Commons ChamberI am grateful to the hon. Lady and to other Northern Ireland Members who have been forceful in putting the case for the fishing communities that they represent. I recognise that they, like many other areas of the country, are affected by an industry in crisis. Our immediate attempts will be to secure for them adequate fish stocks to exploit over the coming year. However, I put on record my determination that they should not continue to live from hand to mouth. As someone who has been in business, I do not know how fishermen can deal with a bank manager when they do not know what they will be able to achieve in three, four or five months’ time. I want to give them a longer-term future, in which they can be part of the solution, rather than being constantly browbeaten by an overbearing and multi-layered regulatory system.
I am extremely grateful to the Minister, but may I remind those on the Treasury Bench that there are a lot of questions to get through, and that a little economy is needed in their answers?
12. What recent steps her Department has taken to maintain the level of biodiversity.
We will certainly need a new relationship with the ABI post-2013, but the hon. Lady must be careful with the numbers that she bandies around before the House. The right hon. Member for Leeds Central (Hilary Benn) had spoken of 50% cuts in capital for the Department that she now shadows if Labour had been re-elected, and she cannot now decide that that was a pipe dream and was not mentioned. Of course this issue is important: it is about people’s homes and flooding. Some 5.2 million homes in this country are at some risk of flooding, and the Government have made this issue a priority. That is why we have protected this budget out of all proportion to other budgets in the difficult round that has been forced on us by the previous Government.
I remind the House that if we are to get down the Order Paper we need short questions and, from Front Benchers, short answers.

Friend knows, I entirely support the idea that the House should be sovereign, and if there is any doubt about which set of rules should reign supreme, it should be Acts of Parliament passed in this House, not those passed by the European Union. I do not want to spend too long proceeding down the line of European Union rules and regulations. I appreciate that that would stray—
Order. I am extremely grateful to the hon. Gentleman for what he has just said. It is very wise that he has made that observation and that he intends to operate in accordance with his own stricture. The point about regulation has been made and the point about European competence has been made. The hon. Gentleman, though a new Member, will be very well familiar with Standing Order No. 42 on the subject of tedious repetition and irrelevance, and I know that he will not wish to fall foul of that. In passing, although I know he is a man with an exceptional memory, I should perhaps just remind him and the House and others interested in our proceedings that on another private Member’s Bill on 22 October this year, he developed his argument for one hour and 39 minutes in respect of a two-clause Bill. This Bill has five clauses, it is true, but he behaved in a slightly unsatisfactory way on that occasion, and I feel sure that he will not want to repeat the experience.
Thank you, Mr. Speaker. No, I mentioned the European Union, but it was brought up by others and I simply responded to them.
I am concerned about the Bill because it appears to me that in the long term it is likely to result in the decline of meat-eating in this country and it will also affect the dairy products that we consume. I will explain why that is likely to be the inevitable result of the Bill.
The Bill’s whole premise is to impose on the Secretary of State a requirement
“to improve the sustainability of the production, processing, marketing, manufacturing, distribution and consumption of products derived to any substantial extent from livestock”.
The requirement could hardly have been drafted in wider terms, although, to be fair, I am sure that that is exactly what the Bill’s promoter desired.
It does indeed, and I will make mention of them later. I am not sure whether the Bill’s promoter considered those points when drafting the Bill. If so, it raises the question of whether they were taken into account.
Order. For the avoidance of doubt, I trust that the hon. Gentleman has no intention of offering the Chamber a disquisition on the contents of the coalition agreement. That would be a lengthy enterprise indeed, and I know that he does not wish to stray into that.
No, absolutely not. It is a very tiny matter really.
I want to deal specifically with clause 1. Subsection (1) states:
“It is the duty of the Secretary of State to ensure the sustainability of the livestock industry.”
What I am not clear about is why it should be the duty—I emphasise the word “duty”— of the Secretary of State to ensure the sustainability of the livestock industry. Surely the best people to ensure that farming is maintained are farmers. Surely it makes sense to rely on farmers’ desire for self-preservation to ensure that they tend their livestock and look after their land in a sustainable way. All the evidence points to the fact that we can rely on them, both to protect the welfare of their animals and to care for their own land properly. How can that responsibility be transferred to the Secretary of State? Do we really expect the Secretary of State to spend every weekend driving up and down the country doing spot checks to see whether farmers are doing their bit to maintain the sustainability of their farms?
If any industry—if we are calling farming an industry, which I consider to be an unusual term, but for the purposes of the Bill it is an industry—in the United Kingdom can make a claim for having proved over the centuries that it is capable of sustainability, it is surely the livestock industry. Man has been tending animals since the beginning of time. Agriculture is the oldest of all industries continued in this country. What more can the poor farmer possibly be expected to do to make his “livestock industry” any more sustainable than it has been already?
Fortunately, the Bill’s draftsman has also spotted this potential problem, and in clause 3, headed “Interpretation”, we are helpfully given a most enlightening explanation of what is meant by the phrase
“ensure the sustainability of the livestock industry”.
We find that it goes much further than anything that we may ordinarily think. For the purposes of the Bill, we are told that the words mean
“addressing the economic, social and environmental impacts of all stages of livestock farming and consumption, in order to…reduce emissions of greenhouse gases and address climate change in the United Kingdom and overseas…prevent biodiversity loss in the United Kingdom and overseas…promote animal welfare…protect and enhance the landscape…protect the resilience of farming communities, and…promote food security.”
Not much to do there, then.
We see immediately that the idea of livestock sustainability has in one fell swoop been extended to include animal welfare, the well-being of farming communities as a whole, which I take to mean the whole of rural Britain, and the promotion of food security—matters that I feel sure any casual inquirer into livestock sustainability would not expect to see because they go well beyond any concept of sustainability, even if it is considered in its widest sense. This starts to demonstrate the enormous difficulties that face anyone who attempts to define the term “sustainable” in so far as it relates to farming. The Bill seeks to define sustainability not just in environmental terms, but in social and economic terms too. It is such a broad definition that it makes the Bill completely unworkable in any meaningful way.
I am concerned that the definition in clause 3(d) includes a requirement not just to protect the landscape, but to enhance it too. It is not clear to me why that requirement should be included in the Bill.
My hon. Friend is enormously generous in giving way. Is it not true to say that the glories of England are created by God and the farmer, and not the bureaucrat?
Order. The hon. Member for Bury North (Mr Nuttall) should respond to that very graceful intervention within the terms of the debate on the Bill, and I feel sure that that is what he will do.
Over the centuries, farming has been sustained in this country by the farmer and the countryside has been looked after by the farmer, and I will come on to those matters later in my remarks.

Commons ChamberI can give the hon. Lady clear assurances on this point, but we need to start with a little myth-busting on the back of press speculation. Only 18% of forests and woodland in England are owned by the state and it is wrong to confuse ownership with any suggestion of a reduction in biodiversity. It is quite right, and in the spirit of the coalition agreement, to consider giving the community who live nearest to the forest the opportunity to own it, as that community and civil society are most likely to give it the best protection. Finally, I should like to reassure her by clarifying that not one tree can be felled without a licence being issued by my Department. In the last analysis, we are committed to forest biodiversity and to enhancing biodiversity. Our forests are among the richest of our genetic resources and we have every intention of protecting them.
May I begin by thanking the Secretary of State for welcoming me to my new role and for the briefing that she gave me on Nagoya? I am sure that the whole House will join me in welcoming the new fund that the Government have pledged in order to deliver international biodiversity benefits through international forestry.
On Government plans to maintain biodiversity at home, however, we have seen a series of deeply worrying moves from the right hon. Lady over the past three months. The Government plan to sell off or simply give away 140 national nature reserves; our national parks, which a Labour Government began in 1949, will suffer a catastrophic 30% cut to their budgets, leaving park workers unemployed, our national trails abandoned and precious habitats neglected; and her Department has announced a review of England’s forests, seeing them sold to the highest bidder—asset stripping our natural heritage. Is it not the case that she preaches environmental evangelism around the world and practices environmental vandalism at home?
Animal disease is costly to the Government and farmers, both financially and emotionally. In 2009-10, the Government spent £330 million on animal health and welfare, and the foot and mouth outbreak in 2001, which devastated the local farming economy in Devon, is believed to have cost the UK £8 billion. I recently had a meeting with farmers in Newton Abbot, and they are very concerned that the Government will not listen to them about shaping plans, going forward, for cost and risk sharing—
Order. I know that the hon. Lady is a new Member and I appreciate her commitment to the House, but far too many questions are prefaced with substantial descriptive statements. That must not happen. I ask her for a quick sentence, and then we will move on.
Will the Minister meet me and some of my local farmers to discuss their ideas on how to reduce cost and risk sharing?
My hon. Friend will be pleased that we managed to protect the flood budget in the comprehensive spending review. The amount is reducing—[Interruption.] At 8% a year it is considerably lower than the 50% capital cuts the Labour Government proposed. An 8% cut across the piece is a considerable advantage.
I have seen the schemes in my hon. Friend’s constituency, and I have met the excellent Defend our Coast community group. That is exactly the sort of arrangement whereby we deliver more by working in a partnership, and deliver a better result at the end of the day. I hope that many of his constituents will—
Does the Secretary of State accept the findings of the independent scientific group on bovine TB, in particular when it says:
“Scientific findings indicate that the rising incidence of disease can be reversed, and geographical spread contained, by the rigid application of cattle-based control measures alone”?
I am delighted to be able to offer that support. The wildlife trusts do an excellent job, which is why we see great scope in the concept of the big society for more work of this kind.
I might have made an error, Mr Speaker, in not responding myself to the question put by the hon. Member for Bristol East (Kerry McCarthy). I apologise, as I should have taken it—but, of course, I agree with everything that the Minister of State had to say.
The right hon. Lady, whom I have known for 15 years, is unfailingly courteous, and I think that will be very much appreciated by the House.
The heart of the new national forest lies in my beautiful constituency of North West Leicestershire. Will the Minister assure the House that any sale of Forestry Commission assets will not reduce public access or enjoyment of our woods and forests?

Commons ChamberThe Minister will know of my interest in fisheries. Will he confirm what discussions he plans to have with commercial fishermen in relation to any extension of special areas of conservation recently introduced, the introduction of marine-protected areas, and the introduction of no-take zones around our coast?
Thank you, Mr Speaker. Of course, it is important to consider mackerel in relation to marine areas of conservation. Therefore, in the context of that species, as well as others, I will have close contact with all the four areas around our coast—how am I doing?—that are responsible for bringing forward these plans. I understand that the matter is causing great concern among fishing communities, which must take part in such schemes—I know that they are doing so, but they must continue. I have visited some of the areas—I will get round to all four of them—to ensure that their concerns are raised and to help to iron out any problems.

Commons ChamberThe Minister will know that Stoke-on-Trent is blessed with many things, and among them are the great canals of England: the Trent and Mersey and the Caldon canal, where we recently had the Hanley regatta. In order to become a proper third sector organisation, British Waterways needs an appropriate financial settlement following the comprehensive spending review and a longer contract with Government to replace annual grants. Can British Waterways’ property endowment be put in a charity-locked mechanism, so that the Treasury does not sell it down the canal, and we can be assured that, as an example of the big—
Order. I am grateful to the hon. Gentleman, but I think that we have the gist of his question.
I am grateful for all those questions, and I look forward to debating this matter with the hon. Gentleman and other colleagues to whom it is important. I know that he is particularly interested in the heritage of our waterways. The answer to his question is yes. For the third sector model to work, British Waterways will have to have access to its estate, or a large proportion of it, for it to gear up funding for sustainable funding in the future. I can assure him that it will not proceed unless it is locked in in that way. Those are the negotiations that we are taking forward with British Waterways.
T3. It is a shame that the former Prime Minister and right hon. Member for Kirkcaldy and Cowdenbeath (Mr Brown) made only a fleeting visit to the Chamber, as I would have liked him to have heard my question. Does the Secretary of State agree that the previous Government’s payments agency was an expensive shambles? Will she visit Matching and other villages in my constituency and meet farmers who were threatened with financial ruin when payments were delayed? Will she take steps to simplify that service?
Order. May I say very gently to the hon. Gentleman and to other Members that topical questions in particular are supposed to be brief, and that a Member has a topical question—singular?
I shall try to reply with one answer. I fully understand my hon. Friend’s concern. I would be very happy to visit his constituency, as I have done many times, and I am very conscious of the distress that the mistakes of the Rural Payments Agency caused to many farmers.

Commons ChamberI congratulate the Secretary of State on his appointment. I am not sure who he was looking at just then, because Labour Members were very decisive about the need for new nuclear power. When you examine the transition to a low-carbon economy, are you factoring new nuclear power in or out? Similarly, do you factor nuclear power in when it comes to—
Order. May I just say to the right hon. Gentleman that I am not factoring in anything?
Indeed. Is the Secretary of State factoring in new nuclear power when it comes to carbon emissions? Does he recognise that in order to drive forward new nuclear power he must play a decisive, hands-on role?
