That this House has considered the funding decisions of Arts Council England.
It is a pleasure to serve under your chairmanship, Mr Bone, and I am very grateful for the opportunity to return to this topic. It is also good to see the Minister in his place in Westminster Hall. As he will know, this topic has been ventilated before, but I think this debate broadens the issues.
As time has gone on, those of us who follow this issue have had more and more grounds for concern, not just about individual funding decisions by the Arts Council but about the process by which it makes them. That process lacks transparency and, I believe, accountability, and there is a lack of engagement with the sector at a time when funding reductions are being made. Those may be necessary in the overall economic climate, but they have been made in a distributional way that has taken no account of economic, social or other impacts—or, above all, of the overall responsibility of the Arts Council.
When the Arts Council was formed, it was set up
“to give more people opportunities to enjoy and benefit from great art and culture”—
I think it still has that phrase on the banner on its social media. It did not regard itself as an organisation about changing the nature of art or culture; it was about making excellence available to the greatest number of people. That was the vision of Keynes when he set it up and of people such as Jennie Lee when she was Arts Minister. In fact, I think Jennie Lee rightly said that it was important that everyone, wherever they were and whatever their circumstances, should have the opportunity of accessing the best in the arts rather than something cut-price or dumbed down. I rather fear that of late the Arts Council has lost its way in relation to that mission. Some of the specific funding decisions in the latest round highlight how it has gone wrong.
The Minister and others will know that I have raised in particular the issue of the removal of English National Opera from the national portfolio. That would have had the effect of creating 600 redundancies, and—for all the mealy words used by the Arts Council to begin with—it would have effectively meant the closure of the company. The idea that it would have been possible to relocate a 100-year-old company to a base in Manchester—more on that in a moment—at about 12 months’ notice was so risible that one wonders what experience and real understanding of the sector the bureaucrats in the Arts Council who drew up that decision ever had.
I am glad to say that discussions, hard work by English National Opera’s team and engagement with the Arts Council has led to some movement. I welcome the fact that there has been a willingness to listen and that funding has been secured, albeit with a reduction—a reduction perhaps on much the same level as those for other arts institutions. That will enable the 2023-24 season to continue next year. I hope that there will be better transition funding for the future. However, that is as yet uncertain. We have had a step forward, but at the moment English National Opera—a major international company that does co-productions with the Metropolitan Opera in New York and is a major draw for audiences—has had only a reprieve, rather than being saved in a form that is recognisably that of a high-class, top-rate opera company. That is not good enough.
I am grateful to the hon. Member for giving way, and I congratulate him both on securing this debate and on his speech. I also welcome the concession made in respect of English National Opera. However, does he agree that the latest Arts Council declaration still leaves more than £50 million worth of cuts to London’s arts budget over three years? That not only has a devastating cultural impact but, as he suggests, an economic impact; I am thinking of employment and the vital revenue that pours into London from tourists and others who seek to attend these marvellous cultural institutions.
That is certainly true; as a London MP, I am conscious of it too. Of course there is more than one issue at play. One is the distribution—where the money goes. Secondly, there is the question of which institutions and sectors are worst affected by what happens. It does seem that the performing arts have been particularly hard hit. When I look at the trustees of the Arts Council, there seems to be a lack of experience in the performing arts as opposed to the visual arts. We should perhaps return to the composition of the board and management and whether relevant experience of those sectors is there.

It is a great pleasure to serve under your chairmanship, Sir Henry, particularly given your personal interest in and commitment to this field of policy. It is also a great pleasure to follow two superb speeches that set out the broad range of topics that we need to cover. I congratulate my hon. Friend the Member for Hammersmith (Andy Slaughter) on securing the debate and on his opening speech. I strongly commend the speech of the Chair of the Justice Committee, the hon. Member for Bromley and Chislehurst (Robert Neill); I do not think I disagreed with a word of it.
The excellent briefings that we received in advance of the debate from a wide range of organisations come on top of a wealth of analysis that has already contributed to the debate, not only from the Justice Committee but from my own Committee, the Joint Committee on Human Rights, which produced a report including an analysis of many of the post-LASPO failings. The case has already been made, as we have heard today, but I wish to make a few remarks to convey not just an analytical concern for the post-LASPO world, but the real anxiety, passion and anger that so many people feel about the environment in which we find ourselves.
Yesterday morning, we marked Justice Week with a meeting of the all-party parliamentary group on legal aid. We were very pleased that the Minister came to speak to us and that the meeting was very well attended, including by the Bar Council, the Law Society, parliamentarians, a great many people from the not-for-profit sector, and solicitors. We heard a compelling case for the central role of legal aid and for ensuring access to justice. We heard the message that the Government need to hear thunder reverberating, because every single prediction made before the passage of LASPO has come to pass. We heard that the situation has declined to the point that the criminal Bar has thought it necessary to take strike action and the Law Society is taking legal action against the Government. It is unprecedented in modern times for those organisations to feel compelled to take such strong action, but they want the Government to hear exactly what is going on.
Sadly, in Justice Week, we also learned in the Budget that the Ministry of Justice, which with the Ministry of Housing, Communities and Local Government has already taken the largest cuts of any Department, is to be subject to yet another cut. It is an unprotected Department, and we now know that its budget will be cut from £6.3 billion to £6 billion. We are making the case for legal aid in a context in which justice funding is falling still further.
As we have heard, legal aid is in competition with many other areas of justice that are also under intolerable pressure. Almost every hon. Member in this Chamber has been present at debates that conveyed our anxiety about other creaking, breaking parts of the criminal justice system, so it is understandable that we are extremely concerned to ensure that the case for legal aid is not made at the expense of the prison service or the other parts of the justice system that are also under absolutely intolerable strain. In truth, the thunder is reverberating; it is just that the Government have not been listening.
I will not repeat in great detail the case that has been made so widely in this House and through the many forms of evidence submitted to the LASPO review about the consequences of areas of service falling out of scope and of the tightening of eligibility. The impact on providers has in turn had an impact on people—often the most vulnerable people—who need to be effectively represented.
I agree entirely with the hon. Lady’s argument, and I am glad that she referred to Justice Week. Does she agree that it might be worth while for every Member of this House to watch the Bar Council’s video about justice cuts, in which several providers, as well as hon. Members, talk about the impact on the individual cases they deal with?
Absolutely. I would love every Member of this House to watch that video and to be made aware of the case being made.
We know what is happening to legal aid providers. Law centres lost 60% of their income from legal aid post LASPO, and in the immediate aftermath we lost eleven law centres. I pay tribute to my own centre, Paddington law centre, which provides such an essential service. I also commend North Kensington law centre—this country’s first law centre, which I used to represent but is now just outside my constituency—for doing such extraordinary work in the aftermath of Grenfell.
Law centres are indispensable; they are an integral part of effective community life. The Chair of the Justice Committee was absolutely right to draw attention to the fact that justice is not a private transaction. These services—particularly law centres, but not only them—are part of a healthy community and a strong civic life. The consequences of undermining them go far beyond the individuals concerned.

The point was well made. There are some people whom we will always have to imprison, because they deserve to go to prison, and I saw enough of them during my career as a barrister practising criminal law. However, many others are in prison due to far more complex reasons, such as bad choices, lack of support, lack of background, poor education and mental health issues. We need to be much more discerning, and that means that we need a much more sophisticated approach to our penal policy. We need to introduce genuinely robust alternatives to custody, in the right cases, for those who do not pose a threat and a danger to the public, and who can be reformed without their going to prison. That is critical. We have not yet achieved that. The objective must be not only that the public have confidence in sentences, but that we have proper systems for the rehabilitation of those who are incarcerated. However, as almost everyone will be released at some point, we must make sure we release them in a better state in which they can contribute to society than at present.
The hon. Gentleman rightly emphasises the importance of education and rehabilitation, but may I add to that the critical aspect of access to family? May I also commend to him the report on mental health in prisons by the Joint Committee on Human Rights, and the work that we did in particular to look at the risks to young people and offenders with mental health problems? Such people were not always guaranteed access to family support at critical times when they were self-harming or at risk of suicide?
That is a good point. I know that other Members are likely to take up such issues in our debate.
While we welcome a number of the initiatives the Government have implemented, more still needs to be done. We particularly regret the loss of the prison element of the Prisons and Courts Bill from the last Parliament, because implementing that statutory purpose, which would have covered rehabilitation for prisoners, would have been an important umbrella under which to link the good work that is done. It is good news that we have a proper prison reform and safety plan, but it needs to be put into a full context. We need positive actions, not just the good aspirations that are set out.
It is essential that there is a genuinely independent and robust inspectorate, so it is regrettable that we have so far lost the opportunity to place on a statutory basis not just the chief inspector of prisons, but the whole inspectorate as an institution, and to strengthen the requirement for his recommendations to be complied with. It is scandalous that at present only a minority of his recommendations in some cases are taken up. That needs to change. It is also regrettable that the prisons and probation ombudsman has not yet been placed on a statutory basis. I hope we will find a legislative opportunity to do so. I believe that that is what the Minister wants to do, but we must not lose it from the agenda.
Our present indicators on safety in relation to self-harm, suicides, prisoner-on-prisoner assaults and assaults on staff continue to go in the wrong direction. More prison officers have been put in, but we must look in the round, too, at how many people we are sending to prison and why, and what sort of regimes are in place.
We have heard reference to an action plan on prison safety and reform, and what we hope to see are specific strategies on employment, mental health, women in prison, and the retention and recruitment of officers, because keeping experienced officers is particularly important. We need a proper robust inspection mechanism under which the inspectorate, which includes excellent people, has genuine teeth to do what is necessary. We also need more transparency, and I know that my hon. Friend the Member for Banbury (Victoria Prentis) will talk about transparency and data.
It is not acceptable that of the 29 local prisons and training prisons inspected this year, 21 were judged to be poor or not sufficiently good. I know that the Minister agrees that we have to turn that around, but all too often I have found a culture of defensiveness among some of the senior management in Her Majesty’s Prison and Probation Service. We must use the changes that have been made to the structure of the service to refresh that culture at every level. That is a most pressing matter. Great work is done further down, but all too often prison officers and governors have said to us that they feel cut out from what can still be too hierarchical a chain of command. That needs to change.
Prison reform was rightly described by David Cameron as a “great progressive cause”, and so it should be, for politicians on both sides of the political divide. Let me end with this thought. A former Home Secretary who became Prime Minister said that one of the purposes of prison was to seek the treasure in the heart of every man. That was said by Winston Churchill in 1910. I say to the current Prime Minister that, as she has had the same career trajectory, such a phrase would fit very well with her desire to tackle burning injustices in society. Some of the injustices and challenges are as acute in our prisons as anywhere else. This is a great cause, and we hope that we will have some more specific responses from the Minister to our reports, and a further indication of the direction of travel. Above all, I hope the House will not let this issue slide down the agenda.

It is a pleasure to see you in the Chair, Mr Sheridan. I congratulate the hon. Member for Westminster North (Ms Buck) on securing the debate and I acknowledge the very constructive interventions and support that she has had from my hon. Friend the Member for Cities of London and Westminster (Mark Field).
This is an important debate about planning and basement development. It raises important issues, not for the first time in relation to planning, about balancing sustainable development with individual rights, and I will happily do my best to respond. The issues have been well set out by the hon. Lady. She is particularly concerned about problems arising from home owners’ wishes to increase the size and value of their home by extending the property through the excavation of new basement rooms. I recognise that there can be a problem with such development. It tends to occur in a fairly limited geographical area, predominantly in parts of central London, as we have heard. I am also aware that the cause for concern is often not the completed basement, but the disruption that can be caused during the construction phase. That is precisely what was graphically described by the hon. Lady.
This is quite a complex issue, because it covers many aspects of both the planning process and the construction process, including concerns about noise and general disturbance and issues about the consistency and effectiveness of enforcement. There is not necessarily, therefore, a single silver bullet that can deal with the problem, but there are existing powers and good practice available to tackle it, and I will endeavour to set those out.
It is important to bear it in mind that the planning system is designed to consider the impact of a development once complete, and of course it is often the case that subterranean developments, once complete, have little visual impact. The system is essentially about land use and visual impacts. What we are talking about today is generally an extension to an existing acceptable land use—a dwelling house. In the end, its visible impact will be limited, but I do understand that that does not help the people experiencing the disturbance during its construction. However, although there are some limitations, people often regard the planning system as the most reliable route for alerting a local community that a development is proposed—we are all familiar with the requirement to put up notices and so on—which can then act as a trigger for wider engagement on how any development will take place.
It might be helpful if I describe how the planning system deals with subterranean developments and the controls available. A planning application is likely to be necessary for a substantial new and deep basement, but as I think the hon. Lady conceded, that will depend on the size of the existing property. It generally depends on the size of the extension in relation to the original size of the house, as is well known. None the less, where permitted development rights grant planning permission without the need for an application, a local planning authority can consult on using the powers available to it to ensure that the proposals are brought back under its control through the planning process. In other words, it is possible to issue an article 4 direction—that is article 4 of the Town and Country Planning (General Permitted Development) Order 1995—which removes the permitted development rights in relation to the proposed development. In those circumstances, an application must be made in the normal way.
Local authorities are already required to consult neighbours and other interested parties on planning applications, and we already advocate pre-application engagement between applicants and neighbours. Local authorities can use locally prepared planning policies to set the standards by which planning applications for subterranean development will be assessed. In addition, local authorities are able to produce guidance that can outline matters such as submission requirements and the standards that development will need to achieve. Our proposals to introduce neighbourhood planning provide further opportunities to fine-tune the detail to reflect what may be particular concerns in particular neighbourhoods of London or other major cities. Local authorities can already require applicants to ensure that their planning applications are accompanied by a construction method statement and require such a statement to be prepared and signed off by a chartered civil or structural engineer. Those methods can deal with some of the matters raised.
Perhaps the Minister is coming to this point, but one of the grave concerns of residents in places such as St John’s Wood, Chelsea and so on is that, although each individual development can be close to unbearable, the compounded effect of, say, 13 developments in one street in St John’s Wood is absolutely intolerable. What powers does the local authority have to consider the compounded effect of numerous developments, rather than each individual one on its merits?
As a matter of planning law, local authorities can have regard to cumulative impacts and they can attach planning conditions to the permissions to ensure that developments meet the standards set for such development. Of course, they have to consider each of those on a case-by-case basis, but it is well established in the case law that cumulative impacts can, in the proper circumstances, be a material planning consideration.
That is the position as far as planning law is concerned. I will also consider building control, because the two are closely interlinked. It is likely that subterranean development work would be required to meet the Building Regulations 2010. Therefore the person in control of the works—from what I have heard, I imagine that that would be the contractor in these cases—will either have to submit plans or give a notice to the local authority building control department about the development. That enables the works to be inspected by a building inspector on behalf of the local authority. The building inspector will have to be satisfied that the basement structure complies with the relevant requirements. It is fair to say that much of the building regulations concentrates on the safety of those working on the site. I do not think that that is suggested as the primary issue in this case, but it is worth bearing in mind. The building regulations are also concerned with ensuring that nothing is done to impair the stability of the building during the construction process. Again, that can be a worry for neighbours.
Work would also need to be carried out in accordance with the Construction (Design and Management) Regulations 2007 and various other related health and safety measures. Regulation 31 of the 2007 regulations requires steps to be taken to ensure that an excavation is safe both for those within the building and for neighbours.
The noise and other sources of potential nuisance, such as dust and deposits, that we have heard about can be dealt with through the statutory nuisance regime set out in the Environmental Protection Act 1990. In addition, the specific issue of noise from construction sites can be dealt with through the powers in the Control of Pollution Act 1974.
I understand the point that my hon. Friend makes, but perhaps it is not entirely fair to say that the controls are inadequate. There is without doubt a fairly new challenge because of the technology and the type of building that we have only fairly recently seen. However, there are powers, if they are robustly enforced.
May I just make this point? The Control of Pollution Act 1974 enables issues such as the equipment type, the hours of working and acceptable noise levels to be stipulated, so there is a control there, if it is robustly enforced.
I am grateful to the Minister for giving way; we are about to run out of time. Will he either mention briefly the scope for looking at the Party Wall etc. Act 1996 in particular, as per the proposals that the hon. Gentleman and I have outlined, or meet us separately, possibly with representatives of the local amenity societies, to consider what action might be available under that set of powers?
Certainly. The 1996 Act was considered in relation to the Localism Bill. As time is short, perhaps I will write to the hon. Lady, setting out the views expressed in the other House. We can then consider the matter if she wishes to make further representations. I think that that is the fairest way to do justice to her and her constituents—

Some of the more alarmist comments about churn in a city that has a great deal of population churn anyway are unjustified.
Will the Minister confirm something for the record? I understand, following the consideration of the Localism Bill in Committee, that existing tenants who voluntarily downsize to smaller properties or move from overcrowded properties will, after the new rules are introduced, be subject to short-term tenancies. That does not seem to me to be consistent with what he and others have said about current tenants not being affected.
The point is that it is a voluntary change in the arrangements, not what exists at the moment. At the end of the day, we must be sensible and recognise that, if we want more new homes, either we go down the route of pumping more and more public money in—when, thanks to the actions of the previous Government, there is no public money—or we go down the alternative route of using a bit more common sense and imagination and being prepared to look at more flexible models for dealing with the situation.
Ultimately—I am conscious of the need to allow the hon. Member for Islington North time to respond to the debate—this Government are strongly committed to housing in London. The current Mayor is committed to housing in London and there has been a 35% increase in the number of affordable starts since Mayor Johnson took office. Increasing the number of family-size properties is another important issue and there has been a 40% increase in three-bedroom houses, so we do not think that we have anything to be ashamed of in respect of our housing policy in London. I am confident that, when we debate the subject again in perhaps a few years’ time, I shall be able to defend Mayor Johnson’s record after he has been re-elected. I am sure that the hon. Member for Islington North will still be there to raise housing issues with the same passion and vigour. I hope that I have left him enough time to conclude.
