Edwin Poots, Northern Ireland’s Agriculture Minister, has made it clear that he does not believe that the new border control posts necessary to control the movement of goods from Great Britain to Northern Ireland will be in place by 1 January. The Association of Freight Software Suppliers has made it clear that it does not believe that the customs declaration service will be operable by 1 January. That would be massively disruptive for businesses on both sides of the Irish sea, in Northern Ireland and Great Britain. Who will take responsibility if those who fear this is going wrong prove to be right?

I have worked closely with Minister Poots, and I recognise that he comes at this with a very different attitude to the protocol—it is not something that he necessarily wanted in the first place—but he and his Department are working pragmatically to deliver on this. We will continue to work with the Department of Agriculture, Environment and Rural Affairs to ensure that the requirements are met and that, where necessary, infrastructure is upgraded. The UK Government have offered to cover the cost of some of that, because we recognise that this relates to an international agreement for which we are responsible. With regard to customs systems, it is for the Treasury to respond on the detail, but I reiterate what I said in my statement: IT systems are on track.

The Government continue to engage regularly with the Northern Ireland Executive as we get on with delivering the protocol and preparing for the end of the transition period. As well as working with the Executive, we are working with port authorities, district councils and other stakeholders in Northern Ireland to deliver protocol requirements at pace. We are also continuing discussions with the EU in the Joint Committee, informed by close working with the Executive, to secure a pragmatic approach to agrifood checks.

The work is continuing. As we have previously set out, we are expanding some existing entry points for agrifood controls in Northern Ireland, building on what already happens at ports such as Larne and Belfast to ensure that new processes are as streamlined and efficient as possible. We continue to work closely with the Executive, port authorities, district councils and other stakeholders in Northern Ireland to take this work forward at pace, but the hon. Lady will recognise that some of these issues are subject to ongoing discussions in the Joint Committee.

The Minister rightfully has a reputation as being a decent individual, but will he not now apologise to businesses that so close to the beginning of next year—so close to the new regime coming in—businesses still do not know what regime they are going to operate under? Is not an apology now absolutely necessary from this Government to businesses in Northern Ireland?

The Government understand the strength of feeling about this issue. We have always been clear that the best way to bring forward reform in this area would have been for the Executive and Assembly to take that forward in the best interests of Northern Ireland. However, the Government are under a clear legal duty, which this House put on it, to make regulations that provide lawful access to abortion services in Northern Ireland by 31 March 2020. To comply with the legal requirement, we will shortly lay regulations in Parliament. It will be a matter for the Department of Health in Northern Ireland to commission the new services.

I know the Minister will agree that underlying the strength of Northern Ireland are commitments to the Good Friday and Stormont House agreements. This morning the Secretary of State made a statement about legacy. That seems to override the need for five-party consultation on this matter, and to override the need for co-operation between the Governments here in London and in Dublin. When will the Secretary of State come to the House so that he can be questioned on this matter of enormous importance to the future—if you like—of the Union, and certainly to stability in Northern Ireland?

Our commitment to the Good Friday agreement and its successors is absolutely intact and 100%—and the Secretary of State is, of course, answering questions in the House today—but it is also clear that the first step we are taking on this is to engage with the parties and, indeed, with the Irish Government. That is clear from the written statement that the Secretary of State has published.

The Government have put Northern Ireland absolutely at the centre of this process. That is reflected in the nature of the protocol that is agreed as part of the withdrawal agreement and legislated for through the European Union (Withdrawal) Act 2020. But of course the end result will depend on the free trade agreement negotiated between the UK and the EU, and it is too early at this stage to speculate on the details of that. Northern Ireland does enjoy special protections in this process as a result of the protocol.

The Minister was very careful not to answer my hon. Friend the Member for Ilford North (Wes Streeting) as to whether there will be checks on goods travelling between Great Britain and Northern Ireland. The First Minister is clear that there will be. The EU negotiator, Michel Barnier, is clear that there will be. Many people in industry and commerce in Northern Ireland believe that there will be. Does the Minister agree that there will be checks, or does he say that there will not be checks, on goods going from GB to Northern Ireland?

The Prime Minister has been clear. Beyond our obligations under international law, there will be no changes for movements of goods between Great Britain and Northern Ireland. When discussing the protocol with the EU, the UK will be ambitious on how flexible we can make this system. Northern Ireland remains part of the UK’s customs territory.

I absolutely recognise the urgency of the matter. Earlier this week, the Secretary of State stated publicly that in order to speed up the delivery of redress mechanisms, he had tasked officials in the Department to work at pace with the Executive Office, and to begin preparations for the scheme once it becomes law. Those preparations will continue, and we will also provide whatever support is needed to assist the Northern Ireland civil service to ensure that victims are paid as rapidly as possible. However, I recognise that this is a question for the House, and we will work with the usual channels to see what we can do on that front as well.

May I begin by thanking you, Mr Speaker, for your courtesy and consideration to the Opposition’s Northern Ireland team?

It would be remiss of me not to recognise the ending of the place on the Front Bench of the Minister of State, Northern Ireland Office, the right hon. Member for Ruislip, Northwood and Pinner (Mr Hurd), as well as that of my hon. Friend the Member for Ealing North (Stephen Pound), who will be sadly missed on our side of the Chamber and, I believe, on the other side as well.

As the right hon. Member for Belfast North (Nigel Dodds) has said, it is absolutely intolerable that victims of institutional abuse, who had been led to believe that legislation would pass through this House imminently, now face the prospect of the Leader of the House and the business managers frustrating their simple call for justice, even though the Secretary of State, the Opposition and the Democratic Unionist party want that legislation. Will the Minister ensure that he talks to the Leader of the House and demands that that Bill be brought forward before Parliament is prorogued?

It is clear that we have agreement across the House on how important this issue is, and we are doing everything we can to move forward on it. I will certainly have those conversations, and I hope that the hon. Gentleman will also have those conversations with the usual channels on his side of the House.

I do not accept that characterisation. The Government have always been clear that we want to see devolved Government restored and that this deadline set out in the Act of the 21st would be when legislation would have to be brought forward if the Executive were not in place. Of course it is right that we are engaging with the parties—as I suspect any Government of any colour would be doing—to try to restore the Executive and Assembly, and we should continue to do that right up to the deadline.

As the hon. Lady notes, the current period for Executive formation expires on Monday, 21 October, and in the event that the institutions have not been restored, we will be required to extend the Act by statutory instrument. On this, I want to be absolutely clear with the political parties in Northern Ireland: this would not be a good outcome. Northern Ireland needs political decision making. The Assembly has had over two and a half years to reach a compromise and get Stormont back up and running, and the people of Northern Ireland are sick and tired of continued delay.

I understand why the Secretary of State is not with us tonight, but can the Minister confirm that there is no part of this country of ours that will be more affected by either a deal on Brexit or, worse, no deal on Brexit? The Secretary of State committed to come to the House and give a clear indication of what powers he would need to take in the event of any outcome of Brexit. We have not yet seen this before the House. Can the Minister guarantee that at a very early stage we will see what legislation is necessary to ensure that we have an orderly exit with a deal and, even more importantly, without a deal?

That is important, because the House will address some substantive issues tonight and we need answers.

The Minister rightly said it is now over 1,000 days since the Stormont Assembly and the Stormont Executive last functioned, which is outrageous. It is almost unrecognisable in terms of modern democratic governance.

If not for other factors, I would be talking tonight about the failure of the political system to reform the education of our young people in Northern Ireland. I would be talking about the failure to reform the health service, and the fact that the Bengoa report is now receding dramatically in the rear-view mirror of life. That is, quite frankly, tragic because it is letting down patients, as the health service in Northern Ireland now sees increasing waiting lists and other things that are unacceptable.

Mental health provision in Northern Ireland is grossly inadequate. If there is one statistic that ought to frighten Members on both sides of the House, it is that more people have died since the troubles through suicide than died during the troubles—that figure is dramatic but true. It is immeasurably sad, and we ought to dwell on that. It is a failure of politicians of all stripes in Northern Ireland.
