Grand CommitteeMy Lords, I am very grateful for the Minister’s comprehensive reply. On Amendment 24, I remain unclear whether the powers in the Bill allow for representatives to have to demonstrate deep pockets. I would be happy to be written to if the Minister cannot reply now. If he could point me in the direction of homework related to Amendment 25, such as the OBR analysis and so on, I would be most grateful.

Lords ChamberMy Lords, I am grateful to my noble friend the Minister for her response. I think that it merely illustrates how far apart we are on the appropriateness of the structure of this Bill that we cannot have a serious discussion about what the curriculum freedoms should be. It is entirely undefined, and the Government say, “We’ll just make it up as we go along in the next few months, and that is what you are allowing us to do if you pass this Bill”. That is where the serious discussions lie; we ought to be having discussions about how the curriculum works. That is the level of responsibility we ought to be taking in this House, and this Bill seeks to take that away from us and place it with the Executive. I am delighted that we have had such unanimity around the Committee on what we think of that as a process.
So far as these individual amendments are concerned, yes, I applaud the diversity, innovation and freedom which the academy structure has had. It will be a problem to move that into a national system, but it will not be impossible. We ought to look at it, because this Bill gives the Government the power to introduce a totally prescriptive national curriculum. They could say what every school was going to do at every moment of every day, and we would have no more right to intervene on that—
My Lords, I am grateful to the noble Lord for giving way. He has really illustrated the puzzle I have: the handbook is clearly working at the moment—we have heard from the noble Lord, Lord Agnew, that interventions can take place in the case of maverick trusts—so why on earth not let that continue, allow the consultation with the sector on the future governance and accountability arrangements, and then bring a Bill in a year’s time when we can actually go through it in detail and scrutinise it effectively? We could also have a statement at the front saying, “This Bill is about the academisation of all schools”. Why not be explicit and say this up front in the legislation, if that is what the Government want to do? Why does it have to be done in this sort of underhand way, and before they have properly worked out with the sector how it is best done? I just do not get it.

Lords ChamberMy Lords, like other noble Lords I pay warm tribute to the noble Baronesses, Lady Newlove, Lady Wilcox, Lady Meacher, and the right reverend Prelate the Bishop of London for their tremendous campaign to deal with this abhorrent crime. It is so pleasing to know that the Government have agreed to put this offence on to the statute book.
I cannot really add to the extraordinary speeches we have heard tonight but I give my support to the noble Baroness, Lady Newlove, in proposing why this Bill—as opposed to the police and sentencing Bill—is the right vehicle for this offence. We have heard in this debate and at Second Reading about the issues facing the police; the problems they have experienced in giving the right attention to non-fatal strangulation and, subsequently, the undercharging of the offence. Surely then, if we want to change this around, it is better for this new offence to be part of a cohesive package of measures in the Domestic Abuse Bill. When the Bill is enacted—as it will be in a few weeks’ time—accompanying the rollout of the new legislation will be a package of training and support measures, so that people in the field are prepared for it. It also makes sense for the police that it is dealt with as a cohesive package of measures.
The third reason why it should be in this Bill is the one spelled out by my noble friend Lady Crawley: we are dealing with an abhorrent crime. This Bill, with its huge support around this House and in the other place, will be law in a matter of weeks. Why wait for a new Bill, which would take months to come through and be enacted? Ministers have shown that they are listening. It is much appreciated. I hope they will listen to our arguments that this Bill is the right vehicle.
My Lords, I too welcome these amendments. However, if this law is going to be passed it should be accompanied by clear advice for the young. Having been guided around TikTok by a young, adult female, there seems to be something of a fashion for strangulation among young women. They say, “I like this”; they say that a boy who will not do it is a pussy, not sexy enough, not interesting enough and not man enough to do what the girl wants. Under those conditions, it is really important that the Government issue clear, unambiguous and easily found advice on the consequences that the introduction of this amendment would have for that sort of activity. I would be grateful if my noble friend would let me know what the Government’s intentions are in this regard, in writing if not this evening.

Grand CommitteeMy Lords, at the heart of many of our debates so far there has been a desire to ensure that there is clear accountability for ensuring that at the end of the day we see the development of high-quality apprenticeships. Given the number of bodies involved and the complexity of the organisation and regulation of apprenticeships and technical education, I do not think there is any surprise that we see some ambiguity around this area. The question raised just now by the noble Baroness, Lady Garden, about the definition of an apprenticeship and how to change it showed some of the complexities that we are struggling with.
The Minister very kindly sent us a chart showing where current responsibilities lie. In summary, they seem to be as follows. The Education Funding Agency funds provision for pre-19 students. The Skills Funding Agency funds provision for students over 19, plus apprenticeships, and operates the apprenticeship service. Ofqual regulates the qualification and awarding bodies, including certain apprenticeships. The Institute for Apprenticeships determines the scope of technical education, sets the criteria and awards licences for the delivery of technical education qualifications; it approves and reviews standards and ensures they are upheld through contractual arrangements. Then there is Ofsted, which inspects the quality of training for level 2 and 3 apprenticeships. The information from the Minister is that HEFCE’s role in relation to levels 4 and 5 is still to be determined.
On any reading, that is a pretty complex picture. Is any one of those organisations responsible, in the end, for high-quality apprenticeships? Which of those bodies does the Minister hold ultimately accountable? For instance, which would be called in by the Education Select Committee, or, as I suspect, would they all be because no one is actually going to take ultimate responsibility?
What about the actions of employers? We know that some apprenticeships fail because of a lack of commitment from employers. My noble friend Lady Cohen described this very eloquently on our first day in Committee. What enforcement powers can be taken against employers who, for instance, undermine the apprenticeship schemes which their employees are on, for one reason or another? Ultimately, if the institute is the nearest we have got to an oversight body, does it have enough clout to ensure that it can influence all the other agencies involved? If the answer to the question is Ministers, what mechanisms do they have to give strategic direction and oversight? My noble friend doubted whether the noble Lord liked to bang heads together. I assume he does like to, but can he and how is it going to be done?
The amendment is a modest but, I hope, useful contribution to this. I have borrowed the concept from health legislation, where we are used to having a number of national bodies—either quangos, quasi-independent or to a certain extent independent—which are under a statutory duty to co-operate with each other. It might be useful to have a similar concept in relation to apprenticeships and technical education, given the diffusion of responsibility among many different organisations. The amendment is modest, but behind it lies the plea that, in the end, there is some organisation that can clearly be held to account for the quality of apprenticeships in future. At the moment, I have some doubts as to whether we can actually do that. I beg to move.
My Lords, I have a couple of questions to add to those of the noble Lord, Lord Hunt. It is important that a single organisation should keep a list of approved qualifications. At present, it is unclear whether this is going to be IFATE or Ofqual. I hope the Committee can have an answer to that. Secondly, I am unclear how far IFATE’s remit goes into the world of commercial qualifications: the sort of things where a commercial training provider will persuade an industry that this is a particular bit of training they should have for their staff; it has some sort of qualification name attached to it but is completely outside the government-funded system. Will IFATE have any influence in this area, or is it entirely outside its remit?

Lords ChamberMy Lords, I have Amendment 92 in this group. I have a long speech on this, but my noble friend has written to the Campaign for Freedom of Information, saying among other things:
“Where possible, we will push to ensure that where functions are transferring to other bodies, the coverage of FOIA is maintained”.
Perhaps I had better listen to him first and then make the speech afterwards.
My Lords, that is an invitation to which I am sure the noble Earl was looking forward. The amendments are clearly concerned with the regulations to be made in exercise of the functions by the board or the clinical commissioning groups, to be known as standing rules. The very words, standing rules, give a clue as to the importance of this part of the Bill.
My Amendment 92ZA concerns the consultation process. New Section 6E(6) of the National Health Service Act 2006, proposed by Clause 17(1), currently states that,
“regulations may require the Board to consult prescribed persons”.
My amendment would replace “may” with “shall”. Given the importance of these matters, there should certainly be a prescribed consultation process.
The noble Earl could perhaps clear up one point about the consultation provisions in this part of the Bill. My reading is that they appear to be confined to an exercise of its functions, by virtue of new Section 6E(4)(b) and new Section 6E(5), which are concerned with the draft terms and conditions and the draft model commissioning contracts. I am sure it is right to consult on these, but I wondered why the consultation appears to be confined just to those. What about the standing rules themselves? Perhaps I have misread Clause 17, or perhaps it is covered by wider consultation requirements elsewhere, but if he were able to reassure me on that I would be grateful.
Amendment 93 is a probing amendment. Under new Section 6E(8), the board,
“may not impose a requirement on only one clinical commissioning group”.
Are there no circumstances in which it would be appropriate for the board to put a requirement on a single clinical commissioning group? I did not understand that, and, again, if the noble Earl could clarify that, it would be helpful. I can reassure him that, like the noble Lord, Lord Lucas, I will not make a long speech on that matter.
I will return to the point raised by the noble Lord, Lord Hennessy. My Amendment 94 would require regulations made under Clause 17 to be affirmative. This Bill is packed with regulating powers. You can hardly move for the regulating powers that have been given to the Secretary of State. The Department of Health is not very fond of affirmative regulations—it has very few affirmative regulations in its legislation compared with other departments—but I think it might have allowed us a few more affirmatives than is currently allowed for. It seems to me that standing rules shape the way the board and clinical commissioning groups go about their business. Given that the intent is to hand over much more authority from the Secretary of State to the board and clinical commissioning groups, I do not think it is unreasonable that matters to do with the standing rules should be subject to the affirmative procedure. I hope that the noble Earl will be able to give some comfort on that matter.

Lords ChamberMy Lords, I am sure that all noble Lords would thank the Minister for this. I wish to ask him a question. Yesterday we debated the small primary school that would have been able to become a foundation trust. Today, we have the announcement of the review of the UEA e-mail issue in relation to climate change scientific research, which in itself raises FOI issues. All of us who have been involved in public authorities know that establishing the apparatus and support mechanisms to deal with FOI requests can be considerable. I can envisage a school, perhaps not so much a primary but a secondary, dealing with admission issues and being subject to FOI requests, which is quite likely. My question for the Minister is: what support mechanism will be put in place to help schools deal with the FOI system, because they will need something.

Lords ChamberMy Lords, I rise with some trepidation in case the noble Lord, Lord Wallace, intervenes to say that we are replicating what we discussed in Committee. However, I think it is fair to make the point that, first, as the noble Baroness, Lady Howe, said in moving the amendment, we did not feel that the Minister responded strongly enough. Secondly, we had a good debate yesterday on Report on the subject of primary schools and academies, and I refer to the remarks of the noble Baroness, Lady Perry, on the role of governing bodies. Thinking back over the past 20 or 30 years to what governors used to do in schools compared with what they do now, there is no doubt that their workload and responsibilities have grown considerably, and I suggest that with academy status more corporate responsibilities will fall on the governing body. This is an important matter. It is also very important to have strong parental involvement, including on the governing body. However, the Bill does not provide for the right signals to be given.
I know that the noble Baroness, Lady Howe, blames the previous Government for the existence of that responsibility, and it is well stated that this legislation on governing bodies follows the previous Government’s legislation on academies. However, as the noble Baroness, Lady Williams, pointed out in Committee, there are reasons for that. We were talking then about developing academies essentially to deal with some of the most challenging situations and communities, and there was genuine concern that some schools would not be able to attract enough parent governors. We are talking now about the extension of academies to schools in general. I should think that it is right to give some kind of signal that we expect strong parental involvement. I therefore ask the Minister whether he will give further attention to this matter between now and Third Reading.
My Lords, this question was asked in Committee but was not answered. Is there an obligation on academies to have elected parent governors, or can they appoint them?

Lords ChamberI do not want to disagree with the noble Baroness, as I agree with the substantive points that she makes in relation to her amendment, but I want to respond to her comments. First, we will wait for Report to hear the Government’s response to the point about consultation, but the fact is that it is not in the Bill. I want assurances that it will not be some fly-by-night consultation but will allow ample time for people concerned to have their say and for that to be considered. On the way in which parent governors are treated under this Bill and under the previous Government’s approach to academies, I, too, drew the distinction that there were specific reasons relating to the situation in which the first academies were created that will not apply where hundreds of academies are being created. However, on the substantive point, I very much share her concerns.
Before my noble friend replies, perhaps I may ask my noble friend on the Front Bench a question. He cited a piece about parent governors being elected. Can he give me the reference to that, because I shared the belief held by my noble friend Lady Walmsley that that was not the case? I would very much like to correct that misapprehension.

Lords ChamberMy Lords, I thank the noble Lord, Lord McNally, for opening our debate and congratulate him on his appointment. He is highly regarded in this House and I look forward to our future debates. It is true that I have not yet sent him a letter, principally because I no longer have the well oiled machinery of the Civil Service to write it, but he has my very warm wishes. I also congratulate the noble Baroness, Lady Neville-Jones, on joining the Government. What a fetching sight the noble Lord and the noble Baroness make, sitting on the Front Bench together. The noble Lord, Lord Bichard, will make his maiden speech today. I pay tribute to him as an outstanding Permanent Secretary and chair of the Legal Services Commission. He has much to offer your Lordships’ House.
I shall focus most of my remarks on constitutional issues and local government, while my noble friend Lord Bach will concentrate on justice and home affairs. However, I first want to respond to what the noble Lord, Lord McNally, suggested about the previous Government. He mentioned authoritarian indifference to civil rights. I remind him that it was a Labour Government who brought in the Human Rights Act, which the Conservative Party opposite continues to snipe at whenever it is given the chance and whatever the coalition agreement. I am proud that we were responsible for the Race Relations Act 2000 and the Civil Partnership Act and that one of the final pieces of legislation that we took through your Lordships’ House was the Equality Act. All those actions were about expanding the rights of the British people. At the same time, a central concern for us was always the security and safety of the UK, which faced the worst terrorist threat that this nation has ever seen. Our aim was always to get the balance right between public protection and the need to maintain the rights of individuals.
The noble Lord has outlined the Government’s proposals on CCTV, ID cards and DNA. We will study those carefully, but we need to be wary of taking actions that might undermine our ability to fight crime. We should not, for instance, underestimate the impact of CCTV in reducing the fear of crime and antisocial behaviour. Talking to people who live in the communities most affected will leave you in little doubt as to the value of CCTV. With DNA, advances in technology have played a critical part in solving serious crimes. Last year alone, 832 positive matches were made in cases of rape, murder and manslaughter.
We will also look carefully at the Government’s policing policies. The programme that the coalition has agreed to has much to say about structural changes but is ominously silent on police resources, front-line policing numbers and crime reduction targets. We shall scrutinise these policing measures carefully to ensure that the safety of our citizens is the paramount consideration.
I turn to constitutional issues. We are promised a new politics, but I have to say that the signs so far are not entirely encouraging. Indeed, many of the Government’s proposals seem more suited to the need to shore up the coalition rather than to enhance our democracy. The Government hardly made a good start with the leaking of the Queen’s Speech over the weekend and then, on Monday, with the announcement of major cuts in government expenditure not to Parliament but to the media.
On local government, the coalition agreement proclaims radical devolution of power and greater financial autonomy to councils. The rhetoric is impressive, but let us look at the reality. The 12 largest authorities in England are to be forced to have a referendum on an elected mayor, whether they want to or not. In education, local authorities will lose powers, influence and budgetary flexibility. The first step towards giving financial autonomy to local authorities is to instruct them to freeze council tax. With the introduction of a democratic element to the NHS and to the police, local government is being bypassed in favour of direct elections. I suspect that the only real freedom given to local government is to decide where the cuts are going to be made.
Nowhere are the needs of the coalition put first more than in its proposals on fixed-term Parliaments. As my noble friend Lord Adonis asked, why is the interval between elections to be five years? Why not four? Of the 14 general elections that have been held in the past 50 years, nine have been in or before the fourth year. Why are the public being given fewer opportunities rather than more to choose their Government?
Then there is the 55 per cent proposal. Votes of confidence have had a critical role in our Parliament; a confidence defeat for a Government leads either to a request for Dissolution or to the resignation of the Government. As the noble Earl, Lord Ferrers, put it so brilliantly on Tuesday, everyone understands that, so why mess around with the principle? The reasons are evolving and changing. Oliver Letwin and Danny Alexander said in the Observer on 16 May that the aim was to guard against the suspicion that one or other of the parties could,
“pull the plug”,
on the coalition,
“and force an early election”.
So this is a quick fix on the constitution, essentially because neither party in the coalition trusts the other. However, the argument has moved on. We had a rather different explanation from David Heath, the Deputy Leader in the other place, who said on Tuesday night:
“If the Government lost a vote of confidence, they would no longer be the Government … Then another party or coalition of parties might be able to form a Government from within the existing House of Commons … If no one can form a Government that has the confidence of the House, Parliament will be dissolved”.—[Official Report, Commons, 25/5/10; cols. 148-49.]
That still raises a number of questions about how it might happen and the logic of 55 per cent. I remain concerned that what looks like major constitutional change is being written on the back of an envelope with apparently no intention for pre-legislative scrutiny. I can assure the noble Lord—
Does the noble Lord remember the abolition of the Lord Chancellor? Was that not rather similar?
My Lords, I am sure that the House will learn lessons from that experience. It all looks different from this side of the House. I can assure the noble Lord that we shall certainly scrutinise the legislation carefully.
I now turn to the alternative vote. Will the noble Baroness tell us in her winding-up speech when we can expect legislation on the proposed referendum and when the referendum is intended to be held? Will a threshold be set in terms of the turnout and the size of the majority that is required for a yes vote in the referendum to succeed? Fifty-five per cent, perhaps?
Why is the coalition bent on reducing the number of Members of Parliament? I have yet to see any persuasive arguments for that. Are 70,000 electors really too small a number for an MP to represent? The intention for more equal constituency sizes will create some unnatural constituencies, as the Electoral Commission pointed out in February. Constituencies will change more frequently, destabilising the link between MPs and constituents. Again, I suggest that the answer is bound up with a narrow, partisan interest and the proposed speeding up of individual voter registration.
We passed legislation to provide for a carefully staged transition from household registration to individual voter registration in a way that would reduce the risk of people falling off the electoral register, as happened in Northern Ireland. If that careful process is ripped up and the rollout made prematurely, millions of people could fall off the register. I remind the House that that is extremely important because constituency boundaries are drawn on the basis of registered electors. We know from the Electoral Commission that 3.5 million eligible voters are missing from the register today. They are predominantly missing in areas of poorer, younger, mobile populations. It would be wholly unacceptable for seats to be cut and boundaries redrawn on the basis of an electoral register from which millions of our fellow citizens are missing.
I am pleased that the Government are supporting the implementations of the Wright committee’s proposals to make the House of Commons more effective, but what of your Lordships’ House? I noted with interest the remarks made on Tuesday by the noble Lord, Lord Strathclyde, who said:
“I also believe that we should look afresh at our working practices. I do not think we should lose sight of the remarkable privileges that Peers already enjoy, such as the right, not given to Back-Bench Members in another place, to table amendments at three stages of a Bill, and to have each one heard and replied to. We should always keep our working practices up to date”.—[Official Report, 25/5/10; col. 22.]
The noble Lord’s rather late conversion to procedural reform is, on the face of it, most welcome, but I say to him that any attempt to restrict the right of Back-Benchers to scrutinise legislation will be firmly resisted. I am happy to discuss the report of the Labour Peers’ working group, which was in the context of a wider debate about the conventions and the pressing against the boundaries of those conventions by the party opposite at the time.
Finally, I come to reform of your Lordships’ House. The coalition parties have agreed to establish a committee. That is progress indeed. The noble Lords, Lord McNally and Lord Strathclyde, and I have already spent many happy hours in such a committee. I must put a question to the Minister, as I am not sure what the committee is going to be asked to do. It seems that the outcome of its work is already known. He has already said it today: a mainly or wholly elected upper Chamber under PR and a system of grandfathering for the current Peers. So what is left for the committee to do? What will the composition of the committee be? Will its outcome be a White Paper and will a draft Bill be published for pre-legislative scrutiny?
Grandfathering is not really about the transition; it is a term used in the regulation of professions and essentially it means that existing practitioners go forward into the new qualified regulated profession. It is clear that grandfathering means that existing Members become Members of a reformed House. I ask the noble Baroness to confirm my interpretation.
In the mean time, as the noble Lord, Lord McNally, confirmed, we are faced with the apparent intention of the coalition to appoint dozens, if not hundreds, of new Peers. Why is this being done, given that the Government already heavily outnumber the Opposition, with 258 Members compared to our 211? There has long been an understanding that there should be rough parity between the Government and the main Opposition. The noble Lord, Lord Strathclyde, has eloquently put the case for a strong second Chamber. In his Politeia article, he argued:
“The executive may not want a second opinion, but every country needs a Parliamentary system that provides one. Part of that must lie in a strong, independent House of Lords”.
Are those the words of a leading Member of a coalition that advocates swamping the Lords to give the Government an inbuilt and overwhelming majority?
Then there is the question of the conventions. I ask the noble Baroness to confirm that the committee will look at how the current conventions will be underpinned and the primacy of the Commons assured in an elected House. I remind her of the committee of the noble Lord, Lord Cunningham, on the conventions, which made it clear that firm proposals for changing the composition of the House would require a re-examination of those conventions.
The coalition professes that it wants to strengthen Parliament to create a new politics. I would have thought that this should have been grounded in promises that the parties made to the public in the recent election. However, when we look at the proposals to be brought before us, how many do we see that were in the manifestos of the two parties? The Conservatives were certainly silent on a referendum on the alternative vote. They were also silent on fixed-term Parliaments. The Conservatives were silent on the intervals between elections to be fixed at five years, as were, incidentally, the Liberal Democrats. The Conservatives were silent on the 55 per cent super-majority required for the Dissolution of Parliament, as were the Liberal Democrats. The Conservatives were silent on their intention to give the Executive a massive majority in the Lords, as were the Liberal Democrats. We see proposals for major constitutional change that were not put to the British people at the recent election. They were cobbled together behind closed doors. They amount to a lack of trust between the two parties and they will do little—
