I thank the hon. Member for Erith and Thamesmead (Abena Oppong-Asare) for securing this debate. I was keen to respond to it for the equalities team, because in my time in public life I have taken a long interest in working on equalities—not always on this area, but it is one that I want to pay attention to. I also thank colleagues who have come along to support or intervened to make specific points. It is an important debate; sometimes people think that Adjournment debates at the end of the day are not important, but they are, so I appreciate everyone who has come along to support and take part.

During Black History Month, we rightly recognise the contribution of black Britons to our national life and history, from the Windrush generation—who helped to rebuild this great country after the war and rebuild the NHS, as the hon. Lady said—to those who continue to run the NHS alongside others. We pay tribute to those black Britons who have saved countless lives working in the NHS through the pandemic.

I do not have an answer to the hon. Lady’s specific question about support, but I will make sure that my right hon. Friend the Minister for Women and Equalities responds fully. Generally, if there is anything that I do not cover or if any Member contacts me with questions that I have not answered, I am more than happy to ensure that my ministerial colleague writes back in full.

It is right that we pay tribute to those who take part in our life, especially those who are coming forward from the black community. I was delighted to see the Paralympic gold medallist Kadeena Cox at the first leg of the Commonwealth games baton relay in Birmingham earlier this month. At the relay from Buckingham Palace, it was quite inspirational to see one of our leading Olympians taking the baton. Her story is truly remarkable, and she is just one of the many inspiring black role models across our society in sports, arts, government and business.

If I may, I will embarrass the right hon. Member for Hackney North and Stoke Newington (Ms Abbott). She will not remember this, but quite a long time ago I was at a dinner which she shared with Michael Portillo. It was a prize from a Stonewall fundraising event. I sat next to her throughout that dinner, and I am sorry to embarrass her, as a Tory politician, by saying that she was a role model. There was a regular feature on the back page of the Sunday Times magazine called “A Life in the Day”. I remember saying to the right hon. Lady that she was the epitome of a constituency MP, and that I thought that that was absolutely inspiring. I am sorry to embarrass her with praise from this side of the House, but, although that may have been a long time ago, the memory has never left me.

As we heard from the hon. Member for Erith and Thamesmead, following the events of last year Britain has engaged in a thorough examination of racial inequality, and in response the Government have carefully examined the evidence and data. We believe it is right to recognise where progress has been made, but also that we need to tackle barriers that still stand.

In just over an hour’s time, York Labour will propose that York should become an anti-racist and inclusive city. However, we do not want that to be just a name tag; we want it to be about an action plan and about our path to the future. Would the Government consider funding such initiatives in order to ensure that that aspiration becomes a reality?

The hon. Lady tempts me outside my portfolio. I cannot give spending commitments; the Chancellor might have a view on that, and my ministerial career might be cut very short. It has been six weeks so far, and I would like it to go on a little bit longer. However, I will ensure that my officials take away what the hon. Lady has said and provide her with a full response. I cannot promise that it will be a response she will like, but it will certainly be a response. I agree with her that this is something that the Government should consider.

We cannot genuinely level up the country unless we remove the obstacles that stand in the way of some of our people, and it was in that spirit that the Prime Minister established the Sewell commission on race and ethnic disparities. I know that people may have different views on that commission, but let us park those and look for the good rather than seeking to dwell on what we disagree on. The commission published its report earlier this year, and it showed that racism and discrimination remain a factor in shaping life outcomes. For instance, discrimination against names that are recognised as not being traditionally British exists when CVs are reviewed in the jobs market. That should not be happening in Britain in 2021. However, the commission found that where disparities between ethnic groups exist, factors other than racism are often the principal cause. That needs to be explored.

I can assure the House that this Government are intent on doing everything in our power to drive out discrimination. For instance, we are shocked by the torrents of online abuse that our footballers received for no other reason than their skin colour. I hope that our Online Safety Bill remains ambitious, and will help to hold to account those who are cowardly enough to hide behind online abuse.

Let me turn to a couple of the hon. Lady’s questions. One was about black maternal health. Our NHS makes the UK one of the safest places in the world to have a baby, but every death is a tragedy. Last month, NHS England published a targeted plan to improve outcomes for mothers and babies from ethnic minority groups, which will provide almost £7 million of support for local maternity systems. Our most senior midwife, Professor Dunkley-Bent, is leading important work in this area. We trust her judgment, and value the brilliant work that she is doing. Of course, with operational independence, we can ensure that the NHS listens and takes heed of what we want it to do, while allowing people to get on with their professional judgments.

Another issue that the hon. Lady raised was specialist ethnicity training for the police on domestic abuse, and it is an issue that I fully understand. This is a slight segue, but as part of my equalities brief I have been raising the ability of the police to respond to same-sex domestic violence. The hon. Lady has raised a very good point. Although our police do an amazing job in many areas, they are not always fully attuned to what domestic violence is really about. I know that domestic abuse affects a wide and disparate group and that a one-size-fits-all approach is not appropriate, particularly for those with specific needs such as ethnic minority victims.

We are seeking environmental provisions with all partners with which we are currently negotiating to ensure that future trade is sustainable and upholds the UK’s high environmental standards. The precise deals of any free trade agreement are a matter for formal negotiations.

Despite what the Minister says about calling for more control over trade, he has completely failed to advance the “polluter pays” principle through the carbon border tax, failed to advance the agenda at the G7, failed to put it into any of the trade agreements that he has drawn up and failed to put it into any of the negotiation frameworks that he is currently discussing. Can he tell me whether he will fail at the next stage when it comes to COP26? Is he already engaged in pre-negotiation talks with all the partners, and how will the principle fare on the COP26 agenda when the summits meets in November?

We take a strong interest in carbon leakage and in how trade deals with carbon. We are studying carefully, for example, EU proposals on the carbon border adjustment mechanism. At the World Trade Organisation in general, we are looking to advance our environmental agenda. The hon. Lady will know of the different measures taken by the UK Government; for example there is the UK global tariff, which reduced and eliminated tariffs on 104 environmental goods. We are also seeking good environmental chapters in all of our future free trade agreements.

My hon. Friend is absolutely right. A key benefit of the CPTPP is increased resilience. It means that our exporters will not have all their eggs in one basket. They will have options about where they send their goods. It will also mean our importers are able to rely on strong relationships in countries which follow the rules and have good standards in areas such as the environment and worker protection.

I am grateful to the Secretary of State for giving way. I have been crunching the numbers. If we look at our trade deficit, we see that this agreement will bring in just £300,000 a day in exports compared with the £11 million a day we are losing in our deal with the EU. Should her efforts not be put towards ensuring that the deal is comprehensive so that we can trade across the channel, in view of the carbon impact of trading across the world?

The logical position, if the hon. Lady does not believe in trading across the world, is that she only believes in having protectionism for the UK. The reality is that trade with the EU has bounced back. This is about positioning Britain for the future, and where the growing markets of the future are. We are expecting trade with CPTPP countries to increase by 65% by 2030. The hon. Lady is harking back to the past; we are looking at where the future opportunities are for Britain.

As the world’s second largest services exporter, we will be perfectly placed to benefit from strong provisions securing the free flow of data and easier business travel to CPTPP countries. True to the British people’s priorities, there are no strings attached to this deal that would force us to cede control over our laws, our borders or our money. Instead, the UK will join 11 fellow sovereign nations in one of the world’s largest free trading areas. This House can be proud that the UK is at the front of the queue and set to be the CPTPP’s first new member since it was established in 2018. This is a testament to the ties that we have forged with our Pacific partners and to the UK’s fierce commitment to high standards. It also shows that our independent trade policy is not just about the here and now, but about the long term. As part of the CPTPP, we can strengthen it as a bulwark against unfair trading practices. Together, we can bring home the benefits of free trade for all our people.

Our accession will have full parliamentary scrutiny. We committed to publishing our negotiating objectives, consultation response and scoping assessments at the outset of our negotiations, and we did that earlier this week. All of this will be fully scrutinised, including by the new Trade and Agriculture Commission. That puts us in a very strong position compared with comparable parliamentary democracies. Five years on from the referendum, we are demonstrating what global Britain is capable of. We are back as a major force for global trade, striking more trade deals than any other nation has been able to manage.

We have the world knocking on our door, eager to do business with Britain. That is why I am working with allies worldwide, from the United States to India and from the Gulf states to Japan, to break down barriers to trade, and we are now seizing the shimmering opportunity offered by this jewel of the Pacific, the CPTPP. Joining will do more than ever to realise our vision of global Britain as we embrace new markets while levelling up every region and nation of the UK. That is the bright future awaiting us as part of the CPTPP, and I commend these negotiations to the House.

My hon. Friend is right: this is about opportunity for the UK overall, and specifically for agriculture. It is a gateway to joining CPTPP. New trade deals will bring new export opportunities to British farmers. Global demand for beef and lamb is soaring. We should be wanting to fill part of that global demand. Meat consumption is projected to rise nearly 73% by 2050, particularly in the Asia-Pacific region.

I simply do not understand the Government’s logic: good-quality British farming undermined, high animal welfare standards compromised, jobs and livelihoods bartered away—all for no financial gain to British farmers, but at significant cost to our climate. Will the Minister assure me that he will not sign any trade deal with Australia until he has satisfactorily answered the five challenges that Minette Batters of the National Farmers Union has set out today, which have the full support of farmers—first protecting their interests, rather than his own?

I have already spoken about climate and the Australian Government’s commitment to the Paris accord, which we warmly welcome. We work very well together with Australia on environmental issues. On standards, I have already answered: there will be no compromise on our standards. May I say something about Australian animal welfare standards, as they sometimes get a little maligned in the press? They are ranked five out of five by the body concerned, the World Organisation for Animal Health—the OIE. Australia already sells naturally-grown beef and lamb into the UK. Our import standards will remain the same after the deal as before. For example, any hormone-grown beef would not meet our import standards.

At a time when our economy is in peril and just 44 days before we leave the transition arrangements, we still have no agreement with the EU. Fifteen continuity agreements are yet to be agreed, breaching the Government’s own deadline which the Prime Minister clearly said was immoveable, yet the Trade Minister comes to the Dispatch Box and says that he will extend provision into January. Will he tell businesses what will happen to their trade with those 15 countries on 1 January, so they can now make their plans?

It is relatively straightforward. If the agreement is made with the remaining countries and there is not the time to put it through the CRaG process before 31 December, it has the potential to be provisionally applied. The terms of that agreement will remain on 1 January in accordance with the existing EU deal going into that time, so there should be no interruption for businesses. Parliament will still have the opportunity, under the CRaG process, to give that agreement full scrutiny.

My hon. Friend is right, and last week I announced a new trade hub in Edinburgh, which will help businesses in Scotland to grow internationally and recover from the impact of coronavirus. The hub will promote opportunities for Scottish companies, and FTAs will provide access to our global network, which is provided in 115-plus markets. There is the support of UK Export Finance—[Interruption.] It is hard to hear oneself think with the chuntering from the Opposition Front Bench. Would it not be great if we saw the same interest in trade, and promoting trade, not least in Scotland, rather than chuntering and sideline messages?

We have had five years of horrific humanitarian crisis in Yemen, and over that period the Government have traded and made profit from £6.5 billion-worth of licensed arms. At the same time, they have given only £1 billion in aid. The UN has said that a consistent pattern of harm to civilians is being caused, so will the Secretary of State say why profiteering from arms sales is more important than supporting civilians in crisis?

I understand the hon. Lady’s point, but Her Majesty’s Government take their arms export responsibilities very seriously. We assess arms exports in accordance with strict licensing criteria. Those are consolidated EU and national arms export licensing criteria, and we draw on a lot of available information, including reports from non-governmental organisations and our overseas network in doing so. We will not license the export of equipment where to do so would be inconsistent with the criteria.

There is a difference between what is permissible and what is right. Since the bombing of Yemen commenced in March 2015, £5.3 billion-worth of export licences have been issued to Saudi Arabia, of which £2.5 billion have related to bombs, missiles and other types of ordnance. So what does the Secretary of State have to hide in not publishing the evidence on which to resume licensing arms and the trade in these deadly weapons?

I think I have already laid out to the House why these reports are not published: a lot are based on confidential information, which it would not be in the national interest for us to disclose. What we can say is that the incidents assessed to have been possible violations of international humanitarian law occurred at different times, in different circumstances and for different reasons. The conclusion was that they were isolated incidents. On that basis, we believe there is not a clear risk that the export of arms and military equipment to Saudi Arabia might be used in the commission of a serious violation of international humanitarian law.

My hon. Friend is right. I was very proud to open the market for pigs trotters into China when I was Secretary of State for Environment, Food and Rural Affairs. Market access is very important. We have seen a massive increase in pork exports to China over the past five years. He is right that our high welfare standards and quality produce are valued across the world. There are lots of new opportunities, including for the Gloucester Old Spot.

Leaked documents from Operation Kingfisher showed that York would be the worst-hit place in the country in the event of no deal. What discussions is the Secretary of State having with my city to ensure that we will be able to trade after 31 October?

I beg to move,

That this House has considered e-petition 242300 relating to future trade deals and the National Health Service.

It is a pleasure to speak under your chairmanship, Sir Roger. I thank Mr Byron Davis for starting the petition, which to date has attracted 166,998 signatures, including more than 200 from my constituency. The petition is entitled, “Don’t put our NHS up for negotiation”, and it asks the Government to,

“Please introduce concrete safeguards that will make sure our NHS is kept out of any future trade deals after Brexit.”

It goes on to say:

“Words aren’t enough—we want watertight protections that will keep our NHS off the negotiating table. Why is this important? When done well, trade deals can be good for the UK. They can help create jobs and build opportunities… But this plan would put our health service at risk.”

The Government responded on 17 June 2019:

“The Government has been clear: the NHS is not, and never will be, for sale to the private sector. The Government will ensure no trade agreements will ever be able to alter this fundamental fact.”

The Department for International Trade went on to provide a detailed 491-word response to the petition, which can be found on the Petitions Committee website. It includes commitments such as:

“the NHS is not, and never will be, for sale to the private sector, whether overseas or domestic.”

This is a crucial debate. The Government have already awarded £9 billion-worth of contracts. Section 75 of the Health and Social Care Act 2012 is the biggest threat to the NHS, as it opens up the whole NHS to the market. Does my hon. Friend agree that the Government must urgently repeal section 75 to safeguard our NHS?

My hon. Friend makes a powerful point, and I completely agree that the Government need to pay urgent to attention to that.

The Government’s response continued:

“the Government will continue to ensure that decisions on how to run public services are made by UK Governments, including the Devolved Administrations, and not our trade partners.”

It also said:

“Trade agreements do not prevent governments from regulating as they see fit, and they also do not require governments to privatise any services… The Government will ensure that nothing in our future trade agreements dilutes the powers of UK regulators to maintain the NHS’s position as the best health service in the world.”

However, as the petitioner says, words are not enough. By tomorrow, we will have a new Prime Minister; by the end of the week, we will probably have a new Cabinet, a new Secretary of State for Health and Social Care and possibly a new Government position on these matters. Although we hear time and again, from across the Benches, support for the great institution that is the national health service and for its abiding principle of being free at the point of need, those are only words without deeds.

As always, my hon. Friend makes a powerful point. Let us not forget the millions spent compensating private companies that lose contracts and take the Government to court.

Trade deals are not only dangerous for the future of the NHS, as they would entrench privatisation, but undermine our democracy, as future Governments would be shackled by their binding provisions. That is why some say the only way to fully protect our NHS from trade deals is to fully exclude it from them.

Does my hon. Friend agree that the riskiest point of entry for privatisation in our NHS is big pharma? Clearly, big pharma will seek to run other services in our NHS. It is essential that any trade deal takes seriously the threat big pharma poses to our NHS, given the service’s extensive drugs bill.

Again, I agree with my hon. Friend and bow to her knowledge. We all know that pharmaceuticals is one of the major gateways to the potential privatisation of NHS services. I say again that the only way to fully protect our NHS from trade deals is to fully exclude it from them. As far as I and, I am sure, the petitioners are concerned, that is precisely what we should do.

I simply say what I have said to the House on a number of occasions: we are making good progress on many of those agreements. I have already signed three of them very recently and deposited them with the House. We will continue to update the House as progress is made, and we will bring forward a report in the next week or two, which will help elucidate the matter further.

T4. Employment rights are human rights, so what is the Minister doing to ensure that no trade agreement is signed that undermines our standards in employment rights, health and safety rights and equality rights?

We set out in the trade agreement that this House supported on Canada the non-regression clauses that said we would not water down labour rights or environmental standards, or give away Government control on public service regulation, in order to reach agreement. I supported that and my colleagues supported that in the House, but the Labour party voted against it; I do not understand why.
