My hon. Friend is absolutely right and it is very sad, when people gain pleasure from using these rifles, that the Government want to effectively ban them. The muzzle energy will effectively mean a ban on the .5 calibre. The only reason the Government are banning them is that they happen to be one of the largest calibres. The police and the other authorities are saying that because they are so large they must be dangerous. I have to tell the House that any rifle is dangerous in the wrong hands and used in the wrong way. A .22, the very smallest rifle, is lethal at over a mile if it is fired straight at somebody. All rifles need to be handled with great care and held in very secure conditions.

In summing up, the Government will, I think, cite some evidence as to why these rifles need to be banned. They will cite the one that was stolen and chucked over the hedge with the barrel chopped off, they will cite the fact that one was used in the troubles in Northern Ireland, and they will cite the fact that more high-powered weapons are being seized by customs at our borders. But this has nothing to do with .5 calibre weapons. It has everything to do with illegal weapons, the sort of weapons of choice that, sadly, the criminal and the terrorist will use, but not these particular weapons.

Does my hon. Friend not agree that the three examples he cites are actually applicable to pretty much any weapon, and that, if we concede on that point, perfectly legitimate rifles and shotguns would be at risk of being removed from society all together?

That is precisely the point I am making. This whole thing would set a precedent: .5 weapons today, then .60—where do we go next? Just because people think they might get into the wrong hands and be used by the wrong people. That is the wrong way to govern. We should not prohibit things unless there is really good evidence for doing so.

I have been having discussions with Ministers. I have said that instead of banning these weapons, as there are so few of them and they are able to be fired legally at so few ranges by so few people, why not toughen up the rules on storage to make it absolutely impossible for them ever to be stolen? If they had to be stored in an armoury, at a gun club by arrangement with the police or in a military storage by arrangement with the military, storage would have to be approved by the police. There could be alarms and CCTV in the storage and weapons would not be licensed unless the police approved places of secure storage. That would be a much more effective and useful way of going forward if we want to stop weapons falling into the wrong hands, and would make it much safer for us all.

If the right hon. Gentleman will please allow me, I will make a little progress. I shall deal with the funding settlement in some detail in a moment.

I was talking about transformation and technology, which is a really exciting area of policing. We have seen great innovation in recent years in how police forces can use technology to serve their communities and to use their specialist skillsets in the best possible ways. If I may, I must pay credit to my local police and crime commissioner, Marc Jones, a Conservative, who has purchased a drone for Lincolnshire police which, given the size of the county, is an invaluable tool for the local constabulary. Lincolnshire police have used the drone for a variety of reasons, including to locate missing people—one can imagine the difference that such an investment can make in a very rural area—as well as to help with hare coursing investigations, in which a drone can make such a difference.

It is very welcome that new technology is used in that way, but does the Minister accept that some technological improvements are dependent on decent wi-fi, mobile phone and broadband connections, which in rural areas are not yet quite where they need to be?

My hon. Friend knows, as I do—it was my first ever campaign as a candidate—that the challenge of improving broadband in rural areas is always there. By and large, more urban areas have excellent coverage, although there are blackspots. The Department for Digital, Culture, Media and Sport has announced a scheme whereby we can use some technology at parish churches, and the Secretary of State for Environment, Food and Rural Affairs has a keen interest in the issue and is acting accordingly.

Let me turn to funding. We have continued to listen to the police. Last year, my right hon. Friend the Minister for Policing and the Fire Service spoke to every police force in England and Wales about the changing demands on the police and how they could best be managed. We have acted on the basis of that consultation and announced an increase in overall investment in the police of £460 million from April for this financial year. That includes a £50 million increase in counter-terrorism funding, and it enables police and crime commissioners to raise up to £280 million of local funding through council tax, protecting the police grant in cash terms and increasing funding for national priorities by £130 million. I am delighted that most police and crime commissioners have accepted the Government’s challenge to make that change to their policing precept and are consequently able to decide for themselves how that money is best spent in their local area.

On that point, the Committee on Standards in Public Life, of which I am a member, reported in some detail on party leadership. It strikes me that simply calling out bad behaviour may be going nothing like far enough, so will the Home Secretary, at least on behalf of our party, assure us that not only will offending activists and third parties be brought to book, but it will be done in a public and robust manner?

May I take this opportunity to thank him for his work on the Committee on Standards in Public Life and to thank Lord Bew for his leadership in delivering the report, which makes a number of recommendations? I may talk delicately across the Floor of the House with the hon. Member for Penistone and Stocksbridge (Angela Smith), but there are some very clear recommendations in the report and some very hard-hitting points. I urge everybody to ensure that their party leaders are held to account and deliver on those.

Thank you for calling me to speak, Mrs Moon. We have worked together on many other issues and it is a great pleasure to serve under your chairmanship today. I also thank the representative of the Petitions Committee, the hon. Member for Newcastle upon Tyne North (Catherine McKinnell), for comprehensively outlining all the issues that surround this very complex case. There are all sorts of arguments for and against virtually every aspect of it—it is not straightforward.

I will contribute a constituency perspective and, of course, a family perspective. On 1 October 2012, I was at home working on my iPad when I read a tweet that a five-year-old girl had disappeared after being seen climbing into a vehicle on the Bryn-y-Gôg housing estate in Machynlleth in Montgomeryshire. It is not unusual to get tweets like that, but there was something about that tweet that immediately gave me the sense that this was something serious. Within hours, the people of Machynlleth and the surrounding area had joined the search for five-year-old April, the daughter of Coral and Paul Jones, who live on the Bryn-y-Gôg estate. Over the following days, a huge number of volunteers and local and national organisations, as well as the police, formed the most intensive, widespread search for anybody or anything that I have ever seen in my life—it was just amazing. Five days later, a local man, Mark Bridger, was charged with abduction, murder and perverting the course of justice. In May 2013, Bridger was found guilty and sentenced to life imprisonment. The sentencing judge, rightly in my opinion, pronounced that he should never again be released from prison.

The death of April was an absolute tragedy for her family and friends, but it touched the entire nation. It was something that the whole of Britain became engaged with. There was a national focus on the town of Machynlleth. The search for April and the truly amazing response of the people of that small market town brought what seemed like the world’s media to Machynlleth. I spent several days there myself. Like everybody else, I found it really difficult to comprehend just what had happened and what April’s family would have been going through.

I pay tribute to April’s parents and her sister Jazz, who are with us in this Chamber today. They have made huge efforts to raise awareness of the widespread availability of pornographic and sexual images of children. They want to do everything they can to prevent other families from facing a similar tragedy and from going through the same pain that they have gone through and, no doubt, are still going through today. Their efforts have culminated in this debate in the House of Commons, after a petition raised by April’s family reached more than 100,000 signatures. For completeness, I will read out that petition, which is quite short:

“We the undersigned call on the prime minister to make all sex offenders remain on the register for life no matter the crime, for service providers and search engines to be better policed regarding child abuse images and harder sentences on those caught with indecent images of children.”

The petition can be divided into three calls for action. In preparation for this debate, I met Coral and Jazz Jones in Machynlleth 10 days ago. We talked through what they expected from the debate and what form an “April’s law” might take. The petition calls for legislation to be based on three objectives. The hon. Member for Newcastle upon Tyne North addressed them all in her speech but, for myself and my constituency, I will repeat some of what she said.

The first objective, which is perhaps the most difficult to achieve, is cleaning up the internet. It should be our ambition to remove all sexual images of children from the internet. We know that the presence of those images is damaging, but removing them is not an easy or straightforward process, because the internet is technologically fast-moving and is not easy to control through legislation. However, the Government have a responsibility, which I think they take seriously—indeed, all Governments throughout the world have a responsibility —to do everything within their power to clean up the internet as far as is humanly possible.

Last week, we learned of a disturbing report, which has already been mentioned but certainly had a very big impact on me, that involved Facebook, a giant of the social media world. A BBC investigative team used the report button, the purpose of which is to highlight to Facebook any improper sexual images on its platforms. The BBC found that 80% of such images were not removed after being reported. There was simply an automated response, stating that the images did not breach community standards—whatever that means. Included were images of children in sexualised poses, pages aimed at paedophiles, and one image that appeared to be taken from a child abuse video. Astonishingly, instead of taking down all those images, Facebook reported the BBC for sharing them.

I cannot be certain of the precise detail of what happened in that case, but it seems beyond all belief. I understand that the images have now been removed, but what we want is for Facebook and every other social network operator, whether small or large, to be under a legal obligation always to take down such images, constantly to survey what appears on their social network platforms and, as far as possible, to report whoever puts them there to the police. We need a law that bans indecent and dangerous content and that ensures that action is taken against whoever instigates or permits it. It must make no difference whether the offender is a small company or is among the biggest companies in the world.

The second aim for what an “April’s law” should include is a stronger process for removing the names of sex offenders from the sex offenders register. I fear that an absolute ban would probably fall foul of human rights legislation, but as far as we possibly can, we must always put the protection of the public first. I do not consider myself to be sufficiently qualified to outline precisely what a process of deregistration might look like in order to satisfy human rights legislation and keep the public safe. However, it must always ensure that no name should ever be removed from the sex offenders list until and unless there is total certainty that the offender has reformed and will not repeat offend.

I ask the Minister whether it is possible to introduce rigour and certainty into the system to a greater extent even than now by establishing some sort of structure similar to a magistrates court structure to judge each individual case. The basis on which we should judge the suitability of a sex offender seeking removal from a sex offenders list is that we must always put first the safety of the public and of children.

The third policy is the importance of always putting sex offenders on the sex offenders list, or at least bringing them to court if the offence justifies it. This has already been covered in this debate, but we cannot have a position whereby police resources or pressure on the criminal court system result in offenders not being prosecuted. Sex offenders should always be prosecuted.

Two weeks ago, there was a report in The Guardian—again, this has already been referred to—on comments by Simon Bailey, the chief constable of Norfolk constabulary and the National Police Chiefs’ Council lead for child protection. He said that the police were struggling to cope with the huge number of criminals looking at indecent images of children online, and that they should focus their resources on high-risk offenders. That is not good enough. All offenders must be looked, not just high-risk offenders. How do we judge between a high-risk offender and a low-risk offender? They are all offenders.

I agreed with the right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper), Chair of the Home Affairs Committee, who wrote in response to the chief constable:

“As you will know, for many decades institutions have put children at risk because it was seen as too difficult, not a priority or resources were insufficient to keep them safe. I would not want to see the same happen over online child abuse.”

I absolutely agree with that. She also said:

“This raises some very serious concerns about the scale of online child abuse, about the level of resourcing the police have available for it, about the systems the police has in place to deal with this new and increasing crime and also about the priority being given to it by police forces.”

We regard child abuse as a hugely serious crime and I believe that it is still under-reported. Police forces throughout the country should make dealing with it an absolute priority. Anybody who is deemed to be a sex offender—albeit they might be described as a low-level offender—should be prosecuted.

On the exploitation of children and police resource, I had reason to talk to Facebook not that long ago about an online bullying problem. Facebook made the not unreasonable point that a lot of this stuff is not necessarily on social media that is within UK control, but on foreign websites in jurisdictions about which we might have limited knowledge and over which we might have limited control. Would my hon. Friend comment on that point and whether he thinks we are suitably focusing on that source of imagery? It is a crime to look for child pornography on the internet, including for employees of the very platforms that we hope will rectify this matter. Does the law give them the power they need to police it themselves?

I thank my hon. Friend for his intervention and I agree with him. The point I am trying to emphasise—I think it is something that most Members in this House believe—is that this is a growing crime. We are also becoming more aware of it, and it has probably been under-reported forever. We are starting to realise just how awful things have been.

This crime destroys young people’s lives forever and it destroys families. We all know what has happened in Machynlleth and the damage it has done at a personal level to the family concerned, but this crime is happening in other places in Britain at a different level. We cannot ever say that the resources are not there to prosecute; we cannot ever knowingly allow somebody to come off a sex offenders register until we are absolutely certain that they are no longer a threat; and we cannot ever allow a major company—no matter how big, how rich or how powerful it is—to adopt an approach to dealing with sex offenders that is different to anybody else’s approach.

I am grateful to my hon. Friend for raising that important issue. He must have read my mind, because I was coming to it. The manifesto we stood on does mean something, and I am pleased to confirm that the Attorney General is undertaking that work as we speak. The scope of unduly lenient sentences is being reviewed at the moment. I hope that gives my hon. Friend the satisfaction for which he rightly asks.

I was asked by other hon. Members to look at other aspects of the criminal justice system. Although they are the responsibility of the Ministry of Justice, I will do so. I agree that it is important that, if perpetrators who are arrested have a range of digital devices, they should be forfeited and searched for inappropriate images. As we have heard, that puts a lot of demand on the police, but new digital tools, such as CAID and fingerprinting, enable much faster recognition of images and should enable the police to manage the increased demand.

In the Minister’s representations to the MOJ, will she commit to raising the issue of whether the Criminal Injuries Compensation Authority reflects the 21st century? It has been put to me that it treats the crimes of sexual assault by penetration and rape entirely differently. Any victim of those crimes would find that an extraordinary distinction.

My hon. Friend makes a very important point. Of course I will speak to my colleagues in the Ministry of Justice.

I want to finish my point on perpetrators time-wasting, demanding things of the police and extracting information from forfeited devices. The hon. Member for Dwyfor Meirionnydd (Liz Saville Roberts) gave an example of a teacher who undoubtedly, as they were going on the sex offenders register, would never be a teacher again. They did not need the teaching plans and resources that they wanted to extract from their computer. That was a dreadful waste of police time. I will certainly take that up to see what more we can do to clamp down on it.

The Prime Minister recently said that she is minded to introduce a new Bill in the next Session to look at what more we can do about domestic abuse and domestic violence. This debate is specifically about child sexual violence and abuse, but that Bill will enable us to look at what more we can do legally. The Home Secretary will chair a group of experts to look at what more we can do to support victims in the criminal justice system to ensure their experience is as positive as possible. The evidence that we get will secure the best possible outcomes. As that Bill is developed, there will be opportunities to look at some of the issues that have been raised today.

A question was asked about what is called Helen’s law. We heard about the absolutely horrendous situation of families who want to know where the bodies of their loved ones have been put by the horrendous criminals who perpetrated those acts. I am a mother myself, so I understand that families want to know exactly where their children’s remains are so they can be reunited with them, lay them to rest and have a place to visit them. The Justice Minister made it clear that he is looking at options to encourage offenders to say where the remains are, including making their release conditional on declaring that information. The Ministry of Justice is doing good work to ensure that happens.

If the hon. Gentleman had been here at the start of the debate, he would have heard me list most of those 34 items of legislation, because I recognise that those are important pieces of legislation. I am asking the Minister to look at two simple things: a lockable cabinet, so there is no access by children and young people who do not realise that this is a weapon that can kill, even though there are regular controls; and the issue of trigger locks. I entirely concur with the hon. Gentleman—the next portion of my speech covers this point—that it is important, as part of general understanding, that those who have weapons are encouraged to look at the good husbandry of those weapons. I spoke to a number of shooting organisations and individuals prior to the debate. They are very keen to ensure that we have proper training and proper use of gun clubs, with people getting involved in air gun clubs, so that they understand the complexities of the weapon and the fact that they can still be weapons that can cause danger and death if misused, despite all the legislation I have mentioned.

The right hon. Gentleman has not yet mentioned the storage of ammunition and I wonder if he is coming to that. With shotguns and other firearms there are quite strict regulations about separate storage, so that even if kids get into the gun cabinet, they do not find the ammunition alongside the gun.

I am grateful to the hon. Gentleman for raising that point. It is another central point about lockable cabinets—perhaps I should have made it clear that I mean separate, lockable cabinets for a weapon and for ammunition.

Given the time left now in the debate, the purpose is not to raise wider airgun issues; it is to focus on those two issues. It would not be damaging to responsible airgun owners, or to those whom the hon. Member for Strangford (Jim Shannon) wishes to support and defend, to have lockable cabinets for ammunition and for the gun. That would not be to the detriment at all of those users. The second issue is for trigger locks to be looked at as an additional protection, because all of us have been children, interested in exploring and looking at what our parents do. The management of those issues is extremely important to ensure the safety not of the responsible users, but of those who do not know the capacity of the weapon that might be available to them. In George’s case, that led to his tragic death.

Jayne and John Atkinson have continued to press this issue over many years, including through me. I hope that I have now put it on the Minister’s agenda. I would welcome his view on the three main points and his response on the issue of licensing.

The right hon. Lady is very well aware that Her Majesty’s inspectorate of constabulary has made it clear that the front line in policing is being protected. I note that no Member on the Opposition Benches, be it the shadow Home Secretary or any other hon. Member, welcomes the 10% fall in crime that we have seen since the general election.

I am aware that many PCCs have innovative ideas on how to handle low-level complaints, in particular, against the police, and I see this as a positive way for them to engage with their local community. I am giving careful consideration to the role that PCCs can play in the new arrangements because I think they could play a valuable role in improving the area of police complaints.

As the right hon. Lady is aware, intercept warranty is covered by RIPA, and as I said, my right hon. Friend the Foreign Secretary will shortly make a statement about the legal framework under which the agencies operate. I suggest that she waits for that statement. I am clear that the ISC will have available to it the evidence it needs to conduct the inquiry, and it is right and proper that it does that. Of course, it has a new status in terms of its relationship with Parliament. I think people will want the Committee to conduct that inquiry, as my right hon. and learned Friend the Member for Kensington, who chairs it, has indicated it will.

I am pleased at the excellent news that the Prime Minister will open the exhibition, and I congratulate my hon. Friend on his work in chairing the all-party group on human trafficking and on bringing forward that exhibition. I am sure that it will remind us not just of the hidden trafficking that exists in UK constituencies as a result of cross-border trafficking but also—unfortunately—of the fact that trafficking takes place within the United Kingdom.

We know that the public want a visible police presence, working with them to identify and tackle issues in their communities. Year on year the crime survey for England and Wales shows that that approach to policing is valued by the public, helping to build public confidence and bring crime down by 10%.

For neighbourhood management to be really effective it requires the active involvement of other Departments such as those for health and housing. That works quite well in Dyfed-Powys, but is the Minister happy that it is working well everywhere else?

I agree with my hon. Friend that, for neighbourhood policing to be completely effective, it requires not just the police to work with others, but also with other Departments. My right hon. Friend the Home Secretary has written to chief constables and police and crime commissioners to emphasise that it is important, particularly in the field of mental health, for the police and the health service to work better together than they have in the past and to improve their response to that particularly vulnerable group of people. There is always more that we can do on that.

It is a great pleasure to serve under your chairmanship, Mr Crausby. I congratulate the hon. Member for Blaenau Gwent (Nick Smith) on securing this debate on an important issue, and I agree with his concluding remarks. I am grateful to Mr Speaker for waiving the sub judice rules so that I can set out some details that the hon. Gentleman is familiar with, but which it would be helpful to get in the public record.

The hon. Gentleman has a particular interest in this issue because one of the care homes covered by the investigation was in his constituency. He and other hon. Members will know about family members of those who were neglected, or those who sadly died, who will be affected and will be concerned about what happened. I am sure that his interest, and the interest of other Opposition Members, will keep this issue at the forefront, to ensure that we learn lessons from it.

Marilyn Jenkins’s mother was in the Brithdir home and died. She is unaware whether her mother was properly treated or not. Will she ever be able to get answers to that question?

I should have said that hon. Friends, as well as Opposition Members, will know of such cases, too. The hon. Member for Blaenau Gwent asked whether the prosecuting authorities would meet family members. That seems sensible. I have had experience of cases in the criminal justice system, in which—even if the outcome was not everything that people wanted—understanding what happened and having the facts, and understanding the thinking, at least gave people a sense that a proper process had been followed.

In my hon. Friend’s constituent’s case, and I suspect in that of many other families, even if they may not be happy with the outcome because the prosecutor has not been able to proceed with the case, it is important to know what happened to their family member and whether they were properly treated. Although that may not give them satisfaction, at least they may understand what happened and can ensure that they and other people learn the lessons, so that it does not happen again.

The hon. Gentleman is right. There is no place in our society for anyone who abuses anyone for whom they are supposed to be caring, whether a child, a vulnerable adult, or any other member of the community. We should always be vigilant about dealing with that.

Operation Jasmine was a long and difficult case for all those concerned, with 103 alleged victims, 63 of whom have subsequently died. That must be incredibly distressing for their families. I thought that it would probably help, given the hon. Gentleman’s questions, if I gave the House some facts about the operation and the outcome of the police investigation, which commenced in 2005.

T2. The Home Secretary will be aware of the excellent scheme run by Dyfed-Powys police, which has cracked down on antisocial behaviour connected to the night-time economy in west Wales. In congratulating that force, will she consider rolling out that scheme across the whole UK, as it saves public money and police time?

I am aware of the scheme in the hon. Gentleman’s area, which I understand is called “Behave or Be Banned”. It strikes me as an extremely good scheme that encourages licensed premises to work together to the advantage of their community.
