I fear that the noble Lord has not read the Home Secretary’s speech closely enough. She asserted that there exist interpretative shifts away from persecution in favour of discrimination, and from well-founded fear towards a credible or plausible fear, and there may be a need to tighten the definition of who qualifies for protection.

My Lords, the Question asked by the noble Lord, Lord Cashman, refers to ill treatment and sexual orientation. When I steered through this Chamber the same-sex marriage legislation relating to Northern Ireland, a friend of mine was sat in the Public Gallery who would have qualified under that law, being an Ulsterman. He had been subjected to conversion therapy. Can my noble friend please convey a message back to the Government that a large number of people in this House would welcome a conversion therapy Bill being introduced in the King’s Speech?

I am afraid that, just like my noble and learned friend Lord Bellamy, I do not know what will be in the King’s Speech, but I will certainly take that point back. The Government remain committed to upholding the rights of LGBT+ people and stand with those around the world facing persecution in relation to their sexuality or gender. No one should be persecuted because of their sexuality or gender identity.

My Lords, I express similar support for the regulations and hope that when the final review is completed in March 2025, we move to a more permanent system of operation. I particularly welcome the support the Prime Minister gave to the extension while these issues were being considered.

I begin by pointing out that I was previously Chief Executive of the British Beer and Pub Association and sat on the other side of negotiations with the Government about the changes of the Licensing Act. I had many a discussion with the noble Lord, Lord Coaker, about not only licensing matters but security matters, which is relevant to the previous debate. I remember sitting discussing such matters with him when the bombing of late-night establishments was attempted.

I want to raise an issue that relates to temporary event notices, and which is not specifically covered by this legislation but arose earlier this summer in the context of the Lionesses’ success in the football World Cup. We should have considered this issue during consideration of the 2003 legislation. I, with others, led the application before the noble and learned Lord, Lord Woolf, to change the interpretation of the law in 2002, when the men’s football World Cup was played in Japan and South Korea. He very sensibly said: “My original judgment was X. I now see that the circumstances have changed”, and the nation was allowed extended drinking hours for the period of the 2002 World Cup. Unfortunately, due to an oversight, the only way that temporary event notices can be extended is with the approval of Parliament. Of course, while the Lionesses were playing Parliament was not sitting, so there was no way that any temporary provision could officially be made. Fortunately, I think in most circumstances the police authorities and local councils were sensible in their application of the intended law.

Although it is outwith the purview of these regulations, when the Minister and his officials review the legislation in question, will they give consideration to circumstances which may arise when Parliament is not sitting, so that temporary event notices can easily be granted in some form or another, without the problems that arose this summer? Otherwise, I wholeheartedly support the regulations as they stand.

My Lords, I also declare an interest—this seems to be the “old hands” thing—having been on the Front-Bench team which debated the original Bill in 2003. Since coming back to this issue, the concerns on both sides have not changed: alcohol, when misused, damages public health and leads to disorder and other things. But traditionally, it is our drug of choice—if you like to put it like that—and the one we use to relax in our society; it is the accepted norm. What is the best way of regulating it and making sure that it is used correctly? We also have a hospitability sector linked to it.

When I read the draft regulations, I was surprised to discover that we still have a coronavirus extension for the hospitability sector, although that makes sense when you run through what has gone on. The overall review of how this will be handled and organised in the future is the important thing—it is the elephant in the room, which is at least opaque at this point time; it is not exactly invisible. When I worked on the original legislation, I discovered that sports clubs did not have the same sort of licensing structure as pubs; they had to be dealt with separately and had been overlooked initially. I suppose that I should declare an incredibly minor interest as a non-playing member of my old rugby club.

If we are going to make this process more coherent, these regulations make some sense. But the points about off-sales and private drinking often leading to domestic violence and more health damage are also important. How will that balance be achieved in the review? That is very important. It is better to have outside control, such as when a barman or manager can literally say to somebody, “You have had too much to drink”. Surely it is preferable to have outside control and influence on somebody, rather than their sitting at home and quietly drinking themselves into oblivion and then occasionally interacting with anybody who tries to interfere with that. What is the Government’s thinking on that? Can they say a few words about that process, what is going on and their input into it? Every time we have discussed alcohol sales, those are the two things we have been trying to balance. I hope the Minister will be able to give us some idea.

To be honest, the outcome on this has a degree of cross-party support; it is not the most political of issues, but people will make ridiculous speeches, usually ranting about a problem after it has been dealt with. There is a constant balancing act. It would be helpful to the House as a whole if we could get some guidance on the Government’s thinking—and indeed that of the Labour Benches, because, let us face it, the reality means that this may well be their problem in about a year’s time.

My Lords, this order was laid before Parliament on 5 September. It proposes an amendment to paragraph 1(a) of Part 3 of Schedule 2 to the Misuse of Drugs Act 1971 to control nitrous oxide under class C of that Act.

After increasing reports of the harms associated with its misuse, the Government commissioned the Advisory Council on the Misuse of Drugs in September 2021 to undertake an updated harms assessment of nitrous oxide. The Government also asked the ACMD to recommend the appropriate legislative control of nitrous oxide.

I am grateful to the ACMD for its updated harms assessment, published in March 2023. While the ACMD did not recommend the control of nitrous oxide under the Misuse of Drugs Act in its assessment, it noted concerning health harms including nerve damage. Its assessment also highlighted anecdotal reports about the association of nitrous oxide with anti-social behaviour as well as the widespread use and availability of the drug, particularly among children and young people.

The Government carefully considered the ACMD’s thorough report and considered a range of factors before reaching a decision. Of particular concern is the popularity of nitrous oxide, given that it is the third most misused substance among 16 to 24 year-olds in England and Wales, with approximately 230,000 young people inhaling it in England and Wales in the year ending June 2022.

In addition to the high numbers of young people misusing nitrous oxide, the ACMD highlighted anecdotal reports of an increase in neurological harms. Noble Lords may have heard of a small number of tragic cases in which young people have been paralysed, or died, following nitrous oxide misuse. Neurology units around the country have reported frequent cases of nerve damage. While many cases of this damage can be treated and even reversed though treatment, sadly not all can. Contrary to the belief of some who might argue that this is a perfectly harmless drug that many people use without consequence, nitrous oxide is not safe to use without medical supervision. Beyond the harmful effects on users themselves, there have been several cases that serve as a testament to the devastating consequences of driving under the influence of nitrous oxide.

In considering our approach, we have also reflected on the reports from those working in front-line policing and night-time industries, and from parliamentarians, about the public effects of nitrous oxide misuse.

People have a right to expect public areas and their neighbourhoods to be safe and clean, even quiet, but in recent years the sight of discarded small silver nitrous oxide canisters, and even more recently the oversized canisters seen on our streets, have become more commonplace. To cite a recent example, an estimated 13 tonnes of discarded canisters were collected in the Notting Hill Carnival clean-up operation. It is entirely unreasonable to expect people to sidestep the paraphernalia and mess associated with nitrous oxide misuse. Neither should anyone have to feel threatened by anti-social behaviour associated with its misuse.

The Government are taking decisive action to tackle anti-social behaviour through a comprehensive action plan, and noble Lords may recall that in March we announced our intention to ban nitrous oxide. As a result of the considerations I have outlined, the Government are taking action beyond that recommended by the ACMD and seeking to control nitrous oxide as a class C drug under the Misuse of Drugs Act. We are doing this to introduce tougher consequences for the supply and misuse of nitrous oxide, and to deter people from harming not only themselves but others.

At present, nitrous oxide is subject to the provisions of the Psychoactive Substances Act 2016 as it is a psychoactive substance. The 2016 Act contains offences for the production, supply, possession with intent to supply, import or export of a psychoactive substance where a person

“knows, or is reckless as to whether”

it will be consumed “for its psychoactive effects”. It does not, however, contain an offence for the simple possession of a psychoactive substance, other than in a custodial setting.

The control of nitrous oxide as a class C drug under the Misuse of Drugs Act would also make it an offence to possess nitrous oxide, unless for a legitimate use. This would mean higher penalties and enforcement provisions. Those found in unlawful possession of the drug could face up to two years in prison, an unlimited fine or both. Meanwhile, those who supply or produce nitrous oxide could face up to 14 years’ imprisonment.

We are conscious that there is a wide range of legitimate uses of nitrous oxide. We are aware of its use in healthcare, including dentistry, industry and catering. To enable legitimate uses to continue, a further related statutory instrument will come into force simultaneously with this order. This would amend the Misuse of Drugs Regulations 2001, scheduling nitrous oxide under those regulations to provide certain exemptions from the offences under the Misuse of Drugs Act 1971, including medical use, and to provide legitimate access to nitrous oxide for legitimate uses, including in industry and catering.

Drug misuse ruins lives and adversely affects society as a whole. The Government have a responsibility to protect the public—their safety and their health—and that is why we are proposing this action. As I have set out, nitrous oxide harms not only people but communities and must be subject to stricter controls. I commend this order to the Committee.

My Lords, I have a quick question about the overall legislation encompassed here. I am not unaware of the impact of people taking drugs, but at times it seems to me that the Home Office automatically wants to ban everything, with the net result that we drive more and more illegal activities into the hands of criminal gangs. Every time one does that, there is a risk that, rather than feeling better and achieving something, we just enlarge the black market of yet another section of society.

I have had the misfortune of having to nurse back, with friends, people who have become drug addicts. I was also offered nitrous oxide from a large container in the lift on the Elephant and Castle Tube line on 18 June. I have seen groups of people using it and proffering it to me. But while I accept the order as it stands, I wonder whether there should be a broader review of the Misuse of Drugs Act because of the implications of driving so much into the hands of criminal gangs and youngsters. We have debates about county lines and the like, which all seem to point in the same direction: we are quite happy to ban things, but there ought to be other solutions to this and other problems.

My Lords, I thank the Minister for his statement and the noble Earl, Lord Russell, for the points he made. Although I do not agree with the central tenet of what he said, he made some interesting points which need an answer. He has started a more general debate which is long overdue.

We support the SI, which brings nitrous oxide under the control of the Misuse of Drugs Act 1971 as a class C drug. As the Minister outlined, unlike the 2016 Act, it makes possession an offence. That goes against the advice of the ACMD, but we believe that the Government are correct in their evidence to do so. In fact, in the Explanatory Memorandum, the Home Office helpfully points out that in 2008 the then Government went against the advice of the ACMD when they—one Member of the Committee was in the Home Office at the time—took the decision to move cannabis from class C to class B, which I believe to have been correct, the reasons for which will be evident in what I will say about nitrous oxide.

As the Minister pointed out, 230,000 young people across our country are affected by nitrous oxide. That is an astonishing figure. What are the Government supposed to do in the face of that—just ignore it? I know the noble Earl, Lord Russell, would say, “Of course I’m not suggesting ignoring it, but there are alternative ways of dealing with it”, but the Government have a responsibility. It is good to see a large number of colleagues from Northern Ireland, because this extends across the whole of the UK.

As the Minister said, nitrous oxide is the third most misused drug among young people, and there is increasing evidence of harmful neurological effects. Rereading the comments made in the other place, I was struck that Justin Madders MP highlighted a London Ambulance Service survey that showed a 500% increase in the number of nitrous oxide incidents between 2018 and 2022. Beyond that, as many of us will know, is the impact on anti-social behaviour, as pointed out by many colleagues in the other place, including my honourable friend Alex Norris MP:

“Nitrous oxide causes significant problems in our communities”. —[Official Report, Commons, 12/9/23; col. 851.]


Many other Members of Parliament made the same point.

I am sure the Minister will agree that these communities are fed up with the nuisance and litter—as he pointed out—of the canisters and other materials in our streets and parks. As I said before, the Government needed to act. I believe that 13 tonnes of nitrous oxide canisters and other material were collected after the Notting Hill Carnival—13 tonnes of waste. What sort of impact does that have on young people walking around? What does it say to young children of three or four, or older people, or the majority of people who abide by the responsible way to behave in our communities? I understand that the noble Earl, Lord Russell, and others would not say that we should ignore that, but somewhere along the line you have to say, “This is not acceptable and we’re going to do something about it”. The Government are quite right. At the end of my remarks, I will come back to this to address a point made by the noble Lord, Lord Hayward.

I have some questions for the Minister, as there are some legitimate questions to ask. The Government’s figures say the SI will have an expected cost of £68 million to the police, courts, Probation Service and prisons. There is to be no additional funding to support that. Can the Government say why, and how it is to be funded? For example, their estimate is that there will be a need for 26 additional prison places. How will that be achieved, given the current crisis? Will this just be subsumed within it? Is there an expectation that it will be sorted out?

I agree very much with the noble Earl, Lord Russell, and the noble Lord, Lord Hayward, about the need to assess the effectiveness of the SI and monitor what happens. The Secondary Legislation Scrutiny Committee called on the Government to make sure that that was properly reviewed. I would like to understand exactly what the police view of the SI is and their—or the Government’s—expectation of increased prosecutions.

As Kit Malthouse pointed out, enforcement will be essential; otherwise, this becomes just another meaningless law. Obviously, the police will have guidance with respect to how this law is enforced. I agree that there must be flexibility. However, it would be helpful if the Minister could confirm the following. A police officer on the street will have flexibility in determining how they deal with someone who is caught in possession of nitrous oxide. It is not automatic that they will be arrested and will have a criminal record. That flexibility on the part of a police officer on the street is important—but it is also important that they have the flexibility to arrest on the basis of possession and can deal with the situation on the basis of the offence of possession. That will be an important step forward.

As I said, the ACMD did not recommend a change in the legal treatment of nitrous oxide but it suggested a number of other interventions, such as restrictions on direct consumer sales, smaller canisters to tackle non-legitimate supply, and the need for a public education programme. Can the Minister say a little more about these non-legislative changes that the ACMD said were important? I agree with the thrust of this, that there should be a change to the legislation, and this should be a class C drug. However, it is also important to recognise that the ACMD made other recommendations; it would be interesting to hear the Government’s view on what they will do in respect of those.

The Minister dealt with the question of the SI not impacting on the legitimate use of nitrous oxide. Can the Minister confirm that in the debate in the other place it was raised that the new SI proposed to deal with this will mean that there will not be any sort of policy gap between the new offence and ensuring that dentists and others with legitimate uses for nitrous oxide can carry on using it without any risk to themselves? We think the Government are right to act, but they need to make more of the damage to individuals, the link to ASB and the impact on communities.

As has been pointed out, if you look at where drugs laws have been relaxed, such as in San Francisco or Portland, there is absolutely no evidence that it reduces the harm caused by drugs. On the contrary, it increases the harm in those communities. That is the important point, and it would be interesting to have this debate around what the noble Lord, Lord Hayward, said. The Minister, Chris Philp MP, raised this in the other place, but I think we sometimes need to make more of that—

My Lords, I live in a street in inner London which is well known to the noble Lord, Lord Kennedy, as he went to school via it. On Thursday night, I chaired the selection of the impressive Festus Akinbusoye, the police and crime commissioner of Bedfordshire. He knows only too well how you can achieve from an ethnic minority in the police community. On Friday, I had seven police cars and ambulances outside my house, dealing with a machete attack in the house next door. The police dealt with the case in an exemplary manner but, as the noble Lord, Lord Ponsonby, identified, there is the risk of alienation. From the pictures I have, not one of the policemen dealing with that case was non-white. Is it really surprising, when it comes to stop and search, that there is alienation among the ethnic communities, when one faces that sort of position? Could my noble friend the Minister identify what efforts are being made to improve the diversity of police forces across the United Kingdom?

I thank my noble friend for his question, and I am delighted to hear him describe the police’s activities as exemplary. I have three points to make on this subject.

First, the police themselves, in particular the Metropolitan Police, have said that they need to do a good deal more in this regard, and I certainly trust them to do that. The Metropolitan Police, under Sir Mark Rowley, should be given time to make the changes we all want to see.

Secondly, I emphasise again that young black men are disproportionately more likely to be victims of serious and violent crime, but the 2021 report by the inspectorate concluded that the vast majority of searches were conducted on reasonable grounds. It is for the police to make sure that their powers are understood and to explain themselves carefully. The expanding use of body-worn cameras, to which we have referred, will go a long way to help that. As I said earlier, we should all accept and acknowledge that community support is there in principle, although it is contingent and fragile. These measures will go a long way to solidify that while trust is being restored.

Finally, I am pleased that my noble friend has mentioned Festus Akinbusoye. He is an excellent PCC, and I am sure that he will become an excellent MP in due course. He has long been a supporter of mine, and it is a great pleasure to return the favour.

I am afraid I cannot answer that specific question, but I can and will say that the public profile of PCCs means they are scrutinised in a way that anonymous police authorities were not. I think the fact that we have this conversation on a relatively regular basis is proof of that. Ultimately, PCCs are directly elected by the communities they serve, and the public will have their say in due course. The noble Lord raised a point on turnout. In 2021, the turnout figure was 33.9%, a 6.5% increase from 2016 and a significant increase on 2012.

My Lords, on 21 December, in answer to the noble Lord, Lord Ponsonby, my noble friend was willing to describe the current circumstances as “disturbing”—this was previously indicated. We have now seen a further month and four days pass, so could my noble friend please indicate when “disturbing” becomes “unacceptable”?

My Lords, they are disturbing; they are concerning; they are all of those things. I cannot say they are unacceptable at the moment because, unfortunately, the responsibility for this particular misconduct hearing lies with the Cleveland police and crime commissioner.

I think noble Lords will all support the upholding of the rule of law, that justice is served and that anyone is innocent until proven guilty. The misconduct hearing will see that course of justice resolved.

My Lords, many thousands of very good police men and women are doing a great job 24 hours of every day, every week, including many on this site, but is it not a comment on the current state of the police force at senior management that the BCU commander for central and east London can issue an email at lunchtime today to say that he has been appointed to help lead the Met’s response to a recent finding by Her Majesty’s Inspectorate of Constabulary, which has placed the Met into a form of advanced monitoring? I thought the Home Secretary described it as “special measures”.

I think it is one and the same thing, in the sense that the Met Police will have to show obvious signs of improvement before the engage process, as the Home Secretary described it, is removed.

My Lords, I thank my noble friend Lady Bertin for her comments. I share entirely my noble friend’s commitment to ensuring that best practice in this area is properly communicated to duty holders. That is what will make it effective. I look forward to working with the domestic abuse commissioner’s office and wider stakeholders to develop the statutory guidance which will be subject to public consultation following Royal Assent. We intend to develop options and include detail on monitoring progress in our statutory guidance. In addition, specified authorities will be requested to keep their strategy under review. PCCs will also have a discretionary power to monitor performance, and routine inspection programmes undertaken by individual inspectorates in future may also consider the organisational response to local serious violence issues.

As my noble friend and others will know, the statutory guidance under Clause 18 already includes references to sexual offences, domestic abuse and gender-based violence. In updating the guidance ahead of the consultation, we will explore whether we should revise it to make it clear to specified authorities that they should consider violence against women and girls, including domestic abuse and sexual offences, in determining what amounts to serious violence in their areas.

In terms of stalking, we are very clear that the reference to domestic abuse to be added by the government amendments will encompass stalking in so far as it takes place in a domestic abuse context. Noble Lords will know that while many stalking offences take place in a domestic abuse context or involve violent behaviour, it is not the case in all instances. We have not expressly set these out in the Bill because we are seeking to avoid an exhaustive list of crime types, partly to allow local areas to take account of new and emerging forms of serious violence as they develop and are identified, and partly to recognise the geographical difference in the prevalence of these types of serious violent crimes.

As I have said, the draft statutory guidance for the duty sets out that there is flexibility for local areas to take account of their evidence-based strategic needs assessment and include in their strategy actions which focus on other related types of serious violence, including gender-based violence, which includes all forms of stalking as well as many other forms of violence against women and girls. We can look to make that clearer in the next iteration of the guidance, which we will be consulting on, as I have said. This is a view shared by the domestic abuse commissioner, and I put on record—following my noble friend’s thanks—my thanks to her for her continued engagement in this area.

My noble friend referred to sexual violence against women and girls. Can I clarify that this legislation actually covers all aspects of sexual abuse and stalking, not just that against women and girls?

I am glad my noble friend has mentioned that. We have said right from the outset that it covers both sexes, but this violence is predominantly meted out to women and girls; that is why noble Lords sometimes question this. But, of course, anyone who is a victim of domestic abuse or serious violence is captured by this.

The noble Baroness, Lady Jolly, asked me about the initiatives we have in place. We have tripled the funding we provide to the National Stalking Helpline, run by the Suzy Lamplugh Trust, this year. The additional funding is enabling the trust to answer more calls and expand its advocacy service. I set out in Committee the other actions we are taking to tackle stalking, and I refer the noble Baroness to those comments. Our forthcoming domestic abuse strategy will include stalking as well.

On that note, I hope that I have answered my noble friend’s questions and those of other noble Lords. I conclude by thanking my noble friend and the commissioner, and I beg to move.

My Lords, some common themes are emerging. I rise in support of Amendment 107, which was tabled by the noble Lord, Lord Rosser, and to which I have added my name, alongside that of the noble Baroness, Lady Jones.

The inclusion in this Bill of immigration officers among those authorised to undertake digital extractions strikes me as extremely troubling, particularly in the absence of significantly more detail on the safeguards, including the meaning of “agreement” and the specificity of the data sought, and the relevant training and expertise of these officers. Voluntary provision and agreement to extract data must surely rely on a level of informed consent. If it is not, then “voluntary” and “agreement” are just empty words.

For vulnerable asylum seekers and other migrants who come to the attention of immigration officers, it is not remotely clear how such informed consent is to be assured under what is currently proposed. Asylum seekers have, by their nature, often experienced negative reactions with agents of the state. In 2020, the top five most common countries from which people were seeking asylum in the UK were Iran, Iraq, Albania, Eritrea and Sudan. These are, to state the obvious, not countries where citizens, never mind those who flee as asylum seekers, tend to develop trusting or positive relationships with state officials, particularly those in uniform. To this experience in their countries of origin we have to add the fear and unfamiliarity of their situation on arrival in the UK. The hostile environment and its successor policies have been immensely successful in at least one regard: many migrants have come greatly to fear our immigration officers and the powers that they possess.

In outlining what I have said so far, I am trying to explain the extraordinary power imbalance, to say nothing of the language barriers, in place between an immigration officer and asylum seeker. It is hard to imagine how, under such a scenario, informed consent for voluntary provision and agreement could legitimately be established. It is particularly hard to imagine when we see no safeguards provided for assuring what is meant by such agreement or on what specific data it is deemed legitimate to extract. It is crucial to get this right. The data-extraction provisions of the Bill look to place current and future practice on a statutory footing. This is important, because the present practice of immigration officers is extremely concerning.

When the Bill was in Committee in the other place, as we have heard, the Member for Rotherham raised an all too common example of an asylum hostel containing some 50 to 100 men, all of whom had had their mobile devices seized as they entered the country. This was done without clear explanation or debate, and certainly without informed agreement or consent. The men in question did not know what, if anything, had been taken from their phones or accessed. This is proving to be a common story expressed by those working in the refugee and asylum sectors. It has simply become part of the process that mobile devices will be confiscated, without clear explanation or consent.

As we have heard, data extraction is a particularly serious privacy interference. It ought to require a high bar of necessity to be reached to justify any such intrusion, and strict parameters on what data is being secured and for what purpose. By contrast, the Home Office has proven consistently reluctant to explain current processes, and I hope we might engage with it on how to take this forward.

As the lead Bishop on modern slavery and one of the Lords spiritual who works on migration issues, I am all too aware of the insidious evil presented by human trafficking and people smuggling. I therefore sympathise hugely with the Home Office, as it tries to counter organised crime in these areas. I do not doubt that there are cases in which data extraction could prove useful in that ongoing battle. However, I suggest in concluding that we can achieve the benefits of such activities without such widely drawn and unchecked powers for immigration officers. I hope the Government will engage in a full process of exploring how any relevant data can be obtained in a way that is consensual, limited, targeted and carried out by professionals with sensitivity training and expertise. In particular, I hope to hear more about how the extreme power imbalance produced by an immigration officer doing this extraction can be better addressed than the Bill does at present.

My Lords, as my noble friend Lady Wyld did earlier, I apologise for not being present at Second Reading. Like my noble friend, I had been diagnosed as a Covid sufferer only a few days beforehand and was unable to participate in the debate. Therefore, if I go slightly wider than one or two amendments, I hope the Committee recognises why.

In making my comments, first, I emphasise that what I say in no way minimises the impact that the failure to tackle rape and sexual assault is having on society, particularly women and young females. There is no doubt that there is a major problem. I think that all Members of this House, including me, are only too closely aware of cases of rape and sexual assault that have had a dramatic effect on the individuals concerned.

I take this opportunity to emphasise that this is not solely a women’s issue. This issue affects men in society as well, particularly gay men. I noticed that as I started that sentence the noble Lord, Lord Paddick, was nodding; we are particularly conscious of the impact that sexual violence and rape have in the gay community as well as among females. To everybody, not just those in this House, I say this: the regularity with which I hear this issue being discussed as if it is a female-only issue causes me enormous concern and, I think, causes a lot of people hurt.

Reference has been made to rape cases and non-reporting and people being deterred from reporting. I know of one particular case, very close to me, in which somebody was subjected to an attempted rape. They chose not to report it, not because they would have had to disclose their mobile phone but because they took the view that the police’s response would be, “Well, you put yourself in that position in the first place”. We have all heard that phrase in relation to women, but in this case, it applied to a man. It had no less effect, but that man took that decision under those circumstances.

On comments in relation to the police, in these debates, we always tend to refer to their failures. There are failures—there is no question about that—but we should also pay credit to the thousands of police across the country who handle this difficult subject incredibly well. Many of them are family men; they know what is going on. It is an incredibly difficult set of circumstances for them as well as for the individual concerned.

More specifically on mobile communications, I made my maiden speech in the other place several decades ago on telecommunications. You can download everything off a phone, as long as it has not been specially hidden in some way or other, in a matter of minutes, certainly a matter of hours. You need to hold a phone for a long period of time only if you have serious criminals who know how to hide the contents of the entries on it. I implore people not to exaggerate the delays that one is talking about. We all use our phones as our livelihood, as the noble Baroness, Lady Chakrabarti, said, but downloading can be undertaken incredibly quickly.

In conclusion, I now want to take a different route in the conversation. In doing so, as I say, I do not underestimate the problems of society regarding sexual assault and rape victims. However, can the Minister clarify how this legislation or other legislation will deal with individuals who are falsely accused? There has been much discussion this evening about victims, but there are all too many such cases—not a substantial number, but there are many cases. For example, noble Lords can think of the number of people in this Palace who have been found not guilty when cases have gone to trial. What rights do those people who are falsely accused have in terms of seeking access to their accuser’s phone—or, rather, what rights do the police have in gaining access? It is all too easy for somebody to make a false accusation and then say they have lost their phone or delay handing it over. If you delay by 12 months, the records have disappeared in the vast majority of circumstances because the phone companies do not store them for more than that. There are a series of questions that need answering, and in the same way as we deal with genuine victims, we need to give consideration to those who are falsely accused and face many problems.

My noble friend Lord Hayward asked the very valid question about someone being falsely accused and what action can be taken where a false allegation of criminal conduct is made against someone. Where there is evidence of a false accusation, that in itself can be a crime—for example, the common-law offence of perverting the course of justice—and the police would be expected to investigate in the normal way.

I thank my noble friend for that answer, but I ask her to clarify her use of the words “where there is evidence”. In these circumstances, somebody who is accused will be making a counteraccusation, or a counterobservation, and therefore there may not be evidence. The evidence is likely to be on the phone in modern-day communications.

My Lords, I am very much aware of the need to respond to the genuine and substantial concerns of women and girls in our society, but could I just take one moment to remind the powers that be that many gay men are sexually abused or raped and that, as Chris Wild has so vividly described in his books, many boys as well as girls have suffered in residential homes or abusive families and flee them to seek what they believe is greater safety, often on the streets?

My noble friend raises an important point and IICSA is currently looking into some of the institutional abuses that took place in the past. We absolutely recognise that men and boys experience these crimes. That is why the Home Office is funding the men’s advice line run by Respect, which advises male victims of domestic abuse, and the Galop helpline, which provides support to LGBT victims. In addition, as part of the VAWG strategy, the Home Office has committed this year to increasing funding by £1.5 million for by-and-for service provision for victims of violence against women and girls, including by increasing the £2 million specialist fund recently launched by the MoJ with Comic Relief. This will build the capacity of smaller, specialist by-and-for organisations, supporting survivors of domestic abuse and sexual violence who are also from ethnic minorities, are disabled or, indeed, are LGBT.

My Lords, following on from the question from the noble Lord, Lord Bach, can I suggest that the Minister looks also at the Elections Bill coming before both Houses in the near future? This is another opportunity to narrow the extraordinarily wide range of reasons for barring candidates for PCCs. They are so wide that they are far broader than reasons for banning Members of Parliament or the Prime Minister.
