Commons ChamberWe all welcome the news that the hon. Gentleman has waited his turn and got an appointment to receive a vaccine. He raises an important point. Although of course the delivery of the vaccine in Northern Ireland is primarily a matter for the Department of Health in Northern Ireland, we will continue to work closely with it to support the vaccine roll-out to all communities, including those in remote and rural areas.
My Cabinet colleagues and I continue to work together closely to ensure that we meet our protocol obligations in a pragmatic and proportionate way. We have heard the concerns raised by people and businesses in Northern Ireland and are sensitive to the economic, societal and political realities in Northern Ireland. That is why we are taking forward a series of further temporary operational steps that reflect the simple reality that more time is needed to adapt to and implement new requirements as we continue our discussions with the EU. The steps include the new operational plan for supermarkets and their suppliers, committed to at the Joint Committee. I will lay a written ministerial statement detailing the steps later today.
After the EU’s outrageous abuse of the Northern Ireland protocol in relation to its failing vaccine programme, is it not clear that, as it stands, the operation of the protocol is not working? There is far too much disruption to businesses and families in Northern Ireland and it needs urgently to be either reset or scrapped altogether.

The borough of Kettering is blessed with many veterans who served in Northern Ireland, and they are outraged by this process. The previous Labour Government issued letters of comfort to known terrorists, and now a Conservative Government are effectively threatening prosecution of veterans, many of whom have already faced court cases. The Minister says he has received legal advice from the Northern Ireland Office. Will he reassure the House that he is challenging that advice, not simply accepting it? He said that Sinn Féin is not pressing for these cases to be examined—he said he had no knowledge of that. Can he confirm 100% that Sinn Féin is not pressing for these veterans to be prosecuted as a condition of setting up the new Northern Ireland Executive?
I am not in that part of those talks, so I would not be able to tell my hon. Friend that one way or another. I can say, however—this returns to my earlier answer to my right hon. Friend the Member for Rayleigh and Wickford—that rancid deals should have no part in how we treat our veterans in any case.

Commons ChamberI do not accept the hon. Gentleman’s analysis. The fact is that the Northern Ireland economy is doing very well, with the lowest unemployment rate in the country, and exports are increasing. On the single market and the customs union, let me be absolutely clear: the people of the United Kingdom collectively voted to leave the EU, and that includes the customs union and the single market.
Does the Minister agree that there would be no need for any kind of border infrastructure at all if the UK and the EU could agree what everybody wants, which is a comprehensive free trade agreement?

Commons ChamberI am grateful to the hon. Gentleman for his comments. The report is strengthened by the fact that it was unanimously passed by our Committee, despite the fact that it was wide-ranging and contained some extremely difficult material. That is a tribute to the Committee, and I pay tribute to the hon. Gentleman.
I believe that the Keegan judgment is probably the start of a process and that there will be similar ones in the months ahead. I think that it should serve as a catalyst to Ministers to think about the framework to which I have referred and focus their attention on how they can start to make those crucial decisions to deal with annex 1 in the report, and the list is growing by the day. The hon. Gentleman has a particular interest in the judgment that has been made, but there will be more, I am sure, across Northern Ireland. Although I would not want to comment specifically on this one, I am confident that there will be several similar judgments ahead, and we need a strategy from the Government for dealing with them; it is clear that civil servants cannot make judgments of that sort because in our system those decisions are reserved to Ministers.
I congratulate my hon. Friend on his statement and commend his Committee for its report. For me, there are two stand-out recommendations in the report. The first is the need for the Policing Board to be reinstituted, and the second is for there to be a Brexit Minister for Northern Ireland, because the Province’s voice is not being heard. These two recommendations can be advanced by the Government relatively simply: in the first case, with a legislative change—a lot of Northern Ireland legislation goes through this House pretty quickly—and in the second, with a ministerial appointment. Should not the Government just get on with it?
I thank my hon. Friend for the interest that he has taken in this matter, and he is, of course, correct on both fronts. We believe that there is no reason for further delay on the recommendations that we have made. I hope very much that the Minister, when he comes to respond to this in the fullness of time, will accept all the recommendations that we have made, but particularly those that are absolutely crucial now. Northern Ireland’s voice is certainly not being heard in Brussels alongside those of Scotland and Wales, although this is a UK Government responsibility and not a devolved matter.
Policing in Northern Ireland is a crucial and desperately sensitive issue. It is unacceptable that we cannot, for example, appoint senior police officers because of the lack of a Police Board. That, in our opinion, is a matter that simply cannot be delayed any further.

Commons ChamberThe right hon. Gentleman makes a point that demonstrates once again why we need devolved government in Stormont. I have met the chair of the Policing Board, and I have also spoken to the Chief Constable about this matter. They are both keen that political representation on the Policing Board should be restored as soon as possible so that there is proper governance. I will be in Washington at the end of the week for the St Patrick’s day events there, and I believe that the chair of the Policing Board will be there too, and I hope to catch up with her and discuss how we might make that a reality.
My constituents in Kettering were under the clear impression that the main purpose in life of Sinn Féin was to avoid at all costs direct rule from Westminster. Is it not clear but ironic that by refusing to reach an agreement with the DUP Sinn Féin has brought about exactly the thing that it has always campaigned to avoid?
I do not want to get into the whys and wherefores of what happened in the talks process. All I know is that all parties have given me a very strong commitment that they want to go back into devolved government, and I am seeking to find ways to make that a reality.

Commons ChamberI will follow up with the hon. Lady on that point after the statement. It is certainly not my intention to prevent her from being properly briefed in advance of statements; that is not how I operate. I will make inquires after the statement and revert to her to ensure that she is kept properly informed, in the usual way. I take seriously the point that she has raised, and I will pursue it to ensure that there is no repetition of the situation.
The hon. Lady made several points about the outstanding issues. As I have indicated, I think we are talking primarily about sustainability in respect of the Assembly and the Executive, and about issues of language, culture, identity and respect. Those have been underlying elements in our discussions, over many weeks, and it is important to get them right to provide a sense of sustainability and allow the Executive to get on with the job of serving Northern Ireland. I think that politicians on all sides seek earnestly to get those things right.
It is, ultimately, for the parties to reach agreement. Yes, we have worked with them and encouraged them, and we recognise our responsibilities as a Government under the various agreements that we hold, but the parties need to be accommodating and reach agreement. No agreement has yet been reached, so we are having to take the next step that I have set out in the statement today. The budget is necessary to put Northern Ireland’s public services and finances on a sound footing. We will continue to support the parties to find agreement, in the knowledge that the situation cannot continue indefinitely.
The hon. Lady highlights the election duty that I continue to be under, in legislation. I have to keep the matter under review, knowing that that is the only power that I have in law. I want resolution and agreement, because that would be the best possible outcome.
My constituents in Kettering find it absolutely abhorrent that threats of prosecution should hang over armed forces veterans for events that happened 40 or 50 years ago, while known terrorists have effectively been told that they will never be prosecuted for their known crimes. If the Secretary of State is bringing legislation to the House, will he ensure that it contains clauses designed to stop this witch hunt?

I thank my hon. Friend for his intervention. He is right that we should be optimistic; we have lots of grounds to be so. At this moment in time, the economy has been completely transformed, and we can build on that. Whether in the tourism economy, manufacturing or agriculture, there is huge opportunity. Our highly skilled populace can add to that further growth.
To touch on the Chancellor’s guarantee, applications for funding secured before the autumn statement will continue through the negotiations period and afterwards. In particular, we guarantee common agricultural policy funding until 2020, which I know will be an important element for the constituency of the hon. Member for South Down, which includes a big rural community that is dependent on the farming industry.
A difficult election campaign is about to start and its tone is important. It will be set against the context of our decision to leave the European Union. There is huge opportunity to grow the economy of Northern Ireland and the rest of the United Kingdom. It is for us as leaders, whether here in Westminster or in the Assembly, to seize that opportunity. I reassure the hon. Lady that the Government’s intention is to ensure that we make the best of the decision we have made for the economy and the people of Northern Ireland.

Commons ChamberI agree that it is very important to take seriously revocation of licences. There is a very clear legal framework for doing that. Where there is evidence that a licence should be revoked, it is considered with the greatest seriousness. I also agree that it is vital that we press ahead with full implementation of the “Fresh Start” programme to eliminate the lingering influence of paramilitary groups in Northern Ireland. The time for those groups has passed. They were never justified under any circumstances and any tolerance of them in Northern Ireland today is to be condemned. In relation to the last point about the public prosecutor’s direction, that is a matter for the independent prosecutors.
What is the Secretary of State’s assessment of the terrorist threat from dissident republican groups to mainland Great Britain?
The threat level is not as severe as it is in relation to Northern Ireland. It continues to be the case that dissident republican groupings have aspirations to mount attacks in Great Britain, but the indications are that their main focus continues to be Northern Ireland, and the Government will remain vigilant in doing everything they can to protect people, both in Northern Ireland and in the rest of the United Kingdom.

Commons ChamberI commend the Secretary of State for the clarity of her statement. However, a line will finally be drawn under this grubby episode only when somebody who has received a letter is successfully prosecuted for a terrorist-related offence. Like me, would she be disappointed if there were not such a successful prosecution?
These decisions are rightly matters for independent police and prosecuting authorities, and no option is available to me that will give us 100% protection against a successful abuse-of-process defence in the future. This is, however, the most effective and expeditious way I can seek to remove potential barriers and reduce the likelihood of another prosecution collapsing.
