Commons ChamberIf the hon. Gentleman thinks that at this late stage of negotiations, we can go back to the beginning, I am afraid his approach is rather delusional. We have made good progress and we are close to agreeing a deal. The responsible thing for Members from all parts of the House to do, regardless of their views on Brexit, is to get behind the Government so we can clinch that good deal for all quarters and all parts of the UK.
Has the Secretary of State made the Republic of Ireland aware that if the French start mucking about with Calais and a go-slow in the event of no deal, the biggest impact will be not on UK trade but on trade with the Republic of Ireland that passes through this country?
I am confident that the authorities in Dublin are well aware of the implications of no deal. All of us, on all sides—not just in this House but in the EU—want to lock horns, close the outstanding issues and seal the good deal that will serve everyone’s interests.

Commons ChamberIt is not for Ministers to determine the ambit, remit or scope of the prerogatives of the Speaker or this House, although we will of course respect them.
The Brexit Secretary has said that he needs the negotiations to be finished by the end of November. If he reaches that target, will the House vote on deal or no deal before or after Christmas?
My remarks were just reflecting the practical challenges, on both sides, for example in implementing legislation in the UK, but obviously there is a degree of flexibility to ensure that we have a meaningful vote and that there is as much time for legislative scrutiny and that the right balance is struck.

Gentleman is an experienced campaigner and knows a lot about such issues and about negotiations, so I am sure that he will recognise that he and others are going to be used in a pressure exercise on the UK Government in the final phase of the negotiations. We are in a direct negotiation with Michel Barnier and the EU as a whole, and we will continue to pursue the proposals that we set out in the White Paper. We are confident that we can get a good deal.
If we leave the EU with no deal, do we get to keep our £39 billion?
My hon. Friend is absolutely right that the nature of the financial settlement, as set out in the withdrawal agreement, is contingent upon us agreeing the deal as a whole, and it could not be guaranteed that we would provide the same amount of money if we left the EU without a deal. We will abide by our legal obligations, but I think my hon. Friend can safely say that that would be open for consideration.

Commons ChamberI thank the hon. Gentleman for his detailed scrutiny of my past record. As I have argued all along and as the White Paper makes clear, the UK can want to maintain, and even strengthen, operational law enforcement co-operation with the EU—through, for instance, bodies such as Europol and Eurojust—without being subject to the supranational jurisdiction of the European Court of Justice and all the decision-making fetters. Indeed, Europol and Eurojust have a large number of association agreements with non-EU countries. I believe that the US has more liaison officers posted at Europol than the average EU country.
Will my right hon. Friend confirm: that he will not extend article 50; that no deal is better than a bad deal; and that if there is no deal, we will keep our 40 billion quid?
It is certainly the case, in my view and the Government’s view, that no deal would be better than a bad deal, but what we are aiming for is the very best deal.
My hon. Friend asked about the money. I took some time to set out in my response that we have made clear the need for a link between the obligations that we undertake in the withdrawal agreement and what we then expect in relation to the future partnership deal on trade, security and other areas in which there is co-operation. That needs to be looked at as a whole. If one side, whichever it may be, does not fulfil its side of the bargain, there will be consequences for the whole deal—and yes, that would include the money.

Commons ChamberThe hon. Gentleman, who is a valued member of the Select Committee, has raised a very important point that is highlighted in the report. It is clear, leaving Brexit to one side, that there is growing wish on the part of this Parliament, and Parliaments across Europe and around the world, to have a say in approving trade deals that may be negotiated in future, because they increasingly have an impact on many aspects of our national life. It is important, as we say in the report, that Parliament can have a meaningful vote on the future trade deal that we have with the European Union when the negotiations are concluded—in time, we hope, for the end of the transition period. We also highlight the fact that it is important that Parliament is able to scrutinise any future trade deals properly, whether they are negotiated by the European Union on our behalf because we end up remaining in the customs union—the Committee has not reached a view on that issue, but it is a matter of debate in the House—or they are negotiated by the Government.
I congratulate the right hon. Gentleman on bringing his report to the House and giving an oral statement. I hope that he does the same for all his subsequent reports. Clearly, he and his Committee are going to be very busy, especially from October onwards. What is his response to a scenario whereby either the European Parliament or the British Parliament sought to amend the withdrawal agreement while the other had approved it? What happens in those circumstances?
I am grateful to the hon. Gentleman for his kind words. We feel pretty busy already. I cannot promise that I will always make a statement on every one of our reports, because that is in the hands of the Backbench Business Committee.
The scenario that the hon. Gentleman describes is a possibility. It is not unknown in negotiations where two parties are discussing an agreement for them to report back to their members—in this case, Members of the European Parliament and Members of the House of Commons—and then return to the table and say, “I’m sorry but it didn’t go down terribly well with the members in this respect. Can we talk about what we are going to do about this?” It is possible that that situation might arise. That is why we thought it important to set out in the report what we think ought to happen. We say that Parliament should be able to express its view—that we in Parliament should be able to offer advice— and the Government should listen to that, but clearly it would be for the Government to go back and negotiate.
This also links to the recommendation about an amendable motion. When the Secretary of State came to give evidence, I asked him, “Will the motion to approve the withdrawal agreement be amendable”, and he indicated that it would be. I think he said, “Show me a motion that can’t be”; I paraphrase. In those circumstances, Parliament might want to say, “The whole thing’s fine”, or it might want to say, “All these bits are okay but we have reservations about this, or we’d like to see that included.” My personal view is that Parliament should be entitled to do that. The view of the Committee is that Parliament should be able to offer advice to the Government and then the Government will have to respond. If the agreement is not approved—or if conditions are put on its approval—in the House, any Government, in any circumstances, on either side of the negotiations, would have to reflect on that and work out what they were going to do.

Commons ChamberBoth the Secretary of State and I have met many local authority leaders around the country. We are keen to engage with them so that we understand their concerns about EU exit. Importantly, the UK will continue to participate in the 2014 to 2020 EU programmes until they close, and, thereafter, EU structural funding will be transferred through a UK shared prosperity fund. Comments from local authorities will be very well received.
Proceedings would be incomplete if we did not hear from the conscience of Kettering.
The UK has reached an important agreement on citizens’ rights with the EU that is fully reciprocal, but it is of course important to recognise that it is the responsibility of member states, rather than of EU institutions, to implement some aspects of that agreement.
Do the reciprocal rights that the EU is meant to have agreed extend just to the country in Europe in which UK citizens are living, or do they extend right across all 27 member states?
My hon. Friend makes an important point. We are clear that we would like to secure onward movement rights for UK citizens living in the EU, and we will return to this issue in the next phase of negotiations. In several other areas, it is right that the rights are reciprocal between the UK and the EU and that they apply throughout the whole EU.
The hon. Gentleman really must learn to pay attention during these questions. The simple truth is that creating such an incentive for the European Union would actually be the one thing that undermined the negotiations.
In any divorce, the assets are divided. Including the £39 billion divorce bill, from the day we joined in 1973 to the day we leave, we will have given £250 billion in today’s money to this organisation. What proportion of the assets are we going to get back?

Lady that the latest figures from NHS Digital show that there were over 3,200 more EU nationals working in the NHS in September 2017 than before the referendum result. Formal impact assessments will, of course, be produced in the normal way in connection with legislation.
We have been working closely with our colleagues. In England, the Marine Management Organisation is working with the Ministry of Defence and the Royal Navy, as well as the Border Force, the inshore fisheries and conservation authorities and other organisations to deliver fisheries protection and regulation, irrespective of whether an agreement has been reached when we leave the common fisheries policy.
Remainers and leavers are united in the opinion that the very worst aspect of our EU membership is the common fisheries policy. When we leave the European Union, we leave the common fisheries policy. On that day, the armada of EU trawlers that have been plundering Britain’s historic fishing grounds since 1973 are not going to be happy that their best years are behind them. Will the Minister ensure that the Royal Navy has the resources it needs to protect our sovereign waters and ensure the rebirth and renaissance of the British fishing industry?
My hon. Friend makes a serious point, with his usual force. We hope to reach an agreement in our mutual interests but, as the Prime Minister made clear in her Mansion House speech, we are leaving the common fisheries policy, and the UK will regain control over our domestic fisheries management rules and access to our waters. On enforcement, we will strengthen our surveillance capability and make sure that the appropriate capacity is in place to patrol our waters and enforce regulations, as required. This will be underpinned by a robust approach to risk-based assessments.

Does the promotion of leaker-in-chief and Brexit-phobic Martin Selmayr to the EU’s top civil service post help or hinder our stance, or make no difference at all?
As a matter of diplomatic policy, we never comment on internal operations in other Governments.

Commons ChamberThe Government have been talking to a wide range of industry groups and representative bodies of business, and we recognise that there are benefits in some areas of maintaining regulatory alignment and ensuring that we have the most frictionless access to European markets. Of course we are entering the negotiations on the future partnership, and we want to take the best opportunities to trade with Europe and the wider world.
Is it true that Michel Barnier has basically offered us the Canada model, agreement on which could be reached this year, thus negating the need for any transition period?

Commons ChamberThe right hon. Member for Carshalton and Wallington (Tom Brake) looks as though he has just consumed a very bitter lemon, but I hope he recovers.
Does my hon. Friend share my dismay that pro-remain Members of this House who represent constituencies that voted to leave leap on incomplete economic analysis and profess deep understanding of complex economic methodology, yet fail to wrap their minds around the simple arithmetic of the referendum, which was that 52% voted to leave?
I must exercise some caution, Mr Speaker, because as you will know, Wycombe District, which is substantially larger than the constituency of Wycombe, did express the other view. However, what I think we need to do is come together to unite around the result as a country, and to choose for ourselves not to leave the EU because we must or because we ought, but to leave the EU successfully because we choose to abide by the democratic decision of the United Kingdom as a whole.

It is in the interests of all parts of the UK to exit the European Union with continuity, certainty and control, which is why I think it was a missed opportunity for his party not to support the European Union (Withdrawal) Bill, but I look forward to seeing that support in the other place. As I said to the hon. Member for Carmarthen East and Dinefwr (Jonathan Edwards), amendments to clause 11 of that Bill will be brought forward in the Lords.
Prior to the referendum, Her Majesty’s Treasury forecast near economic collapse, since when the economy has done well, with manufacturing and exports particularly strong. How can my hon. Friend assure my constituents that Her Majesty’s Treasury understands the electoral arithmetic of the referendum and will finally get with the programme?
I can assure my hon. Friend that our Department has been working closely with Her Majesty’s Treasury to ensure that we make a success of this process. He rightly points to the robust growth figures that we have seen from the UK economy. What we all need to ensure is that, throughout this process, we continue to support that economy to grow and deliver the public services that we all want to see.
