Question to the Department of Health and Social Care:

To ask the Secretary of State for Health and Social Care, whether it was the Government’s intention for Accountable Care Organisations to fall within the scope of the (a) National Health Service (Procurement, Patient Choice and Competition) (No2) Regulations 2013 and (b) Public Contract Regulations 2015 when sub-contracting for services.

I refer the hon. Member to the answer I gave on 29 January to Question 123830.

Procurement law applies in the same way where an Accountable Care Organisation contract is in place, as in all other circumstances.
