Lords ChamberTo ask His Majesty’s Government what assessment they have made of the impact of voter ID rules on people’s ability to vote, and what plans they have to review these rules before the next general election.
My Lords, we are encouraged by the first rollout of voter identification and are confident that the vast majority of voters will have cast their vote successfully based on sector feedback and our own observations on the day. As set out in legislation, we will be conducting an evaluation of the implementation of voter identification at the May polls and intend to publish the report no later than November this year.
I am quite surprised at that Answer, because initial reports suggest that thousands, if not tens of thousands, of people were not able to cast their votes. Of course, the really disturbing thing is that a former member of the Government—still a Member of the other place, recently knighted, Sir Jacob Rees-Mogg—said at the National Conservatism Conference in Westminster last Monday:
“Parties that try and gerrymander end up finding their clever scheme comes back to bite them, as dare I say we found by insisting on voter ID for elections”.
So a member of the Minister’s own party has called it “gerrymandering”.
The successful introduction of voter identification at May’s elections was to ensure the future integrity of our voting system. Comments from elsewhere do not reflect the reality of the reason for or the administration of that change. The Parliamentary Under-Secretary of State for Local Government and Building Safety, Lee Rowley MP, made the Government’s position absolutely clear in a letter responding to a point of order raised in the House of Commons on 16 May. This letter has been deposited in the House of Commons Library.

Lords ChamberLet me give a little background. Three Thai banks had a hold on the former SSI steelworks land. As negotiations to secure that land broke down, a compulsory purchase order was launched. JC Musgrave Capital and Northern Land Management already had back options on parcels of land within the Teesworks site that were key to those negotiations with the three banks over land owned by SSI, which was already in receivership. The STDC was advised by a top KC that, without this private sector involvement, it would very likely lose that compulsory purchase order. The public/private partnership was agreed by the TVCA, the Cabinet and the STDC board, and it was envisaged in the original business case approved by the Department for Business, Energy and Industrial Strategy, MHCLG and the Treasury that that should be the partnership to take this site forward.
My Lords, it is not people on this side creating the concern; these are reports from local people, businesses and a lot of newspapers. Please do not be offensive to this side of the Chamber. We do our best to hold the Government to account—that is our job. In this instance, the Government seem absolutely blind to the fact that there could be problems. Moving forward, an investigation is necessary and should be part of the Government’s plan.
We are not blind to that fact. We are monitoring continually, as we do when we invest in these projects, and the National Audit Office did its audit and said that the public money was being spent as intended. We will look at anything further that needs to be done. As I have said, the mayor is very happy to take part in any review.

Lords ChamberThe noble Lord is absolutely right, but we are investing £11.5 billion through our affordable homes programme to deliver up to 180,000 more affordable homes. A large number of these will be available for social rent. Also, the Government have provided a range of tools to help councils deliver more homes, particularly in this sector. They include the councils’ freedom on how to spend the money received from the right-to-buy sales. The Government also abolished the housing revenue account borrowing cap in 2018, allowing councils to borrow more money to build more homes.
My Lords, do the Government appreciate the value of community land trusts? To follow on from the last question, they actually build homes that are affordable, but affordable in perpetuity because they are not sold on at vast increases in cost. Have the Government evaluated that?
Yes. Many local authorities in the country certainly work closely with community land trusts. I do not have an update on what is happening nationally, but I will certainly get an answer to the noble Baroness.

Lords ChamberI obviously cannot comment on a particular instance. I would like to have more information; if the noble Baroness would like to write to me, we will meet and I will look into it. That is not what should be happening. Leaseholders should not be paying; it should be others who are paying. We made that very clear in the Building Safety Act.
My Lords, the Government promised to make this whole system fairer, faster, easier and cheaper, yet somehow it has absolutely stalled. It is fair enough to have meetings; that is wonderful and very fair of the Minister. At the same time, “before the next election” may be a rather difficult timetable to be sure of. Can the Minister please get some sort of date—some idea—of when this will happen? There is urgency; I ask as a leaseholder.
The noble Baroness is right, and I can assure her that I am talking about it almost daily in the department. I will continue to do so and hope that, the next time I come to the Dispatch Box on this issue, I will have a date.

Lords ChamberMy Lords, I thank the noble Lord, Lord Clement-Jones, for a very thorough piece of scrutiny of this part of the Bill. I think it would be useful if between now and Report we had a meeting with him and other interested parties to discuss this further and also address some of his very in-depth speech that I will not answer this evening because we might be here all night. We will get answers to him very quickly so that we can discuss them when we have that meeting.
The noble Lord, Lord Mann, and many others are right: this is fast moving. What we see today is probably not what we will see in five years’ time, and we need to future- proof. I think we all understand that.
There were some very specific questions that I will answer upfront because that will give some context to what else I am going to say. First, on digital imprints, it is important that “reasonably practicable” is understood. It should be read as commonly understood; “reasonably practicable” is commonly understood. The Electoral Commission and the police will need to interpret this phrase in context in the course of their enforcement of the Bill. The statutory guidance will provide further details on the location of this imprint and what is required. There will be further guidance on this.
A number of noble Lords spoke about the Intelligence and Security Committee and said that political adverts should include an imprint. The Government’s digital imprint regime delivers the ICS’s recommendation to introduce a requirement to add an imprint on digital paid-for political advertising. As digital campaigning is not confined to election periods or geographical boundaries, the regime is intended to apply all year round, UK-wide, and regardless of where in the world content is promoted from. Following a conviction or a civil sanction, the courts can make an order or the Electoral Commission may issue a notice to anyone, including social media companies, requiring them to remove or disable access to infringed content. Failure to comply with a notice or order would be a criminal offence.
The noble Baroness, Lady Jones of Moulsecoomb, brought up the issue of targeting messages. Targeting messages at voters is a legitimate activity that allows campaigners to maximise their resources and target their message at the right audience. All campaigners must comply with direct marketing and data protection laws when using personal data in their campaigning, but it is a legal activity.
This is about transparency, so that the public can know that somebody is saying different things in different places—that is all.
Understood. Listening to the debate, two words have come out, and we will reflect those. One is “safeguarding”, and one is “transparency”, as the noble Baroness has just said. Those two things are important as we move forward with the Bill.
The provisions in Part 6 of the Elections Bill will introduce one of the most comprehensive “digital imprint” regimes operating in the world today; that is the positive thing. However, it is crucial to take a proportionate approach to the scope and application of the regime to ensure that it is enforceable and to avoid stifling political debate. It is for this reason that the Government do not support the noble Lord’s amendments, as we consider that they would introduce unreasonable burdens on campaigners and therefore risk restricting freedom of expression.
Due to the way some digital platforms are designed, it will not always be practical to display the imprint as part of the material itself—for example, in a text- based tweet where there is a strict character limit. Amendment 180A would not give campaigners the much-needed level of flexibility and therefore risks unreasonably hampering their ability to campaign on particular digital platforms. I have listened to the points made about new technology coming out; it is important that we keep an eye on that, so that if that is possible in the future—
My Lords, I do not have the answer to the noble Lord’s question, but I can say that there are a number of groups in government working all the time on early intervention and prevention and with women in custody, and they are delivering for those women.
A key aim of the Female Offender Strategy was to reduce women’s prison places, yet there has been a government announcement recently saying that they are going to increase prison places by 500. Are the Government planning for failure?
No, my Lords, the Government are not planning for failure. We are planning to deliver part of the strategy for women offenders, which is to update the women’s estate. This investment in the estate will allow for single cells and for an estate which can deliver for women offenders, and possibly for their children to help them keep their family ties.
My Lords, we are aware of this concern and are examining it in the context of a departmental review into the use of custodial remand for children, which is shortly to be published. The reforms in the Police, Crime, Sentencing and Courts Bill, which aim to limit the use of custodial remand for children, also have the potential to help reduce the racial disparity in remand decisions.
It is impossible to look at these figures for the disproportionate number of ethnic minority children in custody without drawing the conclusion that the criminal justice system is institutionally racist. However, the problem starts with the police because of their stops and searches. So what is the Ministry of Justice going to do, and how will it approach the Home Office to try to clear up the whole mess?
My Lords, the Government fully support the police in the fair and proportionate use of their powers and the lawful use of stop and search. However, we remain clear that no one should be stopped and searched based on race or ethnicity, and extensive safeguards exist to ensure that this does not happen.
The Government are working to achieve quicker and more certain decision-making for victims of modern slavery but also youths. The Single Competent Authority was launched in April 2019 to handle all national referral mechanism cases and to provide high-quality, timely decisions for victims. There has been a significant ongoing recruitment of SCA decision-makers to address timescales. There are no set timescale or target decisions to be made; the SCA can make a conclusive grounds decision only when sufficient information has been made available by the parties involved in all cases.
My Lords, part of the problem with all the delays and children becoming adults before they go to court is because the Conservative Government massively cut funding to courts. The Minister comes from the Ministry of Justice but this is a clear injustice. What will the Ministry of Justice do about it?
I think I have answered this question once before. HMCTS is working to clear the youth court backlog at pace. The magistrates’ courts, where most youth cases are heard, disposed of more cases than they received from August 2020, which has led to a reduction in the outstanding caseload.
Presumably, the framework will need some bolstering after Covid, and perhaps some extra resources. I am thinking in particular of things such as broadband. I heard the noble Baroness say that there would be an extra £750,000, but quite honestly that does not sound very much when we look at the whole framework and the valuable work being done. Are the Government thinking about improving the provision of resources for the framework?
There are no plans to improve resources for the framework at the moment. The noble Baroness will understand that a lot of government money has gone into all of our communities through the pandemic, but we keep everything under review.
