Commons ChamberAs the specific case to which the hon. Lady refers is before the Court of Appeal and, therefore, sub judice, I will not comment on it. On the general point that she makes, I certainly agree that it is clearly in the public interest that alleged serious crime should be prosecuted. We will have to await the outcome of the case to see whether the resources that are made available in this instance are satisfactory.

Since taking office, I have been active in ensuring that the public are better informed of the law of contempt and, in particular, the dangers of online commentary. I have done that in a variety of ways including education, delivering speeches, attending symposia on contempt, and review by asking the Law Commission to look at the law of contempt and legislation. New criminal offences of juror misconduct and amendments to the law of contempt are being introduced in the Criminal Justice and Courts Bill. Finally, where necessary, I institute contempt proceedings against contemnors.
I thank my right hon. and learned Friend for that answer. I welcome the new offences in the Criminal Justice and Courts Bill. How does he see the interrelation between those new offences and the existing law of contempt working? In other words, how will judges be expected to deal with the often knotty problems that come before them when jurors misbehave?
I hope that the benefit of this change to the law will be to emphasise the criminal nature of the conduct of a juror who fails to follow the judge’s directions and acts in a way that undermines the fairness of a trial process. At the same time, by providing that it is an indictable offence that is triable by jury, there will be better safeguards for jurors in terms of fairness if they are prosecuted as a result. I trust that the combination of those two things will enable judges to be more robust in their directions to the jury at the outset when explaining that it has an important function to perform, and that that must be performed within the framework that the judge lays down in his directions. In my experience, jurors are, for the most part, animated entirely by good will towards the public interest, so I feel that if we do that, some of the regrettable problems that we have had may be further reduced.

On the issue of a full inquiry, I am sure that my right hon. Friend the Secretary of State for Northern Ireland has noted the hon. Gentleman’s comments. I do not think that I can say more on that.
May I associate myself with remarks in support of the victims of this and other appalling crimes that go unpunished? I was not aware that the chief of staff to the then Prime Minister or officials in the Northern Ireland Office had any role in policing or prosecution, and I am amazed that letters are being sent from that part of Government relating to issues that are bound to be referred to in a court of law. Will my right hon. and learned Friend assure me that that manipulation—that misuse of the process—will not recur, and that those who are responsible for prosecution and policing send letters in their own name rather than through Government Departments?
My hon. Friend makes perhaps an important point. It is right to say that the letters were sent on the basis of decisions taken by both the Public Prosecution Service and the PSNI, in the context of Northern Ireland, and if domestic matters elsewhere in the UK were concerned, by their prosecutorial authorities. To that extent, it was an administrative system independently conducted of Ministers; I want to make that quite clear. However, it is also right that, at the end of the process, it was ministerial letters, or letters from officials, that constituted the giving of the information.

Commons ChamberI have noted what Lord Justice Leveson has said and it may be something to be incorporated in press regulation. The current position on the law of contempt is that proceedings are active from the time of arrest. Those considerations are not identical to those that Lord Justice Leveson was considering, but they raise the issue that after arrest the press has to have in mind the possible impact on the fairness of the trial process thereafter. That could include naming a suspect; equally, it might be perfectly acceptable to do that.
There is continuing concern, nevertheless, about the almost habitual naming of suspects after arrest, which in the minds of many of us has the potential to cause real prejudice. Will my right hon. and learned Friend do all he can to monitor the current situation and ensure that the law is prosecuted to its full effect?
My hon. Friend raises an important point. I am certainly mindful that in many of the contempt matters brought to my attention the problem has arisen in the period between arrest and charge. Of course, if the House were minded to change the law on anonymity, which has been floated previously in private Members’ business, that could be done by enacting legislation. However, let me make it quite clear that this would need a legislative solution, not one that I can in some way “magic up”. The law of contempt has to be applied free of all political considerations, and that is what I try to do as best I can.

Commons ChamberWill my right hon. and learned Friend assure me that a request for further resources for the SFO to investigate the LIBOR scandal will be met favourably by the Government?
I reassure my hon. Friend that the matter has already met a favourable response from the Government in terms of ensuring that adequate funds are made available. My hon. Friends and colleagues in the Treasury will want reassurance that the money is being well used, but I am quite satisfied that money and resources are available for the SFO. The director and I are also quite satisfied that he has the necessary resources to carry out the investigation properly.

Commons Chamber9. What steps he is taking following the publication of the report of the Hillsborough independent panel in September 2012.
My consideration of the evidence in this matter is far from complete, but as I do not wish to cause the families affected by this disaster any greater anxiety, I have decided to take an exceptional step and announce that, on the basis of what I have already seen, I am persuaded that an application to the Court for fresh inquests must be made.
Ninety-six people died as a result of what occurred at Hillsborough that day, and 96 inquests were held. I believe that, as all those deaths arose from a common chain of events, it would be better for me to apply for all 96 cases to be considered again. I want to allow all the families affected the opportunity to make representations to me on that issue, and I will be in contact with them.
I wish to make it clear that, having announced my decision, I will still need further time to prepare the application so that the strongest case can be made to the Court. I have given that work priority and I will continue to do so. I have today laid a written ministerial statement in both Houses announcing my decision.
Clearly, the consideration of charges is done independently by the DPP and I have no role in it. It is perhaps trite to say—I think I have said this before—but were there to be criminal proceedings, that could undoubtedly impact on when an inquest could take place. However, I do not think that it has any impact on the timing of my making an application to the Court for it to order inquests to take place if it is so minded.
The Attorney-General’s announcement is indeed welcome news. Will he assure me that adequate parliamentary time will be given for the fullest of debates into the shocking revelations that we heard last month?
It is my understanding that there will be the opportunity for a debate on this matter next Monday, 22 October, which I believe will be led by my right hon. Friend the Home Secretary. Obviously, I will be present for as much of the debate as possible to listen to what is said.

Commons ChamberOn the issue of disclosure, will my right hon. and learned Friend ensure that he or the CPS thoroughly look into the circumstances in which a major and costly criminal trial involving allegations of police corruption collapsed recently in the Crown court at Swansea in order to ensure that lessons can be learned so that such mistakes relating to disclosure are not made again?
I can assure my hon. Friend that the Director of Public Prosecutions takes the collapse of that case very seriously indeed, and there will be internal inquiries and, I am sure, inquiries by the police into why it took place and the lessons that need to be learned from it. It is of course worth bearing in mind that, in terms of its history, it is very much a historic case, but that is no reason for any complacency about the lessons that we might be able to learn for the future.

Commons ChamberI am most grateful to my hon. Friend. I listed in my statement the causes of death as they were found and put in the death certificate, and that has been reviewed in great detail. The unequivocal view of Dr Shepherd and Professor Flanagan is that those causes of death are entirely correct, and that the combination of factors as listed was what caused the death of Dr Kelly. Of course, the primary cause was the fact that he slit his wrists and took an overdose.
As someone who also harboured doubts about the quality of the process before the Attorney-General’s review, may I welcome the clarity of his statement? Does it amount to this—in focusing on the function of a coroner’s inquiry, which is to look into nothing more or less than the cause of death and to reach a verdict from a range of options available as a matter of law, is he telling the House that any inquest would have been driven to a verdict of suicide?
Yes, indeed. There is no evidence that I have seen, including the material that has been produced on the review, that could lead to an inquest coming to any other conclusion.

I am not sure that I entirely agree with the hon. Gentleman. Ultimately, the enforceability of any order made by a court depends first on people obeying the law and, secondly, if people do not obey the law, on the capacity to bring them to justice and to make the court’s order felt on them. That is a slightly different issue but, as I acknowledged earlier and as was acknowledged by the Lord Chief Justice when he gave his press statement last Friday, the multiplicity of available communication media certainly do pose a particular challenge for the courts.
I wonder whether my right hon. and learned Friend could assist me with a point raised by the Neuberger report—the change allowing members of the media to be present when applications are made. Am I right in presuming that the press will be able to report unsuccessful applications with full details? If so, will that perhaps serve as a further check on the makers of these applications in future?
I think that will be very much a matter for the discretion of the judge hearing the case. I do not think that one could make some kind of blanket pronouncement as to how it would operate in practice, but clearly the merit of the course of action being proposed is that it would remove the element of total secrecy, which—I can well see this argument—fuels speculation and in some cases, I have little doubt, a lack of understanding as to why the application was made in the first place, whether it was successful or not.

Commons ChamberWe are doing a number of things. We are developing the recently launched cross-Government violence against women strategic narrative. For the CPS, we agreed on a number of steps to improve domestic violence prosecutions and the safety and support of victims, including specialist co-ordinators, guidance in respect of stalking, effective monitoring of cases and legislation, and ways to improve communication with victims. In addition, guidance for prosecutors on stalking and harassment cases was launched in September 2010, and a new violence against women assurance regime was launched on 1 January 2011. As there is not enough time available now to allow me to amplify my remarks further, I will be happy to write to the hon. Gentleman with details of some of the things we are doing.
Will my right hon. and learned Friend do all he can to ensure that all Government agencies and Departments have a unified definition of domestic violence, as there seem to be alarming differences in that definition between different Departments, and that needs to be remedied at the earliest opportunity?
I am grateful to my hon. Friend for bringing that to my attention. It might be helpful if I have a conversation with him so he can identify in greater detail where he thinks these current misdescriptions exist. I entirely agree that it is important that we are all singing from the same hymn sheet.

Does my right hon. and learned Friend agree that sometimes we lose focus by discussing the process of decision making about prosecution instead of focusing on deficiencies in the investigation of the crime? Particularly with reference to rape, that is a real problem that police forces are having to cope with.
It is absolutely right that the investigation of rape is one of the most difficult tasks for the police. That is for a whole range of reasons, including the difficulties of getting victims to come forward, the problems that the police face in having to look after them properly when they do, and the difficulties of ensuring that they will come to court to give evidence. There are also the problems that have been experienced with victims retracting their evidence. The Crown Prosecution Service, the police and I are very much alive to all those factors, and we will continue to do all we can to improve the way in which this type of offence is handled.

Commons Chamber6. If he will estimate the cost to the public purse of the use by the Crown Prosecution Service of in-house advocates in the Crown court in the latest period for which figures are available.
In 2009-10, the full cost incurred by the Crown Prosecution Service of in-house advocate deployment in the Crown court was £18,552,313. The CPS estimates that it would have cost £27,833,588, excluding VAT and fees, to use self-employed advocates for that work, representing a saving of £9,281,275, excluding VAT. I acknowledge that the methodology for calculating the cost of Crown advocate deployment has been disputed by the Bar Council. I understand that discussions are taking place between the CPS and the Bar Council to try to resolve the matter and to look more generally at sustaining the role of self-employed advocates in the Crown court.
Will my right hon. and learned Friend go further and accept that the best guarantee of cost-effectiveness and quality in the Crown court is the independent bar?
I can reassure my hon. Friend that there is widespread recognition, including by the CPS itself, that the referral bar has an important role to play in the prosecution of offences, and that that must be sustained. It is my intention, working with the head of the CPS, to ensure that that happens.
