Every pair other than that with the hon. Member for East Dunbartonshire was honoured last Tuesday.
As you will know, Mr Speaker, if I think that someone in government should lose their job, I am not afraid to say so. As you might imagine, I, like my hon. Friend the Member for North East Somerset (Mr Rees-Mogg), have had my fair share of run-ins with the Chief Whip. However, I have always found him, even when we have fundamentally disagreed, to be a man of complete honour, of his word and of integrity. That also goes for the other members of the Whips Office with whom I have had fundamental disagreements. Does my right hon. Friend agree that the Chief Whip’s integrity should not be questioned in any shape or form, and that anybody who knows him as well as we do would know that to be the case? Is this not really an attempt by the Liberal Democrat Chief Whip to avoid the embarrassment of the fact that he could not get the leader of his own party, or his immediate predecessor, to vote in a Division last Monday that the Government won by only three?
I do not know whether that was an eloquent bid to be the beneficiary of future pairing arrangements, but my hon. Friend makes an important point. I think it is true that Conservative Members right across the spectrum, from left to right of my party, have always found the Chief Whip to be someone with whom they can do business and whose integrity and honesty they can completely trust.

Commons ChamberI would have thought that the act of depriving someone of his or her liberty when they are sentenced to custody by definition deprives them of some absolutely vital civic rights. What we have announced today is a sensible and constructive way forward that we believe complies with the requirements on us under international law, and the Hirst judgment in particular, but does so in a way that respects the view repeatedly come to by this House.
The Secretary of State knows that I think giving the vote to any prisoners is idiotic, unjustifiable and about as popular with the general public as finding a rattlesnake in a lucky dip. As he has made great play of the rule of law, he must know that the European Court of Human Rights went way beyond what is in the convention when it made this ruling, so he might want to remind it of the obligations under the rule of the law, which are to stick to what is in the convention. It seems from his statement that he is putting the rulings of unelected, unaccountable pseudo-judges, many of whom are not even proper judges in their own country, above the views of the British public and the British Parliament. Will he at least have the courtesy to put this to a vote of this House, to make sure that what he proposes has the consent of the British Parliament?
We are not proposing any change in the law, as I have already said. The commitment to stay within the European convention on human rights, which includes the jurisdiction of the European Court of Human Rights, was in the party manifesto on which both my hon. Friend and I stood earlier this year. I do, however, agree with him that it is important to look for ways in which to respect and enlarge the margin of appreciation allowed to individual member states in interpreting the duties under the convention in the light of their national constitutional and legal traditions. We made a significant step forward when the UK held the chair of the Council of Europe and with the Brighton declaration negotiated by my right hon. and learned Friend the Member for Rushcliffe (Mr Clarke). In taking the Brighton declaration forward and seeking to implement protocol 15, I would hope that we can count on the support of my hon. Friend.

Commons ChamberThese are not in fact new powers; they have been in use across the country for many years. They apply to arrests relating to debt and community penalty breaches, and they must follow the issue of a warrant of arrest from the criminal courts. Any use of these powers is overseen by Her Majesty’s Courts and Tribunals Service.
Following the triumph of the Conservative manifesto at the election, may I congratulate the Lord Chancellor on finding another half-baked and unpopular policy to put before the electorate: giving prisoners the vote? Will he acknowledge that nobody is taking the vote away from prisoners—they are taking it away from themselves? If voting is so important to them, perhaps they should not commit the crimes that lead to them being sent to prison in the first place. I urge him to reject this ridiculous policy, which goes down like a lead balloon with the electorate.
The Government are preparing their position ahead of the December meeting of the Committee of Ministers of the Council of Europe. We will announce any changes in our position to Parliament in the usual way.

Commons ChamberThe Government could not have been clearer about our wish to encourage more women to take part in public life, not only through seeking membership of the House of Commons and local authorities but through many other forms of public service. Successive leaders of my party have worked hard to promote that, not least my right hon. Friend the Prime Minister. My party, unlike the hon. Gentleman’s, has a woman leader both in Holyrood and at Westminster.
The right hon. Member for Birmingham, Edgbaston (Ms Stuart) has been an outstanding Member of Parliament. Her successor, whoever they may be, has an incredibly difficult act to follow.
Will the Leader of the House confirm that the Prisons and Courts Bill has been abandoned for this Parliament and will have to start its passage through the House again in the next Parliament? Can he tell us which Bills will be going through the rather grubby process of the wash-up, which is a rather unsatisfactory way to pass laws?
The Bills that were introduced to this House quite late in the current parliamentary Session and which received carry-over motions so that they could be debated in what would have been the third Session of this Parliament, including the Prisons and Courts Bill, will fall. I referred in my statement to some of the measures that we will be addressing during the wash-up period next week. As my hon. Friend knows, though, discussions are going on through the usual channels about how to handle particular pieces of legislation; I do not want to prejudice the outcome of those discussions.

Commons ChamberFirst, I thank the hon. Gentleman for his kind remarks, and I associate myself with his condolences to the victims of yesterday’s attack and his salute to the emergency services and others.
On the hon. Gentleman’s political questions, I have said that the Government will find time for the statutory instrument to be debated. Of course the fact that that particular statutory instrument is subject to the negative resolution procedure was authorised by the Act of Parliament from which it is delegated, so the power was debated and approved by this House during the Act’s passage.
On the substance of the policy on the third child of a woman who has been subjected to the ordeal of rape, the Government recognise that that is a very difficult and sensitive issue, which is why we have adopted a third-party model to allow us to make sure that neither Department for Work and Pensions nor Her Majesty’s Revenue and Customs staff will question the mother about the incident. Instead, staff will simply take the claim and receive the supporting evidence from a third-party professional, which seems to us to be the right balance between making sure that mothers get the support they need without the need for unnecessary, intrusive processes while providing the right assurance that additional support goes to those for whom it is intended.
On the hon. Gentleman’s question about article 50, I must say that we have not been short of opportunities up till now, but I am sure that before long there will be an opportunity for the House to debate that decision or for questions to be posed.
On the debate in the Scottish Parliament, my right hon. Friend the Prime Minister has been very clear that we believe that now is not the time for a second referendum—particularly given that the 2014 referendum was supposed to be a once-in-a-generation opportunity—and that the United Kingdom Government and all three devolved Governments ought now to work very closely together to ensure that we get the best possible deal for all the people of every part of the United Kingdom in the forthcoming European negotiations.
I commend the Leader of the House for his calm and reassuring presence in the Chamber yesterday and, through you, Mr Speaker, I commend Mr Deputy Speaker; both performed magnificently in the Chamber yesterday.
May we have a timescale for a statement or debate on the fairer funding formula for schools? Preferably, the Government will scrap their current proposals, which are frankly unjustifiable. The formula will take money from schools in Bradford district, which is one of the worst-performing local authorities in the country with regard to education, and transfer it to some of the highest-performing local education authorities in the country, which is absolute madness. Every school in my constituency will lose money. How quickly will the Government realise that their proposals are unjustifiable and unacceptable?
I thank my hon. Friend for his kind remarks. My right hon. Friend the Secretary of State for Education will come forward with a response as soon as possible, but as the consultation on the draft national funding formula proposals concluded only this week, it is reasonable that she should have a while to consider the detailed representations that have been put forward by a number of different parties. Nevertheless, she will come forward with a response, and I promise my hon. Friend that there will be an opportunity for the Government to debate any proposals that are then submitted.

Commons ChamberAs I would expect, the hon. Lady champions the cause of Hull, but the Government are investing £13 billion to improve transport across the north of England, to improve journeys for local people, and to help industry. That is possibly only because we are pursuing economic policies that generate the wealth that enables us to provide that support. I can list a number of projects, including £1 billion to upgrade rail infrastructure, the work with the rail franchises in the north, and the £2.9 billion of road improvements across the north. The position is getting better, but continuing that spending relies upon a strong, productive economy.
Can the Leader of the House give us the anticipated timetable for the Prisons and Courts Bill? In the meantime, may we have a debate about assaults on prison officers? As we all know, the number of assaults has gone up, but the number of extra days added to the prison sentences of those who commit the offences has gone down since 2010 from an average of 20, which was pretty low anyway, to just 16. We should prevent people who have been convicted in prison of assaulting a prison officer from being released halfway through their sentences. May we have a debate to try to influence the Government’s Bill?
When my hon. Friend gets the chance to study the Prisons and Courts Bill, he will find that it contains a number of measures that will be welcomed by prisons governors and prison officers. They are designed to help prison staff to run establishments in a way that is safe for staff and for prisoners alike, and to ensure good discipline, order, and productive work and educational opportunities. I cannot give him the timescale for the debates on the Bill, but there will be questions to the Secretary of State for Justice on 7 March and he may have the opportunity to pursue some of these matters then.

Commons ChamberAlthough that is obviously a matter for the company, trade unions and employees concerned, the Government hope that all employers take seriously their responsibilities to ensure that their workforce is fairly rewarded. I cannot offer the hon. Gentleman a debate in Government time, but this might be a subject on which to seek an Adjournment debate.
Last week, I attended in the House of Lords a meeting, organised by the Cross Bencher and human rights campaigner Baroness Cox, at which three very brave women told us their harrowing tales of how they have been treated and the impact that sharia councils have had on their lives. It is a disgrace that we have this alternative form of justice in our country. May we have a debate on that to make sure everybody in this country is treated equally under the same law and we do not have sharia councils treating women in such an appalling manner?
It is very important that all of us in this place uphold wholeheartedly the rights that both men and women have under the law of the United Kingdom, and emphasise that whatever private or community dispute resolution arrangements may or may not exist, the legal rights of women and men under law trump any such informal agreements.

Commons ChamberWe are very clear that the service provided by Concentrix was poor, and it was right that the contract was scrapped. HMRC has apologised, and it knows that it has to learn some lessons from that contract and what happened there. When it became clear that Concentrix’s customer service issues could not be rectified by Concentrix, HMRC took back 181,000 incomplete cases, and rightly redeployed hundreds of its own staff to deal with this work. All those cases were finalised by 3 November. HMRC has then also had to deal with mandatory reconsideration requests, of which 36,000 have been received, and it has allocated additional staff to that work so that requests can be dealt with quickly and payments restored where claimants are entitled to them. There may be an opportunity for a Back-Bench or Westminster Hall debate on this issue, further to the airing it has already had in this Chamber, but I think HMRC was right to give priority to the incomplete cases and to deal with those first. It is now proceeding as rapidly as it can to sort out the remaining mandatory reconsideration requests.
Can we have a debate on dementia? I am sure the Leader of the House will join me in congratulating Incommunities—the social housing provider for Bradford, which is based in my constituency—on training its staff to support residents with dementia. In such a debate, we could encourage other organisations to do the same. We could also find out what more the Government could do to help people who suffer from dementia—an estimated 6,500 people in the Bradford district are affected by it—and what further support could be given to their families, who have the difficult job of caring for them.
I hope my hon. Friend will have that opportunity, perhaps in Westminster Hall. I add my salute to those groups and individuals in his constituency, and in many others, who have highlighted the challenges posed by dementia and worked not only to encourage more people to become dementia friends but to ensure that we treat people living with dementia with the respect and dignity to which they are entitled and that they get the solidarity and support from their fellow citizens that they are entitled to expect.

May we have a debate on the outrageous plans of Jockey Club Racecourses to close Kempton Park racecourse? If Jockey Club Racecourses is not about the protection of racecourses and the heritage of British racing, Lord knows what on earth it is about. If the closure had been proposed by Arena Racing Company, members of the Jockey Club would have been the first to complain, particularly given that Kempton Park is a profitable racecourse. May we have a debate to find out what this House can do to stop these outrageous plans, which will be a hammer blow to national hunt racing in this country and will concrete over a huge swathe of the area’s greenbelt, too?
As my hon. Friend will understand, this site is ultimately a matter for the Jockey Club, on the one hand—the Jockey Club has a royal charter that obliges it to act for the long-term good of British racing—and the local planning authorities, on the other, but I completely understand his point. I understand not only the importance of Kempton Park to the horseracing industry but the importance of horseracing both as a source of great pleasure to millions of British people but as an industry for this country. Whatever decisions are ultimately taken about Kempton Park, I hope that we will continue to ensure that the horseracing industry thrives, generates jobs and continues to bring great enjoyment and pleasure to so many people.

Commons ChamberThe central point is that there will no change in the level of service that jobcentres offer people in Glasgow. The DWP is merging a number of smaller offices into bigger sites as leases come to an end so that we can save taxpayers, including Scottish taxpayers, money without changing the service offered. The Government have already consulted on the plans, but there will be further consultation in areas where people have to travel more than three miles or for longer than 20 minutes to reach a jobcentre.
May we have a debate on horse-racing, particularly the bravery of jockeys? Horse-racing is undoubtedly the finest sport there is and plays an important part in many communities’ local economies, but it would not be possible without jockeys and their bravery. One in 10 jump jockey rides ends in a fall. Freddy Tylicki, a flat jockey, recently suffered life-changing injuries from a fall on the flat, and Mark Enright recently spoke about the mental health problems that he and other jockeys have faced, particularly in keeping their weight down to ride horses. Such a debate would enable us to praise those jockeys, the British Horseracing Authority and the Professional Jockeys Association. Will the Leader of the House grant such a debate and see if the Government can help the horse-racing industry to tackle these matters?
Millions of people in this country enjoy horse-racing in all its forms and admire the guts and determination of jockeys, and it is a very risky occupation, but, as I am sure my hon. Friend will acknowledge, it is one for which those jockeys volunteer; they accept the sort of devastating risks he describes and, I think, derive huge pleasure and accomplishment from it.

Commons ChamberThere are some legal requirements that govern pension schemes, which give a measure of protection, and accrued rights under the old pension scheme—I understand that it is proposed to close the scheme—remain preserved. I share the hon. Gentleman’s welcome for the agreement that was reached yesterday and pay tribute to those in all political parties in Wales who have fought so hard for such an agreement to be struck. It is good to see that a way appears to have been found to enable steel production to continue at Port Talbot. I will ask Ministers to address the particular point he raises, but we have Business questions next Tuesday and he may want to try his luck at raising this question again then.
It is almost the first anniversary of the Boxing day floods that devastated my constituency and large parts of west Yorkshire. Before the Christmas recess, will the Leader of the House arrange a statement from the Secretary of State for Environment, Food and Rural Affairs to explain what has been done over the past year to prevent any further such flooding in my constituency and those other communities in west Yorkshire, and to explain what arrangements are in place to ensure a rapid response from authorities—including local authorities—if such terrible floods happen again on bank holidays over the Christmas period?
Each area now has a designated local authority—either the county or the unitary authority—that has a lead responsibility for co-ordinating flood management and response to flooding. The Government have also ensured in their response to more recent floods in the north-west and south-west of England that Bellwin scheme money is released at a much earlier stage than has sometimes been the case.
Spending on flood management continues, and we recently published a flood resilience strategy that sets out a plan for the longer-term future. I will make sure that the Secretary of State for Environment, Food and Rural Affairs is aware of my hon. Friend’s particular concerns about his own area, about which she may wish to reply in more detail to him.

Commons ChamberNo; as I said on Tuesday, there was no argument last Friday that any hon. Member on any side of the argument was engaged in filibustering. When 2.30 pm came, the Under-Secretary of State for Justice, my hon. Friend the Member for East Surrey (Mr Gyimah), as the Minister responsible, had spoken for only one minute more than the Bill’s promoter and for a shorter time than one of the Bill’s main supporters. He sought to respond in detail to the many questions raised, and he gave way seven times to interventions. It seems to me that he behaved in a thoroughly reasonable manner.
In order to guarantee the fairness that the Leader of the House spoke about earlier, is it not time that English votes for English laws was extended to private Members’ Bills?
That sounds to me like a further interesting submission to the Government’s consultation.

Commons ChamberThere are opportunities, particularly through the Select Committee system, to pursue those issues in much greater detail and to question Ministers about arrangements with all the relevant British overseas territories. I hope that the hon. Gentleman would, however, acknowledge that this Government have taken more determined and effective action than any of their predecessors to improve the standards of transparency and reporting on behalf of our overseas territories, and to pioneer international agreements to try to stamp out tax evasion and limit tax avoidance.
May we have a debate—it may need to be a long one—on how out of touch the BBC is with the general public in the United Kingdom? A freedom of information request that I have just had returned confirms once again that over the last year the BBC bought more copies of The Guardian than any other national newspaper, despite it being only the eighth most popular daily with the British public. In fact, the BBC bought 75,000 copies of The Guardian last year—it seems to be single-handedly keeping that newspaper afloat. Does this not show how out of touch the BBC is with the general public across the country? Should we not expect the national state broadcaster in this country to be more in tune with, and to represent, the people it is supposed to represent?
There will be a chance at next Thursday’s Culture, Media and Sport questions to pursue concerns about the BBC. It is for the BBC itself to answer questions about its newspaper subscriptions. I do think, however, that evidence suggests that most people in this country value the programmes that the BBC produces on both television and radio, and that although we should certainly be on the lookout for any examples of wasteful spending or abuse of the sort my hon. Friend has described, we should not neglect the reality that the BBC is a formidable soft power asset for the influence of the United Kingdom globally.

That this House—
(i) approves the First Report from the Committee of Privileges (HC 662);
(ii) having regard to the conclusions of the Committee in respect of Mr Colin Myler, considers that Mr Myler misled the Culture, Media and Sport Committee by answering questions falsely about his knowledge of evidence that other News of the World employees had been involved in phone-hacking and other wrongdoing, and therefore formally admonishes him for his conduct; and
(iii) having regard to the conclusions of the Committee in respect of Mr Tom Crone, considers that Mr Crone misled the Culture, Media and Sport Committee by giving a counter-impression of the significance of confidentiality in the Gordon Taylor settlement and by answering questions falsely about his knowledge of evidence that other News of the World employees had been involved in phone-hacking and other wrongdoing, and therefore formally admonishes him for his conduct.
That the matter of the exercise and enforcement of the powers of the House in relation to select committees and contempts be referred to the Committee of Privileges.
This case was referred to the Privileges Committee by the House on 22 May 2012. The Committee was tasked to investigate the conclusions in chapter eight of the 11th report from the Culture, Media and Sport Committee, Session 2010-2012, on “News International and Phone-Hacking”. The Committee found that Mr Colin Myler and Mr Tom Crone misled the Culture, Media and Sport Committee by each answering
“questions falsely about… knowledge of evidence that other News of the World employees had been involved in phone-hacking and other wrongdoing”
and made a finding of contempt in relation to each of them. The Committee also made a finding of contempt in relation to Mr Tom Crone being found to have
“misled the CMS Committee in 2009 by giving a counter-impression of the significance of confidentiality in the Gordon Taylor settlement. He was involved in the settlement negotiations and knew that NGN’s desire for confidentiality had increased the settlement amount.”
The standard of proof employed by the Privileges Committee was whether the allegations contained in the Culture, Media and Sport Committee’s report were significantly more likely than not to be true. The other allegations made against Tom Crone, Les Hinton and News International did not meet the evidentiary standard set out by the Committee. I thank the Committee for its diligent work, particularly given the necessarily long pause in the inquiry while legal proceedings were under way.
The findings matter because Select Committees play an important role in parliamentary and national political life. Ultimately it is voters who lose out when witnesses fail to provide reliable evidence. Decisions that shape and affect our constituents’ lives are made by the businesses, organisations, and of course Ministers whose work is overseen by Select Committees. Scrutiny happens effectively only because of the powers and privileges afforded to Members of Parliament. Without them, the ability of MPs to serve their constituents properly is undermined. The findings of the Privileges Committee that Parliament has in this instance been knowingly misled are of serious concern. The fact that questions were raised by parties to this inquiry regarding the use of Parliament’s powers and the proper jurisdiction of the House is troubling.
News International tried to get the shadow Secretary of State for Culture, Media and Sport and me thrown off the Select Committee inquiry into this issue when we were serving on the Committee. These people were lying through their teeth—that is absolutely clear. Does the Leader of the House think the penalties put forward in this motion are commensurate with the systematic lying by people at News International during that inquiry?
I am going to deal with the question of penalties a little later in my speech.
I said that the questions raised by parties to the inquiry about parliamentary powers and proper jurisdiction were troubling. In its report, the Committee of Privileges cites submissions from lawyers acting on behalf of the News of the World journalists. Those legal representatives claimed that the House does not have penal powers in respect of contempt of Parliament. It is regrettable that Parliament and its powers have been challenged in such a way. Although Parliament has chosen not to exercise penal powers for many years, there is no doctrine of desuetude in English law or, I believe, in the law of any part of the United Kingdom. It is for Parliament to make a judgment about the best course of action in addressing that challenge, and for that reason the motion refers
“the matter of the exercise and enforcement of the powers of the House in relation to select committees”
to the Committee of Privileges for further consideration. Without such a formal referral from the House as a whole, under our Standing Orders that Committee could not consider the matter further. Of course, in practice there have been relatively few instances where the authority of the House has been challenged—at least in recent years—so the House has had little need to exercise its powers.

I said that we would consider seriously the proposals from the Committee. The hon. Lady needs to reflect on why her Bill failed to get the support of the majority of MPs.
Does the Leader of the House agree that if people are particularly unhappy about a Bill not getting through on a Friday, they should make the effort to turn up to support it, because if at least 100 people turn up to support the first Bill that is taken, it will go through despite any opposition or attempt to block it? Does he agree that it is not too much to expect any Bill that goes through this House to have the support of 100 MPs?
I do not always agree with my hon. Friend, but on this occasion he makes a very reasonable point.

Commons ChamberMay we have a statement urgently from the Government about the farce of allowing the child refugees into the country? The Home Office has admitted that two thirds of successful applicants as child refugees are actually adults. Today, Jack Straw has said that we need to do better on age checks, as the right hon. Member for Birmingham, Hodge Hill (Liam Byrne), did when he was the Immigration Minister. That is a serious concern to many of our constituents. May we have an urgent statement on what the Government are going to do to make sure that the child refugees are actually children?
We do work closely with the French authorities to ensure that all those applying to the UK do actually qualify under the Dublin arrangements, which include the requirement for children to be under 18. We have to carry out the checks in a way that complies with High Court judgments on the matter. As my hon. Friend knows, the British Dental Association has taken the view that to carry out X-rays of claimants’ teeth would not be a reliable indicator of age, as well as being, in its view, unethical.

Commons ChamberAs the hon. Gentleman knows, we have, for a long time and under successive British Governments, supported the efforts to try to bring about an end to the appalling conflict in Colombia. We welcome the courageous work President Santos has done to try to reach that agreement, and British Ministers are certainly not going to, in any way, seek to tell the President of Colombia how he should proceed in setting the final seal on an agreement that we all hope will endure.
Can we have a statement from the Secretary of State for Justice on the policy of allowing prisoners out to spend time with their families at Christmas? It seems from an answer to a parliamentary question that 973 prisoners were allowed home to spend time with their families last Christmas, including 61 murderers. I would have hoped that it went without saying that the victims of those murderers will never be able to spend Christmas at home with their families again. The Government might reflect on what the families of those victims must think when those murderers are allowed out to enjoy a family Christmas at home, when the victims will never have that experience again. The Government might tell prisoners that if they want to spend time at home with their families at Christmas they should not commit the crimes in the first place that get them sent to prison.
I will certainly draw the Justice Secretary’s attention to the point my hon. Friend has made, but I would just add this: all but a very small number of prisoners are going to be released one day, either at the end of the sentence or on life licence. It is not unreasonable, in the context of people who are approaching the end of a sentence, to be looking at ways in which to make it possible for them to adjust to society outside prison and to earn a living, take family responsibility and, hopefully, pursue a better path at that point. Where my hon. Friend is absolutely right is that such a step needs to be looked at in the context of overall sentence planning, and should not be a way in which to soften the necessity for the punitive aspect of a prison sentence, which the public rightly expect judges and the Prison Service to see enforced.

Will my right hon. Friend arrange for the Attorney General to make a statement about appealing against unduly lenient sentences? A number of people, including some of my constituents who have contacted me about this, felt that the sentence given to Anjem Choudary was derisory, given the serious level of the offences that he had committed. Today, we found out in the newspapers that the Attorney General is unable to appeal against an unduly lenient sentence for that crime. We promised in our manifesto to extend the number of crimes that could be appealed with regard to unduly lenient sentences, so will the Attorney General come to the House and explain when we are going to crack on with it?
As my hon. Friend points out, the Government were elected on a manifesto that pledged us to extend the list of crimes that were covered by the right of the Attorney General to refer an excessively lenient sentence to the Court of Appeal. Work on that is ongoing. As soon as it is completed, either the Attorney General or the relevant Justice Minister will come forward with a statement to the House.

Commons ChamberI am delighted that my right hon. Friend is in his post, as I am that the Deputy Leader is in his post. I welcome him to the Front Bench. May we have a debate on the welfare of dogs? There is much material that could be used in such a debate, such as: the appalling practice of dogfighting; the terrible distress caused by the theft of dogs, which has happened to a number of my constituents; and the great deal of distress experienced by dogs left in cars during very hot weather. Last weekend, the RSPCA’s 24-hour emergency helpline received 106 reports of dogs left in hot environments. I suspect that that figure will be much higher for this week, which has been unseasonably hot. May we have a debate to draw attention to the welfare of dogs and how such things can cause unnecessary distress?
My hon. Friend raises an important issue for those of us who are concerned about animal welfare. In his reference to how people sometimes leave pet dogs in cars in hot weather, he alighted on the fact that often for such issues it is not a matter of a need for new legislation, but a matter of people recognising that they have a responsibility to care for the animals they own. If a debate enables my hon. Friend to highlight that, I can see the benefit of such a debate taking place. I would direct him towards either the Adjournment debate process or the Backbench Business Committee, where he might find those opportunities.

Commons ChamberAs I said earlier, the cost of 34p per household is reasonable. I think that the public would be astonished if, having reached a clear view about this important decision, the Government neglected to express that view clearly by all means legally available to them. The truth is, I think, that what my hon. Friend yearns for is silence and neutrality on the Government’s part, but that is not what he is going to get.
I take my hat off to my right hon. Friend for keeping a straight face while saying that this was a factual document. If that is the case, there must have been a few pages missing from my copy, because I did not see any facts in it. If my right hon. Friend is so keen for the facts to be communicated to the British public, will he tell us what the trade deficit between the United Kingdom and the European Union was last year, and what our net contribution to the EU budget is each year? For some reason, those facts seem to be missing from my copy of the document. I am sure that my right hon. Friend would like to put the record straight and apologise for the omission.
I think that when the Treasury analysis is published, my hon. Friend will find that it contains a full account of the net contribution in the way that he would expect. As he will know, the calculation of the net contribution is published every year by Her Majesty’s Treasury and the Office for Budget Responsibility.

Commons ChamberFirst, the letter was not ignored, and we certainly took account of the views of the devolved Administrations even though we decided in the end to disagree with their recommendation. I want to come to that point at a later stage in my remarks.
The date is just one element of the order, but clearly the most important, because the remaining elements largely flow from it. I will therefore explain the Government’s thinking on the date and then turn to the rest of the order. There must be enough time for a full, serious and considered debate that allows all the issues to have a full airing, and the campaigners must have enough time to put their case to the British people. On the other hand, although this may grieve some hon. Members, the campaign cannot continue indefinitely. The vote should be timely, while the issues are live and the details fresh—and we should also be wary of testing the public’s patience. Several prominent campaign groups are already active on both sides. Following the Prime Minister’s announcement on the outcome of the renegotiation, the debate on the referendum question will now begin in earnest and is already starting to gather real momentum.
The Government selected 23 June because we needed enough time for a proper airing of the issues, and we thought that any sooner would risk curtailing that debate, but to go any later would test the patience of the British people. School holidays in Scotland begin on 24 June, and from then people will be travelling and enjoying their summer. Later than 23 June would mean, in essence, waiting until after the summer holiday period had concluded in all parts of the United Kingdom and in Gibraltar. Frankly, I think that the British people would have found it very difficult to understand if we had asked them to wait seven or eight months after the conclusion of the renegotiation before they could have their say.
I have previously raised with my right hon. Friend the fact that a European Council meeting is also scheduled to take place on 23 June. What can we do to ensure that, if the leave campaign looks to be gaining momentum at a late stage, that will not be used to pretend that there are things on the meeting’s agenda to try to change people’s opinions, or that things will not be leaked in advance of that meeting to try to give people the impression that the Government have agreed a better deal than is actually the case?

Commons ChamberI set out the position on that in my statement and my subsequent answers a week ago. It is important that we secure a package of changes that will be seen by all as irreversible and as legally binding.
The Government used to complain about Tony Blair giving the UK’s rebate back to the European Union, so why did the Prime Minister not ask for a reduction in our EU membership fee in his letter? Are the Government now happy that we gave up our rebate, or has the Prime Minister asked only for the things that he has already had agreed by the European Union, so that he can tell us that his negotiations have been a success—on the basis that if you ask for nothing and get nothing, it looks like a success?
My hon. Friend would do well to do as he has done before, and to applaud the Prime Minister’s success in getting the first-ever reduction in the EU’s multi-annual budget. I can assure my hon. Friend that the negotiations will be tough and, at times, difficult, but I am confident that they will end with a better set of relationships between this country and the EU.

Commons ChamberI am saying that the European Union is a constant process of negotiation on a whole range of issues involving Ministers and officials from many different Departments. In the course of that work to champion our national interests, Ministers and their officials have to produce materials that I believe could be classed, under section 125, as published material and material the content of which would deal with an issue raised by the referendum question. As well as covering a wide range of content, the 2000 Act gives a very broad definition of the term “publish”. It defines it as making it
“available to the public at large, or any section of the public, in whatever form and by whatever means”.
That would therefore cover printed material and electronic communications.
Yes, I will, but I am conscious that other Members want to speak.
May I give the Minister an example of what I fear? What I envisage is if, two weeks before the date of the referendum, the leave campaign is 10 points ahead in the poll—I hope it will be further ahead, but for argument’s sake let us just say it will be 10 points ahead—I am not sure that the Minister’s amendment will deal with the prospect of the Government, the European Commission and the German Chancellor all in a mad panic, like the clumsy intervention in the Scottish vow, standing up and saying, “We hear what you are saying and if you vote to stay in we promise to address some of these issues.” Will the Minister give a commitment now that the Government will not engage in that kind of activity?
What my hon. Friend describes would not be permitted under the amendment.
Let me give some examples of the types of business I believe would be caught under section 125. We often table minute statements during Council meetings, for example to set out the UK position on the limits of powers conferred on the EU under the treaty. They are an important point of reference to have on the record, and we make them public and publish them. We circulate papers to other Governments and to the institutions to advocate particular policy outcomes. We did that with some success recently in relation to the digital single market. If appropriate, we would want to do that with other EU business if it happened to fall within the final 28 days of the campaign.

Commons ChamberT5. The Minister reaffirmed earlier that the Government are in favour of Turkey joining the EU. Have they estimated the additional financial cost to the UK of Turkey joining the EU, and the additional immigration to the UK resulting from Turkey joining the EU, beyond any transitional arrangements; or do they support Turkey’s membership of the EU at any long-term cost to the UK?
The answer to my hon. Friend’s last point is no, we support Turkish accession to the EU because we believe that would be in the interests of the United Kingdom. We have made it clear that the arrangements for transitional controls on freedom of movement would have to be radically reformed before we could agree to new countries becoming full EU members. The question about cost would have to be settled in negotiations. Of course, it would depend very much on the prosperity not only of Turkey but of existing EU member states at the time when Turkish accession seemed likely to be on the cards.

Commons ChamberThat brings me to my second point, which is that if British Ministers were to open that kind of conversation with our partners, their immediate response would be to say that such is already provided for in the European Union’s budgetary set-up. Even if the number of Commissioners increases to 28 or beyond, that cannot result in any increase in the ceiling set by the multi-annual financial framework, which my right hon. Friend the Prime Minister negotiated last week at the European Council; nor can an increase in the number of Commissioners lead to an increase in annual spending limits. To paraphrase what I think my hon. Friend said in moving his amendment, if there has to be additional expenditure to provide for a new Commissioner and his or her team, it would need to be found from elsewhere in the European Union budget, subject to the ceilings set unanimously by the European Council in respect of the multi-annual framework and, subsequently, each annual budget negotiated and agreed by qualified majority vote on a 12-monthly basis, so there is a measure of safeguards already.
Let me also make this point to my hon. Friend. I am the first to agree that when we look for efficiencies and economies, we should not be shy about looking for savings in small matters as well as large. However, we also need to be clear about what an extra Commissioner would entail. It is true that it would mean providing somewhere in the budget for a salary for that Commissioner and their immediate cabinet. That money would have to be found, within the ceilings, by sacrificing spending opportunities elsewhere, but the process would not mean the creation of entirely new directorates-general. Indeed, I can tell the House that the discussions already under way about provision for a probable new Croatian Commissioner involve the splitting up of existing directorates-general and parcelling them in a slightly different way, not adding to the overall number of new people working for the Commission. We are talking about a redistribution of responsibilities among a larger number of Commissioners.
I am enjoying my right hon. Friend’s gymnastics in trying to resist the amendment moved by my hon. Friend the Member for Christchurch (Mr Chope). Am I right in thinking that my right hon. Friend is saying that we should not worry because the overall EU budget is capped and, therefore, that if the EU wastes more money on a European Commissioner, that will just mean it has less to waste on something else? Is that really the thrust of his argument?
What I am saying to my hon. Friend the Member for Christchurch is that the objective that is explicitly sought in the amendment—to ensure that the budget does not increase as a consequence of the appointment of additional Commissioners—is a principle that is already embodied in the European Union’s budgetary arrangements, both multi-annual and annual.
My third point is about what is perhaps the most important area. It should remain a key priority for the Government of the United Kingdom—and, I should add, for a fair number of other national Governments around the European Union—to look for ways to make the European Union more efficient in everything it does and to look for every opportunity to eliminate wasteful or unnecessary expenditure. There are a number of ways that that could be done.
The hon. Member for Wolverhampton North East (Emma Reynolds) talked about a possible reconfiguration of the Commission along a senior Minister/junior Minister model. That is not something to which the UK Government are committed at the moment, but it is certainly one idea that is being discussed in think-tanks and elsewhere as a means of trying to impose not just greater efficiency, but greater coherence on the operations of the Commission. If we look at the Commission today, to provide one illustration, we have a Commissioner for External Relations, who is the High Representative on foreign policy, and we have separate Commissioners for international development, for disaster relief and for European Union enlargement. One conceivable model would be to see those four portfolios given to a Commissioner who was head of department and to subordinate Commissioners reporting to that more senior post holder. That is one way of seeking greater efficiency, but there are many others, too.

That this House takes note of European Document Nos. 8029/10 and 11507/10, draft Council Decisions establishing the organisation and functioning of the European External Action Service; European Document No. 8134/10, draft Regulation on the Financial Regulations for the European External Action Service; and an unnumbered draft Regulation amending Staff Regulations of officials of the European Communities and the conditions of employment of other servants of those Communities; and supports the Government’s policy to agree to the Decision establishing the External Action Service at the Foreign Affairs Council in July 2010.
It was the European Scrutiny Committee which, during the last Parliament, called for a debate on the measures to establish the European External Action Service. I am pleased to have the opportunity to update the House on recent developments, and to give Members on both sides of the House a chance to debate this important issue.
The EEAS was established by the Lisbon treaty, which came into effect last year. As the House will know, my party did not support either the treaty or the creation of the EEAS, but, as my right hon. Friend the Foreign Secretary told the House in June this year, the EEAS is now a fact. The challenge for the Government has been, and remains, to help to shape the service so that it both respects the competence of member states over foreign policy, and at the same time provides for a more cohesive and effective diplomatic voice for the European Union collectively on issues on which the EU, speaking as a whole in support of an agreed common position, carries more clout than member states acting on their own.
What will happen on the many occasions when the United Kingdom is on a completely different page from the European Union, which seems to be the case more and more frequently? Will the EEAS be making proposals with which this country vehemently disagrees?
If the High Representative, Lady Ashton, and the EEAS are to represent a common EU position on an aspect of foreign policy, they can do so only on the basis of a foreign policy mandate that has been approved unanimously by all 27 member states. We have the safeguard that if the United Kingdom wishes to exercise a right of veto and prevent a common position from being reached on a particular aspect of foreign policy, that power remains with us.
I do not wish to delay the Minister unduly, but I do not understand for the life of me why he has so little faith in British ambassadors’ ability to represent this country’s opinions, given that presumably the diplomatic services of other countries are perfectly capable of representing those countries’ views.
My hon. Friend misunderstands me if he thinks I have any lack of confidence in the capabilities of our network of ambassadors and high commissioners around the world, but it is the Government’s judgment that there are areas where it makes sense for the 27 member states of the European Union to speak with one voice if they can. Later in my speech I will give some examples of where I believe United Kingdom national interests have been well served by such a common approach.
