Amendment 70, tabled in the name of my noble friend Lord Kennedy, and with the support of the noble Lord, Lord Paddick, would place in the Bill a provision to exempt the kirpan from the provisions relating to the possession of offensive weapons under the Criminal Justice Act. There is no question that the Sikh community is fully behind tightening the law on offensive weapons. We are all appalled by the toll that knife crime is taking on innocent young lives. The Government have responded to this issue in the Commons but I seek to go further, and that is the purpose and intention of what I am moving today.

The noble Lord, Lord Singh of Wimbledon, raised the issue during the Second Reading debate, and my noble friend Lord Kennedy responded to those legitimate concerns in his speech. Observance of the Sikh faith for practising Sikhs requires adherence to keeping what I understand is called the five Ks, one of which is to wear a kirpan. Larger kirpans are used on many religious occasions such as during Sikh wedding ceremonies. It is fair to say that noble Lords in all parties and on the Cross Benches would be concerned if restrictions in this Bill had unintended consequences for the Sikh community in observing and practising their faith or caused upset or concern where a member of the community was using a kirpan for ceremonial, sporting or historical reasons.

My first ask of the Minister is that she meet my noble friend Lord Kennedy, the noble Lord, Lord Singh of Wimbledon, and representatives of the Sikh community. In asking for a meeting, I put on record that the status quo is not adequate, as it only provides a defence of religious reasons if a person is charged with a criminal offence. It does not cover other reasons such as ceremonial, historical or sporting, where kirpans are offered as gifts to dignitaries. The status quo only provides a defence if a person is charged—the amendment in the name of my noble friend will provide an exemption for the possession of kirpans. The amendment will provide specific reference in the law for the kirpan, which Sikhs have been calling for. Sikhs are a law-abiding community who make a wonderful contribution to the United Kingdom. However, the community still faces difficulties in workplaces, education and in leisure with their kirpans, and this amendment will provide great assistance in education about the kirpan. My Lords, I thank the noble Lord, Lord Tunnicliffe. I shall give just a little background. Sikhs are sometimes referred to as a martial race. The description is wrong on two counts: we are neither martial, nor are we a race. Sikh teachings criticise all notions of race or caste, emphasising that we are all equal members of one human race.

The martial assumption comes from the fact that Sikhs have had to endure being a persecuted minority for many years—at one time, there was a price on the head of every Sikh caught dead or alive. Sikhs have had to develop dexterity with a sword to survive, and, importantly, to protect the weak and vulnerable of other communities in society. Kirpan, the Sikh word for sword, means “protector”, and figures prominently in religious practice and ceremony.

This amendment is particularly necessary to protect the Sikh tradition of presenting a kirpan as a token of esteem. Recipients have included royalty, a former Speaker of the Commons and a police chief. Sikhs are grateful to the noble Lords, Lord Kennedy and Lord Tunnicliffe, for introducing this amendment and for a large measure of cross-party support.

My Lords, I will also speak to the amendment initiated by the noble Lord, Lord Tunnicliffe. As a member of the Sikh community, I know that the kirpan is an important part of our identity. As the noble Lord, Lord Tunnicliffe, rightly pointed out, it is part of the five Ks, particularly for all practising Sikhs.

Adding to what the noble Lord, Lord Tunnicliffe, said, the Sikh community is one of the most law-abiding in this country. This symbol is often very well hidden when worn; it is there as a symbol and nothing more. As the noble Lord, Lord Singh, said, it is often gifted to those who come offering friendship to us. I hope that, given its essence as part of the Sikh community’s cultural identity, this will be one area around which we will all coalesce. I know that both my noble friends take these cultural issues seriously, as does the Home Secretary, and we need to try to find a way of being able to ensure that the Sikh community does not feel that it has not been heard properly by Parliament. I hope that, when the Sikh community comes, the noble Lord, Lord Tunnicliffe, will extend his invitation to all Members who are interested in meeting with them.

I thank the noble Lord for the correction. The spirit of my comment is that we will respect whoever he feels it is appropriate for the Minister and me to meet. I also thank him for his very helpful introduction, which gave us a sense of the historical context of the discrimination that Sikhs have faced over the years, despite their values, which he outlined for us. I thank also my noble friend Lady Verma for her explanation of the importance of the kirpan to the cultural identity of the Sikh community.

While I have great sympathy for the issue raised by noble Lords, a key difficulty with this amendment is how to define a kirpan in legislation in a way that does not open up a glaring loophole that could be readily exploited. A kirpan is only a kirpan in relation to Sikh culture and faith, otherwise it is simply a knife or a sword. In our discussions with the Sikh community, it was made clear that there is no such thing as a standard kirpan. They can come in all forms: some have curved blades and some do not; some have long blades, while others have short blades. The fundamental problem with the noble Lord’s amendment is that it depends on a legally sound definition of a kirpan which until now simply does not exist. The only thing that distinguishes a kirpan from other swords and knives is its use for religious purposes.

Under Section 139 of the Criminal Justice Act 1988 it is already a defence to possess a bladed article, including a kirpan, in a public place with good reason or lawful authority. The legislation is clear that good reason includes religious reasons. Similarly, Section 139A of the 1988 Act, which prohibits possession of a bladed article or offensive weapon on school premises, includes a good reason defence which again includes religious reasons. As the noble Lord is aware, Clause 25 amends the Criminal Justice Act (Offensive Weapons) Order 1988 to provide a religious reasons defence for the possession in private of weapons covered by Section 141 of the 1988 Act, which can include large ceremonial kirpans where they have a curved blade of more than 50 centimetres.

The possession of kirpans for religious reasons is therefore covered under all of the possession offences. In addition to religious reasons, the offences include other defences—for example, for re-enactment activities and sporting purposes, as was mentioned by the noble Lord, and for items of historic importance—but these are not just aimed at kirpans.

Finally, we should be clear that when a kirpan is possessed for non-religious reasons it should be treated like any other bladed article. Crime is unfortunately committed by all parts of our society including, sadly, the Sikh community. Just because something is claimed to be a kirpan does not mean it cannot be used as a weapon, and it is quite right, for example, that the police might want to question why someone is carrying a ceremonial kirpan at three in the morning if they are hanging around a former partner’s home. Clearly Sikhs should be able to own and carry kirpans in public and use them in Sikh martial arts where this is part of their faith. The law already provides for that.

The Sikh Federation (UK) and the Sikh Council UK raised concerns via the All-Party Parliamentary Group on British Sikhs about the provisions.

I wish to put in context that the Sikh Federation (UK) is not a representative body of the Sikh community. Concerns have been raised by the Network of Sikh Organisations. They are trying to capitalise and muddy the waters. It would be helpful if the Government dealt with the Network of Sikh Organisations, which represents the vast part of the Sikh community.

I thank the noble Lord for his advice. As I mentioned earlier, the spirit of our meeting is that we will take his steer on who we should talk to about this. The point I raised simply reflected the fact that those organisations raised concerned with the All-Party Parliamentary Group on UK Sikhs about the provisions in the Bill.

The All-Party Parliamentary Group and the Sikh Federation are one and the same thing. They are exactly the same, and everyone knows it.

I thank the noble Lord for clarifying that point. Concerns were raised on the possession of long kirpans. As a result, the Government amended the Bill to include a defence for religious reasons rather than religious ceremonies, which is narrower. No concerns were raised in relation to any other provisions of the Criminal justice Act. Moreover, members of the Sikh community have been able to carry kirpans in public, including long kirpans, in religious parades—I am not sure whether that addresses my noble friend’s earlier point—and the Bill will not change that. I am therefore not persuaded that a wholesale exemption for kirpans from the provisions in the Criminal Justice Act 1988 is needed. I fully understand the importance the Sikh community attaches to this issue. Indeed, I understand it better thanks to the interventions of noble Lords. With the reassurance of a future meeting, I hope I have been able to persuade the noble Lord that we have the balance right and that he will be content to withdraw his amendment.

My Lords, I too believe that the Bill is both timely and necessary. As a Sikh, I would like to voice my appreciation of the sensitivity shown by the protection of the existing right of Sikhs to wear a short kirpan for religious reasons. However, it appears that the common Sikh practice of presenting a full-length kirpan, or sword, as a token of esteem or appreciation to those who have made a significant contribution to Sikh ideals, such as tolerance and respect for other faiths, has been overlooked and is not currently protected.

The recipients of this honour do not have to be Sikhs. I have made presentations on behalf of the Sikh community to His Royal Highness Prince Charles, when he joined us as the main guest at a major function at the Royal Albert Hall, and to the late Lord Weatherill, the former Speaker of the House of Commons, for his work with the Sikh community in India and Britain. Years earlier, the Sikh community in Leicester honoured Sir John Templeton, founder of the Templeton Prize, after he awarded me the UK equivalent for furthering religious understanding.

For Sikhs, this custom is no less important than the protection given in the Bill to the use of a sword for theatrical performances or for its keeping for historical reasons. Unfortunately, the presentation and keeping of this token of esteem is not protected in the proposed legislation. It is important that, as the noble Lord, Lord Lucas, so eloquently put it, we do not criminalise people unintendedly. On behalf of the UK Sikh community, I will seek a small amendment to the existing wording to ensure that the presentation and receipt of this traditional ceremonial Sikh honour remains protected.

I do agree with the noble Lord that the conflation of Islamism and Islamic is widespread. Not only should we understand where the two terms come from—Islamism, of course, comes from the collapse of the Ottoman empire—but that Islam itself is a peaceful religion and Muslims in this country contribute to the variety and diversity of our country.

My Lords, does the Minister agree that all faiths should be treated equally, and does she deplore the present practice of resources going to those who shout the loudest? There are no comparative statistics on hate crime for different faiths.

I agree with the noble Lord that all religions should be treated equally. The premise of some of our hate crime legislation absolutely underpins that equality in society. No one should feel that hate should be meted out on them because of their religion, the colour of their skin, their sexual orientation or their disability.

I recognise my noble friend’s great expertise in this area. However, I repeat that we believe it is for the Governments of Pakistan and India to initiate an open dialogue. As I said, we are encouraged that the Government of India have appointed an interlocutor but it is for them to initiate the process. However, the absolute wish of Her Majesty’s Government is that those talks should happen and be productive, so that there can be a solution and the types of issues that my noble friend raises can be resolved.

My Lords, the Minister said that both India and Pakistan are friends of this country. Does he agree that friendship has no relevance to the abuse of human rights and that we should be even-handed in our condemnation of human rights abuses wherever they occur?

Human rights are important. Whenever meetings take place between Ministers, be it Mark Field recently and my noble friend Lord Ahmad, human rights issues are always on the table and are always addressed. However, in conflict situations we also need to recognise that there needs to be a dialogue towards a peaceful resolution of the problem, so that human rights, and most crucially, human development, can take place.

My Lords, closing the pay gap between men and women is a really important question, and one that this Government have been very committed to addressing. The noble Baroness will be aware of the work of the noble Lord, Lord Davies. We must ensure that companies are held to account. That is why my right honourable friend Nicky Morgan, the Minister for Equalities, is pressing hard for companies employing more than 250 people to publish what they pay to men and women.

The noble Lord is absolutely right in highlighting the charter. We agree with him that we must push hard for the Commonwealth to meet those commitments under the charter. All forms of discrimination are unacceptable and we will do our bit at CHOGM to raise those questions with the countries that continue to abuse the charter.

My Lords, will Her Majesty’s Government use the opportunity of the summit to ensure a greater commitment to human rights within the Commonwealth by suggesting, on the lines already mentioned, the creation of a human rights task force within the secretariat to monitor and tackle human rights abuse wherever it occurs within this unique and important group of countries?

The noble Lord reiterates what the noble Lord, Lord Chidgey, said. The important thing is that there is a charter and we should ask all countries within the Commonwealth to uphold that charter. We need to push hard. It is not about creating more task forces; it is about pushing and working together to make sure that the Commonwealth is relevant in today’s world. In doing that, I hope that a new Secretary-General will, as part of their commitment and role, push hard for countries within the Commonwealth to adhere to the rules and regulations of the Commonwealth.

My Lords, I am grateful to my friend, the noble Lord, Lord Alton, for securing this important debate. Manipulation of religious sentiment to persecute those of other faiths is a sad feature of human rights abuse in much of the world. I would like to take this opportunity to give a Sikh perspective on possible ways to a fairer and more tolerant society.

When we talk of human rights abuse, we immediately think of countries such as Syria, North Korea and Iran. We rightly condemn their abuses of human rights, but we look more benignly at countries with which we have close political alliances or trade links—as the noble Lord, Lord Parekh, perceptively observed. As the right reverend Prelate the Bishop of Derby reminded us, we should look to the mote in our own eye. If we were consistent, the UN report of a government massacre of some 40,000 men, women and children from Sri Lanka’s Tamil minority and evidence of continuing human rights abuses would have led to that country’s immediate suspension from the Commonwealth pending an investigation.

I will give another example of this less than even-handed approach to human rights. Next year sees the 30th anniversary of the Indian army attack on the Sikh Golden Temple in Amritsar and the subsequent massacre of tens of thousands of Sikhs throughout India. An independent inquiry headed by a former Chief Justice of India found overwhelming evidence of top Congress Party involvement. Yet our Government’s response to this attack on a minority faith was total silence. When I raised the matter with a then Cabinet Minister, I received the reply, “Indarjit, we know exactly what’s going on, but we are walking on a tightrope. We have already lost one important contract”. He was referring to the Westland helicopter contract.

We rightly condemn the use of sarin gas in Syria but were silent over America’s use of Agent Orange in Vietnam—which, even today, is causing horrendous birth defects half a century after its use. The same country’s use of drones to fly over sovereign territory to kill and maim those it does not like and, in the process, kill many innocent civilians sets a dangerous precedent.

I have spoken about our country’s selective approach to human rights only as an example. Other world powers, including India, China, the USA and Russia, behave in exactly the same way, making any co-ordinated approach on human rights virtually impossible. It was the great human rights activist Andrei Sakharov who said that there will be little progress in our universal yearning for peace and justice unless we are even-handed in our approach to human rights.

My hope is that Her Majesty’s Government will take the lead in working for a world in which principle always transcends the interests of trade and power-bloc politics. I firmly believe that our country is best placed to give a lead in this wider view of human rights.

My Lords, it is with a feeling of humility and trepidation that I rise to speak for the first time in this House, particularly after having listened to the earlier words and speeches that were put so movingly.

I shall say a few words on where I am coming from, and what I hope to bring to the House. I started life as a mining engineer, but not long after qualifying, was told by the then National Coal Board that British miners would never accept a Sikh mine manager. I was offered a job in the scientific department but politely declined, seeing it as an opportunity to go and see a bit of India, a country that I left as an infant. Surely people there would welcome me. They did not. I was seen as a Punjabi, and not welcome in the mines of West Bengal, but I stubbornly dug my heels in and gradually became accepted.

I returned to England to take up a post in a civil engineering management consultancy, and though there was some initial hostility, I was soon respected and valued and even assisted in taking a year off to do an MBA. It was while I was with this company that I noticed a strange end-of-day ritual that made me see the lighter side of our attitude to those we see as different.

We were on the fifth and sixth floors of an eight-storey building. Above us were the overseas civil engineers, who clearly thought themselves superior. They would go about with briefcases carrying labels of exotic places visited. At the end of the day they would get into the lift to go home. When the lift got to our floors, a curious thing would happen; those inside would unconsciously stick out their stomachs to give the impression that the lift was a little fuller than it actually was. We would barge in none the less; the stomachs would gradually recede and we all became fellow work colleagues.

The lift would then move to the floors below, occupied by the Department of Health and Social Security. We all joined in in sticking out our stomachs to deter what, in our bigotry, we saw as a lower form of life entering our lift. However, again, they took no notice and got in; the stomachs would grudgingly recede and we all got to the ground floor as fellow human beings—until the next day.

This strengthening of common identity by looking negatively at others is all too common. We see it all too often with a group of people who have been speaking together on a street corner. If one goes away, you can be sure that those remaining will often make some negative comment about the person who has just left, to strengthen their newfound sense of unity. We see it in the behaviour of football crowds. In its most serious form, it can lead to the active persecution of those we call different.

Guru Nanak, the founder of the Sikh faith, saw it in the India of his day some 500 years ago. He reminded us that we are all, men and women, equal members of the same human family and he criticised all notions and distinctions of race, caste or gender. These are 21st-century values being put forward in the 15th century. This theme has been central to my own life: from campaigning against apartheid in South Africa when it was unfashionable to do so, to supporting dissidents in the former Soviet Union and working with Amnesty International, and others, for greater social and political justice for all members of our human family. In this context, I fully endorse all the comments of the noble and right reverend Lord, Lord Harries, about Dalits, and the other remarks made by other speakers.

Some of us are quick to criticise some aspects of life in the United Kingdom but when we go abroad, even to our countries of origin, we see that this country is way ahead of much of the rest of the world—light years ahead in its freedoms, and its understanding and respect of different cultures and ways of life. Our country can take justifiable pride in the way that it has welcomed many from other lands and the lead it has taken in extending human rights, social justice and economic well-being to other parts of the world.

Moving to the central theme of today's debate, some 10 years ago I was invited to join a working group of DfID. I went as a cynic but was soon converted by the passion and genuine commitment of all those involved including, as has been mentioned, many voluntary organisations. I persuaded Sikhs to buy bonds of the GAVI alliance for the mass vaccination of 500 million people and urged the community to support the humanitarian work of DfID with its characteristic generosity. We also established Khalsa Aid, a Sikh charity.

At this time of economic recession, it is tempting to look to our need and ignore the suffering of others; in biblical terms, to cross to the other side of the street. Yet, as the continuing success of Children in Need showed, this is not the way of the British people. The euro crisis, economic difficulties in the United States and the emergence of new, major competitors also remind us that our economic future is inextricably linked to that of other nations, including the very poor. Britain is unique in the way it has led on many issues of justice and in the fight against poverty. It is a tribute to Britain that we are continuing to give assistance, with international development the highest priority. In the past year, Britain's development budget of just short of 0.6 per cent of GDP helped to train more than 95,000 teachers, build or refurbish 10, 000 classrooms, train more than 65,000 health professionals and provide clean drinking water to more than 1.5 million people.

In addition to the ethical arguments, there are strong economic and geopolitical imperatives for helping the poor climb out of poverty. These include the development of soft power and influence in key areas. By 2050, Africa will be a key trading partner, rich in resources with a population of over 2 billion. Understandable reservations about the misuse of aid should be tackled by more stringent checks and never be used as an excuse for doing less or doing nothing.

I could go on, but I am conscious that a maiden speech should be brief. Before I finish, I would like to thank your Lordships for your extraordinary kindness in making me feel so welcome, with particular thanks to the noble and right reverend Lord, Lord Carey, and the noble Baroness, Lady Kennedy, in introducing me to your Lordships.
