions on 2 December and look to ease them on a regional basis, according to the latest data. The Chief Scientific Officer has been clear that we will not be going back to normal in four weeks’ time—if we can remember what normal is now. My noble friend is absolutely right: we want to use this time to make sure that we provide the drugs that have proved to be quite effective and, as I said, start new pilots such as the one in Liverpool, so that we are able to bear down in a more effective way. We must use this time to bring the R rate down and make sure that we have the tools available to keep it down, so that we do not have to go back to further national measures such as these if we can avoid them.
My Lords, I have a quick thought, having listened to the Mayor of Liverpool this morning, about not counting into the statistics those who have multiple tests and were shown to be Covid-free first time around. Thinking of the future with hope, will the Government press for an expansion of the no-tariffs WTO pharmaceutical agreement and an acceleration of the implementation of the WTO trade facilitation agreement? What are the Government planning in preparation for a fair and equitable distribution of any Covid vaccine worldwide that leaves a positive legacy on the global trading system, particularly in relation to no tariffs on medical supplies and to efficient, digitised customs and borders?
I hope the noble Viscount will be pleased to know that, last week, we confirmed that we will join the global COVAX initiative, with the aim of expediting the discovery, manufacture and fair distribution of a vaccine to 1 billion people.

Lords ChamberI agree that we all want to work together to fight this terrible disease. Your Lordships’ House provides a very good model for how constructive discussions can happen. On my noble friend’s point about the 10 pm curfew, public health directors have reported that compliance with social distancing and enforcement of regulations becomes more challenging later in the evening, after people have been drinking. That is part of the reasoning behind the 10 pm curfew, so that drinking does not continue through the evening.
My Lords, the complexities of getting the balance right are immense. While I sympathise with a circuit-breaker strategy that pulls the nation together in regional endeavour and would resolve confusion, why not thereafter reduce risk by restricting or shutting down hospitality but funding it, keeping manufacturing and construction running as normal, and encouraging or even insisting on working from home?
Each tier—medium, high and very high—has a range of restrictions around all the things the noble Viscount rightly says.

Lords ChamberMy Lords, our image externally has not been enhanced, with some bemusement over how we have reached this point. Other noble Lords have underlined what is needed: reaching out, being magnanimous and healing wounds with those of differing Brexit persuasion. Mending differences and closing divides should be the order of the day.
I rise briefly with one or two personal reflections on what has been a traumatic process that has certainly taken its toll. I commend the noble Lord, Lord Callanan, who is not in his place, together with the respective shadow Front-Benchers who collectively have advocated their positions with effectiveness and good humour.
The debate in the UK has been domestic in nature. However, the EU side has, understandably, also stuck to its core principles, and I suspect has, on occasion, accommodated the United Kingdom. Future decision makers might wish to reflect on such contributions, remembering that Brexit should not be a winner-takes-all circumstance. This election will give the electorate the opportunity to express their preferences, but this is where I register my personal regret that the political class has been unable to deliver on Brexit. I accept that the Government have had no choice but to call the election, but it would have been preferable to determine the real will of the electorate in isolation from unrelated grievances.
Finally, there is one point that I wish to belabour. Amid all the talk of extending the franchise to 16 and 17 year-olds and EU citizens, there has not been sufficient consideration of UK citizens living in the EU, who lose the right to vote in general elections after 15 years outside the UK. This group, among the most adversely affected by Brexit, will be anguished not to be able to vote in December, and that includes many thousands in Portugal, where I am resident, and elsewhere on the continent. That said, if I were to offer any suggestion to UK citizens living on the continent, it would be, “Go register with your local immigration authorities in order to spare yourself angst post Brexit”.

Lords ChamberWe have been very clear that, in the event of no deal—which we do not want—we would not put new infrastructure along the border. We very much hope that the EU and Ireland would agree the same. Obviously, in a no-deal situation we would have to have a different set of conversations with the Irish. That is why we are clear that we do not want no deal; it is not the focus of this Government. We want to get a deal and that is why in good faith we have put forward these proposals.
I reiterate—frustrating though it is for everyone in this House—that the House of Commons three times rejected the withdrawal agreement and the backstop that was on the table. So we cannot put it back to the Commons again; we have to do something else. That is what we are trying to do. That is why we have come up with some flexible proposals to have the conversation with the EU in order to get a deal done and move forward to talk about our strong, positive future trading relationship with the EU. That is what we want to move towards.
Picking up on the theme of potential disaster, but nevertheless wishing the Government well in their endeavours to break the deadlock, while I can see complications, some of which have been expressed this afternoon. I hope that Yellowhammer will never need to be tested. However, given its importance—the report on its effectiveness is due out on 16 October, I believe—will the Government give serious consideration to ensuring that the Queen’s Speech allows us the opportunity to debate the contents of this, with appropriate days made available, because it is of such crucial importance? If not, will the Government ensure that, at the earliest opportunity after the Queen’s Speech, proper time will be put aside so that we can consider the contents of the publication?
I am sure that discussions with the usual channels being very constructive will ensure that we will have time available to discuss the issues that noble Lords wish to discuss. I will obviously relay that back to the Chief Whip.

Lords ChamberMy Lords, does the noble Lord think that there are lessons to be learned from this evening? While I originally had considerable sympathy with the guillotine Motion put before us, I fear that it is simply not working. Would it not therefore be more effective to have the whole guillotine Motion removed even from this circumstance and for the Constitution Committee to consider the practicality of such guillotine Motions being used in this regard?
The noble Viscount will realise that I am totally opposed to the whole idea of a guillotine in your Lordships’ House. If it were to be considered, it should certainly be referred to the appropriate committee, but, there again, we come upon the problem of time. We need time to do that, time to absorb it and time to think about it. Rushing it will be bad, and that applies to this guillotine, too.

Lords ChamberMy Lords, in following on from my noble friend I welcome these amendments. I was very pleased to hear the noble Lord, Lord Blunkett, and the noble Baroness, Lady Byford, refer to skills and apprenticeships. I return to a subject which I raised at Second Reading. The noble Baroness, Lady Stowell, and I served on the Joint Committee on the Palace of Westminster and will readily remember the evidence we received regarding the importance of skills. However, we are talking about skills in the heritage sector, where there may be a shortage at the moment, and there could well be lead times in training people to deploy those skills when it comes to R&R.
One of the recommendations which the Joint Committee made in paragraph 306 of its report is that,
“market engagement should begin early, and be facilitated by the early establishment of a shadow Sponsor Board and shadow Delivery Authority”.
I understand that we do not have a shadow delivery authority at the moment, but it would be helpful if, in responding to the debate—if not tonight then in writing—the Minister could tell us what steps have already been taken to pursue that market engagement and identify where there might be bottlenecks, and see what could be actively done at the moment to try to ensure that there will be an adequate supply of skilled tradespeople when the time comes to undertake this important work.
My Lords, sometimes competitive tender can breed low bidding rates, and contractors make up their profits through claims. Is the idea to generate negotiated unit prices or have competitive bidding?

Lords ChamberI thank my noble friend for his question. I am afraid I must disappoint him: while the EU Council gets into a lot of detail, it did not discuss the merits or otherwise of the noble Baroness’s Motion. In fact the EU Council did not discuss Brexit, no-deal planning or the views of the Conservative leadership, but I very much look forward to our debate next week relating to the noble Baroness’s Motion. We look forward to that discussion.
My Lords, do the Government recognise that it is essential that the UK conducts itself at governmental and parliamentary levels with courtesy and respect, is not disruptive for disruption’s sake, and that, more than ever, we need to work on our bilateral and multilateral relationships?
I entirely agree with the noble Lord. That is most certainly the approach that the Prime Minister took at this Council and which we will continue to take in future.
The Prime Minister has been very clear on this point. We have continued to support the nuclear deal, for instance, even though the United States have not, and we will continue to work with our European partners because we believe that this has helped stability. We will continue to talk to Iran on that basis.
Since there is a moment in hand—I apologise to the Leader—it might be worthy of note that the whole question of Iran and Russia, and therefore China, geopolitically, is a moving target that we need to understand fully. Iran is now a potential member of the Eurasian Economic Union so there is a whole new dynamic in world affairs that we need to understand. We in this country need to be on the right side of the future.
I agree with the noble Viscount. There will be a further opportunity at the G20 later this week for us to talk to our global allies about some of these extremely difficult and dangerous issues.

Lords ChamberAs the Statement clearly sets out, if the House of Commons does not pass a meaningful vote, there will then be an opportunity to vote on whether or not it wants to go ahead with no deal.
My Lords, is there now a unified direction of travel of the 27 and the European Parliament? I understand that conflicting messages are coming from within individual Governments about whether or not to support the UK in future on many key matters, including a possible extension of Article 50.
All I can say to the noble Viscount is that since the last Statement the Prime Minister has spoken to leaders of every member state. At the summit over the weekend she had further discussions with President Tusk, Chancellor Merkel, Prime Minister Rutte, President Juncker, Prime Minister Conte and the Taoiseach. Conversations are going well. The EU wants a deal, like we do, so there is a willingness to work together. That is what we are doing. That is why work is intensifying and why the Secretary of State for Exiting the EU, the Attorney-General and the Prime Minister have all being making regular trips to Brussels to make sure that we can get this deal over the line.
