It is interesting to follow the fascinating and detailed contribution from the hon. Member for Foyle (Mark Durkan), with its insight into welfare reform. Let me make it clear at the outset that the name of my constituency does not begin with the word “south”—or indeed with the word “north”—but it does have “South” contained within it. I am happy to live up to that record—I hope it will not be as depressing in the minds of some as others have been or claim to be. My aspirin has already gone, so I think I will move on.
The Secretary of State, who is not in her place at the moment, must feel privileged to be referred to as “tough Theresa”. It certainly goes way beyond some of the names that I recall other Secretaries of State for Northern Ireland being called in the past. For example, I remember “Traitor” and “Lundy” to name but a couple, and there are loads more as well.
I am pleased that welfare reform is moving forward, because we could not continue as we were. I also wish to put it on the record that I, too, was disappointed that this did not go through the Northern Ireland Assembly for a reasonable and proper debate. I did note some Members saying, “Why shouldn’t the UK Parliament legislate for it? It has every right to.” Of course it has every right to do so. I do not deny that, and nor does my hon. Friend the Member for South Antrim (Danny Kinahan). However, the reality is that we have devolution, and under devolution we should debate these issues, but, as the hon. Member for North Antrim (Ian Paisley) said, if there is a dysfunctional and unworkable Assembly, why should the UK Parliament not legislate? That is right. If the Assembly is dysfunctional, then, yes, let us legislate, and that is exactly what we are doing.
I must say though that had we had the debate in the Assembly, we might have achieved more clarity. For example, nearly £600 million will come from other Northern Ireland Departments to support welfare reform and tax credits. We could have had some indication of where that money was going to come from and what Departments would be affected—would it be Health, Regional Development, or Culture, Arts and Leisure? In bringing this matter to this place, that is the type of debate we are missing, but we are where we are, and that is what we must progress with. I want to reiterate once again that I am pleased to see welfare reform progress, because we could not continue as we were.
I assume that some parties in this House will have huge difficulties with this. The parties that voted against welfare reform in the past will find it hard to support this legislation. That may be so, but we must progress. Yes, Northern Ireland is getting a better deal in respect of money coming in to welfare reform and substituting for tax credits, but let us not forget that that money is coming from our own Northern Ireland block grant, which means that it will have to come out of other Departments and it will have to be paid for by the Northern Ireland Executive moneys. I noted that the right hon. Member for Lagan Valley (Mr Donaldson) made an all-out attack on the Ulster Unionist party. He has every right to do so, and I am sure there will be more of that as time goes on. We will just take it as it comes.

Yes, we will do that as well. The right hon. Gentleman pointed his finger at the Ulster Unionist party, saying that we were to blame for what we have. Yes, it is easy to lay the blame on the Ulster Unionists, but let me remind him that his party has been the largest party in the Northern Ireland Assembly for the past 12 years. We still have the IRA army council in place, the IRA with arms and IRA members shooting people on our streets. I would prefer it if that were not the case, but that is the reality. I say to him that he should not point the finger at the Ulster Unionist party. His party has had 12 years to make the running in Northern Ireland, and take a lead on the issues. It is time that we made some progress.
I am grateful to the hon. Gentleman for taking an intervention. I just want to prompt him to pay tribute to a Nobel peace prize winner. We do not have many in Northern Ireland, but Lord Trimble is certainly one of them, and he gave very courageous leadership to the Ulster Unionist party when it needed it. I am speaking as one who has been in the Ulster Unionist party and who is proud to say that about him.

I thank the hon. Lady for paying that tribute to Lord Trimble. I agree with her, and I would pay tribute also to John Hume, another former Member of this House. Indeed, I also wished Peter Robinson a happy retirement here in this Chamber the other day. I think that all Members make a contribution to our society. David Trimble and John Hume took risks. I have to say that, for me, that sometimes went too far, but I said that at the time. I was open and upfront about the fact that I thought a better deal was on the table, but we are where we are. We need to progress, and we need to rid Northern Ireland of terrorism, paramilitarism and criminality. The fact that that has not happened yet is a huge failure in our society.
We need to ensure that welfare reform protects the most vulnerable in our society, and I hope that we will do that, but we will not know the workings of that until a few years have passed. Why have we wasted so much time? The welfare reform legislation passed through this House three years ago. Why have we wasted time, money and energy in Northern Ireland by not progressing it? I do not agree with all the welfare reform changes, but that reform is here. It is part of our society, and we should be moving forward. It has cost our society in Northern Ireland dearly. To see that one only has to look at how the health waiting lists have spiralled over the past few months. We are told that that is because money is coming out of healthcare to support welfare institutions. We could not progress the way we were going.
In Northern Ireland we have our fair share of the most vulnerable in society because of the decades of our troubles. We need to protect those people but we also need a practical, sensible review and we need reform. We could not continue as we were. People need to be realistic and accept that we need to build our economy in Northern Ireland the way the economy is being built everywhere else. We are all happy to play our part in that—I do not think that any Member in this Chamber would disagree—but we need society to play its part as well. We need people to accept that if we are to build a consensus in Northern Ireland, it has to be genuine. We have to rid our society of those criminals who are fuel-laundering, those who are still out shooting people and those who rule by the gun and the bomb. We cannot allow that to continue, and we need society to stand up to those people and say, “Enough is enough.” We need to move forward.
I am pleased that we are progressing with welfare reform. I heard some of the detailed explanations given by the hon. Member for Foyle. I will not repeat that detail, but there are many aspects of this that will be challenging for society in Northern Ireland over the next number of years—not least will be the challenge for other Departments as to where the £585 million will come from over the next four years.
I was getting on to that, and indeed I have the answer. The Welfare Reform and Work Bill is about more than just welfare. For example, it has clauses on full employment reporting obligations and apprenticeship reporting obligations that would not be considered to be welfare measures, while on the other hand it has a benefit cap that would be so considered. If he looks at the Bill, the hon. Gentleman will see that some parts directly impact on welfare, as welfare measures, while others, such as the reporting mechanisms, do not. I will be happy to write to him in detail subsequently.
The hon. Member for Belfast South (Dr McDonnell) made a strong contribution. I always feel and understand his heartfelt compassion for his constituents who are on benefits and welfare. I pay tribute to him for his leadership of the SDLP and the good grace with which he has taken the recent change of leadership. I look forward to continuing to help and support him in trying to make sure that his constituents get into work and off benefits. We are really determined to make sure that the economic pact delivers for Northern Ireland, alongside the Northern Ireland Assembly.
The hon. Member for South Antrim (Danny Kinahan) made known his view that the UUP was locked out of the process and the concerns it raised were not addressed. Every single one of the UUP’s concerns, including a sustainable budget, legacy issues, paramilitary monitoring and organised crime, is addressed in this deal. They were addressed previously in the Stormont House deal and they are addressed in the new deal that we have before us tonight. The deal also comes with a significant amount of money: £185 million of new money will be made available to tackle paramilitarism and organised crime in Northern Ireland.
I add my tribute to that given by the right hon. Member for Lagan Valley (Mr Donaldson) to his party leader. On devolution, the departing First Minister has navigated a very difficult course. I was in the Scottish Parliament in the late 1990s, so I know that devolution is not straightforward, and devolution in a multi-party system is even harder. It is a real tribute to him that he has managed to bring Northern Ireland to this point and secured a new start with this deal. I hope that whoever follows him—perhaps the right hon. Gentleman’s powerful speech was a leadership bid—will continue in the same vein. As the shadow Secretary of State has said, this is about leadership. It is also about taking risks with one’s own electorate, not just those on the opposite side.
I say to the hon. Member for South Down (Ms Ritchie) that it was not our wish, either, that the Bill be taken through in this way. We do not want Westminster to have to pull back some of the powers to pass welfare legislation. If we were in a different place at a different time, the Stormont Assembly would have agreed it, but unfortunately Northern Ireland needs consensus and the SDLP is just one of the parties involved. Although I admire its determination for consistency on welfare reform, the fact of the matter is that we could not let the situation continue.
We asked the Assembly to pass a legislative consent motion, and it is important that I put on the record its wording:
“That this Assembly consents to the Northern Ireland (Welfare Reform) Bill 2015 being taken forward by the Westminster Parliament; approves the welfare clauses of the Welfare Reform and Work Bill as initially introduced at Westminster; the draft Welfare Reform (Northern Ireland) Order 2015; and the Executive’s proposals to enhance payments flowing from the agreement announced on 17 November 2015.”
Who are we to override that legislative consent motion? We believe in devolution, and a legislative consent motion from the devolved Parliament is asking this House to resolve the lack of consensus on welfare, to deliver for the people of Northern Ireland.
I say to the hon. Member for Belfast South that the biggest barrier to lifting people out of poverty in Northern Ireland is a dysfunctional Northern Ireland Assembly. Devolution, when it works, will deliver a better deal for the people of Northern Ireland, and it is important that we get over the current barrier by passing time-limited measures in this House, so that we can move forward together.

I appreciate the Minister’s helpful summary, but does he accept the assertion made by the hon. Member for North Antrim (Ian Paisley) that the deal is being approved by this House only because the Northern Ireland Assembly is dysfunctional and unworkable?
I do not think that the Northern Ireland Assembly is dysfunctional. It deals with people’s problems and issues every day. The Ministers I have met since my appointment make daily decisions that can result in improvements. On welfare, however, after four years of the tortuous freezing of government, something had to be done. If the Northern Ireland Assembly grasps the deal that the parties have achieved, the future will be all to play for. The ability to deliver and to improve the lives of people in Fermanagh and South Tyrone is better than the situation for many of my constituents. A lot of Members who are not from Northern Ireland will be slightly envious of the flexibility, funding and generous package on offer to the people of Northern Ireland. We do that with good will, because we want Northern Ireland to move away from its troubles and give the best chances to its people.

Commons ChamberThe Government’s position is that we will give the final go ahead for the devolution of corporation tax once the conditions on financial sustainability in the Stormont House agreement are met. We have already passed the legislation to enable us to do that. We just need commencement of that legislation to enable the transfer of power to take place. The agreement published this week sets out the aim of the Northern Ireland Executive to deliver a reduced rate of corporation tax operating from April 2018. I know that we are all working on that and hoping that that target date will be met.

I thank the Secretary of State for bringing forward her statement today. May I, too, pass on some words to Peter Robinson to wish him well in his retirement and in future years?
In her statement, the Secretary of State suggested that the involvement of members of the Provisional IRA in a murder in Belfast led to the conclusion that it was necessary to convene a fresh round of cross-party talks. How concerned is she now that all those involved in the discussions, including Her Majesty’s Government, the Irish Government, the Democratic Unionist party, the Social Democratic and Labour party, the Ulster Unionist party, the Alliance party and others, all accept that the IRA is still in place, but Sinn Féin does not?
The crucial issue is that all participants in the talks process are absolutely clear that there is no justification whatever for paramilitary groups in Northern Ireland, that they must all disband, and that for that to happen we need not just a surge in criminal justice activity, but a broad approach that embraces the whole community in working for the day when those organisations are consigned to Northern Ireland’s past rather than its present.

Not only can I assure my hon. Friend that there is no amnesty, but in the latest Northern Ireland agreement, which was reached yesterday, there is £160 million more money to fund our police forces and security services in Northern Ireland to pursue people who commit crimes, or who have done so in the past, against the innocent people of Northern Ireland. Yesterday’s agreement also included measures to monitor the paramilitary activity of former paramilitaries or organisations that should be inactive. We are determined not only to deal with the past, but to invest and give our police the support to make sure we bring to justice those terrorists who have been on the run and who have not yet been brought to justice, as well as those dissident republicans who are out there right now targeting colleagues and police officers who are going about their business in Northern Ireland every day.

The Minister has said that he does not think there is any inequality. How, then, does he explain that more than 20 PSNI officers are investigating Bloody Sunday soldiers, but not one police officer is investigating the 11 murders in Enniskillen on Remembrance Sunday in 1987?
I do not know the inner workings through which the Chief Constable and his senior officers decide to investigate each individual case, and nor should I. Suffice it to say that the Chief Constable is determined, as I understand it, to bring to justice any individual who has broken the law in the past. There are plenty of former and current terrorists who need to be brought to justice, and PSNI officers and Security Service officers are out there every day trying to catch the terrorist. It is not, in my view, all focused on former soldiers.

Commons ChamberNaturally, with criminal and paramilitary activity it is not easy to get an entirely clear picture. Of course, a key element of the talks will be deciding what further process of verification is needed. There has been considerable discussion of reviving a body similar to the Independent Monitoring Commission. I think that is a useful point for discussion, and I am sure that the parties will be considering it in the coming days.

I thank the Secretary of State for her statement. I know that she has tried to put as positive a spin as possible on the report, but it confirms that the report by the Chief Constable of the PSNI two months ago was accurate, that the IRA is still in place, that IRA members murdered Kevin McGuigan and that they are still involved in paramilitary and criminal activity. It actually goes further and gives more information, indicating that the IRA army council is still in place and that it oversees the IRA and Sinn Féin’s overarching strategy. Will she now indicate whether Sinn Féin accepts that the IRA is still in place, and does she accept that the IRA and Sinn Féin continue to be inextricably linked?
It will not surprise the hon. Gentleman to hear that I am unable to speak for Sinn Féin—no doubt it will provide its own response to the report—but I also take issue with him, because I am not trying to put any spin on the assessment. Today of all days, we need people to read the report and consider it objectively. Yes, there is a great deal in it to be very concerned about, but we need to use it as an opportunity to reflect on how we deal with the problem and on what more needs to be done to ensure that Northern Ireland makes progress. I have acknowledged that the situation is serious and that the task will not be easy, but I think that it is a task that can be achieved. Northern Ireland’s leaders have shown in the past that they are capable of grappling with this very difficult kind of issue.

Commons ChamberI agree with my hon. Friend that unless this impasse is solved, public services will start to be hit as the money runs out. Let us not forget that the people of Northern Ireland deserve that this solution be put in place. We are already seeing the impact on the health service in Northern Ireland—and no doubt on other services, too. There is very little time left before the people of Northern Ireland realise that a non-functioning Stormont will take Northern Ireland backwards, not forwards.

May I refer the hon. Gentleman to his party leader, who has been in the talks over the last few weeks? He may be able to refresh his memory about what proposals have been put forward. The talks are ongoing; they are intense and we hope collectively to come to a resolution.

Commons ChamberIt is clear that in Northern Ireland everyone, not just some Members of the Assembly and the Government, needs to take responsibility for making balanced budget proposals and agreeing an effective Assembly Government based on sustainable finances, a point that I have made following the last two statements to the House by the Secretary of State. If people do not agree, it behoves them to state what they would agree to and then be prepared to discuss that to keep the whole system going. We could spend all night listing issues with how the Assembly works, and there are some who are not prepared to accept some of what was signed up to. It can be easy to get an agreement, but implementing it is usually slightly more difficult.
There is a golden opportunity to secure a peace process for the future. The speech that I was looking for in this debate was the one made by the hon. Member for Bury South (Mr Lewis). We could have a fascinating debate lasting until the early hours listing all the problems, but the hon. Gentleman set out solutions. I may not agree with every point that he made, but he was certainly right to say that there needs to be a positive approach to finding a solution to the current impasse. All parties, not just some, need to take responsibility.
I hope that the Government will continue to move down the path set out in the Belfast agreement, support the implementation of the Stormont House agreement and support Northern Ireland’s politicians in coming to a point where they are able to govern on behalf of the people of Northern Ireland and deliver many of the benefits that devolution should be bringing. That, for me, is the core of the matter. I want to see a time when Northern Ireland debates in this Chamber are about the economy, jobs and the future, rather than the past and the constitutional situation. I am as fervent a Unionist as the next person; I believe that the four nations are better together than they are apart. Clearly, there are those in the Chamber who disagree with that statement, but to be fair they show that one can pursue their argument through democratic debate, not by any other means. For me, the solidity of the Union lies in being able to discuss those issues rather than constantly coming back to the constitution.

I think that we all want to discuss the economy and the good things about Northern Ireland and the rest of the Union. Does the hon. Gentleman accept that we cannot ignore criminality, paramilitary actions and murder on our streets?
No, we cannot have murder as part of our political debate. Paramilitary groups have no place in this country. They should disband and respect the fact that, as I said earlier, decisions nowadays will be taken by ballots, not bullets. We go about achieving that by making sure that we have an agreement that all parties can take forward. No devolved Assembly can live for very long without a sustainable financial position. Governments in Wales and Scotland agree balanced budgets despite huge political disagreements with Westminster. I hope that we can see some parties take a lesson from that in Northern Ireland to allow the Assembly and Executive to proceed with sustainable finances for the next few years.
It has been a pleasure to have the chance to contribute to the debate. I hope that we can go forward on the basis of a positive plan that allows us to put Northern Ireland’s future back exactly where it should be: in the hands of Northern Ireland’s people and their elected representatives, not coming back to a Committee Room in this House for direct rule.

The hon. Member for Torbay (Kevin Foster) said that we should be more positive about some aspects. How much more positive can we get than Northern Ireland qualifying for the European football championships for the first time at the weekend, and the Ireland rugby team topping their group in the rugby world cup, although there were quite a number of Ulstermen playing for Ireland as well? Let us be fair—there are some positives. Perhaps we should just let the sportspeople of Northern Ireland run Northern Ireland. Would we have a better place? I do not know. It is difficult to replicate the euphoria in the sporting world in Northern Ireland in politics at the moment, but that is what we need to try to do. However, we cannot ignore what is happening on our streets—the murder and the criminality. All those aspects must be dealt with.
It is incumbent on us to go back to where we were in December. Not every party agreed with the Stormont House proposals. In fact, Sinn Féin was the only party that totally signed up to them. Let me quote what some of its members said at its party conference in March this year. Gerry Adams, the Sinn Féin leader, said of the deal they got at Stormont House in December:
“Welfare reform is a fresh start that we need to seize with both hands”.
Deputy First Minister Martin McGuinness referred to a
“remarkable achievement which has the potential to give the executive a fresh start…Against all the odds we have forged a way forward, we have achieved a deal in the interests of the people…We are immensely proud of the achievement”.
Only a couple of days later, they reneged on that deal. Why? Is it because they want to demonstrate that Northern Ireland is unworkable? There is a real challenge for us to prove that it is workable. We need to bond together—perhaps without Sinn Féin, but we need to do it. We need to bond together with unions, with representatives of the community, with public representatives, and, dare I say it, with sportspeople to make sure that Northern Ireland is a workable country and that Sinn Féin and those who are determined to drive that away cannot be successful.

I thank the Secretary of State for her statement. I, too, welcome back the hon. Member for Gedling (Vernon Coaker) as shadow Secretary of State for Northern Ireland. I also welcome his comments on the issue of consent in relation to the people of Northern Ireland, and I look forward to that being repeated by his party leader and the shadow Chancellor.
The Secretary of State will be aware that very few cases of criminality have been brought by Her Majesty’s Revenue and Customs for fuel laundering and tobacco and alcohol contraband products. Is the Secretary of State willing to engage the National Crime Agency in tackling the issue of criminal and organised paramilitary activity? It is an international issue, because some of those concerned come from the Republic of Ireland jurisdiction. I hope that the Secretary of State will ensure that they are not let off the hook by making sure that the Garda Síochana is also involved in tackling such criminality.
The hon. Gentleman is right to raise matters relating to HMRC and the National Crime Agency, as well as law enforcement bodies south of the border. They all have a hugely important part to play in tackling organised crime, criminality and cross-border crime, and I know that they are making every possible effort. I will engage with my colleagues across government who have responsibility for such bodies to see whether we can do more to ensure that we do everything we can to combat criminality and cross-border crime.

Commons ChamberOne reason we do not think that it would be right to move to suspend is the difficulty in getting things up and running at the end of a period of direct rule. As I have said, it is not part of our plan and we hope to see a successful outcome to the talks so that that question goes away.

I welcome the Secretary of State’s statement today. Obviously, there is a lot of bad faith and bad trust in the entire process in Northern Ireland. Whether through Sinn Féin supporting the Stormont House proposals on welfare reform and then reneging on that agreement some three months later, or as a result of members of the IRA who have murdered people on our streets in Northern Ireland, there is a lot of bad faith. I note that the Secretary of State said that she will initiate the voluntary exit scheme for the Northern Ireland civil service. Is that the start of the Secretary of State’s process of returning powers to Her Majesty’s Government in Westminster, or is that something separate?
That is a separate issue. We have always said that the Stormont House agreement is a package and that if one part of it falls, the rest of it falls. Most of the financial package has not been delivered yet and we would look carefully at the implementation of the rest of the agreement before we could deliver it. For the VES to happen we needed a decision, as people were going through the scheme and expecting to leave their roles from the end of the month. That is why we pressed ahead and will release the funding to enable that to go ahead. Let me make one last point on welfare reform. I want to thank the UUP, the DUP and the Alliance for voting for financial sustainability in the Assembly. I know that it was not an easy choice and I thank them for their responsibility.
