Question to the Department of Health and Social Care:

To ask the Secretary of State for Health and Social Care, what steps he is taking to support charities facing back-pay demands for sleep-in shift workers.

On Friday 13 July 2018, the Court of Appeal ruled that sleep-in shifts no longer attract the National Minimum Wage or National Living Wage. This judgment applies to both past and future sleep-in shifts.

The ruling should give clarity to providers, including charities, and social care employees about what shifts attract the National Minimum Wage and National Living Wage. The Department for Business, Energy and Industrial Strategy will update their guidance shortly.
