Question to the Department for Business, Innovation, Science and Trade:

To ask the Secretary of State for Business, Innovation, Science and Trade, what information his Department holds on the number of tied pub tenants (a) who have served a section 26 notice and secured a Market Rent Only agreement under the Pubs Code and (b) whose applications did not proceed because the landlord relied on Ground G(1) of the Landlord and Tenant Act 1954.

The Pubs Code only applies to pub companies with 500 or more tied pubs in England and Wales. The Pubs Code Adjudicator (PCA) is responsible for regulating those covered by the Code and exists to protect fairness in the tied business relationship. The PCA obtains data from the six Pub-Owning Businesses (POBs) that it regulates through its annual compliance report, published on its website: Reporting Data to the PCA | PCA. This page also contains information about the uptake of the Market Rent Only option.

Neither the PCA nor Government holds data about the use of s30(1)(g) of the Landlord and Tenant Act 1954.
