Commons ChamberLottery funding is a crucial source of cash for regional arts organisations, and I have repeatedly asked Camelot to provide a constituency breakdown of the purchase of lottery tickets so that MPs on both sides of the House can see whether their constituents are getting their fair share of cash. Will the Minister urge Camelot to provide such a breakdown?
The Business Secretary and I helped to launch the most recent update on Lord Davies’s report. Both of us noted how much progress had been made. However, the hon. Lady is right to say that there is still much more to be done, whether in FTSE 100 or FTSE 250 firms. However, the House should note that considerable progress has been made under the Government—progress that was not forthcoming before.
The message that we send from this place is important. Some 32 Ministers are entitled to attend Cabinet meetings, but just five are women. Will the Secretary of State join me in urging the Prime Minister to put the situation right?
The hon. Lady will know that the Government are absolutely committed to the importance of equality and fairness and of getting more women involved, not just at the top of our organisations but throughout them. What we and other parties are doing is making sure that we develop that pipeline of great women to take those positions in future.

We cannot simply continue to pour out taxpayers’ money to little effect. The changes are meant to ensure that the money spent on supporting victims of crimes of all sorts is spent in the most effective way.
I am sorry, but I have given way often enough and I know that many hon. Members wish to speak.
I must emphasise that the Government are committed not only to improving support for victims and witness but to improving practically the overall package of victim support so that they will have better services in future. The protections that remain in the compensation scheme will be aimed in particular at those who suffer the most serious crimes and at those who are most vulnerable to suffering serious hardship. I would be surprised if Opposition Members did not recognise that those ought to be the two biggest priorities of the scheme. That is what the compensation scheme should achieve within the financial boundaries it is required to keep. The draft scheme provides a coherent and fair way of focusing payments towards those most seriously affected by their injuries within an affordable budget and I ask the House to reject the motion.
My constituent was a self-employed business man when he was subjected to a vicious knife attack. He lost everything when he was attacked. There were two years of form filling before he got a small amount of compensation—an extremely stressful process. Should we not be talking today about improving the system for blameless victims, rather than making it worse?

My hon. Friend makes a very good point. Of course we should be doing that. The Labour Front-Bench team has offered to have talks. There should be talks between Opposition and Government. Let us get the scheme right so that it genuinely helps victims of crime, rather than withdrawing modest sums of money, often from people who have suffered serious injuries.
I am proud to have been a member of the shop workers union USDAW for more than 30 years, and I know just how vulnerable many shop workers, along with other workers serving the public in the postal, transport and other public services, are to attack. I recently met Frankie, a customer services adviser aged 28, who was attacked on a woodland path on his way to work in a large supermarket on the south side of Glasgow. Frankie suffered two stab wounds and was left with eight scars on his face, hands and forearms, after one of his attackers held him down while the other slashed at him with a sharp object before robbing him. His assailants were never identified. He has been told that if they are caught they will be charged with attempted murder.
Frankie was off work for almost a year and says that the incident, understandably, turned his life upside down because of the trauma. He still gets anxiety and panic attacks. He was diagnosed with post-traumatic stress syndrome, for which he has received counselling. Under the proposals in the scheme, the £2,500—that is all—that he received in compensation would be reduced to £1,000, which he says would have left him homeless in the circumstances that he was in. I cannot believe that in their heart of hearts Government Members really think it is right to deny the likes of Frankie £1,500.

Commons ChamberI support the comments of my hon. Friend the Member for Stoke-on-Trent South (Robert Flello) and the hon. and learned Member for Harborough (Mr Garnier), who I see is still plain “Mr Garnier” on the monitors.
It has been a long road to libel reform. For newspapers and other media, the real issue is cost. Responsible newspapers have been concerned about conditional fee agreements with 100% success fees and the sheer costs involved in such cases, especially as it seemed to be a case of “always win, double the fee”. Of course, we have heard examples where that is not the case: my hon. Friend cited the case of Dr Peter Wilmshurst, consultant cardiologist at Royal Shrewsbury hospital and our local University hospital of North Staffordshire, who needed that measure to be able to defend himself and give some certainty in a fraught situation to his family that, if he were to lose his case, all their worldly goods would not be forfeit.
Over time, proposals have been made, including by Lord Justice Jackson and my right hon. Friend the Member for Blackburn (Mr Straw), who laid a statutory instrument which was—almost uniquely—defeated by a cross-party ambush in Committee, because Members felt so strongly about the issues involved. In addition, the Culture, Media and Sport Committee, of which I am a member, produced proposals to limit the uplift in fees to 10%, rather than 100%, and not to recover after-the-event premiums—often, there is a false market in those premiums. I will put on the record now my belief that, in that report, we went too far, but our proposal was not to abolish an uplift, which would encourage lawyers to take on difficult cases, in their entirety. On the one hand, we are reforming libel law to protect responsible journalism, but on the other hand, we are potentially denying people access to justice, and I think the whole environment has become unbalanced.
What we have to remember, with phone hacking and Lord Leveson soon to report, is that we have a macho media world and some highly aggressive corporations. If we remove people’s ability to fight to restore their reputation, we risk giving a carte blanche to libel and going back to the bad old days when the only questions a newspaper asked were, “How much have they got? Can they afford to sue us?”
There seems to be some consensus that the main obstacle to pursuing a defamation claim would be lack of cash. Does my hon. Friend agree that, rather than resolve that crucial issue, the Government’s proposals could make the situation worse?
I entirely agree. I do not propose a return to the bad old regime, but I hope that the Government will give some thought to the remarks made by my hon. Friend the Member for Stoke-on-Trent South and the hon. and learned Member for Harborough. The situation is unbalanced now and we need to address that.
So often, if people do not sue, our media do not take them seriously. That simply increases the licence to libel. I know people who defend responsible journalism and investigative journalists who have had to take that course of action because newspapers with an agenda have been out to get them; if they did not threaten or take legal action, the situation would never change. I believe the culture of our media needs to be borne in mind, as we will be reminded when Lord Leveson reports next month.

Commons ChamberThe work done after the riots is a tribute to the public spiritedness of all who sat on the bench—all the court staff, probation staff, police and duty defence solicitors. There was a widespread feeling that people should do their bit to restore order, and I am glad to say that the courts rose to the challenge. Normally, on an ordinary day, we do not have a shortage of court space, so there is no general need to have night or evening sittings. We can certainly improve the efficiency with which the more straightforward cases are dealt with. They can be brought on at an ordinary hour more quickly than they sometimes are now. We are working on that. It was a tribute to the court service and everybody who works in it that they all worked as well as they did.
T7. I wrote to the Justice Secretary six weeks ago on behalf of my constituent Gary Thrall, but have not yet had an answer. May I ask him again to look at this case and at the fact that 16 months on from a vicious knife attack, Gary has yet to receive a final settlement from the Criminal Injuries Compensation Authority or to be advised of the likely time scale for the settlement, which is preventing the family from moving on?

My hon. Friend has raised a valid operational concern about Friday releases. However, holding prisoners whose statutory release date falls at a weekend until the following week is unlawful, and we do not think it right for prisoners to be let out early: they should serve the custodial period required by law. Our duty is to manage the operational issue of Friday releases. That includes ensuring that all prisoners are properly prepared for release, and implementing restorative justice as part of that preparation where appropriate.
My constituent Gary Thrall was left for dead after a vicious knife attack last year. His first contact from Victim Support came five weeks later, when it was suggested that he might like to meet some knife attackers. Does the Minister agree that that is a gross misuse of restorative justice, and what can he do to ensure that the same thing does not happen to other people?

I read about that case in the papers. It is plainly important for restorative justice to carry the confidence of victims. They should not be placed in a position in which they are required to take part in restorative justice disposals; restorative justice should be a right for them to exercise when they see fit, and when it is clearly in their interests to do so.
