Lords ChamberMy Lords, I will briefly comment on two of the amendments. First, the noble Baroness, Lady Andrews, introduced Amendment 204A so powerfully. I share others’ strong preference for this amendment, rather than the weaker Amendment 204B.
I want to emphasise the point made by the noble Baroness, Lady Andrews, about embodied carbon. These structures that were built in the past are there for us. Knocking them down and building something again has environmental costs, which we have to start to take seriously. Along that line, I want to pick up a phrase used by the noble Earl, Lord Lytton. He spoke about how we might want to knock things down and replace them with tidier looking buildings. I ask your Lordships’ House to think very carefully about the word “tidy” because heritage and history is seldom tidy, just as nature is not tidy. Straight lines and very even frameworks—the idea that tidiness is a virtue—has done enormous amounts of damage. It is something we really need to challenge. With a lack of tidiness, there may well be character, diversity and reality rather than something new and artificial.
My second point is to commend government Amendment 271A on the extension of blue plaques. I take this opportunity to invite the Minister to comment from the Dispatch Box and reflect on the fact that currently in Greater London only 14% of blue plaques commemorate the lives and contributions of women. I looked into this to see whether I could get a plaque for Moll Cutpurse or Bathsua Makin. Unfortunately, the buildings with which they were associated do not survive. However, will the Minister take this opportunity from the Dispatch Box to reflect on the need to ensure the encouragement of women and greater diversity in the lives which are commemorated?
My Lords, I will very briefly add to the salutations rightly directed at my noble friend Lord Parkinson for his important amendment extending the blue plaque scheme. One moment my noble friend is expounding issues related to online safety, and a little while later he brings forward a major heritage measure, which I think will have given him great personal pleasure because of his considerable interest in matters related to history.
The extension of the scheme will surely stimulate added interest on a considerable scale in localities throughout our country and extend knowledge of individuals who contributed within those localities and, in many cases, at national level too. The scheme will not be appropriate in every single case. For example, in Birmingham there is a fine memorial to Joseph Chamberlain. The noble Lord, Lord Shipley, will know it, as will the noble Lord, Lord Carrington, with whose remarks on the preservation of buildings I agree strongly.
On the Joseph Chamberlain memorial, there is a suitably inscribed plaque recording his important work. The city council has agreed in principle to a proposal from the noble Baroness, Lady Stuart of Edgbaston, and me to add plaques to Joseph Chamberlain’s two sons, Austen and Neville, who contributed greatly to the life of Birmingham and, of course, at national level. In Neville’s case, rather controversially, but he was above all the greatest social reformer the Conservative Party has ever produced. It would be right to ensure, as I think we will, that the new plaques blend in satisfactorily with the existing one. However, I think that in most cases, the blue plaques shining forth in their localities will do so much to stimulate historical interest throughout our country. For that, I salute my noble friend.

Lords ChamberMy Lords, it is immensely gratifying to reach the end of a long, six-year campaign. At last, more gay people who in the past suffered cruel wrong under unjust military and civilian offences are about to be given the means of securing the redress they so greatly deserve. It has been extremely encouraging to receive so much support from all parts of the House, particularly from the noble Lord, Lord Ponsonby, on the Labour Front Bench and the noble Lord, Lord Paddick, on the Liberal Democrat Front Bench.
May I add briefly to the comments made by my fellow campaigner, the noble Lord, Lord Cashman? It was through amendments to earlier legislation, which I moved in December 2016, that the disregards and pardons scheme, in its existing, incomplete form, was brought into force in Northern Ireland with the consent of its devolved Executive and Assembly. The then Justice Minister in Northern Ireland, Claire Sugden, said at the time it was important to ensure that the criminal law in Northern Ireland offers equality of treatment to gay and bisexual men in Northern Ireland with England and Wales.
There can be no doubt that widespread support exists in Northern Ireland for the redress of past gay injustices, particularly among younger people, on whom the future of that wonderful part of our country depends. I am confident it will be strongly felt in Northern Ireland that its devolved Department of Justice should use the powers it possesses under existing legislation to bring today’s amendments fully into force in the Province when they become law here very shortly. That would be particularly appropriate this year, which marks the 40th anniversary of the initial decriminalisation of homosexuality in Northern Ireland, following the triumph of my friend Jeffrey Dudgeon in the European Court of Human Rights, which forced the Thatcher Government to take action in 1982.
The Minister signed my amendments back in 2016. I hope she will endorse my comments today. It cannot be right to have a border down the Irish Sea in respect of human rights.
My Lords, I rise as I did in Committee to speak briefly and humbly on behalf of my noble friend Lady Jones of Moulsecoomb, who signed the matching amendments in Committee. I can only pay very strong tributes to the noble Lords, Lord Cashman and Lord Lexden, for all their long work on these issues. The Green group, of course, welcomes these amendments. I would like to thank the Minister for her helpful letter that addressed the questions I raised in Committee about why it is not possible to automatically get rid of these offences to clear people of them.
In the light of that, I would simply like to prompt the Minister—though I realise it is early—for whatever information she might be able to give us both about what plans there are to publicise this legal change to make sure people are able to easily and simply apply and about what kind of timeframe for the process she sees going forwards. As has been said, many people affected by this may be of an older age group, and it is really important this is available to people as soon as possible.

Lords ChamberMy Lords, I endorse all that my noble friend Lord Cashman has just said. We have been close allies, as he mentioned, for five years, in a sustained campaign to bring far more gay people within the scope of a hugely important scheme, through which they can attain disregards and pardons for offences that have been rightly overturned by Parliament. The House will understand how earnestly we hope that the end of our campaign is at last in sight.
Our amendments include provisions originally incorporated in amendments to the Armed Forces Bill, now completing its passage through the House. The provisions in question have now been embodied in these amendments. This has been done on the advice of the two Ministers concerned—my noble friends Lady Goldie and Lady Williams—with whom most helpful conversations have been held.
I refer to the provisions that relate to the Armed Forces. More gay members of our Armed Forces need the belated release from past injustice that our proposal will provide. Many were routinely punished, sometimes with imprisonment, under the service discipline offences, for actions such as disgraceful conduct for engaging in consensual same-sex activity, even when, after 1967, this was perfectly legal for civilians. They must now have the redress that our amendments would provide. Medals have been restored to former gay service personnel. Their reputations must be fully restored, too, by the removal of the stains that they should never have borne in the first place.
It was through initiatives in this House that the disregard and pardon scheme was significantly extended, five years ago. It is immensely gratifying to know that wide support exists across the House today for the scheme’s further enlargement to bring redress to many more gay people who have suffered grave injustice, particularly former gallant members of our Armed Forces, who served our country in peace and in war.
My Lords, I rise to briefly and extremely humbly speak on behalf of my noble friend Lady Jones of Moulsecoomb, who signed Amendment 266. I am greatly honoured to follow two such champions of this matter of undoing great injustices of the past.
I want to record our support for this and also to ask the Minister a question—to which I do not expect an answer now. These clauses provide for people to apply. Why can we not have a situation where we go through, find and identify these case and wipe them clean? That is the question I was asked to ask, and I am asking it. I do not necessarily expect an answer now, but I am putting it on the record.

I beg leave to withdraw my amendment now, but this is certainly something we will come back to.

Lords ChamberMy Lords, my noble friend Lady Jones of Moulsecoomb has already set out the temporal position of the Bill: it is at the end of a long line of debates on the Agriculture Act, the Fisheries Act, the Trade Act and Brexit. It is the place where the Government told us that many of the issues raised in those debates would finally be dealt with. It would seem that it is also the place where the Dasgupta review’s call for new economic indicators should be acknowledged, as the noble Lord, Lord Bilimoria, referred to. It is the place to start the transformation from an economy based on the exploitation of people and the environment to a system based on resilience and regeneration.
Some 25 years after the Act that set up the Environment Agency, the Bill is certainly urgently needed, for that Act and 25 years of Governments of various hues have clearly failed. Our nation ranks 187th globally for the state of our nature. Much of it is a beautiful but sterile green desert, from the burned, shorn land of our first national park in the Peak District to the rapeseed flowers now blanketing chemical-drenched fields.
Yet food security remains an acute and pressing issue. Unlike the noble Lord, Lord Cameron, I will not posit a third world war, but rather point to our responsibility, as a wealthy nation, not to take food, water, labour and resources from the fields and mouths of others in a world where production is threatened by the climate emergency, the water crisis, the destruction of soils and the massive practice of food waste that is the factory farming of animals.
Many noble Lords have already addressed issues that the Green group—all two of us—will seek to offer our support on. I endorse many things that the noble Baroness, Lady Parminter, said so eloquently, including on the need for environmental principles to be applied universally, the need for local governments to have the resources they need to protect and enhance nature, and the principle of net biodiversity gain not excluding major infrastructure developments. In fact, I will go further: we need to abolish the principle of biodiversity offsetting. We have so little left that we cannot afford to destroy any national treasure that we have left—certainly not for the uncertain outcome of a few saplings stuck in a field and called a replacement for an ancient forest.
Relatedly, the Secretary of State should not be allowed to amend the habitat regulations at will. The noble Lord, Lord Montrose, spoke of a forest of Henry VIII regulation. This is one forest that should be felled. The noble Lords, Lord Khan and Lord Rooker, focused particularly on the legal weakness—indeed, the legal attack on basic principles contained in the Bill—as so powerfully outlined by the Bingham Centre. We will work on that.
I agree with everything said by the noble Baroness, Lady Boycott, who is not currently in her place, and thank her for drawing attention to the Knepp planning issue. Drawing a broader point from that, in their planning and agriculture principles, the Government seem to be locked into a sparing rather than a sharing mindset—one of sparing a little land and making it pristine and rich but trashing the rest for industrial agriculture or housing luxury development of a kind that fails to meet urgent community needs. We need to care for all of our land.
The noble Lord, Lord Trees, pointed out an obvious gaping hole in the Bill: the lack of measures on antimicrobial resistance. I do not often quote David Cameron, but I will today:
“With some 25,000 people a year already dying from infections resistant to antibiotic drugs in Europe alone, this is not some distant threat but something happening right now”.
That was in 2014. The noble Lord, Lord Teverson, rightly stressed the importance of our marine environment and the non-existence of its protection. The Green group intends to offer support on all these issues and more.
I am afraid that the nature of the rest of my speech is also that of a list—that is, a list of the issues that I have not heard other noble Lords clearly set out. This reflects concerns that my noble friend and I have heard from the millions of voters we do our best to represent and the many industry and campaign groups whose issues are not covered or are badly dealt with by the Bill.
The ordering is roughly in the order of the easiest issues, from those that any sensible Government would surely embrace through to those that require a fundamental philosophical shift and an understanding that there are enough resources on this planet for everyone to have a decent life and for the natural environment to be cared for if we just share them out fairly. This requires a sudden outbreak of understanding of planetary limits—I live in hope.
First, on plastic and packaging materials, an amendment is needed to ensure that the bottle deposit scheme is variable, reflecting the size and impact of bottles, not just their number. An amendment is also needed to tackle the horrendously costly waste of disposable nappies, both to household budgets and the cost we all bear in council waste. However, what is really lacking in the Bill is an understanding of the waste pyramid. Recycling is third best; we have to reduce and reuse, and recycling comes a poor third.
Secondly, on pesticides, we have soaked the planet with poison. We need to protect rural dwellers, and the whole of our land, from pesticide applications.
Briefly, because I am running out of time, human rights have to be linked to environmental rights—due diligence along the lines of the Bribery Act. Then there is the issue of what land is for, which was partially raised by the noble Baroness, Lady Young of Old Scone. It has to be for the people and for the natural world. Driven grouse shooting, growing food to waste in feeding animals kept in misery, and sugar beet production, which strips soils and produces obesity, are some examples of land uses we do not need.
Finally, we often hear in your Lordships’ House that these are crowded islands. The crowding has one very large cause: 50% of the land is owned by 1% of the people, so 99% of people are excluded from half of our land. An Environment Bill surely has to offer access to more of it—a great deal more—for food growing, nature and recreation. They are not making any more land, so we have to share it out fairly.

Lords ChamberMy Lords, it is a pleasure to follow the noble and learned Baroness, Lady Butler-Sloss. I join the noble Baroness, Lady Hamwee, in regretting that we have not yet heard the noble Baroness, Lady Helic, introduce Amendment 160. On the assumption that we will do so eventually, I shall contain myself to simply offering support for Amendments 151 and 160. I join others in saying that, had there been space, I would have been very happy to attach my name to them.
I shall speak chiefly to Amendment 148, tabled by the noble Lord, Lord Rosser. He has already provided an eloquent and powerful introduction, so I shall briefly add some further points.
I start with a reflection on the overall status of no recourse to public funds. This applies to some 1.3 million people who are part of and contribute to our society. We should ask ourselves some very tough questions about why we ask people to contribute without offering them protection.
However, today, with Amendment 148 we are specifically addressing the issue of victims of domestic abuse. I very much hope that every Member of your Lordships’ House will agree with the statement that the state must not be the facilitator of domestic abuse and that it must not act in ways that trap victims in abusive relationships. It is very clear that that is currently happening, and the amendment would seek to ensure that it does not.
Over the past year, I have been doing quite a bit of work on no recourse to public funds from a number of angles. I have spoken to Green Party councillors and asked them to share with me cases that they have dealt with. Of course, at that very distressing local level, very often it is local councillors, who have very few tools and resources at their disposal, who are forced to rush around trying to help and provide support in any way they can.
I want to quote one person who has been stuck with no recourse to public funds during the Covid pandemic. She had just about cobbled together the circumstances in which to survive, but then the pandemic pulled those apart. I ask your Lordships to reflect on this woman’s words. She said, “The citizens advice bureau is a vicious cycle of being referred to the same departments that have already said no.” We should think about what that must be like and the circumstances in which that leaves people. I note from information provided by Women’s Aid what it means practically. It noted that women with no recourse to public funds who care for children are, theoretically, entitled to continued support for their children under Section 17 of the Children Act, yet under the Women’s Aid Federation of England’s No Woman Turned Away project, of 20 women with no recourse to public funds who were fleeing with children in 2017-18, social services refused outright either to fund a refuge space or to provide emergency accommodation for 14. In six of the cases, they offered to accommodate the children but not the mother.
Those findings show very clearly that women with no recourse to public funds who have children are being refused help, despite Section 17 duties, and that the state is acting in ways to break up families. So, we have a situation where victims of domestic abuse are being trapped and families are being broken up by the law. That is why I very strongly support Amendment 148, and I hope that the Government will see the need to support it, or something very like it, too.
I finish with words from a Women’s Aid briefing. It is a simple, bald statement and I ask the Government whether they agree with it:
“No survivor should be left without access to a safety net and it is essential the Bill delivers reforms to ‘no recourse to public funds’.”
Those are the words of Women’s Aid. I very profoundly agree with them and I hope that the Government will too.
