I describe the Government’s approach to Brexit as chaotic and clueless, and nothing will ever distract me from that principle when it comes to the way they have prosecuted this Brexit, which has been such an utter disaster.

Does the hon. Gentleman understand that if by some stroke of luck this House were to come to a conclusion tonight or on Monday on a way forward that was totally contrary to the manifesto that the Government stood on, no Government would wish to negotiate a deal that was contrary to the programme they stood on in the first place?

I do not think the right hon. Gentleman is really keeping up with what is happening today with this innovation in which the House determines the process and decides. That should be done without any undue concern for what has been said and done before. For goodness’ sake, this is our chance. This is our moment to make sure that we ensure a decisive outcome, which the Government should respect. I really hope that the Leader of the House reconsiders her approach to the indicative votes. I encourage the right hon. Member for West Dorset to continue his approach to coming to a solution that clearly demonstrates the will of the House. At that point, the Government must accept the will of the House.

This is a good day for Parliament and for this House. We cannot make a worse job of it than the Government already have. I hope that they listen carefully to what is said today. The SNP will support the motion.

I think the massive advantage to the Irish Government, other Governments and the European Commission in respect of future leverage over the negotiations is handed over in the withdrawal agreement. I do not accept what the hon. Gentleman says, because the Attorney General went on the record yesterday to say:

“There is nothing to see here.”—[Official Report, 3 December 2018; Vol. 650, c. 557.]

So there is obviously nothing of concern about national security in his advice. That is what he said himself.

The reality is that we had this debate on 13 November. The Government had the choice to vote against the motion and decided not to because they feared they would lose the vote. Their abstaining from a vote on an Humble Address cannot invalidate the motion, because that would set a very serious precedent.

Some of the legal advice that the Attorney General has given to the Cabinet—the advice it is crucial that we must have—has already been leaked by members of the Cabinet to the press and media. I think the Attorney General accepts that. The reality is that members of the Cabinet have already released to members of the press and media some of the advice given by the Attorney General in terms to the Cabinet. The Attorney General is somewhat estopped, if I may use a legal term, from saying that the rest of us are not entitled to have that advice. If some members of the media and press are entitled to have it, Members of this House are entitled to have it.

Does my right hon. Friend agree that as the Government and the Prime Minister are going around the country trying to convince the populace that it is a good deal, this secretive approach only confirms in people’s minds that there is something to hide? If anything, the Government are scoring an own goal by refusing to publish the advice.

Let me make it clear to the House what the deal between our party and the Government is. First, there are no side deals; it is a confidence and supply agreement. The important point for this debate is that the purpose of the confidence and supply agreement is to ensure stable government over the period of this Parliament, and that requires the Government to be able to get their Bills through and to have the requisite numbers on Committees as well.

As the hon. Lady will know, the Government have demonstrated their commitment to trying to help people who are victims of domestic violence. The Prime Minister takes a very close and strong personal interest in this issue and, as she has said within the past week, the Government are committed to looking again at the whole range of laws that apply to domestic violence to consider what changes should be made. If the hon. Lady would like to provide me with some details of the particular problem she raises today, I will certainly draw it to the attention of the appropriate Ministers.

The Leader of the House will be aware that there will be Assembly elections in Northern Ireland next week. It has been revealed this week that the even-more-holier-than-thou sister party of the Liberal Democrats, the Alliance party, has been seeking to manipulate phone-in programmes by encouraging its members to give fake names and addresses and claim to be members of other political parties—a tactic that it says has worked at previous elections. So far, the BBC has provided very little coverage of this story, which is yet another example of the biased way it has conducted itself during the election campaign. May we have a debate in the House on the political bias of this publicly funded body and how it has breached its charter?

The hon. Gentleman has made his point powerfully. The BBC in Northern Ireland, as in everywhere else in the United Kingdom, is under an obligation, particularly during any kind of election campaign, to demonstrate that it is impartial with regard to rival political parties, but it must be for the BBC, not Government Ministers, to take responsibility for editorial decisions.

In some cases, there might be some evidence of influence from Edinburgh, but I do not think that anybody would dare suggest that the right hon. Member for Gordon (Alex Salmond) could be told what to do in this place by anybody.

Does the Leader of the House accept that how this matter has been dealt with has stoked the fires of nationalism? He has admitted today that only one Bill is likely to be affected in this way. Does he really fear that the hordes from across the border will pillage his programme in the next year, so he has to rush this thing through without proper consideration?

The hon. Gentleman talks about proper consideration and these proposals were, of course, published late last year. They have been subject to extensive statements to the House. They were in our manifesto and they are now subject to extensive debate in the House. They are a relatively modest step that, in my view, provides a balance of fairness across the Union. While we are in this place, there is inevitably a degree of rhetoric. This is an important part of saying to the people of England that, as we devolve more powers to Scotland and to Wales, England is a part of that.

Absolutely—that is what people have voted for us to do. They have voted for us, in the same way as people have voted for English Members, to come down here to represent their interests, and that is exactly what we will do.

I loathe foxhunting—I think it is barbaric—and cruelty to animals wherever in the world I see it. I do not want any succour to be given to the Tories’ toff friends, dusting down their red coats, getting out their silly little bugles and lustily shouting “Tally ho!” in the mirror as they prepare to savage and ravage poor, defenceless foxes in the name of sport. That appals me.

I would accept the hon. Gentleman’s argument if he told the House that he had responded just as quickly to his constituents’ concerns about foxhunting by changing the law in Scotland before showing his righteous indignation about what happens here.

We are going to do that. The plan to water down foxhunting legislation in England has given us an opportunity to examine our approach and perhaps tighten it up. The hon. Gentleman is right: we should be doing that. I actually did not know that we have more lax laws than England. We are going to do all we can to ensure that they are tightened.

As a Unionist, I find this a sad and alarming debate. I come from a part of the United Kingdom where Unionism is not just a constitutional choice. Indeed, for many people, over the past number of decades, it was a matter of life and death. Many of them laid down their lives to be Unionist. Although it is not the Government’s intention, the way in which this debate, discussion and decision has been conducted is fanning the flames of nationalism. We have heard it here today. Second-class MPs, fourth-class MPs are to be excluded. It is all hyperbole. The truth is that when something is rushed through without consultation and when shortcuts are made, it adds grist to the argument that people from other parts of the United Kingdom are being excluded.

I know that we have a problem, but it is not an immediate one. If one looks at the evidence, one can see that in the previous Parliament 14 Bills were either English or English and Welsh only. Not one of them can the Government say was changed so dramatically by outside interference from non-English MPs. Not one of them caused huge problems or warranted this action.

I agree that these things need to be carefully considered in detail. Like me, is the hon. Gentleman concerned and surprised that the Government have completely dismissed the findings of the McKay commission?

I am, which is why I think the Government should take more time over this. Historically, there is not a problem. Indeed, the Leader of the House told us today that there is not even a problem for the immediate future. The only Bill that he believes will be an English-only Bill is the buses Bill. Does he really believe that the constitutional and parliamentary Picts and Celts from north of the border led by Robertson the Bruce will somehow draw out their claymores and dirks and shred his legislation? Does he really believe that that is the threat he faces? There is no immediate threat, so why do we need this ill-thought out, ill-conceived and rushed piece of legislation—it is not even legislation—which will enable Members to conjure up grievances?

I cannot attribute a motive for this fancy footwork, and for these shortcuts. I cannot understand why the Government have rushed this through. The hon. Member for South Leicestershire (Alberto Costa) talked about how concerned his constituents were, when he talked to them on their doorsteps, about English-only legislation and the way in which it might be interfered with. As there is no immediate threat, why can we not have proper discussion, proper consultation and a plan for the future that finds some consensus?

The talk we have heard from the Opposition is that our policy might be fanning the flames of English nationalism. Actually, it does the very opposite precisely because my constituents in South Leicestershire, and the constituents of hon. Friends, have been saying that they simply want fairness. They are not seeking an English Parliament. All they want is a simple resolution to a problem that the Labour party created in 1998, and that is what we are providing for the people of England.

If that is the case, and if all that the hon. Gentleman’s constituents want is a simple resolution of the issue, surely the best way to achieve that without unnecessarily fanning the flames of nationalism is to do exactly what the Opposition spokesperson said and take an approach that will lead us to consensus.

One of the reasons I think the Government are playing games with this and trying to rush it through is that the UK Independence party is driving them forward, but we have not seen that yet.

I do not know what the motive is, but I do know what the outcome will be: it will be damaging to the Union. As a convinced Unionist, I do not want to see that happen.

We heard assurances from the Leader of the House today that Members would have every opportunity to debate legislation that might affect their constituents, but what is English-only legislation, and what kind of legislation will carry Barnett consequentials? I remember in a previous role as Finance Minister in Northern Ireland having discussions with the Treasury about legislation that seemed to have no financial consequences for Northern Ireland. It was about the Olympics and spending in London. When I looked at it, however, I saw that it did have financial consequences for Northern Ireland, and the Treasury had to admit that there were Barnett consequentials—not that I got any money out of the Treasury, but at least it had to admit it.

Let me give another example. Education policy here in England might be regarded as English-only legislation, but changes in exam structures have consequences right across the United Kingdom, and many students from Northern Ireland apply to English universities. Dramatic changes in the exam structure here will have consequences in Northern Ireland, and we often have to reflect such changes. However, the current proposals would not allow us the opportunity to have an input.

As the hon. Gentleman well knows, I am extremely sympathetic to all matters relating to Northern Ireland, but I just want to ask him one question. It is completely mind-boggling to imagine how anybody will make their way through 30 pages of proposed changes to Standing Orders, so is he attracted to my proposal, which would simple do it by order of the Speaker and in seven lines, which would at least bring clarity?

The role of the Speaker has already been discussed. I fully appreciate the work that the Speaker does and do not wish to cast any aspersions about that, but I think that we would be putting him under huge pressure. We would be expecting him to make a decision for which he would not have to give any explanation, and about which Members would have no opportunity to make representations. That puts a huge onus on the Speaker. Such decisions would not be the end of the matter, because every time he made a decision there would be opposition to it. It would be an open sore, or a scab to be picked at. It would be another opportunity to cry foul, with claims that Members have been excluded. Not only would that be unfair on the Speaker, but it would perpetuate the grievance that many people would feel.

The hon. Gentleman started his speech by going on about how little impact the proposal would have, suggesting that only the buses Bill would be affected in this Session, but then he moved on to say that it fans the flames of separatism. He cannot have it both ways. It is a relatively modest measure for giving consent. He is the one fanning the flames of separatism. No matter what we do in this place, the Scottish nationalists will claim that it is an appalling assault. I am surprised that a Unionist like him would fall for their guff.

If the hon. Gentleman had been listening, he would know what I said, but I think he has already made up his mind on this. I said that every time the Speaker had to make a decision—he might have to do so only once in the Parliament, whether it is one year or four years down the track—the same argument would be made that there had not been an opportunity to make proper representations to him and that people had been hard done by.

We have some experience of the double veto in Northern Ireland. Indeed, we have an impasse in Northern Ireland at the moment over welfare reform because of a voting arrangement that allows one party, or one side of the House, to have a veto on legislation where cross-community support is required. The arrangement whereby we need to have a majority of the House, and a majority of English or English and Welsh MPs only, will create that situation here. I can tell the House that it will lead to impasse, to conflict, to bad government, and to decisions being even more difficult to make.

There are reserved matters that stay here in Westminster, one of which is parading. Parading is specific to Northern Ireland, but there is no arrangement in the Government’s proposals for Northern Ireland MPs to have an exclusive say on what would happen on parading issues and changes within the Parades Commission. The decision would be made by all MPs. If we are to have an English-only veto, why do we not have a Northern Ireland-only veto? Then we might move on to other aspects and we would get into a political quagmire. That is why I believe that these proposals are bad and need to be reconsidered. We have been right to raise these issues with the Government, and the Government should rethink them.

If a bank has a failure of that kind and it ends up costing its customers money, it has a duty to its customers; it is as simple as that. Those customers are buying a service from the bank. If the bank ceases to be able to deliver it for a period of time and customers suffer financially as a result, the bank should respond accordingly, and I very much hope that it does.

Although my friends in the Scottish National party may wish for hard-pressed electricity consumers to continue to pour money into the wind energy gravy train, communities across the United Kingdom will welcome the Government’s announcement today. However, given the consequences of the high cost of electricity, may we have a debate on why the Government still insist on electricity consumers subsidising expensive offshore wind energy when there are cheaper alternatives from oil and gas generation?

The hon. Gentleman will have a chance to raise that point with the Secretary of State next week. I am glad that he welcomes today’s decision. There are a great many beautiful parts of Northern Ireland, which are sometimes well served by wind, but which I would not wish to see covered in wind farms.

I am very pleased that on a huge turnout the Scottish people voted by a decisive majority in favour of remaining within the United Kingdom. When we set out on this process, the aim had been to have a referendum that was fair, legal and decisive, and that objective was clearly delivered. Liberal Democrats have long argued for home rule for Scotland and for a very powerful Scottish Parliament within the United Kingdom, and we are now well on the way to achieving that. My vision for Scotland is a country with its own Parliament that raises the majority of its own revenues and can borrow, tax and spend to meet Scotland’s priorities, with the freedom to innovate and reform but which keeps the strength and security of the United Kingdom.

Does the hon. Gentleman accept that the more devolution there is of tax, borrowing, revenue and spending powers to any devolved Administration, the greater the instability that arises within its Parliament or Assembly?

The hon. Gentleman makes an important point, but that is why I believe that Scotland should remain part of the United Kingdom. That gives us security not only in defence terms, but in financial terms. Although the Scottish Parliament should have more tax powers, we still need to be part of the United Kingdom for that security. Later in my speech I will outline which taxes I think are suitable for devolving and which I think should remain at the United Kingdom level.

The referendum saw levels of engagement and enthusiasm for politics never seen before. Now that the will of the Scottish people is known, everybody should accept the outcome and harness all that energy and enthusiasm to work together to build a strong, democratic Scotland within the United Kingdom. We want to harness that enthusiasm so that we can see much more participation in our democracy and much more consultation with people, working with them and devolving powers to a local level.

The argument so far has concentrated on any lobbying of the final decision maker, but does the Deputy Leader of the House not agree that the process of eventually making the decision is equally important? That starts with senior civil servants and goes through special advisers, and is as important as any lobbying of the final decision maker.

I think the hon. Gentleman is asking me to require the Government to publish all the internal workings of government, but that is not done by any Government. My view is that the Government’s proposed amendments in lieu will be a pragmatic response to the Lords’ concerns.

Let me turn to the amendment tabled by the Chair of the Political and Constitutional Reform Committee. I should remind the House that we have discussed the matter and that no relevant amendments were moved. Similar amendments were moved in the House of Lords, and the extension of the register to public officials such as civil servants was rejected by a substantial majority of 51. As I have outlined, the register is intended to complement the existing Government transparency regime. Both systems are intended to enhance the transparency of key decision makers—Ministers and permanent secretaries—and those who communicate with them.

My hon. Friend, like me, might have been surprised that when Labour Members responded to a statement on water bills they appeared completely to ignore the fact that this Government had taken steps to ensure that water bills in the south-west were kept down through substantial support to the local water company. This Government have enabled council tax to be frozen right through this Parliament. That is very significant, as is the fact that council tax doubled under the previous Labour Government. However, this is of course something that local authorities have to take up.

This week millions of Royal Bank of Scotland customers suffered inconvenience and embarrassment when they could not use their bank cards. The week before, it was revealed that businesses have been forced into bankruptcy so that RBS could seize their assets. May we have a debate on what is happening in this state-owned bank?

The hon. Gentleman will understand that I cannot offer a debate at the moment, but he will appreciate that during next Wednesday’s debate on banking reform issues may well arise relating to banking standards and the performance of the banks, including those in which the public sector—the Government—has a substantial stake, and he may wish to use that opportunity to discuss them.

My hon. Friend is absolutely right. We are getting to the crux of the issue, because it is becoming clear exactly why this part has been included in the Bill. It has nothing whatsoever to do with the accuracy or otherwise of the membership lists of trade unions. If the Committee does not believe me, it should listen to Lord Tyler, the Liberal Democrat spokesperson on constitutional affairs, who said that one explanation for this part of the Bill is the role that some unions play in the Labour party:

“The third arm of the Bill is about ensuring that trade unions have accurate membership lists. We will listen carefully to what people have to say about how the detail of this is set up, but the principle seems beyond dispute. The membership numbers of a trade union have a bearing on how much money they can give to a political party through their political funds. In this sense, the trade unions have a unique role in UK politics. It is therefore important for transparency’s sake that the membership lists are accurate.”

I agree with Lord Tyler that it is important that the lists are accurate, but they are already heavily regulated in law. I think this has more to do with the Government’s obsession with the Labour party and trade unions than with legislating to help hard-working, ordinary people.

I had hoped that we would get an explanation as to why this part of the Bill is essential. If the only argument that can be made is that the public should be able to complain about a controversial ballot, surely if it was that controversial it would be taken up by the trade union movement and a trade unionist would object to it rather than wait for a member of the public to do so.

The hon. Gentleman is absolutely right. No general secretary of a trade union, whether it is affiliated to the Labour party or not, would take strike action on the basis of a 51:49% vote of its membership. It would also be concerned about the legality of its membership list if any of it was found to be inaccurate, but the point is that legislation on the accuracy of membership lists already exists. It is in the union’s best interests—this has nothing to do with strike action—to have and maintain accurate membership lists, because it wants to communicate with its members, and it is also in the members’ interests to ensure that the unions have accurate details.
